Association de la norme technique à l'innovation. Étude de droit de la propriété intellectuelle et de droit de la concurrence / Association of the technical standard and innovation covered by intellectual property rights

La norme technique exige parfois de lui associer des innovations faisant l’objet de droits privatifs, au bénéfice de la réalisation de sa mission. De prime abord, la propriété intellectuelle apparaît comme étant un élément perturbateur, impliquant désormais d’examiner l’ « économie » de la norme au moment de son élaboration et de son utilisation et non plus uniquement la technique. Pour éviter la corruption de la norme par des droits privatifs trop contraignants, les organismes de normalisation exigent que seuls les droits privatifs « essentiels » soient associés à la norme. Les critères de l’adhérence réciproque de la norme et de l’innovation structurant leur association, justifient au nom de son « utilité sociale », une adaptation réciproque des régimes juridiques attachés à ses deux composantes. Ainsi l’ « utilité sociale » incarnée par la norme technique impose une adaptation du régime des droits de propriété intellectuelle. Symétriquement, l’innovation « essentielle » à la norme suppose une adaptation du régime de la norme technique à la propriété intellectuelle. Cela donne naissance à deux régimes juridiques substantiellement interpénétrés et structurellement interdépendants. D’une part, les droits privatifs étant « essentiels » à la norme, peuvent être considérés comme des « infrastructures essentielles », justifiant une érosion systémique de leur portée dans le cadre de leur association à la norme. Dans le cadre de l’application de règles de concurrence, cette érosion résulte d’une approche ex post à laquelle se conjugue une approche ex ante, conceptualisée par les conditions FRAND. D’autre part, l’association s’évalue également à l’aune de la propriété privée. Il apparaît que la norme technique devrait être considérée comme étant une chose commune imposant d’aménager, au bénéfice de ses utilisateurs, un accès et une utilisation libre. Cela suppose d’envisager alors l’émergence d’un droit d’utilisation de l’innovation associée à la norme technique. / Technical standards may sometimes be associated to innovations covered by proprietary rights. In this case, intellectual property appears to embody a quite disturbing component within the partnership between standardization and innovation. We are thus led to analyse the association economy ; it must be construed as of the creation and the use of the standard rather than to insist on its sole technical aspects. In order to avoid the corruption of the standard by over-restrictive IP rights, standard-setting-organizations require that only "essential" proprietary rights can be associated to a technical standard. Economical and technical criterias of the mutual adherence of the technical standard and the owned innovation – structuring their association – justify in the name of its "social utility", a mutual adaptation of their legal regimes. Therefore, the technical standard’s "social utility" requires an adaptation of the IP rights legal regime. Symmetrically, the essential innovation, included in the standard, requires its fitting to the technical standards legal regime. This results in the rise of two regimes naturally interpenetrated, and structurally interdependent. On the one hand, IP rights "essential" to the standard, can be considered as "essential facilities", justifying a systematic erosion of their spectrum. As part of competition rules implementation, this erosion results from an ex post approach as well as an ex ante approach conceptualized by FRAND terms. On the other hand, the association is also evaluated through the private property perspective. It appears that the technical standard should be considered as a "common", assuming a free access and a free use. It contributes to create a right of use of the owned innovations integrated in technical standard.

Mikroklima bazénových hal / Indoor environment of pool halls

The diploma thesis deals with the problems of the indoor environment of swimming pool halls. Firstly, it describes issues and principles of designing HVAC system in the areas with high humidity production. Thesis then focuses on various approaches to calculations of evaporation from the water surface and different possibilities of dehumidification including different types of HVAC units. This knowledge was applied to the design of HVAC system for particular assigned building, for which are proposed two different solutions. Thesis includes experimental part, its aim is to analyse one specific critical part of the hall. Based on local surveying and long-term measurements a few possibilities of improvement are suggested.

