The impact of organisational justice on ethical behaviourShah, N., Anwar, S., Irani, Zahir 12 November 2016 (has links)
Yes / Within the workplace, justice is influenced by the interpersonal relationships between colleagues and/or management among other things. The main reason for this research is to examine the correlation between organisational justice and the ethical behaviour of employees. Based on the literature, the conceptual model developed in this paper integrates distributive, procedural, interpersonal and informational justice in relation to ethical behaviour. By applying an adapted survey questionnaire, data were collected from teaching staff at public sector higher education institutions. Multiple regression analysis was applied to 360 samples and this showed that distributive and procedural justice have a more positive and significant impact than informational and interpersonal justice on the ethical behaviour of employees. This is an empirical study which may contribute to the literature on ethical behaviour, organisational development and employee development.

“THE POLICE ARE HERE TO MAKE US FEEL SAFE, BUT THEY DON’T DO THAT AT ALL” : A qualitative inquiry on youthful experiences and attitudes towards the policeBruus, Simon January 2024 (has links)
This study explores the formation of attitudes towards the police from the experiences of young, ethnic minority males residing in the Danish ‘Vestegnen’ municipalities, situated within contemporary research on legal cynicism in the Nordic countries. Based on data from semi-structured interviews with five respondents, the study respondents demonstrate formations of negative attitudes towards the police from experiences - both direct and vicarious - of harbouring unjustified suspicion, different forms of police misconduct, and feeling purposely humiliated by the police. Conversely, the study respondents demonstrate formations of positive attitudes towards the police from experiences of feeling respected by the police, despite engaging in unlawful activity and having a positive relation to local police officers with a community-oriented approach. Following the notions of legal cynicism, the study suggest that the young men did not portray an absolute erosion of faith towards the police, as they generally approve of the police function in society. In closing, the study concludes by emphasising the importance of procedural just policing towards young, ethnic minority males from marginalised areas, as their compliance with law enforcement relies greatly on their experienced treatment. Following this, the allocation of resources towards local police officers with a community-approach may be a step towards effective crime-control efforts aimed at preventing youthful alienation from the police force.

Perceptions of Procedural Fairness and Discrimination Based on Sexual Orientation : An Experimental Vignette Study Comparing AI-Assisted vs Human Recruitment ProcessesHahne, Anne, Petta, Eleni January 2024 (has links)
The use of artificial intelligence (AI) tools is rapidly increasing in organizations worldwide. The purpose of this cross-sectional experimental study is to compare perceptions of procedural fairness and perceptions of discrimination based on sexual orientation in AI-assisted versus human recruitment processes. Using vignettes, we asked participants (N = 278) to assess recruitment processes and fictional applicant’s LinkedIn profiles where sexual orientation was signaled. In more detail, after participants were informed about the negative decision made either by the AI tool or the human recruitment team, they were asked to report their perceptions of procedural fairness and perceptions of discrimination based on sexual orientation. We used independent samples t-tests and two-way ANOVA to analyze our main hypotheses. Our findings reveal that AI-assisted recruitment processes are perceived as less procedurally fair than human recruitment processes. In contrast, the results indicate that AI-assisted recruitment processes are perceived as less discriminatory for non-heterosexual applicants compared to heterosexual applicants. The findings cover a gap in research on perceived discrimination based on sexual orientation in AI-assisted recruitment. Moreover, by shedding light on the complexities of perceptions concerning AI-assisted and human recruitment processes, our findings underline the emerging need for organizations to invest in AI literacy, increase employees’ AI familiarity, and openly commit to AI legislation. This qualitative case study investigated how lesson study influenced teachers’ pedagogical strategies and content knowledge by leveraging the interplay between conceptual understanding and procedural fluency, with conceptual knowledge forming the foundation for procedural fluency in the planning and implementation of fraction-based mathematics tasks. The study aimed to address two research questions: (1) How does the engagement of teachers in the creation and analysis of fraction-based mathematics tasks in lesson study influence their instructional decision-making processes? and (2) How do teachers construct pedagogical strategies that integrate procedural and conceptual knowledge through lesson study? The sample size consisted of seven elementary school teachers who worked collaboratively to modify fraction tasks. Triangulated data from observations and interviews revealed two key findings. First, the study’s findings highlight the transformative power of collaborative professional growth among teachers and their subsequent shift towards engaging in more conceptual, student-centered mathematics instruction, addressing the first research question. Second, the findings suggest that lesson study can be a valuable tool for enhancing teachers’ pedagogical content knowledge and improving fraction instruction when utilized consistently, thus answering the second research question. Implications for future teacher education are discussed, emphasizing the importance of sustained, collaborative learning opportunities to support conceptual understanding in mathematics education.

