[pt] O objetivo principal da presente dissertação é discutir a
dinâmica dos relacionamentos entre estados, e entre estado
e sociedade, que giram em torno da produção e do acesso ao
conhecimento, entendido como o estado da arte, da ciência e
da tecnologia e as crenças e idéias de cada época a esse
respeito. O exame desses relacionamentos será feito através
do estudo do regime da Propriedade Intelectual, o que torna
necessário discutir as teorias de regimes a fim de entender
sua importância nas relações internacionais. Trata-se,
portanto,de duas discussões interligadas, cada uma em seus
aspectos substantivos, que levam a conclusões tanto a
respeito da importância dos regimes como a respeito da
dinâmica dos relacionamentos que giram em torno da produção
e do acesso ao conhecimento. Minha proposta é discutir os
dois temas centrais desse trabalho através da análise de
como aconteceram as mudanças no regime internacional da
propriedade intelectual e a mudança de regime. As mudanças
serão identificadas a partir dos instrumentos legais que
constituem o regime, dos debates sobre a adoção de agendas
de revisão desses instrumentos legais, e do exame das
coalizões formadas em função dos interesses particulares
dos atores em cada um dos diferentes foros de negociações.
Outra contribuição que esse estudo pretende trazer é
uma pesquisa da literatura sobre o tema da propriedade
intelectual que adota abordagens teóricas e ferramentas
analíticas da disciplina de Relações Internacionais. / [en] The proposal of this work is to discuss the dynamics of
interactions between states and between states and society,
in which the main object is the production and access to
knowledge - here understood as the state of the art,
science and technology, and the beliefs and ideas about it.
This dynamics is analyzed through the study of the
Intellectual Property International Regime, what makes it
necessary to discuss also regime theories and the
meaning of regimes to International relations. Two separate
and interconnected discussions will be developed, each one
with its own aspects, and will bring us to conclusions both
about the importance of regimes and about the dynamics of
interactions on production and access to knowledge. The two
main discussions are advanced through the analysis of
regime changing. The changes are identified on the legal
instruments which constitute the Intellectual Property
regime, through the analysis of the debates over the
agendas of revisions on these legal instruments, and
through the exam of the coalitions created around
particular interests of the actors in each of the different
forum of negotiations. Another contribution this study
intends to bring is a research on the literature about
Intellectual Property that takes a theoretical approach and
uses analytical tools of the discipline of International
Relations.

Esta dissertação concentra suas investigações nas contramedidas do direito internacional geral e da Organização Mundial do Comércio (OMC). No âmbito do direito internacional, estudou-se a essência política da sociedade internacional descentralizada, bem como a tendência do processo de fragmentação do direito internacional em direção a regimes mais regulados pelo direito. Além disso, investigou-se a tentativa de ampliação da normatização das contramedidas por meio do Projeto de Artigos sobre Responsabilidade Internacional do Estado de 2001. No âmbito do regime especial da OMC, analisou-se o maior adensamento jurídico das contramedidas como ponto culminante na fase de implementação das decisões no sistema de solução de controvérsias da OMC. Com base na avaliação sobre a necessidade de reforma do instituto das contramedidas da OMC, foram pesquisadas as principais propostas para sua modificação, buscando-se identificar a tentativa de redução do espaço político. A hipótese deste trabalho partiu da afirmação sobre a existência de uma tendência evolutiva no direito internacional geral e na OMC no que tange ao aumento da juridicidade do instituto das contramedidas. Entretanto, essa hipótese confirmou-se apenas parcialmente, pois a tentativa de aprimorar a regulamentação jurídica do instituto das contramedidas ocorre em meio à permanência de elementos políticos. / This thesis focused on countermeasures in general International Law and in the World Trade Organization (WTO). Regarding International Law, the thesis studied the political foundation of the decentralized international society, as well as the trend of fragmentation of International Law towards law-based regimes. Moreover, this thesis researched the attempt to regulate countermeasures through the Draft Articles on Responsibility of States for Internationally Wrongful Acts. Regarding the WTO special regime, the thesis analyzed its more law-based countermeasure as the last stage in the implementation of decisions in the WTO dispute settlement system. L'Accord sur les Aspects des Droits de Propriété Intellectuelle qui touchent au commerce constitue l'un des principaux piliers des accords de l'Uruguay Round. C'est aussi l'un des plus controversés. Cet Accord renforce les droits de propriété intellectuelle, les associe au commerce et introduit une norme mondiale ayant force exécutoire. La mise en application de cet Accord, qui suppose notamment