Cross-examining suggestibility : memory, childhood, expertise

Initially a central topic for psychology, suggestibility has been forgotten, rediscovered, evaded definition, sabotaged experimentation and persistently triggers epistemological short-circuits when interconnecting psychological questions of memory, childhood and scientificity, with concrete legal issues of child witnesses' credibility, the disclosure of sexual abuse and psychological expertise in courts of law. The aim of this study is to trace suggestibility through history, theory, research and practice, and to explore its efficacy at the intersection of psychology and law, by examining and comparing the. concrete case of child witness practice in England and Germany. Taking a transdisciplinary approach the study draws on two interrelated sources of 'data' combining historical, theoretical and research literature with the analysis of empirical data. A genealogy if theory and research is combined with the results of reflexive interviews, conducted in England and Germany with practitioners from all those professions involved in creating, applying or dealing with knowledge about child witnesses and suggestibility: judges, prosecutors, lawyers, police officers, psychologists (researchers, experts) and social workers. Drawing on the work of G. Deleuze and 1. Stengers this study shows how practical tensions around reliable witnesses, evidence and expertise merge pragmatically with theoretical movements employed to adjust the discipline, thereby causing frictions and voids. In this sense suggestibility provides a liminal resource: It transgresses disciplinary boundaries and pervades pragmatic and theoretical, global and personal, historical and actual considerations, creating voids that allow us to reconsider the pragmatics of change and to redefine the issue of critical impact, as well as to reformulate the problem of child witness practice and children's suggestibility. The study hopes to make a concrete contribution to facilitating the just prosecution of sexual abuse by adding transparency to the complex and at times unhelpfully polarised field of child witness practice. By exploring the 'pragmatics of change' the study furthermore hopes to give an unsettling and productive impetus to theoretical debates within critical approaches to psychology.

Témoigner par la fiction : une étude de L’Écriture ou la vie de Jorge Semprun et de L’Immense fatigue des pierres de Régine Robin

Prenant comme point de départ le rapport paradoxal qui existe entre le témoignage et la littérature (l’un étant considéré comme véridique et l’autre, comme fictive) le présent mémoire s’intéresse à l’utilisation de la fiction dans les récits autobiographiques et testimoniaux de Jorge Semprun, avec L’Écriture ou la vie (1994), et de Régine Robin, avec L’Immense fatigue des pierres (1996). L’étude de ces textes tente de vérifier l’hypothèse selon laquelle, en faisant de leur témoignage une œuvre littéraire qui assume sa part de fiction, les deux auteurs arriveraient à offrir un témoignage plus juste de leur expérience de la Shoah. Le premier chapitre constitue un panorama critique et historique des deux axes théoriques principaux sur lesquels s’appuie ce travail, d’une part les études sur l’écriture testimoniale et sur la littérature de la Shoah (Derrida, Bornand, Prstojevic) et d’autre part les travaux sur l’autobiographie (Lejeune, Robin, Viart et Vercier). Il s’interroge sur les liens qui les unissent tout en tentant de positionner Robin et Semprun à travers ce champ de pratiques littéraires. Les deuxièmes et troisièmes chapitres s’intéressent ensuite aux différents effets de fiction et de réel qui se trouvent dans les deux œuvres du corpus et analysent, dans un premier temps, la mise en scène d’un pacte de vérité ambiguë passant par la représentation littéraire de la figure auctoriale et de l’acte d’écriture et, dans un deuxième temps, la représentation littéraire du réel en étudiant les nombreuses références intertextuelles, la présence du topos de la visite au camp de concentration, ainsi que l’utilisation particulière de l’archive par Semprun et Robin. / Taking as a starting point the paradoxical link that exists between testimony and literature (one being considered veracious and the other, fictional), this master’s thesis explores the use of fiction in the autobiographical and testimonial works of Jorge Semprun, with L’Écriture ou la vie (1994), and Régine Robin, with L’Immense fatigue des pierres (1996). This study tries to confirm the assumption that, in making their testimony a literary work which assumes a fare share of fiction, the two authors succeed in offering a more accurate testimony of their experience of Holocaust. Chapter one consists in a critic and historic overview of the two approaches, which are this thesis foundations : the Holocaust studies and the testimonial writings (Derrida, Bornand, Prstojevic) on one hand, and the studies on autobiographical writings (Lejeune, Robin, Viart and Vercier) on the other. It focusses on finding what unifies them and tries to position Robin and Semprun in this large literary conventions spectrum. The next two chapters of this thesis are focussing on the various fictional effects as well as on the reality-occurencies in both novels of the corpus, first by studying the staging of this ambiguous truth pact through the literary representation of the auctorial figures and the act of writing, and then, by observing the literary representation of reality through the many intertextual references, the actual concentration camp visits descriptions (that have become a topos of Holocaust literature) and finally Semprun and Robin’s particular use of the archives.

