A presente dissertação tem como objeto um debate que se desenvolveu durante o processo revolucionário russo, entre os anos de 1923 e 1928. Tal debate envolveu dois grupos: a Oposição de Esquerda, liderada por Leon Trotsky, e a Frente de Esquerda das Artes (LEF), movimento que aglutinou os artistas construtivistas. Ambos os grupos estavam interessados na reestruturação do modo de vida do proletariado russo como uma das dimensões do combate à burocratização do regime soviético e ao processo de modernização iniciado com a promulgação da Nova Política Econômica. A pesquisa examina, assim, as distintas posições e estratégias formuladas pela Oposição de Esquerda (e, posteriormente, Oposição Unificada) e pela LEF para o combate nos campos da cultura e do psiquismo. / This dissertation is about a debate that developed during the Russian revolutionary process, between the years 1923 and 1928. This debate involved two groups: the Left Opposition - led by Leon Trotsky - and the Left Front of Arts (LEF), a movement that brought the constructivist artists together. Both groups were interested in restructuring the way of life of the Russian proletariat as a crucial part of the fight against bureaucratization of the Soviet regime and the process of modernization, started with the enactment of the New Economic Politcy. The research thus examines the different positions and strategies formulated by the Left Opposition (and, later, the United Opposition) and the LEF for the combat in the fields of culture and psychism

The development of Malay entrepreneurship in Malaysia : a thesis presented in fulfilment of the requirement for the degree of Doctor of Philosophy in Business at Massey University, Auckland, New Zealand

Since the institution of the New Economic Policy (NEP) in 1971 and beyond its end in 1990, the Malaysian government has had mixed successes in developing Malay entrepreneurship. Despite on-going of privileges and assistance and the government’s concerted efforts and initiatives, Malay entrepreneurship still continues to lag behind that of the Chinese. This study centres on the challenges faced by the Government of Malaysia in the promotion of Malay entrepreneurial development. Based on interviews with diverse people, both within and outside the government, the study reveals that Malay entrepreneurial development is a complex process confronted by many issues and problems. The study also reveals that government privileges and assistance to Malays to promote entrepreneurship do not help much in boosting an entrepreneurial culture nor do they help them in enhancing entrepreneurial competitiveness and achievement. Instead, such privileges and assistance have conversely made the Chinese more resilient and competitive entrepreneurially but discriminative against the Malays. This conclusion confirms the proposition that “state assistance in the form of an affirmative action to an economically-challenged sector of society does little to create entrepreneurship; rather it challenges rival economic groups to sharpen their own competitiveness”. Finally, the study is able to indicate that Malay entrepreneurship differs slightly from the conventional Western concepts of entrepreneurship. The differences are largely due to the historical background of the Malays as a communitarian society; as Muslims; as a society still divided along class lines and as a status conscious community.

BEE and Malaysia's NEP: a comparative study

International Studies))--University of Stellenbosch, 2006. / South Africa and Malaysia share a similar history charecterised by multi-ethnicity and similar policies in redressing their economic imbalances created by past colonial experiences. In both countries, the decolonization process left economic power with minority ethnic groups, a phenomenon that led to the exclusion of the majority of people from meaningful participation in the mainstream economy. It has been argued that in such instances minority ethnic communities often experience minority domination of the economy in ethnic terms as control of economic levers of economic power. Upon independence, Malaysia and South Africa faced the challenge of redressing the socio-economic and political imbalances. In South Africa, the government led by the African National Congress (ANC) adopted the Black Economic Empowerment (BEE) programme to create an inclusive economy that can meet the needs of its entire citizen. Unlike Malaysia where the economic restructuring took place in a less globalised period, South Africa’s economic restructuring occurs at a time when globalisation is at an advanced stage. This has made it difficult for the South African government to match Malaysia’s successes in redressing the economic imbalances. Also, in adopting the BEE programme the ANC government has not given enough attention to education and skills development, two elements that were key to Malaysia’s own model of economic empowerment. Strategies to address poverty have so far borne little success thus further condemning the majority of Black people to impoverished conditions. The outcome of the study suggests that in order for BEE to be successful, the ANC government has to empower the majority of black people with the necessary skills that will make them active participants in the mainstream economy. Also, a broadened empowerment process should see education, skills development and poverty alleviation become aligned to the BEE programme.

Die Dissertation untersucht am Beispiel des Volkskommissariates für Außenhandel die Entstehung der frühen Sowjetbürokratie und analysiert administrative und politische Prozesse, die der Herausbildung des Stalinismus vorangingen. Gegenstand der Untersuchung sind die Probleme des staatlich organisierten Außenhandels sowie die Schwierigkeiten bei der Anknüpfung von Handelsbeziehungen zu den kapitalistischen Staaten in der Zeit nach der Revolution. Außenpolitische Faktoren und weltwirtschaftliche Voraussetzungen werden in diesem Zusammenhang ebenso berücksichtigt wie die zum Teil widersprüchlichen Interessen des sowjetischen Außenhandels einerseits und der sowjetschen Diplomatie anderseits. Im Mittelpunkt steht die Frage nach dem Verhältnis zwischen Parteiapparat und Regierungsbürokratie sowie die Rolle der Volkskommissariate im politischen Entscheidungsprozeß. The study deals with the problems of centrally planned foreign trade and the difficulties of establishing trading connections to the capitalistic states in the post-revolutionary period. In this context international factors and conditions, dictated by world economy, are considered as well as the contradictory interests of Soviet foreign trade on one hand and soviet diplomacy on the other hand. The focus is set on decision-making concerning the relationship between party apparatus and the People´s Comissariats. In this context the author concentrates on three aspects: the influence of CK´s Policy of Cadre selection on People´s Comissariat of Foreign Trade, the organizational change in this institution during the New Economic Policy and the cooperation between the various economic and party institutions, concerning the decision on concrete questions of foreign trade.

