The Impact of the Affordable Care Act on the Safety-Net. A Focus on Two Community-based Clinics Serving Latin@ Immigrants in the Greater New Orleans Region

. Latin@ immigrants face many obstacles to affordable healthcare that push them to disproportionately rely on the primary safety-net for their healthcare needs. This system is mostly funded with public monies that will be significantly reduced when Affordable Care Act is fully implemented. Since undocumented Latin@ immigrants are prohibited from accessing federally funded healthcare, they will be left out of the health care reform. This thesis examines two community-based clinics in the Greater New Orleans area that serve this population, and have developed linguistically and culturally appropriate programs that address its needs. The New Orleans Faith Health Alliance and Common-Ground Health Clinic are cases used to explore the impact that the Affordable Care Act will have in the already unstable safety-net in New Orleans. Through the analysis of other models around the nation, this thesis presents viable recommendations to both clinics and the City of New Orleans Health Department.

La présente recherche entend analyser les emplois occupés par des migrants dits « sans-papiers », originaires majoritairement de la vallée du fleuve Sénégal, à Paris, à la lumière des processus de régularisation par le travail dont ils sont l'objet. En mobilisant les notions d'« identités de papiers » (Dardy [1991] 1998 ; Noiriel, 1998, 2007 ; Bruno, 2010) et d'« interstices de jeu », la thèse, basée sur une approche sociologique qualitative et inductive, cherche à mettre à jour les mécanismes et logiques à l’œuvre dans la mise au travail d'une population particulière qui est celle d'étrangers en situation irrégulière. Aussi, l'absence d'un titre de séjour en règle a-t-il pour effet la mise en relation de ces migrants avec des secteurs d'emploi déterminés dans un espace économique particulier, et pour lesquels les emplois observés relèvent du marché du travail dit secondaire, voire exogène, aux formes d'emploi précaires et instables. Si les migrants rencontrés acceptent ces emplois précaires et quelque peu dévalorisés, c'est parce que le travail (et le salariat qu'il permet) définit les situations migratoires observées. Pour autant, l'adéquation entre une offre et une demande de travail tire en partie sa légitimité de l'État français. Aussi, les processus de régularisation par le travail en viennent-ils à déterminer partiellement la rencontre entre cette offre et cette demande de travail, la justifier en la normalisant pour partie. Du reste, si l’État en vient à légitimer cette rencontre, c'est aussi au moyen d'une récupération au profit d'une « instrumentation » (Lascoumes, 2003) de la figure du « Travailleur Sans-papiers », énoncée et revendiquée par la grève de 2008-2010. En somme, l'observation des situations d'emploi (notamment dans la répétition des postes occupés et des formes d'emploi) amène à considérer la constitution d'une population au travail, permise par la reconnaissance par l’État de la figure du « Travailleur Sans-papiers ». Les procès de régularisation au titre du travail dessinent la figure du « Travailleur Sans-papiers » et décident si l'étranger en situation irrégulière peut être régularisé par le travail ou non, par le jeu de catégorisations que produit l’État. Et la thèse défendue est la suivante : l'emploi des migrants dits « sans-papiers » s'arrime à des logiques économiques qui assurent la mise en place et la permanence de formes d'emploi particulières. Ces formes d'emploi se nourrissent de la précarité des postes occupés et de la relation salariale contractée. Dans le cas des migrants rencontrés, elles renvoient à la production de formes d'infra-citoyenneté, sous-tendues par des logiques politiques (dans la gestion des flux migratoires et des politiques de main-d’œuvre) que la régularisation par le travail vient couronner. La figure du « Travailleurs Sans-papiers » telle que l'a promue la grève de 2008-2010, mais reprise dans les processus de régularisation au titre du travail, est alors l'archétype du travailleur régularisable et le travail des sans-papiers en est sa logique-même. Ils sont tous deux déterminés par un dispositif singulier de biopolitique. / This research deals with the employment of undocumented people from the Senegal valley, in Paris and the legalization processes. Mobilizing the two concepts of "identify of papers" Dardy [1991] 1998; Noiriel, 1998, 2007; Bruno, 2010) and "interstices of game", this doctoral thesis, based on an sociological and inductive approach, highlights the mechanisms and logics that are inherent to putting undocumented people into work. From there, the lack of residence permit implies the inscription of these migrants in specific sectors of activities. Therefore, employments are registered in the secondary labour market, if not an exogenous market, where employment and its forms are very precarious. If migrants take these jobs, it is because work is the key parameter in the migratory situations. The balance between supply and demand of labour draws its legitimacy from the French State. Indeed, leglization processes determine this balance, and justify it by normalizing it. The legitimacy of French State is allowed by a recovery and "instrumentation" (Lascoumes, 2003) of the figure of "Undocumented Worker", which was first introduced during the strike of 2008-2010. In other words, the employment situations lead to discuss of the production of a specific labour force by the State. The legalization processes are based on the figure of "Undocumented Worker" and by this manner elect the alien in an irregular situation who will be regularized. This lead to formulate the following argument: the employment of undocumented migrants is due to economic logics which establish specific forms to putting undocumented people into work. This is guaranteed by precariousness of status employments, enables to produce forms of a low citizenship that political logics reinforce. Thus, the legalization process supports this perspective. The figure of "Undocumented Worker", from the strike of 2008-2010, is used by the French State to justify the legalization process by work. All these elements are included by a manner of governing that is attached to a particular scheme of biopolitic.

