Previous issue date: 2011-12-02 / The research arose from the necessity of showing ways to be followed by the actors of the
System Guaranteeing Rights of the Child and Adolescent (SGD), regarding the
implementation of rights for young people, because the legislation in force in Brazil is
currently considered a model around the world and, paradoxically, the fundamental rights of
children and adolescents are not met, even with the constitutionally guaranteed priority. Thus,
the study investigates the fundamentality rights for young people, enshrined in the
Constitution of the Republic, as well as the ways of effectiveness of these rights through the
actions of actors of the System Guaranteeing Rights, especially the judiciary. Focusing
realized, studying theories of fundamental rights, especially Structuring a Theory of Law
(Strukturiende Rechtslehre), Friedrich M?ller, who emphasizes the need for analysis of social
reality in the application of the rule of law. Study also the public budget and public policies
concerning children and adolescents, with emphasis on preparation of budget laws and the
process of discussion, deliberation, choice and implementation of public policies for children
and teenagers. It then presents the typical functions of the members of System Guaranteeing
Rights, as well as prepare a plan for optimum performance for each of the actors, with
emphasis on analysis of the implementation of public policies at the municipal level. Finally,
it analyzes the theory of separation of three powers, and discusses the positive and negative
factors for judicial intervention, concluding that the Courts can consider the action activist,
from finding the omission of the Executive and legislative branches, as regards the
implementation of the rights of children and adolescents, as well as the rights of children and
young people are not realized in most cases, due to the omission of actors of the System
Guaranteeing Rights / A pesquisa surgiu da necessidade de apresenta??o de caminhos a seguir por parte dos atores
do Sistema de Garantia de Direitos da Crian?a e Adolescente (SGD), no que se refere ?
concretiza??o dos direitos infanto-juvenis, pois a legisla??o em vigor no Brasil atualmente ?
considerada modelo em todo o mundo e, contraditoriamente, os direitos fundamentais das
crian?as e adolescentes n?o s?o concretizados, mesmo diante da prioridade absoluta garantida
constitucionalmente. Assim, o estudo investiga a fundamentalidade dos direitos infantojuvenis,
consagrados na Constitui??o da Rep?blica, bem como as formas de efetiva??o dos
referidos direitos, atrav?s da atua??o dos atores do Sistema de Garantia de Direitos,
especialmente do Judici?rio. Com enfoque concretizador, estuda algumas teorias dos direitos
fundamentais, especialmente a Teoria Estruturante do Direito (Strukturiende Rechtslehre), de

Previous issue date: 2011-09-23 / The aim of this thesis is to evaluate the quality of public spending on education for the
municipalities of the Metropolitan Region of Natal (RMN) in 2009 by use of two theories:
The Theory of Welfare (Welfare State) and the Public Choice Theory (TEP), both important
to understand the relationship between education and economics. The study also uses
principles of microeconomics and public sector economics to get a better idea of the role of
education in economy and society. It describes the development of the educational policy in
Brazil from 1988 to the Federal Constitution of 2010, following the major changes in basic
education during each government. The characteristics of the RMN municipalities were
illustrated with socioeconomic indicators, while educational indicators were used to
characterize each municipality regarding education. The model used in this study was
developed by Bert?, Brunet and Borges, the data was collected on the back of the School
Census 2009 and the Brazil Exam 2009 and it was processed quantitavely in the Information
System on Public Budgets in Education (SIOPE) by use of the statistical method called
standardized score of the normal cumulative distribution function. The quality of public
spending on education is the result of the relation between performance indicator ratio and
expense ratio. For the qualitative analysis of results, the criteria of efficiency, efficacy and
effectiveness were used. The study found that municipalities with higher expenses showed a
worse quality of spending and failed to convert the expenditure incurred into performance,
thus confirming ineffectiveness / A presente disserta??o tem como objetivo avaliar a qualidade do gasto p?blico em educa??o
pelos munic?pios da RMN, em 2009, por meio de duas teorias: Teoria do Bem-Estar Social
(Welfare State) e Teoria da Escolha P?blica (TEP), importantes para entender a rela??o entre
educa??o e ci?ncia econ?mica. O estudo tamb?m utiliza princ?pios da microeconomia e da
economia do setor p?blico para melhor entender o papel da educa??o na economia e na
sociedade. Percorre-se, neste trabalho, a trajet?ria da pol?tica educacional no Brasil a partir da
Constitui??o Federal de 1988 at? 2010, acompanhando as principais mudan?as ocorridas na
Educa??o B?sica em cada Governo. As caracter?sticas dos munic?pios da RMN foram
reveladas atrav?s de indicadores socioecon?micos, e, para caracterizar cada munic?pio no que
se refere ? educa??o, recorreu-se aos indicadores educacionais. O modelo utilizado neste