Conception et évaluation d'une consigne verbatim de l'entretien cognitif : la reconstitution / Conception and evaluation of a verbatim instruction of the cognitive interview : the reenactment-alike instruction

Le témoignage oculaire est un élément fondamental de la résolution des enquêtes criminelles. Pour la bonne conduite des enquêtes judiciaires, il apparait primordial d’obtenir des témoignages exhaustifs et exacts. C'est ainsi qu’une équipe de recherche a conçu une méthode basée sur les principes du fonctionnement de la mémoire ayant pour but l’optimisation du recueil des propos du témoin : l’entretien cognitif (Geiselman et al. 1984). Si cette méthode permet d’obtenir des descriptions détaillées sans diminution de la qualité du témoignage, elle est néanmoins marginalement utilisée par les professionnels de la justice. L’objectif de cette thèse est double : il s’agit de proposer une consigne d’entretien qui prend en compte les processus psychologiques en œuvre dans le rappel d’un évènement en mémoire épisodique, et qui soit acceptable du point de vue des pratiques professionnelles. Une première étape a consisté en l’analyse des pratiques professionnelles. L’évaluation d’une formation à l’entretien cognitif auprès d’enquêteurs de police a montré que la méthode est facilement assimilable par les enquêteurs, suggérant que sa non-application sur le terrain ne résiderait pas dans sa difficulté d’utilisation, mais relèverait plutôt de problèmes d’acceptabilité de la part des professionnels. Pour comprendre les objectifs professionnels de l’audition, nous avons ensuite procédé à une analyse des pratiques en termes d’audition. Cette analyse a révélé que les enquêteurs recherchaient de façon prépondérante des informations sur les actions d’une scène criminelle. Sur la base de ces constats, nous avons conçu une consigne dite de reconstitution, qui fait appel aux traces verbatim en mémoire, et vise à apporter des actions générales et spécifiques d’une scène. La consigne a été testée dans un protocole d’entretien et a démontré son efficacité aussi bien quantitative que qualitative, en apportant davantage d’informations correctes sur une scène comparée à d’autres consignes, sans augmentation concomitante du nombre d’erreurs. Il apparait que la consigne de reconstitution répond de façon pertinente au principal objectif d’une enquête de police. / Eyewitness testimony is a fundamental determinant to the resolution of criminal investigations. To conduct criminal investigations effectively, it appears essential to obtain complete and accurate testimony. For this purpose, a research team has developed a method based on the features of human memory, aiming to enhance the eliciting of eyewitness accounts: the cognitive interview (Geiselman et al., 1984). Although this method enables investigators to obtain detailed descriptions without reducing the quality of the testimony, it is still only marginally used by legal professionals. The objective of this thesis is twofold: it aims to provide interviewing instructions which take into account the psychological processes at work in the recalling of events in episodic memory, while simultaneously being acceptable from the standpoint of professional practice. The first step involved conducting an analysis of professional practices. An evaluation of training in cognitive interviewing by police investigators showed that the method is easily learnt and suggests that the lack of implementation in practice does not stem from the difficulties linked to its implementation, but rather arises as a result of a lack of acceptance among professionals. In order to further our understanding of the professional objectives of the hearing, we then conducted an analysis of practices in terms of hearing. This analysis revealed that investigators were essentially seeking out information about the actions which took place during the crime scene. Based on these findings, we designed a re-enactment-alike interviewing instruction, which activates the verbatim traces in memory and is intended to elicit the general and specific actions of a scene. This instruction was tested in an interviewing protocol and demonstrated its quantitative and qualitative effectiveness in providing a greater quantity of correct information compared with other instructions, whilst withstanding a concomitant increase in the number of errors. Re-enactment-alike instruction thus appears highly relevant for reaching the main objective of a police investigation.

