Le choix de l’école secondaire par des parents dans le marché scolaire montréalais. Une étude compréhensive des conditions, stratégies et effets sociaux de l'exercice d'un devoir parental

Notre système d’éducation, comme on le connait, est le fruit de la Révolution tranquille des années 1960. S’appuyant sur un principe de démocratisation, le système scolaire est rapidement devenu le levier de développement économique et social d’une société « en retard » par rapport au reste du pays (Proulx et Charland, 2009). Cependant, d’après Lessard (2019), le système scolaire du Québec fait piètre figure en matière d’équité : il est le moins équitable des systèmes canadiens, et ce, pour plusieurs raisons. Depuis la Révolution tranquille, la Loi sur l’instruction publique québécoise (LIP) régit les droits et obligations des élèves et des institutions scolaires, et reconnait également certains droits des parents d’élèves, comme les choix d’écoles au primaire et au secondaire. Ces choix semblent par ailleurs évoluer de manière croissante, en particulier depuis les années 1980. En effet, sur fond de courants politiques et économiques globaux (la Nouvelle gestion publique – NGP, la Gestion axée sur les résultats - GAR, etc.), et aussi nationaux et locaux (la Loi sur l’instruction publique du Québec, politiques municipales et urbaines diverses, etc.), ces pratiques de choix tendent à profiter d’une conjoncture favorable qui stimule leur montée (Bélanger, 2011; Turmel, 2014; Felouzis et coll., 2013). En outre, ils feraient partie des leviers favorisant ce que Felouzis et ses collègues (2013) appellent les « marchés scolaires » (Felouzis et coll., 2013). Dans les marchés scolaires, les prix ne constituent pas une mesure de la qualité éducative. La relation offre-demande éducative s’appuie alors sur l’élaboration de jugements sur la qualité perçue, une qualité non mesurable basée sur des critères sociaux différents en fonction des intentions éducatives et origines sociales variées des familles (Felouzis et coll., 2013, p. 4). Le fait est que ces jugements différenciés participent ultimement à la construction de possibilités de choix inégalement réparties entre les familles. Considérant que le paysage scientifique québécois abordant les processus de choix scolaires est, à ce jour, relativement vierge, cette thèse a donc pour visée d’éclaircir la question et donner une intelligibilité à la construction de jugements de qualité d’une bonne école secondaire. Embrassant une posture interprétative compréhensive, cette thèse s’inspire de la sociologie interactionniste de van Zanten (2009) sur les choix scolaires de même que de la sociologie de la famille (de Singly, 2010; Déchaux, 2010; Valois, 2009), tout en portant une attention particulière au poids des capitaux dans la sociologie de la reproduction sociale selon la perspective de Bourdieu (1979) et Bourdieu et Passeron (2011). Basée sur vingt-sept entretiens semi-dirigés qui ont été conduits auprès de parents résidant dans cinq arrondissements montréalais (Ahuntsic-Cartierville, Côte-des-Neiges-Notre-Dame-de-Grâce, Mercier-Hochelaga-Maisonneuve, Montréal-Nord, Rosemont-La-Petite-Patrie), l’analyse inductive des données révèle une variabilité importante des processus de choix parentaux, élaborés en fonction de conditions, de ressources différenciées, de perceptions subjectives et contraintes objectives. En effet, celles-ci sont fortement indexées en fonction de l’offre de services éducatifs dans les secteurs de résidence des familles et conditionnées par la position socioéconomique des parents et le statut EHDAA des enfants. Il a également été constaté que les qualités sociales de l’établissement sont souvent, spécialement aux yeux des parents de classes moyennes, corrélées avec les qualités de l’instruction. Ce constat a été noté chez plusieurs répondants, bien que seuls ceux disposant de ressources économiques et culturelles suffisantes soient en mesure de mettre en place des stratégies pouvant satisfaire leurs préférences et leur vision de la qualité éducative souhaitable pour leur enfant. / The Quebec education system is based on a democratization principle and rapidly became a lever for the economic and social development of a society “lagging behind” the rest of the country (Proulx & Charland, 2009). However, according to Lessard (2019), while being above average compared to the rest of OECD countries regarding performance, the Quebec school system does much worse with regards to equity: it is the least equitable of the Canadian systems. Since the Quiet Revolution, the Quebec Education Act (Loi sur l'instruction publique) regulates the rights and obligations of students and institutions, and also recognizes certain rights to the parents. School choice, for elementary or high school, is among the individual rights of parents recognized by the Education Act. Throughout the world, many global political and economic trends (New Public Management or NPM, accountability, etc.) as well as provincial and local policies (the Education Act in Quebec and various municipal and