[pt] O estudo sobre a aplicação do princípio da prioridade
absoluta por varas de Família de
Justiça Gratuita da comarca do Rio de Janeiro foi o
objetivo principal desse trabalho.
Para entender a questão proposta, foi feito um histórico
da aplicação das políticas
públicas relativas a infância e às doutrinas que as
apoiavam nos diferentes momentos da
sociedade brasileira. Foi realizado também um histórico da
família e suas
transformações no decorrer dos séculos XIX a XXI, com a
legislação aplicada a ela
nesses períodos, iniciando pela família constituída
exclusivamente pelo casamento e
chegando ao conceito de família monoparental. Quanto à
Ação de Alimentos, fez-se
uma revisão de sua conceituação no sistema jurídico e sua
relação com a família, para
mostrar a sua importância face ao problema da garantia de
vida digna. O estudo mostrou
que não é dada prioridade no andamento das Ações de
Alimentos que envolvem
crianças de forma que fica mantida a violência estrutural
porque passam as classes
menos favorecidas, sem atender ao princípio da prioridade
absoluta, determinado pelo
ECA. / [en] The main goal of this dissertation is to explore the
implementation of the principle of
the absolute priority by the Family Courts in Rio de
Janeiro. It was made a historical
study of the application of the public policies concerning
the childhood and the thesis
which supported it throughout the different moments of the
Brazilian society. It was
also made a historical study of the family and its changes
from the XIX to the XXI
centuries, starting from the families based on the
marriage to the single parent ones. The
concept of the child support suit was reviewed based on
the judicial system and its links
with the family, in order to demonstrate its importance
concerning the survival. The
results showed that the maintenance of the actual
legislation concerning child support
favors the structural violence suffered mainly by the
lower income families, and does
not follow the principle of the absolute priority, in the
way its determined by the Statute
of the Child and the Adolescent.

[pt] O corpo tem sido alvo de observações psicanalíticas desde os primeiros
trabalhos freudianos. Partindo dos impasses da clínica contemporânea, procuramos
nesse estudo refletir sobre os limites da representação e as atuações no corpo como
tentativa extrema de inscrição de vivências de violência. São as marcas corporais que
entram em cena, tais como cortes, fraturas, queimaduras, entre outras cicatrizes que nos
fazem pensar em intensos afetos que permanecem fora do circuito associativo. Estas
características nos remetem à clínica das origens cujo enfoque está nas experiências
anteriores à aquisição da linguagem. É contemplada a importância do outro na formação
do psiquismo e na constituição de um corpo representado. Visamos entender de que
maneira o contato corporal mãe-filho é responsável por reunir o corpo do bebê,
propiciando condições favoráveis para que a psique possa realizar o trabalho de
elaboração das funções e sensações corporais. Assim, traçamos uma distinção entre o
corpo representado da histeria e o corpo apresentado, lugar do excesso, da pulsão
desligada que se encontra fora do campo simbólico. / [en] The body has been subject of psychoanalytic observation since Freud’s early
works. Based on the impasses of contemporary clinic, this study tries to reflect upon the
limits of representation and the acting-out on the body as an extreme effort to inscribe
experiences of violence. Body marks such as cuts, fractures, burns and other scars come
into play suggesting intense feelings that remain outside the associative circuit. These
characteristics seem related to early experiences and to a clinical practice that focus on
sensations and perceptions prior to language acquisition. The importance of the Other in
the constitution of the psyche and of a body representation is contemplated. The paper`s
main objective is to understand how the mother-infant body contact is responsible for
giving the baby a sensation of body unification that, in turn, creates a favorable
condition for the beginning of the psychical function of representation and elaboration
of bodily sensations. Thus, a distinction is made between the hysteria s represented body
and the body which is shown, site of excess, of the disconnected instinct that is outside
the symbolic field.