bancos do Censo Escolar 2009, da Prova Brasil 2009 e no Sistema de Informa??es sobre

tratamento estat?stico denominado escore padronizado pelo m?todo da fun??o de distribui??o

Previous issue date: 2010-04-15 / Coordena??o de Aperfei?oamento de Pessoal de N?vel Superior / Considering that tourism tends to reproduce itself privatizing the areas where it installs, the secondary residence has been an urban element responsible for the private appropriation of the public spaces of coastal of N?sia Floresta. The private appropriation of these accesses, for secondary residences, constitute in an issue-problem of the research. The principal goal is to analyze the relationship of the consumers/users of secondary residences with the public space; and, specifically, identify how the government has been acting and manifesting itself about the occupation of the coastal of N?sia Floresta; as also to verify how the secondary residence has been
appropriating privately of the public access of the coastal. On account of the scarce literature about secondary residences and the importance of the public access to beaches for the inhabitant, the present work aims to contribute to the discussion of this theme. The secondary residences in Rio Grande do Norte began in the late nineteenth century, becoming more common in the 90s, when the coast south of Natal is appropriated from local vacationers. In 2000, foreign investment began to be applied in real state and tourism, producing closed developments, served in leisure infrastructure, trade, and hospitality, mainly to external demands. The methodology
included a bibliographic survey, data collection and in l?cus observation. Applied questionnaires and interviews were performed with consumers/users of the secondary residences, permanent residents and government, respectively. To the legal grounding, taken as a reference the article. 10, of the law 7.661/88 to establish that the beaches are goods of common use . Considering the conclusive analysis of the research, can be said that the
right of free access and use of the beach is committed for the benefit of the consumers/users of secondary residences, due to the negligence and omission of the government / Considerando-se que o turismo se reproduz tendencialmente privatizando as ?reas onde se instala, a resid?ncia secund?ria tem sido elemento urbano respons?vel pela apropria??o privada dos espa?os p?blicos litor?neos de N?sia Floresta. A apropria??o privada desses acessos, por resid?ncias secund?rias, se constitui na quest?o-problema da pesquisa. decision of the adoption of electronic collecting in the system of urban transport in the country, a subject that has been controversial. A modeling of criteria and alternatives is
carried through and applied a questionnaire based on method AHP the excellent actors in the system of urban transport - Leading of the Managing Agency Public Municipal theatre
of Urban Transports, Controller of Company of Bus, Controller of Labor union, Controller of Union of Companies, Communitarian Leader. The considered alternatives were: the
maintenance of the current state with collectors, the implementation of electronic collection without collectors, and the implementation of electronic collection with collectors. The used criteria were: job, impact in the fare, control of the system, easiness of use, information. The study was carried through in the city of Natal, RN, where if the adoption of electronic collection argues and where this implementation in some bus lines between Natal and Parnamirim exists, city that integrates the region of the great Natal. The main results of the method evidence in a dimension, the viability of use of method AHP with questionnaire by means of validation of the judgments with analysis of variance beyond proper the normal mechanisms of analysis of consistency to the method, and in
another one, the contribution of the analysis boarding multicriterion to become the judgments more clearly. The main results of the analysis help to show that although to
models of criteria and distinct judgments of the actors, the method evidenced that it has inclination the adoption of the electronic collection on the current situation, even so with
divergences between the maintenance or not of the collector. The research points to the possibility of accomplishment of the application of the AHP in successive rounds of

