détermination du contenu et sur l'identification de la source de chacun des pouvoirs
traités. Par ailleurs, dans la deuxième partie, l'identification des limites desdits pouvoirs
nous permettra de préciser la notion de compétence arbitrale.
L'étude nous permettra de conclure que, sauf exception, telle que le recours à la force, les
pouvoirs d'un juge étatique sont les mêmes que ceux qu'un tribunal arbitral peut
posséder. En fait, ce dernier, grâce à la volonté des parties, pourrait en avoir plus que le
premier. Toutefois, le caractère hybride de l'arbitrage nous amènera à affirmer que, sauf

de celles du tribunal arbitral. / The objective of this study is to define and specify the scope as well as the content of the
concept of arbitral tribunal jurisdiction in commercial arbitration.
An analogy between the status of national judge and of arbitrator enables us to expand the
application of certain concepts specifie to national justice, such as "jurisdiction", "authority" and "powers", to commercial arbitration. Thus, in the first part, by identifying
the principal powers an arbitral tribunal has or could have, we specify the concept of
arbitral authority. The study focuses on determining the content and identifying the
source of each of the powers treated. Moreover, in the second part, identifying the limits
of said powers enables us to specify the concept of arbitral jurisdiction.
The study allows us to conclude that, with a few exceptions such as physical imposition,
the powers of a national judge are the same as those of an arbitral tribunal. In fact, the
latter, owing to the intention of the parties, may have more than the former. However, the
hybrid character of arbitration leads us to assert that, with a few exceptions such as
natural justice, the limits of the national judge's powers differ from those of the arbitral
tribunal.

This thesis studies teachers’ and students’ conceptions of history and history teaching and aims to explain the importance of an interest in history among teachers and students of the subject. Research on teachers’ conceptions (e.g. Martin 2005) shows that the didactical question “Why?” influences the “How?” and “Why?” questions and that teachers’ thinking about their own practice is mainly influenced by their background and their experiences from teaching. Research on students’ opinions (e.g. Youth and History, 1997) shows that they enjoy history shown in films, that they appreciate museums, and that the preferred topic is 20th century history. In this thesis learning is envisaged as something individual but it is the learners’ social context that defines what is important, meaningful and interesting to learn. The research methods consist of a survey study concerning the pupils’ attitudes towards history and history education, and an interview study with their teachers about their teaching and their opinions about history in general. Nine teachers and their 217 pupils participated. It is mainly topics from 20th century that are described as interesting by both students and teachers. The teachers had different views on the didactical whyquestion, which they described either as student oriented or subject oriented. Their views on why history is important influenced their teaching methods. The student oriented teachers stated that their pupils’ needs and wishes affect their methods while the subject oriented teachers said that they give varying lessons, and have a more student active teaching, but decide for themselves what teaching methods are to be used. The subject matter is influenced by the teachers’ personal interest in history, in most cases a Eurocentric political history. This choice of content, and the teachers own interest, are explained by the historical culture of Swedish society rather than the curriculum. The teachers state that exciting stories and dramatic events related in books or films were, and still are, important to their interest in history. Their individual interpretation of what is important and meaningful in their historical culture influences teachers’ personal interest, their knowledge, and the content of their history teaching. The students’ attitudes to history are also influenced by various factors, of which history education at school is merely one.

自美國聯邦巡迴上訴法院於一九九八年State Street Bank一案,肯認商業方法軟體得為法定之專利標的後,全球之金融業、電腦業與網路公司莫不尋求以專利作為保護其商業方法之武器,商業方法專利申請之案件遂絡繹而來。惟商業方法軟體是否得為專利之標的,至今美國學界仍有爭議而見解不一,日本專利局係採與美國專利局相同之立場,然歐洲專利局目前似仍採否定見解。對此一議題,我國已有相當文獻討論,並均採肯定之見解。惟並未對何以可專利性之理由詳予闡述,至於專利侵害之問題,亦未就我國法深入分析。
本文擬自比較法之觀點,分析美國實務運作及學界之論述、歐洲發明專利公約及專利局實務之見解、日本法之規定與特許廳之意見,汲取其中之經驗與見解以為借鏡。第二章首先就商業方法軟體加以定義,並探究現今商業方法軟體之架構及其特殊性,以作為專利標的適格性分析之基礎。第三章分析商業方法軟體之施以專利保護,對產業與實務造成之影響。包括實務所面臨的困難﹙如先前技術資料庫之建立、審查人員之訓練、法院面臨之困難等﹚,及我國軟體產業應如何調適。第四章係探討商業方法軟體之專利標的適格性分析,依次分析美國法之規定與學說實務之見解、歐洲專利公約與專利局之立場、日本特許法之規定與特許廳之態度,以及國內學說實務之見解,並由我國專利法之立法意旨與商業方法軟體架構之特殊性,論述商業方法軟體在現今軟體發展之架構下,應非發明專利保護之標的,另亦就我國智慧財產局所公布之「電腦軟體相關發明專利審查基準」,加以探討並提出個人淺見,並摘錄智慧財產局已核准若干商業方法軟體專利之個案,加以分析。第五章自發明專利保護要件之觀點,探究商業方法軟體專利保護之問題。第六章則自美國法之觀點,分析商業方法軟體於網際網路上,所發生之跨國界專利侵害問題,並試從國際私法之角度,處理此類問題。最後,於第七章提出個人對商業方法軟體專利之淺見,並就我國現行專利制度提出未來保護方向之建議,以為結論。

