La política migratoria ecuatoriana en el contexto suramericano 2007-2013Escudero Durán, Lorena 06 March 2017 (has links)
Esta tesis doctoral es un estudio en profundidad y un análisis crítico de la política migratoria llevada a cabo por el Estado ecuatoriano en el periodo comprendido entre el año 2007 al 2013. La propuesta y la ejecución de estas políticas son producto de un proceso de transformación que vive Ecuador después de la irrupción de la peor crisis de su historia contemporánea, que propició la salida masiva de ecuatorianos al exterior como alternativa de vida social y colectiva. Esta transformación se realiza a la luz de una nueva visión de desarrollo, alternativa a las políticas neoliberales aplicadas en Ecuador y en América Latina en las últimas décadas del siglo XX y primeros años del siglo XXI, en la que se pone en el centro de las preocupaciones a las personas y no a los intereses del capital. La nueva política migratoria responde a esta visión de desarrollo y pretende garantizar los derechos de los migrantes y reconocerles el papel como actores transnacionales de desarrollo humano, en consonancia con el compromiso del nuevo gobierno y los preceptos de la Constitución de la República refrendada por el pueblo ecuatoriano en el año 2008. Para formular y ejecutar esta política se crea en 2007 una nueva institución: la Secretaría Nacional del Migrante (SENAMI) que desarrolla proyectos innovadores que pretenden ser coherentes con la apuesta política del momento. Ecuador, en este periodo, asumió una vocería en la región Suramericana en defensa de la primacía de los derechos de las personas en movilidad y el correspondiente rechazo a todas las formas de discriminación a nivel social o institucional, logrando incorporar en la agenda regional elementos importantes de su propuesta de desarrollo humano para las migraciones. La lógica que subyace a esta investigación es demostrar la hipótesis que sustenta este trabajo: la coherencia entre la política pública propuesta y ejecutada en estos años con la realidad del país, las demandas de las personas migrantes y su nueva visión de desarrollo.

La violencia hacia las mujeres en el Perú se ha convertido en una problemática social de atención prioritaria. Según la ENDES (Encuesta Demográfica y de Salud Familiar), del año 2010 al año 2018, los casos de violencia física en mujeres se han reducido solo en un 6%, un porcentaje muy bajo para un periodo largo de tiempo.
El Centro de Apoyo Integral para la Mujer Víctima de Violencia, se plantea con el fin de ayudar a disminuir la problemática que atraviesa el distrito de Comas en la actualidad, además de la precaria infraestructura de los establecimientos ubicados en este distrito que ofrecen ayuda a las mujeres e hijos que sufren de violencia.
En este proyecto se busca que las mujeres y sus hijos, quienes hayan sufrido de algún tipo de violencia, puedan recibir el apoyo que necesiten tales como asistencia psicológica, asistencia legal, asistencia médica, capacitación y albergue con el fin de aportar a su autonomía y a una vida digna y libre de violencia. / Violence against women in Peru has become a social problem of priority attention. According to the ENDES (Demographic and Family Health Survey), from 2010 to 2018, cases of physical violence in women have decreased by only 6%, a very low percentage for a long period of time.
The Integral Support Center for Women Victims of Violence, is proposed in order to help reduce the problems that the district of Comas is currently experiencing, in addition to the precarious infrastructure of the establishments located in this district that offer help to women and children who suffer from violence.
This project seeks that women and their children, who have suffered some type of violence, can receive the support they need such as psychological assistance, legal assistance, medical assistance, training and shelter in order to contribute to their autonomy and a life with dignity and free from violence. / Tesis

El presente trabajo de investigación, plantea la construcción de un Hogar Refugio Temporal para las víctimas de violencia familiar en la ciudad de Huamanga, Ayacucho. Para ello se analizó la situación actual de la ciudad con respecto a dicho problema, observando así una cantidad considerable de afectados en la zona, pues son un aproximado de 220 personas; las que se encuentran sin atención en la actualidad, dichos afectados no solo enfrentan problemas psicológicos, sino también problemas sociales, culturales, problemas de readaptación y falta de hogar.
El proyecto prevé empezar a ser parte de la solución, con el diseño de espacios que cubran en una medida razonable las necesidades de los usuarios, teniendo en cuenta la arquitectura multisensorial y las diferentes actividades que necesitarán los hospedados para su debida recuperación. / This thesis work, proposes the construction of a Temporary Shelter Home for victims of family violence in the city of Huamanga, Ayacucho. For this, the current situation of the city was analyzed with respect to this problem in the actual context, thus observing a considerable number of affected people in the area, as there are approximately 220 people, who are currently without care. Those affected people not only face psychological problems, they also face social and cultural problems; rehabilitation problems and homelessness.
The project plans to start being part of the solution, with the design of spaces that cover the needs of users to a reasonable extent, taking into account the multisensory architecture and the different activities the victims will need for their proper recovery. / Trabajo de investigación

