Research shows an increase in alcohol consumption among older generations, leading to a rise in alcohol-related issues within this age group. In spite of this, there is a lack of knowledge and national guidelines regarding alcohol abuse among the elderly, resulting in complex work for social welfare officers and home care personnel who must balance the statutory self-determination rights of care recipients with a reasonable standard of living. Through 10 conducted interviews, this study aims to find out how social welfare officers and home care personnel work with alcohol abuse among elderly individuals. The data collected has been analyzed through thematic analysis, aiming to find answers on how professionals describe the work with alcohol abuse among the elderly, as well as how they balance self-determination with a reasonable standard of living. The study's result shows the complexity of working with alcohol abuse among the elderly, the lack of guidelines and policies, as well as the challenges it poses for professionals in their daily work.

Afrikaans text / The Canadian and South African legal systems established equivalent constitutional values and principles pertaining to searches conducted with or without a valid search warrant. It creates the basis for a comparative study on this particular aspect. The Supreme Court of Canada held in R v A. M 2008 S.C.C 19 random sniffer dog searches conducted without neither a reasonable suspicion nor any legislative authority on learners enrolled in public schools, is unconstitutional due to its infringement of a learner's reasonable expectation to privacy, as protected in section 8 of the Canadian Charter of rights and Freedoms. South African learners are randomly search by law enforcement officers by using sniffer dogs for purposes of detecting the possession of illegal drugs in instances without neither a reasonable suspicion nor statutory authority. The search is subsequently conducted in terms of the common law. The common law is not regarded as law of general application to limit a fundamental right in terms of the limitation clause. By taking into consideration the ratio in R v A. M (supra) the conclusion is subsequently that random sniffer dog searches conducted on learners in South African public schools, without neither a reasonable suspicion nor statutory authority, is unconstitutional which infringes section 14 of the Constitution of South Africa of 1996. / Die basis vir hierdie studie is ontleen aan die ooreenstemmende vereistes en beginsels in die Kanadese en Suid Afrikaanse reg ten aansien van deursoekings met of sonder 'n wettige lasbrief uitgevoer. In die Kanadese beslissing van R v A.M 2008 SCC 19 is die grondwetlikheid van ewekansige deursoekings met behuip van snuffelhonde op leerders sonder statutere magtiging uitgevoer, deur die Supreme Court of Canada as ongrondwetlik bevind aangesien 'n leerder wel oor 'n redelike verwagting op privaatheid beskik. The viability of the concept of political liberalism

This thesis examines the viability of the concept of political liberalism. Since its emergence, the idea of a purely political liberalism has been the subject of a voluminous amount of discourse and debate. The concept of political liberalism has been presented as both a solution to the problems of justice and political stability troubling liberal democracies and an exemplar of all that is wrong with contemporary political philosophy; it has, quite literally, altered the landscape and the vernacular of contemporary political theory. Herein it is argued that, despite the significant amount of literature that has been devoted to the analysis of the idea of a purely political liberalism, the idea itself has yet to be subjected to the type of critique that is required if one is to assess its viability effectively. Though there have been a number of contemporary political theorists who have developed conceptions of political liberalism which they believe differ in important ways from those of their doctrinal colleagues, detailed analyses of the concept of political liberalism have and remain focussed almost exclusively on a single formulation: namely, Rawlsian political liberalism. This singular focus has precluded the completion of a comprehensive assessment of the viability of the concept (as opposed to a single conception) of political liberalism as represented both by Rawlsian and non-Rawlsian models. This thesis confronts this problem by expanding the scope of investigation to include a fulsome examination of other prominent paradigmatic conceptions of political liberalism namely, those developed by Charles Larmore and Judith Shklar and in so doing provides a more inclusive and, subsequently, thorough critique than has previously been offered. Adopting such an approach reveals that, despite protestations to the contrary, the prominent paradigmatic conceptions of political liberalism are sufficiently similar in all important respects to enable their conflation for the purpose of analysis; and when subjected to a thorough analysis, the idea of a purely political liberalism proves itself to be untenable. / Political Science / D. An evaluation of the rights of fixed term employees in South Arica

