Den slopade ungdomsreduktionen : En studie om nyckelinformanters reflektioner om slopandets konsekvenser för framtida brottslighet / The abolished youth reduction : A study on key informants´ reflections on the consequences of the abolition on future criminalityEdman, Emma, Eklund, Isabelle January 2023 (has links)
The study intends to investigate the abolition of the youth reduction between 18 and 21 years (with a penalty value of at least one year's imprisonment) and what effects the legislative change may have on future crime. Furthermore, the current study aims to find out what attitudes to legislative change exist among actors working with young people, crime and brain development. Therefore, lawyers, criminologists, psychiatrists and actors with a psychological and neurological background were contacted. Based on a qualitative approach, 10 semi-structured interviews were conducted and then analyzed thematically. The analysis revealed five main themes emerged: skepticism, developments in criminal policy, experts talking to deaf ears, consequences - at best no impact and alternative sentencing options. The majority of the informants share a negative view of abolition, partly due to the maturity of youths, and believe that such a consensus also exists in their work sector. When discussing possible reasons for the abolition, the interviews are permeated by the societal developments that have taken place, with an emphasis on the increase in gang crime and a hardening of criminal policy. The abolition is also expected to lead to a variety of future consequences. This includes an increase in the number of inmates in prisons. Several informants also highlighted legislative changes that have taken place in parallel with the abolition of the youth reduction and thus the difficulty of isolating the effect of a specific legislative change. Subsequently, the majority of informants discussed alternative sentencing options, such as personalization. Finally, the question remains whether the abolition of the youth reduction will lead to a sufficiently positive outcome to be worth the negative consequences discussed by the key informants.

[pt] POLICIAMENTO PREDITIVO E ASPECTOS CONSTITUCIONAIS / [en] PREDICTIVE POLICING AND CONSTITUTIONAL ASPECTSFELIPE OLIVEIRA DE MORAES 01 June 2022 (has links)
Questões atinentes a discriminação algoritma e
[en] Predictive Policing is a computerized algorithmic processing system that
uses a database and statistical analysis to predict a future criminal event. System
Little used in our country, but which is already in an advanced stage of operation
in developed countries such as the United States of America and China. The
system, which works based on criminal analysis, manages to foresee and prevent
crimes, avoiding offense to legal interests and the consequent reduction of
violence. This technology that has been implemented as a crime prevention
strategy, used by the Brazilian police, needs fine and systematic adjustments.
Even if in slow steps, actuarial criminal policies see this computer modeling
system as an important contribution to crime prevention. Parallel to this
technological advance, we have a growing legislative movement in the protective
dogmatics of fundamental rights regarding privacy, intimacy and data protection.
Thus, for a legal feasibility of this predictive policing system, its functioning must
be analyzed in correlation with the constitutional rights and guarantees involved
in the process. In this dissertation, we propose as a challenge, first, to collect
reliable information about the technological programs of criminal prediction made
available to public security and the technical-legal aspects involved. In a
dogmatic-legal approach, we analyze the constitutional rights related to the
operationalization of the system. Issues related to algorithmic discrimination and
social inequalities are sensitive topics addressed in the study, as the predictive
policing system, when poorly structured, can exacerbate social problems and be
inefficient in fighting crime. Its source of data, when poorly researched, can bring
about social discrimination and direct a policing that is born biased from the
beginning and applied with partiality. The very functioning of the system reveals
problems related to the management of personal data, intimacy and privacy, when
they go beyond the limits of reasonableness. Another aspect is related to
anticipated culpability, as the system classifies suspects and dispatches police officers to approach them even before any criminal activity occurs, only guided
by a technological device of artificial intelligence, based on statistical analysis.
The theories involved behind predictive policing software can still bring
ideologies according to the line adopted by the system developer, with arms, for
example, in zero tolerance policies and capitalist models of managing systems.
In an even more hidden face, we can observe with a keen eye, aided by the work
Discipline and punish: birth of the prison by Michel Foucault, that the State
sometimes uses the discourse of combating crime and inspection to carry out
social control and dominance of the masses. As the state is not obliged to be
isolated from the social system, without taking advantage of technological
advances, predictive policing can be an efficient tool in reducing crime and
violence as long as its operation is compatible with the legal system and does not
work to feed discrimination society, deepen inequalities and distribute injustices.

Système pénal et politique criminelle : interférences et spécificités / Penal system and criminal policies : interferences and specificitiesBeji, Noël 09 May 2011 (has links)
The conceptual and structural differences between penal systems and the operating mode of the criminal policies linked to these differences. The solutions to the criminal phenomenon are specific to a social construction model, which its consistency and efficiency require the compatibility of the criminal policy and the penal system. The construction of a criminal justice is distinguished by the exclusivity of its configuration and by a particular lecture of its institutions. It is performed throw an intellectual chaining that incorporates its historical, political and social filiations to realize a set of common references.