urban policies, etc.) stimulate the growth of choice practices, and the situation in Quebec, especially in Montreal, is no different. Researchers have yet to meaningfully address school-choice processes, but international studies have shown tangible links between the high school-choice processes of middle- and upper-class parents and increased inequality through social segregation (Felouzis et coll., 2013; van Zanten, 2009a). This dissertation aims to clarify the current debates on school choice in Montreal and highlights parental perceptions related to the singular feelings, experiences, and trajectories entailed in the choice of high schools. This research is essentially based on previous work by Felouzis et coll. (2013) and Karpik (2007) on judging quality of a public service. It also borrows conceptual notions from the sociology of the contemporary family (Singly, 2010) as well as studies by Déchaux (2009) and Valois (2009). Furthermore, following Bourdieu (1979) and Bourdieu and Passeron (2012), it illuminates the importance of cultural, economic, and social capital in the judgment and decision-making process of parents when they attempt to choose the right high school for their child. Finally, it feeds off of the interactionist sociology of van Zanten (2009) on school-choice decisions. The study first examined the decision-making processes of twenty-seven Montreal parents whose child is transitioning from elementary to high school. It then studied the educational supply in the five Montreal boroughs in which these parents reside: Ahuntsic-Cartierville, Côte-des-Neiges-Notre-Dame-de-Grâce, Mercier-Hochelaga-Maisonneuve, Montréal-Nord, and Rosemont-La-Petite-Patrie. This thesis also embraces comprehensive and interpretive sociology and is based on semi-structured interviews (Kaufmann, 2011; Boutin, 1997). The inductive data analysis revealed great variability in parents’ school-choice processes following their differentiated conditions and resources. Only some parents could actually consider enrolling their child in the school of their choice. The limitations observed came down to places available in the institutions, the successful completion of a qualifying examination, the payment of relatively high school fees, the limited geographical access to certain schools or their child’s handicaps, social maladjustments or learning difficulties. Finally, the results extracted from the analysis highlight that the subjective perceptions and objective constraints that come into play in the school-choice process are also strongly conditioned by the supply of educational services in the families’ area of residence where there is indeed a differentiated access to education services. It shows that families living in these areas do not all have access to the same provision, to the same “quality” of education services and that the possibility of choosing a school or relocating to a given area of residence is tied to family income.

Moraliska bedömningar av autonoma systems beslut / Moral judgments of autonomous intelligent systems

Samhällsutvecklingen går i en riktning där människor arbetar i allt närmare samarbete med artificiella agenter. För att detta samarbete ska vara på användarens villkor är det viktigt att förstå hur människor uppfattar och förhåller sig till dessa system. Hur dessa agenter bedöms moraliskt är en komponent i denna förståelse. Malle m.fl. (2015) utförde en av de första studierna kring hur normer och skuld appliceras på människa respektive robot. I samma artikel efterfrågades mer forskning kring vilka faktorer hos agenter som påverkar de moraliska bedömningarna. Föreliggande studie tog avstamp i denna frågeställning och avsåg att undersöka hur moralisk godtagbarhet och skuldbeläggning skiljde sig beroende på om agenten var en person, en humanoid robot eller ett autonomt intelligent system utan kropp (AIS). Ett mellangrupps-experiment (N = 119) användes för att undersöka hur agenterna bedömdes för sina beslut i tre olika moraliska dilemman. Deltagares rättfärdigaden bakom bedömningar samt medveten hållning utforskades som förklaringsmodell av skillnader. Medveten hållning avser Dennetts (1971) teori kring huruvida en agent förstås utifrån mentala egenskaper. Resultaten visade att person och robot erhöll liknande godtagbarhet för sina beslut medan AIS fick signifikant lägre snitt. Graden skuld som tillskrevs skiljde sig inte signifikant mellan agenterna. Analysen av deltagares rättfärdiganden gav indikationer på att skuldbedömningarna av de artificiella agenterna inte grundade sig i sådan information som antagits ligga till grund för denna typ av bedömningar. Flera rättfärdiganden påpekade också att det var någon annan än de artificiella agenterna som bar skulden för besluten. Vidare analyser indikerade på att deltagare höll medveten hållning mot person i störst utsträckning följt av robot och sedan AIS. Studien väcker frågor kring huruvida skuld som fenomen går att applicera på artificiella agenter och i vilken utsträckning distribuerad skuld är en faktor när artificiella agenter bedöms.

