The introduction of algorithms has for companies led to new ways of marketing themselves. However, access to personal data is needed for a company to successfully use an algorithm, which means companies can trade with our personal data. Personal data is therefore no longer used solely for nonprofit purposes but has rather acquired a financial value. This has led to new challenges in terms of third country transfer of personal data, which requires legislation that can effectively protect personal data. Within the EU, the General Data Protection Legislation (GDPR) regulates how personal data can be transferred to a third country. Article 45 GDPR, which contains the first requirement for third country transfers, states that transfers are only permitted based on an adequacy decision issued by the Commission. On the basis, inter alia, of the annulment of the Safe Harbor decision, by the European Court of Justice, and the criticism that has been addressed towards the Privacy Shield decision, questions are raised if there are reason for companies to make third country transfers based on the alternative provisions in article 46 and article 49 GDPR. The aim of this thesis is to examine the possibilities of making third country transfers according to articles 45, 46 and 49 GDPR by making a comparison that has been made from an individual- and company perspective. The research questions have been focused on the content of the adequacy decisions concerning USA, Switzerland, Canada, Israel and Japan, a review of the legal basis for third country transfers stated in articles 46 and 49 GDPR, as well as benefits and drawbacks with applying the grounds set forth in articles 46 and 49 GDPR rather than applying an adequacy decision pursuant to article 45 GDPR. In conclusion, it may be noted that the adequacy decisions that have been discussed leave room for doubt in relation to the level of protection that is guaranteed in the GDPR. This gives reason for companies to consider application of article 46 and article 49 GDPR. There are several benefits and drawbacks with such considerations including the size of the company and its financial recourses affecting which appropriate safeguard in article 46 GDPR is the most suitable safeguard to use. Furthermore, the derogations in article 49 GDPR may, in theory and in practice, be very difficult to apply instead of article 45 and article 46 GDPR since the derogations focuses on specific situations and must be used restrictively. The findings in this thesis however leads to the conclusion that there are several reasons for companies to consider application of article 46 GDPR instead of article 45 GDPR.

Cette thèse vise à analyser l’émergence de l’individu comme un sujet du droit de l’Union européenne s’affirmant face à l’État membre. Elle défend l’idée selon laquelle le droit de l’Union connaît un processus de « subjectivisation fonctionnelle », de source essentiellement juridictionnelle, qui se manifeste par la reconnaissance des droits, des intérêts et de la situation subjective de l’individu, de façon à placer ce dernier au service de la réalisation du projet d’intégration européenne. Prenant une portée constitutionnelle, ce mouvement s’inscrit dans une double logique de protection et d’instrumentalisation de l’individu par l’Union, dialectique inhérente à l’ordre juridique incomplet que constitue l’Union. / This dissertation aims at describing the emergence of the individuals as subjects of European Union law, asserting themselves against the Member State. It upholds the idea that European Union law undergoes a “functional subjectivation” process, mostly based on case-law, materialized by the recognition of the individuals’ rights, interests and subjective situation, in order to make them agents of the European integration project realization. This movement, taking on a constitutional dimension, is part of both a protective and instrumental approach of the individual by the European Union, dialectic inherent to the European Union incomplete legal order.