[pt] Governança trata heterogeneidade, autonomia e diversidade de interesses entre diferentes agentes em um sistema multi-agente (SMA), estabelecendo um conjunto de normas. A maioria dos mecanismos de aplicação de leis verifica a violação de normas apenas sob o aspecto da interação entre os agentes. Entretanto, em SMAs com a presença de agentes heterogêneos e independentemente projetados, existirão mensagens confidenciais, que só serão percebidas por seus remetentes e destinatários, e execução de ações que só serão observáveis pelos agentes que as executam ou por agentes que sofrem as conseqüências da execução dessas ações. Este trabalho apresenta uma abordagem que implementa um mecanismo de governança em SMA baseado em testemunhos. Agentes podem testemunhar fatos que estão relacionados à violação de normas as quais eles têm conhecimento. Este mecanismo é composto por três sub-sistemas: Reputação, julgamento e sanção. O foco deste trabalho está apenas no sub-sistema de julgamento, responsável por receber os testemunhos e prover decisões apontando se o agente realmente violou uma norma. Será mostrada a arquitetura deste sub-sistema e um processo de julgamento genérico. Finalmente, será ilustrada a utilização deste mecanismo através de um estudo de caso. / [en] Governance copes with the heterogeneity, autonomy and diversity of interests among different agents in a multi-agent system (MAS) by establishing a set of norms. Most of the governance enforcement mechanisms usually check norm violations from the point of view of interaction protocols. However, in MAS, with the presence of heterogeneous and independently designed agents, there will be private messages, that will only be perceived by their senders and receivers, and execution of actions that will only be observed by the agents that execute them or by the agents that suffers from their consequences. This work presents a governance mechanism for MAS based on testimonies. Agents can witness facts that are related to norm violations witch they are aware of. The proposed mechanism is composed by three sub-systems: Reputation, judgment and sanction. This work focuses only in the judgment sub- system, witch is responsible for receiving testimonies and providing a decision, pointing out if an agent has really violated a norm. The judgment sub-system architecture and a generic judgment process will be presented. Finally, the use of this mechanism will be exemplified by a case study.

Loin de la scène politique, Abbas II en exil, Nubar en retraite, chacun enregistre ses Mémoires pour offrir à la postérité leur précieux témoignage, en français non seulement sur leur vie publique mais aussi sur l’Égypte des vice-rois et sur les faits de leurs temps. Nubar, ce pacha d’origine arménienne qui a servi tous les vice-rois de l’Égypte depuis Mohamed Ali jusqu’à Abbas II, insiste dans ses Mémoires sur les projets qu’il a le plus défendus et les défis qu’il a relevés au fil des années : la réforme de la justice, la défense des droits du fellah, son refus du projet du canal de Suez, ainsi que son opposition aux caprices de Saïd et surtout à ceux d’Ismaïl qui ont conduit progressivement l’Égypte à la faillite.Abbas II se défend dans ses Mémoires devant l’Histoire et surtout contre les accusations de son rival Cromer, le consul général britannique, publiées dans Modern Egypt et dans Abbas II. Le Khédive met en avant la lutte nationaliste qu’il a menée aux niveaux politique, éducatif, culturel, entre autres, afin de faire face à l’occupation anglaise. Il explique l’évolution de sa relation avec les généraux britanniques de la politique de rupture sous Cromer à celle de l’entente qui a commencé en 1907 après l’incident de Denchaway (1906).Cette forme d’écriture de soi se distingue de ses formes voisines (le journal, l’autobiographie, le récit de voyage) par son identité mixte (historique, juridique, politique et esthétique). Cela explique la variété des stratégies suivies par le pacha et le Khédive dans leurs Mémoires : stratégie de dénégation, de disqualification de l’adversaire, de l’interprétation, de prudence, etc. Nous étudions ces deux textes en insistant sur le côté littéraire des Mémoires, qui est d’habitude marginalisé au profit de leur dimension historique.Les Mémoires constituent une arme de l’homme politique qui lui permettent de bénéficier d’une grande liberté grâce à leur identité mixte. Le mémorialiste homme de pouvoir multiplie les stratégies d’écriture pour prouver sa crédibilité. Il se défend et fait de son ouvrage un monument capable de traverser les siècles aussi bien par sa valeur historique qu’esthétique. Malgré le débat sur la subjectivité du mémorialiste et sa relation avec l’écriture de l’Histoire, la valeur historique des Mémoires est indéniable. Au terme de notre travail, nous revendiquons l’insertion des Mémoires dans l’enseignement : un moyen parmi d’autres pour tirer ce patrimoine précieux de l’oubli et lui octroyer la place qu’il mérite dans la mémoire collective. / Away from the political scene, Abbas II in exile, Nubar retired, each one has written his