L'étude de l'exploitation des oeuvres cinématographiques sous le prisme du droit administratif révèle un pan peu connu du droit du cinéma. Loin des idées reçues, la recherche démontre combien le droit administratif a d'abord été un instrument visant à préserver et à promouvoir les salles de cinéma et combien il reste aujourd'hui un moyen puissant de promotion de la diffusion des oeuvres cinématographiques. Par ailleurs, à l'heure où les modes numériques de diffusion du cinéma vont profondément bouleverser l'industrie cinématographique, la thèse confirme qu'il ne fait aucun doute que le cadre juridique de son développement va nécessairement être fragilisé. De nouveaux défis vont devoir être relevés par le droit, car la salle, comme support principal de l'oeuvre, est désormais confrontée à la numérisation des équipements, l'émergence du hors-film, ou l'obsolescence programmée de l'actuelle chronologie des médias. Tout ceci impliquera donc une adaptation, voire une mutation, du droit administratif s'il souhaite conserver une place centrale dans la régulation de l'exploitation des oeuvres cinématographiques. L'intention principale de cette thèse est donc de révéler et de comprendre la persistante nécessité d'un encadrement par le droit administratif de la diffusion des oeuvres cinématographiques. Pour ce faire, avant de démontrer combien le droit administratif constitue encore aujourd'hui un moyen légitime d'organisation et de soutien de la projection-diffusion des oeuvres, il sera révélé que ce droit « dérogatoire », bien que contraignant, s'est très vite avéré indispensable à l'existence même de spectacles de cinéma et au maintien d'une industrie cinématographique française. / The study of the exploitation of films through the prism of administrative law reveals a little-known side of cinema law. Indeed, far from the preconceptions, research shows how administrative law was first an instrument to preserve and promote movie theaters and how it remains today a powerful means of promoting and distributing cinematographic works.Moreover, at a time when digital cinema distribution methods will totally disrupt the film industry, the thesis confirms that there is no doubt that the legal framework for its development will necessarily be weakened. New challenges will have to be officially recorded by the law, because the cinema hall (movie theater), as the principal medium of the work, is now faced with scanning equipment or planned obsolescence of the current media timeline. All this therefore implies an adaptation or mutation of administrative law if its duty is to retain a central role in regulating the exploitation of cinematographic works. The main intention of this thesis is to reveal and to understand the continued need for a framework formed by the administrative law of cinematographic works. To do this, before showing how administrative law is still a legitimate way to organize and support the distribution-projection of works, it will first be shown that "special" law, although binding, was very quickly essential to the very existence of movie performances and generally speaking, to the maintenance of the French film industry.

Cette recherche questionne les incidences du rattachement du secteur du cinéma au ministère des Affaires culturelles au moment de l'avènement de la Ve République. Elle s'efforce de décrire l'oscillation permanente de l'administration d'André Malraux en la matière, partagée entre le souci de répondre avec exigence aux enjeux liés à la qualité de la production cinématographique, le besoin d'accorder le cinéma à la mission de prestige national et la nécessité d'élaborer une politique consensuelle en mesure de satisfaire les diverses parties prenantes de l'action publique. Sans nul doute ce dernier aspect s'avère essentiel pour asseoir son autorité au regard de l'instabilité gouvernementale qui a perduré longuement avant 1959 mais également en raison des bouleversements économiques, techniques et professionnels provoqués par l'apparition de la Nouvelle Vague. Bien que le modèle d'intervention français soit pleinement reconnu à l'échelle européenne sur ces années, certaines de ses orientations sont pourtant critiquées au plan national par une partie de la critique et des jeunes réalisateurs appartenant aux Cahiers du cinéma. La diversité des longs métrages soutenus par le système des avances sur recettes ne concorde pas avec l'exclusivité de la novation esthétique telle qu'elle a pu exister au temps du jury de la prime à la qualité de 1956 à 1960. La sélection nationale envoyée au Festival de Cannes est également peu goûtée en ce sens. La crise de fréquentation des salles de cinéma, laquelle perdure sur toute la période, accentue davantage ces crispations. Forcé de soumettre aux autorités gouvernementales un projet de rationalisation de l'ensemble de la filière, le Centre national de la cinématographie est en passe de limiter les possibilités d'existence des producteurs les plus modestes. Alors qu'une profonde stabilisation est parvenue à inscrire durablement l'intervention de l'État dans le domaine du cinéma, André Malraux s'apprête pourtant, à