The dissertation deals with semantic relations between adjectives and deadjectival verbs in Czech. It focuses on the question how the property scale conveyed by adjectives is encoded in the semantics of deadjectival verbs. After the first chapter which presents the topic of the dissertation, in the second chapter, I describe the theoretical and methodological context of contemporary linguistics from a broader perspective in order to relate the theoretical and methodological procedures present in this paper to the current linguistic development. The third chapter pursues the semantics of adjectives in Czech and various approaches to their classification. It presents a scalar classification of adjectives according to which adjectives denote a scale of some property, i.e. an ordered set of degrees along a dimension. With support of empirical research (based on a questionnaire survey and corpus data) I show that it is possible to implement the scalar model into the description of Czech adjectives. This approach states that adjectives are one of many means in language that serve to express measurement (and attribute it to objects and individuals). La présente thèse part d’une tendance de la jurisprudence européenne, destinée à influencer la jurisprudence nationale de droit international privé, et se trouve dans le prolongement d’un grand débat doctrinal d’actualité. Il s’agit de la méthode de reconnaissance des situations juridiques, qui suppose l’abandon de la règle de conflit de lois. L’objectif est de conceptualiser cette nouvelle méthode et d’en définir le domaine et les conditions de mise en œuvre. Vu les particularités du sujet, la recherche passe nécessairement par plusieurs thèmes fondamentaux du droit international privé mais aussi du droit européen, du droit privé général et de la théorie du droit. / Inspired by a trend in the European case law, which is meant to affect the national ones, the dissertation takes part to a topical debate among European academics on the putting aside the choice-of-law rules. It is about application of so-called recognition method to the foreign legal situations that haven’t been enacted in court. The purpose is to conceptualise this new method and to determine its scope and its modalities. Given the particularity of the task, the study necessarily bears on several pivotal topics of private international law but also of European law, general private law and jurisprudence.

Lois de police et conflits de juridictions. (Essai sur la coordination des systèmes à l'aide de la notion d'ordre juridique prépondérant) / Mandatory provisions and conflicts of jurisdictions

Dans un contexte où le recours au mécanisme des lois de police apparaît de plus en plus fréquent et facilité sur le plan des conflits de lois, la perte d’impérativité que connaissent ces dispositions du fait des solutions libérales retenues sur le plan des conflits de juridictions, conduit à s’interroger sur la possibilité d’apporter des correctifs. En droit positif, l’admission généralisée des clauses de prorogation de for, étatique et arbitral, malgré l’applicabilité d’une loi de police, associée à un système de reconnaissance pratiquement automatique des jugements étrangers et des sentences arbitrales au stade du contentieux de l’exequatur, conduit à rendre ces dispositions globalement semi-nécessaires dans les rapports internationaux. Alors que la mise en œuvre des lois de police devant un for étatique étranger ou arbitral apparaît très incertaine et que la violation de ces dispositions ne fait pas obstacle à la reconnaissance d’un jugement ou d’une sentence qui les aurait négligées, les clauses de prorogation de for apparaissent comme des instruments à la disposition des parties pour se livrer au forum shopping et contourner les impérativités étatiques. Cette solution, paradoxale et peu satisfaisante, compte tenu de l’importance et de la nature des intérêts par principe mis en cause à travers ces dispositions, incite à envisager une solution permettant de restaurer l’impérativité des lois de police dans les conflits de juridictions. Dès lors que ce résultat apparaît comme la conséquence du maintien du principe traditionnel de l’indépendance des compétences législative et juridictionnelle malgré le lien existant entre forum et jus en matière de lois de police, ce constat conduit à s’interroger sur la possibilité de déroger exceptionnellement à ce principe pour consacrer un forum legis impératif et exclusif, fondé sur l’applicabilité d’une telle disposition. Cette solution, restaurant efficacement l’impérativité des lois de police dans leur for d’origine, devrait néanmoins être associée à la mise en place d’un mécanisme de coordination des systèmes permettant de prolonger son efficacité devant les fors étrangers. Il pourrait trouver ses fondements dans certains procédés préexistants, susceptibles d’être adaptés à la réalisation de l’objectif de protection des impérativités étatiques poursuivis. La mise en place de différents mécanismes, apparentés à celui du forum non conveniens, fondés sur un système de coopération interjuridictionnelle ou inspirés de la méthode de référence à l’ordre juridique compétent envisagée par P. Picone, pourrait permettre d’assurer, à l’étranger, le respect des lois de police du for dans des hypothèses différentes. De manière transversale, la