The Killing of Osama bin Laden, Was it Lawful?

The main purpose of this work is to investigate if the US ́s killing of Osama bin Laden on 2 May 2011 in Abbottabad in Pakistan was lawful. The background to the killing is what happened on 11 September 2001 when four US airplanes were hijacked and crashed into World Trade Center and Pentagon. Al Qaeda, a terrorist organisation led by Osama bin Laden, was immediately suspected for the attacks, which led to the starting point of the US ́s ‘global war on terror’. This work tries to give a short brief on ‘global war on terror’ and answer if there is a global war on terror and/or if a new category of war is needed. In order to get an answer to the main question of this work I had to investigate if US is in an international armed conflict or in a non-international armed conflict with Al Qaida. Another important question to investigate is if an armed conflict in one State can spill over to another State and still be consider as an armed conflict. Other important questions to answer are, if Osama bin Laden was a legitimate target under international humanitarian law, if he was a civilian or if he had a continuous combat function and what level of participation in hostilities he had? Not less important is also to investigate if human rights law is applicable when Osama bin Laden was killed, especially the fundamental right to life. Lastly I end my investigation with a quick review of the laws of jus ad bellum in order to get an answer if US had a right to resort to force in Pakistan. My conclusion is that the US was not involved in an armed conflict with al Qaeda in Pakistan where the killing took place. The conflict between the US and al Qaeda in Afghanistan is to be categorised as a non-international conflict. This conflict cannot be described as a conflict that has spilled over to Abbottabad where Osama bin Laden was killed. All people, including Osama bin Laden, has a right to life. Because of lack of information on what happened in Abbottabad when Osama bin Laden was killed it is impossible to give a clear legal answer if the US had the right to kill him. It could be lawful, but it could also be considered as a crime against international human rights law.

From cuprates to manganites: spin and orbital liquids

Both cuprates and manganites belong to the transition metal oxides. The physics of these compounds is characterized by a dualism of local electron interaction and itinerant charge motion. In the present work, several key issues of metallic cuprates and manganites are addressed on a theoretical level, while close connection to recent experimental work is kept. The work is based on the notion of spin and orbital liquids, representing elegant tools to handle the strongly correlated nature of the metallic state in an efficient and transparent manner. A concise introduction to the physics of cuprates and manganites as well as to the methods employed is presented at the beginning of the work. In a subsequent part, we show that the peculiar magnetic response of metallic cuprates upon impurity doping can be successfully explained within a spin-liquid picture. The remainder of the work is devoted to the metallic state of manganites. Elaborating on the notion of an orbital liquid, the interplay of electron correlations, orbital degeneracy, and double exchange is studied. Thereby, the unconventionally large incoherent optical spectrum of metallic manganites and the pronounced softening of the magnon spectrum observed in experiment can be explained. Finally, a theory of the metal-insulator transition of manganites is presented which is based upon the newly introduced notion of orbital polarons. In general, we believe the close agreement of our results with experiment to strongly support the validity of our approach, giving new insight into the spectacular and sometimes as-tonishing physics of transition metal oxides.

Compression des données Multi-View-plus-Depth (MVD): de l'analyse de la qualité perçue à l'élaboration d'outils pour le codage des données MVD