Immigration Attorneys' Perceptions and Attitudes About Delays in Removal Proceeding Hearings

Abstract Immigration courts in the United Sates are struggling to resolve 610,524 removal proceedings cases with approximately 330 judges located in 58 immigration courts nationwide. Due to the limited number of judges, case backlogs have increased steadily, with the wait time being 854 days in 2017 for the first hearing and much longer for case resolution. The purpose of this case study was to explore the perceptions and attitudes of immigration attorneys about delays in removal proceeding hearings in an immigration court in the southwest. Kettl's transformation of governance theory served as the theoretical foundation for this study, which explored immigration attorneys' perceptions about the effects of delays on the welfare of immigrant clients, the effects of delays on client-attorney relationships, and potential solutions to the delay crisis. Data were collected through semistructured interviews with a snowball sample of 10 participants as well as deportation hearing observations and court document reviews. Data were analyzed using the open coding technique. Findings indicated that legal representation was challenging for undocumented immigrants as the lack of proper documents often dissuaded immigrants from seeking legal guidance and they experienced challenges in navigating workplaces, schools, and society. Findings also indicated inadequacies in immigration courts and the need for more funding and resources such as judges, staff training, online application submission system, and judicial system restructuring. The implications for positive social change are directed at immigration policymakers and decision makers as a better understanding of the delay crisis may help them to focus attention and resources in helping to reduce the backlog and improve the judicial process.

Background: The provision of healthcare for immigrants is a global issue. Understanding the complexities of migrant’s experiences seeking healthcare is essential to improving their ability to access healthcare. This qualitative study reports on the experiences seeking healthcare for three groups of migrants. Methods: Seventeen one-on-one interviews were conducted with Spanish-speaking women through an interpreter. Community-based participatory action research was the framework utilized for this study. Results: An individual’s immigration status emerged as the single most important factor affecting both an individual’s ability to seek out healthcare and what their experiences are when trying to access healthcare. Conclusion: This study brings to light two issues that are not discussed in great depth in the migrant health service literature. The immigration status of migrants is the largest factor affecting their ability to seek healthcare. Food security is a very stressful issue for many refugees and undocumented immigrants.

Papperslösas tillgång till hälso- och sjukvård : Kunskap och uppfattningar hos personal inom öppen hälso- och sjukvård i landstinget i Uppsala län

Syftet med denna studie var att undersöka kunskap och uppfattningar om papperslösas tillgång och rätt till vård hos personal inom öppen hälso- och sjukvård i Landstinget i Uppsala län. Ett ytterligare syfte var att undersöka om information kring handhavandet av papperslösa finns på arbetsplatserna, vad personal i så fall anser om detta, samt vad de önskar för information.   Studien är av en deskriptiv design med kvantitativ ansats. 86 anställda vid vårdcentraler i Uppsala län besvarade enkäter med frågor angående kunskap och uppfattningar om lagstiftning samt tillgång till och önskan om information gällande papperslösa. Insamlad data har sammanställts i Microsoft Excel och presenterats i tabeller och diagram.   Resultatet av studien tyder på att det finns en kunskapsbrist bland personal inom öppen hälso- och sjukvård angående lagstiftningen om papperslösas tillgång till sjukvård. Enligt de medverkandes vetskap finns ingen information tillgänglig på arbetsplatsen gällande papperslösa, och så gott som alla önskar information av något slag. Majoriteten av de tillfrågade anser att papperslösa ska ha samma rätt till vård som svenska medborgare.   Slutsatsen av denna studie är att det finns ett behov av information och riktlinjer gällande handläggning av papperslösa i Landstinget i Uppsala län. / The aim of this study was to investigate knowledge and opinions concerning undocumented migrants’ access and right to health care among employees within the primary health care sector in the county council of Uppsala. An additional aim was to investigate whether there is information available about management of undocumented migrants at the workplaces, and if so what the employees think about it and what kind of information they wish to receive.   The study is quantitative with a descriptive design. 86 employees at primary health care centres within the county of Uppsala answered questionnaires concerning knowledge and opinions about legislation as well as access to and demand for information concerning undocumented migrants. Collected data was compiled using Microsoft Excel and was then presented in tables and diagrams.   The result of the study indicates that there is a lack of knowledge among employees within the primary health care sector concerning legislation on undocumented migrants’ access to health care. According to the employees’ knowledge there is no information available at the workplace concerning undocumented migrants, and nearly everyone requested information of some kind. The majority of the employees are of the opinion that undocumented migrants should have the same right to health care as Swedish citizens.   The conclusion of this study is that there is a need for information and guidelines concerning management of undocumented migrants in the county council of Uppsala.

