Previous issue date: 2012-11-29 / Nenhuma / Este estudo tem por objetivo identificar, a percepção dos gestores da Universidade do Estado de Mato Grosso – UNEMAT, sobre a atuação da controladoria, observando se a controladoria está auxiliando os gestores da instituição nas suas atividades direcionadas ao cumprimento da missão institucional de atender as demandas do Estado e da sociedade. A Controladoria é um órgão que dá suporte à gestão, fornecendo informações para o processo de tomada de decisão que conduza a organização ao alcance dos resultados planejados, contribuindo assim para sua continuidade. Trata-se de uma pesquisa descritiva e exploratória quanto aos objetivos e envolvendo aspectos quantitativos e qualitativos na abordagem do problema. A coleta de dados deu-se por meio de instrumento de pesquisa estruturado com assertivas e escalas do tipo Likert de cinco pontos, cuja aplicação ocorreu pessoalmente entre o pesquisador e os gestores da gestão atual (2010- 2014), durante o 4º trimestre de 2011, e com os gestores da gestão anterior (2006- 2010) no 2º trimestre de 2012. Em algumas situações especiais essa aplicação ocorreu por meio de correio eletrônico. Para análise quantitativa dos dados utilizouse a mensuração do ranking médio ponderado das escalas, frequência, desvio padrão, coeficiente de variação e coeficiente de correlação de Pearson (r). Os respondentes foram agrupados em gestores da reitoria e coordenadores de campi atuantes nos períodos de gestão anteriormente citados. Os principais resultados retratam, sob a ótica dos gestores de ambas as gestões, que: (a) as mudanças da gestão pública pode favorecer o desenvolvimento da instituição, no entanto, percebem também que ela ainda é mais voltada para o cumprimento orçamentário; (b) a controladoria da UNEMAT é uma área que contribui para o fortalecimento e desenvolvimento da instituição, porém é necessário conhecer melhor a sua aplicabilidade; (c) a falta de estrutura material e humana mais adequada compromete o desenvolvimento das atividades com eficácia; (d) a controladoria precisa atuar mais proficuamente no auxílio da elaboração do orçamento, análises financeiras, avaliação de resultados e controle gerencial, bem como, no planejamento do processo de gestão da universidade; (e) evidenciou-se o distanciamento dos coordenadores de campi da atuação da controladoria, aspecto que precisa ser observado pela gestão. Há reconhecimento geral que a controladoria pode avançar muito nas suas atividades e contribuição à gestão da IPES visto ainda estar com forte viés legal de controle interno. / This study aims at identifying the perception of the managers of the University of the State of Mato Grosso - UNEMAT, about the performance of the controllership, observing whether the controllership is helping the managers of the institution in their activities aimed to the fulfillment of the institutional mission of meeting the demands of the State and of the society. The Controllership is an organ that gives support to the administration, providing information for the process of decision making that leads the organization to reach the planned results, contributing, thus, to its continuity. It is a descriptive and exploratory research, as it concerns to its goals, and involving quantitative and qualitative aspects in the approach of the problem. The collecting of data was made through instrument of research structured with assertive and scales of the type Likert of five points, whose applying occurred personally between the researcher and the managers of the current administration (2010-2014), during the 4 th quarter of 2011, and with the managers of the previous administration (2006- 2010) in the 2nd quarter of 2012. In some special situations that application occurred by e-mail. For the quantitative analysis of the data we used the mensuration medium ranking pondered of the scales, frequency, standard deviation, variation coefficient and correlation coefficient of Pearson (r). The respondents were pooled in managers of the rectory and coordinators of campi actuating in the periods of administration above mentioned. The main results show, under the viewpoint of the managers of both administrations, that: (a) the changes of the public administration may favor the development of the institution, however, they also realize that it is still pointed to the fulfillment of budget; (b) the controllership of UNEMAT, is an area that contributes to the straightening and development of the institution, however it is necessary to know its applicability better; (c) the lack of a more suitable material and human structure compromises the development of the activities with effectiveness; (d) the controllership needs to act more strictly in helping the elaboration of the budget, financial analyses, evaluation of results and management control, as well as in the planning of the process of administration of the university; (e) it was clear the distancing of the coordinators of campi from the acting of the controllership, aspect that needs observing by the administration. There is a general recognition that the controllership can advance a lot in its activities and contribution to the administration of the IPES, since it is still with strong legal bias of internal control.