Previous issue date: 2015-06-16 / Current trends in criminal law propose replacing the deprivation of liberty for
alternative sentences, focusing on education and prevention, particularly for illicit less
offensive potential, given the high costs and damages arising from the prison to the
individual and the community. It is proposed to analyze the criminal alternative used
by Goiás Judiciary to replace the prison sentence for cases of individuals in conflict
with the law, for unlawful conduct associated with problem drug use or under the
influence of these, focusing on the Justice Programme Therapy adopted in Goiânia
County. Through literature, with study of foreign and national literature, this last little,
in addition to legislation, official documents and using qualitative and quantitative
methodology, we proceeded to the analysis of the data, for the period 2010 to 2013.
The study recovered the history of prohibition in the world and in Brazil, legislation
influenced, and the essential concepts for understanding the action of the drug and
its relationship to crime. The history of Therapeutic Jurisprudence were raised, of
foreign origin, and national experience with theoretical support in Wexler and Winick
(2002), Lima (2009) and Fensteseifer (2009). It appears that the criticism that the
Therapeutic Justice homeland receives are unjustified because it differs from the
American and Canadian model. The analysis of the experimental data in Goiânia-GO
concluded that 43.60 % of the participants completed the program with an average
duration of 12 months and 85.1 % of the participants had no involvement in criminal
proceedings as defendants in the region, similar to the results International, showing
that it is an effective alternative to criminal probation and reduction of recidivism.
legislação, documentos oficiais e utilizando metodologia quali-quantitativa, procedeu-
O estudo
difere do modelo americano e canadense.

The thesis analyzes the performance of the secretaries of security and their capacity to generate changes in the security institutions and on the rates of crime and violence. The object of investigation is limited to the scope of the state of Rio Grande do Sul, in the city of Porto Alegre, in the public security administrations of the period between 2001 and 2015. The focus is the security policy proposed by the secretaries of security and the data criminal cases of the city of Porto Alegre, that allow a dialogue with the Portuguese criminal policy and special programs of public security, executed by the Public Security Police. For this scenario, the thesis seeks to present the historical, social and economic context that favors criminality in Porto Alegre and in the city of Porto, by discussing elements such as security plans, policing models, criminal indexes, Portuguese criminal policy, law that decriminalizes drug use in Portugal and the special programs of the Porto Public Security Police. In methodological terms, document analyzes were carried out; data were collected on crime, re-organization of security institutions, investment in training, new technologies and social participation; and interviews were conducted. The theoretical framework was constituted by approaches on public security and dilemmas of violence and crime - Benevides (1985), Soares (2003), Adorno (1996), Velho (2000), Silva (1999); (1998), Johnston & Shearing (2003), Agra (1997), Oliveira (2006), Zedner (2009), Lemieux (2000), Webber (2004) and Jones (2012); and citizenship - Villagómez (1997), Elster (1993), Martin & Ceballos (2004), Sen (2003), Dagnino (2004) and Carvalho (2001) In order to develop this analysis, we link the public security context to fundamental issues such as "governance", which enables us to make contact with management through a specific debate and citizenship as an element that sets a new starting point for security public. We can see that public security in Brazil arrives differently from social strata. In general, using diverse resources, the secretaries of security sought to provide answers that defined a certain type of control over crime and violence, the results are exposed in crime rates. The approaches to confront insecurity range from combating crime to tackling the causality of crime. The view of the criminal has a big difference, some secretaries avoid this angle, some understand that they are citizens who should have opportunities and others understand them as hopelessly deviant people. Thus, the secretaries are divided among more focused on a social-critical approach to the context of crime, those who are in an intermediate stage, conservative, seeking preventive actions and those who focus on a punitive and traditional perspective of the fight against crime. As for Portugal, he comes to this thesis to confirm the possibilities of a peaceful social coexistence, in spite of the existence of socioeconomic problems, highlighting important cultural elements in the construction of safe environments. Finally, the Public Security Police demonstrates the importance of special, perennial, well-defined security programs aimed at more vulnerable groups.

Les mesures de sûreté : essai sur l'autonomie d'une notion / The safety measures : trial on the autonomy of a notionGrégoire, Ludivine 01 December 2014 (has links)
At the moment, two forms of penalties oppose and complement each other: a classic shape and rétributive, the sentences, and a more modern and essentially preventive shape, the safety measures. These two criminal punishments, if they do not possess either the same foundations, or the same objectives, are nevertheless sometimes difficult to differentiate. The question of the relationships which they maintain is recurring but with regard to the constant increase of the number of safety measures in the penal law for these last years, it deserves from now on an answer. The latter will be brought in the form of the notion of autonomy which will on one hand allow to identify clearly safety measures and on the other hand to clear a set of more or less specific rules intended to clarify their legal regime. In this way, the legitimacy of the existence of safety measures can be confirmed.

