The mandate of political representatives with special reference to floor crossing: a legal historical study

South Africa has had a free mandate theory of representation up to 1994. From 1994 to 2002 an imperative theory applied and in 2003 a limited hybrid free mandate was introduced. The origin of parliament, the development of representation as a concept in Public Law and the birth of political parties are studied. It is shown that parliament and representation were natural developments that occurred at the same time, not by grand design, but by chance. It is also shown that political parties appeared first as informal intra-parliamentary groupings that developed into extra-parliamentary organisations, organised to achieve and exercise power in the political system as the franchise became more liberal. The factors that influence a member's mandate and floor-crossing as such are discussed. Finally it is concluded that from a legal historical perspective, a free mandate of representation is the preferred theory of representation in public law. / Jurisprudence / LL.M. (Public Law)

The phenomenon of displacement in contemporary society and its manifestation in contemporary visual art

As an alternative to existing research which states that the phenomenon of displacement resists theorisation because of its complex nature, this study conducts a Phenomenological examination of the nature of displacement in which the interlinked losses in the key concepts of the consciousness of the displaced, namely Memory, Land and home and Identity, are navigated. It is shown that the current consciousness of society mimics these losses with the effect of displacement being experienced as a state of mind by contemporary society. By comparing selected artworks of artists Rachel Whiteread and Cornelia Parker, it is established that although manifested in diverse ways, contemporary artworks reflect displacement according to a set of broadly defined visual signifiers. The visual documentation of a site of displacement in the North West Province of South Africa and subsequently produced artworks underline these findings and highlight the elusive attributes of loss inherent in the displacement phenomenon. / Art History, Visual Arts and Musicology / M.A. (Visual Arts)

The literature confirms that peer pressure is a multidimensional phenomenon. Certain factors such as the parent's behavioural- and cognitive functioning, the adolescent's social competence and susceptibility to peer pressure influence his compliance to peer pressure. Processes such as identification, internalization, modelling and coercion are involved in this compliance. The implementation of a mentor system and suggested program at school and the teaching of social-, decisionmaking, problemsolving- and selfassertiveness skills will help the adolescent to use peer pressure positively. The educational psychologist can support the adolescent and parents through individual, family and group therapy. / Hierdie studie handel oor die ontleding van portuurgroepdruk by die adolessent en die hantering daarvan deur die adolessent self, die ouers, onderwysers en opvoedkundige sielkundige. Estudantes universitários de uma instituição privada e suas relações com o saber : de espectadores a protagonistas

The study aims to analyze the relationships with the knowledge of university students entering a private institution in the interior of Bahia through the assistance of government programs such as the Student Funding Fund (FIES) and the University for All Program (ProUni) and even those implemented by the institution itself, such as the Host Program (ProVIDA). The Institution object of this research is the first higher education institution of the municipality of Paripiranga (BA), region included in the Polygon of dry and located 360km from Salvador and 110km from Aracaju. In order to reach the proposed objective, the subjects of the research were 170 undergraduate university students of the first and second periods, all of them scholarship holders of the Programs indicated above and having joined the Institution in 2015/2016. As instruments of data production a questionnaire, the Balance of Knowledge, and interview were adopted. The research is based on a qualitative investigation and the works of Bernard Charlot and Alain Coulon as the main references that support the discussions explored here.The study pointed to a profile of students young, female, from low-income classes, who exceeded their parents' schooling and arrived at university. The relationship with the academic knowledge for these university students is marked by the desire to, from the diploma, to enter the labor market and thus to grow economically. In this context, it seems that the University fulfills its role, since more than half of them mention intellectual knowledge when referring to the learning they acquired at the University, although they have not been able to specify a content, a knowledge. The University for students is also visualized and experienced as a space far from its reality, the space of new experiences, of meeting new people, establishing different relationships. / O estudo tem como objetivo analisar as relações com o saber de estudantes universitários que ingressam numa instituição privada do interior da Bahia mediante o auxílio de programas governamentais, tais como o Fundo de Financiamento Estudantil (Fies) e o Programa Universidade para Todos (ProUni) e mesmo aqueles implementados pela própria Instituição como é o caso do Programa de Acolhimento (ProVIDA). A Instituição campo desta pesquisa é a primeira instituição de ensino superior do município de Paripiranga (BA), região incluída no Polígono da Seca e situada a 360 km de Salvador e 110 km de Aracaju. Para atingir o objetivo proposto os sujeitos da pesquisa foram 170 estudantes universitários de cursos de licenciatura de primeiro e segundo períodos, todos eles bolsistas dos Programas acima indicados e tendo ingressado na Instituição em 2015/2016. Como instrumentos de produção de dados adotamos questionário, Balanço de Saber e entrevista. A pesquisa sustenta-se em uma investigação qualitativa tendo os trabalhos de Bernard Charlot e Alain Coulon como as principais referências que amparam as discussões aqui exploradas. O estudo apontou um perfil de estudantes jovens, sexo feminino, oriundos de camadas de baixa renda, que ultrapassaram a escolaridade dos pais e chegaram à universidade. A relação com o saber acadêmico para esses universitários é marcada pelo desejo de, a partir do diploma, ingressar no mercado de trabalho e assim crescer economicamente. Nesse contexto, parece que a Universidade cumpre seu papel, pois mais da metade deles menciona o saber intelectual ao se referirem às aprendizagens que adquiriram na Universidade, embora não tenham sido capazes de especificar um conteúdo, um saber. A Universidade para os estudantes é também visualizada e vivenciada como um espaço distante de sua realidade, o espaço de novas experiências, de conhecer pessoas novas, estabelecer diferentes relações.