"Ett snäpp högre" : En studie av historielärares hanterande av tankeredskap.Estenberg, Martin January 2016 (has links)
Abstract The aim with this study is to examine how practicing history teachers in upper secondary school deal with historical thinking concepts. The three main questions are: which concepts do teachers use in their courses and when do they use them? How can teachers’ use of different historical thinking concepts be described in terms of reconstruction and construction? What factors influence teachers when they work with historical thinking concepts? To answer these questions, the material, for example tests, lesson plans and notes of seven teachers has been analyzed. These analysis were followed by interviews with the teachers. The empirical data have been handled in two steps. The first step is a survey of what historical thinking concepts teachers use and when they use them. The survey was done as a detailed reading of the teachers’ material. In this survey two historical thinking concepts, evidence and cause and consequence, have been selected for further analysis, which is the second step. The results show that when teachers deal with the historical thinking concept of evidence they show their students models and ways to handle evidence. This is not the case when teachers handle the historical thinking concept of cause and consequence. Models are shown here as well but not to the same extent. The result also shows that the teachers’ handling of evidence in a greater extent leads to construction compared with their handling of cause and consequence. The explanations provided in the study also point to the different character between the two concepts and what form of test the teachers’ use and what words are used to communicate for example cause and consequence. Furthermore, the explanations also indicate that the teachers’ view of what historical knowledge contains of, together with what kind of students and what other subject they teach play some part in their dealing with historical thinking concepts. / Vilka tankeredskap hanterar historielärare i sin undervisning och när framkommer dessa i de kurser lärare undervisar i? Hur hanterar lärare tankeredskap i termer av rekonstruktion och konstruktion? Dessa frågor ställs i denna studie som bygger på en analys av sju lärares undervisningsmaterial och på uppföljande intervjuer med lärarna. I den första delen kartläggs de tankeredskap som lärare hanterar i hela kurser som de undervisar i. Ett resultat av denna del är att orsak och konsekvens är det dominerande tankeredskapet som lärare hanterar. Ett annat resultat är att tankeredskapens förekomst i lärarnas kurser uppvisar stora variationer. I den andra delen sker en fördjupad analys av två tankeredskap, källor och källkritik samt orsak och konsekvens. I denna analys framkommer att lärarnas hanterande av källor och källkritik i större utsträckning kan beskrivas i termer av konstruktion, jämfört med lärarnas hanterande av orsak och konsekvens. Previous issue date: 2016-02-22 / The proposal of this thesis is to demonstrate that the effects attributed by the Supreme Court on judicial review can not be defined without proper bond with the previous steps to the judgment of the legal action; and this modulation, considered the technique to restrict the effects of the declaration of unconstitutionality, or determine that a statement only be valid from the final judgment, from decision or other time as may be fixed, and this effects are more relevant in relation to norm of tax law, because of weakening of judicial review in a special appeal, and the strengthening of abstract judicial review, which is the analysis of tax law without regard to the particular case. As a methodological option, the thesis covers the fields of Constitutional Law, Tax Law and Procedural Law, supported by legal texts and decisions of the Supreme Court, anchored in one of the elements of the Paulo de Barros Carvalho theory of tax law, and its construction within the jurisdiction, and Pontes de Miranda theory of preponderance of loads efficacy, in order to demonstrate that there is a specific efficacy in relation to the court decision, which is to procedural efficacy. From these premises, the thesis contains a defense that modulation is the result of a link between the nature of the legal action and its efficacy from the force generated by procedural technique of kinetic energy. In the end, we present suggestions that the modulation could not be an isolated act in the judgment of Supreme Court, on the constitutionality control, with suggestion's split into three guidelines, to serve as parameters in the use of modulation, from the most rigorous, and through a median suggestion, to arrive at a proposal to set minimum procedural standards / A proposta