Memoirs to offer to the posterity their precious testimony in french, not only about their public life but also about Egypt’s vice-kings and about their time.Nubar, this pacha of armenian origin, and who served all the vice-kings of Egypt since Mohamed Ali to Abbas II, insists in his Memoirs on the projects which he defended the most and his won challenges over the years: the justice reform, the defense of the fellah’s rights, the rejection of the canal of Suez project, his opposition to the whims of Saïd and especially those of Ismaïl which have led Egypt to the bankruptcy.Abbas II defends himself in front of the history, especially against his rival’s charges: Cromer, the general British consul published in Modern Egypt and in Abbas II. The Khedive highlighted his nationalist struggle that he led in several fields: political, educational, cultural fields in order to face the British occupation. He explains the evolution of his relation with the British generals from the discord policy under Cromer leadership to the agreement that began in 1907 after the Denchaway incident (1906).This form of personnal writing differs from its related forms (the diaries, the autobiography, the travel novels) by its mixed identity (historical, legal, political and aesthetic). This explains the variety of the strategies followed by the pacha and the Khedive in their memoirs: strategie of denial, of disqualification of the opponent, of the interpretation, of the caution, etc. We study these texts focussing on the lirerary side which is usually marginalized in the benefit of their historical side.The Memoirs are weapons of the politician which give him free style due to their hybrid identity. The political memoirist multiplies his writing strategies to prove his credibility. He defends himself and makes his book a monument able to cross the centuries by both historical and aesthetic value. Despite the debate about the subjectivity of the memoirist and its relationship with writing the history, the historical value of Memoirs is undeniable. At the end of our study, we reclam to insert the Memoirs in the education programs: a way among others to save this precious heritage from oblivion and give it its rightful place in the collective memory.

These are stories that become repetitive and overbearing to their subject. Because of their blocking nature, such narratives prevent the creation of alternate interpretations. Their rigidity impedes the transition of the experienced fact to memory and hampers its acquisition as such. The goal of this study is to create a venue of debate on the concept of overlaying stories, keeping such discussion in line with clinical practice, in other words, with psychoanalytical therapy. To reach said goal, we trace the delimiting paths of what we perceive as origin, history, narrative, experience and transmission, with the help of underlying areas of psychoanalysis. Then, we create a distinction between concealing stories based on the Freudian concept of screen memories and overlaying stories. With reference of work from the literary piece Austerlitz, by W. G. Sebald, as well as clinical observation based on treatment by the author, we seek further familiarization with the phenomenon of overlaying stories, relating it with the former meta-psychological discussion. It also covers the relevance of the concept of overlaying stories to both analysts and psychoanalytical clinics and issues of collective overlaying stories. Lastly, the relations between the concept of overlaying stories and the topic of generational psychic transmission are discussed / Esta pesquisa se dedica ao estudo de alguns ditos que inviabilizam o esquecimento, tão necessário à perlaboração. Trata-se de histórias que se tornam repetitivas e obliterantes para o sujeito. Pelo seu caráter de tamponamento, tais narrativas impossibilitam a criação de outras versões. Por sua fixidez, impedem a passagem do vivido ao experienciado e dificultam a apropriação da herança. O objetivo deste estudo é a criação de um espaço de debate acerca do conceito de história recobridora, de modo que tal discussão esteja comprometida com o fazer clínico, ou seja, com a terapêutica psicanalítica. A fim de que seja alcançado tal objetivo, percorrem-se os caminhos da delimitação do que se entende por origem, história, narrativa, experiência e transmissão, com o apoio de áreas de interface da psicanálise. Em seguida, faz-se uma distinção entre a história encobridora com base no conceito freudiano de lembrança encobridora e a história recobridora. Por meio do trabalho efetuado tanto com a obra literária Austerlitz, de W. G. Sebald, quanto com uma construção clínica com base em atendimento da autora, busca-se mais aproximação com o referido fenômeno, relacionando-o à discussão metapsicológica realizada anteriormente. Além disso, discute-se a relevância do conceito de história recobridora para o analista e para a clínica psicanalítica. It consists of applying listening activities of formal and informal testimonials in order to promote reflection on the language and contribute to the