The diploma thesis is concerned with the swimming pool compound which is situated in the area of the Czech-Moravian Highlands, in the town Humpolec and it contains the complete documentary materials (documentation) for the execution of the project, fire safety solution to the building with respect to building physics, structural assess of wooden constructions and air- conditioning of the swimming hall. In the swimming compound there is a swimming hall with five swimming pools with the total water area of 605,4 m2 (swimming pool, the swimming pool for non-swimmers, relaxing swimming pool, whirpool, wading pool) and other additional services – four saunas with bar, massages,solarium and two buffets. The capacity of the swimming hall is 286 persons, the capacity of the whole compound is 418 persons. As for the shape of the building, it is designed as five rectangulars of different heights embedded into each other. Under the part of the swimming centre there is a basement and its external ground plan size is 61,33m*52,83. The basement serves as utility rooms of the whole building. The load-bearing construction of the swimming hall is designed using beam girders and pillars, made of glued laminated timber. In the rest of the building there is a brick construction system. Around the swimming hall there is a glass fronted facade.

Anionic Phospho-Fries Rearrangements for the Synthesis of Planar-Chiral Ferrocenes and their Application in (atropselective) Suzuki-Miyaura Reactions

The present PhD thesis describes the synthesis and characterization of novel planarchiral 1,2-P,O-ferrocenes and their application in the Pd-catalyzed Suzuki-Miyaura reaction. It was especially focused on the development of a new synthetic pathway to this type of substitution pattern by applying the anionic phospho-Fries rearrangement in ferrocene chemistry. Starting from hydroxy ferrocene, a high diversity of Fc–O–P- type (Fc = (n5-C5H5)(n5-C5H4)) compounds were synthesized, whereby the electronic properties of the phosphorus fragments were varied. The anionic phospho-Fries rearrangement successfully occurred subsequent to an ortho-lithiation with a non-nucleophilic base giving the 1,2-P,O-ferrocenes in up to quantitative yields. The usage of chiral pool-based alcohols for the synthesis of chiral ferrocenyl phosphates allowed a diastereoselective proceeding, giving single isomers in up to 95% de. Temperature-dependent investigations of mixed ferrocenyl-, phenyl- and Nheterocyclicphosphates revealed a limitation of ferrocenyl-based rearrangements per reaction step, contrary to phenyls. 1,2-P,O-ferrocenyl phosphonates could successfully be converted into phosphines by applying Stelzer P,C cross-coupling reactions on ferrocenes for the first time. Their usage as ligands for C,C cross-coupling reactions was confirmed by the synthesis of sterically hindered biaryls in high yields at 70°C with a low catalyst loading of 1 mol-% Pd. Functionalization of the 1,2-P,O -structural motif could be achieved by applying nucleophilic aromatic substitution reactions (SNAr) as an alternative pathway for the synthesis of ferrocenyl aryl ethers. Subsequent to a Fries rearrangement sterically-demanding 1,3-di-orthosubstituted aryloxy ferrocenes could be obtained. Multi SNAr reactions of hydroxyferrocenes at polyfluorinated arenes gave up to pentaferrocenyl-functionalized aryl ethers, whose electrochemical properties were investigated. The reaction of CH2-enlarged ferrocenylmethanols gave α-ferrocenylcarbenium ions instead of phosphates, while treating them with chlorophosphates. Enantiopure 2-P(S)Ph2-substituted derivatives of these ions underwent a subsequent intermolecular “S2−“ migration, resulting in thioethers, for example (Sp,Sp)-(2-(P(S)Ph2)FcCH2)2S, in a unique mechanism. Instead, the presence of electronrich arenes gave electrophilic aromatic substituted benzenes bearing chiral ferrocenylmethyl backbones. These type of ligands gave biaryls with up to 26 % ee. / Die vorliegende Arbeit beschäftigt sich mit der Synthese und Charakterisierung von neuartigen planar-chiralen 1,2-P,O-ferrocenen sowie deren Anwendung in der Pd-katalysierten Suzuki-Miyaura