Previous issue date: 2017-04-05 / No Brasil, há muito que se percebe uma insatisfação dos cidadãos na busca de equacionamento para seus conflitos, por soluções mais ágeis e efetivas para os dissensos. Fortes avanços e muitos esforços têm sido conduzidos em diversas frentes de trabalho institucionais e na governança pública, no sentido de divulgar os métodos de resolução de conflitos extrajudiciais, e entre eles, a Mediação, como oportunidades para inovações buscando novos caminhos que não dependam da tutela jurisdicional do Estado. Recentemente, com o advento da Lei nº 13.140, publicada em 26 de junho de 2015, a Mediação é uma realidade positivada e ganha força no cenário atual, tendo entrado em vigor em 26 de dezembro de 2015. Esta Lei estabeleceu a Mediação judicial, extrajudicial e também deu tratamento à autocomposição de conflitos em que for parte Pessoa Jurídica de Direito Público, trazendo segurança jurídica maior para a sua utilização. O presente estudo faz uma reflexão sobre os métodos alternativos de solução de conflitos à luz da Lei nº 13.140 e sua utilização no âmbito de uma autarquia pública. Foi desenvolvido um questionário para a pesquisa sobre mediação de conflitos, abordando, além dos dados do respondente, informações sobre o uso de meios consensuais na solução de conflitos e entendimento das motivações para o uso ou não dos meios consensuais. O questionário foi implantado na Plataforma SurveyMonkey e distribuídos via e-mail para 245 servidores da Autarquia que ocupam ou já ocuparam cargos de chefia, no período de 25/09/2016 a 10/10/2016, dos quais 90 responderam. Através da análise gráfica das frequências de respostas às questões apresentadas, pode-se concluir que a mediação de conflito é um instrumento importante e adequado para ser praticado na Administração Pública, apesar de não haver previsão para utilização dos meios consensuais de resolução de conflitos no âmbito da Autarquia estudada em decorrência de conflitos entre servidores. / In Brazil, there has long been perceived dissatisfaction among citizens in the search for a solution to their conflicts, for more agile and effective solutions to dissents. Strong advances and many efforts have been conducted in various institutional work sites and public governance, in order to disseminate extrajudicial methods of dispute resolution, including mediation, as opportunities for innovation seeking new ways that do not depend on the legal protection of State. Recently, with the advent of Law No. 13140, published on June 26, 2015, Mediation is a reality and gains strength in the current scenario, having entered into force on December 26, 2015. This Act established the extrajudicial court mediation and gave treatment to self-composition of conflicts in which it is part of Legal Entities of Public Law, providing greater legal certainty for its use. The present study is a reflection on alternative methods of conflict resolution in light of Law No. 13140 and its use in the context of a Public institution. A questionnaire was developed for the research on conflict mediation, addressing, in addition to the data of the respondent, information on the use of consensual means in the solution of conflicts and the understanding of the motivations for the use or not of consensual means. The questionnaire used the SurveyMonkey Platform and was emailed from 09/25/2016 to 10/10/2016 to 245 servants of the Public institution who occupy or have held head positions in the Organization. Out of this total, 90 servants responded. Through the graphical analysis of the frequencies of answers to the presented questions, it could be concluded that conflict mediation is an important and appropriate instrument to be practiced in Public Administration, although there is no intention for implementation of consensual means in the resolution of conflicts among the servants of the Organization studied

Aim of the study. To assess and compare patients possibility to use their right to choose primary health care institutions in the context of competition.