Le développement de compétences de l’Union européenne en matière migratoire a pourconséquence de soustraire au seul cadre étatique, la gestion des questions relatives au droitdes étrangers et, de soustraire dans le même temps les citoyens de l’Union de la catégorie del’étranger ordinaire. Dorénavant, l’Etat doit distinguer entre les étrangers possédant lanationalité d’un autre Etat membre (les étrangers européens) et les étrangers possédant lanationalité d’un Etat tiers. Le droit de l’Union conduit ainsi à fragmenter et refaçonner lacatégorie juridique de l’étranger au sein de l’Etat. Cependant, il ne se substitue pas à l’Etatdans la définition de l’étranger et, ne se traduit pas par une unification des règles applicablesdans les Etats membres. Par conséquent, l’étranger est à la fois un sujet du droit de l’Etatmembre et un sujet du droit de l’Union. Cette recherche vise à démontrer que ce postulat dedépart doit être considéré. L’analyse des influences du droit de l’Union sur le processusnational de catégorisation des étrangers conduit à démontrer que d’une part, la définitioneuropéenne de l’étranger tend à s’autonomiser et que d’autre part, le droit de l’Union desétrangers tend à devenir commun voire à se substituer au Etats membres. / As a result of the development of EU competences in the field of immigration, the memberStates have lost their monopoly to enact foreigners Law. As well, the EU citizens are nolonger “ordinary” foreigner. Nowadays, the member States have to make a difference betweenthe foreigners with the nationality of another Member State (European foreigners) andforeigners with third countries (extra- European foreigners). Thus, the EU law tends to bothsplit and reshape the legal category of “foreigner”. As well, EU law does not result in aunification of the relevant rules within the member States. Therefore, the foreigner is a thesame time a subject to the EU law and a subject for the national legislations. This researchintends to prove that this assumption must be reconsidered. The analysis of the EU influenceson the national categorization of the foreigners proves that firtsly, the EU definition offoreigner tends to become more and more autonomous and, on the other hand, the EU Law onforeigners tends to become more and more a common Law to the member States.

The Concept of'European Citizenship': National Experiences and Post-National Expectations?

<p>The aim of this thesis is to interpret and understand the concept of citizenship in general, and the European citizenship in particular, placed within a broad theoretical framework. Furthermore, the purpose is to examine whether the development of a European citizenship indicates an emergence of a new ‘post-national’ model of citizenship, based on residence rather than nationality or place of birth. In order to address this, the status of third- country nationals (TCN’s), who are legally long-term residents within the Union, in relation to EU citizens has been analysed from the theoretical perspectives. </p><p>Different models of citizenship provide the paper with a theoretical framework, through which the empirical data has been examined. The theoretical approaches dealt with in this paper are the liberal, the republican/communitarian and the ‘post-national’ models of citizenship respectively. Fundamental ‘key concepts’ have been derived from these different models of citizenship, which have facilitated the analysis by providing the interpretation of the EU citizenship with an analytical framework. </p><p>To find answers to the initial research questions and fulfil the aim of the paper, a qualitative and hermeneutic study has been carried out, aiming at interpreting and understanding the European citizenship placed within its socio-political context. Text and language constitute the units of analysis and, hence, a textual analysis has been conducted of official EU documents. Following a conceptual history approach, concepts are not just reflections of historical processes, but can themselves contribute to historical change by making new things imaginable. As emphasised throughout the paper, concepts embrace at the same time a ‘space of experience’ and a ‘horizon of expectation’. </p><p>The main conclusions drawn from the research can be summarised in a number of points. First, while the concept of European citizenship was originally connected to a formal and economic view upon citizenship, close to a liberal/neo-liberal notion of citizenship, the texts express an aim of a more active citizenship, emphasised in the republican/communitarian tradition. Secondly, despite a multicultural and post-national rhetoric concerning the status of long-term resident TCN’s, the gaining of ‘full’ EU citizenship can still only be attained through nationality in a Member State. Thirdly, the importance of interpreting a concept placed within its socio-political context has been clear from the study. The semantic analysis has showed a close link between the European citizenship andthe goal to create an ‘area of freedom, security and justice’ throughout the Union. This goal is interpreted as a response to recent occurrences in the world, but at the same time it expresses expectations about the EU citizenship, and it can thus itself affect future developments in this field. </p><p>To sum up, while the concept of European citizenship is post-national to the extent that it applies to all EU citizens irrespective of where in the Union they live, it is still not completely based on the principle of residence. Only nationals of an EU Member State can obtain citizenship of the Union. Thus, the concept of European citizenship, while establishing a citizenship across national borders, is still based on nationality.</p>

Out of sight, out of mind : hinder för att ersätta rätten att söka asyl med enbart ett EU-gemensamt kvotflyktingsystem / Out of sight, out of mind : limitations to replacing the right to seek asylum with only a common EU resettlement system