humanidade e foram responsáveis pode moldar a sociedade. Os migrantes precisam
e devem ser acolhidos com dignidade, todavia é importante analisar as causas de
sua migração como forma de garantir que as pessoas só migrem no exercício de sua
livre escolha. Nenhum ser humano deve ser forçado a migrar, a sair do seu país para
buscar condições de vida dignas, se expondo aos inúmeros riscos e problemas
oriundos desse tipo de migração. A responsabilidade de proteger tem potencial para
ser uma ferramenta útil na prevenção de migrações forçadas considerando a
segurança humana como uma meta a ser garantida e a soberania como uma
responsabilidade e não, um direito absoluto do soberano. Além disso, a segurança
humana, através da análise das situações inerentes à sua ausência é um importante
sistema de alerta precoce visando a uma atuação com menos efeitos colaterais pela
detecção de inseguranças humanas nos estágios iniciais. Embora seja importante a
análise ainda que sucinta de alguns casos específicos onde a responsabilidade de
proteger tenha sido, ou não, utilizada, o enfoque será prognóstico e focado na

do instituto em si. / [en] Migrations are population movements that exists since the beginning of
humanity and were responsible for shaping the society. Migrants need and should
be welcomed with dignity, but it is also important to analyze the causes of their
migration as a way of ensuring that people only migrate at their free agency. No
human being should be forced to migrate, to leave their country in order to seek for
a decent living condition, exposing themselves to the numerous risks and problems
that this type of migration brings with it. A study of how the responsibility to protect can be an useful tool to prevent forced migrations taking human security as a goal to be guaranteed and sovereignty interpreted as a responsibility, not an absolute
right of the sovereign. In addition, human security through the analysis of situations
inherent to its absence will be considered as an important early warning system in
the search for a way of action with fewer side effects by detecting human
insecurities in the early stages. A briefly analyze of some specific cases where the
responsibility to protect has been used or not, is important. However, the focus will
be prognostic with focus on the potential of the concepts and principles, even if in
the past they have been misused. As will be shown, many of the problems in
applying the responsibility to protect came from political issues rather than from
the concept itself.

[pt] O presente trabalho realizou análise acerca do conceito de Grave e Genera-lizada Violação de Direitos Humanos (GGVDH), a fim de investigar quais são as fundações da definição ampliada de refugiado e como se deu a sua construção no Brasil. Através de pesquisa bibliográfica e documental, os dados usados nesta Dissertação de Mestrado foram coletados das seguintes fontes: teses, dissertações, livros e artigos; relatórios do governo, de organizações internacionais e não go-vernamentais; tratados, declarações e legislações. Esta dissertação buscou apre-sentar a arquitetura protetiva internacional da pessoa humana, investigando as conexões com os diversos mecanismos do Direito Internacional dos Direitos Hu-manos, suas complementaridades, seus regimes e aplicações regionais e nacionais para, então, explorar a trajetória do refúgio no Brasil não somente até a construção do conceito de GGVDH pelo governo, mas também no seu reconhecimento. Em um primeiro momento, deu-se a apresentação do arcabouço jurídico internacional, sua interdependência e relevância para a proteção humana, culminando na Decla-ração de Cartagena (1984) e seus processos revisionais. Posteriormente, desen-volveu-se o histórico brasileiro em matéria de refúgio, chegando ao período de redemocratização e incorporação do conceito de GGVDH pela Lei n° 9.474/1997. Por fim, passou-se à breve análise do reconhecimento de refúgio no Brasil por GGVDH, no intento de mapear o posicionamento do governo frente a essa defini-ção, sua aplicação e limitações, apontando algumas nuances e conclusões. / [en] The present study undertook an analysis about the concept of Gross and Generalized Violation of Human Rights (GGVDH), in an attempt to understand what the foundations of the extended definition of refugee are and how it has been constructed in Brazil. Through a bibliographic and documental research, the data used in this Master s Thesis was collected from the following sources: theses, dissertations, books and articles; reports from government, international and non-governmental organizations; treaties, declarations and legislation. This thesis sought to present the international protective architecture of the human person, investigating its connections with the various mechanisms of International Human Rights Law, their complementariness, regimes, regional and national applications to then, explore the refuge trajectory in Brazil, not only until the construction of the GGVDH concept by the government, but also its recognition. Initially, the international legal framework was presented, their interdependence and relevance to the human protection, culminating in the Cartagena Declaration (1984) and its revision processes. Subsequently, it demonstrated the Brazilian history in terms of refuge, up until the period of re-democratization and incorporation of the GGVDH concept by the Law n 9.474/1997. Finally, it presented a brief analysis of the refugee status recognition under GGVDH in Brazil, in an attempt to map the gov-ernment’s position in relation to this definition, its application and limitations, pointing out some nuances and conclusions.

