Syftet med detta examensarbete var att studera hur våldsbrottsoffer porträtteras inom svensk textbaserad media och att studera eventuella genusskillnader för dessa beskrivningar. Detta gjordes genom en kvalitativ innehållsanalys av 24 tidningsartiklar från Aftonbladet och Expressen. Analysen och kodningen tog sitt stöd i Butlers teori om genus och Christies teori om det ideala offret. Vi fann flera likheter och skillnader mellan de kvinnliga- respektive manliga offren. Största likheten var porträtteringen av offren som värdiga och legitima offer, trots att ingen av de 24 fallen egentligen föll under den mest stereotypa bilden av ett brottsoffer. Den skillnad vi fann mest intressant var männens uppnådda legitimitet och värdighet trots att flertalet påvisade en viss tvivelaktig livsstil. / The purpose of this bachelor thesis was to study how Swedish text- based media constructed their portrayal of victims suffering from criminal violence and also to see if there were any gender differences in these portrayals. The study was made by using a qualitative content analysis based on 24 newspaper articles from the Swedish newspapers Aftonbladet and Expressen. The analysis and coding took support from Butler’s gender- theory and Christie’s “ideal type victim”- theory. The analysis resulted in multiple similarities and differences between the female- and male victims. The greatest similarity was the portrayal of the victims as legitimate, although none of the 24 cases fell under the most stereotypical portrait of a crime- victim. The most interesting difference in the results was that the men’s obtained legitimate and dignity despite several showed some kind of doubtful lifestyle.

Sem pretender esgotar o assunto, demonstrará que tão importante quanto o estudo relativo ao autor do delito, haja vista que o crime constitui ofensa a um bem ou valor da vida social, é o estudo daquele que sofreu as conseqüências do fato criminoso. Por tal motivo, além de evidenciar a importância da figura da vítima nos sistemas desde os primórdios da Civilização, induzirá o leitor à reflexão sobre os sistemas contemporâneos adotados por países da América do Sul e Europa. Importante mencionar que o direito processual possui mecanismos muito pouco utilizados pelo ofendido na defesa de seus interesses, em virtude dos danos provocados em decorrência da eclosão do evento delitivo, razão pela qual se fará abordagem aos institutos da assistência e medidas assecuratórias, ainda utilizados, com reservas, pelos operadores do Direito. É objetivo, também, demonstrar a posição do ofendido, desde o momento da prisão do suspeito, passando-se pela instauração do inquérito policial e às hipóteses de ações penais contempladas pela processualística vigente. O desenvolvimento dos temas demonstrará a preocupação do legislador atual com a situação do ofendido, não só no sistema processual, mas no contexto social a que está inserido, tratando de assuntos como a reparação do dano, composição e mecanismos de proteção. The aim of the study was to examine the news coverage surrounding Stockholm City Theatre’s former CEO Benny Fredriksson during the metoo-movement, from the time of the accusations against him until a time after his death. The questions examined were: How is Benny Fredriksson represented at the time of the publishing of the accusations and at the time of his death? How are the anonymous witnesses and the journalism represented? How does the representation of victims and perpetrators change after the death of Benny Fredriksson? What are the differences and similarities in the reporting of Aftonbladet and Dagens Nyheter? To analyze this, we made a discourse analysis of 12 articles from Aftonbladet and 13 articles from Dagens Nyheter. The results showed that the roles of all the characters change during the coverage. At the time of the publishing of the accusations, Benny Fredriksson is represented as an evil dictator that harasses his employees at Stockholm City Theatre. After his death, Benny Fredriksson is represented as a victim of circumstances, helpless and full of anxiety. At first, the witnesses are represented as scared, helpless victims. At the end of the coverage the representation has changed, and the victims are instead represented as perpetrators that are accused of lying. The journalism goes from being represented as investigative journalism to being represented as a media hunt that killed Benny Fredriksson. Overall, Aftonbladet is more defending of the witnesses and the journalism while Dagens Nyheter is more defending of Benny Fredriksson. The study shows that a death can affect the news coverage and consequently how the characters are represented.