Prosociality and Risk: How Risky Decision-Making in Young Adults Relates to Altruistic Tendencies, Empathic Concern, and Prosocial Peer Affiliation

Adolescence involves an increase in risky decisions, such as reckless driving and illicit substance use, but prosocial characteristics and peer affiliation have yet to be investigated as protective factors. The present study assessed altruistic tendencies, prosocial peer affiliation (PPA), and empathic concern as predictors and moderators of risk-taking, including both self-reported health risks and riskiness in a behavioral task. Young adults from ages 20 to 25 (M = 22.55, SD = 1.38) completed a battery of behavioral tasks (including the Balloon Analogue Risk Task and the Dictator Game) and questionnaires on Amazon MTurk, measuring risk-taking (drunk driving, texting while driving, binge drinking, illicit substance use, and tobacco use), altruistic tendencies, PPA, empathic concern, reward sensitivity, and self-regulation. Results indicated that drunk driving and texting while driving were negatively associated with all three prosocial characteristics, and binge drinking was related to PPA and empathic concern. Moderating effects included interactions between altruistic tendencies and reward sensitivity on drunk driving, altruistic tendencies and self-regulation on drunk driving, PPA and reward sensitivity on binge drinking, and empathic concern and self-regulation on binge drinking. Mediating effects, however, were not found. Overall, prosocial characteristics seemed to buffer against reward sensitivity and strengthen self-regulation in several models. The discussion centers on how prosocial individuals might be less prone to risk-taking, and how affiliating with positive peers can offset the effects of heightened reward sensitivity during this crucial developmental period.

An investigation of the political factors contributing to floor crossing in the Malawi National Assembly : 2003-2009

Floor crossing was an unknown phenomenon in Malawi until the re-emergence of multiparty politics in 1994. Since then the number of MPs crossing the floor in the Malawi National Assembly has steadily increased from around twelve in 1994 to more than sixty in 2005. This practice has continued even today. However, the biggest incident of floor crossing took place in 2005 when the State President, Dr Bingu wa Mutharika, under the United Democratic Front (UDF) decided to abandon the party that sponsored him into office to form his own, the Democratic Progressive Party in February, 2005. Following him were several opposition MPs, a move which sparked a lot of tension in the National Assembly. The purpose of this study was to investigate political factors contributing to this phenomenon, and it was established that, among other factors, institutional weaknesses of political parties and gaps in the Constitution contributed significantly to floor crossing. / Political Science / M.A. (African Politics)

Gubernatorial coattail effects in state legislative elections : a reexamination

Indiana University-Purdue University Indianapolis (IUPUI) / Prior studies on state legislative elections have found gubernatorial coattails playing a key role; however, they fail to examine the temporal and state-based trends of this phenomena. Using precinct level data from nine states (Alabama, Arkansas, California, Minnesota, New York, Oklahoma, Tennessee, Texas, and Wyoming), over two election cycles (2002 and 2006), I measure the importance a state’s ideological makeup, and a governor’s institutional powers has on gubernatorial coattails. Findings reaffirm the importance of coattails, and previously researched variables; however, the addition of the above measures greatly affects coattail strength, dependent on host of controlling factors.

