Carlshamre, Nathan January 2024 (has links)
In this essay I attempt to show that both the weak interpretation and the strong interpretation of what John Searle calls the principle of self–referentiality for social phenomena should be abandoned. This, I argue, is because they give rise to what I, following Burman (2023), call ”location problems” for opaque social phenomena and for social wholes, as well as a faulty understanding of social power. Instead, I propose that we understand social phenomena as constitued by social practices, in turn constituted by individuals who have the know–how necessary to participate in the social practices (in the sense that they are reliably able to do so), while not necessarily knowing that they are participating in them. In doing this, I draw on Robert B. Brandom’s notion of a social practice from Making it Explicit (1994).

Deficits in Miranda Comprehension and Reasoning: The Effects of Substance Use and Attention Deficits.

Hazelwood, Lisa L. 08 1900 (has links)
Each year, an estimated 318,000 defendants who do not comprehend the Miranda warnings waive their rights and provide incriminating evidence without the protection of counsel (Rogers, 2008), which make Miranda-related competencies one of the most pervasive pretrial issues. A wide range of issues could potentially affect an individual's capacity to provide a knowing and intelligent waiver. Previous Miranda research has focused narrowly on the effects of cognitive and developmental factors. The current study added to the Miranda literature by examining the impact of two highly prevalent conditions found in correctional populations, attention deficits and substance abuse. Adult defendants in custody (N = 118) were evaluated within 36 hours of arrest in order to assess both chronic psychological disorders and situational variables. Results indicate that attention deficits have a significant impact on defendants' ability to provide a knowing Miranda waiver, whereas substance use profoundly affected their reasoning about Miranda waiver decisions. This study represents the first systematic investigation of the effect of transient mental states on Miranda-related abilities with criminal defendants. Important implications for forensic practice are addressed.

Guilmaine, Anne-Marie 12 1900 (has links)
This master’s thesis proposes to establish a dialogue between the practices of two contemporary writers and artists, Sophie Calle and Miranda July. The four studied pieces of work – Calle’s Douleur exquise (2003), Aveugles (2011) and Rachel, Monique (2012) and July’s Il vous choisit (2013) – are based on concrete experiences occurring beforehand, prior to the act of writing itself. Those experiences mobilize the body of the writers engaging them in a real action and often in interactions with other people. This form of action art becomes the foundations of their writing and could be linked to the theories of pragmatic philosopher John Dewey and artist Allan Kaprow – one of the first to develop a reflexion on performance art. The intermedial writing that Calle and July practice as a game of relations between different medias in the same work allows both artists to revive the performative value of the experience. It impulses the writing and initiates a reading experience which itself becomes performative. Exemplary of a relational aesthetic, polyphonic in the voices that are expressed, the studied body of work reveals glimpses of community to feel and experiment. It is a literature that is interdisciplinary and intersubjective but primarily performative in its constant questioning of art’s capacity to transform life.

The period between 1945 and 1971 corresponds to the time of publications of those collections. The author was also the publisher of two of the collections: Curso de Psicologia e Pedagogia and Curso de Filosofia e Ciências. He also published some volumes in the collections Atualidades Pedagógicas and Iniciação Científica directed initially by Fernando de Azevedo up to 1946 and later, by Damasco Penna. Inserted in the perspective of Cultural History, the research intends to operate with the study of the collections in its materiality in view of the strategies of the production, circulation, appropriation and imposition of the catholic model as an educational political project. The production and the edition of the collections were inserted in a context of disputes for the domain of the educational field, especially between pioneers and catholics. From the edition, production and circulation of these materials, in which the plot and disputes for the conquest of the educative place are perceived, it is also possible to understand how the knowledge propagated in the collections has constructed and prescribed pedagogical practices based on the catholic pedagogical model. From this problematic, the work searches to understand, through the material analysis of the collections, which had been the publishing and catholics strategies to conquer the market in a process of modulation of a pedagogy that brought in its volumes prescriptions of knowledge toward the formation of the professor. The collections had been part of a major project of the catholics for intervening in the culture, shaping the knowledge in the catholic perspective / A investigação desse trabalho voltou-se para as coleções Curso de Psicologia e Pedagogia, Curso de Filosofia e Ciências e os volumes publicados nas coleções Atualidades Pedagógicas e Iniciação Científica de autoria do professor Theobaldo Miranda Santos.

Boff, Leonir Amantino January 2002 (has links)
The aim of this research is to analyze the politics of youth and adults education implemented in the State of Mato Grosso during the period of 1991/2001, in the context of the program Education for Everybody Decade, its internallity, relations, dialogues produced by the youth and adult world in three schools. Although the State has developed temporary projects of layman teachers qualification, high school, and a project of literacy for youth and adults, the politics of Education for Youth and Adults, of during this period characterizes basically a supllementary adult education, offered by schools called supplementary. The starting point, analyzes the project of youth and adults education implmented in the State, from the experience developed in the performance of the same project onwards in the city of Nova Xavantina -Mato Grosso, and within the projects of layman teachers qualification, analyzing the project GenerAction. Nevertheless, it intensifies the investigation in the supplementary schools, seen as the world life circle, searching understanding for the produced process and the sense given by youth and adults to his experience developed in the referred schools. For that reason, interviews were made with teachers, principlas and a questionaire was applyed to the students form the three researched schools. The theoretical references are based on Paulo Freire's thought, in part with the Theory of Communicative Action of Jurgen Habermas, Anthony Gidens, Gaudêncio Frigotto, and others. The analyses done show that although the State of Mato Grosso developed an Education of Youth and Adult politics based on the supplementary adult education model, and very distant from the purpose of Education for Everybody Decade, the schools have developed breaking and overpassing experiences in relation to the implemented model, that is based on dialogs and negotiation. I propose that, starting with forums of dialogues and experience exchange, involving the different actors of the civil society and state, to built, and intensify a movement of public politics defense to youth and Adults Education that is more serious and coherent, according to the demands of our time.