program Minha Casa Minha Vida, track 1, which comprehends people who made 0 to
3 minimum wages within the metropolitan region of Natal RN between the years of
2009 and 2012. The research covers the municipalities benefited by the program:
Cear?-Mirim, Extremoz, Maca?ba, Monte Alegre, Natal, N?sia Floresta, Parnamirim
and S?o Gon?alo do Amarante. We have investigated the extensions of PMCMV on
the context of the access to the city, debating some concepts attached to the
capitalist mode of production such as residential segregation and peripherization. We
have aimed to identify the accessibility conditions in the new housing complexes from
three primal categories, namely, the localization of the complexes, the disponibility of
public equipments, services, leisure and cultural properties on the neighborhood and
the offer of public transport. Our theorical references are based on the ideas of the
british geographer David Harvey on his work Social Justice and the City , from 1980.
Harvey s studies made us debate on the locational choice for the social-matter
habitation, and also let us discuss the price to accessibility on these new programs
and its implications on the income of those who are benefited by them, specially
because this is about a low-income population. To the achievement of these
objectives, we made use of case study, including desk research, photographic
documentation, records of field observations and informal conversations with locals,
composing a qualitative study. In light of what has been researched and considering
the guiding research questions, we reflect on aspects of the program that can greatly
influence the processes of residential segregation and housing periphery of the lowincome
population from the precarious conditions of accessibility to the referred
population / A presente disserta??o busca refletir sobre a acessibilidade nos conjuntos
habitacionais do Programa Minha Casa Minha Vida, Faixa 1, que compreende as
pessoas que recebem de 0 a 3 sal?rios m?nimos, no ?mbito da Regi?o Metropolitana
de Natal RMNatal - entre os anos de 2009 e 2012. A pesquisa abrange os
munic?pios beneficiados pelo programa: Cear?-Mirim, Extremoz, Maca?ba, Monte

Previous issue date: 2014-08-13 / In recent decades higher education in Brazil has gone through several changes. The
Programa de Reestrutura??o e Expans?o das Universidades Federais REUNI has been the
greatest overhaul performed by the government in public universities in the last years. REUNI
is presented as the biggest reform in tertiary education in contemporary times, having as the
main goal a gradual increase in the average rate of conclusion in live learning graduation
courses up to 90%, as well as a rate expansion of graduating students in face to face classes
per professor. This research aims at studying the perception of professors from UFRN
concerning the REUNI program in execution from 2008 until 2012. The study seeks to
understand how professors evaluate the program and what the dimensions that most influence
in this evaluation are. The study made use of a research tool (survey) which was sent through
the internal system of the university, SIGAdmin, to all professors of superior teaching from
UFRN. The answers generated by the survey were processed using SPSS statistical software
(Statistical Package for Social Science). Factorial Analysis and Multiple Linear Regression
were used as an analysis technique. 180 answers were obtained, reaching all UFRN Centers
and some academic units, as well as some campuses in the countryside of the state. Through
the research was possible to analyze how professors from UFRN perceive the REUNI
program implemented in the institution. The results point to the program approval by the
professors. Statistical tests showed that the average values obtained in the Centers and
academic units are basically the same. It was demonstrated that the extent that most
influenced in the answers is linked to practical outcomes of the program, whereas the
knowledge of REUNI goals was the least that impacted on the marks given to the program.
Another dimension which influenced the perception of professors relates to the influence of
REUNI in their activities. It was observed that professors from UFRN don t see REUNI as an

Programa de Reestrutura??o e Expans?o das Universidades Federais REUNI, foi a maior
reforma executada pelo governo Federal em universidades p?blicas nos ?ltimos anos. O
REUNI se apresenta como a grande reforma do ensino superior na contemporaneidade, tendo
como meta global a eleva??o gradual da taxa de conclus?o m?dia dos cursos de gradua??o
presenciais para 90% e amplia??o da rela??o de alunos por professor. Esta pesquisa tem como
objetivo estudar a percep??o dos docentes da UFRN acerca do programa REUNI, em
execu??o durante o per?odo de 2008 a 2012. O estudo busca compreender como os docentes
avaliam o programa e quais s?o as dimens?es que mais influenciam nesta avalia??o. O estudo
utilizou-se de um instrumento de pesquisa (question?rio), que foi enviado atrav?s do sistema
interno da universidade, SIGAdmin, para todos os professores de magist?rio superior da
UFRN. As respostas geradas pelo question?rio foram processadas pelo software estat?stico
SPSS (Statistical Package for Social Science). Como t?cnica de an?lise utilizou-se da An?lise
Fatorial e Regress?o Linear M?ltipla. Foram obtidas 180 respostas, conseguindo atingir todos
os Centros da UFRN e algumas unidades acad?micas, chegando tamb?m aos Campi do
interior do Estado. Atrav?s da pesquisa foi poss?vel analisar como os professores da UFRN
percebem o programa REUNI, implantado na institui??o. Os resultados apontaram para uma
aprova??o do programa por parte dos docentes. Os testes estat?sticos demonstraram que as
m?dias obtidas nos diferentes Centros e Unidades Acad?micas pesquisados foram as mesmas,
n?o havendo diferen?as significativas entre elas. Ficou demonstrado que a dimens?o que mais
influenciou nas respostas dos docentes est? ligada aos resultados pr?ticos do programa,
enquanto que o conhecimento sobre as metas do REUNI foi a que menos impactou nas notas
atribu?das ao programa. Outra dimens?o que tamb?m influenciou na percep??o dos docentes
diz respeito ? influ?ncia do REUNI em suas atividades. Foi poss?vel observar que os
professores da UFRN n?o veem o REUNI como um entrave ?s suas atividades

