A intersetorialidade no campo sociojurídico

The goal of our research was to analyze the operationalization of intersectionality in sociojurídico field next to the 5th and 6th sticks private legal assistance of the Court of the state of Sergipe/TJSE. For both theoretically deepen the reflections on the field besides sociojurídico identify the components of this professional field institutions participating in the labor suite sticks process, by analyzing the lawsuits. The research is exploratory and is guided by the historical- dialectical materialist method. The methodological procedure for collecting the data used for bibliographic and documentary research and the intentional non- probabilistic sample consisted of 12 physical lawsuits, ie, non-virtualized, who were in the Judiciary Archive TJ. This paper presents the dynamics of intersectionality within institutions known sociojurídicas, from the analysis of the process of intersectoral work, the 5th and 6th custodial sticks judicial assistance of the Court of the state of Sergipe, aimed at enforcing rights of jurisdictional. Clarifies that intersectionality implies interdisciplinary work between specialties operating in sociojurídico field. The interconnection of an institution or between institutions distinct sectors is because the demand, which is made by the users of justice, is intersectoral. She is of refractions of social issues as well as judicialized family and interpersonal conflicts that arise within the State by sector, which historically fragmented, regulates and restricts its services to individuals. We found that among the institutions and sociojurídico field, the area of coverage of the forums I Integrated social security policy for a partnership between professionals who see the need for institutional exchange. / O objetivo da presente pesquisa foi analisar a operacionalização da intersetorialidade no campo sociojurídico junto às 5ª e 6ª varas privativas de assistência judiciária do Tribunal de Justiça do estado de Sergipe/TJ-SE. Para tanto, aprofundou-se teoricamente as reflexões sobre o campo sociojurídico, além de identificar as instituições componentes desse campo de atuação profissional, participantes do processo de trabalho de varas privativas, por meio da análise de processos judiciais. A pesquisa teve caráter exploratório e orientou-se pelo método materialista histórico-dialético. O procedimento metodológico para a coleta dos dados utilizou pesquisas bibliográfica e documental, além de amostra não-probabilística intencional, constituindo-se de 12 processos judiciais físicos, ou seja, não-virtualizados, que se encontravam no Arquivo Judiciário do TJ. O presente trabalho apresenta a dinâmica da intersetorialidade no interior de instituições denominadas sociojurídicas, a partir da análise do processo de trabalho intersetorial das 5ª e 6ª varas privativas de assistência judiciária do Tribunal de Justiça do estado de Sergipe, voltado à efetivação dos direitos dos jurisdicionados. Esclarece que a intersetorialidade implica o trabalho interdisciplinar entre as especialidades que atuam no campo sociojurídico. A interconexão dos setores de uma mesma instituição ou entre instituições distintas acontece porque a demanda que é posta pelos usuários da justiça é intersetorial. Ela se reveste de refrações da questão social, como também de conflitos familiares e interpessoais judicializados, que se apresentam no interior do Estado setorizado, historicamente fragmenta, regulando e restringindo seu atendimento aos indivíduos. Foi identificado que entre as instituições do campo sociojurídico e a política de seguridade social da área de abrangência dos Fóruns Integrados I, há um trabalho de parceria entre os profissionais que veem a necessidade de intercâmbio institucional.

