À l'intérieur d'un État, la distribution des ressources publiques sur le territoire a une importance fondamentale, parce qu'elle représente un facteur de justice dans les rapports entre collectivités territoriales, de sorte qu’elle conditionne la capacité à assurer les charges liées à l’exercice de leurs compétences, dans le respect de leur autonomie, au profit des habitants qui doivent pouvoir bénéficier d’une qualité minimale des services publics. Cette thèse vise d’abord à étudier et à comparer quelle est l’influence de la forme d’État (unitaire pour la France et fédérative pour le Brésil) sur les mécanismes de la solidarité territoriale. Elle se propose de décrire et d’analyser l’efficacité des mécanismes plus importants (financiers : impôt local, dotations, fonds et transferts facultatifs ; coopératifs : institutions représentatives, politiques publiques nationales, mutualisation et contrats entre collectivités territoriales) mis en place, dès le prélèvement des impôts (nationaux ou locaux), en passant par les incitations fiscales, jusqu’au transfert des ressources aux bénéficiaires. Toute d’abord par une description de l’évolution historique qui explique l’organisation territoriale et la naissance des mécanismes de solidarité actuels, puis en montrant les inégalités importantes qui existent, principalement entre communes pour, enfin, finir avec une analyse prospective de l’efficacité et des défauts (guerre fiscale, corruption et évasion fiscales) de ces mécanismes qui visent à réaliser une péréquation (verticale ou horizontale) des ressources publiques. / Within a state, the distribution of public resources inside the territory have a fundamental importance, because it represents a factor of justice in the relationship between local authorities, so that it affects the ability to provide their obligations related to the exercise of their powers in respect of their autonomy, in benefit of citizens who need to have a minimum quality of public services. This thesis aims first to examine and compare what is the influence of the form of state (Unitary for France and Federal for Brazil) on the mechanisms of territorial solidarity. It aims to describe and analyze the effectiveness of the most important mechanisms (financial: local taxes, grants, funds and discretionary transfers; cooperative: representative institutions, national public policies, pooling and contracts between central state and local authorities). Firstly with a description of the historical evolution of territorial organization and the birth of the current solidarity mechanisms and showing the significant existant inequalities, moreover among municipalities, to finally end up with a prospective analysis of effectiveness and defects (tax war, corruption and tax evasion) of these mechanisms designed to achieve equalization (vertical or horizontal) of public resources.

Unitary aspects of Hermitian higher-order topological phases

Robust states exist at the interfaces between topologically trivial and nontrivial phases of matter. These boundary states are expression of the nontrivial bulk properties through a connection dubbed the bulk-boundary correspondence. Whether the bulk is topological or not is determined by the value of a topological invariant. This quantity is defined with respect to symmetries and dimensionality of the system, such that it takes only quantized values. For static topological phases that are realized in ground-states of isolated, time-independent systems, the topological invariant is related to the properties of the Hamiltonian operator. In contrast, Floquet topological phases that are realized in open systems with periodical pumping of energy are topologically characterized with a unitary Floquet operator i.e., the time-evolution operator over the entire period. Topological phases of matter can be distinguished by the dimensionality of robust boundary states with respect to the protecting bulk. This dissertation concerns recently discovered higher-order topological phases where the difference between dimensionalities of bulk and boundary states is larger than one. Using analytical and numerical single-particle techniques, we focus on instances where static higher-order topology can be understood with insights from the mature field of Floquet topology. Namely, even though static systems do not admit a Floquet description, we find examples of higher-order systems to which certain unitary operators can be attributed. The understanding of topological characteristics of these systems is therefore conditioned by the knowledge on topological properties of unitary operators, among which the Floquet operator is well-known. The first half of this thesis concerns toy models of static higher-order topological phases that are topologically characterized in terms of unitary operators. We find that a class of these systems called quadrupole topological insulators exhibit a wider range of topological phases than known previously. In the second half of this dissertation, we study reflection matrices of higher-order topological phases and show that they can exhibit the same topological features as Floquet systems. Our findings suggest a new route to experimental realizations of Floquet systems, the one that avoids noise-induced decoherence inevitable in many other experimental setups.