[pt] Esta tese apresenta uma leitura decolonial das formas através das quais a
violência atravessa imaginações, materialidades e experiências na e sobre a cidade
do Rio de Janeiro. Argumenta-se que é a violência produtora e reprodutora das
representações, das formas de gestão urbana e das vivências cotidianas que
coexistem e se cruzam no Rio de Janeiro, como cidade que busca se construir como
pós-colonial. Para tal, discute-se a relação entre violência e a cidade a partir de
quatro pontos de contato. Em primeiro lugar, a tese apresenta o conceito de cidade-violência,
a partir da qual é construída uma interpretação sobre a relação entre a
formação material e imaterial da cidade do Rio de Janeiro e as dinâmicas violentas
de racialização do espaço urbano no contexto histórico-político de uma forjada
pós-colonização. Em seguida, trabalha-se com a ideia da cidade sensível, em
que se discute em que medida determinados processos de racialização do espaço
urbano, em suas muitas formas e manifestações, forjaram regimes estético-urbanos
que distribuem lugares e espaços para a existência e circulação de corpos,
percepções, sensações, objetos e sujeitos na cidade. Na terceira parte da tese,
analisam-se as interpretações da violência que circulam, produzem e informam a
gestão do espaço urbano na cidade do Rio de Janeiro, a partir de um mapeamento
crítico do campo de saberes e práticas que constroem entendimentos e imaginários
correntes sobre violência na cidade. Em todos esses casos, serão abordadas as
formas através das quais essas interpretações produzem limites, apagamentos e
silêncios sobre a relação entre raça, racismo, colonialidade e violência na cidade do
Rio de Janeiro. No capítulo seguinte, a tese se debruça sobre as imaginações,
materialidades e experiências da guerra na cidade, discutindo como o conceito de
militarização atravessa representações e vivências da cidade pós-colonial, e quais
são os contra-saberes a partir dos quais é possível vislumbrar intelectualidades e
contra-estéticas insurgentes, capazes de apontar novos sentidos e interpretações
para as relações entre a violência e as configurações da colonialidade no espaço
urbano. Pretende-se, com esta tese, oferecer uma contribuição teórica original ao
campo de estudos das Relações Internacionais que se debruça sobre as dinâmicas
de violência no âmbito das cidades em contextos de pós-colonização,

decoloniais para estudar a relação entre violência, cidade e (pós-)colonialidade. / [en] This thesis presents a decolonial interpretation on the ways in which violence
crosses imaginations, materialities and experiences in the city of Rio de Janeiro. It
argues that violence produces and reproduces representations, forms of urban
management and everyday experiences that coexist and intersect in Rio de Janeiro,
as a city that seeks to build itself as post-colonial in the everyday. To this end,
the thesis addresses the relationship between violence and the city through four
points of contact. First, the thesis presents the concept of city-violence, from
which an interpretation is built on the relationship between the material and
immaterial formation of the city of Rio de Janeiro and the violent dynamics of
racialization of the urban space in the historical-political context of a forged postcolonization.
Then, it works with the idea of the sensible city, in which it
discusses the extent to which certain processes of racialization of urban space, in
their many forms and manifestations, forged urban-aesthetic regimes that distribute
places and spaces for existence and circulation of bodies, perceptions, sensations,
objects and subjects in the city. In the third part of the thesis, it analyzes the
interpretations of violence that circulate, produce and inform the management of
urban space in the city of Rio de Janeiro, based on a critical mapping of the field of
knowledge and practices that forge meanings, representations and imaginations
about violence in/and the city. Specifically, the thesis addresses the ways in which
these interpretations produce limits, margins and silences on the relationship
between race, racism, coloniality and violence in the city of Rio de Janeiro. The
final chapter focuses on the imaginations, materialities and experiences of the war
in the city, discussing how the concept of militarization crosses representations
and experiences of the post-colonial city. This part also includes an interpretation
on the counter-knowledge about war in/and the city that is produced daily and
from which it is possible to glimpse insurgent intellectualities and counteraesthetics,
capable of pointing out new meanings and interpretations for the
relations between violence and the configurations of coloniality in the urban space.
By exploring the multiple connections between violence and the city of Rio de
Janeiro, this thesis aims at offering an original theoretical contribution to the field
of International Relations that studies the dynamics of violence within cities in
contexts of post-colonization, arguing for the necessity of building new epistemic
and decolonial possibilities to study the realtions between violence, the city and
(post-)coloniality.