It still intends to investigate great part of the most important doctrinal production concerning the doctrine of the separation of powers, giving ballast to the quarrel concerning the birth, growth and consolidation of the paper of Constitutional Justice as warranting force of the values sculptured in the Constitutions of the countries with democratic experience. In this line of reasoning, this work adopts as starting point the phenomenon of the legalization of the politics or the politicalization of the law, understood here as a social phenomenon, which demonstrate the new role assumed by the Judiciary Power in the current days. In the next chapter, this work reconstructs the historical line of the formation of the State, starting with the Liberal State and the rights of freedom, going trough the Social State and the consolidation of the social rights, finishing with the formation of the Constitutional State and the sprouting supply-individual right, also involving the sphere of solidarity and fraternity rights. In the third chapter, the concern is the doctrine of the separation of powers, passing for its conception and evolution, in the attempt to point out the work of the jurisdictional function as counterpoint of the other instituted powers. During the fourth chapter, this work demonstrates the movement of the constitutionalism, considering the center role that the Constitution acquired modernly, and the concepcion of Justice Constitutional in diverse countries. The third chapter also brings the problem of the neoconstitutionalism as new Law theory, demonstrating the methods of interpretation of the Constitutional Law, intending to give handle of the mission that constitutional principles have, in the modern Constitutions, by becoming effective, using the direct application of values, as well as the problem of the judicial ativism that, in many times, exceeds the tenuous line between the legitimacy of the proper judicial function and the usurpation of the political decisions conceived in legitimate process in other democratic spheres. Finally, study perceives the necessity of the balance between the diverse state functions, to maintenance a healthy democratic system. / O presente trabalho pretende aferir, no contexto do movimento do constitucionalismo, qual foi e qual é o papel do Poder Judicial na consolidação histórica dos direitos fundamentais do ser humano. Pretende, ainda, investigar grande parte da mais importante produção doutrinária acerca da separação de poderes, dando lastro à discussão sobre nascimento, crescimento e consolidação do papel da Justiça Constitucional como força garantidora dos valores esculpidos nas Constituições dos países com prática democrática. Nessa linha de raciocínio, esta dissertação adota como ponto de partida o fenômeno da jurisdicionalização da política ou a politização do direito, entendido aqui como fenômeno social apto a demonstrar o novo papel assumido pelo Poder Judiciário nos dias atuais. Em seguida, o trabalho reconstrói a linha histórica da formação do ente estatal, passa pelo Estado Liberal e pelos direitos fundamentais de liberdade, caminha pelo Estado Social e pela consolidação dos direitos de prestação e termina na formação do Estado Constitucional de Direito e no surgimento dos direitos supraindividuais, envolvendo a esfera da solidariedade e fraternidade dos povos como destinatária de tais direitos. No terceiro capítulo, a preocupação se dá com a doutrina da separação de poderes, passando por sua concepção e posterior evolução, na tentativa de situar o trabalho da função jurisdicional como contraponto dos demais poderes instituídos. Durante o quarto capítulo, demonstra-se conceitualmente o movimento do constitucionalismo e o surgimento e a operacionalização histórica, ante a centralidade que a Constituição adquiriu modernamente, das Justiças Constitucionais em diversos países. Outrossim, o terceiro capítulo traz a problematização do neoconstitucionalismo como nova teoria do Direito, a demonstrar ainda os métodos de interpretação da Lei Maior que pretendem dar cabo da missão de tornar efetiva, pela aplicação direta de valores, dos princípios havidos nas Constituições modernas, bem como o problema do chamado ativismo judicial que, por vezes, ultrapassa a tênue linha demarcatória havida entre a legitimidade da função judicante própria e a usurpação das decisões políticas concebidas em processo legítimo em outras esferas democráticas. Finalmente, à guisa de conclusão, percebe-se a necessidade do equilíbrio entre as diversas funções estatais, salutar para a manutenção coesa do sistema democrático.

La responsabilité médicale et le risque obstétrical / The medical liability and the obstetrical risks

L'obstétrique est généralement présentée comme l'archétype des problèmes de la responsabilité médicale. La présente étude entreprend de dépasser ce constat afin de dévoiler l'appréhension imparfaite du risque obstétrical par la responsabilité médicale. La première partie de la thèse met en exergue les spécificités du risque obstétrical : elle soutient, d'une part, que ces spécificités ont des effets sur les systèmes d'indemnisation, et ; d'autre part, que ces spécificités atteignent également les mécanismes assurantiels. La seconde partie de l'étude s'intéresse à la judiciarisation du risque obstétrical. L'ouvrage constate en premier lieu que celle-ci à des incidences directes sur la pratique obstétricale et des incidences indirectes sur l'économie. La thèse envisage en second lieu d'utiliser les outils contractuels afin d'éviter les méfaits de cette judiciarisation. Entre la théorie et la pratique, la thèse propose de réécrire certaines dispositions législatives afin d'améliorer l'indemnisation des dommages obstétricaux, mais aussi de formaliser un contrat de naissance de nature à déjudiciariser le risque obstétrical. / Obstetrics is generally presented as the archetype of the issues related to medical liability. This study undertakes to go beyond that finding in order to cast light on the specific reasons for which medical liability hardly addresses issues related to obstetrics. The first part of the thesis highlights the specificities of the obstetrical risks: it argues on the one hand, that those specific characteristics have consequences as regards compensation systems; and on the other hand,, that those specific features also have an impact on the insurance mechanisms. The second part of the study deals with the judicialization of the obstetrical risks. The book notes, first, that judicialization has direct effects on obstetrical practice and indirect consequences on the Economy. Secondly, the study considers the use of contractual mechanisms as a way to prevent the effects of judicialization. Between theory and practice, the study proposes to rewrite certain legal provisions with a view to improve the compensation of obstetrics damages but also to formalise a birth contract in order to "de-judicialize" obstetrical risks.