da presente tese consiste em demonstrar que os efeitos atribuídos pelo Supremo Tribunal Federal no controle de constitucionalidade não podem ser definidos sem o devido vínculo com as etapas anteriores ao julgamento da ação direta de inconstitucionalidade; e essa modulação, tida como a técnica de restringir os efeitos da declaração de inconstitucionalidade, ou de determinar que tal declaração só tenha validade a partir do trânsito em julgado, da decisão ou de outro momento que venha a ser fixado, se mostra mais relevante em relação à norma tributária, por causa do enfraquecimento do controle de constitucionalidade realizado em recurso extraordinário, e do fortalecimento do controle abstrato de constitucionalidade, em que se tem a análise da norma tributária independentemente da existência de caso concreto. Como opção metodológica, a tese percorre os caminhos do Direito Constitucional, do Direito Tributário e do Direito Processual, tendo como suporte textos jurídicos e decisões do Supremo Tribunal Federal, ancorada em um dos elementos da teoria da norma tributária de Paulo de Barros Carvalho, qual seja, o da sua construção no âmbito da jurisdição, e na teoria da preponderância das cargas de eficácia de Pontes de Miranda, a fim de demonstrar que existe uma eficácia específica em relação à decisão judicial, que é a eficácia processual. with the inclusion of principles and procedural warranties within it. These did not exist
before and provoke effects into all civil procedural jural order. The principles and
constitutional warranties are the basis of the procedural system, remanding the right
operator to investigate and reread the procedural rules from National Constitution. The
Constitution is embodied in a historical period and cannot be separated from this time
concrete reality. The principles and the warranties point the direction and whatever the
rule supported by them is not supposed to contradict the imposed North; thus, the
interpreter has no right to any conclusion that might vitiate all constitutional structure. It
is undisputed that the1988 Constitution has brought a new conception of State and the
values assured by it. Specifically concerning the civil procedure, the procedural system,
as mentioned before, supported by constitutional fundamental principles and imposing a
jural political order as a whole, has been maintained upon four bases: the jurisdiction,
the action, the defense and the proceeding. These constitute the normative constitutional
structure and the present work seeks to, through examining the constitutional principles
and warranties of the access to justice and adversary, reevaluate the institute of
procedural substitute and the res judicata in the presence of constitutional normative
force of mentioned principles and warranties / A partir da Constituição de 1988, o sistema processual brasileiro sofreu profundas mudanças com a inclusão de princípios e garantias processuais no corpo da Lei Maior, os quais antes não existiam e irradiam efeitos sobre todo o ordenamento jurídico processual civil. Os princípios e garantias constitucionais são estruturantes do sistema processual, remetendo o operador do direito a investigar e reler as normas processuais a partir da Constituição Federal. A Constituição está condicionada a um momento histórico, não podendo se separar desta realidade concreta de seu tempo. A nova realidade constitucional resgatou a força normativa da Constituição. Os princípios e garantias apontam a direção e qualquer que seja a norma que neles se sustenta, não pode contrariar o norte imposto; não cabe, pois, ao intérprete nenhuma conclusão que possa contrariar os princípios e garantias constitucionais, sob pena de comprometer toda a estrutura constitucional. Não há a menor dúvida de que a Constituição de 1988 trouxe uma nova concepção de Estado e valores por ele protegidos e, no que diz respeito ao processo civil em particular, o sistema processual, como já afirmado, sustentado em princípios fundamentais constitucionais impondo uma ordem político-jurídica como um todo, tem a sua sustentação em quatro alicerces: a jurisdição, a ação, a defesa e o processo. guides the procedure with elements which prove the reasonableness of each part as
necessary, but linked to the truthfulness of the individual allegations. Truth is a theme
which concerns not only morality but also the value of presumed good-faith, an
indispensable element throughout the proceedings. The thesis treats of the
procedural responsibility of the lawyer in litigation concerning bad-faith. First of all, it
presents a history regarding truthfulness, beginning with the Bible, passes on to
ancient Greece, proceeds to the Romans, hears the Iberians and considers the
Codes of 1939 and 1973 - all this to bring from the past to the present the importance
