Advance fee fraud

The focus of this thesis is on Advance Fee Fraud (419 scams) on how it is executed and more importantly, on how it can be prevented. The research addresses the origins of AFF, the nature and extent of this crime and how the perpetrators are able to defraud their victims. The research described, examined and analysed the crimes, the perpetrators, the victims, adjudication and the prevention strategies of this fraud. Information was gathered through literature and empirical research. A qualitative research method was used to gather information from AFF offenders who were incarcerated in South African prisons in 2005. The results of the empirical research were carefully examined, analyzed and integrated into the various chapters of this thesis. A theoretical framework was also developed in an attempt to explain this complex phenomenon. The findings and recommendations in terms of the crimes, the criminals, the victims, adjudication and prevention were also made and some suggestions for further research thereof were also cited. / Criminology / D. Omniprésente dans le discours juridique, la question de « l’application » ou de la« concrétisation » du droit n’est que rarement considérée comme un objet d’étude à partentière. C’est pourtant peu dire qu’elle recouvre un phénomène multiforme, sinon confus.Cette thèse vise à l’étudier en lui-même et pour lui-même, du point de vue du rapport deconcrétisation entre actes juridiques. Mais, tout en s’inscrivant dans son sillage, l’étudeentendra dépasser la représentation classique de ce rapport livrée par l’École normativiste, àtravers la célèbre théorie de la formation du droit par degrés et de la concrétisationcroissante des normes. Elle se propose de démontrer que le rapport de concrétisation entreactes juridiques, loin de la banalité à laquelle il est généralement associé, relève en réalitéd’une opération juridique bien plus complexe qu’il n’y parait. Cela se vérifie d’abord parl’identification de ce rapport : en soi, concrétiser un acte juridique ne signifie rien pour unautre acte juridique. Tout dépend du point de vue à partir duquel le problème est envisagé.Sous un angle conceptuel, il existe en effet plusieurs figures du rapport de concrétisationentre actes juridiques, tandis qu’appréhendé par le juge, ce même rapport fait l’objet d’untraitement contentieux. Cela se vérifie ensuite par l’analyse de la pratique du rapport deconcrétisation par les acteurs juridiques. Non seulement celle-ci n’a rien de neutre, mais elles’avère pour le moins déstabilisatrice, si ce n’est subversive, à l’égard de la hiérarchie desnormes et des organes. Alors même que sa raison d’être est de rendre compte de larationalité globale de notre système juridique, le rapport de concrétisation entre actesjuridiques aboutit ainsi à la mettre en cause. / Omnipresent in legal discourse, the issue of “application” or “concretization” of law is rarelyseen as an object of study in itself. Yet it is an understatement to say that it covers amultifaceted phenomenon, if not a confused one. This thesis aims to study it in itself and foritself, from the perspective of the relationship of concretization between legal acts. But, whileremaining in its wake, the study will go beyond the classic representation of this relationshipdelivered by the Normativist school, through the famous theory of the gradual construction ofthe law and the increasing realization of norms. It aims to demonstrate that the relationship ofconcretization between legal acts, far from the banality to which it is usually associated, isreally one of a much more complex legal transaction than it looks. This checks out first by theidentification of this relationship : in itself, concretizing a legal act means nothing to anotherlegal act. It all depends on the perspective from which the problem is considered. Under aconceptual perspective, indeed there are several cases in the relationship between legalacts. Examined by the judge, this same relationship is the subject of a contentious treatment.Subsequently it is confirmed by analysis of concretizational practice between the relationshipof legal representatives. Not only is the latter nothing neutral, but it proves to be at leastdisruptive, if not subversive, with regard to the hierarchy of norms and organs. 反壟斷法(我國為公平交易法)上的效率抗辯,是指經營者通過證明結合的效率效果足以抵消或超過反競爭效果而取得反壟斷法豁免。“減損競爭”和“促進效率”這兩大因素的權衡是企業結合反壟斷控制的核心內容。 第一章為引言部分,提出本文的研究動機,並對研究方法、研究限制及論文大綱進行簡要介紹。在第二章介紹效率抗辯定義,及反壟斷法視野下普遍被接受的主要效率類型。第三章對效率抗辯制度在歐美國家的發展作了回顧。第四章則是利用經濟分析方法,計算反競爭效果,再比較分析實質性減少競爭標準和嚴重妨礙有效競爭標準之差異。第五章分三部份,第5.1章提及普遍被採納的效率抗辯模式,主要係一體分析模式、抵消分析模式和混合分析模式三種。