However, there is still a meaningful number of children, adolescents and young people, totally or partially excluded from the formal education system. This fact becomes more evident in early childhood education; within the age group from zero to three years old, that is, in kindergarten. Considering that early childhood education is the first stage of basic education, which, besides being a social right, is a universal right, a duty of the State and the family, this thesis has the objective of analyzing and understanding the reasons for the mismatch between legal texts and the reality in childhood education. Particularly in the context of kindergarten, in the Mauá district, leading to the judicialization of education at this stage. The scope of this research comprises, in the bibliographic context, research and study on the theme of education as a right, the main official texts on the legislation of the subject, and, empirically, data and information collected in a municipal school of early child education. It considers the discourse of the different agents involved in this reality (mothers of children at day-care centers, teachers and school administrators) as well as data obtained at the Municipal Department of Education regarding registration and legal actions, filed by parents, to obtain a vacancy in the day-care center. The theoretical reference of this research is based on authors who have developed studies focused on the right to education and its viability, thinkers who identified with the emancipating approaches to education, among them Paulo Freire and scholars of child education, specifically of early child education. This research develops from quantitative and qualitative approaches, operating with both official data (Municipal Secretary of Education, Federal Government and Public Ministry) as well as information from protagonists of the school reality. According to the data analysis obtained so far, it is quite clear that, since LDB / 96, when early childhood education was included in the basic system, this stage of education gained greater visibility and became the target of public policies. However, there is still not enough amount of schools to care for children between zero and three years of age. Thus, as well as the legal text, which states that education is a universal right, a real text, noticed by a movement of the organization of society, through a claim with the public institutions, is being developed those who have had their rights historically denied. / El derecho a la educación está presente en textos legales, en particular, en la Constitución Federal de Brasil de 1988, en el Estatuto del Niño y del Adolescente (ECA), de 1990, y en la Ley de Directrices y Bases de la Educación Nacional (LDB) 1996. Sin embargo, todavía hay un significativo número de niños, adolescentes y jóvenes, excluidos total o parcialmente del sistema educativo formal. Este hecho se vuelve más evidente en la educación primaria, en el grupo etário compreendido entre cero y tres años de edad, es decir, en la eduacación inicial. Considerando que esta fase es la primera de la educación básica, que, además de ser un derecho social, es un derecho de todos, deber del Estado y de la familia, esta tesis tiene como objeto de estudio el análisis y comprensión de las razones de los desencuentros entre el texto legal y la realidad de la educación inicial. Particularmente en el contexto de la educación inicial, en el municipio de Mauá, llevando a la judicialización en esa etapa de la educación. El universo de esta investigación comprende, en el ámbito bibliográfico, estudios sobre la temática del derecho a la educación y los principales textos oficiales respecto a la legislación del tema, y, en el ámbito empírico, datos e informaciones recogidas en una escuela municipal de educación inicial, considerando los discursos de los diferentes agentes involucrados en esa realidad (madres de los niños de la guardería, profesoras y gestor escolar), además de datos obtenidos en la Secretaría Municipal de Educación referentes a la matrícula y acciones judiciales, realizadas por padres y madres, para obtener una vacante en