Cette thèse aborde la problématique de compression des vidéos multi-vues avec pour pilier un souci constant du respect de la perception humaine du media, dans le contexte de la vidéo 3D. Les études et les choix portés durant cette thèse se veulent orientés par la recherche de la meilleure qualité perçue possible des vues synthétisées. L'enjeu des travaux que de cette thèse réside dans l'investigation de nouvelles techniques de compression des données multi-view-plus-depth (MVD) limitant autant que possible les dégradations perceptibles sur les vues synthétisées à partir de ces données décodées. La difficulté vient du fait que les sources de dégradations des vues synthétisées sont d'une part multiples et d'autre part difficilement mesurables par les techniques actuelles d'évaluation de qualité d'images. Pour cette raison, les travaux de cette thèse s'articulent autour de deux axes principaux: l'évaluation de la qualité des vues synthétisées ainsi que les artefacts spécifiques et l'étude de schémas de compression des données MVD aidée de critères perceptuels. Durant cette thèse nous avons réalisé des études pour caractériser les artefacts liés aux algorithmes DIBR. Les analyses des tests de Student réalisés à partir des scores des tests de Comparaisons par paires et ACR-HR ont permis de déterminer l'adéquation des méthodes d'évaluation subjective de qualité pour le cas des vues synthétisées. L'évaluation des métriques objectives de qualité d'image/vidéo ont également permis d'établir leur corrélation avec les scores subjectifs. Nous nous sommes ensuite concentrés sur la compression des cartes de profondeur, en proposant deux méthodes dérivées pour le codage des cartes de profondeur et basées sur la méthode LAR. En nous appuyant sur nos observations, nous avons proposé une stratégie de représentation et de codage adaptée au besoin de préserver les discontinuités de la carte tout en réalisant des taux de compression importants. Les comparaisons avec les codecs de l'état de l'art (H.264/AVC, HEVC) montrent que notre méthode propose des images de meilleure qualité visuelle à bas débit. Nous avons également réalisé des études sur la répartition du débit entre la texture et la profondeur lors de la compression de séquences MVD. Les résultats de cette thèse peuvent être utilisés pour aider à la conception de nouveaux protocoles d'évaluation de qualité de données de synthèse; pour la conception de nouvelles métriques de qualité; pour améliorer les schémas de codage pour les données MVD, notamment grâce aux approches originales proposées; pour optimiser les schémas de codage de données MVD, à partir de nos études sur les relations entre la texture et la profondeur.

Växters effektorutlösta försvars funktionoch evolution : Ett uthålligt skydd mot patogener?

Diversiteten bland gener som ger resistens (R) mot infektionssjukdomar är mycket stor i växtriket, särskilt i den effektorutlösta klassen av försvaret. Denna artikel beskriver interaktioner mellan växters effektorutlösta fösvar och patogeners effektorproteiner och undersöker evolutionära och genetiska mekanismer för uppkomsten av ny resistens. R-genprodukter har en typisk domänstruktur och interagerar både direkt och indirekt med patogeners effektorproteiner.Vid kontakt med ett effektorprotein utlöses en försvarsrespons som kan förhindra fortsatt patogen tillväxt. Flera genetiska mekanismer verkar samtidigt på R-gener, något som resulterar i en hög hastighet för uppkomst av nya R-varianter. Den intima samevolution som existerar hos många patogen-växtsystem formar det evolutionära utvecklingsmönstret av R-gener. Diversifierande positiv selektion via den biologiska kapprustningsmodellen och bevarande negativ frekvensberoende selektion är båda viktiga samevolutionära processer. Denna artikel indikerar att växters immunförsvar är anpassningsbart och robust, men belyser också den kunskapsbrist som råder inom resistensforskningen. / The diversity among genes conferring resistance (R) against infectious diseases is very high in the plant kingdom, especially in the effector triggered class of defense. This article describes the interactions between the plant effector triggered immunity and pathogen effectors and examines the evolutionary and genetic mechanisms for the emergence of new resistance. R gene products have a typical domain structure and interacts both directly and indirectly with pathogen effectors. Upon contact with an effector a defense response is triggered that may prevent the further pathogen growth. Multiple genetic mechanisms act simultaneously on the R-genes, which results in a rapid diversification of novel R variants. The intimate co-evolution of many existing plant-pathogen systems form the evolutionary pattern of R genes. Diversifying positive selection via the biological arms race model and conservative negative frequency-dependent selection are both important coevolutionary processes. This article indicates that the plant immune system is adaptive and robust, but also highlights the lack of knowledge in plant resistance research.

Basic structure of personal work used in this thesis is creation and job analysis, personnel planning, recruitment and selection of staff, their evaluation and remuneration, deployment of staff, termination of employment, education and care for workers, relationships with employers and HR information system. In the pracical part is the analyzed company introduced at first, its business activities and history. Then the basic information about employees are meantioned, their number and changes in last five years. Organizational structure is described here too. At the end of the thesis are improvement neasures for some of the personal work.