[pt] O estupro foi visto durante muito tempo como uma consequência do conflito armado. Contudo, esse cenário mudou na guerra da Bósnia, pois o estupro deixou de ser meramente um efeito colateral da guerra para ser percebido como estratégia/arma de guerra com o principal objetivo de realizar a limpeza étnica. A violência, o estupro e o trauma são os protagonistas da nossa investigação. Nossa pesquisa é de cunho estritamente teórico e, para isso, utilizamos a referência psicanalítica nos baseando principalmente na obra freudiana para pensar a ideia de pulsão de morte, violência, guerra e trauma. Além disso, utilizamos também as considerações de André Green para analisar os conceitos de objetalização e desobjetalização do corpo da mulher nesse processo. Pois percebemos o quanto a mulher é investida como objeto/instrumento de guerra com o fim de um propósito maior – como no caso da guerra da Bósnia, a limpeza étnica – também é totalmente desinvestida e anulada como sujeito, sem poder consentir ao que acontece com seu corpo tornado objeto. Além disso, analisamos o quanto o trauma possui efeitos dessubjetivantes na mulher que passa por essa cena de horror. / [en] Rape has long been seen as a consequence of armed conflicts. However, in the Bosnian war this setting changed, for rape was no longer merely a side effect of the war, to be seen as a strategy/weapon of war with the main objective of carrying out ethnic cleansing. Violence, rape and trauma are the leading figures of our investigation. Our research is strictly theoretical and for this we use the psychoanalytical reference based on Freud s work to think about the idea of death drive, violence, war and trauma. In addition we also use André Green s considerations to analyze the concepts of objectalization and deobjectalization of the woman s body in such process. As we realize how much women are invested as an object/ instrument of the war with the aim of a greater purpose – as the ethnical cleansing in the Bosnian war – the woman is also totally disinvested and annulled as a subject, without being able to consent to what happens to her body made an object, In addition, we analyze how much trauma has desubjective effects on the woman who goes through such horror scene.

O Caderno Um – Rio de Janeiro – rememora a história de Sandro Rosa do Nascimento, conhecido como Mancha, responsável pelo sequestro do ônibus 174 na cidade do Rio de Janeiro e também a vida e a morte de Márcio Amaro da Conceição, conhecido como Marcinho VP. O aporte teórico desta discussão se apoia principalmente em Luiz Eduardo Soares, Richard Rorty, Paul Ricoeur, utilizando-se também dos filmes e documentários de José Padilha e Eduardo Coutinho. O Caderno Dois – Montevidéu – se passa no Uruguai quando da pesquisa com a professora Helena Modzelewski, que tem sua tese ancorada em Martha Nussbaum e a educação das emoções através do texto literário. Modzelewski aplica a teoria de Nussbaum em seu trabalho com mulheres em situação de rua, depois transformado em livro: El refugio de las palabras dormidas (2015). Neste caderno se concentra quase toda base teórica da tese, como a ligação entre a educação das emoções e a teoria das capacidades, teorias desenvolvidas por Martha Nussbaum e Amartya Sem. To achieve the objective a qualitative research was conducted through interviews with representatives of varied instances that are part of the local Rights Assurance System. The information obtained was submitted to content analysis, in its thematic modality. The results indicate an articulated work incipient implementation process, yet lacking agreement spaces and collective integration of all system composing instances.