la guardería. El marco teórico de esta investigación se basa en autores que desarrollaron estudios centrados en el derecho a la educación y su viabilidad, pensadores identificados con los enfoques emancipadores de la educación, entre los cuales están Paulo Freire y otros estudiosos de la educación inicial en especial. Esta investigación se desarrolla a partir de enfoques cuantitativos y cualitativos, basándose tanto datos oficiales (Secretaría Municipal de Educación, Gobierno Federal y Ministerio Público) como en informaciones de los actores y protagonistas de la realidad escolar. A partir del análisis de los datos obtenidos hasta ahora, queda evidente que, a partir de la LDB / 96, cuando aconteció la inclusión de la educación inicial en la educación primaria, esta fase ganó mayor visibilidad y se convirtió en objeto de políticas públicas; Sin embargo, todavía es insuficiente el número de escuelas y guarderías, para la atención de niños de entre cero y tres años de edad. No entanto, ainda há um significativo número de crianças, adolescentes e jovens, excluídos, total ou parcialmente da educação formal. Esse fato se torna mais presente na educação infantil, na faixa etária de zero a três anos de idade, isto é, na creche. Considerando que a educação infantil é a primeira etapa da educação básica, que, além de ser um direito social, é um direito de todos, dever do Estado e da família, esta tese tem como objeto de estudo a análise e compreensão das razões do descompasso entre o texto legal e a realidade, na educação infantil, particularmente no contexto da creche, no município de Mauá, situação que contribui para a judicialização da educação nessa etapa da educação. O universo desta pesquisa compreende, no âmbito bibliográfico, estudos sobre a temática do direito à educação e os principais textos oficiais sobre a legislação do tema, e, no âmbito empírico, dados e informações colhidas em uma escola municipal de educação infantil, considerando os discursos dos diferentes agentes envolvidos nessa realidade (mães das crianças da creche, professoras e gestor escolar) e dados obtidos na Secretaria Municipal de Educação referentes à matrícula e ações judiciais, impetradas por pais e mães, para obtenção de uma vaga na creche. O referencial teórico desta pesquisa aporta-se em autores que desenvolveram estudos centrados no direito à educação e sua exequibilidade, pensadores identificados com as abordagens emancipadoras da educação, dentre os quais Paulo Freire, e estudiosos da educação infantil, em especial, da educação em creches. Esta pesquisa desenvolve-se a partir de abordagens quantitativas e qualitativas, operando tanto com dados oficiais (Secretaria Municipal de Educação, Governo Federal e Ministério Público) quanto com informações dos diversos protagonistas da realidade escolar. As análises dos dados desta tese revelaram que, a partir da LDB/96, quando da inclusão da educação infantil na educação básica, esta etapa de educação ganhou maior visibilidade e se tornou objeto de políticas públicas; contudo, ainda é insuficiente o número de escolas e creches, para atendimento de crianças de zero a três anos de idade. Les obligations conventionnelles nées du divorce / Conventional obligations originating from divorce

Le phénomène de conventionnalisation du droit de la famille, plus précisément le rôle assigné à la volonté individuelle lors d'un divorce se développe de manière exponentielle. Les sources des obligations conventionnelles étant multiples, il convient de définir les éléments qui les composent. Le contrat ne constitue pas l’unique source des obligations conventionnelles. Cette catégorie doit comprendre l’ensemble des actes juridiques conventionnels. Ceux-ci se définissent comme des manifestations de volonté produisant des effets de droit.En droit du divorce, nombreux sont les accords de volontés que les époux peuvent conclure afin de régler les conséquences patrimoniales et extra-patrimoniales de leur rupture. Cette place croissante, accordée par la loi aux volontés individuelles dans l’aménagement des conséquences du divorce, invite à s’interroger sur la qualification des accords conclus par les