Dans ce travail de doctorat, nous avons pour objectif de reconstituer les présupposés et les conséquences de la thèse ockhamiste selon laquelle la quantité n’est pas réellement distincte de la substance ou de la qualité. Cette thèse est formulée dans les écrits philosophiques et théologiques de Guillaume d’Ockham, logicien et théologien anglais du début du XIVe siècle (1285-1349). La thèse est organisée en trois parties. La première partie a pour objet la question de savoir comment s’organise la catégorie de quantité si l’on admet que la quantité n’est pas réellement distincte de la substance ou de la qualité. La deuxième partie, consacrée à la physique de la quantité, traite de chacune des trois espèces de quantité, la quantité permanente continue (l’extension spatiale), la quantité successive (le mouvement et le temps) et la quantité discrète (le nombre). Enfin, la troisième partie consiste en une description et une évaluation de la théorie ockhamiste de la structure métaphysique de la substance / The aim of this PhD dissertation is to reconstruct the assumptions and consequences of the ockhamist thesis according to which quantity is not really distinct from substance or from quality. This thesis can be found in the philosophical and theological writings of William of Ockham, a logician and Franciscan theologian from the beginning of the 14th century (1285-1349).The dissertation is divided into three parts. The first part deals with the question how the category of quantity is organised if one assumes that quantity is not really distinct from substance or from quality. The second part is dedicated to the physics of quantity. Each species of quantity is examined, that is permanent continuous quantity (spatial extension), successive quantity (motion and time) and discrete quantity (number). The research hereto intends to analyse consistency of the legal order or the duty of legislative consistency (Folgerichtigkeit), as a part of the understanding the Law as a system, in order to (I) understand, define and demonstrate the fundamentals of the the duty of legislative consistency and (II) to demonstrate the implementation of the duty legislative consistency in tax law, applying its control mechanisms. To achieve the goal to delimit and demonstrate the fundamentals of the constitutional duty of legislative consistency, are facing three major issues: 1) is the definition of legislative consistency, analyzing its development, its dimensions of effectiveness, its contrast with similar institutes, proving to be a complex legislative consistency standard can be employed to guide the legislator in the preparation of standards in attention to relations of new standards with the pre-defined already by him (legislative consistency postulate) , to achieve the ideal of distributive justice by requirement continues to pursue the egalitarian distribution of privileges and the tax burden (legislative-consistency principle), as limited to the power to legislate by imposing the elaboration of consistent laws and free of unjustified discrimination (legislative consistency-rule) and also as a criterion for evaluation of normative content material compatibility (legislative consistency-criterion). Its Foundation is given by deriving from the rule of law and legislation and equality. Through it we need the Legislature to autovinculação so that the more intensely it has set an Institute, the higher your burden of justification for deviating from the duty of legislative consistency. Secondly the duty of legislative consistency is applied to the tax law, through the control of equality and a systematic approach. As for example apply these controls for the non-cumulative PIS and COFINS inserted specifically in relation to two issues: (1) the imposition of restriction on crediting, realizing the legislative inconsistency in that the purpose of the standard and how it has been implemented are not consistent and (2) the discrímen criteria for imposition of cumulative or non-cumulative regime the given contributor. Also in this case there is legislative inconsistency.