l'aube de la deuxième moitié des années 1960, à faire face à une contestation sans précédent de son action. / This study examines the implications of the attachment of film industry to the Ministry of Culture at the beginning of the fifth French Republic. This thesis strives to describe permanents fluctuations of André Malraux's administration between the concern to answer with requirement to the challenges relating to the high quality of the cinematographic production, the need to match the cinema with reasons of national prestige and the necessity to develop a consensual policy able to satisfy miscellaneous stakeholders of the public action. There is no doubt that this last aspect turns out to be crucial for establishing his authority in relation to governmental instability which has continued before 1959 but also because of upheavals provoked by Nouvelle Vague appearance. Although the French intervention model is completely recognized on European scale on this years, some of its options are yet criticized on the national level by a part of critics and young directors close to the magazine Les Cahiers du cinéma. The diversity of full-length movies subsidized by De Gaulle's government doesn't tally with the exclusivity of aesthetic innovation as it existed between 1956 and 1960. The French selection sent at Festival of Cannes is also not much appreciated on this way. The crisis of attendance in the cinemas, which existed all over this period, emphasized more these tenseness. André Malraux is consequently confronted with unprecedented protest movement of his action at the dawn of the second half of the sixties.

El presente artículo analiza el consumo de cine regional, tomando como objeto de estudio a la audiencia joven residente en Lima, para comprender los factores influyentes en su consumo. El cine regional peruano, se ha caracterizado, recientemente, por ser una categoría del cine peruano, en evolución, con obras cinematográficas de gran presencia en los circuitos de distribución y exhibición comercial. Sin embargo, la evolución en el crecimiento y los avances tecnológicos para la producción, no han logrado introducir el cine regional en la distribución comercial. Así mismo, las investigaciones académicas alrededor del tema son escasas. El presente trabajo, se centra en analizar el consumo de cine regional peruano en los adultos jóvenes que viven en Lima, a través de una investigación cualitativa de la audiencia mencionada, la cual se realizó de manera virtual, a través de grupos focales online asíncronos. Debido a la pandemia que se vive actualmente generada por la Covid-19. Los resultados muestran que los usuarios tienen presente el cine regional dentro de sus hábitos de consumo cinematográficos. Finalmente, esta investigación, ha permitido conocer los factores que influyen en el consumo de cine regional y la necesidad de mayor estudio en el campo del cine regional peruano, en el campo audiovisual, psicológico y académico. / This article analyzes the consumption of regional cinema, taking as object of study the young audience residing in Lima, to understand the influencing factors in its consumption. The Peruvian regional cinema has been characterized, recently, as a category of Peruvian cinema, in evolution, with cinematographic works of great presence in the distribution and commercial exhibition circuits. However, the evolution of growth and technological advances for production have not succeeded in introducing regional cinema into commercial distribution. Likewise, academic research on the subject is scarce. The present work focuses on analyzing the consumption of Peruvian regional cinema in young adults living in Lima, through a qualitative investigation of the aforementioned audience, which was carried out virtually, through asynchronous online focus groups. Due to the current pandemic generated by Covid-19. The results show that users keep regional cinema in mind within their film consumption habits. Finally, this research has allowed to know the factors that influence the consumption of regional cinema and the need for further study in the field of Peruvian regional cinema, in the audiovisual, psychological and academic fields. / Tesis

La siguiente investigación desarrolla un estudio acerca del análisis de la banda sonora y el espacio cinematográfico en la película peruana “Canción sin nombre” (2019), dirigida por Melina León, la cual relata uno de los tantos casos de robos de bebés en la década de los ochenta. El análisis de esta banda sonora y el espacio cinematográfico se realizó a partir de su presencia, relación y desarrollo narrativo en la película. Luego de la investigación respectiva, con la ayuda de las categorías determinadas, se plantearon las preguntas y objetivos, generales y específicos, para desarrollar de manera correcta la investigación. Los resultados de la investigación demostraron que la banda sonora y el espacio cinematográfico son elementos del lenguaje audiovisual con una gran carga narrativa que se complementan para que una historia pueda desarrollarse de manera clara. La banda sonora tiene un carácter connotativo muy