époux. L’étude des obligations conventionnelles nées du divorce permet de démontrer que des contrats de droit commun s’épanouissent dans le droit du divorce et que parallèlement des conventions du divorce, caractérisées par l’intervention du juge, se développent en marge des principes issus du droit des contrats.En définitive, dans un contexte où est promue la liberté individuelle, les contrats de droit commun constituent un instrument privilégié pour des époux qui souhaitent organiser les conséquences patrimoniales de leur rupture. Cependant, l’ordre public familial inhérent au domaine extra-patrimonial persiste. À cet égard, il faut souligner que la théorie générale des obligations n’a pas vocation à mettre en péril l’état des personnes qui par nature doit demeurer indisponible. / The phenomenon of conventionalisation of family law and more precisely the role assigned to individual will in divorce has been increasing exponentially. As the sources of conventional obligations are multiple, it appears essential to define the variouselements that make up this specific group. Contracts are not the only source of conventional obligations. This last category should include all conventional legal acts which can be defined as expressions of will intending to produce legal effect.In divorce law, the voluntary agreements spouses are allowed to conclude in order tosettle the patrimonial and extra-patrimonial consequences of their separation are numerous. The growing importance given by law to individual will in order to settle the consequences of divorce calls for the examination of the genuine qualification ofspouses’ agreements. The analysis of the conventional obligations originating from divorce demonstrates that common law contracts flourish in divorce law while, at the same time, divorce agreements develop on the fringes of the guiding principles of contract law. Regarding these conventions, judges’ interventions add to individual willso as to reach perfect agreements. Eventually, in a context where individual freedom is promoted, common law contracts are a privileged tool for spouses who wish to organize themselves the patrimonial consequences of their separation. However, matrimonial public order legislation remains and cannot be dissociated from the extra-patrimonial field. In this regard, it should be noted that the general theory of the law of obligations does not intend to endanger the status of persons which must inherently remain inalienable.

Cette thèse dégage, à partir de l'étude des mutations du droit constitutionnel thaïlandais et des doctrines qui le sous-tendent depuis ses plus lointaines origines, le point cardinal de l'ordre politique thaïlandais, identifié comme étant la souveraineté du roi. La construction de la souveraineté monarchique s'est appuyée sur des emprunts étrangers formant, par sédimentations successives, une doctrine proprement thaïlandaise du pouvoir royal l'érigeant en constituant suprême, seul interprète du dharma et de la coutume, auxquels le droit positif serait par nature inféodé. Si, en Europe, le « constitutionnalisme médiéval » a soustrait au roi le pouvoir de modification des lois fondamentales du royaume, le constitutionnalisme moderne a eu tendance à le dépouiller de sa « majesté », et enfin, le néoconstitutionnalisme a transféré son rôle de gardien de la constitution au pouvoir judiciaire ou à un organe spécialisé de contrôle de la constitutionnalité des lois, au Siam puis en Thaïlande, la royauté a su utiliser les innovations constitutionnelles occidentales pour s'institutionnaliser et se transformer tout en maintenant l'affirmation doctrinale de sa souveraineté et son exercice effectif. L'instabilité constitutionnelle chronique qui en résulte a pour effet de neutraliser le développement du parlementarisme nécessaire à la convergence du régime politique thaïlandais vers son modèle britannique. Sont ainsi posés les jalons d'une réflexion sur l'impossibilité du transfert des conventions de la constitution, règles non-écrites qui forment le cœur du droit parlementaire britannique, en tant que cristallisation de contraintes juridiques propres à une histoire