Objectives. 1) To assess factors who determine the choice of private or public primary health care institution; 2) To compare patients opinion about services that are provided in public and private health care institutions; 3) To compare ethical problems in healh care in micro (doctor – pacient) level in public and private health care institutions.
Methods. During the survey there were questioned 380 patients at the public and private health care institutions in Garliava. Response rate in public health care institutions was 81% and in private health care institution it was 84%. Statistical analysis was carried out using statistical package for social sciences - SPSS 11.5 for Windows. Associations between the variables were tested by Chi squared. Patients answers under provided services in public and private health care institutions were analyzed by measuring means that were compared using the Stujdent test (t). Les Services départementaux d’incendie et de secours (SDIS) modernes sont nés de la volonté du législateur français qui, par une loi du 3 mai 1996, a créé des établissements publics autonomes dotés de missions propres et partagées afin de gérer l’un des plus anciens services public au monde : celui des secours et de la lutte contre l’incendie.La qualification ainsi retenue, conforme à l’histoire et à la tradition administrative française, n’en suscite pas moins certaines interrogations car si le critère de spécialité inhérent aux établissements publics est bien présent, celui non moins important de l’autonomie est sujet à caution et pose la question de la véritable nature des SDIS.Ainsi pour mener à bien leurs missions de service public, les SDIS ont besoin d’immeubles, afin de loger les hommes et les véhicules départementalisés, mais aussi de locaux afin de dispenser la formation et d’héberger l’administration nécessaire au fonctionnement de l’établissement public.Ce patrimoine immobilier, hérité principalement des communes et des Etablissements publics de coopérations intercommunales (EPCI) anciennement titulaires de la compétence incendie, a pris majoritairement la forme de mises à disposition à titre gratuit, comme le permettait les textes en vigueur. Cependant, peu de collectivités ont fait le choix de transférer les biens en pleine propriété aux SDIS, mettant ces derniers dans une situation délicate d’un point de vue juridique et comptable puisque les investissements futurs ont été effectués sur des biens ne leur appartenant pas.De même, si en principe, les SDIS construisent, acquièrent ou louent les biens nécessaires à leur fonctionnement (article L 1424-12 du CGCT), certains l’ont fait sur des terrains dont ils n’étaient pas propriétaires, puisque ces derniers ont eux aussi été mis à disposition par des communes ou des EPCI à compétence incendie. Les collectivités historiquement en charge de des SIS ont ainsi marqué une certaine réticence à se départir aussi des terrains d’assiette.Quelle est donc la consistance réelle de ce patrimoine immobilier ? Existe-t-il des moyens de le valoriser ? Si oui, dans quel but ? Et enfin, les SDIS doivent-ils se doter d’une véritable stratégie en matière de gestion de ses actifs immobiliers ? / The modern day local Fire Rescue Services have arisen through the will of the French administration who by an Act of May 3 1996 created autonomous public institutions with specified shared missions in order to manage one of the oldest public services in the world that being the rescue and the fight against fire.The adopted measures, consistent with past history and the traditional French administration nevertheless raise certain questions concerning the true nature of the Fire Rescue Services because even if the specific criteria inherent to public service establishments is respected the no less important autonomy of these establishments should be carefully considered.In order to carry out their public service missions the Fire and Rescue Services not only require buildings to house personnel and departmental vehicules but also to provide training and house to the required administration.This real estate is primarily inherited from the local community and public establishments formerly holding fire authority (EPCI), the majority have been made available free of charge as permitted by law, however few communities have chosen to legally transfer the freehold property to the Local Fire and Rescue Service, which therefore puts them in a delicate position both from a legal and financial point of view as investments for the future have been made on property, legally not belonging to them.Similarly, if in principle the Local Fire Rescue Services construct, acquire or lease property required to operate, some have done so on land they did not own as this has also been made available by the local community or the EPCI. The local communities historically in charge of the Fire Rescue Services have been reluctant to dispose of their land base.So what is the actual substance of this inherited real estate? Are there ways in which it could be enhanced ? If so with what objective? And finally should the local Fire Rescue Services develop a strategy to enable them to manage their real estate assets ?