Previous issue date: 2016-02-24 / CAPES / This dissertation consisted in investigating the Municipal Plan of Education of Itagua?/RJ, which was reformulated in the year 2015 and will be current until the year 2025. For this purpose, acknowledging the relevance of the PME (2015) from Itaguai/RJ, (because it acts in a sense of re-orientating the education in the municipality) this study researched the reorientation of that document regarding pedagogical and educational assistance of the target-public students of the special education program of the municipality, and overall of the CEMAEE (Centro Municipal de Atendimento Educacional Especializado, in english "Municipal Centre of Specialized Educational Assistance"). Our researched issues were: Does the Municipal Plan of Education of Ituaguai (2015) contribute to the democratization process of the education system? How is the political-pedagogical organization set in the (re) orientation included in the PME (2015) of Itagua?, regarding the assistance to the target-public students in special education programs? Is the PME Itagua? (2015) in line with the PNE (National Education Plan)? Which are the perspectives of improvement that the PME Itagua? could establish in the CEMAEE's assistance? Which are the difficulties that the participants in this study have found for the implementation of the inclusive orientation for the target-public of the special education program? What do the participants of this study think/know about the current Public Policy of Inclusive Education concerning the special education target-public students? The methodological conception of this research was the "undissociability" between method and theory exposed in the Teor?a Critica (Critical Theory) of education. The thought of Theodor Adorno inspired our analysis, as well as Damasceno and Costa, commentators of his thought. Regarding the methodological procedures, we divided them in two moments, the first moment consisted in the documental analysis, in which we evaluated the previous PME of Itagua? (2010-2020) and the current (2015-2025) and we characterized the Documento de Forma??o (Formation Document) from 2010 from the CEMAEE. In the second moment, we accomplished the interviews with the subjects of the study, as follows: Ex-secretary of Education, Ex-sub-secretary of Education, Secretary of education, manager of the CEMAEE and the teacher of the CEMAEE, and we applied the characterization to them. In our final considerations, we identified that the PME (2015) represents a very important achievement for the education of the Municipality, since it presents political-pedagogical disposals that collaborate with the school inclusion of the target-public students of special education. Nevertheless Itagua? still faces challenges that raise obstacles to reach education for everyone, thus becoming urgent that what was instituted by the PME (2015) is implemented in the sphere of the institutive of the municipal network of Itagua?. We emphasize the importance of this and other researches that have the objective of studying the operational ability of the process of the school inclusion of the target-public individuals/students in the special education programs, in tune with the movement of democratization of the education. / Esta disserta??o tem como objeto de investiga??o o Plano Municipal de Educa??o de Itagua?/RJ, que foi reformulado no ano de 2015, com validade at? o ano de 2025. Para tal, tomando conhecimento da relev?ncia do PME (2015) de Itagua?, no que se refere a (re)orienta??o da educa??o do Munic?pio, este estudo pesquisou/problematizou os impactos deste documento no atendimento pedag?gico e educacional dos estudantes p?blico-alvo da educa??o especial do Munic?pio e, sobretudo, no CEMAEE (Centro Municipal de Atendimento Educacional Especializado). Nossas quest?es de investiga??o, derivadas de nosso objetivos, foram: O Plano Municipal de Educa??o de Itagua? (2015) contribui para o processo de democratiza??o no sistema de ensino? Como est? posta a organiza??o pol?tico-pedag?gica na (re) orienta??o inclusiva do PME (2015) de Itagua?, no que tange ao atendimento dos estudantes p?blico-alvo da educa??o especial? O PME de Itagua? Quais as dificuldades que os profissionais da educa??o, participantes deste estudo, tem encontrado para a implementa??o da orienta??o inclusiva para o p?blico-alvo da educa??o especial? O que pensam/sabem os sujeitos participantes do estudo sobre as atuais Pol?ticas p?blicas de Educa??o Inclusiva no que se refere aos estudantes p?blico-alvo da educa??o especial? A concep??o metodol?gica desta pesquisa se fundamenta na indissociabilidade entre teoria e m?todo posta na Teoria Cr?tica da educa??o. O pensamento de Theodor Adorno subsidiou nossas an?lises, assim como as reflex?es de Damasceno e Costa, comentadores de seu pensamento. Quanto aos instrumentos e procedimentos metodol?gicos, os dividimos em duas etapas: a primeira consistiu na an?lise documental, onde analisamos o PME de Itagua? (2010-2020) e o atual (2015-2025), al?m do Documento de Forma??o (2010) do CEMAEE. Na segunda etapa, realizamos as entrevistas com os sujeitos de estudo, a saber: Ex-secret?ria de educa??o, Ex-subsecret?ria de educa??o, Atual Secret?ria de educa??o, Gestor do CEMAEE e uma Docente do CEMAEE. Em nossas considera??es finais de pesquisa identificamos que o PME (2015) representa uma significativa conquista para a educa??o do Munic?pio, pois apresenta disposi??es pol?tico-pedag?gicas que colaboram com a inclus?o escolar de estudantes p?blico-alvo da educa??o especial. Entretanto, Itagua? ainda possui in?meros desafios que obstaculizam a afirma??o de uma educa??o para todos, tornando-se urgente que o institu?do no PME (2015) se implemente na esfera instituinte dos movimentos democr?ticos desta rede de ensino. Destacamos a import?ncia desta e outras pesquisas que possuem como objeto de estudo a operacionalidade do processo de inclus?o escolar de indiv?duos/estudantes p?blico-alvo da modalidade de educa??o especial, consent?neo ao movimento de democratiza??o da educa??o na contemporaneidade.