constitutionnelle spécifique. / Based on the study of the evolution of Thai constitutional law and its underlying doctrines from its very origins onwards, this dissertation identifies the core principle of the Thai polity as being royal sovereignty. It was built on material and doctrinal constitutional borrowings, that have, through successive sedimentation, created a specifically Thai doctrine of royal power making the King the supreme constituant power, the interpret of dharma and custom, to which positive law is subordinate. In Europe « medieval constitutionalism » took from the King the power to modify the fundamental laws of the realm, modern constitutionalism tended to take his « Majesty» away, and finally, « new constitutionalism » transferred his role as guardian of the constitution to the judicial power or a constitutional court. In Siam and later in Thailand, the monarchy used Western constitutional ideas and mechanisms to institutionalize and transform while at the same time maintaining the doctrine of royal sovereignty and its effective practice. As a result, constitutional instability has neutralized the development of parliamentarism necessary to make the Thai political regime converge towards its official British constitutional model. This finding opens the question of the transferability of the Bristish constitutional conventions unwritten rules at the heart of British parliamentary system, as they are but a crystallization of legal constraints proper to a specific constitutional history. / วิทยานิพนธ์นี้สกัดประเด็นปัญหาอันเป็นหัวใจสำคัญของระบบการเมืองไทยในเรื่องอำนาจอธิปไตยเป็นของกษัตริย์ โดยศึกษาการปรับตัวของกฎหมายรัฐธรรมนูญไทยและลัทธิวิชาการซึ่งช่วยสร้าคำอธิบายที่เกี่ยวข้องนับตั้งแต่เริ่มต้น การก่อร่างสร้างตัวของอำนาจอธิปไตยแบบกษัตริย์อาศัยการหยิบยืมจากต่างประเทศมาอย่างต่อเนื่องจนตกผลึก โดยลัทธิวิชาการในแบบฉบับของไทยโดยเฉพาะเพื่อยืนยันว่ากษัตริย์เป็นผู้ทรงอำนาจสูงสุดในการสถาปนารัฐธรรมนูญ กษัตริย์แต่เพียงผู้เดียวที่เป็นผู้ตีความธรรมะและประเพณี และกฎหมายที่ใช้บังคับในรัฐต้องจำนนต่อธรรมะและประเพณี ในยุโรป “รัฐธรรมนูญนิยมในยุคกลาง” ทำให้กษัตริย์ไม่มีอำนาจในการแก้ไขเปลี่ยนแปลงกฎหมายพื้นฐานของราชอาณาจักร รัฐธรรมนูญนิยมสมัยใหม่พยายามตัดขาดอำนาจสูงสุดเด็ดขาดของกษัตริย์ และในท้ายที่สุด “รัฐธรรมนูญนิยมใหม่” ก็ได้ถ่ายโอนบทบาทในการพิทักษ์รัฐธรรมนูญให้แก่ศาลหรือองค์กรพิเศษที่จัดตั้งขึ้นโดยเฉพาะเพื่อทำหน้าที่ตรวจสอบความชอบด้วยรัฐธรรมนูญของกฎหมาย แต่ในสยาม ซึ่งต่อมากลายเป็นประเทศไทยนั้น กษัตริย์ได้ใช้นวัตกรรมทางรัฐธรรมนูญของตะวันตกเพื่อทำให้ตนเองกลายเป็นสถาบันและทำให้ตนเองเปลี่ยนรูป โดยอาศัยลัทธิวิชาการที่ยืนยันว่าอำนาจอธิปไตยเป็นของกษัตริย์และกษัตริย์ใช้อำนาจอธิปไตยนั้นอย่างแท้จริง ความไร้เสถียรภาพทางรัฐธรรมนูญที่เกิดอย่างต่อเนื่องส่งผลให้การพัฒนาระบบรัฐสภาในระบอบการเมืองไทยเพื่อให้เป็นไปตามรูปแบบอังกฤษนั้นสะดุดลง เช่นกัน เป็นไปไม่ได้ที่จะถ่ายโอนธรรมเนียมปฏิบัติทางรัฐธรรมนูญหรือกฎเกณฑ์ที่ไม่เป็นลายลักษณ์อักษรซึ่งเป็นหัวใจสำคัญของระบบรัฐสภาอังกฤษ มายังประเทศอื่น เพราะสิ่งเหล่านี้บ่มเพาะขึ้นได้จากเหตุปัจจัยบังคับทางกฎหมายซึ่งเป็นไปตามประวัติศาสตร์รัฐธรรมนูญของแต่ละประเทศโดยเฉพาะ

I begin making reference to transformative constitutionalism theory, presenting its main thesis, and then I point out the transformative features of 1988’s Brazilian Constitution and make the distinction between dirigiste constitutionalism and transformative constitutionalism. Then I present and comment both the housing problem in Brazil and the Brazilian legal doctrine on housing rights. After that, I propose a multidisciplinary methodology developed to assess Courts’ transformation performance on housing rights issues. Finally, I present an empirical study that makes a systematic content analysis of 50 'class action' filled by the 'Defensoria Pública do Estado de Sao Paulo against the Municipality of São Paulo, which aims to modify the municipal housing policies to accommodate the interests of marginalized groups. I conclude that in these issues, Courts has a limited transformation capacity, since social change occurs only when political, social and economic agents are also engaged "out of court" and when there is political will of the government. / Esta dissertação tem por objetivo avaliar o desempenho transformador