Desenvolvimento de estratégias analíticas visando a determinação de macroelementos, microelementos e elementos traço em rações de cães e gatos empregando técnicas de espectrometria atômica / Development of analytical strategies aiming the determination of macroelementos, microelementos and trace elements in feeds for dogs and cats employing atomic espectrometry techniques

Coordenação de Aperfeiçoamento de Pessoal de Nível Superior - CAPES / In this work, four methods were developed for analysis of feed for dogs and cats using atomic spectrometry techniques. Initially, the multivariate optimization of sample digestion procedure was employed in wet feed for dogs and cats and then the simultaneous determination of macroelements (Ca, K, Mg and P), microelements (Cu, Fe, Mn, and Zn) and trace elements (Al, B, Ba and Sr) was carried out by optical emission spectrometry with inductively coupled plasma (ICP OES). The results of the elements concentrations in the samples were in agreement with the values provided and regulated by Ministry of Agriculture, Livestock and Supply (Ministério da Agricultura, Pecuária e Abastecimento - MAPA) and American Association of Official Food Control Officials (AAFCO). Limits of detections (LoD) ranged between 0.1 μg g-1 (Ba, Mg and Sr) and 15.0 μg g-1 (P) and limits of quantification (LoQ) between 0.3 μg g-1 (Ba, Mg and Sr) and 49.9 μg g-1 (P). In the second part of the work two analytical methods were optimized for Co and Cr determination in wet food (sachets and cans) for dogs and cats using direct sample analysis (SS) and detection by high resolution continuum source graphite furnace atomic absorption spectrometry (HR-CS GF AAS). Pyrolysis temperatures were 1500 ° C and 1400 ° C for Cr and Co determination, respectively. Atomization temperatures of 2500 ° C for Cr, and 2400 ° C for Co with chemical modifiers were adopted. The optimized method for Co and Cr determination in wet feed was fast, precise and accurate and contributes to the concept of “Green Chemistry”. The results obtained for concentrations of Cr and Co were not compared to any official rule, since there is no regulation for these elements. The LoD's obtained for Cr and Co were 0.01 and 0.05 ug g-1, respectively, and LoQ's obtained were 0.03 to 0.17 ug g-1 for Cr and Co, respectively. Finally, in the third part of the work, an analytical method for determination of Zn in dry feed for dogs and cats using energy dispersive Xray fluorescence spectrometry (EDXRF) was developed. Sample were prepared as pressed pellets. The concentration of Zn in seven dry feed samples for dogs and cats were determinate. The results were statistically compared to the values found by the analytical method by ICP OES. Additionally, paired t-test between concentrations of Zn by EDXRF and ICP OES was applied. The LoD e LoQ obtained for Zn determination were 0.1 e 0.4 mg kg-1, respectively. The independent methods were not significantly different at a 95% confidence level. In our work, the analytical methods proposed were efficient, fast and reliable for the determination of macroelements (Ca, Mg, K and P), microelements (Cu, Fe, Mn and Zn) and trace elements (Al, B, Ba, Co, Cr and Sr) in feeds for dogs and cats using atomic spectrometry techniques. This work was financially supported through the project Universal notice nº 014/2013 approved by CNPq, registered process nº 482416 / 2013-0. / Neste trabalho, foram desenvolvidos quatro métodos para análise de rações de cães e gatos, usando técnicas de espectrometria atômica. Primeiramente, foi empregada a otimização multivariada do procedimento de digestão da amostra para determinação simultânea de macroelementos (Ca, K, Mg e P), microelementos (Cu, Fe, Mn e Zn) e elementos traço (Al, B, Ba e Sr) em rações úmidas de cães e gatos, utilizando a espectrometria de emissão óptica com plasma acoplado indutivamente (ICP OES). Os resultados das concentrações dos elementos nas rações dos animais mostraram-se de acordo com os valores fornecidos e regulamentados pelo Ministério da Agricultura, Pecuária e Abastecimento (MAPA) e pela Associação Americana de Controle Oficial dos Alimentos (AAFCO). Os LoD’s variaram entre 0,1 μg g-1 (Ba, Mg e Sr) e 15,0 μg g-1 (P) e os LoQ’s variaram entre 0,3 μg g-1 (Ba, Mg e Sr) e 49,9 μg g-1 (P). Na segunda parte do trabalho, foram otimizados dois métodos analíticos para determinação de Co e Cr em rações úmidas (sachês e enlatadas) para cães e gatos utilizando análise direta de sólidos (SS) e detecção por espectrometria de absorção atômica de alta resolução com fonte contínua e atomização em forno de grafite (HR-CS GF AAS). Foram estabelecidas temperaturas de pirólise de 1500°C e de 1400°C para a determinação de Cr e Co respectivamente, e temperaturas de atomização de 2500°C para Cr e de 2400°C para Co, sem o uso de modificadores químicos. Os métodos otimizados foram rápidos, precisos e exatos, além de contribuir com a concepção da Química Verde. Os resultados obtidos para as concentrações de Cr e Co não foram comparados com nenhuma norma, uma vez que estes elementos não são regulamentados. Os LoD’s obtidos para Cr e Co foram de 0,01 e 0,05 μg g-1 respectivamente, já os LoQ’s obtidos para Cr e Co foram de 0,03 a 0,17 μg g-1 respectivamente. Por fim, na terceira parte do trabalho, foi desenvolvido um método analítico para determinação de Zn em rações secas destinadas à alimentação de cães e gatos empregando a espectrometria de fluorescência de raios-X com energia dispersiva (EDXRF). As amostras foram preparadas na forma de pastilhas prensadas e a concentração de Zn, determinada em sete rações secas de cães e gatos. Os resultados obtidos foram estatisticamente comparados com os valores encontrados através de um método analítico estabelecido por ICP OES, em que foi aplicado o teste t pareado entre as concentrações de Zn por EDXRF e ICP OES. Os LoD e LoQ obtidos na determinação de Zn através do método foram de 0,1 e 0,4 mg kg-1 respectivamente. Os métodos independentes não apresentaram diferença significativa para um nível de confiança de 95%. Em nosso trabalho, os métodos analíticos propostos foram eficientes, rápidos, e confiáveis para a determinação de macroelementos (Ca, Mg, K e P), microelementos (Cu, Fe, Mn e Zn) e elementos traço (Al, B, Ba, Co, Cr e Sr) em rações de cães e gatos, usando técnicas espectroanalíticas. Este trabalho teve o auxílio financeiro do projeto Universal Edital 014/2013 aprovado pelo CNPq, registrado sob processo nº 482416/2013-0.