The aim of this bachelor thesis was to examine how news journalism represented the two swedish journalists Kim Wall and Nils Horner, when describing their posthumous reputation after they were murdered during assignments. The research questions examined were: How does the journalism, in describing their posthumous reputations, portray the story of Kim Wall, and Nils Horner? What differences and similarities can be found in how they are portrayed as journalists, and as victims? We used Faircloughs critical discourse analysis (CDA) to find reoccurring discourses in the description of Horner and Wall. By examining the characteristics they were assigned and what conclusions the audience were offered to draw about their journalistic competence and about them as victims of murder, we found many similarities between Horner and Wall. They are both described as exceptionally competent. They are also portrayed as born with a “calling” towards the journalistic profession, and in both cases, they are ascribed with next to supernatural characteristics. As victims of murder we found them to be portrayed as idealistic, with some variations in relation to the description of the content of their character, and where the murder took place. Our study shows that the discourses we found contribute to the creation of heroic myths in the news journalisms description of them. They are elevated, and our conclusion is that by elevating their murdered colleagues as heroes, the news journalists are also elevating themselves and, in turn, the journalistic profession.

À ce moment charnière où les T.P.I. accomplissent leurs Stratégies d’achèvement et où la C.P.I. va rendre son premier jugement, il est essentiel de faire un point sur le droit international pénal et particulièrement sur les statuts de victime selon ce droit. En effet, ceux-ci symbolisent les tenants et aboutissants de l’ensemble du droit international pénal. Tantôt oubliée, tantôt sacralisée, la victime ne laisse pas indifférent, et encore moins lorsqu’elle a subi un crime international. Sa reconnaissance a d’ailleurs bouleversé l’économie générale du droit international pénal qui lui accorde une place de plus en plus grande. Une étude approfondie des droits des différentes juridictions permet de constater qu’il n’y a pas un mais plusieurs statuts de victime. La pluralité de ces statuts réside dans l’existence de plusieurs qualités juridiques de victime et de plusieurs régimes juridiques applicables à celle-ci. L’analyse des différents facteurs de cette pluralité donne lieu de voir qu’elle est une force et non une faiblesse du droit international pénal. Elle est la voie médiane entre le rejet de la considération des victimes comme une masse informe et leur impossible prise en compte individuelle. Mais, comme pour le statut du particulier en droit international public général, l’équilibre est parfois difficile à trouver et les statuts sont perfectibles. C’est pourquoi, des propositions d’enrichissements des statuts de victime sont faites et, pour chacune d’entre elles, il est observé si elle est réalisable et souhaitable. Un système de justice pénale internationale serait en construction. La victime pourrait finir par trouver une place en son sein qui satisferait l’ensemble des protagonistes de la répression des crimes internationaux, y compris et surtout, les États. / While the ICT carry out their Completion Strategies, the ICC will soon pronounce its first decision. At this point, itis important to assess international criminal law and especially victim’s status according to this law. Actually, theysymbolise the ins and outs of international criminal law. Once forgotten, once sacralised, the victim never leavesus indifferent, above all a victim of international crimes. His or her recognition has deeply altered internationalcriminal law, which now gives him or her an increasing place. Studying the laws of the international criminal courtsshows that there is not one status but several status of victim. This plurality comes from the fact that there areseveral legal characterisations of victim and several legal conditions. The analysis of the different factors leadingto this multiplicity of legal status enables us to envision this legal diversity as a power of international criminal law,rather than one of its weaknesses. It is the middle way between considering victims as a shapeless, undefinedand undifferentiated crowd and considering each victim individually. But, as with the status of private persons ininternational public law, reaching and keeping a well-balanced status is difficult ; and these are perfectible andcan be improved. This is the reason why some suggestions for the enrichment of the different status are madeand, for each of them, there is a thorough questioning and analysis of whether it is feasible and desirable. As aninternational criminal justice system is under construction, the victim could find a place in it which would satisfy allthe protagonists of the legal proceedings against international crimes, including and particularly States.