the society and entities own state in order to promote greater environmental awareness and
actions that mitigate negative environmental impacts, such as the Environmental Agenda
program in Public Administration (A3P). The adoption of an Environmental Management
System (EMS) formalized by an educational institution can contribute to the awareness and
the spread of the importance of environmental issues. The Campus Uberaba of Federal
Institute of Education, Science and Technology of Triângulo Mineiro (IFTM - Campus
Uberaba) is an educational institution that seeks to establish an environmental management
system. This study aimed to carry out an environmental diagnosis in IFTM - Campus
Uberaba as a way to aid in the definition of social and environmental responsibility policies
and the implementation of an EMS in the institution. Exploratory study was conducted in
order to identify existing environmental standards to which the IFTM - Campus Uberaba is
subject, as well as meet other voluntary environmental management practices by public
institutions and / or higher education that could serve as a model for the institution. From the
management reporting analysis, environmental control report, bidding notices, pedagogical
projects of the courses offered by the institution, and also through direct observation, the main
environmental aspects and impacts from campus´s processes and services have been
identified, and existing environmental practices. It was verified that, over time, there was an
intensification of government actions to mobilize their public institutions in the adoption of
sustainability and environmental responsibility criteria. In IFTM - Campus Uberaba,
environmental impacts information were identified on the physical, biotic and socioeconomic
means and the action already present of a solid waste management project and a joint
selective collection program. It was observed that the bidding notices practiced on campus do
not include sustainability criteria in the procurement of materials and services and, for the
discard practices of the institution, the legislation that deals with it has been obeyed. It was
also observed that it is prevalent the use of virgin paper and disposable cups in the institution.
As for the teaching practice it was found that the environmental issues, social and
environmental responsibility and sustainable development are covered by most courses. The
analysis of the survey of voluntary environmental management practices of some higher
education institutions and other public institutions has observed that for the IFTM - Campus
Uberaba assume its social and environmental responsibility are necessary several actions of
its senior management to motivation and conviction of their community. From these findings
it was concluded that the IFTM - Campus Uberaba may adopt changes and fixes in existing
shares to fit the criteria and environmental requirements in voluntary standards, either by ISO
14001 or as the A3P, which should promote a management participatory, enhancing existing
initiatives and involving the whole community. / O Estado brasileiro vem implementando normas e procedimentos que regem as ações da
sociedade e dos próprios entes estatais a fim de promover maior consciência ambiental e
ações que amenizem impactos ambientais negativos, como por exemplo o programa Agenda
Ambiental na Administração Pública (A3P). A adoção de um Sistema de Gestão Ambiental
(SGA) formalizado por uma instituição de ensino pode contribuir para a conscientização e
para a propagação da importância das questões ambientais. O Campus Uberaba do Instituto
Federal de Educação, Ciência e Tecnologia do Triângulo Mineiro (IFTM – Campus Uberaba)
é uma instituição de ensino que busca implantar um sistema de gestão ambiental. O trabalho
objetivou realizar um diagnóstico socioambiental no IFTM – Campus Uberaba como forma
de auxílio na definição de políticas de responsabilidade socioambiental e na implantação de
um SGA na instituição. Foi realizado estudo exploratório a fim de se identificar as normas
ambientais já existentes às quais o IFTM – Campus Uberaba está sujeito, assim como
conhecer outras práticas voluntárias de gestão ambiental por parte de instituições públicas
e/ou de ensino superior que poderiam servir de modelo para a instituição. A partir da análise
de relatórios de gestão, de relatório de controle ambiental, de editais licitatórios, de projetos
pedagógicos dos cursos oferecidos pela instituição e, ainda, através da observação direta,
foram identificados os principais aspectos e impactos ambientais oriundos dos processos e
serviços do campus, assim como as práticas socioambientais já existentes. Pôde-se verificar
que, ao longo do tempo, houve a intensificação das ações do Estado que visam mobilizar suas
instituições públicas na adoção de critérios de sustentabilidade e responsabilidade