並建議基於我國國情和《公平交易法》的相關規定,我國宜採用混合分析模式。第5. 2章就效率抗辯制度的適用標準而言,主要有價格標準、消費者剩餘標準、總剩餘標準和權重平衡標準。第5. 3章建議確立效率抗辯制度的證明標準、證明方法。尤其,就效率抗辯制度的適用條件而言,主要有效率為集中所特有、效率的及時性、效率的可證實性、在壟斷或接近壟斷的集中案件不應適用等要件。第六章建議我國明確建立安全港標準,凡屬於安全港範圍的結合不再作進一步審查。第七章綜合上述的結論,試著對我國效率抗辯制度建立提供建議 。 關鍵字:效率抗辯、事業結合、實質性減少競爭標準、嚴重妨礙有效競爭標準、抵消分析、一體分析、混合分析、價格標準、消費者福利標準、總剩餘標準、權重平衡標準 / The efficiency plea on the antitrust law refers that the intensified efficiency effect proved by the operator is sufficient to set off or stronger than the anti-competition effect so as to be exempted by the antitrust law. Competition impairment and efficiency promotion are two factors need to be traded off during the anti-monopoly control on concentration for business operators. Chapter One presents the motive , approach, framework, scope and limitations of the paper. Chapter Two introduces the definition of efficiency and the main types of efficiency which includes production efficiency, allocative efficiency, dynamic efficiency and other efficiencies. Chapter Three provides a brief history of efficiency plea practices in Europe and the United States . Chapter 4 tries to compare the Substantial Lessening of Competition test (SLC) with Significantly Impedes Effective Competition test (SIEC ) standards and try to prove the SIEC is suitable for our country. Chapter 4 also attempts to analyze anti-competitive effects of mergers by using economic analysis methods. Chapter Five is divided into three sections. Section one analyzes the main types of efficiency defense system models, including the integrated analysis model, offset analysis model and mixed analysis model. Considering the actual situation in our country and in accordance with regulations by the Antitrust Law of Taiwan, a mixed analysis mode is suggested for application. Section two focuses on the welfare standards of price standard, consumer welfare standard, the total surplus standard and the balancing weights standard. Section three recommends that standard of proof and method of proof and types of application conditions shall be established. Especially, the main types of application conditions are efficiency specific to concentration, the timeliness of the efficiency, the verifiability of the efficiency and whether the efficiency defense system is applied in the situation of near monopoly. Chapter Six defines the relevant market and suggest Critical loss analysis should be introduced for the relevant market definition. Chapter Six also suggests to adopt the " strong safe harbor" standard which means that once undertakings belong to the safe harbor range,they will no longer be subject to further review. The final chapter tries to offer some suggestions on the establishment of efficiency defense in Taiwan . A importância do princípio, muitas vezes não explicitada nas discussões sobre a constitucionalidade dos institutos e leis, é de tamanha monta que, conjuntamente com o princípio da presunção de inocência, forma a base axiológica de todo o sistema processual penal democrático. Contudo, o poder Estatal, diante do apelo popular e em resposta aos altos índices de criminalidade e episódios notórios de corrupção no Brasil tem, nos últimos tempos, a partir de uma continuidade cronológica de legislações, relativizado ou erodido os sustentáculos do princípio nemo tenetur se detegere. Tal postura Estatal consubstancia o que na criminologia se denomina de direito penal do inimigo, que servirá de substrato teórico para explicar o porquê do fenômeno de hipercriminalização e recrudescimento Estatal. A pesquisa visa, portanto, reafirmar o valor do nemo tenetur se detegere, acentuando os casos em que está a sofrer ataques e oferecer, a partir de pesquisa doutrinária e da análise jurisprudencial nacional e estrangeira, possíveis salvaguardas ao princípio com vistas a garantir que o processo penal brasileiro continue a respeitar os direitos individuais inerentes a uma ordem constitucional de fato e não meramente de direito. / [en] The principle nemo tenetur se detegere, in its double aspect privilege against self-incrimination and right to silence, is a civilizational conquest of democratic societies. The importance of this principle, which is often not made explicit in the discussions on the constitutionality of institutes and laws, is so significant that, together with the principle of presumption of innocence, forms the axiological basis of the entire democratic criminal procedural system. However, the State power, in the face of popular appeal and in response to high crime rates and notorious episodes of corruption in Brazil, has recently, from