The current South African legislative framework does not properly address the unequal bargaining position between employers and fixed term employees. Ineffective regulation of fixed term employment in South Africa has had the effect of excluding certain groups of fixed term employees from claiming the remedies provided in terms of the Labour Relations Act and other labour legislation. Furthermore, where remedies are applicable to them they are often ineffectual. Interpretational variation evident from case law pertaining to the enforcement of the rights of fixed term employees, indicate clear lacunae in the unfair dismissal protection afforded to these vulnerable employees. This is mainly a consequence of uncertainties related to the interpretation of the legislative provisions. The infusion of the values entrenched in the Constitution of the Republic of South Africa and the development of the common law to reflect these values might augment the scope and availability of rights enjoyed by fixed term employees. But, changing socio-economic and political circumstances necessitates review and amendment of the legislation applicable to fixed term employees to meet the country’s constitutional and international obligations. Proposed amendments to the Labour Relations Act have been tabled. These amendments may be capable of addressing some of the current problems. However, they may also lead to other undesirable consequences. An investigation into problems related to the application of similar provisions as those proposed by the Labour Relations Amendment Bill in other jurisdictions crystallises some possible causes for concern. Students with learning disabilities : an exploration of university staff perceptions

The number of students with learning disabilities entering the higher education system in South Africa is increasing dramatically. At the same time, the misconceptions about disabilities can have distressing consequences for disabled students. A thorough understanding of current staff attitudes and knowledge of learning disabilities will assist when setting up interventions aimed at improving perceptions. This qualitative, phenomenological case study uses the bio-psycho-social model of disability to explore staff perceptions at the University of the Witwatersrand. Interviews with staff members showed that a wide range of opinions and attitudes exist. Although perceptions varied between participants, the main findings indicated that they presented a poor understanding of what disability, and in particular, learning disability means. The conclusion was drawn that Wits University should be proactive in empowering their staff by providing them with opportunities to learn about disabilities. This investment in staff development should ultimately lead to a richer campus life where all students feel welcome. / Educational Studies / M. Ed. (Adult Education)