Previous issue date: 2012-12-27 / This research aims to contribute to understand the bonds of loyalty that guide the actions of the Brazilian civil servants. Following the literature review, interviews were conducted to collect and analyze the perceptions of professionals. The study focused on public safety employees of Brazilian Federal District, as forensics experts, police chiefs and officers, including those working on the front lines, as well as leaders. Adapted the theoretical reference from Maynard-Moody and Musheno (2003), and from De Graaf (2010), about the loyalty of civil servants, the study tried to gather narratives that illustrate everyday situations in which decisions are taken and discretion is exercised. Accordingly, we sought to investigate instances the most representative of responsibility, as well as potential tensions and conflicts, especially in a scenario where governance and accountability are in evidence. Regulations are always strictly observed? Or is there a judgment of moral evaluation that considers other facets and interests? Answered these questions, we proceeded to the comparison between the results and those from the research references. Finally, also sought to engage in topics that can be implemented as a development of this research. / Esta pesquisa tem por objetivo contribuir para compreensão dos vínculos de lealdade que orientam a atuação dos servidores públicos brasileiros. Após a revisão bibliográfica, foram realizadas entrevistas a fim de coletar e analisar as percepções dos profissionais. O estudo focou em funcionários da segurança pública do DF, como peritos criminais, delegados e policiais, abrangendo aqueles que atuam na linha de frente, assim como chefes e dirigentes. Adaptou-se o referencial teórico de Maynard-Moody e Musheno (2003), assim como o de De Graaf (2010), acerca da lealdade dos servidores públicos e buscou-se reunir narrativas que ilustrassem situações cotidianas em que as decisões são tomadas e a discricionariedade é exercida. Nesse sentido, procurou-se investigar as instâncias de reponsabilidade mais representativas, assim como possíveis tensões e conflitos, sobretudo em um panorama em que governança e accountability estão em evidência. Os regulamentos são sempre rigorosamente cumpridos? Ou haveria um juízo de ponderação moral abrangendo outras facetas e interesses? Respondidas estas questões, procedeu-se o cotejo entre os resultados obtidos e aqueles oriundos das pesquisas referenciais. Por fim, também se procurou entabular tópicos que possam ser desenvolvidos como desdobramentos desta pesquisa.

Cette recherche porte sur la politique d’asile en Suisse, appréhendée sous l’angle de la force du droit et de sa production sociale. Elle part du constat d’une inflation normative et d’une sophistication du droit, consécutives à de nombreuses révisions législatives et à une importante judiciarisation depuis l’entrée en vigueur de la loi sur l’asile en 1981. Cette thèse s’appuie sur une enquête ethnographique menée sur plusieurs terrains auprès du Secrétariat d’Etat aux Migrations et de services d’aide juridique aux migrants. Elle analyse, d’une part, les effets de la sophistication du droit sur les pratiques des acteurs de terrain et, d’autre part, les effets de ces pratiques sur le droit. In fine, elle montre que le droit et la politique d’asile sont produits par les pratiques de l’administration en interaction avec celles de la défense juridique des migrants qui les conteste et du Tribunal administratif fédéral qui juge les recours en matière d’asile. / This research analyzes the Swiss asylum policy, focusing on the force of the law and on its social production. The study starts from the observation of an increase of the rules regulating asylum and of the sophistication of law. These latter are related to the numerous legislative revisions and to an important judicialization since the enforcement of the Swiss Asylum Act in 1981. This thesis is based on an ethnographic research combining fieldwork in the State Secretariat for Migrations and in legal defense organizations in different Swiss cantons. The author analyzes, on the one hand, the effects of the sophistication of law on the practices of the street-level actors (administration, lawyers and organizations of the legal defense of the asylum seekers) and, on the other hand, the effects of theses practices on law. Finally, the thesis shows that asylum law and policy are produced by the practices of the administration in interaction with those of the legal defense of asylum seekers opposing administrative decisions, and of the Federal Administrative Court judging asylum appeals.