development of oral communication skills of the students, so necessary for the socio-affective practice of the individual. These reflections also undergo retextualization activities, they discuss themes such as linguistic diversity and the relations between speech and writing in an approach that represents an improvement when considering the guidelines introduced by the textbooks. The proposal in question is based on the design of interactive language - dialogue space that enables social practice of all kinds of acts - contrary to the approach of orality in the classroom as an excuse to practice reading and writing Marcuschi (1997, 2005a , 2005b); Marcuschi and Dion?sio (2007); Dolz; Schneuwly (2004); Bentes (2010); BRAZIL (1997, 1998); Oliveira (2012); Bortoni-Ricardo (2004), Bronckart (2003); Machado (2007). The didactic sequence (DS) - structured in modules - was applied to a group of 6th grade of elementary level from a public school of S?o Domingos in the state of Bahia, during the period of two months, totalizing 26h/classes. The material obtained in the DS and analyzed in this work - audio, video and written texts ? were obtained from the study subjects. The results of the intervention point that working with oral communication in the classroom, from the active listening texts, is productive and that the choice of testimony genre sparked interest and developed the creativity of students, becoming apparent in their productions, their progress regarding the oral competence. It is believed that if the DS were applied in greater time it would give more significant results. The research material is available in a repository for those who are interested in the discussions on the teaching of orality and concerned about the development of the oral competence of their students. The idea is that the proposal presented here add to other orality teaching proposals specifically, and mother tongue teaching, more broadly, in order to improve basic education and the life quality of students, expanding their communicative competence and making them, therefore, able to move around within the society without difficulty, mastering the resources and language mechanisms, understanding the meanings and senses that come to her. / Esta proposta de interven??o pedag?gica ? produto do Trabalho de Conclus?o de Curso realizado no ?mbito do Mestrado Profissional em Letras (PROFLETRAS) da Universidade Estadual de Feira de Santana (UEFS). Os resultados da interven??o apontam que o trabalho com a oralidade em sala de aula, a partir da escuta ativa de textos ? produtivo e que a escolha do g?nero depoimento despertou o interesse e desenvolveu a criatividade dos alunos, ficando evidente, em suas produ??es, seu avan?o no que diz respeito ? compet?ncia oral. Acredita-se que, aplicada em maior espa?o de tempo, a SD daria resultados ainda mais significativos. A tese dedica-se ao estudo de La escritura o la vida de Jorge Semprún. Examina como na obra o narrador, sobrevivente do campo de concentração de Buchenwald, desenvolve uma trajetória dialética para poder narrar sua experiência do campo: primeiro nega sua identidade de sobrevivente para, 47 anos depois, assumi-la na escrita como negatividade que põe em risco permanente sua vida como escritor testemunha da catástrofe. A história dessa superação provisória e permanente da negatividade do campo estrutura-se mediante a fragmentação textual e o diálogo. A contraposição da voz do narrador a vozes de outras personagens e a textos diversos indica que somente através da fragmentação discursiva ele pôde aproximarse do horror vivenciado no campo, pois ela se lhe apresenta como o único modo de exprimir a dialética entre a necessidade do diálogo do narrador com seu passado e a impossibilidade de com ele reconciliarse. A precariedade do sobrevivente objetiva-se na forma precária do romance, marca de singularidade desta obra de Semprún na literatura de testemunho. / The thesis devotes itself to the study of La escritura o la vida by Jorge Semprún. It examines how the narrator, a survivor from Buchenwalds concentration camp, develops in the work a dialectic trajectory in order to be able to narrate his experience at the camp: firstly denying his identity as a survivor for, 47 years later, assuming it in the writing as a negativity that puts a permanent risk on his life as a witness writer of the catastrophe. The history of this temporary and permanent overcoming of the negativity of the camp structures itself through textual fragmentation and dialogue. The contraposition of the narrators voice to the voices of other characters and to different texts points that it was only through discursive fragmentation that he could come closer to the horror experienced at the camp, since it presents itself to him as the only way to express the dialectics between the narrators necessity of dialogue with his past and the impossibility of reconciling himself with it. The survivors precariousness objectifies itself in the precarious form of the novel, a mark of uniqueness of this work by Semprún in the literature of testimony.