近年來在我國,有關就業歧視所引起的爭議,已經因各弱勢團體權利意識之覺醒,而有逐漸受到社會的重視,除了一般較為熟知之性別歧視外,尚有其他有關宗教信仰、族群、黨派、身心障礙、語言、年齡及容貌等因素所造成的工作機會或待遇的不平等之現象,也曾引起廣泛的討論,究竟這些現象在我國之嚴重程度如何?我國現行法規制度是否能夠有效因應?有沒必要參酌其他先進國家法制,作禁止歧視之統一性立法?都是值得進一步探討的課題。 因此,本論文針對禁止身心障礙就業歧視制度發展最完備的美國作為探討的對象,首先討論美國禁止身心障礙就業歧視制度之早期發展沿革,包括了禁止身心障礙之概念與理論之簡介以及一九六四年所通過之民權法第七章(Title VII of the Civil Right Act of 1964)、一九七三年通過之復健法(Rehabilitation Act of 1973)之重要規定及對於禁止身心障礙就業歧視問題之影響。其次,則針對一九九0年所通過之美國身心障礙人士法(Americans with Disabilities Act of 1990)作討論。而美國身心障礙人士法乃是禁止身心障礙就業歧視制度之核心規範,因此,本文除了討論該法之立法背景外,同時更針對該法之重要條款規定以及平等就業機會委員會(Equal Employment Opportunity Commission: EEOC)對於該法所頒佈之相關指導原則作一個綜合之分析討論。進而,更針對該法在美國所引發之重大爭議中,選取美國最高法院在最近所作出之最具代表性之六個判決,也對判決作一個綜合之評析,以明瞭其利弊得失之所在及我國可資借鏡參考之處。 再其次,則討論我國目前建構禁止身心障礙就業歧視制度之現狀及所遭遇之困境,主要是對於身心障礙者之就業困境及遭受就業歧視之情形、禁止身心障礙就業歧視之相關規範與制度、身心障礙之就業歧視評議制度運作情形及處理禁止身心障礙就業歧視所引發之爭議等幾個議題作分析,以期能夠對於我國目前建構禁止身心障礙就業歧視制度之現狀及其所遭遇之困境有所瞭解。最後,則以美國處理禁止身心障礙就業歧視問題之經驗,希望能對於我國建立一個正確之禁止身心障礙就業歧視制度之建構方向,以及關於目前我國在處理禁止身心障礙就業歧視問題之一些具體建議。 / Disputes resulted from the employment discrimination have been gradually noticed by Taiwan society due to the awakening consciousness of each disadvantaged minority in these years. In addition to the commonly known of sexual discrimination, other factors of unequal employment and treatment are also widely discussed, such as religion, race, party, disability, language, age and appearance. However, how serious are these phenomena in our country after all? Do existing laws and regulations could solve them effectively? Is it necessary to refer to other modern countries’ legal systems to legislate against discrimination? All of the above are worthy of further discussion. Therefore, America, the country with the most complete legislation system to protect a disability from employment discrimination, is the object for discussion in this article. First to discuss is its early development history, including the introduction of concept and theory, the important regulations of Title VII of the Civil Right Act of 1964 and Rehabilitation Act of 1973 and their influences. Second to discuss is the Americans with Disabilities Act of 1990, which is the core regulation of the legislation system to protect a disability from the employment discrimination; Therefore, in addition to discussing its legislation background, this article also discusses comprehensively of its important regulations and the regulations to implement the equal employment provisions of the Americans with Disabilities Act on it at the same time. Then selects 6 most representative decrees made by Supreme Court of the United State with regard to the important disputes, and also analyze those decrees comprehensively to realize their advantages and disadvantages to find some experiences that could learned in Taiwan. Moreover, is to discuss that the situation and the difficulty in the establishment of the legislation system to protect a disability from employment discrimination, which mainly focus on the analysis of the employment difficulties and discrimination faced by the people with physical and mental disabilities, relevant regulations and legislation system against employment discrimination, operation of committee on employment discrimination, and disputes arose from employment discrimination. Finally, it is expected to establish a correct direction for the establishment of legislation system to protect a disability from employment discrimination and to seek out specific suggestions relevant to problems we have in the management of the employment discrimination faced by the people with physical and mental disabilities through America’s experiences.

大法官在釋字第689號解釋中,首次在解釋文中引進美國法上的「合理隱私期待」概念,以作為人民是否受到憲法隱私權保障的判定標準。事實上,「合理隱私期待」的概念在我國法上並不令人感到陌生。例如,通訊保障及監察法第3條第2項即明確規定:「前項所稱之通訊,以有事實足認受監察人對其通訊內容有『隱私或秘密之合理期待』者為限」。 除了尾隨、全天候視覺監控等類似的古老方法,隨著科技的進步,諸如以衛星為基礎的汽車導航系統、以基地台為基礎的行動電話定位服務等低成本、高效率的定位科技,可以更輕易且嚴重地侵害我們的私生活及隱私。當定位科技成為我們每天生活的一部分時,如何在這樣的脈絡下正確地操作「合理隱私期待」概念,已成為一項重要的議題。 惟國內學術文獻對於如何正確地操作「合理隱私期待」,似乎欠缺全面性地研究。為了填補國內的空白,本文進行了美國及台灣案例法之深入比較分析,尤其是關於合理隱私期待及定位裝置的判決。本文指出了以往我國及美國法院判決的問題,以及邏輯矛盾之處。為了達到更加一致、正確的判決結果,本文認為,在操作合理隱私期望概念時,法院應著重於四個因素,其分別是:「資訊的性質」、「侵害的手段」、「侵害的場所」及「第三人原則」。 / In J.Y. Interpretation No. 689, the Constitutional Court , for the first time, employs the concept of “reasonable expectation of privacy”, originated from the United States, in order to determine whether an individual enjoys a constitutionally protected right to privacy. The concept, however, is not new to our legal system. For example, Paragraph 2, Article 3 of the Communication Protection and Surveillance Act provides: “The communications referred to in the preceding paragraph shall be limited to those for which there is an adequate showing of facts that a person subject to surveillance would have a reasonable expectation of privacy or confidentiality with respect to the content of the communications.” In addition to tailing, around the clock visual surveillance and similar old-fashioned methods, with the advance in technology, our private life and privacy could be more easily and greatly intruded by low-cost, high-efficiency location positioning technology, such as satellite-based car navigation system and cell sites-based cellphone positioning service. When location positioning technology becomes part of our everyday life, how to properly apply the concept of “reasonable expectation of privacy” in this context has also become an important issue. So far, there seems to lack a comprehensive study on the aforementioned issue in domestic academic literature. To fill the gap, this thesis conducts an in-depth comparative analysis of both U.S. and Taiwan case law, especially those involving reasonable expectation of privacy and location positioning devices. This thesis points out the problems and logical inconsistencies in past decisions in both jurisdictions. In order to reach a more consistent and appropriate result, this thesis argues that when applying the reasonable expectation of privacy test, courts should focus on four factors which are: “nature of information,” “measure of infringement,” “the place where the intrusion happens,” and “third party doctrine.”