[pt] Esse trabalho trata da luta das mães e familiares de vítimas da violência do
Estado brasileiro, mais especificamente sobre o engajamento político das mães,
moradoras de favelas no Rio de Janeiro, que perderam seus filhos assassinados
por policiais militares e agentes do Estado. As reflexões trazidas aqui são fruto de
trabalho etnográfico no qual acompanhei e testemunhei o luto público das mães
nos espaços públicos da cidade. É a partir do testemunho da luta e do luto das
mães que pude tecer a problemática dessa tese que se centra na relação entre
gênero, violência, soberania e sacrifício. Argumento, partindo das minhas
experiências e vivências etnográficas, que o movimento de mães questiona a
legitimidade do poder de matar do Estado ou, em outras palavras, questiona a
própria soberania de Estado como o poder sobre a vida e a morte. Ao defenderem
que o Estado brasileiro não tinha o direito de tirar a vida dos filhos que elas
geraram, as mães trazem à tona a relação entre gênero e soberania e o modo como
ambos estão intimamente conectados. Além disso, argumento que o movimento
de mães toca nas estruturas fundacionais do Estado-nação ao revelar que a
soberania de Estado repousa sobre uma economia sacrificial na qual a vida de
alguns depende da morte de outros. O movimento das mães reúne tanto as
condições para expor a lógica sacrificial sobre a qual se sustenta a soberania
estatal quanto revelam que elas, as próprias mães, se inserem também em uma
lógica sacrificial ao lutar em nome de seus filhos assassinados pelo Estado. Nesse
sentido, percorro um caminho de investigação filosófica a fim de compreender as
fundações mitológicas da soberania de Estado e a lógica sacrificial intrínseca a
ela. / [en] This dissertation deals with the struggles faced by mothers of victims of
Brazilian state violence. More specifically, about the political engagement of
mothers, slum dwellers in Rio de Janeiro, who have lost their sons murdered by
military police and state agents. The reflections I brought to the fore are the
results of an ethnographic project in which I followed and witnessed the public
mourning of some mothers in the public space of the city. Through witnessing
their mourning I was able to develop the problematic tackled in this thesis: the
relationship between gender, violence, sovereignty and sacrifice. Based on my
ethnographic experiences, I argue that the movement organized by these mothers
put into question the legitimacy of state sovereignty, in other words its power over
life and death. When they claim that the Brazilian state did not have the right to
take their sons lives, lives which they give birth to, they bring to the fore the
intimate relation between gender and sovereignty. In addition, I argue that the
mothers movement touch upon the foundational structures of the nation-state
when they reveal the state sovereignty reliance on an economy of sacrifice,
specifically one in which the lives of some depend on the death of others. The
mothers movement provides the conditions both to expose the sacrificial logic
upon which state sovereignty relies and to reveal that the mothers themselves are
also embedded in a sacrificial economy when they struggle in the name of their
sons killed by the state. In this sense, my thesis is a philosophical investigation in
order to grasp the mythological foundations of state sovereignty and its intrinsic
reliance of an economy of sacrifice.

[pt] O presente estudo tem como objeto as particularidades na implementação da Política Nacional de Enfrentamento à Violência contra as Mulheres no contexto local, através da atuação do Centro de Referência de Mulheres da Maré-Carminha Rosa (CRMM-CR), localizado na Vila do João, sub-bairro do conjunto de favelas da Maré, no município do Rio de Janeiro. Considerando a violência de gênero contra as mulheres como um constructo social, histórico e multifacetado que fere os Direitos Humanos das mulheres e gera impactos na vida dessa população no Brasil, o estudo busca identificar como uma política formulada pela esfera federal é implementada no contexto local da Vila do João – Maré. A pesquisa foi desenvolvida a partir da metodologia qualitativa e os instrumentos utilizados para produção de dados foram entrevistas semiestruturadas realizadas com 6 profissionais que integram a equipe do CRMM-CR. Os dados produzidos foram analisados a partir de uma perspectiva interseccional, articulando as três categorias fundantes das desigualdades no modo de produção capitalista patriarcal: gênero, raça e classe. Os principais resultados apontam para a necessidade de ampliar a compreensão sobre proteção às mulheres em situação de violência de gênero, olhando não só para violências domésticas e interpessoais, mas também para as violências estruturais, urbanas e aquelas perpetradas pelo Estado. Destaca-se nesse sentido, o papel fundamental do CRMM-CR como porta de entrada para a PNEVC nesse território e articulador da Rede de Atendimento. / [en] This study has as its object the particularities in the implementation of the National Policy to Combat Violence against Women in the local context, through the performance of the Maré-Carminha Rosa Women Reference Center (CRMM-CR), located in Vila do João, sub-neighborhood of the Maré favelas, in the municipality of Rio de Janeiro. Considering gender violence against women as a social, historical and multifaceted construct that hurts the human rights of women and impacts on the lives of this population in Brazil, the study seeks to identify how a policy formulated by the federal sphere is implemented in the local context of Vila do João - Maré. The research was developed from the qualitative methodology and the instruments used for data production were semi-structured interviews conducted with 6 professionals who are part of the CRMM-CR team. The data produced were analyzed from an intersectional perspective, articulating the three founding categories of inequalities in the patriarchal capitalist mode of production: gender, race and class. The main results point to the need to broaden the understanding of protecting women in situations of gender-based violence, looking not only at domestic and interpersonal violence, but also at structural, urban and perpetrative violence by the State. In this sense, the key role of CRMM-CR as a gateway to the NPCVW in this territory and articulator of the Service Network stands out.