importante en esta película, debido a que permite sentir y entender por lo que pasa cada personaje, mientras que el espacio cinematográfico permite situar al personaje en la historia y mostrarlo de una manera determinada, dándole una perspectiva especifica dentro del mundo. / The following research develops a study about the analysis of the soundtrack and the cinematographic space in the Peruvian film “Canción sin nombre” (2019), directed by Melina León, which talks about one of the many cases of theft of babies in the eighties. The analysis of this soundtrack and the cinematographic space was made from their presence, relationship and narrative development in the film. After the respective investigation, with the help of the determined categories, the questions and objectives, general and specific, were raised to develop the investigation correctly. The results of the research showed that the soundtrack and the cinematographic space are elements of the audiovisual language with a great narrative load that complement each other so that a story can develop clearly. The soundtrack has a very important connotative character in this film, because it allows us to feel and understand what each character goes through, while the cinematographic space allows us to place the character in the story and show it in a certain way, giving it a perspective specified within the world. / Trabajo de investigación

La presente tesis realiza una evaluación de la representatividad y resiliencia en base al personaje principal de la película “La teta asustada” dirigida por la peruana Claudia Llosa. A partir de estos dos términos, Fausta, interpretado por Magaly Solier genera una serie de elementos narrativos que sirven para la construcción de su personaje aunados a los sonidos y el silencio, en su dimensión connotativa, desarrollados por la directora y el sonidista en la puesta en escena.
De igual manera se plantea un análisis visual y sonoro de una serie de cuadros seleccionados de los momentos en los cuales el color, los símbolos, los silencios y encuadres que se funcionan con un tema tan frágil como es la época del terrorismo y cómo este afectó a las muchas mujeres andinas peruanas, las repercusiones que causó, tanto físicas como psicológicas y que mediante este film se ha logrado crear consciencia demostrando una realidad que lucha entre lo tradicional y lo contemporáneo. / This thesis evaluates representativeness and resilience based on the main character of the film "La teta asustada" (The Milk of Sorrow) directed by the Peruvian Claudia Llosa. From these two terms, Fausta, played by Magaly Solier, generates a series of narrative elements that serve for the construction of her character together with the sounds and silence in its connotative dimension developed by the director and the sound designer in the mise-en-scene.
In the same way, a visual and sound analysis of a series of pictures selected from the moments in which color, symbols, silences and framing are merged with such a fragile subject as the time of terrorism and how it affected the many Peruvian Andean women, the repercussions it caused, both physical and psychological, and that through this purpose has managed to create awareness demonstrating a reality that struggles between the traditional and the contemporary. / Tesis

La presente investigación tiene como finalidad analizar la función estética de la dirección de fotografía de uno de los largometrajes de ficción peruanos más galardonados en la última década, se trata de la película “Retablo”, dirigida por Álvaro Delgado Aparicio. La estética fotográfica utilizada para la construcción cinematográfica de este film es objeto de estudio debido a su minucioso y audiovisualmente motivado empleo. Dentro de esta, elementos como la luz, las ópticas y los movimientos de cámara cumplen una función que permiten construir el espacio cinematográfico de “Retablo”, cuya historia narra la relación padre-hijo entre Noé y Segundo, artesanos de retablos en Ayacucho, quienes ilustran la vida laboral, costumbres e ideologías presentes en esta zona rural del Perú. A través de la puesta en escena, la puesta en cuadro, la puesta en serie y sus respectivos elementos, es posible analizar el espacio en el que transcurre la historia. / This study presents, as a final analysis, the aesthetic function of the photographic direction of one of the most gallant Peruvian fiction films in the last decade, the movie "Retablo", directed by Alvaro Delgado Aparicio. The photographic aesthetics used for the cinematographic construction of this film is the object of study debited to its subtle and audiovisually motivated work. From there, elements such as light, optics and camera movements complete a function that allows building the cinematographic space of "Retablo", which tells the story about a son and dad relationship between Noah and Segundo, retablo artists in Ayacucho, illustrate the working life, habits and ideologies in this rural area of Peru. Through the staging on scene, staging on frame, staging on series and its respective elements, it is possible to analyze the space in which to trace history.