Reaktion. Dabei lag der Focus in der Anwendung anionischer phospho-Fries Verschiebungen auf Ferrocene um dieses spezielle Substitutionsmuster erhalten zu können. Ausgehend von Hydroxyferrocenen wurde so eine Vielzahl neuer Verbindungen des Typs Fc–O–P (Fc = (n5-C5H5)(n5-C5H4)) synthetisiert, wobei die elektronischen Eigenschaften des Phosphor-tragenden Fragmentes variiert wurden. Die anionische phospho-Fries Verschiebung erfolgte im Anschluss einer ortho-Lithiierung mit einer nicht-nucleophilen Base, was 1,2-P,O-Ferrocene nahezu quantitative ergab. Durch die Verwendung von chiral-pool basierten Alkoholen für die Synthese chiraler Ferrocenylphosphate konnte eine diastereoselective 1,3-O->C Umlagerung mit Isomerenreinheiten von bis zu 95 % erreicht werden. Untersuchungen von gemischten Ferrocenyl-, Phenyl- und N-heterocyclischen Phosphaten bei verschiedenen Temperaturen zeigte eine Limitierung Ferrocenyl-basierter Umlagerungen pro Reaktionsschritt im Gegensatz zu denen von Phenylen. Die erhaltenen 1,2-P,O-Ferrocenylphosphate wurden erstmals mittels Stelzer P,C Kreuz-Kupplungsreaktionen erfolgreich in Phosphane umgesetzt. Deren Verwendung als Ligand in C,C Kreuz-Kupplungsreaktionen wurde am Beispiel der Synthese räumlich anspruchsvoller Biaryle in hohen Ausbeuten bei nur 70°C und niedrigen Katalysatorbeladungen von 1 mol-% Pd demonstriert. Die Funktionalisierung des 1,2-P,O-Strukturmotifes konnte durch die Anwendung von nucleophilen aromatischen Substitutionsreaktionen erreicht werden, die einen alternativen Zugang zu Ferrocenylarylethern bietet. Im Anschluss an eine Fries Umlagerung konnten so sterisch anspruchsvolle 1,3-di-ortho-substituierte Ferrocenylarylether erhalten werden. Durch mehrfache SNAr Reaktionen von Hydroxyferrocenen an polyfluorierten Aromaten wurden bis zu fünf-fach substituierte Ether erhalten, deren elektrochemischen Eigenschaften untersucht wurden. Die um eine CH2-Einheit verlängerten Ferrocenylmethanole gaben bei Reaktion mit Chlorophosphaten alpha Ferrocenylcarbeniumionen anstelle der gewünschten Phosphate. Enantiomerenreine 2-P(S)Ph2-substituierte Derivate dieser Ionen durchliefen anschließend einen intermolekularen ”S2–“ Transfer in einem einzigartigen Mechanismus, was bspw. in Thioethern des Typs (Sp,Sp)-(2-(P(S)Ph2)FcCH2)2S resultierte. In Anwesenheit elektronenreicher Aromaten wurden elektrophile aromatischen Substitutuionen und die Bildung chiraler ferrocenylmethyl-substitutuierter Benzene beobachtet. Deren Einsatz als Ligand ergab Biaryle mit bis zu 26 % ee.

Most labour rooms in Sweden pretty much all look the same. They have a white plastic floor and a light colored wall. The room has one bed, and next to the bed you find machines that will help you if anything goes wrong. These rooms are made to give birth in - but somehow they’re not made for that at all. This project is based on research showing that home births can lower the risk of several medical interventions, infections and helps to get a better birthing experience overall (in low risk pregnancies). In Sweden only about 0,1% give birth at home, which is something that might change with time - but not everyone has the possibility, or feel safe enough, to give birth in their own home - or even want to. In Swedish history there was a transition from giving birth at home to giving birth at the hospital - and during this transition there also existed delivery homes. These were places that gave the opportunity to give birth in a home like setting - but with a more evolved medical security than in the home. These homes were later found not as cheap to run as the cost effective hospitals - and were all eventually shut down. Until now. The project uses biophilic design and rounded shapes to connect to the shapes of nature, while at the same time combining it with the rural Swedish home. The project becomes a space to give birth in - but also share experiences, meeting family on your terms, celebrate the life created and mourn when life gets taken away too soon. The birth of a child is one of the biggest things that can happen in a persons life. And we should give birth, not only with medical support - but with spatial support as well.