The Effects of Temperature on Judgment and Behavior in the Contexts of Jurisdiction, Retail, and Services

Warum verwenden wir Wörter, die mit physikalischer Temperatur zu tun haben, zur Beschreibung zwischenmenschlicher Phänomene (wie zum Beispiel “eine warmherzige Person” oder “jemandem die kalte Schulter zeigen”)? Jüngere Forschung im Bereich Embodied Cognition hat in aktuellen Publikationen eine Antwort auf diese Frage geliefert: Das Erleben von physikalischer Wärme wird unbewusst mit Gefühlen interpersonaler Wärme assoziiert; physikalische Kälte hingegen wird mit Gefühlen von interpersonaler Kälte und Einsamkeit verbunden. In diesem Zusammenhang konnten beispielsweise Williams und Bargh (2008) zeigen, dass bereits das kurzzeitige Halten einer Tasse mit heißem Kaffe (verglichen mit einer Tasse Eiskaffee) dazu führt, dass die Persönlichkeit einer Zielperson als wärmer (d.h. großzügiger und fürsorglicher) eingeschätzt wird. Diese unbewusste Assoziation hat weitreichende Konsequenzen für das Urteilen und Handeln von Menschen. Die vorliegende Arbeit zielt darauf ab zu klären, ob und wie Temperatur menschliches Urteilen und Verhalten in verschiedenen Kontexten beeinflusst. Desweiteren sollen zugrundeliegende Prozesse (Mediatoren) sowie weitere Rahmenbedingungen (Moderatoren) untersucht werden. Insgesamt wurden drei Versuchsreihen in drei angewandten Kontexten durchgeführt (Rechtsprechung, Verkauf und Dienstleistungen). Diese Bereiche stehen exemplarisch für eine große Anzahl von Situationen, in denen Temperatur das Urteilen und Handeln von Menschen beeinflussen kann (insbesondere alle Situationen, in denen Menschen sich gegenseitig wahrnehmen und miteinander interagieren). Zur Manipulation von Temperatur wurden verschiedene Methoden angewandt. Dies umfasste sowohl semantische Temperaturprimings als auch die systematische Variation der Raumtemperatur. Dabei wurde die Raumtemperatur unter Berücksichtigung bauphysikalischer Gesichtspunkte erfasst und innerhalb einer Komfortzone manipuliert. Die Ergebnisse aus allen Experimenten der vorliegenden Forschungsarbeit zeigen, dass Temperatur das Urteilen und Handeln von Menschen entscheidend beeinflussen kann. Ergebnisse aus dem ersten Laborexperiment (Kontext Rechtsprechung) legen nahe, dass die Beurteilung von Verbrechern signifikant von der Raumtemperatur, die innerhalb einer Komfortzone manipuliert wurde, beeinflusst wird: In einem kühlen Raum wurden Verbrecher als kaltblütiger eingeschätzt, während sie in einem warmen Raum als hitzköpfiger eingestuft wurden. In diesem Zusammenhang schrieben die Teilnehmer bei niedriger Raumtemperatur Verbrechern mit einer höheren Wahrscheinlichkeit Kalkülverbrechen, mehr Morde und schwerere Verbrechen, die mit längeren Gefängnisstrafen verbunden sind, zu (verglichen mit Teilnehmern bei mittlerer und hoher Raumtemperatur). Bei hoher Raumtemperatur hingegen hielten es die Teilnehmehmenden für wahrscheinlicher, dass die Verbrecher ein Affektverbrechen begangen haben (verglichen mit den anderen beiden Bedingungen). Diese Ergebnisse zeigen, dass Temperatur attributionale Prozesse beeinflusst. In der zweiten Versuchsreihe (Kontext Verkauf) gaben die Teilnehmer bei niedriger Raumtemperatur positivere Konsumentenurteile gegenüber Produkten und Verkaufspersonal ab (im Vergleich zu Teilnehmenden bei mittlerer und hoher Raumtemperatur). Zudem zeigten sie positivere Verhaltenstendenzen gegenüber Produkten und Verkäufer/innen (z.B. eine höhere Kaufwahrscheinlichkeit und eine höhere Bereitschaft, mit Verkaufspersonal ein Beratungsgespräch zu beginnen). Überdies steigerte in einer weiteren Studie ein semantisches Kältepriming den Drang der Teilnehmer, umgehend einen Einkauf zu tätigen (verglichen mit einem Priming von Wärme und einer Kontrollbedingung). In der dritten Versuchsreihe (Kontext Dienstleistungen) zeigten Personen in einem umfassenden Dienstleistungsszenario bei niedrigen Raumtemperaturen (im Vergleich zu hohen Temperaturen) eine höhere Kundenorientierung – sowohl in kritischen Service-Szenarien als auch in einem Selbstberichtsmaß. Zudem vergaben sie Kunden signfikant höhere Rabatte. Dieser Effekt wurde auch in einer Stichprobe mit erfahrenen Dienstleistern bestätigt, die nach einem semantischen Temperaturpriming eine höhere Kundenorientierung in der Kaltbedingung (im Vergleich zur Warm- und Kontrollbedingung) angaben. Mithilfe dieses Experiments konnte zudem aufgezeigt werden, dass die gefundenen Effekte unabhängig von menschlicher Routine, Erfahrung und individuellem Wissensstand stattfinden. Die vorliegende Forschungsarbeit konnte als erste in der Embodied Cognition-Forschung einen Mediationseffekt zwischen Temperatur und Verhaltensvariablen (im Kontext von Konsumentenverhalten) nachweisen. Niedrige Temperaturen führen demnach zu einem erhöhten Anschlussmotiv. Dies wirkt sich wiederum auf das Verhalten von Konsumenten aus (z.B. durch eine höhere Bereitschaft, mit einem/r Verkäufer/in in Interaktion zu treten oder etwas zu kaufen.) Zudem zeigt die vorliegende Arbeit als Erste in diesem Forschungszweig einen Moderationseffekt: In der dritten Versuchsreihe konnte in einer Moderationsanalyse bestätigt werden, dass die Verträglichkeit der Teilnehmenden den Einfluss von Temperatur auf die Gewährung von Kundenrabatten moderierte. Auf diese Weise liefert die Arbeit nicht nur in verschiedenen Kontexten Erkenntnisse über die Tragweite von Temperatureffekten auf menschliches Urteilen und Handeln – sie gewährt auch wertvolle Einblicke in die zugrundeliegenden Faktoren und Rahmenbedingungen von Temperatureffekten. Can mindfulness enhance connectedness with nature? The case of in-depth nature experiences with adolescents