a chronological continuity of legislation, relativized or eroded the pillars of the nemo tenetur se detegere principle. This state posture consubstantiates what in criminology is called the criminal law of the enemy, which will serve as a theoretical substrate to explain the phenomenon of hypercriminalization and State recrudescence. The aim of the research is to reaffirm the value of the nemo tenetur, to highlight the cases in which it is under attack and to offer possible safeguards to the principle, based on jurisprudencial research and national and foreign case analysis, with a view to ensuring that the Brazilian criminal proceeding continues to respect the individual rights inherent in a constitutional order of fact and not merely law.

ALes instances civile et pénale parallèles suscitent des risques de contrariétés que le droit positif prévient traditionnellement par l'utilisation de la règle de l'autorité du pénal sur le civil et du sursis à statuer de l'article 4 du Code de procédure pénale. Or ce double mécanisme de la primauté du pénal sur le civil est tout à fait singulier. Il assure en effet une cohérence entre les motifs des décisions concernées, dont le droit positif ne se soucie guère au sein des autres contentieux. Il est de plus unilatéral, puisqu'il ne joue qu'au bénéfice des décisions pénales. Justifié initialement par l'importance et les garanties de vérité des décisions pénales, il s'avère cependant, à l'analyse, largement discutable. Quant à ses fondements d'abord, ce mécanisme assure certes une certaine cohérence des choses jugées, mais maintient une apparence de vérité plus qu'il ne la garantit. Or précisément, la cohérence entre motifs de jugements distincts n'est légitime qu'autant qu'elle sert l'objectif de vérité. Quant à son régime, ensuite, l'autorité du pénal sur le civil entrave la liberté du juge civil et viole, par son caractère absolu, le principe du contradictoire, tandis qu'une application systématique du sursis à statuer est source de lenteur des procédures et contrevient à l'objectif de célérité. Afin de pallier ces inconvénients, le législateur et la jurisprudence se sont d'abord efforcés de restreindre les effets les plus néfastes de ce principe, en dissociant les concepts civils et répressifs, puis en le cantonnant étroitement. Néanmoins, l'objectif de célérité l'a finalement emporté, et le législateur, par la loi du 5 mars 2007, n'a maintenu le caractère obligatoire du sursis à statuer de l'article 4 qu'à l'égard de l'action civile en réparation du dommage né de l'infraction. Le nouveau dispositif consacre désormais le principe d'une indépendance des procédures parallèles, au risque de l'incohérence, même si pour l'heure les juridictions du fond tiennent compte du risque de contrariété et maintiennent la règle de l'autorité du pénal sur le civil. Il conviendrait néanmoins de revenir sur cette dernière règle, et d'attribuer aux énonciations qui constituent le soutien nécessaire de la décision pénale, la valeur d'une présomption réfragable de vérité. Il serait ainsi tenu compte des spécificités des décisions pénales, de même que seraient préservées les exigences, parfois antagonistes, d'autonomie des juridictions, de cohérence des choses jugées, et de recherche de vérité. / AWhen civil and penal proceedings occur in parallel, there is a risk of conflicting judgments, which positive law traditionally precludes by making penal proceedings paramount and by deferring adjudication on article 4 of the Criminal Code. This double mechanism, which ensures supremacy of criminal proceedings over civil proceedings, is quite singular. Indeed, it guarantees that the justifications for the decisions made are coherent. In other contentious matters, positive law pays little attention to such concerns. Moreover, it is unilateral, since it exclusively favours criminal law decisions. Though this supremacy was initially justified by the notion that criminal law decisions guaranteed truth, analysis has shown that this is largely debatable. First of all, with regard to the foundations themselves, this mechanism of course ensures a certain coherence of the matters judged, but maintains an appearance of truth rather than a guarantee of truth. Yet, precisely, the coherence of the justifications for distinct judgments is only legitimate insofar as it seeks to determine the truth. Then with regard to the system itself, the supremacy of criminal over civil proceedings interferes with the freedom of the civil judge, and violates by its absolute nature, the adversarial principle, while the systematic deferral