socioambiental. No IFTM – Campus Uberaba foram identificadas informações sobre impactos
ambientais nos meios físico, biótico e socioeconômico, e a ação já presente de um projeto de
gestão de resíduos sólidos e de um programa de coleta seletiva solidária. Observou-se que os
editais licitatórios praticados no campus não contemplam critérios de sustentabilidade na
aquisição de bens e serviços e, quanto às práticas de desfazimento da instituição, que a
legislação que trata do assunto tem sido acatada. Pôde-se também perceber que é
predominante o uso de papel virgem e copos descartáveis na instituição. Quanto às práticas de
ensino constatou-se que as questões ambientais, a responsabilidade socioambiental e o
desenvolvimento sustentável são abordados pela maioria dos cursos. A análise do
levantamento das práticas voluntárias de gestão ambiental de algumas instituições de ensino
superior e de outras instituições públicas permitiu observar que para que o IFTM – Campus
Uberaba assuma sua responsabilidade socioambiental, são necessárias diversas ações de sua
alta administração para motivação e convencimento de sua comunidade. A partir dessas
constatações concluiu-se que o IFTM – Campus Uberaba poderá adotar adaptações e
correções em ações já existentes para se adequar aos critérios e requisitos ambientais
estabelecidos em normas voluntárias, tanto pela ISO 14001 ou quanto pelo A3P, e que deverá
promover uma gestão participativa, valorizando iniciativas já existentes e envolvendo toda a
comunidade.

Previous issue date: 2016-06-29 / Resilient organizations adapt to adversities because resilience allows the organizations to absorb complexity and emerge from situations for having larger repertoire of solutions. Such situations are experienced by Higher Education Institutions (HEIs) mainly in the face of affirmative action policies (AAP). The affirmative actions constitute a set of public policies aimed at promoting the rights of the excluded group to ensure, in the medium and long term, equal access to the same opportunities for employment and education. This study, of a qualitative and exploratory nature, aimed at analyzing how the resilient capacities of a HEI influence the implementation of the affirmative action policies from the point of view of their managers, students, technicians and teachers. For this reason, a single case study was carried out in a public HEI – Federal University of Mato Grosso. The data were collected mainly through interviews but also through analysis of secondary documents and direct observation. The main contributions of the study are in proposing a descriptive model of construction of resilient characteristics for the implementation of the AAP in the Higher Education Institutions (HEIs), and the discussion of five research proposals developed in light of the theoretical framework studied, taking into account the data collected in the case study. The results show that situation awareness, identification of the most important vulnerabilities, collaboration between the organizational elements and capacity of adaptation have a strong influence on the resilient capacities of the HEIs to implement the affirmative action policies. / Organizações resilientes adaptam-se à adversidade, porque a resiliência permite às organizações absorver a complexidade e emergir de situações por ter maior repertório de soluções. Tais situações são vivenciadas por Instituições de Ensino Superior (IES), em especial diante das políticas de ações afirmativas (PAA). As ações afirmativas constituem um conjunto de políticas públicas que visam à promoção de direitos do grupo excluído para garantir, a médio e longo prazo, o acesso equânime às mesmas oportunidades de emprego e de educação. Este estudo, de natureza qualitativa e exploratória, teve como objetivo analisar como as capacidades resilientes de uma IES influenciam a implementação das políticas de ações afirmativas na visão de seus gestores, estudantes, técnicos e docentes. Para tanto, foi realizado um estudo de caso único em uma IES Federal pública – Universidade Federal do Mato Grosso. Os dados foram coletados principalmente por meio de entrevistas, mas também análise de documentos secundários e observação direta. As principais contribuições do estudo estão em propor um modelo descritivo de construção das características resilientes para a implementação das PAA nas IES e a discussão de cinco proposições de pesquisa elaboradas à luz do referencial teórico estudado tendo em vista os dados coletados no estudo de caso. Os resultados indicam que a consciência da situação, a identificação das vulnerabilidades mais importantes, a colaboração entre os elementos organizacionais e a capacidade de adaptação desempenham forte influência na capacidade resiliente da IES para implementar as políticas de ações afirmativas.