restauration de l’impérativité des lois de police pourrait être assurée grâce à un recours à la notion d’ordre juridique prépondérant. Désignant un ordre juridique dont une loi de police mettant directement en cause un intérêt étatique réellement fondamental serait applicable au fond du litige, elle devrait pouvoir fonder la reconnaissance de la vocation plus forte de celui-ci à faire valoir ses vues pour la résolution d’un litige. Elle pourrait fonder à la fois la revendication de compétence juridictionnelle prioritaire de celui-ci pour trancher le différend et un effacement des fors étrangers pour faire prévaloir le point de vue qu’il retient. Une telle solution, étroitement délimitée et justifiée au regard de l’importance des intérêts mis en cause, assurerait une solution satisfaisante permettant à la fois d’articuler harmonieusement la poursuite de la politique libérale qui s’impose dans les conflits de juridictions avec le respect des lois de police et de réconcilier la protection des impérativités étatiques avec la coordination des systèmes. / In times of mandatory provisions becoming more and more prevalent, based on conflict of law, the concept of mandatory enforcement appears to be somehow diluted regarding the liberal solutions found in conflicts of jurisdictions. In positive law, mandatory rules do not prevent the enforcement of a forum clause, no more than they are considered during the enforcement stage of decisions. While the application of these rules before foreign courts and arbitrators is very uncertain and does not raise obstacles to the recognition of foreign judgments or arbitral judgment which overlook them, choice of forum clauses has become an instrument of forum shopping in order to avoid mandatory regulations. This solution paradoxically induces a search for a solution to restore there international imperativity. This result has appeared as a consequence of the principle of separation of conflicts of law and conflicts of jurisdictions. That observation leads to ask questions about the possibility of an exemption to this general principle. Indeed, this encourages to consider the possibility to admit a correlation between forum and jus in order to establish imperative and exclusive competence, based on the applicability of such mandatory rules. This forum legis would require to maintain the litigation in its courts and could ensure their application in international relations. However, unilateralism that governs rules of judicial competence should involve the establishment of a mechanism of different legal systems coordination. Depending on the type of mandatory rules concerned, it could be based on an adapted form of forum non conveniens, on international judicial Co-operation processes, or be inspired by the method of reference to the competent legal order envisaged by P. Picone. The deployment of these solutions could be based on using preponderant state notion, that would be the one with the most widely public policy involved. It would lead to the recognition of the strong vocation of it to assert its views for the resolution of a dispute and would justify both the priority jurisdiction of its courts and circumspection of the other jurisdictional authorities to exercise their competence. Such a solution, tightly defined and justified in view of the importance of the interests involved, would provide a satisfactory solution to both harmoniously articulate the pursuit of liberal politics required in conflicts of jurisdictions with respect of public policy, and reconcile the protection of imperativities with the coordination of legal systems.

L'avenir du critère de la nationalité en droit international privé / The future of nationality as connecting factor in private international law

Nous sommes aujourd'hui face à un incontestable déclin du critère de la nationalité en droit international privé. À l'heure de la mobilité croissante des personnes et de l'essor des autres critères de rattachement, il nous faut faire le constat de la marginalisation de la nationalité, pourtant considérée pendant longtemps comme la principale notion en matière de statut personnel, une marginalisation confirmée par les règlements européens et la jurisprudence. Face aux changements dans ce domaine et aux incertitudes qui y sont liées, il est nécessaire d'analyser ces données afin de pouvoir procéder à un bilan et d'énoncer des résolutions pour l'avenir. En effet, l'évolution du droit international privé a conduit à privilégier de nouveaux critères de rattachement, considérés comme plus efficaces et moins discriminatoires que la nationalité, qui sont ainsi plébiscités par le législateur et les juges européens. Il s'agit tout d'abord des critères territorialistes, et particulièrement de la résidence habituelle qui est devenue le rattachement principal, pour la plupart des textes européens, en matière de divorce, de responsabilité parentale ou encore de régime des incapables. L'importance donnée aux individus, reconnus en tant que quasi-sujets de droit international, résultant de l'intervention des droits de l'homme, apparaît comme le principal facteur du déclin de la nationalité. Le principe de non-discrimination et la prise en compte de la volonté des parties, jusqu'à leur désunion et leurs successions, illustrent cet état de fait. Il s'agit alors de savoir, à