[pt] A partir de entrevistas com policiais do Rio de Janeiro, esta pesquisa tem por
objetivo investigar a relação tensa que há entre Polícia e violência. Com as
entrevistas, nota-se que os policiais evitam e resistem a discussões sobre violência
e à própria palavra violência. Em vez disso, empregam guerra como
instrumento retórico para pleitear autorização e leniência para o exercício de
violência na função policial. Posicionando a violência como parte do poder
discricionário da polícia, ele mesmo resultado de uma tensão inescapável entre lei,
que deveriam seguir, e ordem, que deveriam impor, a pesquisa apresenta que a

nunca vai cessar, que estão enxugando gelo. / [en] Based on interviews with police officers in Rio de Janeiro, this research aims
to investigate the uneasy relationship between Police and violence. With the
interviews, it is noted that police officers avoid and resist discussions about violence
and the word violence itself. Instead, they use war as a rhetorical device to
claim authorization and leniency for the exercise of violence in police duty.
Positioning violence as part of the police s discretionary power, itself the result of
an inescapable tension between law, which they should follow, and order, which
they should impose, the research shows that the same structure of criticism of
violence as excess supports and reiterates the possibilities of employment of
extrajudicial violence by police officers. The police officers, in turn, present this
violence with concealment and duplicity, in addition to the use of euphemisms,
denials and silences, in contrast and tension with the use of war rhetoric. Finally,
the research presents the police function as an impossible job. Acting on the
tensions and paradoxes between law and order, and between the authorization for
the use of violence and the rejection of violence, police officers respond to
contradictory demands using the rhetoric of war, but recognize that this war
will never cease, that they are drying ice.

[pt] O Rio de Janeiro é o estado que conta com o maior número de mortos em incursões policiais nas favelas – geralmente, incursões relacionadas ao combate às drogas. Por exemplo, em 2019, 1.808 mortes (sendo a população negra, 70 porcento das vítimas) foram classificadas como homicídio decorrente de intervenção policial, classificação que caracteriza a ação do policial como legítima defesa e significa uma série de diligências que, geralmente, resultam no arquivamento do Inquérito Policial sem uma investigação mais profunda ou na absolvição dos oficiais envolvidos. Nesse cenário emerge o movimento de luta das mães de vítimas desse tipo de violência – mulheres que se engajam em movimentos sociais para lutar por justiça, para esclarecer as circunstâncias da morte dos filhos e exigir a punição dos envolvidos. O presente
trabalho tem como objetivo investigar como se dá a transformação do luto em luta, isto é, examinar como as mães articulam sofrimento pessoal e ativismo político ao se engajarem em movimentos sociais, mais especificamente, na Rede de Comunidades e Movimentos contra a Violência. As narrativas enunciadas por elas nos protestos públicos se configuram como objeto privilegiado de análise. Trata-se de uma análise
qualitativa-interpretativista, empreendida em perspectiva micro, conduzida pelos estudos que consideram o discurso narrativo como forma de construção da vida social e instrumento dos movimentos sociais para reivindicar suas demandas. A análise foi organizada segundo quatro esferas, partícipes do engajamento dos familiares na Rede, são elas: as narrativas, a resistência, a maternidade e o gerenciamento das emoções. A
primeira análise focaliza a estrutura das histórias, chamadas aqui de narrativas de engajamento. Emprega elementos da teoria laboviana, em interface com os estudos que contemplam os aspectos socioculturais e interacionais que fundamentam a prática discursiva. A segunda trata dos mecanismos discursivos mobilizados pelos familiares na elaboração de emoções como a dor de perder um filho; se debruça sobre os sistemas de coerência acionados junto ao contexto macrossocial nas narrativas, isto é, sobre o
modo como as relações de sequencialidade e causalidade construídas nessas histórias relacionam-se a outros discursos culturalmente consagrados. A terceira observa como a categoria mãe é acionada nas narrativas. A quarta e última análise se detém nos eventos catalizadores que impulsionam o engajamento e o ativismo sustentado dos familiares na Rede, investigando como o chamado choque moral é construído nas histórias. Em suma, o trabalho analítico sugere a existência de um padrão que organiza as narrativas de engajamento e identifica dois mecanismos discursivos entrelaçados: i) a dupla transição entre uma pessoalização x coletivização da dor de perder um filho e da experiência com a violência policial – de modo que o sofrimento individual de uma mãe se transforma no sofrimento do grupo e a caracterização do policial responsável pela morte se transforma em denúncias à atuação da corporação como um todo; ii) a