Les conséquences juridiques de la coexistence de l’obligation d’accommodement raisonnable et du régime public de réparation des lésions professionnelles

Une bourse d'études du Conseil de recherches en sciences humaines (CRSH) a été accordée à l'auteur pour la réalisation de ce projet de recherche. / Suite à l’étude de la genèse de deux régimes occupant une place fondamentale en droit du travail québécois, soit le régime public de réparation des lésions professionnelles institué par la Loi sur les accidents du travail et les maladies professionnelles, et l’obligation d’accommodement raisonnable, issue du droit à l’égalité consacré à l’article 10 de la Charte québécoise, ce mémoire s’intéresse au déploiement du conflit normatif et du conflit juridictionnel découlant de l’évolution en parallèle de ces deux sources d’obligations pour les employeurs, dont l’objet est la réintégration et le maintien du lien d’emploi du salarié atteint d’un handicap. Cette étude propose ensuite d’explorer les conséquences juridiques de la solution retenue par la Cour d’appel du Québec, dans l’arrêt Caron rendu en juin 2015, laquelle décide de juxtaposer une obligation d’accommodement raisonnable au régime public de réparation des lésions professionnelles. Ainsi, ce mémoire met en évidence les conséquences en droit constitutionnel canadien et quasi constitutionnel québécois de la démarche utilisée dans l’arrêt Caron et des résultats auxquels elle a conduit, en recentrant la place du droit à l’égalité en droit public et en discutant de ses impacts sur la séparation des pouvoirs. En outre, ce revirement jurisprudentiel engendre maintes difficultés au regard de la particularité du droit administratif, plus spécifiquement quant au rôle et aux pouvoirs limités de la C.N.E.S.S.T. et du T.A.T.-D.S.S.T. Enfin, cette analyse fait ressortir que la solution retenue par la Cour d’appel porte atteinte à l’équilibre que s’efforce de maintenir ce régime public reposant sur un important compromis social. / Following the review of the genesis of two fundamental regimes in Quebec labour law, the public system that provides repairs to injured workers, established by the Act respecting industrial accidents and occupational diseases, and the duty to provide reasonable accommodation arising from the right to equality under section 10 of the Quebec Charter, this thesis focuses on the development of the normative conflict and the jurisdictional conflict stemming from the parallel evolution of these two sources of obligations for employers. Both of these are based on the reinstatement of disabled workers and the continuation of their employment relationship. This study proposes to explore the legal consequences of the solution adopted by the Quebec Court of Appeal in Caron’s case, dated June 2015, in which the Court decided to overlay the employer’s duty to accommodate onto the Workers’ Compensation public system. Thus, emphasizing on the role that the right to equality plays in public law and discussing its impact on the separation of powers, this thesis shows the consequences from the approach used in the Caron judgment and its particular results through Canadian constitutional and Quebec quasi-constitutional principles. Furthermore, this significant change gives rise to many difficulties regarding the particularities of administrative law, and more specifically, the role and the limited powers of C.N.E.S.S.T. and T.A.T.-D.S.S.T. Finally, this analysis highlights that the solution held by the Court of Appeal infringes on the balance attempted by the public system based on an important social compromise.
