11	Age-related differences in deceit detection: The role of emotion recognition Tehan, Jennifer R. 17 April 2006 (has links) This study investigated whether age differences in deceit detection are related to impairments in emotion recognition. Key cues to deceit are facial expressions of emotion (Frank and Ekman, 1997). The aging literature has shown an age-related decline in decoding emotions (e.g., Malatesta, Izard, Culver, and Nicolich, 1987). In the present study, 354 participants were presented with 20 interviews and asked to decide whether each man was lying or telling the truth. Ten interviews involved a crime and ten a social opinion. Each participant was in one of three presentation conditions: 1) visual only, 2) audio only, or 3) audio-visual. For crime interviews, age-related impairments in emotion recognition hindered older adults in the visual only condition. In the opinion topic interviews, older adults exhibited a truth bias which rendered them worse at detecting deceit than young adults. Cognitive and dispositional variables did not help to explain the age differences in the ability to detect deceit. С. January 2014 (has links) Master’s thesis is devoted to the complex description of the semantic-motivational field “Deceit” mainly on the material of Russian dialect lexis and phraseology. The work belongs to ethnolinguistics, that involves the reconstruction of a fragment of the Russian linguistic world picture, reflecting beliefs about deceit. The main methods by which the research is conducted are semantic, motivational and etymological analysis. In particular, the thesis includes defining the semantic components related to the concept of deceit (i.e. answering the questions “What do speakers mean by deceit?” and “What actions are represented in the language as deceptive?”), the field’s division on the semantic sectors, revealing links between the concept of deceit and other semantic areas (intelligence, speech, relations to work, etc.), founding narrow and cross-cutting motives of nominations, as well as basic nominative models used by the field; in addition, the etymological solutions are proposed for the number of motivationally “dark” items. / Магистерская диссертация посвящена комплексному описанию семантико-мотивационного поля «Обман» преимущественно на материале лексики и фразеологии русских народных говоров. Работа выполнена в русле этнолингвистики, что подразумевает реконструкцию фрагмента русской языковой картины мира, отражающего представления об обмане. Основные методы, с помощью которых проводится исследование – семантический, мотивационный и этимологический анализ. В частности, в рамках диссертации были определены смысловые компоненты, относящиеся к понятию обмана (то есть даны ответы на вопросы «Что носители языка понимают под обманом?» и «Какие действия “изображаются” в языке как обманные?»), произведено членение поля на семантические секторы, выявлены связи между сферой обмана и другими смысловыми сферами (интеллекта, речевых действий, отношений к труду и проч.), обнаружены частные и сквозные мотивы номинации, характерные для поля, а также основные номинативные модели, им используемые; кроме того, были предложены этимологические решения для ряда «темных» в мотивационном отношении лексем. 13	La pénalisation des atteintes au consentement dans le champ contractuel / Penalisation of infrigements of consent in the contractual field Raschel, Evan 03 December 2013 (has links) La pénalisation est depuis longtemps la réponse privilégiée à la singulière augmentation des tromperies, abus de faiblesse, violences ou encore refus du consentement d'autrui à un contrat. Si son ampleur impressionne, cette pénalisation connaît certains travers. Les incriminations sont mal rédigées et leur construction se révèle rapidement incohérente. Mais par dessus-tout, le droit pénal paraît dans bien des cas dévoyé. Même lorsqu'elle n'est utilisée qu'à titre d'auxiliaire de disciplines ou réglementations externes, la sanction pénale répond à certaines finalités propres, au regard desquelles elle doit apparaître nécessaire et proportionnée. Ce dévoiement doit se résoudre par une certaine dépénalisation des atteintes au consentement contractuel. Pour que celle-ci n'entraîne pas une baisse de la protection des contractants, il convient de rechercher des substituts crédibles à la sanction pénale, par conséquent efficaces et adaptés au contentieux des atteintes au consentement contractuel. Il importe également que ces substituts offrent des mesures originales, sous peine de n'opérer qu'une dépénalisation purement symbolique. Cela doit conduire à écarter les sanctions administratives, au profit de la voie civile. Cette dernière doit toutefois être renforcée pour pallier les insuffisances que le droit civil présente actuellement dans la prévention et la sanction des atteintes au consentement contractuel. / Priority has long been given to criminalisation in response to the important increase in the commission of fraud, fraudulent abuse of vulnerable persons, duress, or other refusals of consent in the contractual field. Whilst the scope of this criminalisation is impressive, it also raises questions. The offences are poorly circumscribed, and their constructions turn out to be incoherent. Above all, criminal law appears in many cases diverted from its proper function. Even when criminal law is used as an auxiliary enforcement to other disciplines or external regulations, the resort to the criminal penalty follows its own ends according to which it should appear necessary and proportionate. This diversion must be resolved through a decriminalisation of refusals of consent in the contractual field. In order to avoid diminishing the protection of contractors, it is necessary to search for credible substitutes to criminal penalties, which are both effective and adapted to litigation involving the infringement of contractual consent. In order to amount to more than purely symbolic decriminalisation, these substitutes should also consist of innovative measures. Administrative sanctions must be discarded in favour of the civil law route. Civil sanctions must however be reinforced in order to overcome the existing limitations and drawbacks faced by civil law in the prevention and sanctioning of refusals of consent in the contractual field. In The Pickwick Papers the trial is only a part, though an important one, of a series of related adventures in which the main characters of the novel participate. In the three novels there is a trial in which the accused is found guilty, although he is actually innocent. In The Posthumous Papers of the Club Pickwick, the author’s main purpose is to present the operation of the legal system, in which the modus operandi of unscrupulous lawyers, who rely only on cheating and deceiving methods, is atthe beginning of and determines the outcome of the lawsuit. In Billy Budd, an innocent is sentenced to death in order to preserve a supposed higher interest: the common good. In The Bonfire of the Vanities, political factors, personal interests, resentments and other worldly elements determine the outcome of the trial.