racionalização dos eventos que levaram à morte do filho por meio de sistemas de coerência que operam com versões simplificadas do racismo e da teoria da Necropolítica. Nesse sentido, as narrativas se caracterizam como práticas de resistência e denúncias ao racismo que permeia diversas instituições do Estado; e práticas de reexistência na medida em que as mães, ao praticarem o luto público, humanizam as
vítimas da violência policial e reenquadram as mortes nas favelas não como casos isolados de má conduta de policiais, mas sim como parte de uma lógica de atuação do Estado. / [en] Rio de Janeiro is the state with the highest number of homicides due to police
brutality – often as a result of incursions related to the war on drugs. In 2019, for
instance, 1.808 deaths were classified as homicide due to police intervention, a
classification given when a police officer kills in self-defense. It also gives rise to a
series of procedures which primarily result in the archiving of the cases without a
proper investigation, or the police officers being absolved of murder, or any other crime
for that matter. Such injustice leads the victims mothers to unite – engaging in social
movements to fight for justice, seek clarification of the circumstances in which their
children died, as well as to demand punishment of those involved. This study aims to
investigate how grief is converted into political struggle as these mothers engage in
social movements, more specifically in the Rede de Comunidades e Movimentos contra
a Violência. Narratives enunciated by these mothers in public protests organized by the
Rede are considered the privileged loci for analysis. Based on a micro-perspective, this
analysis is guided by a qualitative-interpretative approach, and draws on studies which
consider narrative discourse a way of constructing social life as well as a political tool
used by social movements to demand justice. The macro-social context in which the
deaths of Black people are placed also informs the analytical process which is
organized around four spheres that are part of the mothers engagement in social
movements: the narratives told at the protests, political resistance, the concept of
maternity and the management of emotions. The first analysis describes the structure
of the stories – referred to here as narratives of engagement –by employing elements
from Labovian theory in tandem with theories which accentuate the interactional and
sociocultural values underpinning narrative practice. The second analysis observes the
discursive resources brought to bear on the narratives of the victims relatives in their
process of managing emotions as pain. The analysis focuses on their systems of
coherence, i.e., whether sequential ordering and causality relations constructed in these
stories relate to culturally established discourses. The third analysis aims to understand
how the categorization of “mother” is elaborated in the stories. The fourth and final
analysis is focused on catalysing events that drive the engagement and sustained
activism of these relatives in the Rede, investigating how moral shock is constructed in
these narratives. In sum, the analytical work suggests the existence of a recurrent
pattern that organizes narratives of engagement. Two discursive mechanisms interact
with each other in the narratives: i) a double transition between personal experience
with police brutality and the collective experience of those who have lost their children
– this means that individual pain becomes collective pain, and the specific
characterization of one police officer is transformed into grievances with respect to the
corporation as a whole; ii) the rationalization of events leading to the death of their
children by using coherence systems that operate with simplified versions of racism and the theory of Necropolitics. In a sense, these narratives of engagement are
characterized as practices of resistance and work to denounce the racism that permeates
several State s institutions. As well as practices of re-existence. By means of publicly
mourning their children, these mothers humanize the victims of police brutality
reframing these deaths not as isolated cases of police misconduct, but as part of a
system.
