O presente trabalho analisa os fundamentos da responsabilidade civil pelo fato do produto e do serviço no direito brasileiro. O estudo está centrado na controvérsia entre a teoria formalista e a teoria funcionalista, que apresentam concepções distintas de direito privado. Para avaliar essa controvérsia e fornecer os fundamentos da responsabilidade civil pelo fato do produto e do serviço, são desenvolvidos os sentidos de justiça aristotélica e de direito kantiano. O estudo decide, com base nos referidos conhecimentos, entre a aplicação da teoria clássica da culpa, da teoria do risco ou de uma teoria específica. / The present study analyzes the basis of product and service related torts in Brazilian law. It is centered in the controversy between the formalist and the funcionalist theories, which have distinct conceptions of private law. The meanings of Aristotelian justice and Kantian law are developed in order to acess this controversy as well as to provide the basis of the legal discipline of product and service related torts. The research decides, based on such knowledge, between the application of the classical theory of fault, of the risk theory or, for the elaboration of a specific theory.

As principais objeções do Aenesidemus (1792) de Gottlob Ernst Schulze (1761-1833) à filosofia kantiana segundo a Filosofia elementar de Reinhold sinalizam duas tendências. Por um lado, servindo-se de argumentos que recusam a proposição suprema proposta por K. L. Reinhold (1757-1823) apontam para o esgotamento de investigações relativas ao âmbito puramente teórico em filosofia, mais especificamente, o da busca por um primeiro princípio universal em filosofia. Por outro lado, dão ensejo à solução dialética no iminente idealismo alemão, através da leitura que J. G. Fichte (1762-1814) faz das objeções, partindo então para a construção da Doutrina da ciência. É com a dialética, elemento central neste novo período, que Fichte irá propor o que entende ser o primeiro princípio capaz de fundamentar a filosofia como saber do saber. Mais que uma proposição teórica, este princípio será o Eu absoluto. / In its main objections to the Kantian philosophy as presented by K. L. Reinhold\'s Elementary Philosophy, G. E. Schulze\'s (1761-1833) Aenesidemus (1792) brings two different tendencies to the fore. On the one hand, by relying on arguments which refuse the supreme proposition as proposed by Reinhold (1757-1823), they signal the exhaustion of investigations regarding the purely theoretical side of philosophy - more specifically the one concerning the search for a first universal principle. On the other hand, they prepare the context for the dialectic solution by rising German idealism, namely through J. G. Fichte\'s (1762-1814) reading of those objections as he moves on to the construction of his Doctrine of Science. It is with his dialectic, a key element of this new period, that Fichte will propose what he takes to be the first principle capable of grounding philosophy as the \"knowledge of knowledge\". It gives special attention to the ground books: The metaphor of God incarnate, An interpretation of religion, Death and eternal life. In the first book, he reformulates the incarnation doctrine to turn the pluralist hypothesis possible. In the second, he introduces his pluralist hypothesis that all religions are valid responses to the Real or Ultimate Reality. And in the third, which is his global theological work, he searches to build up what would be a pareschatology embracing the pluralist hypothesis. Finally, the essay seeks to demonstrate the inconsistency of Hick‟s Kantian epistemological grounds. It also presents the strong consequences that the revisionist project and the global theology have to Christian theology. It shows that the revisionist task, which has been proposed by Hick, empties the meaning of Christian theology. Therefore, it does not consider it as an authentic response to the Real, what invalids Hick's pluralist hypothesis. / Esta dissertação analisa as principais teses do teólogo pluralista John Hick. Dá-se especial atenção aos livros que as fundamentam: A Metáfora do Deus Encarnado, An Interpretation of Religion e Death and Eternal Life. No primeiro livro, ele reformula a doutrina da encarnação para tornar a hipótese pluralista possível. No segundo, ele apresenta sua hipótese pluralista de que todas as religiões são respostas válidas ao Real ou Realidade Última. E no terceiro, o qual é seu trabalho de teologia global, ele busca construir o que seria uma parescatologia que mantenha a hipótese pluralista. Finalmente, a dissertação procura demonstrar a inconsistência da base epistemológica kantiana de Hick. Demonstra também as profundas conseqüências que o projeto revisionista e a teologia global têm sobre a teologia cristã. Apresenta que a tarefa revisionista que tem sido proposta por Hick, esvazia o significado da teologia cristã. Por conseguinte, não a considera como uma resposta autêntica ao Real, o que invalida a hipótese pluralista de Hick.