of the truth in any procedure. It is also understood that there exists a procedural
deontology in which it is indispensable to include morality, ethics and good-faith as
well as the meaning of such words as power, onus, duty, rights and obligation, since
all of them occur in the evolution of the proceedings. The same is confirmed as
regards the principles. With this basic idea, an attempt is made to theorize the
presuppositions of litigation regarding bad-faith, beginning with the intervening party,
the litigation and the bad-faith itself. Next, concerning the elements of bad-faith, an
evaluation is made of the abuse of the law and its difference from a procedure for
bad-faith, followed by the typology which identifies the malevolent litigation. Along
with these considerations, the role of the lawyer will be discussed, vis-a-vis his client
and before the law, as a way to hold him responsible for the proceedings in bad-faith
both directly and in the files of the proceedings which gave rise to the fact. The
intention is to put an end to the myth that having made a poor choice of the
professional should fall on the proceedings, since this would have occurred as
blameworthy in eligendo . To summarize, this thesis proposes to make lawyers
responsible for any bad-faith in the proceedings, presuming that, in the majority of
cases, the professional responsibility of the lawyer occurs / O processo atual é um instrumento técnico, guarnecido por um componente ético.
Trata-se de instruí-lo, doravante, com elementos probatórios das razões de cada
demandante, mas vinculados à veracidade das alegações individuais. A verdade não
é apenas um tema do qual se ocupa a moral, mas um valor presumível pela boa-fé e
indispensável ao fim do processo. Na tese, que tratará da sanção processual ao
advogado pela litigância de má-fé, faz-se, primeiramente, um histórico da veracidade
com início na Bíblia, transita-se pela Grécia antiga, incluem-se os romanos, ouvemse
os ibéricos, passeia-se pelos códigos de 1939 e 1973 para trazer do passado
ao presente a importância da verdade no processo. Também, se entende que há
uma deontologia processual, sendo indispensável pensar a respeito da moral, ética,
boa-fé, bem como o sentido das palavras: poder, ônus, dever, direitos e obrigações,
pois todos estarão presentes na tramitação do processo. O mesmo sendo
confirmado quanto aos princípios. Com esta ideia básica, tenciona-se teorizar os
pressupostos da litigância de má-fé, começando pela parte, interveniente, a
litigância e a má-fé. Seguindo-se com os elementos da má-fé, quando se fará
avaliação do abuso do direito e sua diferença da má-fé processual, mostrando-se,
sucessivamente a tipologia, que identifica a litigância malévola. Com todos estes
conceitos, vai-se discutir o papel do advogado privado frente ao constituinte dele e
diante da Justiça, como forma de torná-lo responsável pela má-fé processual
diretamente e nos próprios autos do processo, que se deu o fato. Pretende-se
romper o mito de que, a falta pela má escolha do profissional, deve responsabilizar a
parte processual, porque esta teria incorrido na culpa in eligendo . Enfim, a
pretensão da tese é tornar o advogado privado responsável pela má-fé processual ,
pois, na maioria das vezes, ocorre responsabilidade profissional dele, dando ensejo
à sanção processual do advogado

Previous issue date: 2015-10-29 / This works derives from the certainty that judicial reviews are the main cause for the delays in lawsuits, specially at the Labor Courts, in which the plaintiff or the defendant are sometimes forced to waive their rights due to such lawsuits delays. It shall discuss alternatives, in the Extraodinary Review Procedure to adjust it to the constitutional procedural principles, since in practical terms one can verify 3 judicials instances, while we maintain that the Superior Labor Court should be restricted to its role as an extraordinary instance. This is not possible when one can not distinguish the effects of an Ordinary Review from that of the Extraordinary Review. The Extraordinary Review is subject to the competence of the panels of the Superior Labor Court and applicable to review the rulings of the Regional Labor Courts on Ondinary Reviews of individual claims whenever the requirements of CLT's article 896 are present. The limitation of the applicability of the Extraordinary Review is not enough to grant TST the status of a true Extraordinary Review Court. The scope of this work is to establish the exact function of the Superior Labor Court and its efectiveness, based upon the constitutional procedural principles, specially the due process of the law and the reasonable procedural length, which comprises the effectiveness and fast-track of the procedure by analysing the effects of both