Eliminating Cash; cash-free corporate liquidity : A study on the plausibility and efficiency of financial lean

This paper addresses the problem of a failing net debt approach; deposited funds rarely compensate the cost of debt. Venturing into operational credit facilities, the study evaluates the efficiency and feasibility of transitioning into fully cash-free liquidity management. The study takes a holistic approach and evaluates the research questions from the perspective of management through case studies on four smaller Swedish industrial firms. The study finds that there is substantial potential to free up capital; return on equity could have been boosted by an annual 5-10 percent including substantial one-off distributions. The study also concludes that Agency reasons are strong reasons for why firms are carrying material cash reserves. Through qualitative interviews, the study identifies several additional, but not less important, obstacles in the way of a full out cash-free transition. Most significantly, the financial system is not offering fully committed long term operational credit facilities and operating across different jurisdictions complicates the consolidation of liquidity. The study concludes that the matter would not have vast negative implications on real business activities, although further research would be required in regard to an extended debt overhang problem. / Uppsatsen kretsar kring den fallerande logiken med begreppet nettoskuld; tillgodohavanden på bank genererar sällan upp för kostnaden relaterad till motsvarande skuld. Med utgångspunkt i operationella kreditstrukturer utvärderas möjliga effektivitetsvinster och genomförbarheten av en fullständig övergång till kassa-fri likviditetshantering. Studien har ett holistiskt angreppssätt och utvärderar frågeställningarna från ett management-perspektiv genom fallstudier på fyra mindre svenska industriella bolag. Studien finner betydande möjligheter att frigöra kapital; årliga avkastningen på eget kapital hade kunnat öka med 5–10 procent och betydande engångsutdelningar hade varit möjliga. Studien finner vidare att agentteorin är en stark anledning till att bolag bär betydande kassapositioner. Genom kvalitativa intervjuer identifierar studien ytterligare, men ej desto mindre betydande, hinder för en kassa-fri övergång. Mest betydelsefullt, är att nuvarande finansiella system inte erbjuder för syftet fullgoda kreditstrukturer, samt det faktum att företag med verksamhet över olika jurisdiktioner upplever juridiska svårigheter med att konsolidera likviditet. Studien drar slutsatsen att en övergång inte skulle medföra betydande negativa konsekvenser för den operativa affärsverksamheten, men identifierar samtidigt att ytterligare studier skulle vara nödvändiga framförallt kring hur finansiella incitament kopplade till agent-teorins ’debt overhang’ skulle förändras vill en övergång till en fullt garanterad operationell kreditstruktur.

Carbon Dating of Agricultural Soils and Further Understanding the Transport of CO2 Gas Using Isotopes