of adjudication slows down procedures and undermines the objective of celerity. In order to remedy these drawbacks, legislators and jurisprudence have made an effort to limit the most damaging effects of this principle, by dissociating civil from repressive concepts, then by compartmentalising each within strict limits. Nevertheless, the objective of celerity finally won the day and legislators, through the law of 5th March 2007, retained the compulsory nature of the deferral of adjudication of article 4, but only with regard to civil action for damages resulting from the offence. The new law now establishes the principle of independence of parallel proceedings, even though it carries a risk of conflicting results. For the time being, however, the jurisdictions take into account the risk of conflicting results and have maintained the supremacy of criminal proceedings over civil proceedings. It is nonetheless desirable to revise the recent law, and to incorporate in the reasons which are necessary support for the criminal decision, the value of a refragable presumption of truth. The specific nature of decisions in criminal proceedings would thus be taken into account, and the sometimes antagonistic requirement of autonomy of the different jurisdictions, the coherence of the matters being judged, and the search for truth would thus be preserved.

Le thème de la protection pénale de l'accusé, connu des pénalistes, mérite aujourd'hui d'être renouvelé sous un angle essentiellement probatoire, au regard de l'évolution actuelle du procès pénal. Situés au confluent de l'innocence et de la culpabilité, les droits et garanties accordés à l'accusé, entendu dans son acception conventionnelle, doivent être analysés en considération des principes fondateurs que sont la présomption d'innocence et les droits de la défense. L'évolution continue de ces deux principes, dans un sens diamétralement opposé, rejaillit inévitablement sur l'intensité et les modalités de la protection dont bénéficie toute personne suspectée ou poursuivie dans le cadre d'une procédure pénale.La présente étude, volontairement limitée à la phase préparatoire du procès pénal, se propose d'appréhender, dans un souci pratique et technique, les différentes évolutions jurisprudentielles et législatives opérées en la matière. Y seront ainsi abordées les principales problématiques actuellement rencontrées en procédure pénale telles que la question du statut juridique du suspect ou encore l'effectivité du principe du contradictoire dans l'avant-procès pénal. S'il peut être tentant, au premier abord, de conclure à un renforcement indiscutable de la protection pénale accordée à l'accusé, il conviendra alors de reconsidérer cette question à l'aune de l'étude des limites procédurales attachées au procès pénal. Loin d'aborder ce thème dans une optique partisane, il sera question de modération dans les propos tenus. En effet, peut-être plus que sur toute autre question de procédure pénale, il est impératif de savoir raison garder. / The theme of the criminal protection of the accused, well-known to criminal specialists, today deserves to be renewed under a probationary essentially angle, in the light of current developments in the criminal trial. Located at the confluence of innocence and guilt, the rights and guarantees granted to the accused understood in its conventional sense, must be analyzed in consideration of the founding principles of presumption of innocence and the rights of the defense. The continuing evolution of these two principles, in a sense diametrically opposite, inevitably reflects the intensity and the terms of the protection afforded any person suspected or prosecuted under criminal proceedings.This study deliberately limited to the pre-trial phase, proposes to understand, in a practical and technical problems, the various case law and legislative developments carried out in the field. Will thus addressed the key issues currently faced in criminal proceedings such as the question of the legal status of the suspect or the effectiveness of the adversarial principle in the preliminary criminal trial. While it may be tempting, at first, to conclude an indisputable strengthening the criminal protection afforded to the accused, then it will be necessary to reconsider this issue in terms of the study of procedural limitations attached to the criminal trial. Far from addressing this issue in a partisan way, it will be about moderation in the remarks. Indeed, perhaps more than any other issue of criminal procedure, it is imperative to keep a sense of proportion.