«Avec salutations socialistes» : lettres de plaintes et relations socio-étatiques en République démocratique allemande, 1953-1967

Ce mémoire de maîtrise consiste en une analyse des dynamiques relationnelles entre l'État de la République démocratique allemande et ses citoyen·ne·s à travers un échantillon de lettres de plaintes envoyées entre 1953 et 1967 concernant les problèmes liés au logement. Les plaignant·e·s ont adopté des « valeurs socialistes » tout au long de leurs discours pour justifier la légitimité de leurs demandes et ils ont utilisé les mots et les principes mêmes de l'État pour exiger des actions. Ce mémoire met en lumière non seulement ces différentes stratégies en utilisant une approche « par le bas », mais examine aussi examine également la réaction de l'État. On remarque notamment que les réponses envoyées par l’État aux plaignant·e·s étaient en général plus positives dans les années 1960 et 1950, ce qui montre d’une part une évolution dans le rapport entre l’État et la société, mais aussi d’autre part un certain changement quant à l’application même des principes socialistes. On remarque en outre que, dans les années 1960, le gouvernement de l’Est a davantage pris soin d'adapter la gestion de ses politiques intérieures aux besoins de la population. L'analyse de ces lettres se situe à la croisée de deux méthodes ; tout d'abord, une analyse discursive a permis de saisir les stratégies d'écriture récurrentes par lesquelles la population a tenté d’influencer l’État. Puis, une analyse statistique des réponses de l’État croisée à l’évolution des politiques intérieures a permis de saisir les changements d’attitude du gouvernement envers sa population. / This master’s thesis analyzes the dynamics between the German Democratic Republic and its citizens through complaint letters that East Germans sent to the State between 1953 and 1967 regarding housing problems. It argues that the complainants adopted “socialist values” throughout their discourses as a way of justifying the legitimacy of their complaints. In other words, they used the discourse and principles of the state against it in order to demand action and a resolution to their problems or concerns. This thesis not only highlight these various strategies, utilizing a “history from below” approach, but it also investigates the state’s reaction to the complaints of its citizens. It argues that the state responded overall better in the 1960s as it did in the 1950s, showing evolution in the relationship between state and society as well as a shift in the state’s way to understand socialism. By the 1960s the East German government had had time to slowly adapt its domestic politics towards the population’s needs. The analysis of these letters is at the crossroads of two methods: First I employ a discursive analysis that allows me to identify the recurring strategies by which the state and its citizens sought to influence each other. Second, I use a statistical analysis of the State’s responses coupled with an examination of domestic politics that allows me to capture the changing attitude of the government towards its population.

A Pragmatic Standard of Legal Validity

American jurisprudence currently applies two incompatible validity standards to determine which laws are enforceable. The natural law tradition evaluates validity by an uncertain standard of divine law, and its methodology relies on contradictory views of human reason. Legal positivism, on the other hand, relies on a methodology that commits the analytic fallacy, separates law from its application, and produces an incomplete model of law. These incompatible standards have created a schism in American jurisprudence that impairs the delivery of justice. This dissertation therefore formulates a new standard for legal validity. This new standard rejects the uncertainties and inconsistencies inherent in natural law theory. It also rejects the narrow linguistic methodology of legal positivism. In their stead, this dissertation adopts a pragmatic methodology that develops a standard for legal validity based on actual legal experience. This approach focuses on the operations of law and its effects upon ongoing human activities, and it evaluates legal principles by applying the experimental method to the social consequences they produce. Because legal history provides a long record of past experimentation with legal principles, legal history is an essential feature of this method. This new validity standard contains three principles. The principle of reason requires legal systems to respect every subject as a rational creature with a free will. The principle of reason also requires procedural due process to protect against the punishment of the innocent and the tyranny of the majority. Legal systems that respect their subjects' status as rational creatures with free wills permit their subjects to orient their own behavior. The principle of reason therefore requires substantive due process to ensure that laws provide dependable guideposts to individuals in orienting their behavior. The principle of consent recognizes that the legitimacy of law derives from the consent of those subject to its power. Common law custom, the doctrine of stare decisis, and legislation sanctioned by the subjects' legitimate representatives all evidence consent. The principle of autonomy establishes the authority of law. Laws must wield supremacy over political rulers, and political rulers must be subject to the same laws as other citizens. Political rulers may not arbitrarily alter the law to accord to their will. Legal history demonstrates that, in the absence of a validity standard based on these principles, legal systems will not treat their subjects as ends in themselves. They will inevitably treat their subjects as mere means to other ends. Once laws do this, men have no rest from evil.