CO2 is a greenhouse gas which is significantly emitted by agricultural soils through the decomposition of plant residue and soil organic carbon. Carbon isotopes can be used in determining the source of the CO2, origin of the carbon, and the age of the CO2 emissions. This study investigates the transport of CO2 gas through agricultural soils using carbon isotopes 14C and 13C to complement concentration and production rate measurements in two comparative agricultural settings in Eastern Ontario, one of which has been modified by clearing and dredging of the adjacent riparian zone and one left undredged. Traditional radiocarbon dating measures time through loss by decay, while recent dating is based on matching measurements with the atmospheric 14CO2 signal (F14C) generated by nuclear bomb testing in the 1950s and 1960s. CO2 emissions were analyzed from soil core sections together with soil-probe gas samples and surface flux chamber samples collected from the study area. Soil cores were collected from 0- 90 cm at 7.5 cm increments and placed into IsoJar® microcosms for a period of one month. CO2 in-growth was monitored to provide production rates and samples for 14C and 13C analysis. The radiocarbon data for the microcosms showed that values increase with depth from the current fraction modern value of 1.00 F14C at the surface to an attenuated peak of 1.04 F14C at a depth of 30 to 40 cm and then decrease to values below 1.00 F14C. The data collected from the soil-probe gas showed a significant depletion in comparison to the microcosms and the surface chambers. The soil cores were subsequently analyzed by a selective leach oxidation protocol to sample decreasingly labile solid organic carbon. This involved placing the weighed soil samples into MilliQ water for 24 hours, before being passed through two sieves, 63 microns and 0.45 microns. The DOC leachate was collected and analyzed for 14C and 13C. The two solid soil fractions were then dried, treated with HCl to remove carbonate and then oxidized under vacuum with 5% H2O2 yielding CO2 and residual soil carbon for 14C and 13C. The radiocarbon analysis of these variously labile fractions, together with the microcosm and soil probe measurements, demonstrate that surface emissions at both sites are greatly dominated by CO2 from recently-sequestered labile organic carbon from the upper 30 cm with minor contribution from earlier, bomb-pulse carbon or from deeper pre-bomb carbon. No significant difference in age of emissions between the dredged and undredged sites was found.

An institutional approach to appropriation and provision in the commons : a case study in the Highlands of Eritrea

Thesis (MAgric (Agricultural Economics))—University of Stellenbosch, 2006. / The natural resources mainly land, forests, and grazing lands in the Highlands ago-ecological zone of Eritrea are in a severely degraded state. And much of these common pool resources comprise commons i.e. they are managed under the common property rights management regimes. “The tragedy of the commons”, model suggests that all commons will inexorably suffer overexploitation and degradation. Contrary to this deterministic proposition, however, common property theory argues that the ‘tragedy’ is not due to inherent flaws in the common property rights management regimes, but because of institutional failure to control access to resources, and to make and enforce internal decisions for collective use. If the commons dilemma situation exists- i.e. ‘tragedy’, then the underlying problem is the degeneration of the existing common property rights resource management regime into open-access-like regime—a condition that can potentially trigger “the tragedy of the commons”. The question of how to deal with the problem of the commons is, therefore, primarily an issue of the existence of efficient institutions. The prevailing severe degradation of the common-pool resources in the Highlands of the country thus calls into question the robustness of the common property rights regimes that are in place for the governance of these resources. This thesis attempts to address this important problem specifically in relation to forest and grazing land common pool resources. A case study based on a single-case qualitative and exploratory-explanatory research design was carried out in a village located in the Highlands of the country. Data were collected through various forms of interviews (semi-structured interviews, in-depth interviews, key informants interviews, group discussions, and informal conversational interviews), direct observation, and document review. The data, gathered largely through using these separate lines of enquiry, were crosschecked to provide a triangulation of methods and to strengthen the validity and reliability of the data. The empirical findings reveal that existing common property rights management regimes for the management of the local common pool resources of the case study area have weakened over time. These findings indicate that, there is a significant incongruence between appropriation and provision rules. And this is manifested in terms of appropriation externalities and demand side and supply side provision externalities. This situation implies that existing local institutional arrangements i.e. common property rights management regimes in the case study area are not sufficiently robust to solve common pool resource appropriation and provision externalities. Though generalisation cannot be made beyond the case that was studied, there are several lessons that may be drawn from this field analysis, which may have valid implications for the natural resources management challenges and opportunities of the entire Highlands agoecological zone of the country.