This thesis deals with the institute of summary preliminary proceedings in the context of past and current legislation and also the reasons that led to its introduction into law. The paper also outlines the objectives of summary proceedings and the use of the institute for other criminal laws. In this work there are also defined summary preliminary proceedings within individual forms of pre-trial proceedings. In some cases, the work compares the above mentioned institute of summary preliminary proceedings with foreign legislation. This study also defines the essence of summary preliminary proceedings and acts carried out in it. At the same time the author tries to define the legal conditions for holding summary preliminary proceedings, further the course of summary preliminary proceedings. The paper also describes the course of summary preliminary proceedings, from the record of initiation of criminal proceedings, to notification about suspicion, further deals with the question of proving evidence in summary proceedings. The paper also discusses in detail the specific entities acting in summary preliminary proceedings. Malgré le peu de fondements écrits consacrés à la justice dans le texte de la Constitution du 4 octobre 1958, le Conseil constitutionnel, en réalisant un travail d’actualisation à partir de la Déclaration des droits de l’homme et du citoyen, a permis l’émergence d’un droit constitutionnel processuel, construit autour de principes directeurs. Ceux-ci peuvent être répartis dans trois catégories : deux principales, selon que l’acteur du procès prioritairement concerné soit le juge ou les parties et une troisième, complémentaire, celle des garanties procédurales, permettant de favoriser les qualités essentielles du juge et de contrôler le respect des droits des parties. Une gradation des exigences du Conseil constitutionnel est discrètement perceptible entre les deux premières catégories de principes, plus facilement identifiable entre celles-ci et la dernière famille. Cette échelle décroissante de « densité » des principes directeurs du procès témoigne d’une véritable politique jurisprudentielle en matière de droit constitutionnel processuel, qui met l’accent sur l’accès au juge, doté des qualités indispensables à l’accomplissement de sa mission juridictionnelle. Toutefois, aussi satisfaisante que soit l’action du juge constitutionnel français à l’égard du droit du procès, celle-ci nécessiterait aujourd’hui le relais du constituant, afin de moderniser le statut constitutionnel de la justice. / In spite of a relatively low number of written dispositions dedicated to justice inside of the body of the Constitution of October 1958 4th, the constitutional Council, while updating this text through the Declaration of Human Rights, contributed to the development of a procedural constitutional law, which is structured around guiding principles. Those principles can be classified within three different categories : two major categories depend on the trial actor that is primarily concerned, either the judge or the parties; a third and additional category pertaining to procedural protections, fosters the essential qualities of the judge and secure the protection of the parties’ rights. A gradation of the requirements of the constitutional Council is discreetly perceptible between the first two categories of principles, and more easily identifiable between those first two categories and the last one. This decreasing scale of “density” yoked to the trial guiding principles highlights a genuine judicial policy when it comes to procedural constitutional law, emphasizing access to the judge, whom is given essential qualities in order to achieve its judicial duty. However, the action of the French constitutional judge, as satisfactory as it is towards the rights of the trial, would easily support the intervention of the constituent power in order to update Justice’s constitutional status.