Investigating The Universality And Comprehensive Ability Of Measures To Assess The State Of Workload

Measures of workload have been developed on the basis of the various definitions, some are designed to capture the multi-dimensional aspects of a unitary resource pool (Kahneman, 1973) while others are developed on the basis of multiple resource theory (Wickens, 2002). Although many theory based workload measures exist, others have often been constructed to serve the purpose of specific experimental tasks. As a result, it is likely that not every workload measure is reliable and valid for all tasks, much less each domain. To date, no single measure, systematically tested across experimental tasks, domains, and other measures is considered a universal measure of workload. Most researchers would argue that multiple measures from various categories should be applied to a given task to comprehensively assess workload. The goal for Study 1 to establish task load manipulations for two theoretically different tasks that induce distinct levels of workload assessed by both subjective and performance measures was successful. The results of the subjective responses support standardization and validation of the tasks and demands of that task for investigating workload. After investigating the use of subjective and objective measures of workload to identify a universal and comprehensive measure or set of measures, based on Study 2, it can only be concluded that not one or a set of measures exists. Arguably, it is not to say that one will never be conceived and developed, but at this time, one does not reside in the psychometric catalog. Instead, it appears that a more suitable approach is to customize a set of workload measures based on the task. The novel approach of assessing the sensitivity and comprehensive ability of conjointly utilizing subjective, performance, and physiological workload measures for theoretically different tasks within the same domain contributes to the theory by laying the foundation for improving methodology for researching workload. The applicable contribution of this project is a stepping-stone towards developing complex profiles of workload for use in closed-loop systems, such as human-robot team iv interaction. Identifying the best combination of workload measures enables human factors practitioners, trainers, and task designers to improve methodology and evaluation of system designs, training requirements, and personnel selection

歐洲統合專利制度與統一專利法院施行之專利策略 -以台灣廠商為例 / The Patent Strategy Analysis of European Unitary Patent System and Unified Patent Court -The Case Study of Taiwanese Enterprises

本論文旨在提供台灣廠商在統合專利制度下之歐洲專利策略建議。本論文首先介紹以歐洲專利公約為主之現行歐洲專利制度,其次再介紹統合專利制度與統一專利法院制度。接著再以現階段我國廠商於歐洲專利申請狀況切入,分析現階段我國廠商於歐洲專利之布局狀況,再針對未來即將施行之統合專利制度,對台灣廠商之申請人及專利權人提出策略建議。 歐洲專利公約自1977年生效後,申請人向歐洲專利局遞交歐洲專利申請後,經過指定國程序,即可在歐洲專利公約之會員國間取得專利保護。某些會員國亦會要求遞交翻譯文件及繳納相關規費。然而,相比於美國、日本及中國,現行的歐洲專利制度是分離破碎的,進而導致申請人須負擔高額的申請費用與訴訟成本,同時亦有許多法律不確定性。在2013年2月,歐盟終於完成協商,正式簽訂確立歐洲統合專利與統一專利法院之條約。統一專利法院將在所有參與之會員國間擁有專屬管轄權。統合專利制度之下,申請人獲得歐洲專利之費用下降、申請程序更為簡化,且提供更有利於申請人之申請方式。如此,統合專利制度預期將提升申請專利之效益與吸引更多的申請者。統一專利法院制度之專屬管轄權,將提升專利有效性與訴訟之法律安定性,且訴訟相關費用之減免,亦有利於專利權人。 統合專利制度的所有準備工作雖已於2015年陸續完成,但仍需要德國、英國及另外任一個歐盟成員國批准歐洲統一專利條約方可生效,預計最快可在2017年達成。統一專利法院亦於2016年3月完成裁判費用之規定,並陸續完成各級法院之選址與訴訟案件性質之分類。專利權人與專利申請人應要謹慎思考在新制度下可能帶來之各種挑戰,特別是台灣廠商需要評估在新制度下之專利策略。因此,本文將針對新制度介紹,希冀能提供欲前往申請的台灣廠商專利佈局之策略建議。 / First of all, this Article overviews current European patent system in particular with the system under European Patent Convention. This Article also summarizes the features of new system and considers the practical steps which should be taking now in preparation for the start of new regime. European Patent Convention has entered into force since 1977. Under European Patent Convention, applicant can deliver their application to EPO and once the mention of the grant is published, the patent has to be validated in each of the designated states to keep its protective effect. In a number of member states, the patent proprietors may have to file a translation of the specification and pay fees. However, the current European patent system has been the fragmentation compared to the United States, Japan and China. This has caused to a high cost of application and lawsuit and also a high level of uncertainty. In February 2013, the European Union formally signed an agreement established a single European patent and the Unified Patent Court. The court will have exclusive jurisdiction for all participating Member States. Through European unitary patent system and Unified Patent Court, this new system reduces the costs of obtaining a patent, simplifies procedures, and regulates the language issue in a user-friendlier manner than before. Therefore, unitary patent system are expected to enhance the efficiency and attractiveness. All preparation of unitary patent system is accomplished before 2015, but still need the Germany, the Untied Kingdom and two other European member states to ratify the agreement. The beginning of 2017 is now said to be the earliest that can be achieved. Owing to the new patent system, patent proprietors and applicants, especially Taiwanese enterprises should be contemplating their patent strategy for meeting the challenge created by this new patent right. Thus, the Article presents patent strategy for Taiwanese enterprises under new patent system in Europe.