Previous issue date: 2017-01-03 / As Instituições Públicas de Ensino necessitam de métodos, técnicas e ferramentas gerenciais para auxiliar na gestão de seus processos. O Governo implementou um modelo de excelência em Gestão Pública para contribuir com a melhoria da capacidade de governança e governabilidade das estruturas executivas que deve ser modelado de acordo com as suas premissas. A partir da percepção da necessidade de mudanças na gestão do Cefet/RJ, Campus Maracanã, responsável pelo ensino e pesquisa nas áreas do ensino médio/técnico, tecnológico e superior, esta dissertação tem por objetivo propor um modelo de gestão organizacional baseado nos modelos de referência da qualidade e excelência e Gespública com a finalidade de investigar e caracterizar os elementos da atual gestão do Cefet-RJ através da abordagem do estudo de caso, com a utilização de entrevistas, análise de documentos e questionários realizados com a comunidade. Identificou-se que o modelo de gestão da instituição estudada caracteriza-se como misto, pois tanto o sistema de gestão burocrático quanto o colegiado são observados no estudo. A construção do Meta-Modelo ocorrerá com a integração de diferentes modelos de referência condicionado a uma abordagem sintética e compreensiva, especificando os componentes dos requisitos do Artefato. A escolha da abordagem pelo conceito de Design Science pretende desenvolver soluções que tragam melhorias para a gestão atual, resolvendo problemas que com a criação do artefato que está na interface entre o conceitual e o praticado. Acredita-se, portanto, que o artefato modelo é capaz de promover uma cultura de melhoria contínua do gerenciamento dos processos internos e a análise da aderência da gestão do Cefet-RJ ao artefato conceitual, que é um conjunto de proposições que expressam a relação entre os elementos, formando os requisitos. A pesquisa foi desenvolvida a partir do referencial teórico-conceitual adquirido com um estudo exploratório que posteriormente tornou-se a base para o desenvolvimento de um Meta-Modelo que promoveu o destaque da fragilidade do modelo de gestão atual praticado pela instituição de ensino analisada e as características principais que determinaram a aderência ou não aderência aos requisitos apresentados como solução para a melhoria do processo de gestão para a qualidade com excelência em um processo de ensino, bem como a apresentação de uma proposta sugestiva para a implantação e implementação do Artefato. Desta forma, obteve-se como conclusão que não existe aderência significativa do modelo de gestão praticado com o Meta-Modelo desenvolvido com base na pesquisa. A partir deste resultado, acredita-se que se aplicado, o modelo proposto trará benefícios para a gestão, pois, promoverá soluções quanto aos problemas gerados por procedimentos inadequados que não são os melhores para a execução das atividades que compõem o processo de gestão de uma instituição pública de ensino. Por fim, este trabalho apresenta o artefato modelo e também sugestões para pesquisas posteriores acerca do tema abordado. / The Public Educational Institutions need methods, techniques and management tools to assist in the management of their processes. The Government has implemented a model of excellence in Public Management to contribute to the improvement of the governance and governance capacity of executive structures that must be shaped according to its premises. Campus Maracanã, responsible for teaching and research in the areas of secondary / technical, technological and higher education, this dissertation aims to propose a model of organizational management based on the models of Reference of quality and excellence and Gespública with the purpose of investigating and characterizing the elements of the current management of Cefet-RJ through the approach of the case study, with the use of interviews, document analysis and questionnaires conducted with the community. It was identified that the management model of the studied institution is characterized as mixed, since both the bureaucratic and collegiate management system are observed in the study. The construction of the Meta-Model will occur with the integration of different reference models conditioned to a synthetic and comprehensive approach, specifying the components of the requirements of the Artifact. The choice of approach by the concept of Design Science aims to develop solutions that bring improvements to the current management, solving problems that with the creation of the artifact that is at the interface between the conceptual and the