Mind the blues : Swedish police officers' mental health and forced deportation of unaccompanied refugee childrenHansson, Jonas January 2017 (has links)
Introduction: Policing is a public health issue. The police often encounter vulnerable populations. Police officers have wide discretionary powers, which could impact on how they support vulnerable populations. In encountering vulnerable populations the police officers are required to be professional; maintaining mental health in the face of challenges is part of professionalism. Their encounters with vulnerable populations might influence their mental health which in turn might influence the way they use their discretion when making decisions. Background/context: Sweden receives more unaccompanied, asylum-seeking refugee children than any other country in Europe. The number of asylum applications for such children increased from 400 in 2004 to 7000 in 2014 to over 35,000 in 2015. These children come to Sweden and apply for asylum without being under the care of their parents or other legal guardian. Some are denied asylum. If they do not return to their country of origin voluntarily the police are responsible for their deportation. The Swedish government wants an increasing number of deportations and wants them carried out with dignity. This thesis is about the police officers’ perceptions of how to interpret the seemingly contradictory demands for more deportations, that is, efficiency; and concerns for human rights during the deportation process, that is, dignity. This is conceptualized using three theoretical frameworks: a) street-level bureaucracy, b) job demand-control-social support model and c) coping. These theoretical frameworks indicate the complexity of the issue and function as constructions by means of which understanding can be brought to the police officers’ perceptions of deportation work involving unaccompanied, asylum-seeking refugee children and how such work is associated to their mental health. Aim: The current research aims to investigate and analyse Swedish police officers’ mental health in the context of deportations of unaccompanied, asylum-seeking refugee children. Methods: This thesis uses both qualitative and quantitative methodology. The qualitative approach comprised interviews conducted to achieve a deeper understanding of the phenomenon of police officers’ perceptions of deportations of unaccompanied, asylum-seeking refugee children. The quantitative method involved the use of validated questionnaires to investigate the association between police officers’ mental health and psychosocial job characteristics and coping. This approach made it possible to study a complex issue in a complex environment and to present relevant recommendations. A total of 14 border police officers were interviewed and 714 police officers responded to a survey. Results: The police officers utilize their wide discretionary powers and perceive that they are doing what is best in the situation, trying to listen to the child and to be aware of the child’s needs. Police officers with experience of deportations of unaccompanied, asylum-seeking refugee children were not found to have poorer mental health than police officers with no such experience. Furthermore, high job demand, low decision latitude, low levels of work-related social support, shift work and being single are associated with poor mental health. Coping moderates the association between mental health and the experience of carrying out deportations of unaccompanied, asylum-seeking, refugee children, and the police officers seem to utilize both emotional and problem-solving coping during the same complex deportation process. Implications / conclusions: The general conclusion reached in this thesis is that if police officers are subject to reasonable demands, have high decision latitude, access to work-related social support, and utilize adaptable coping, the deportation work does not seem to affect their mental health. When police officers meet vulnerable people, they utilize their discretionary powers to deal with seemingly contradictory demands, that is, efficiency and dignity. The executive role in the deportations of unaccompanied, asylum-seeking refugee children and the awareness of dealing with a child threatened with deportation might give rise to activation of a sense of protection, safety and security. Discretion might make it possible to act on this sense of protection, safety and security and to combine efficiency and dignity. Further studies, which integrate