Formes modulaires p-adiques sur les courbes de Shimura unitaires et compatibilité local-global / P-adic modular forms over unitary Shimura curves and local-global compatibility

Cette thèse s'inscrit dans le cadre du programme de Langlands local p-adique. Soient L une extension finie de Q_p, \rho_L une représentation p-adique de dimension 2 du groupe de Galois Gal(\overline{Q_p}/L) de L, lorsque \rho_L provient d'une représentation \rho globale et modulaire (i.e. \rho apparaît dans la cohomologie étale des courbes de Shimura), on sait associer à \rho une représentation de Banach admissible de \GL_2(L), notée \widehat{\Pi}(\rho), en utilisant la théorie de la cohomologie étale complétée d'Emerton. Localement, lorsque \rho_L est cristalline (et assez générique), d'après Breuil, on sait associer à \rho_L une représentation localement analytique de \GL_2(L), notée \Pi(\rho_L). Dans cette thèse, on montre divers résultats sur la compatibilité entre les représentations \widehat{\Pi}(\rho) et \Pi(\rho_L), qui s'appelle la compatibilité local-global, dans la cas des courbes de Shimura unitaires. Par la théorie des représentations localement analytiques de \GL_2(L), le problème de compatibilité local-global se ramène à l'étude des variétés de Hecke X construites à partir du H^1-complété des courbes de Shimura unitaires. On montre des résultats sur la compatibilité local-global dans le cas non-critique en utilisant la théorie de la triangulation globale. On étudie ainsi les formes modulaires p-adiques sur les courbes de Shimura unitaires, à partir desquelles on peut construire des sous-espaces rigides de X à la manière de Coleman-Mazur. On montre l'existence des formes compagnons surconvergentes sur les courbes de Shimura unitaires en utilisant les théorèmes de comparaison p-adique, d'où on déduit des résultats sur la compatibilité local-global dans le cas critique. / The subject of this thesis is in the p-adic Langlands programme. Let L be a finite extension of \Q_p, \rho_L a 2-dimensional p-adic representation of the Galois group \Gal(\overline{\Q_p}/L) of L, if \rho_L is the restriction of a global modular Galois representation \rho (i.e. \rho appears in the étale cohomology of Shimura curves), one can associate to \rho an admissible Banach representation \widehat{\Pi}(\rho) of \GL_2(L) by using Emerton's completed cohomology theory. Locally, if \rho_L is crystalline (and sufficiently generic), following Breuil, one can associate to \rho_L a locally analytic representation \Pi(\rho_L) of \GL_2(L). In this thesis, we prove results on the compatibility of \widehat{\Pi}(\rho) and \Pi(\rho_L), called local-global compatibility, in the unitary Shimura curves case. By locally analytic representations theory (for \GL_2(L)), the problem of local-global compatibility can be reduced to the study of eigenvarieties X constructed from the completed H^1 of unitary Shimura curves. We prove results on local-global compatibility in non-critical case by using global triangulation theory. We also study the p-adic modular forms over unitary Shimura curves, from which we construct some closed rigid subspaces of X by Coleman-Mazur's method. We prove the existence of overconvergent companion forms (over unitary Shimura curves) by using p-adic comparison theorems, from which we deduce some results on local-global compatibility in critical case.

Low Intensity Conflict: Contemporary Approaches and Strategic Thinking

Low Intensity Conflict (LIC) is a significant feature of the contemporary world and it is a particular challenge to the armed forces of many states which are involved is such conflict, or are likely to become so. This thesis is not concerned with how such difficult conflict situations arise. Rather it is concerned with how, from the point of view of the state, they may be contained and ultimately brought to a satisfactory resolution. The work is thus concerned with the practicalities of ending LIC. More specifically, the purpose of this research is to establish a framework of doctrinal and military principles applicable to the prevention and resolution of LIC. The principles of this thesis are based in numerous historical examples of LIC and six in depth case studies. These distilled principles are analysed in two central chapters, and are then applied in two latter defence force chapters so as to ensure there practicality and resilience. Numerous defence academics and military practitioners have been consulted in the production of this thesis; their contribution has further reinforced the functionality of the principles examined in this research. The research illustrates the criticality of a holistic approach to LIC. The function of this approach is to guarantee the stability of the sovereign state, by unifying civil, police, intelligence and military services. The effectiveness of the military elements must also be ensured, as military force is central to the suppression of LIC. Consequently, the research makes strategic and operational prescriptions, so as to improve the capability of defence forces that are concerned with preventing or resolving LIC.