Ordinary and Extraordinary Reviews / Este trabalho tem origem na crença de que os recursos são os principais responsáveis pela morosidade dos processos, mormente na justiça do trabalho, onde a parte se vê obrigada, muitas vezes, a abrir mão de seus direitos em razão da demora judicial na solução do processo. Discutiremos alternativas, no âmbito do recurso de revista, a fim de adequá-lo aos princípios constitucionais do processo, pois o que se verifica na prática é a existência de três instâncias judiciais, enquanto que defendemos que o TST deve se limitar à sua natureza de instância extraordinária. E isso não é possível quando os efeitos dos recursos de natureza extraordinária não se distinguem dos efeitos dos recursos de natureza ordinária. O recurso de revista é cabível para turmas do TST, contra as decisões proferidas em grau de recurso ordinário, em dissídio individual, pelos Tribunais Regionais do Trabalho, quando presentes as hipóteses do artigo 896 da CLT. A limitação ao cabimento do Recurso de Revista é insuficiente para transformar o TST em verdadeiro órgão de natureza extraordinária. O propósito deste trabalho é estabelecer a exata função do Tribunal Superior do Trabalho e sua eficácia, com base nos princípios constitucionais do processo, em especial o devido processo legal e o princípio da duração razoável, que engloba a efetividade e a celeridade processual, analisando os efeitos dos recursos de natureza ordinária e extraordinária

Previous issue date: 2011-05-17 / Over the last sixteen years, Brazil has gone through important legislative modifications,
which have been motivated by the need, in the economical field, of reducing the interests
rate and the banking spread. The changes that have occurred, not only in civil procedure,
were encouraged by the financial institutions and by the Central Bank of Brazil, through a
series of annual reports. The model in which the modifications were based had as its
foundation the paradigm that the lack of effectiveness in the civil procedure was the result of
a system that granted many guarantees to the creditor, which would make it difficult for the
credits to be obtained in court. In the field of substantial law, the legislation would obstruct a
series of contractual practices carried out by the financial institutions, once abusive. The
Judicial System, when interpreting these rules in force, would have an inadequate position,
contrary to the interests of the financial institutions. The system would suffer from a moral
risk. The legislation has been modified. Licit situations have become illicit. New forms of
enforcement and its instruments have been created or improved. Although, the system still
suffers from the sluggishness for parties to obtain their credits in court. The interests rate
and the banking spread remain high. The diagnosis was mistaken. The obtaining of the
credits in court was slow not because the Judiciary System was being lenient with de
debtors, or because the legislation was retrograde or excessively protective. The abuse of
procedural right by the financial institutions, with the sole aim of enforcing the contractual
illegalities and to force the performance of undue installments is the cause for the delay on
the closure of the law suits. The financial institutions, assumingly acting in bad faith, insist on
using excessive procedural tools, in order to try to make illegality prevail. The process ends
up operating not as a means of enforcing justice, but as a way to blackmail and to
discourage the debtor of proceeding in the defense of his legitimate rights. However, one of
the damaged parties by the abuse of procedural right is the creditor himself, as far as, with
the reaction of the good faith debtor, the process tends to procrastinate, not because the
debtor is not right, the opposite: the debtor is right and the creditor can t cope with this fact.
Notwithstanding, the abuse of procedural right can only succeed when there is an active or
omissible collaboration of the Judicial System. Jurisdiction becomes a means of realization of
the abuse, instead of being the least likely place for it to be found in. At last, all the parties
involved lose with the abuse of procedural right: the debtor, once, in some moment, could
give up, even having the law on his side; the creditor, because it will take a long time for him
to obtain his credit; the State, once the Judicial System must administrate a litigation which
could have been solved way before. Also, the collectivity, under a diffuse point of view. The
abuse of procedural right needs treatment, and this could be preventive, corrective or

material, a legislação impediria uma série de práticas contratuais das instituições
financeiras, porque abusivas. O judiciário, ao interpretar tais normas vigentes, teria uma