[pt] Esta tese de doutorado investiga o acolhimento humanitário de pessoas LGBTI+
pela Operação Acolhida (2018-2022) como resposta do Brasil para o fluxo de
migrantes e refugiadas venezuelanas no país, pensando um panorama dos serviços
oferecidos e das questões que surgem no acolhimento e na integração dessa
população no território brasileiro. Uma abordagem da performatividade de Judith
Butler amparada por Jacques Derrida será usada como estratégia analítica para
entender as práticas, os discursos, os protocolos e as regras empreendidas nesse
caso pensando a reiteração de normas de gênero, sexo e sexualidade, do
humanitarismo e de Estado. Nesse sentido, o texto é um enquadramento parcial de
reiterações performativas da Operação Acolhida que podem (re)criar
(im)possibilidades não-intencionais para migrantes e refugiadas venezuelanas
LGBTI+. A realidade social LGBTI+fóbica traz consigo atravessamentos culturais
locais e transfronteiriços em que imperam lacunas, silêncios, segregação e
violências. Enquanto a lógica humanitária traz consigo as narrativas e protocolos
da crise, da emergência estabelecendo pressa e reforçando ausências constitutivas;
e o Estado traz consigo a demanda da contenção, da gestão e governo das
populações e espaços, criando narrativas de (des)acolhida. Nessa sobreposição
normativa e regulatória do contexto de acolhimento da Operação Acolhida, a
população migrante e refugiada LGBTI+ necessita de integração a médio e longo
prazo e de políticas que garantam seus direitos no país. Demandas de
empregabilidade, saúde e assistência social se multiplicam em um universo em que
o pensamento de curto prazo é reproduzido de forma central. Os limites, problemas
e avanços da estrutura logística humanitária são foco do trabalho e delinearão os
achados da pesquisa apontando para uma reflexão em torno da adaptação de
protocolos e de uma crítica dialógica. / [en] This PhD thesis investigates the humanitarian reception of LGBTI+ people from
Operação Acolhida (2018-2022) as a response from Brazil to the flow of
Venezuelan migrants and refugees in the country, thinking about an overview of
the services offered and the issues that arise in the encounter and integration of this
population in the Brazilian territory. An approach to Judith Butler s performativity
supported by Jacques Derrida will be used as an analytical strategy to understand
the practices, discourses, protocols and rules undertaken in this case thinking about
the reiteration of norms of gender, sex and sexuality, humanitarianism and the State.
In this sense, the text is a partial framing of performative reiterations of the
Operação Acolhida that can (re)create unintentional (im)possibilities for
Venezuelan LGBTI+ migrants and refugees. The LGBTI+phobic social reality
brings with it local and international cultural crossings in which gaps, silences,
segregation and violence prevail. While the humanitarian logic brings with it the
narratives and protocols of crisis, of emergency, establishing haste and reinforcing
constitutive absences; and the State brings with it the demand for containment,
management and government of populations and spaces, creating (un)welcoming
narratives. In this normative and regulatory overlap of the reception context of
Operação Acolhida, the LGBTI+ migrant and refugee population needs medium
and long-term integration and policies that guarantee their rights in the country.
Employability, health and social assistance demands multiply in a universe in which
short-term thinking is centrally reproduced. The limits, problems and advances of
the humanitarian logistical structure are the focus of this work and will outline the
research findings, pointing to a reflection around the adaptation of protocols and a
dialogic critique.