Kant Stop the Kidfluencers : Moral Considerations in Using Children as Social Media Influencers

The practice of "kidfluencing," or using children as social media influencers to promote commercial products and services, raises ethical concerns about the commodification of childhood, them being viewed as products, and their rights falling between the gaps. This essay critically examines the moral dilemmas and challenges in regulating kidfluencing practices from a Kantian and virtue ethics perspective, analyzing the implications of commodifying childhood and the potential harm it can cause. The UN Convention on the Rights of the Child is used as a framework for evaluating the moral interests of children in the context of kidfluencing practices. Arguments for and against regulating kidfluencing practices and the challenges and dilemmas in achieving effective and consistent regulation are presented. The essay concludes with a summary acknowledging the limitations and the need for further research.

Nous entendons confronter pratique des mathématiques et réflexions sur les mathématiques dans l'œuvre de Weyl. Nous étudierons : (a) ses monographies en analyse complexe, en relativité générale et en mécanique quantique, (b) les articles en lien avec ces ouvrages, (c) certains de ses cours, (d) sa correspondance avec divers scientifiques, principalement A. Einstein, E. Cartan, J. von Neumann. Nous voulons savoir si les théories mathématiques qu'il investit conditionnent ses positions sur les fondements des mathématiques. Inversement, nous montrerons que les philosophies auxquelles il se réfère – essentiellement le criticisme kantien, l'idéalisme fichtéen et la phénoménologie de Husserl – conditionnent ses recherches. Tout d'abord, nous reviendrons sur Die Idee der Riemannschen Fläche (première éd. 1913). Nous montrerons qu'il opte alors pour un formalisme mitigé. Il se revendique de deux traditions incarnées par Klein et par Hilbert. Ensuite, nous étudierons les éditions successives de Raum, Zeit, Materie (1918-1923). Nous aborderons le projet d'une géométrie purement infinitésimale qui permet à Weyl de proposer une théorie unifiée des champs, cette dernière étant réfutée par Einstein, Pauli, Reichenbach, Hilbert and Eddington. Nous décrirons aussi la construction et la résolution de son « problème de l'espace » (1921-1923). Nous indiquerons comment la référence aux philosophies de Fichte et de Husserl permet d'éclairer ces deux projets. Enfin, nous commenterons l'article de Weyl sur les groupes de Lie (1925-1926) ainsi que son ouvrage Gruppentheorie und Quantenmechanik (1928, 1931). Son article sur les groupes de Lie manifeste la voie moyenne entre formalisme et intuitionnisme qu'il adopte en 1924. Son ouvrage en mécanique quantique incarne quant à lui un « tournant empirique » dans son épistémologie qu'il conviendra de comparer \`a l'« empirisme logique ». / Our purpose consists in comparing Weyl's mathematical practice with his philosophical reflections on mathematics. We will study (a) his monographs on complex analysis, general relativity and quantum mechanics, (b) the articles which are linked to these books, (c) some of his lecture courses, (d) his correspondence with different scientists, mainly A. Einstein, E. Cartan, J. von Neumann. We will show that his mathematical research has a strong influence on the different stands he successively takes regarding the foundations of mathematics. Conversely, we will show that the philosophical systems he refers to (mainly kantian criticism, fichtean idealism and husserlian phenomenology) have a real impact on his investigations in mathematics. We will first analyse Die Idee der Riemannschen Fläche (first edition 1913). In this book, Weyl seems to take up a formalist point of view, but this is partly true. In fact, he is influenced by two traditions respectively embodied by Hilbert and Klein. Then, we will study the successive editions of Raum, Zeit, Materie (1918-1923). We will describe Weyl's project of a “purely infinitesimal geometry”. Thanks to this geometrical framework, he builds a unified fields theory, which will be disproved by Einstein, Pauli, Reichenbach, Hilbert and Eddington. During this short period, Weyl also constructs and solves the so-called space problem (1921-1923). Weyl's references to Fichte and Husserl have a significant impact on these two projects. Finally, we will comment Weyl's main article on Lie groups (1925-1926) and his monograph on quantum mechanics, i.e. Gruppentheorie und Quantenmechanik (1rst ed. 1928, 2nd ed. 1931). Weyl's article on Lie groups is in accordance with his compromise between intuitionism and formalism (1924). On the other hand, Weyl's book on quantum mechanics encapsulates an “empirical turn” in his epistemology, which will be compared with the so-called empirical logicism.