The purpose of this research is to analyze the aesthetic function of the photography direction of one of the most awarded Peruvian fiction films in the last decade, it is the film “Retablo”, directed by Álvaro Delgado Aparicio. The photographic aesthetics used for the cinematographic construction of this film is the object of study due to its meticulous and audiovisual use. Within this, the light, the optics and the camera movements fulfill a function that allows the construction of the cinematographic space of the film: the father-son relationship, Noé and Segundo, artisans of altarpieces in Ayacucho. Tras el estreno de la película animada de Mulan en 1998 hasta su live action del 2020, Disney nos ha presentado a sus protagonistas, Fa Mulan y Hua Mulan, como mujeres fuertes, hábiles y valientes. Sin embargo, en el camino de ambos personajes encontramos actos y frases, basados en estereotipos de género, que minimizan el valor de la heroína e influyen en su toma de decisiones. Si bien Disney cada cierto tiempo nos presenta princesas nuevas y diferentes entre sí, en su intento por empoderar a la mujer, cada vez evidencia su sexismo y machismo oculto. Desde la mirada audiovisual, el presente trabajo de investigación analiza cómo, después de 22 años de diferencia, las películas de Mulan continúan presentando estereotipos de género y cómo estos influyen en el desarrollo de sus protagonistas. Para ello se realizará un estudio de método cualitativo e interpretativo, mediante el análisis de contenido de las películas de Mulan de 1998 y 2020 y será representado mediante tablas comparativas. Además, se consultará a fuentes verídicas de autores sobre la construcción del personaje, así como, de los estereotipos de roles de género presentes en las películas de princesas, animadas y Live-action, de Disney. / After the premiere of the animated film Mulan in 1998 until its live action in 2020, Disney has introduced us to its protagonists, Fa Mulan and Hua Mulan, as strong, skilled and courageous women. However, in the path of both characters we find acts and phrases, based on gender stereotypes, that minimize the value of the heroine and influence her decision making. Although Disney every so often shows us new and different princesses, in its attempt to empower women, increasingly it shows its hidden sexism and machismo. From an audiovisual perspective, this research work analyzes how, after 22 years of difference, Mulan’s films continue to present gender stereotypes and how these influence the development of their protagonists. For this, a qualitative and interpretative method study will be carried out through the content analysis of Mulan’s films from 1998 and 2020 and will be represented by comparative tables. In addition, veridical sources of authors will be consulted on the construction of character, as well as the stereotypes of gender roles present in Disney princesses, animated and live-action films. / Trabajo de investigación

Montréal. / Le film Punch-Drunk Love, réalisé en 2002 par Paul Thomas Anderson, présente
une approche formelle hors du commun et expose, de manière flagrante, le travail
énonciatif du film. L’énonciation filmique qui est sienne pousse le spectateur à se distancer
de l’oeuvre et l’incite à se questionner sur la signification des codes mis en place. Ce dernier
est également stimulé à remettre en question ses propres attentes ainsi qu’à s’interroger sur
son plaisir spectatoriel. Nous proposons, dans le cadre de ce mémoire, de faire l’analyse de
l’énonciation filmique du film à travers l’approche abstraite de Christian Metz. Grâce à sa
théorie, qui affiche la préséance du film sur l’auteur en matière de signification des codes,
nous mettrons en évidence l’idée que les constructions énonciatives fortes reprennent à leur
compte l’histoire racontée par le film. L’énonciation réfléchit et redouble le film. Avec une
telle approche, le film expose son rapport fusionnel entre le fond et la forme.