[pt] POR QUE O LEGISLADOR QUER AUMENTAR PENAS? POPULISMO PENAL LEGISLATIVO NA CÂMARA DOS DEPUTADOS: ANÁLISE DAS JUSTIFICATIVAS DAS PROPOSIÇÕES LEGISLATIVAS NO PERÍODO DE 2006 A 2014 / [en] WHY LEGISLATORS WANTS TO RAISE PENALTIES? LEGISLATIVE PENAL POPULISM IN THE CHAMBER OF DEPUTIES: ANALYSIS OF THE REASONS OF LEGISLATIVE PROPOSALS FROM 2006 TO 2014ANDRE PACHECO TEIXEIRA MENDES 19 July 2016 (has links)
inscrito (John Pratt e Julian V. Roberts).
fizeram quaisquer referências a dados, estudos e estatísticas relacionadas a norma
populismo penal, a ausência do conhecimento técnico e a supremacia do senso
punitivista, sugerindo um comportamento populista punitivo dos parlamentares;
representatividade, confirmando o caráter suprapartidário do populismo penal. A
[en] This doctoral thesis aims to find evidence of the phenomenon called penal
populism in the Brazilian legislative activity, based on the analysis of the
justifications of the bills (B s) which tends to increase penalties, presented for the
period 2006-2014 in the Chamber of Deputies. This work presents as research
problem the investigation of the stated intentions and the reasons why the
legislature persists in raising penalty. Why the political insists on increasing
penalties? It is hypothesis of this work that the legislator has acted as it has
adhered to the penal populism, a phenomenon characterized by speeches and
criminal hardening practices, allegedly backed on a homogeneous public
clamoring for punishment. This violates the criminal upsurge of principles that
derives from the Brazilian constitutional model and invariably bet on the purposes
of the sentence recognized as negative general prevention (deterrence) and
retribution. So, in the theoretical plan, we have established the theoretical
premises for the analysis of B s, (i) indicated five limiting principles of punitive
power, (ii) pointed out the theories of the purposes of punishment recognized by
the official discourse of penology, and (iii) we exposed the new crime control
culture (David Garland), in which the penal populism is inscribed (John Pratt and
Julian V. Roberts). In the practical plan, we have analyzed 758 (seven hundred
fifty-eight) legislative proposals that, after purification, resulted in 191 (one
hundred and ninety-one) that fell within the scope of this research: penalty raising
for existing crime. The year 2006 was chosen as the initial term for two reasons.
First, allows embracing two terms in the Chamber of Deputies, the 53rd and 54th
respectively in the periods 2007-2011 and 2011-2015. Second, it enables the
continuity in the production of scientific knowledge on legislative production on
penal law, considering research published by the Ministry of Justice, Thinking
Series Law No. 32 (Analysis of the justifications for the production of criminal
provisions), which covered the study of legislative proposals from 1987 to 2006.
The final point at 2014 is justified for two reasons: closing the 54th Legislature
Chamber of Deputies (2011 to 2015) and the need to end the data collection phase
for this academic paper. The research findings of this scientific study, after
quantitative and qualitative analysis of the justifications of 191 B s, identified
that: (i) almost half (48.16 percent) of the proposals focus on the deterrent effect of
punishment (negative general prevention), the aim of punishment that has
characterized the penal populism; (ii) 63.35 percent of B s have made no references to
data, studies and statistics related to standard targeted to change, confirming the
penal populism process of destatisticalization, a lack of technical knowledge
and the supremacy of common sense; (iii) a fifth (20.41 percent) of B s were about
crimes against the person, while only 2.09 percent of B s made up the so-called
Economic Criminal Law, confirming the selectivity of the legislator; (iv) almost a
fifth (19.37 percent) of the proposals indicated responsiveness of the legislator to the
media, in which the criminal media repercussion affects the legislature for
bringing punitive bill, suggesting a punitive populist behavior of parliamentarians;
(v) the B s proved to be diluted among the various most representative political
parties, confirming the nonpartisan character of penal populism. The conclusion
of the thesis points to the idea that the Brazilian legislator performs irrational
legislative criminal policy, flirting with the worldwide phenomenon of penal
populism that has characterized contemporary Western democracies. Ignores the
principles for criminal law making. Bet on the deterrent function of punishment,
whose efficiency has not been proven in history. rather, produced mass
incarceration, which is incapable of reducing crime rates.