The purpose of this essay was to lay the foundations for a model in the form of a question battery that can help buyers compare the sustainability responsibilities of different suppliers, so that the buyer can choose the supplier that contributes most to the Sustainable Development Goals (SDG). The model is designed as a question battery to enable the buyer to ask more comprehensive questions to the various suppliers regarding social, ecological and economic sustainability than they do today.   In order to find questions on an overall ethical level I have investigated how the global institutions intend us to navigate and prioritize between the SDGs, I have also applied the Aristotelian and Kantian ethics and Archie Carrol's model, the CSR pyramid, to broaden the ethical perspective in the questions to the companies.   The result is a question battery with questions about the company's vision and global goals, about the company's values ​​linked to all stakeholders, questions about whether the internal good and the external good are in harmony with society, questions about the company's value chain and business model and a larger stakeholder analysis.   How should a buyer then be able to evaluate a supplier's different answers? This essay aimed to create the first questionnaire with a broad question battery, the next step is to evaluate the different answers. / Syftet med den här uppsatsen var att lägga grunden till en modell i form av ett frågebatteri som kan hjälpa inköpare att jämföra olika leverantörers hållbarhetsansvar, så att inköparen ska kunna välja den leverantör som bidrar mest till de globala målen.  Modellen är utformad som ett frågebatteri för att inköparen ska kunna ställa mer omfattande frågor till de olika leverantörerna angående social, ekologisk och ekonomisk hållbarhet än vad de gör idag.   Mitt tillvägagångssätt har varit att undersöka hur de globala institutionerna tänker sig att vi ska navigera och prioritera mellan de globala målen, genom att övergripande backa tillbaks till de hållbarhetsdokument som togs fram redan på 1980-talet och sedan arbeta mig vidare till de globala mål som kom 2015 och fram till de guider som finns för ett hållbart näringsliv idag. För att hitta frågor på en övergripande etisk nivå har jag tagit hjälp av den aristoteliska och den kantianska etiken samt Archie Carrols modell, CSR pyramiden, för att bredda det etiska perspektivet i frågeställningarna till företagen.  Resultatet blev ett frågebatteri med frågor om företagets vision och de globala målen, om företagets värderingar kopplat till samtliga intressenter, om det internt goda och det externt goda är i samklang med samhället, frågor om företagets värdekedja och affärsmodell samt en större intressentanalys. Hur ska en inköpare kunna värdera en leverantörs olika svar? Den här uppsatsen syftade till att skapa det första frågeformuläret med ett brett frågebatteri, nästa steg är att värdera de olika svaren.

The harmonisation of good faith and ubuntu in the South African common law of contract

The legal historical development of fairness in the South African common law of contract is investigated in the context of the political, social and economic developments of the last four centuries. It emerges that the common law of contract is still dominated by the ideologies of individualism and economic liberalism which were imported from English law during the nineteenth century. Together with the theories of legal positivism and formalism which are closely related to parliamentary sovereignty and the classical rule of law, these ideals were transposed into the common law of contract through the classical model of contract law which emphasises freedom and sanctity of contract and promotes legal certainty. This approach resulted in the negation of the court’s equitable discretion and the limitation of good faith which sustain the social and economic inequalities that were created under colonialism and exacerbated under apartheid rule. In stark contrast, the modern human rights culture grounded in human dignity and aimed at the promotion of substantive equality led to the introduction of modern contract theory in other parts of the world. The introduction of the Constitution as grounded in human dignity and aimed at the achievement of substantive equality has resulted in a sophisticated jurisprudence on human dignity that reflects a harmonisation between its Western conception as based on Kantian dignity and ubuntu which provides an African understanding thereof. In this respect, ubuntu plays an important role in infusing the common law of contract with African values and in promoting substantive equality between contracting parties in line with modern contract theory. It is submitted that this approach to human dignity should result in the development of good faith into a substantive rule of the common law of contract which can be used to set aside an unfair contract term or the unfair enforcement thereof. / Private Law / LL. The Sublime as an Aesthetic Experience of Art : The Aesthetic Experience of Mark Rothko's Abstract Paintings

The following work investigates the nature of the aesthetic experience of the abstract expressionist paintings of Mark Rothko. I suggest that the aesthetic experience in relation to his paintings best is understood in terms of the sublime. To support my position, I discuss the impact of abstraction in comparison to figuration in art on our aesthetic experience. Abstraction in art, I suggest, provides the basis for an aesthetic experience where the viewer can enjoy the visual features and composition free from connecting any depicted imagery to our physical world. This, I hold, provides the basis for a unique type of aesthetic experience. Further, I suggest that the visual complexity in the abstract paintings of Mark Rothko, as well as the aesthetic appeal of his artworks, provides a sense of great magnitude and depth whilst captivating our aesthetic attention. The notion of abstraction allows our minds to never reach a final conclusion as to what type of object we are perceiving. The artistically refined manner in which the artworks are presented captivates our aesthetic attention, allowing us to fully perceptually engage in the limitless sense of depth and visual complexity of his paintings. This, I suggest, provides an encounter in which we through means of perception encounter the idea of a complete form of which magnitude we can never fully comprehend. I argue that this suggests that the aesthetic experience of the abstract expressionist paintings of Mark Rothko best is understood as that of the sublime.