L’énonciation, vue sous cet oeil, devient l’alter ego du film. / In Punch-Drunk Love (2002), Paul Thomas Anderson applies a unique creative
process that reveals the very inner workings of enunciation in the film. His filmic approach
functions to distance the spectator from the film and, to various degrees, challenges the
spectator to question the codes that create an aesthetic of illusion. Drawing on Christian
Metz’s abstract approach to enunciation, this thesis proposes to analyse the filmic
enunciation of Anderson’s film. By means of this theoretical approach, we become aware
that the enunciation of the film stimulates the spectator into realizing that the implied
meaning of the enunciation is one that can be understood within its own self. The “who”
and the “what” are no longer questions that are answered from the “outside”. The “who” is
the film and the “what” resides in it. What we are observing is the self–reflexive nature of
enunciation.

Destruction, puissance et limites du cinéma dans les films d'Ozu YasujirôBeth, Suzanne 01 1900 (has links)
Cette thèse de doctorat se rapporte aux films du cinéaste japonais Ozu Yasujirô (1903-1963) suivant l'hypothèse principale que les enjeux de la destruction qui y sont mis en scène, sous la forme de la disparition des liens familiaux et de la mort, ne peuvent être éclairés par la narration, dont le caractère non dramatique est notoire. En figurant la dislocation de la famille, les films d'Ozu rendent plutôt compte de la vulnérabilité du monde à la prise cinématographique : la destructivité du médium s'y énonce comme sa capacité à mobiliser ce qui entre dans son champ et à le transformer en faire-valoir de son aptitude à produire des effets. Cette étude fait ainsi apparaître les images animées, en tant qu'elles relèvent de la logique technique régie par la modernité, comme une forme de désastre, qui atteint la famille comme expérience de la communauté, c'est-à-dire comme rapport constitutif à un hors-de-soi. Mais à cette destructivité fait également face, au sein même de la pratique cinématographique d'Ozu, une autre possibilité du cinéma, qui peut restaurer ces liens menacés.
Cette étude du cinéma d'Ozu montre sa profonde affinité avec la pensée du désœuvrement élaborée par Giorgio Agamben, les films du cinéaste et les travaux du philosophe s'éclairant mutuellement. Le concept de désœuvrement permet de reconsidérer les enjeux essentiels des films d'Ozu à un niveau à la fois thématique et formel, immatériel et matériel, articulant ces deux facettes pour en considérer le registre proprement médiatique. Le propos n'est pas essentiellement esthétique ou formaliste, mais s'intéresse avant tout au travail d'Ozu du point de vue des enjeux éthiques du cinéma, qui se formulent en termes de relation à sa puissance. Celle-ci concerne aussi bien l'attention d'Ozu à la vie collective que le soin qu'il porte aux potentialités expressives du cinéma, c'est-à-dire à la manière dont il se rapporte aux limites de son médium. / In this dissertation, the films of Japanese director Ozu Yasujirô (1903-1963) are studied according to the main hypothesis that the destruction they picture – disappearing family bonds, death – cannot be accounted for by plot development, its non-dramatic stance being well-known. As it is depicted in his films, family dissolution in fact testify for the world's vulnerability to cinematographic take: the medium's destructivity is especially expressed as an ability to mobilize what comes into its range and to transform it as a stooge for its own capacity to produce effects. This study then portrays moving images, inasmuch as they conform to the logic of modern technology, as a kind of disaster affecting family as a commununity, as an experience of being out-of-oneself. But Ozu's cinematographic practice shows as well ways to face such a destructivity, and points to another, restaurative potentiality for cinema.
This study of Ozu's cinema shows its profound affinity with Giorgio Agamben's conception of inoperativeness, the filmmaker's work and the philosopher's thought throwing light on each other. Through the concept of inoperativeness, the issues at the heart of Ozu's films are considered anew at a level both thematic and formal, immaterial and material, articulating these two aspects in order to tackle their very mediatic register. My approach, then, is not foremost aesthetic or formal but focuses on Ozu's films from the point of view of practice: it deals with ethical issues raised by the cinematographic medium, which express themselves in relation to power (or potentiality). This ethical concern relates to Ozu's attention to collectivity as well as to his care for cinema's expressive potentialities that is to say to the way in which his films face their medium's limits.