"Väcker jag hopp om nåt som inte finns?" : En studie om diakoners arbete med papperslösa / "Am I raising hope for something that isn't there?" : A Study of Deacons of the Church of Sweden working with Undocumented Migrants

Syftet med denna studie är att öka kunskapen om diakoners arbete med papperslösa. I Sverige finns det 10 000-tals papperslösa som befinner sig här efter att undanhållit sig utvisningsbeslut, smugglats in som traffickingoffer eller strävar efter att arbeta ihop inkomster att skicka till hemlandet. Med en kvalitativ ansats har jag intervjuat sex stycken diakoner som arbetar i Svenska kyrkan i Stockholm, och som alla möter och erbjuder socialt stöd till papperslösa. Resultatet har jag analyserat utifrån teori om ekologiskt perspektiv på socialt arbete med flyktingar och migranter, samt teorier om värdegrunder i socialt arbete. Resultatet visar att diakonerna fokuserar på det sociala arbetet på mikronivå, men att viss samverkan på mesonivå förekommer. Dock förekommer inte särskilt mycket samverkan med andra diakoner som möter papperslösa. De diakoner som samverkar minst uttrycker en ensamhet rörande sitt arbete. Diakonerna ställs inför etiska överväganden rörande resursfördelning och då prioriteras papperslösa overstayers framför de som befinner sig i Sverige för att arbeta. Resultatet visar även att diakonerna upplever en maktlöshet rörande sitt arbete och gör etiska överväganden huruvida det är värt att bistå människor som lever papperslösa, trots att det i vissa fall verkar bättre att återvända. Denna maktlöshet kan kopplas till de juridiska kunskaper diakonerna besitter eller saknar, då den diakon som har störst juridisk kunskap även är den som uttrycker mest hopp. Med ökad samverkan mellan diakoner som arbetar med gruppen, och med ökande juridiska kunskaper gällande lagstiftningen verkar både känslan av ensamhet och maktlöshet att minska.   Nyckelord: Papperslösa, diakon, Svenska kyrkan, trosbaserat socialt arbete, flyktingar, migration   Keywords: Undocumented Migrants, Irregular Migrants, Deacon, Church of Sweden, Faith-based Social Work, Refugees, Migration

"AVRÄTTAS ej BENÅDAS" : en kvalitativ studie av migrationsmyndigheternas bedömning av synnerligen ömmande omständigheter i ärendena för sex funktionshindrade migranter

This study is aimed to increase the knowledge about the Swedish immigration authorities’ assessment of the asylum applications based on particularly distressing circumstances, submitted by disabled undocumented migrants. Making an attempt to explain the reasons of asylum-seekers’ health deterioration during the asylum process, this study determines the factors in migration authorities proceedings affecting such deterioration. Documents in five personal files concerning six disabled asylum-seekers, whose applications were declined, were studied by applying two observational methods: content analysis of the documents in the personal files and non-participant observations made during receptions of undocumented migrants at the Swedish Asylum Committee. The results of the study have shown that migration authorities' way of applying the principle of child’s best interests have a declarative character, while the disability perspective is completely ignored. The migrations authorities make free interpretations of the information on the countries of asylum-seekers' origin, while adaptation to Swedish conditions does not work at all as cause for residence permit. Advocates, who neglect their prior duties, have also a negative influence on the asylum process. Analyzed from the perspective of appropriate sociological concepts, the results of this study have shown that the above mentioned observations cause disabled undocumented migrants health deterioration.

This study explores undocumented migrant’s access to social welfare and income support distributed by the non-profit and public sector in Stockholm. The study is conducted through interviews with representatives from the non-profit sector whose organisations and networks come in contact with undocumented migrants. According to Swedish law the social services have a responsibility to assist everyone who temporarily resides within the county. Consequently undocumented migrants have the right to assistance in acute situations. According to the testimonies given from the non-profit sector undocumented migrants have much difficulties acquiring all forms of aid from the social services. The respondents experiences show a multi-layered complex of problems giving reason for bureaucrats representing the public authority narrowing their services to undocumented migrants. The main focal points presented in this study are bureaucrats confusion regarding their own mission in relation to the migration board as well as the services restricted resources. Since undocumented migrants have difficulties claiming their rights in regard to the public sector, many turn to the non-profit sector for support. The result in the study shows that the non- profit sector functions as an informal social service bureau without the economical or legal framework to support it.

More precisely the presence of Latin-American immigrants in the capital of the State of Santa Catarina. The main objective of this study is to understand who are these immigrants and how their integration happends in the society. The fieldwork was performed from contacts with Pastoral Service of the Migrant (SPM) and included, particularly, undocumented immigrants that seeks Pastoral for aid of the institution in its effective regularization or simply for greater integration with the society. For understand, singularly, this new migratory flow, the phenomenon was contemplated in agreement with their characteristics acordingly contemporary international immigrants.