de reconnaître et de renforcer la protection des produits et procédés pharmaceutiques par des brevets, pose des problèmes particuliers aux pays en développement vu le manque de ressources professionnelles, financières et d'infrastructure. La manière dont se fait l'interprétation de cet Accord peut avoir d'importantes répercussions sur les politiques de santé publique et, en particulier, sur l'accès des populations aux médicaments. Soumis aux pressions des pays riches et des groupes pharmaceutiques, les gouvernements des pays en développement se retrouvent parfois pieds et poings liés et n'utilisent pas les flexibilités prévues à leur avantage dans l'Accord, ce qui rend la situation sanitaire de leur population encore plus précaire. Cette étude décrit les principaux acteurs et les étapes importantes de la négociation de l'Accord, ainsi que les différentes adaptations qui en ont été faites sous les pressions contradictoires des nombreux protagonistes. Elle donne des explications sur les mécanismes en place et les conséquences possibles de l'entrée en vigueur de l'Accord sur l'accessibilité des pays en développement aux médicaments. / The Agreement on Trade-Related Aspects of Intellectual Property Rights is one of the main pillars of the agreements of the Uruguay Round. It is also one of the most controversial. This agreement strengthens the intellectual property rights, ties them to trade regulation and introduces a global binding standard. The implementation of this Agreement, which includes the recognition and the strengthening of the protection of pharmaceutical products and processes by patents, raises particular problems for developing countries, given the in lack of professional over financial resources as well as their poor economics infrastructure. The interpretation of this Agreement can have important consequences on public health policies and in particular on people's access to medicines. Unless the pressure of rich countries and pharmaceutical companies, governments of developing countries sometimes find themselves bound hand and foot and do not use the flexibilities provided to them by the Agreement to improve their position, thus making the health situation of their people still more precarious. This study describes the main actors and the important stages of negotiating the Agreement, as well as the various adjustments that were made under the pressures of numerous actors. It provides explanations of the existing mechanisms and of the potential consequences of the implementation of the Agreement on the accessibility of developing countries to medicines.

A comunidade internacional tem se convencido sobre a seriedade da mudança climática e a necessidade de respostas urgentes para combatê-la. No entanto, a ausência de um regime universal com metas para os principais poluidores faz com que cada país adote ações individuais de maneira descoordenada. Esse descompasso levanta preocupações sobre possíveis impactos para a competitividade e a eficácia dos esforços dos países com políticas climáticas mais ambiciosas. Com o escopo de neutralizar tais ameaças, desponta a alternativa de adoção de ajustes de carbono na fronteira para equalizar os encargos ambientais entre a indústria doméstica e as importações. Nesse contexto, a presente tese defende a criação de disciplinas internacionais para orientar o uso de ajustes de carbono em sintonia com os valores do livre comércio e da preservação do clima. Recomenda-se que as negociações internacionais sejam lideradas pelas Nações Unidas, na moldura do regime climático, porém, em estreito diálogo e cooperação com a Organização Mundial do Comércio (OMC). A partir da análise de possíveis cenários, o trabalho expressa preferência por disciplinas multilaterais. Reconhece-se, contudo, méritos em arranjos intermediários, como os instrumentos setoriais. Por fim, indica-se um roteiro sobre os principais aspectos da aplicação dos ajustes de carbono que mereceriam apreciação em plano internacional. / The international community has acknowledged the need for urgent responses to address climate change. However, in the absence of a global agreement setting binding targets for all major polluters, countries pursue individual actions in an uncoordinated fashion. Such a situation raises concerns on competitiveness impacts and on the environmental effectiveness of climate policies of most countries, especially those leading the way. As a solution to level the playing field vis-à-vis international competitors, countries evaluate the use of border carbon adjustments. Against this background, this analysis supports the design of international disciplines to guide the use of border carbon adjustments in line with the goals of free trade and climate protection. It argues that the United Nations should lead those negotiations in the framework of the climate regime, in close dialogue and cooperation with the World Trade Organization (WTO). Based on an analysis of multiple scenarios, this essay favours the adoption of multilateral disciplines. It recognizes, however, advantages in alternative approaches such as sectorial agreements. Finally, it proposes a roadmap on key aspects concerning the use of border carbon adjustments that merit consideration in the international arena.