practiced. It is believed, therefore, that the model artifact is capable of promoting a culture of continuous improvement of the management of internal processes and the analysis of the adherence of the Cefet-RJ management to the conceptual artifact, which is a set of propositions that express the relation between The elements, forming the requirements. The research was developed from the theoretical-conceptual framework acquired with an exploratory study that later became the basis for the development of a Meta-Model that promoted the highlight of the fragility of the current management model practiced by the analyzed teaching institution and the Main characteristics that determined the adherence or non-adherence to the requirements presented as solution for the improvement of the management process for quality with excellence in a teaching process, as well as the presentation of a suggestive proposal for the implementation and implementation of the Artifact. Thus, it was concluded that there is no significant adherence of the management model practiced with the Meta-Model developed based on the research. The results obtained with the analysis of the data demonstrate that if applied, the proposed model will bring benefits to the management, including to define the procedures conditioning the operations to the appropriate requirements to the management model of a public educational institution that has its peculiarities. Les relations des collectivités territoriales avec leurs organismes satellites / The relationships between regional authorities and their satellite organizationsVignes, Alexandre 27 November 2017 (has links)
Dans la perspective de mettre en œuvre les services qui relèvent de leurs compétences, les collectivités territoriales sont, en principe, libres d’emprunter le mode de gestion de leur choix et, en conséquence, d’opter soit pour une gestion directe soit pour une gestion déléguée. Cependant, désireuses de confier la réalisation de certaines missions à un tiers tout en conservant la maîtrise de leur exercice, les collectivités territoriales envisagent, parfois, de recourir à une entité personnalisée dont elles constituent les membres et que nous proposons d’identifier sous les termes d’« organismes satellites ». Dans ce cas de figure, les collectivités territoriales sont inévitablement amenées à nouer des relations avec ces structures satellites afin que ces dernières disposent des moyens de fonctionner et aient des tâches à accomplir. Ces relations, à la fois organiques, matérielles et fonctionnelles traduisent, d’une part, la participation des collectivités territoriales aux organismes satellites et, d’autre part, l’attribution de missions des premières aux seconds. Or, le cadre juridique dans lequel évoluent les collectivités territoriales tend à s’opposer à l’établissement de ces relations et à compromettre l’apparente faculté pour les collectivités territoriales de recourir à un mode de gestion mixte de leurs services. / In order to apply the services that come under their competences, regional authorities are, in principle, free to take the method of administration of their choice and, consequently, to opt either for a direct administration or a delegated one. However, having the desire to entrust the realization of some projects to a third party while keeping the control, regional authorities sometimes plan to use a legal entity in which they are members and that we suggest to be identified under the words “satellite organization”. In this case, regional authorities have to build relationships with the satellite organizations so as they have tools to work and to get projects. These organic, material and functional relationships show, on the one hand, the participation of regional authorities in the satellite organization and, on the other hand, the awarding of projects to the satellite organization. But the legal framework around regional authorities seems to be opposed to the setting up of these relationships and compromising the apparent faculty for the regional authorities to use a method of mixed administration of their services.

The process of retrenchment in a public institution with reference to the independent electoral commissionTshifura, Khaukanani Obadiah 30 June 2004 (has links)
The dissertation examines the process of retrenchment in a public institution with reference to the execution of such a process by the Independent Electoral Commission (IEC). The aim is to establish whether or not the retrenchment was substantively and procedurally fair as required by legislation.