cognitive and emotional discretion with coping, need to be undertaken. / Introduktion: Polisarbete är i mångt och mycket en folkhälsofråga, något som inte minst blir tydligt i polisers möte med utsatta människor. Poliser har ett stort handlingsutrymme, vilket kan påverka hur de bemöter utsatta människor. I mötet med dessa människor behöver poliserna vara professionella; att ta hand om sin psykiska hälsa när man möts av utmaningar är en del av professionalismen. Att möta utsatta människor kan påverka polisernas psykiska hälsa, som i sin tur kan påverka hur de använder sitt handlingsutrymme när de fattar beslut. Bakgrund: Sverige tar emot fler ensamkommande asylsökande flyktingbarn än något annat land i Europa. Antalet asylansökningar för sådana barn ökade från 400 år 2004 till 7000 år 2014 till över 35 000 år 2015. Dessa barn kommer till Sverige och ansöker om asyl utan sina föräldrar eller annan vårdnadshavare. Somliga av dem nekas asyl. Om de inte återvänder till sitt ursprungsland frivilligt är polisen ansvariga för utvisningen. Den svenska regeringen kräver ett ökande antal verkställigheter av av- och utvisningar samt fastlår att verkställigheterna ska genomföras med respekt för människors värdighet. Denna avhandling handlar om polisers uppfattningar och tolkningar av de till synes motsägelsefulla kraven på att verkställa fler av- och utvisningar, det vill säga effektivitet; och hur man hanterar de mänskliga rättigheterna under utvisningsprocessen, det vill säga värdighet. Detta beskrivs och analyseras med hjälp av tre teoretiska ramverk: a) gräsrotsbyråkrati, b) jobb-krav-kontroll-socialt stödmodellen och c) coping. Dessa teoretiska ramverk visar på arbetsuppgiftens komplexitet och fungerar som utgångspunkt för att skapa förståelse för polisernas uppfattningar av arbetet med att verkställa av- och utvisningar av ensamkommande asylsökande flyktingbarn och hur sådant arbete är associerat med polisernas psykiska hälsa. Syfte: Denna avhandling syftar till att undersöka och analysera svenska polisers psykiska hälsa i relation till av- och utvisningar av ensamkommande asylsökande flyktingbarn. Metod: Både kvalitativ och kvantitativ metod användes i denna avhandling. Det kvalitativa tillvägagångssättet innefattade intervjuer för att uppnå en djupare förståelse för hur poliser uppfattar av- och utvisningar av ensamkommande asylsökande flyktingbarn. Den kvantitativa metoden innebar tillämpning av validerade frågeformulär för att undersöka sambandet mellan polisernas psykiska hälsa och psykosociala jobbkarakteristika samt coping. Detta tillvägagångssätt gjorde det möjligt att studera en komplex fråga i en komplex miljö och att presentera relevanta rekommendationer. Totalt intervjuades 14 gränspoliser och 714 poliser svarade på en enkätundersökning. Resultat: Resultatet visar att poliserna utnyttjar sitt stora handlingsutrymme och uppfattar att de gör det som är bäst i situationen, att de försöker lyssna på barnet och vara medvetna om barnets behov. Poliser med erfarenhet av av- och utvisningar av ensamkommande asylsökande flyktingbarn har inte visat sig ha en sämre psykisk hälsa än poliser utan sådan erfarenhet. Vidare är höga krav och lågt beslutsutrymme på arbetet, låga nivåer av arbetsrelaterat socialt stöd, skiftarbete och singelliv associerat med dålig psykisk hälsa. Coping mildrar effekten på den psykiska hälsan hos de som har erfarenhet av att utföra av- och utvisningar av ensamkommande asylsökande flyktingbarn. Poliserna verkar utnyttja både emotionell och problemlösande coping under en och samma komplexa utvisningsprocess. Slutsats: Den viktigaste slutsatsen i denna avhandling är att om poliser utsätts för rimliga krav, har stort beslutsutrymme, tillgång till arbetsrelaterat socialt stöd och använder sig av anpassningsbar coping, verkar det som att arbetet med av- och utvisningar inte påverkar deras psykiska hälsa. När poliser möter utsatta människor utnyttjar de sitt handlingsutrymme för att hantera de till synes motsägelsefulla kraven, det vill säga effektivitet och värdighet. Den verkställande rollen i av- och utvisningar av ensamkommande asylsökande flyktingbarn och medvetenheten om att hantera ett barn som hotas av utvisning kan ge upphov till en aktivering av känslan att ge skydd, trygghet och säkerhet. Handlingsutrymmet kan göra det möjligt att agera på denna känsla av skydd, trygghet och säkerhet samt att kunna kombinera effektivitet och värdighet. Ytterligare studier, som integrerar kognitivt och känslomässigt handlingsutrymme med coping, behöver emellertid genomföras.