Escuta de criança vítima de crime de estupro de vulnerável: perspectivas do direito ao depoimento especial no Tocantins

O presente estudo tem como objeto a análise das condições de (in)efetividade do direito da criança ser inquirida em processos judiciais por meio do depoimento especial do Poder Judiciário do Estado do Tocantins. A finalidade da pesquisa consiste em averiguar em que medida o Poder Judiciário do Estado do Tocantins está preparado para realizar o depoimento especial, quais os caminhos que vem percorrendo para tanto e quais as perspectivas para a sua implantação. Os objetivos centrais da pesquisa foram apontar a evolução histórica do tratamento jurídico dispensado à criança, inclusive na seara penal especificamente quanto ao crime de estupro de vulnerável, apresentar o método tradicional de oitiva do sujeito passivo do crime e o método do depoimento especial e, por fim, analisar da realidade atual das condições materiais e humanas necessárias à oitiva da criança pelo método do depoimento especial, na tentativa de identificar estruturas e projetos existentes no Poder Judiciário tocantinense com tal desiderato. O método de abordagem foi o descritivo; o de pesquisa, dedutivo. Informações advindas de diversas fontes oficiais de pesquisa foram reunidas, organizadas e avaliadas. Apurou-se que o Poder Judiciário do Estado do Tocantins não reúne condições materiais e humanas necessárias à implementação do depoimento especial. Concluiu-se que, apesar dos esforços e iniciativas, o depoimento especial, trazido pela Lei n. 13.431/2007, não encontra ambiente para efetiva e imediata aplicação no Estado do Tocantins, sequer a curto ou médio prazo, o que representa uma violação ao direito de a criança ser ouvida por meio do depoimento especial. / The present study has as its object the analysis of the conditions of (in) effectiveness of the right of the child to be interviewed in judicial processes through the special testimony of the Judicial Branch of the State of Tocantins. The purpose of the research is to find out to what extent the Judicial Branch of the State of Tocantins is prepared to carry out the special testimony, what are the paths it has been going through and the perspectives for its implementation. The main objectives of the research were to point out the historical evolution of the legal treatment given to the child, including in the criminal chamber specifically regarding the crime of rape of vulnerable, to present the traditional method of hearing of the subject of the crime and the method of the special testimony, To analyze the current reality of the material and human conditions necessary for the child's hearing through the special testimony method, in an attempt to identify existing structures and projects in the Tocantins' Judiciary with such desideratum. The method of approach was descriptive; the research, deductive. Information from various official sources of research was gathered, organized, and evaluated. It was found that the Judicial Branch of the State of Tocantins does not meet the material and human conditions necessary for the implementation of the special testimony. It was concluded that, despite the efforts and initiatives, the special testimony, brought by Law no. 13.431 / 2007, does not find an environment for effective and immediate application in the state of Tocantins, even in the short or medium term, which represents a violation of the right of the child to be heard through the special testimony.