do Poder Judiciário em questões relacionada ao direito à moradia. O estudo tem como referência teórica o constitucionalismo transformador, razão pela qual apresenta-se suas as principais teses, aponta-se as características transformadoras da Constituição brasileira de 1988, e propõe-se uma distinção entre constitucionalismo transformador e constitucionalismo dirigente. Faz-se apresentação e crítica do problema habitacional brasileiro e da doutrina jurídica brasileira sobre direito à moradia. Propõe-se uma metodologia multidisciplinar desenvolvida para aferir o desempenho transformador do Judiciário em questões sobre o direito à moradia. Feito isso, apresenta-se um estudo empírico que faz a sistematização e análise de 50 ações civis públicas propostas pela Defensoria Pública do Estado de São Paulo em face da Prefeitura de São Paulo, em que se pretende modificar as políticas habitacionais municipais para contemplar os interesses de grupos marginalizados. Conclui-se que, nessas questões, o Judiciário tem um desempenho transformador limitado, uma vez que a transformação social pleiteada ao Judiciário só ocorre se forças econômicas, sociais e políticas estiverem mobilizadas 'extra-judicialmente' para tanto e se houver vontade política do Administrador.

Para tal, examinamos a literatura sobre o DL 201 e Poder Judiciário nas áreas do direito, ciência política e administração pública. Coletamos do site do Supremo 190 casos de recursos, inquéritos e ações penais originárias referentes ao art.1º do DL 201. Os processos foram lidos e extraímos informações para montagem de uma base de dados que nos permitisse analisar o processo de judicialização desse instrumento jurídico. Nosso achado é que, em via de controle concreto como recurso somado a uma decisão precedente de ação penal originária do DL 201, entre 1971 e 1987, ocorreu uma judicialização do tipo arbitragem de interesses em conflito, criando uma jurisprudência sobre o DL 201 com força vinculante sobre a primeira instância, para 'salvar' os prefeitos de um suposto uso politizado desse Decreto-Lei em nível local. A partir de 2003, em controle concreto de ação penal originária, não constatamos força vinculante para o Supremo nem para instâncias inferiores. Ao assumir cargos de deputado federal e fazer o processo subir ao Supremo, os ex-prefeitos praticam uma judicialização como tática de oposição, que tem como conseqüência grande número de prescrições e arquivamentos desses processos, um aumento de decisões majoritárias dos órgãos colegiados e queda da correlação entre voto do relator e resultado do julgamento. / This dissertation aims to study the concrete control of constitutionality of common crime proceedings against mayors defined by art. 1 of Decree-Law 201/67, judged in the Federal Supreme Court from 1968 to 2016. To this end, we have examined the literature on DL 201 and Judiciary in the areas of law, political science and public administration. We collected from the Supreme's website 190 cases of appeals, inquiries and criminal prosecutions referring to DL 201’s article 1. The cases were read and we extracted information to set up a database that would allow us to analyze the judicial process of this legal instrument. Our finding is that, through concrete control as a resource, added to a previous decision of criminal action originating in DL 201, between 1971 and 1987, there was a judicialization of the type of arbitration of conflicting interests, creating a jurisprudence on DL 201 with binding force on the lower courts to 'save' the mayors from an alleged politicized use of this Decree at the local level. As of 2003, in concrete control of the originating criminal action, we did not find a binding force either for the Supreme Court or for lower instances. In assuming positions of federal deputy, and bringing the process rise to the Supreme, the former mayors pratice a judicialization as a tactic of opposition, which has as consequence a great number of prescriptions and fillings of these actions, an increase of majority decisions of the collegiate organs and fall of correlation between the rapporteur's vote and the outcome of the trial.