The National Credit Act 34 of 2005 and its Regulations came into full effect on 1 June 2007. In order to protect consumers by addressing over-indebtedness, the Act introduces a novel process of debt review in which a new agent, the debt counsellor, plays an important role to help relieve a consumer’s over-indebtedness. However, after the Act commenced, problems soon came to pass with regard to the debt review process. This was mainly due to loopholes and shortcomings in the National Credit Act and its Regulations. The key problems in debt review practice which are identified and analysed in this dissertation, are as follows: <ul>a) The interpretation of “the steps contemplated in section 129” in section 86(2). b) The application for debt review (Form 16 in the Schedule of the Regulations). c) The procedure to be followed when approaching the court. d) The format and contents of the “proposal” mentioned in sections 86 and 87. e) The omission of section 86(7)(c) in section 87. f) The non-provision for consent orders in terms of sections 86(7)(a) and 86(7)(c). e) The non-regulation of payment distribution agencies. f) The termination of debt review by the debt counsellor or a consumer. g) The qualifications, training and expertise of debt counsellors.</ul> Consequently measures taken by the industry or suggested by scholars to solve these problems are evaluated, for example the work stream agreement, the publication of two sets of new draft regulations, the request for a declaratory order in the High Court, a research commission to the UP Law Clinic and numerous conferences. Somewhat oversimplified, it can be said that most of the measures taken to solve the problems moved in the wrong direction, that is away from a simple, easy, quick, cheap and consumer-friendly process. At the moment the debt review procedures are very complex, extended, expensive and even consumer-hostile. In conclusion additional measures are proposed to those that other sources already recommended. Children who experience violence is one aspect of the work of social secretaries and is a complex assignment in their work. The purpose of this essay has been to understand how social secretaries describe their work within their discretion on children who experience violence. More specifically focus has been on cases where there is a lack of consent to voluntary interventions according to the Social Services Act and when compulsory care is not possible. Previous research about this specific situation is limited which makes this study necessary. The questions of this study had a focus on how social secretaries use their discretion in these cases, which challenges they meet in their work and also their reasoning on today´s legislation regarding children who experience violence. The method of this study has been qualitative semi-structured interviews with five social secretaries in three different municipalities in Sweden. Our results have been analysed with previous research and two theoretic starting-points, discretion and caring power. This study shows that knowledge about children who experience violence is an important part in the work of social secretaries and is a crucial factor in children’s right to protection. It also shows that parental rights to refuse interventions is a major aspect that prevents the possibilities of social secretaries to protect children who experience violence which the social secretaries describe as a difficult challenge. Another difficult challenge described was when parents deny that their children are experiencing violence and there is a lack of proof in the same time. The social secretaries in this study expressed a wish to have a possibility in the law to force parents of children who experience violence to receive interventions even though there is a lack of consent.

The purpose of the current study is to examine the experiences of social workers who have worked with violence in close relationships during the restrictions of the Covid-19 pandemic. In addition, the study aims to investigate how social workers felt that their approach and discretion were affected during the pandemic's restrictions. The previous research as well as the theoretical concepts Discrection and Coping Strategy have formed the study's theoretical basis which has been used to analyze the study's results through a thematic analysis. The study has a qualitative approach with five semi-structured interviews whose respondents work on various supportorganizations that work with violence in close relationships. The results of the study showed that the social worker's experiences clarified that the organizations have followed the restrictions and designed new approaches to be able to reach victims of violence who need support and help. The social workers' personal competence and discretion were decisive factors as to whether the social workers' approach was shaped during the pandemic. The results also showed that it varied in the experiences around the pandemic's impact. The organizations had to adapt to the digitalization of social work, which in turn resulted in varying challenges in social work. / Den aktuella studiens syfte är att undersöka erfarenheter hos socialarbetare som har arbetat med våld i nära relationer under Covid-19 pandemins restriktioner. Dessutom syftar studien till att undersöka hur socialarbetare upplevde att deras tillvägagångssätt och handlingsutrymme påverkades under pandemins restriktioner. Den tidigare forskningen samt de teoretiska begreppen Handlingsutrymme och Copingstrategi har utgjort studiens teoretiska underlag som har använts för att analysera studiens resultat genom en tematisk analys. Studien har en kvalitativ ansats med fem semistrukturerade intervjuer vars respondenter arbetar på olika stödverksamheter som arbetar med våld i nära relationer. Studiens resultat visade att socialarbetarens erfarenheter synliggjorde att verksamheter har tillämpat restriktionerna och utformat nya tillvägagångssätt för att kunna nå våldsutsatta personer som behöver stöd och hjälp. Socialarbetarnas personliga kompetens och handlingsutrymme var avgörande faktorer till huruvida socialarbetarnas tillvägagångssätt formades under pandemin. Resultatet visade dessutom att det varierade i upplevelserna kring pandemins påverkan. Den främsta påverkan som verksamheterna fick anpassa sig efter var digitaliseringen av det sociala arbetet som i sin tur resulterade i varierande utmaningar i det sociala arbetet.