Civil (OSCs) brasileiras na integração local de refugiados e em que medida estas assumem

modelo tripartite ou de responsabilidade compartilhada que possibilita essa transferência de
responsabilidade do Estado para as OSCs. Para tanto, este trabalho realiza uma revisão da
literatura no tema e fundamenta essa análise com entrevistas realizadas em campo. Assim, no
primeiro momento, este trabalho analisa os compromissos do Direito Internacional dos
Refugiados e da legislação brasileira em vigor a respeito de refúgio e migração. Posteriormente,
o trabalho expõe um breve debate sobre o conceito de integração local. Por fim, é analisado o
papel da sociedade civil organizada na integração local de refugiados no Brasil, incluindo a
visão dos entrevistados, e então, expostas as conclusões a partir do evidenciado. / [en] This dissertation investigates how Brazilian Civil Society Organizations (CSOs)
develop the local integration of refugees, and to what extent they are willing to take on
responsibilities that originally belong to the State under the national and international
commitments signed by it. Within this context, this work highlights the tripartite or shared
responsibility model s dynamics that enable this assignment of responsibility from the State to
the CSOs. To pursue this argument, this work relies on a literature review and interviews
carried out in the field throughout the research. Firstly, this work will analyse the commitments
of International Refugee Law and the current Brazilian legislation regarding refuge and
migration. Then, this work follows by exposing a brief discussion of the concept of local
integration. Finally, this dissertation will look at the role of organized civil society in the local
integration of refugees in Brazil. In this part, this work will consider the perspectives brought
by interviewees to advance its argument, and then, conclusions are exposed from the evidence.

[pt] Diversos processos nos últimos vinte e cinco anos vêm transformando o entendimento das fronteiras e da mobilidade internacional, com um número cada vez maior de pessoas que se deslocam e de fronteiras que se multiplicam para além dos limites territoriais de cada estado. Ao lado desses processos, que alteram a velocidade do movimento, criam novos caminhos para a circulação e oferecem novas formas de vigilância e bloqueio dos indivíduos, a interpretação das fronteiras começa a ser redefinida buscando dar conta desses novos processos, tanto para facilita-los quanto para proibi-los. Seguindo essas transformações no entendimento das fronteiras e com um histórico de constantes inovações nas políticas migratórias, a Austrália em 2013 adotou a Operation Sovereign Borders, uma operação que abarca diversas dessas transformações. A Operation Sovereign Borders criou e institucionalizou novas práticas de controle da imigração, sendo permeada por uma racionalidade específica do medo da invasão e apoiada em extensas e controversas inovações legislativas. O presente trabalho apresenta as diferentes transformações das fronteiras e suas interpretações, explorando para isso o caso australiano, seu campo de controle de imigração e fronteiras, os atores desse campo, sua legislação, racionalidade e práticas. / [en] Different processes in the last twenty-five years have transformed the understanding of borders and international mobility, with an increasing number of people on the move and borders that multiply beyond the territorial limits of the state. Alongside these processes that alter the speed of movement, create new pathways for circulation and offer new forms of surveillance and blocking of individuals, the interpretation of borders is being redefined seeking to account for these new processes, both to facilitate them and to prohibit them. Following these changes in the understanding of borders and with a history of constant innovations in immigration policies, Australia in 2013 adopted the Operation Sovereign Borders, an operation that encompasses several of these transformations in seeking greater control and by using more violence against asylum seekers. The Operation Sovereign Borders created and institutionalized new immigration control practices, being permeated by a specific rationality of the fear of invasion and supported by extensive and controversial legislative innovations. This dissertation presents the transformations of borders and their interpretations, exploring the Australian case, its field of migration and border control, the actors in this field, its legislative structure, its rationality and practices.