At first glance, Strange Case of Dr. Jekyll and Mr. Hyde is a tale that reinforces binaries. One of these is the self/other binary that is central to David Hume's and Adam Smith's theories of sympathy that conceive of a self imaginatively identifying and experiencing fellow-feeling for an other. However, this notion is complicated because Jekyll and Hyde are the same person. Further, many critics argue that Stevenson actually challenges binary thinking. While Hume and Smith do not challenge the self/other binary in connection with sympathy, trauma theory critics do challenge a self/other binary that lies at the heart of sympathy: the victim/perpetrator binary. Noted trauma theorist Dominick LaCapra develops a method of empathizing called empathic unsettlement where a secondary witness listens with empathy to a victim's traumatic witness while recognizing the difference of his or her position as a witness. He argues that perpetrators may also warrant understanding, but this understanding does not come through empathy. However, one of the hallmarks of empathic unsettlement is that it does not neatly resolve or replace traumatic narratives. Therefore, I argue that empathic unsettlement could also be a useful method for allowing a perpetrator to witness. While practicing empathic unsettlement for a perpetrator may not be worth the risk in real life, performing a thought experiment in literature can test how using empathy might provide a better way to theorize perpetration. Using two witnesses who attempt to practice empathic unsettlement for Jekyll and Hyde, Dr. Hastie Lanyon (who fails), and Mr. Gabriel John Utterson (who succeeds), I will show how empathic unsettlement could be used for both a victim and perpetrator to tease out the complexities of assessing a traumatic situation.

Crime control became a function of government and the state increased its responsibility for the investigation and punishment of criminal conduct. Gradually, the victim was removed from the proceedings and relegated to serving as a witness for the state. This fallacy provided the foundation for a criminal justice which, until recently, encourage victim exclusion. In recent years, there has been a clear trend towards re-introducing the right of victims to participate in the criminal justice process. This international trend has been labelled the &bdquo / return of the victim‟. In South Africa, the Constitution and, in particular, the Bill of Rights contained therein underscore the move towards procedural rights for victims of crime. Moreover, the South African government has taken significant legislative steps to ensure that victims have formal rights in criminal justice proceedings. However, to date, comparatively little attention has been paid to the question of whether or not victims should be allowed a meaningful role in the process of plea and sentence negotiations. One of the aims of this study is to determine whether victims‟ rights are properly understood, defined and implemented within the criminal justice system. This qualitative study aimed to examine which discourses can be found within the Child and Adolescent Psychiatry (BUP) and women’s shelters against domestic violence, concerning children that have experienced violence within the family, from two perspectives: the child’s need of father and of protection from violence. The study also aimed to examine which discourses can be found within the organisations concerning children’s well-being, how they define their mission concerning domestic violence and how this can affect the practical work with children that have experienced violence and their parents. The questions that the study aimed to answer were which discourses can be distinguished within BUP and the women’s shelters against domestic violence and how they can affect the different agencies’ view of the child’s need and well-being. These questions have been answered with collected interviews from the two respective agencies which have then been interpreted and processed through a critical discourse analysis from different theoretical concepts such as dominant discourses and service discourses in relation to Social Work, children’s need as a social construction and discourses of the child as a victim and an active participant. What the study showed was that the active participant-discourse overall was more prominent within BUP and that the victim-discourse was more prominent within the women’s shelters against domestic violence but also that both discourses were distinguishable in different ways and to different extents in both agencies in different combinations and variations. The study also found that the discourses, in different ways and to different extents, also affected the agencies’ view of the child’s need of father and of protection from violence.

Crime control became a function of government and the state increased its responsibility for the investigation and punishment of criminal conduct. Gradually, the victim was removed from the proceedings and relegated to serving as a witness for the state. This fallacy provided the foundation for a criminal justice which, until recently, encourage victim exclusion. In recent years, there has been a clear trend towards re-introducing the right of victims to participate in the criminal justice process. This international trend has been labelled the &bdquo / return of the victim‟. In South Africa, the Constitution and, in particular, the Bill of Rights contained therein underscore the move towards procedural rights for victims of crime. Moreover, the South African government has taken significant legislative steps to ensure that victims have formal rights in criminal justice proceedings. However, to date, comparatively little attention has been paid to the question of whether or not victims should be allowed a meaningful role in the process of plea and sentence negotiations. One of the aims of this study is to determine whether victims‟ rights are properly understood, defined and implemented within the criminal justice system.