SSII, laboratoire de formes modernes de mise au travail ? / IT companies laboratoy of modern forms of getting to work ?

En définissant les notions de „travail“ et de „ métier“, nous avons observé l’importance du „système d’information“ dans la réinvention du „travail“. Constatant la disparition ainsi que la modification des métiers ; en atteste les licenciements et les réorganisations des entreprises ; le travail ne disparait pas pour autant et s’invite sous de nouvelles formes, comme les statuts auto-entrepreneur et stagiaire, mais aussi en positionnant le consommateur comme travailleur. Du travail visible, sous la forme d’un travail salarié, au travail „caché“, c‘est la société tout entière qui s’en trouve réinventée, et invite à de nouvelles perspectives sociales.Au travers de l’étude de deux SSII (société de services en ingénierie informatique), pendant une durée de 5 ans, nous nous sommes intéressés aux différentes formes de mise au travail de 152 ingénieurs informaticiens. Appréhender le contexte des SSII comme un laboratoire de formes modernes de mise au travail, nous a permis d‘identifier ces mises au travail novatrices et leurs valorisations.Le système d’information se constituant comme l’axe incontestable de cette modification du travail, permet la mise en place d‘un travail normé et standardisé, dessine les nouveaux contours du travail, et ouvre vers de nouvelles perspectives sociales et économiques enrichissantes.Si le système d’information contribue à la mise en œuvre de ces nouvelles formes de travail, les décisions managériales se constituent comme étant à l’origine de cette l’utilisation.Vers quel paradigme nous oriente, cette utilisation du système d‘information ? / Defining the concepts of "work" and "job", we observed the importance of "information system " in the reinvention of "work".Noting the loss and modification of „jobs“ ; evidenced by layoffs and reorganization of enterprises , the work does not disappear , however, and invites new forms , such as statutes of freelance and student , but also by positioning the consumer as a worker.Work visible, in the form of wage labor, to work "hidden" , it is the whole society that is reinvented, and calls for new social perspectives.Through the study of two IT compagnies, for a period of 5 years , we are interested in various forms of work activity concerning 152 computer engineers .Understand the context of IT compagnies as a laboratory for modern forms of development work has enabled us to identify these updates in innovative work and valuations.The information system is forming as the undisputed center of this change of work, allows the establishment of normalized and standardized work , draws the new border of work, and open to new rewarding social and economic opportunities.If the information system contributes to the implementation of these new forms of work , managerial decisions are to be at the origin of this use.To what paradigm directs us, this use of information system?