Notwithstanding the fact that the staff may have been disadvantaged by the short retrenchment notice (the staff did not have representation prior to the announcement, and the swiftness of the process did not, under the circumstances, provide the staff with enough time to comprehensively apply their mind to the underlying issues), the dissertation finds that the retrenchments had been substantively fair given the fact that the IEC could not retain all staff because of budgetary constraints. The dissertation also finds that the process had been procedurally fair in accordance with section 189 of the Labour Relations Act, 66 of 1995. / Public Adminstration & Development Studies / M.A. (Public Administration)

La commune nouvelle, enjeux et perspectives d'un nouveau régime de fusion des communes / The «commune nouvelle», challenges and prospects for a new merger regimeLenfant, Thibaut 20 December 2018 (has links)
La politique de réforme et de modernisation de l’État engagée par les gouvernements français successifs a visé à mettre l’organisation territoriale de la République aux standards des grandes démocraties occidentales comme l’indique l’avant-propos du dernier projet de loi de décentralisation. La question du nombre de communes en France est partie prenante de cette réflexion. C’est ainsi que la loi du 16 décembre 2010, sous l’influence du rapport rendu par le comité Balladur en mars 2009 et qui s’intitulait «il est temps de décider » a eu pour ambition d’engager la création d’un nouveau dispositif de fusion de communes : «la commune nouvelle». L’objectif est de poser les fondements de la commune du 21ème siècle en facilitant les fusions de communes par l'amélioration du système né de la loi Marcellin du 16 juillet 1971 qui avait connu un succès limité. La récente proposition de loi déposée par le député maire de Lons le Saunier Jacques Pélissard vise à « consolider, améliorer et rendre plus attractif le dispositif de commune nouvelle dans un contexte de nécessaire optimisation de notre organisation territoriale. » 3) Les enjeux : La France et l’Europe font face à une métamorphose économique qui les oblige à s’interroger sur leur organisation administrative. La construction européenne, la mondialisation, et le contexte de crise généralisée auquel la France est confrontée l’oblige à s’interroger sur l’efficacité de ses structures publiques. L’organisation territoriale de la France est-elle à même de répondre aux exigences d’action publiques que le 21ème siècle exige ? Une structure pluriséculaires comme la commune peut elle se moderniser pour faire face ? Bon nombre de pays voisins de la France ont drastiquement réduit le nombre de leurs communes. Le Royaume uni possède 4000 seulement pour une population comparable à celle de la France. Mais s’arrêter à la dimension financière ou structurelle de la commune cacherait le fait que la décentralisation est d’abord et avant tout un processus démocratique et historique. La commune occupe une place centrale dans ce dispositif démocratique français. 4) La problématique :Ce tableau général de la France du début du 21ème siècle nous amène à nous interroger sur la nature de ce nouveau régime. Quels sont les ressorts, les enjeux et les perspectives du régime des « communes nouvelles » et que nous dit-il sur l’avenir de la commune en France? Par la commune nouvelle, assiste-t-on au renforcement de la commune? Ou assiste-t-on au contraire à une dynamique de disparition progressive de la commune au profit d’ensembles plus larges, le régime de commune nouvelles étant un outil de plus de la transformation des structures territoriales historiques par la recherche d’un optimum de l’efficacité. Cette approche nous amènera nécessairement à nous interroger sur le rapport entre la commune nouvelle et l'intercommunalité. La commune nouvelle est-elle la forme la plus aboutie de l’intercommunalité? / The communal fragmentation is at the origin of the communal crisis. The size of the communal perimeters is indeed inadequate to the needs of the citizens and leads to the marginalization of French municipalities. The merger of municipalities is a response to this situation. The latter has not, for the time, substantially reduce the number of municipalities. Created in 2010, the "commune nouvelle" aims to revive the process of fusion. It is therefore a question of defining the impact of this new fusion regime on the municipality. If the "commune nouvelle" first allows the strengthening of municipalities in their means of action, it also endorses a renewal of their institutions. These two dynamics must be assessed in view of the growing importance of intercommunality. It has long appeared as a competitor of the merger of municipalities. However, the law now imposes inter-municipal cooperation to ail municipalities including "communes nouvelles". This obligation does not condemn the latter to marginality. Indeed, the increase of intermunicipal perimeters recorded in 2015, promotes the emergence of a need of proximity that the majority of municipalities are not able to assume given their size. The development of the "commune nouvelle" is therefore useful to the good govemance of the municipal bloc. It can contain the continuous growth of intercommunality and thus mark the great return of the municipality in the French territorial architecture.