Natural resources endowment, international trade and convergence / Dotation en ressources naturelles, commerce international et convergenceSoukar, Louai 26 September 2018 (has links)
Dans cette thèse, nous étudions l'effet de la répartition inégale des ressources naturelles entre les pays sur trois aspects principaux. Dans le premier chapitre, nous examinons empiriquement les effets asymétriques potentiels de l'adhésion à l'Organisation Mondiale du Commerce (OMC) entre les membres, en nous concentrant spécifiquement sur les pays en développement. Les résultats suggèrent que l'adhésion à l'OMC a contribué à l'augmentation des exportations de tous les pays, à l'exception des pays non-émergents riches en ressources. En revanche, les pays émergents riches en ressources sont les plus grands bénéficiaires de l'accession à l'OMC. Dans le deuxième chapitre, nous explorons empiriquement l'impact de la dotation en ressources naturelles sur les gains de six Accords Commerciaux Régionaux (ACR) entre les membres à travers trois axes : la complémentarité entre les pays, la diversification des pays riches en ressources ainsi que la création et le détournement des échanges. Nous concluons que la complémentarité entre les pays riches et les pays pauvres en ressources a été atteinte dans les accords de l’ECOWAS, du SADC et du CIS. Les résultats indiquent également que, dans tous les ACR, les pays riches en ressources ont accru leurs exportations hors secteurs des ressources naturelles et diversifié ainsi leurs structures d'exportation, en particulier avec les partenaires régionaux. En outre, dans la plupart des ACR, les pays pauvres ont accru leurs exportations vers leurs partenaires riches en ressources, tandis que ces derniers souffrent du détournement des échanges en termes d'importations. Dans le dernier chapitre, nous étudions l'impact de la dotation en ressources naturelles sur le processus de convergence entre les pays du PAFTA. Premièrement, les résultats démontrent que la sigma-convergence n'était observable qu'entre 1970 et 1990 dans les pays du PAFTA. De plus, l’estimation révèle que les ressources naturelles sont l'un des principaux déterminants de la convergence conditionnelle au sein du PAFTA. Par conséquent, l'asymétrie entre les pays en termes de dotation en ressources naturelles n'a pas empêché la convergence dans le PAFTA. L'analyse de la convergence des clubs a identifié trois principaux clubs parmi les pays du PAFTA. En outre, les facteurs qui ont déterminé la formation des clubs sont les ressources naturelles, la qualité des institutions et l'investissement. Par ailleurs, une abondance de ressources naturelles n'est pas suffisante pour être le meilleur club, mais doit être accompagnée d'institutions de qualité. / In this thesis, we examine the effect of the unequal distribution of natural resources between countries on three main aspects. In chapter one, we empirically examine potential asymmetric effects of the accession of the World Trade Organization (WTO) across members, focusing specifically on the developing countries. The results suggest that membership in the WTO contributed to greater exports for all countries, except for non-emerging resource-rich countries. In contrast, emerging resource-rich countries are the greatest beneficiaries from the accession of the WTO. In chapter two, we empirically explore the impact of natural resource endowments on the gains of six Regional Trade Agreements (RTA) across members through three axes: complementarity between countries, diversification of resource-rich countries, and trade creation and diversion. We conclude that the complementarity between resource-rich and resource-poor countries has been achieved in the ECOWAS, SADC and CIS agreements. The results also indicate that in all RTAs, the resource-rich countries increased exports in non-natural resource sectors and thereby diversified their export structures, especially with regional partners. Moreover, in most RTAs, poor countries boosted their exports to resources-rich partners, while resource-rich countries suffer from trade diversion in terms of imports. In the last chapter, we study the impact of natural resource endowments on the process of convergence among PAFTA countries. First, the results demonstrate that sigma-convergence was only observable between 1970-1990 among PAFTA countries. The estimation reveals that natural resources are one of the main determinants of conditional convergence within PAFTA. Therefore, the asymmetry between countries in terms of natural resource endowment did not impede the convergence in PAFTA. Club convergence analysis identify three main clubs among PAFTA countries. In addition, the factors that determined clubs’ formation are natural resources, quality of institutions, and investment. Further, an abundance of natural resources is alone not enough to be the best club, but must be accompanied by high-quality institutions.