Biodistribution and biological impact of nanoparticles using multimodality imaging techniques : (Magnetic resonance imaging) / Biodistribution et effet biologique des nanoparticules utilisant des techniques d’imagerie multimodale : (Imagerie de résonance magnétique)

En raison de leurs propriétés uniques, des nanoparticules industriellement fabriquées comme les nanotubes de carbone (NTC) ont révolutionné le domaine de la nanotechnologie. Il apparait nécessaire de développer des techniques d’investigation in vivo basées sur les propriétés intrinsèques de ces particules et permettant un suivi longitudinal pour évaluer leur risque après inhalation accidentelle par voie respiratoire. Un protocole d’IRM pulmonaire non-invasive utilisant l’hélium-3 hyper polarisé sous respiration spontanée a été développé en complément d’un protocole d’IRM systémique proton pour permettre la détection des NTC grâce à l’effet de susceptibilité magnétique induit par les impuretés de fer, associées aux nanotubes après leur exposition intra pulmonaire. Combiné avec l’IRM pulmonaire proton et des analyses en microscopie optique et électronique à différents temps d’investigation, ce protocole d’imagerie multimodale permet d’évaluer la biodistribution et l’impact biologique des NTC bruts après exposition intra pulmonaire.Une accentuation des réactions inflammatoires (granulomes multifocaux, dépôt de fibres de collagène…) avec le temps et la dose administrée a été observée.De l’évaluation de l’impact biologique des NTC après une exposition intra pulmonaire vers leurs applications biomédicales, les nanotubes de carbone avec leurs propriétés physicochimiques fascinantes et leur forme spécifique laissent entrevoir des applications potentielles en nanomédecine. La bio distribution et le profil pharmacologique des différents types de NTC ont été évalués longitudinalement par IRM et dosage dans le sang et les organes cibles après une injection intraveineuse, et leur impact biologique sur le métabolisme du foie a été examiné ex vivo par RMN haute résolution à l’angle magique (HR-MAS). Aucun signe de toxicité aiguë (variation du métabolisme du foie) n’a été observé et les analyses statistiques conduits sur les spectres RMN (tests PCA) ne montrent aucune différence entre les échantillons analysés et donc l’absence de discrimination entre les différents groupes par rapport aux animaux contrôles. / As novel engineered nanoparticles such as single-walled carbon nanotubes (SWCNT) are extensively used in nanotechnology due to their superior properties, it becomes critical to fully understand their biodistribution and effect when accidently inhaled. There fore, development of animaging technique which allow longitudinal in vivo follow-up of SWCNT effect based on their intrinsic properties is highly desirable. Non invasive free-breathing hyperpolarized 3He lung MRI protocol was developed complementary to proton systemic MR protocol to allow monitoring SWCNT based on their intrinsic iron impurities after intrapulmonary exposition. Combined toproton lung MRI and ex vivo optical and electron microscopy at different time points, this protocol represents a powerful multimodality imaging techniques which allows a full characterization of the biodistribution and biological impacts of iron containing SWCNT. SWCNT was found to produce granulomatous and inflammatory reactions in a time and dose dependent manner with their bio persistenc eafter intrapulmonary exposition.From biological impact evaluations after intrapulmonary exposition towards biomedical applications, SWCNT hold promise for applications in nanomedicine field with their distinct architecture and their novel physicochemical properties. The biodistribution and pharmacological profile of various well-dispersed pristine and functionalized SWCNT were assessed in blood and target tissues after their intra venous administration by longitudinal in vivo susceptibility weighted MRI and their potential effect on liver metabolism by ex vivo HRMAS 1H NMR. No presence ofacute toxicological effect (variation in liver metabolism) was observed confirmed by the absence of clustering in NMR spectra using Principal Component Analysis (specific biomarkers of toxicity).

Generational differences in the military : a focus on job satisfaction and emotional intelligence

The aim of the study was to explore the differences between generations X and Y in the military by exploring whether belonging to a particular generational cohort influences perceptions of job satisfaction and emotional intelligence (EI). Data on generational groupings, job satisfaction and EI was drawn from a convenience sample of 187 members from the Human Resources (HR) Division in the South African National Defence Force (SANDF). Descriptive statistics, correlations and t-tests for independent samples were used to analyse the data. Analysis revealed that job satisfaction has a significant positive relationship with EI. Furthermore, the empirical study also yielded evidence to support a difference between Gen X and Gen Y in relation to two job satisfaction facets, namely promotion and supervision. The findings, however, did not support a difference between Gen X and Gen Y in terms of overall job satisfaction and total EI. The leadership of the SANDF may be able to use the study’s findings to guide effective organisational policies and processes to maintain and retain a loyal and productive human resources pool working in cohesion despite underlying differences. / Industrial and Organisational Psychology / M.