I kölvattnet av den så kallade flyktingkrisen 2015 har allt fler röster höjts i Europa om att förändra asylrätten för skapa ett mer förutsebart och hållbart asylmottagande. Diskursen synliggör asylrättens centrala rättighetskonflikt där det allmännas intresse av reglerad invandring vägs mot den enskildes rätt till asyl. Denna uppsats utreder möjligheterna att ersätta EU:s nuvarande asylsystem med ett EU-gemensamt kvotflyktingsystem. Utgångspunkten för uppsatsen är ett förslag som Moderaterna under oktober 2017 antog i sitt partiprogram vars innebörd är att EU ska övergå till ett gemensamt asylsystem med enbart kvotflyktingmottagande. Frågeställningen är vilka hinder som föreligger för en sådan förändring med hänsyn till gällande rätt och ändamålen bakom asylrätten. Moderaterna föreslår alltså en ordning som skulle inskränka rätten att söka asyl. Rättighetsinskränkningar ska vara proportionerliga. Uppsatsen besvarar därför huvudfrågeställningen utifrån fyra delfrågor som påminner om en proportionalitetsbedömning för att avgöra om förslaget är möjligt eller lämpligt. Först diskuteras om dagens asylsystem behöver förändras med hänsyn till den så kallade flyktingkrisen 2015, sedan utreds andra brister i dagens system. Slutsatsen nås att det finns brister med dagens system som motiverar en förändring som exempelvis de höga dödstalen för migranter som reser över Medelhavet för att söka asyl i EU. Därefter undersöks vilka möjligheter en förändring till enbart ett EU-gemensamt kvotflyktingsystem skulle kunna medföra och det konstateras att förslagets största fördel är att vidarebosättning utgör en laglig och säker väg för asylsökande till EU. Kärnan i uppsatsen är utredningen av de praktiska och juridiska hinder som finns för en förändring till enbart ett EU-gemensamt kvotflyktingsystem. Där finner jag att det största hindret är svårigheten att organisera systemet på ett sätt som är förenligt med principen om non-refoulement enligt såväl folkrätten som Europakonventionen. Jag identifierar även andra allvarliga praktiska och juridiska hinder för en sådan ordning. Slutligen undersöks om det finns alternativa lösningar att tillgå som är mindre ingripande än förslaget om enbart ett EU-gemensamt kvotflyktingsystem. Jag finner att så är fallet. Till exempel kan medlemsstaterna öka sitt kvotflyktingmottagande, införa humanitära visum eller inrätta en EU-centraliserad asylprövning. Min slutsats är att rätten att söka asyl på plats i EU måste kvarstå och att de mindre ingripande lösningarna som tas upp i uppsatsen är att föredra framför ett asylsystem i EU med enbart kvotflyktingmottagande.