la lumière des réflexions sur ces nouveaux paradigmes, s'il est encore possible de reconsidérer le rattachement des personnes en revalorisant le critère de la nationalité dans certains domaines, comme cela a été suggéré dernièrement en droit des successions. Nous proposons ainsi une méthodologie permettant aussi bien dans le conflit de lois que dans le conflit de juridictions de déterminer les raisons du déclin de la nationalité. Nous menons également une réflexion sur son irrévocabilité en droit international privé. / The decline of the nationality in private international law is nowadays an undeniable reality. The impact of an almost unconditional mobility of European citizens and the emergence of other connecting factors in the personal law result in the weakening of the nationality link, despite its historical role in determining the law applied to an individual. The weakening is confirmed by the modern European legislation and case law. This study seems essential to understand the foundations of nationality as the connecting factor and takes into account the important changes of the nationality and its uncertainty. Indeed, the evolution of the European private international law led to the switch of the connecting factor from nationality toward territorial nexuses. Particular significance is put on the nexus of habitual residence, which is considered to be more efficient and less discriminatory, and is retained by the main European regulations and judgments, not only in case of international divorces or parental authority, but also according to such matters as legal capacity. Furthermore, the superiority of human rights appears to be the essential reason for the acknowledgement of individuals as the quasi-subjects of international law, which resulted in the decline of nationality as a connecting factor. Consequently, the principles of non-discrimination and personal autonomy impact the further fields of personal law, e.g. disunion and heritage. In the light of these new paradigms, it should be questioned if it is possible to overcome the decadence of the nationality and authorize its part in some matters of the European private international law, as it was regulated in the new heritage European regulation. For these reasons, this study propose a methodology that determines the reasons of the fall of nationality as the nexus of the private international law, both in the conflict of laws and in the conflict of jurisdictions, and provides some reflections on its irreversibility.

La simulazione negoziale nel processo civile

The thesis aims to reconstruct the procedural rules that apply whenever the simulation of contract becomes an issue within a civil proceeding.To this end, a different method is followed from that commonly used by the courts and in the scholarly literature, which have mostly deduced the content of these rules assuming, as a starting point, a certain solution to the problem of the nature of simulated contracts. The courts, that still adhere to the traditional doctrine of nullity of the simulated contract, state that the rules of the civil code dedicated to the action and the objection of nullity shall also apply to the action and objection of simulation. Part of the scholars, rejecting such premises, uphold interpretative solutions that are at odds with those supported by the courts. On the contrary, in this thesis, the legal notion of simulation is assumed as a starting point. Such a legal notion describes the set of facts that lead to a simulation of a contract and to the legal consequences set forth in articles 1414 and ff of the civil code; these facts are thus material to the process in which the simulation is an issue. Hence, the first part of the thesis (chapters 1 to 4) aims at framing the legal notion of simulation within the main categories of civil procedure, and starts from the definition of the legal notion of simulation by critically assessing the two main conceptions of the simulation phenomenon that emerge from the conspicuous literature on the subject: a “negative” conception, which sees the simulation as the lack of an essential element of the contract, and a “positive” conception, which sees the simulation as an agreement between the parties with the aim of excluding the legal effects of a contract between them (simulation agreement). The arguments in support of this last conception are set forth; after that, the question of the structure of the so-called “concealed contract” and the role of the simulation agreement on its formation and effectiveness is examined. The framing of the simulation in the fundamental categories of the process is then carried out through the observation of the legal effects that the simulation activity produces with regard to third parties, and the procedural classification of the substantial categories referred to in Articles 1415 and 1416 of the Italian Civil Code (in particular, unopposability). Finally, the objective scope of the process in which the ascertainment of the simulation of a contract is requested (action of simulation) is defined by critically examining the prevailing doctrine, according to which the said action aims at ascertaining the lack of a “contractual relationship”. Another doctrine is then examined, according to which simulation and nullity may be described as authonomous