Basotho oral poetry at the beginning of the 21st centuryTsiu, M. W. (Moruti William), 1944- 31 October 2008 (has links)
Largely based on material recorded during an internationally sponsored inter-university research tour through the Sesotho speaking area of southern Africa in August 2000, this thesis explores the state of the Basotho oral poetry, the dithoko `praise poems', the difela `mine workers' chants' and the diboko `family odes' at the beginning of the 21st century.
Unlike the classical dithoko which were inspired by the wars or the battles in which the Basotho fought as well as cannibalism, those composed at the beginning of the 21st century are inspired by socio-economic and political situations of the poets. Lack of wars has resulted in the poets turning the praising to their chiefs and themselves. Changing socio-economic conditions inspired the difela compositions. The diboko though still a living tradition among the rural Basotho are not adhered to by some who are affected by modernism.
Performance of the three oral genres has shifted from the natural settings such as the battlefield, working parties, traditional courts, assemblies, etc., to organized annual festivals such as Morija Arts & Cultural Festival which constitute the Basotho's `popular culture'. The subject-matter and themes of the dithoko have shifted from warfare to traditional chiefs, current heroic deeds of the poets, current political situations and religion. The difela are characterized by inclusion of new subject-matter. The diboko still play an important function as carriers of the names of the ancestors, the tribal idiosyncrasy of the clan and the history associated with the clan's establishment.
The three Basotho oral genres demonstrate an emergence of a new phenomenon whereby one genre penetrates another, a phenomenon which may be called `migration of texts'. The last chapter explores the insights emanating from the entire research, and discusses suggestions on what should be done to ensure that the Basotho oral genres are maintained and improved. The video footage of the poets recorded at various places of the Free State and Lesotho have contributed to the success of the research. The thesis serves as a contribution to the Basotho's dynamic oral poetry on which scholars will hopefully do further research in the near future. / African Languages / D. Litt et Phil. The thesis is interested in the problem of musical sign. In which ways can we speak about musical sign and which elements of musical material can become signs? These are the basic questions which we are interested in. This thesis is divided into three parts. The first part attends to the common theory of sign. The historical survey with the main ideas of philosophers and thinkers will be helpful to find out basic terms and problems of semiotics. In the second part of thesis we look at the historical reflection of musical sign in order to find out in which way it was treated with music and musical sign in each historical period of European music. In the third part we focus on musical semiotics, but we will consider some problems of musical aesthetics and musical psychology, too. In the end we make recapitulation of answers to the aforesaid questions.

The teaching of writing is a central task for teachers of Swedish and it is a complex activity which requires knowledge of different areas such as language, communication, and text. The aim of this licentiate’s dissertation is to investigate when and how the knowledge needed for the teaching of writing is developed in teacher education as well as during the first years of teaching. The study is based on semi-structured qualitative interviews with prospective and novice upper secondary school teachers of Swedish. The data obtained from the interviews were analyzed in two ways. The first analysis focused on the way in which the prospective and novice teachers talked about text, writing, and the teaching of writing. The result shows that, at the beginning of the teacher education, prospective teachers focus on concrete aspects of text – such as syntax, punctuation and spelling – when they speak about text, writing, writing instruction, and assessment of student writings. In other words, they pay special attention to local text levels. At the end of the teacher education programme, prospective teachers focus on aspects of text structure such as outline, the structure of paragraphs, coherence and cohesion. Certain aspects that the students pay special attention to are mentioned by the novice teachers, but these aspects are not central to them. Instead, novice teachers give special attention to the global text levels such as context, receivers and the purpose of the text, i.e. abstract aspects of text and writing. The pattern discerned shows a development that starts with a focus on the details at a local text level and expands into a more comprehensive view with a focus at a global level. The second analysis concerns the development of the knowledge base for the teaching of writing. This analysis focuses on two of the knowledge categories described by Lee S. Shulman (1986, 1987), namely subject matter knowledge and pedagogical content knowledge (PCK), both of which can be seen as central for the teaching of writing. The knowledge base manifested in the prospective teachers’ utterances mainly consists of subject matter knowledge, whereas the greater part of the knowledge base manifested in the teachers’ utterances consists of pedagogical content knowledge for the teaching of writing. The teachers also manifest a more complex subject matter knowledge and speak about writing instruction in a way which is characterized by conscious choices, reflection and metacognition. The analysis thus shows that the PCK for the teaching of writing is mainly developed in the teaching profession; in other words, after the teacher education programme is finished.

The purpose of the master’s thesis is is to improve the methodological support for public procurement carried out by the budget organization, using functional-cost analysis tools. The work addresses the issue of the fact that the description of the items to be purchased is prepared before the cost analysis of the options for procurement. The sources used were research and methodological literature, macro- and micro-level statistics, accounting and reporting data of organizations, and normative documents. The master’s thesis proposed a methodological approach to the justification of public procurement carried out by a budget organization, based on the application of functional toolsA cost analysis, a study of the economic utility of the functions of the subject matter of procurement and the selection of the optimal level of performance of those functions.

This dissertation deals with how the subject matter of performance under a contract for work is defined and issues related to formulating the rights and obligations ensuing therefrom. At the same time, it seeks common legal sources existing across national laws which provide definitions thereof. It attempts to find a common definition of contracts for work and how they differ from other similar contracts. It further defines some common basic features and problems related to contracts for work which apply in international trade or in cases where parties decide to formulate their contract by reference to international contract conditions. In that context, it primarily refers to construction contracts as the most common type of contract for work in international trade. At the same time, it focuses on the possible consequences of a breach of contract and emphasizes some parties' claims ensuing therefrom. Moreover, this work examines the definition of work defects and conditions for asserting claims as a specific topic, which relates to the definition of the subject matter of a contract for work and its basic features.