Previous issue date: 2018-04-12 / Hoje, um dos temas mais sensíveis para a humanidade é o meio ambiente. Em um
mundo globalizado, onde a preocupação com o meio ambiente deve ser repartida
entre todos, não há caminho para a prática de medidas unilaterais, estanques, ante
a complexidade e influência destas no mundo atual. Assim, litígios podem aparecer
e alguns surgem, em razão desta dificuldade em conciliar interesses. A questão é
como prevenir e resolver estes dilemas ambientais sem a necessidade da imposição
da força. Daí surge a governança global como instrumento para a busca de soluções
pacíficas e comuns para as mais diversas questões relativas à proteção ambiental,
por meio da adoção de políticas e de instrumentos normativos. Ocorre que estas
questões ambientais também atingem o comércio internacional, principalmente
quando medidas ambientais aparecem como forma de barreira comercial,
caracterizando-se, muitas vezes, como uma medida protecionista, prática combatida
pelo comércio internacional e por seu órgão máximo de defesa e regulação, a
Organização Mundial do Comércio. Mais uma vez, aparece a governança global,
agora, governança global ambiental, como instrumento para a proteção ambiental,
expandindo seu campo de atuação nos acordos de livre comércio mundial, sendo a
sua importância destacada em dois deles, o Acordo de Facilitação do Comércio,
nascido dentro da Organização Mundial do Comércio, objetivando a simplificação e
desburocratização do comércio internacional e exterior, e no TransPacific
Partnership, este último com grande preocupação ambiental e com mecanismos de
solução de conflitos ambientais embasados nas melhores práticas de governança.
Assim, em razão da complexidade das questões ambientais, principalmente nos
acordos mundiais de livre comércio, o meio capaz de prevenir litígios e resolvê-los
são os arranjos de governança global. / Today, one of the most sensitive issues for humanity is the environment. In a
globalized world, where the concern for the environment must be shared among all,
there is no way to practice unilateral, watertight measures, given the complexity and
influence of these in today's world. Thus, litigation may appear and some arise,
because of this difficulty in reconciling interests. The question is how to prevent and
resolve these environmental dilemmas without the need for force. Hence, global
governance emerges as a tool for seeking peaceful and common solutions to the
most diverse issues of environmental protection through the adoption of policies and
normative instruments. These environmental issues also affect international trade,
especially when environmental measures appear as a form of trade barrier, often
being a protectionist measure, a practice attacked by international trade and by its
highest defense and regulatory body, the World Trade Organization. And, once
again, global governance now appears as a global environmental governance
instrument for environmental protection, expanding its field of activity in global free
trade agreements, and its importance is highlighted in two of them, the Trade
Facilitation Agreement , born within the World Trade Organization, aiming at
simplifying and reducing bureaucracy in international and foreign trade and in the
TransPacific Partnership, the latter with great environmental concern and with
environmental dispute resolution mechanisms based on the best governance
practices. Thus, because of the complexity of environmental issues, especially in
trade-free agreements, the means of preventing and resolving disputes are the
means embedded in global governance arrangements.