This thesis is an exploratory look into the use of mindfulness practice on in-depth nature experiences to determine if the practice has benefit to the participant, their outdoor experience, and overall connectedness with nature. An original research project examined three groups of adolescents from St. Michaels University School Outdoor Education program in Victoria, BC, Canada, as they hiked the Juan de Fuca trail. Two of the three groups undertook a simple mindfulness protocol to explore the outcomes. Based on participant-observation and interviews, mindfulness practice was determined to be a useful practice towards alleviating stress and anxiety associated with aspects of in-depth outdoor experiences, such as morning preparations. Participants who practiced mindfulness on the trip asked fewer questions about the future and remained present more often than those who did not practice mindfulness. A further finding was that there are aspects of mindfulness inherent in in-depth nature experiences, such as sitting around a fire. These inherent mindfulness moments should be encouraged as they provide benefit to trip experiences, and potentially towards greater connectedness with nature. Overall, this qualitative study suggests that mindfulness is a useful tool for the benefit of human well-being and nature connection. However, more research is needed to further identify the magnitude and mechanisms of the benefit. / Graduate

Mission statement and management of private tertiary religious institutions in Eastern and Southern Africa

The region of Eastern and Southern Africa has recently experienced an unprecedented development of private tertiary institutions. Most of these institutions are established by religious organisations which, since the inception of education, have been involved in operating educational institutions of lower levels. Although referred to as private institutions, which by definition would imply funding other than the government sources, these private institutions find themselves, at times requesting the government to fund their development as well as their operations. This study sought to investigate if these private religious institutions have unique raison d'etre expressed in the form of mission statements. The study also investigated the nature of their management and the management structures in practice. The literature reviewed indicated that private religious institutions have a unique mission based on their basic concept of education and their world view. They seek to pursue and inculcate specific values. Operating in a competitive environment, however, in which their competitors do receive funding from the government makes the private institutions vulnerable to hardships. The study was conducted using qualitative research approach in three countries, namely Kenya, Uganda and Zimbabwe; involving all degree granting recognised private religious institutions in the sample and focussing on the management. The respondents were chosen by elite purposive and snowball sampling. The main data collection method was the interview. However, document analysis, observations, and a questionnaire were also used. The findings from the data indicate that private religious institutions have unique missions although they are, at times, not expressed in the form of mission statements. As a result some of the stakeholders, including those involved in management, don't get to know what their institutions' missions are. The study concludes by emphasising the development of clear mission statements involving the stakeholders in the process and having the mission statements widely disseminated. It is also recommended that training in management is important for the managers of the institutions at the various levels. A model of management is proposed for streamlining the management of the institutions considering the requirements of the national governments as well as those of the religious proprietors. / Educational Studies / D.