[pt] O objetivo desta tese de doutorado é investigar as produções de sentidos que
são (des)construídos por voluntários que atuam no atendimento às pessoas em
situação de refúgio no Centro de Atendimento ao Refugiado, mantido pela
Associação São Vicente de Paulo (ASVP) e localizado no bairro de Botafogo, zona
Sul da cidade do Rio de Janeiro. Uma vez que intentamos compreender os sentidos
promovidos por voluntários em diferentes perspectivas, os dados foram gerados,
por meio da entrevista qualitativa, com um psicólogo, uma recreadora infantil e um
professor de português como língua estrangeira, todos ofertantes de assistência
voluntária a refugiados. A fim de alcançarmos nossos objetivos, lançamos mão dos
postulados teórico-metodológicos do arcabouço da Análise da Narrativa, uma vez
que, por meio deste ferramental, podemos promover a investigação sobre como os
voluntários avaliam os refugiados a que atendem; as motivações para
(des)continuidade da oferta da prática assistencial que desempenham; bem como
analisar a maneira como os voluntários desenvolvem suas práticas identitárias, que,
neste trabalho, são entendidas como performáticas, fluidas e emergentes durante o
fluxo interacional. Os dados aqui observados apontam para o trabalho voluntário
como uma arena socio-interacional em que são operacionalizados sentidos e
sistemas de coerência díspares, que perpassam pelo domínio discursivo religioso,
educacional, jurídico e clínico. / [en] The objective of this doctoral thesis is to investigate the productions of
meanings that are (de)constructed by volunteers who work in order to assist people
in refugee situations at the Refugee Service Center, maintained by the Associação
São Vicente de Paulo (ASVP) and located in neighborhood of Botafogo, south zone
of the city of Rio de Janeiro. Since we tried to understand the meanings promoted
by volunteers from different perspectives, the data was generated, through
qualitative interviews, with a psychologist, a children s entertainer and a Portuguese
teacher as foreing language, all offering voluntary assistance to refugees. In order
to achieve our objectives, we made use of the theoretical-methodological postulates
of the Narrative Analysis framework, since, through this tool, we can promote
investigation into how volunteers evaluate the refugees they serve; the motivations
for (dis)continuity in offering the care practice they perform; as well as analyzing
the way in which volunteers develop their identity practices, which, in this work,
are understood as performative, fluid and emerging during the interactional flow.
The data observed here point to voluntary work as a socio-interactional arena in
which disparate meanings and systems of coherence are operationalized, which
permeate the religious, educational, legal and clinical discursive domain. / [es] El objetivo de esta tesis doctoral es investigar las producciones de
significados que son (de)construidos por voluntarios que trabajan para ayudar a
personas en situación de refugiados en el Centro de Atención a Refugiados,
mantenido por la Associação São Vicente de Paulo (ASVP) y ubicado en el barrio
de Botafogo, zona sur de la ciudad de Río de Janeiro. Como intentamos comprender
los significados promovidos por los voluntarios desde diferentes perspectivas, se

die von Freiwilligen, die im Flüchtlingszentrum des São Vicente de Paulo Vereins
(ASVP) arbeiten und im Stadtviertel Botafogo im Süden von Rio de Janeiro
ansässig sind, (des)konstruiert werden. Da wir die von Freiwilligen in
verschiedenen Perspektiven geförderten Bedeutungen verstehen möchten, wurden
die Daten durch qualitative Interviews mit einem Psychologen, einem
Kinderbetreuer und einem Portugiesischlehrer als Fremdsprache, die alle
freiwillige Unterstützung für Flüchtlinge anbieten, generiert. Um unsere Ziele zu
erreichen, greifen wir auf die theoretisch-methodologischen Postulate des
narrativen Analyserahmens zurück, da wir mithilfe dieser Instrumente die
Untersuchung darüber fördern können, wie Freiwillige die Flüchtlinge bewerten,
die sie betreuen; die Motivationen für (Dis)Kontinuität des Angebots der
unterstützenden Praxis, die sie ausüben; sowie die Analyse, wie Freiwillige ihre
identitären Praktiken entwickeln, die in dieser Arbeit als performativ, flüssig und
emergent während des interaktiven Flusses verstanden werden. Die hier
beobachteten Daten deuten darauf hin, dass Freiwilligenarbeit als
soziointeraktionale Arena fungiert, in der unterschiedliche Sinn- und
Kohärenzsysteme operativ sind, die durch religiöse, Bildungs-, rechtliche und
klinische Diskursdomänen durchdrungen sind.