legal effects capable of being ascertained within a judgment having the force of res judicata. The second part (chapters 5 and 6) is dedicated to the discussion of selected issues of “procedural dynamics”, namely: a) the objection of absolute simulation, and the problem wether the judge may decide upon it ex officio in both the processes aimed at enforcing a simulated contract, and in those that aim, on the contrary, at the declaration of nullity, or at the annulment, rescission or termination of the same contract; b) the multiple facets that the issue of absolute simulation presents in the course of a forced expropriation proceeding undertaken against an “apparent owner”; c) the form of the concealed contract and the extent to which the simulants may prove a relative simulation by witnesses, particularly in the event that the relative simulation of the price of a sale contract is alleged as an objection to an avoidance action promoted by the bankruptcy trustee; d) the stading to an action of simulation; e) the objective scope of the res judicata in the same action. / La tesi mira a ricostruire la disciplina processuale della simulazione negoziale, ossia le regole concernenti l'attività compiuta nel processo dalle parti e dal giudice, ogniqualvolta la simulazione di un negozio giuridico sia oggetto di allegazione, prova e decisione (nella forma della mera cognizione o dell'accertamento). Si segue, a tal fine, un metodo diverso da quello comunemente impiegato dalla giurisprudenza e dalla dottrina, le quali hanno perlopiù dedotto il contenuto di tali regole a partire dalla soluzione di volta in volta prescelta al problema della qualificazione del contratto simulato. La giurisprudenza, muovendo dalla tesi della nullità del contratto simulato, conclude per la diretta applicabilità delle norme del codice civile dedicate all'azione e all'eccezione di nullità. Parte della dottrina, discostandosi da quella premessa, propone soluzioni applicative di segno opposto. Al contrario, nel presente lavoro, la centralità solitamente assegnata al contratto simulato, è occupata dalla simulazione, ossia dalla fattispecie degli effetti che gli artt. 1414 e seguenti designano quali “effetti della simulazione”. Detta fattispecie è infatti quanto forma oggetto dell'attività dei soggetti del processo (l'allegazione, la prova, la cognizione e l'accertamento). La ricostruzione della disciplina processuale della simulazione muove pertanto dalla collocazione della fattispecie simulatoria entro le categorie che informano il contenuto di quella disciplina, e cioè la qualificazione della simulazione come tema di prova, come questione di merito oggetto di mera cognizione, nonché, infine, come oggetto del processo e dell'accertamento munito di autorità di cosa giudicata. La prima parte della tesi (capitoli da 1 a 4) si occupa esattamente di tale inquadramento, prendendo le mosse dalla definizione della fattispecie simulatoria e dalla discussione critica delle due opposte concezioni del fenomeno simulatorio che emergono dalla cospicua letteratura sul tema: una concezione “negativa”, che vede nella simulazione una forma qualificata di difetto della fattispecie negoziale, e una concezione “positiva”, che ravvisa la fattispecie simulatoria in un negozio distinto da quello simulato (il c.d. accordo simulatorio). Enunciate le ragioni a sostegno di quest'ultima concezione, si prende in esame la questione della struttura del contratto dissimulato e del ruolo dell'accordo simulatorio sulla formazione e l'efficacia del medesimo. L'inquadramento della simulazione nelle categorie fondamentali del processo prosegue mediante l'osservazione degli effetti giuridici che l'attività simulatoria produce riguardo ai terzi, e l'inquadramento processuale delle categorie sostanziali richiamate negli artt. 1415 e 1416 c.c. (segnatamente, l'inopponibilità). Infine, si definisce l'oggetto dell'azione di simulazione, mettendo di fronte la prevalente tesi che detto oggetto fa coincidere con il rapporto fondamentale contrattuale, e quella minoritaria che addita le azioni di simulazione e nullità quali esempi di processi di accertamento di situazioni giuridiche preliminari. Si sottopone quindi a critica la tesi del rapporto fondamentale. La seconda parte (capitoli 5 e 6) è dedicata alla discussione di profili scelti di dinamica processuale, segnatamente: l'eccezione di simulazione assoluta, e il problema della sua rilevabilità d'ufficio nei processi diretti all'esecuzione del contratto simulato, nonché in quelli che mirano, al contrario, alla dichiarazione della nullità, ovvero all'annullamento, alla rescissione o alla risoluzione dello stesso contratto; le molteplici sfaccettature che presenta la cognizione della simulazione assoluta nel corso (o a lato) dell'espropriazione forzata intrapresa contro il titolare apparente; la forma del contratto dissimulato e l'ampiezza dei poteri istruttori dei simulanti che intendano dar prova della simulazione relativa, e per suo tramite del contratto dissimulato, particolarmente nel caso in cui la simulazione relativa del prezzo venga addotta per contrastare l'azione revocatoria promossa dal curatore fallimentare contro una compravendita immobiliare “a prezzo vile”; la legittimazione ad agire nell'azione di simulazione; i limiti oggettivi del giudicato di accertamento della simulazione.