原住民族部落土地資源自主治理之研究--以苗栗縣南庄鄉為例 / A Study of Self-governing about Indigenous Land Resources

原住民部落資源自主治理(self-governing)之概念已陸續地推展於原住民地區,過去有關於部落資源自主治理相關議題之討論與研究鮮少從原住民族土地問題切入,少數結合原住民族土地問題與部落資源自主治理者,研究場景也僅著重於原住民族單一族群內的自主治理組織發起與運作過程描述分析,至於在現實政經環境背景下,不同族群間自主治理的過程究竟該如何運作?以及藉由分析其運作過程產生的相關問題,進一步檢視現行原住民族自主治理部落土地資源之政策與地權及地用等相關法令規定者,尚乏相關論著。 本研究選取苗栗縣南庄鄉蓬萊村為實證研究對象,以Elinor Ostrom(1990)所提出的成功自主治理共用資源(common pool resources)八個設計原則(design principles)為檢驗基礎,分析蓬萊溪封溪護魚與八卦力民宿村部落土地資源自主治理制度設計成功與否、歸納制度脆弱或未成功的原因,並且透過社會關係網絡(social context)與取得權(access theory)等相關概念,分析兩案例之社會關係網絡與利益流樣態,以理解制度規範建構之互動過程與核心理由,發掘置於國家權力統治與資本主義貨幣經濟(cash economy)之現實場景下,原╱漢「多族群間」、以及「同族群內部」到「多族群間」自主治理部落土地資源之問題,並指出現行部落自主治理之地用與地權政策規劃與部落現實場景間之差距。 由實證案例分析可知,原住民族傳統部落組織的瓦解與重構過程中,原住民與平地人之間的政經稟賦差異加大,原住民族自主治理之立意往往被扭曲,平地人卻能掌控部落土地資源進而分享大部分之利得。此外,原住民族自主治理部落土地資源之政策走向,忽略漢人使用原住民族傳統領域土地亦有其特殊歷史背景或政策因素,是以在政策層面上當有再深入研究及通盤檢討之必要。而多族群間亦須放棄成見、加強溝通以謀求彼此共識,增加地方自主治理的社會資本,方可妥善管理部落土地資源,朝共同治理之目標邁進。 / The concept of indigenous resources self-governing has been promoted to the indigenous areas one after another. However, there have been few issues and studies about tribal resources self-governing observed from the viewpoint of indigenous land management. Even though minority of issues and studies link up indigenous land problems with tribal resources self-governing, their research background also only puts emphasis on the analysis of a single indigenous race, which describes the establishment of organization and operation for self-governing. How is the self-governing mechanism operated among different races under the realistic political and economical background? How is the self-governing policy of tribal land resources manipulated further? How are laws related to land ownership and land use implemented? All of these topics still lack correlative studies. Therefore, this research takes the tribe of the Penglai Village in Nanjhuang Township Miaoli County as an example, using eight design principles proposed by Elinor Ostrom (1990) to examine the case, which the Penglai stream blocking for fishing resources protection and the self-governing for tribal land resources in the Baguali B&B(bed-and-breakfast) village. The context of illustrations are: (1) analyzing whether the design of institution for the case is successful; (2) inducing the reason why institution is unsuccessful or weak; (3) analyzing the social context and benefit flows of the case to understand the interactive process and the core reason for the establishment of institution standard by the concept of social context and access theory; (4) finding the self-governing problems of tribal land resources among indigenous /Han multi-races(the case of Penglai River) and from one single race to multi-races(the case of Baguali B&B Village) under the realistic background of state right governing and cash economy of capitalism; and (5) pointing out the gap between the current land use and landownership policy plan for tribal self-governing and the realistic situation of tribe. By the analysis of the case, we can find that the disintegration and restructuring of the indigenous tribal organization because of the difference of the political and economical endowment from Han people results in the phenomenon, which the purpose of the indigenous tribe self-governing for land common pool resources has been twisted. In addition, the formulation of the self-governing policy for indigenous land resources ignores that the Han people using the indigenous traditional territory also have its special historical background or resulted from policy implementation. Therefore, it is necessary to study further and overall review, to strengthen the communication to seek a consensus among multi-races and to gain the social capital of local self-governing. In this way, it will be possible to manage the tribal land resources well and achieve the goal of common governance.