Previous issue date: 2009-02-17 / This work intends to analyze the open public central spaces, in the urban structuring of the city of Recife, to verify the existence of dialog between these spaces and metropolitan dynamics. Taking as the axis central research open spaces which are located in urban centers and have public use, the research used the territorial context of the city of Recife as a case study. After a conceptual search to consider the open public spaces as the uses and integral appropriation in the central area, it was investigated the open spaces located in the center of the city that resulted in the analysis of three public open spaces with a radius of influence in metropolitan areas. The Pra?a do Derby, Pra?a Rio Branco and the Parque 13 de Maio were investigated and chosen as the research focus the Pra?a do Derby, for being a nodal point of influence in dynamic metropolitan space contemporary and present characteristics of the sphere of public life. / Este trabalho tem como objetivo analisar os espa?os livres p?blicos centrais, na estrutura??o urbana da cidade do Recife, buscando verificar a exist?ncia de di?logo entre estes espa?os e a din?mica metropolitana. Tendo como eixo central da investiga??o os espa?os livres que est?o localizados nos centros urbanos e que possuem uso p?blico, a pesquisa utilizou-se do contexto territorial da cidade do Recife como estudo de caso. Ap?s uma busca conceitual que considerasse o espa?o livre p?blico como integrante dos usos e apropria??es da ?rea central, investigou-se o conjunto de espa?os livres localizados no centro da cidade do Recife, o que resultou na an?lise de tr?s espa?os livres p?blicos com raio de influ?ncia metropolitana. Ap?s investigar a Pra?a do Derby, a Pra?a Rio Branco e o Parque 13 de Maio, ficou escolhido como foco da pesquisa a Pra?a do Derby, por ser um ponto nodal de influ?ncia na din?mica espacial metropolitana e apresentar caracter?sticas contempor?neas da na esfera da vida p?blica.