Cette étude a pour objet principal de présenter une analyse juridique de la libre circulation des ressortissants de pays tiers dans l'UE. La migration et la mobilité des personnes en provenance des pays tiers constituent des thèmes clés pour l’avenir d'un continent européen de plus en plus vieillissant. La présence de ressortissants de pays tiers sur le territoire européen permet d’analyser la relation potentielle des perspectives juridiques de la libre circulation avec les intérêts du marché intérieur. Cette première hypothèse repose en grande partie sur les récentes avancées législatives concernant la mobilité au sein de l'Union. Il est important de préciser que les ressortissants de pays tiers qui voyagent dans l'UE pour des raisons économiques doivent être « mobiles ». Cela suppose « en théorie », selon les dispositions juridiques les plus favorables à la libre circulation, que le législateur européen vise à attirer certains profils de travailleurs sur le territoire de l’UE. Ensuite, cette étude vise à examiner et à souligner l'importance d'assurer la sécurité intérieure au sein de l’UE par rapport à la mobilité des personnes provenant de pays tiers. À cet égard, et en particulier aujourd'hui, tout ressortissant d'un pays tiers qui décide de se déplacer sur le territoire de l'UE, quelle qu’en soit la raison, ne doit pas constituer une menace pour la sécurité intérieure de l'UE. / The main purpose of the doctoral thesis is to provide a legal analysis of the free movement of third-country nationals within the European Union (EU). Migration and mobility of third country nationals represent key topics for the future in Europe. The international migrant population in EU in expected to increase, due to ageing population, impending demographic crisis, global competitiveness and growth, among others. Regarding the presence of third country nationals within European territory, this thesis offers the study of the potential link between provisions on free movement under EU law and the internal market interests. This hypothesis rests to a large extent on the recent legislative developments concerning the mobility of third country nationals within the Union, mainly for persons who travel to the EU for economic reasons. Therefore, «in theory», it is through the most favorable legal provisions on free movement, how the European legislator seeks to attract certain profiles of «mobile workers» from third countries into EU territory. Furthermore, the present thesis tries to examine and underline the importance of guaranteeing the EU internal security with regard to the mobility of third countries nationals. In this respect, and especially these days, any third country national who decides to move into EU territory, for whatever reason, cannot constitute a serious threat to EU public policy or internal security. / La tesis doctoral tiene por objeto principal ofrecer el análisis jurídico de la libre circulación de los nacionales de terceros países en la Unión Europea (UE). La migración y la movilidad de las personas procedentes de terceros países se presentan como temas claves para el futuro de un continente europeo cada vez más envejecido. En relación a la presencia de los nacionales de terceros países en el territorio europeo, por una parte, se analiza en la presente tesis, la potencial relación entre las previsiones jurídicas de la libre circulación con los intereses del mercado interior. Esta primera hipótesis descansa en gran parte, en los recientes avances legislativos relativos a la movilidad dentro de la Unión de los nacionales de terceros países que se desplazan a la UE, sobre todo, por motivos económicos. Por ello, «en teoría», es a través de las previsiones jurídicas más favorables de la libre circulación, como el legislador europeo pretende atraer determinados perfiles de trabajadores «móviles» al territorio europeo. Asimismo, por otra parte, el presente estudio trata de examinar y subrayar la importancia que tiene la garantía de la seguridad interior de la UE en materia de la movilidad de las personas procedentes de terceros países. This master thesis deals with the issue of development of the EU immigration policy and expansion of the rights of third-country nationals who have been legally residing in the territory of the Union throughout this development. The aim of this thesis is to outline the crucial milestones in the form of primary and secondary legislation that led to the broadening of the scope of rights of third-country nationals in the Union, while examining their legal status in the Union in general and in the Member States in particular. The first part of this master thesis introduces the historical background, outlines the development in context of the European Union and provides the categorisation of legal third-country nationals residing in the territory of the EU, whereas the second part of the thesis deals with transposition of European legislation into national legislation of the selected Member States - Germany and the Czech Republic - while drawing a line of compliance and emphasising local requirements that were introduced in addition to (but not exceeding the scope of limitation provided by) EU legislation. <p>This paper studies the structural issues concerning possible human rights violations found in the Dublin Regulation; An EU regulation aiming to allocate a responsible member state to a third-country-nationals asylum application. It is one of the criticized legal documents within the scholarly field of human rights. Hence, this study aims to study the details of the regulation to find out the elements of the regulation that are prone to human rights violations. Asking the question: What are some details of the Dublin Regulation that could potentially result in human rights violation of the third-country nationals seeking international protection within the territory of member states? Hence, exploring the gap found between the regulation and human rights of the asylum seekers. This was done by a normative legal analysis study of the law, studying the text of the regulation, relevant human rights law, and jurisprudence from two courts of law: ECHR and ECJ. The findings of the study highlights, first, the regulation upholds only the superficial elements of human rights law. Second, the regulation assumes that every member state is a safe country. Third, there is an imbalance of responsibility on either of the two or more member states involved. These are the details of the regulation highlighted in this study that is potentially the result of possible human rights violations and the criticism of the topic. </p>

The goal of this diploma thesis is to define, analyze and evaluate the most relevant areas related to the topic of European migration law and politics. Although the subject is quite broad, I try to focus on legal migration. Free movement of EU citizens could not be left out, however I concentrate mainly on position of migrating three country nationals within the EU. I compare the Czech legal system against the European legal system. The thesis has been divided into four chapters, which are further subdivided. In the first chapter the thesis brings a brief definition of the concept of migration in general, including a chronological historical excursion of the European norms connected to the migration law and a description of migration law, politics and the necessity of a suitable integration approach. The second chapter is devoted to create a characterization of the European migration legislation, competences in the field and a definition of fundamental human rights standards. This section also deals with theoretical and practical issues of European citizenship and the associated right of free movement.
