Daar word aangetoon dat handelinge nie net eksistensiele gedrag is nie; handelinge het 'n onderliggende spiritualiteit as intensie en motivering. Verskillende perspektiewe op spiritualiteit word ondersoek. Die terme praxis pietatis word gekies om spiritualiteit te beskryf. Die skepping-herskepping tema word gebruik om 'n teologiese basis van praxis pietatis te omskryf. Die praxis is kommunikatiewe geloofshandelinge wat as intensionele konkretisering van die imperatief moontlik gemaak is deur die indikatief van God se openbaring van Homself aan die mens. Deur die pietatis word die werklikheid van God se verlossing as eksistensiele kennis, deur die geloofsinoefening van die gelowige as nuwe mens - met die hoop op die opstanding - integrerend in die daaglikse lewe toegepas. / This study intends to describe a spirituality that can function as intention and motivation for communicative faith acts. The operational scientific approach to Practical Theology is discussed briefly. It is shown that acts are not only existential behaviour but has an underlying spirituality as intention and motivation. Different perspectives on spirituality are explored and the term praxis pietatis is chosen describe spirituality. The creation-recreation theme is used to define a theological basis for praxis pietatis. The praxis is intentional communicative acts that stem from the imperative. It is made possible by the indicative of the self-revelation of God to mankind. The redemption of God as existential knowledge is made possible by the exercising of faith by the new man. Indecent assault consists in an unlawful and intentional indecent assault which is and is intended to be indecent. There is some controversy in the case law whether the indecency is committed only by acts which are, objectively speaking indecent, against the view that even though the act is not indecent itself, may nevertheless found a conviction of indecent assault if it was the intention of the accused to act indecent and such intention was conveyed to the victim. It is submitted that the last mentioned approach is to be preferred but that the following test should be used: 1. If the act, is objectively speaking indecent and there is no doubt about the unlawfulness as well as the indecent intention of the accused, the crime of indecent assault was committed. 2. If the act is objectively speaking indecent but the indecent intention of the accused can not be proven, there is a rebuttable presumption that the accused acted with an indecent intention. Such as presumption must be rebutted b the accused himself. 3. Estudou-se a relação do exercício das masculinidades com o cuidado em saúde para homens na atenção primária, para se compreender como são percebidas e apreendidas as necessidades de saúde masculina nas interações entre homens e profissionais de saúde, tomando como referência a identidade masculina. Partiu-se do pressuposto de que o exercício das masculinidades pode representar riscos para a saúde dos homens e que os serviços de saúde não incorporam os referenciais culturais de masculinidades nas práticas de saúde efetivadas. Foram estudados dois serviços de atenção primária à saúde por meio de observação direta das atividades assistenciais e de entrevistas com homens usuários e profissionais de saúde. Encontrou-se uma diversidade de modelos de masculinidade que definem diferentes formas para pensar o cuidado de saúde dos homens. O estudo aponta que a identidade masculina de gênero passa por diferentes dimensões, as quais devem ser consideradas na apreensão das necessidades e nas práticas de cuidados de saúde empreendidas aos homens. No entanto, os padrões hegemônicos de gênero socialmente construídos criam dificuldades para o bom cuidado da saúde masculina. Não obstante, a população masculina procura as unidades básicas de saúde. Embora presente, percebe-se barreiras no uso desses serviços, relacionadas à invisibilidade e à não identificação dos homens com os serviços de atenção primária. Observou-se que as necessidades de saúde dos homens estão pautadas por questões como o trabalho, a sexualidade, a estrutura corporal, a vida comunitária e as relações familiares. Discute-se que as necessidades de saúde das masculinidades e suas particularidades não são acolhidas integralmente nas práticas de cuidado dos serviços de atenção primária à saúde. / This thesis studied the relation between the exercise of masculinities and health care of men in primary health care services. It consists of an attempt to comprehend how male health needs are apprehended in the interactions between men and health professionals. It was presumed that the exercise of masculinities could represent a risk to mens health and that health care services do not incorporate masculinities cultural references in effectuating health practices. Two primary health care services were studied by means of direct observation of assistential activities and interviews with men utilizing the services and health professionals. A diversity of models of masculinity that define different forms of reflecting upon mens health care was encountered. The interviews indicate that gendered masculine identity permeates different dimensions and that these dimensions should be taken into consideration when apprehending the needs and practices with respect to health care undertaken by men. The socially constructed hegemonic patterns of gender create difficulties for men to attain good health care. Nonetheless, the masculine population seeks the primary health care services for care. Although they are present, barriers related to invisibility or to the lack of identification of men with the primary health care services were perceived. This study indicates that mens health needs are regulated by issues such as work, sexuality, corporal structure, community life and family relationships. Masculinities and their needs are not entirely taken into account, as discussed, within the health care practices undertaken by the health services wherein this research was conducted.

Le discernement est traditionnellement rattaché à l’étude de l’élément moral de l’infraction.Sous l’empire du Code pénal de 1810, des fondements de droit naturel sont à l’oeuvre, si bien que le discernement fut défini par emprunt au droit canon comme une aptitude à distinguer le bien du mal. Mais cette acception ne révèle pas la teneur originelle du critère du libre-arbitre :il correspondait à la connaissance de la loi divine dont le droit séculier n’était que le reflet.L’analyse du droit positif laïcisé invite à découvrir l’existence d’une présomption de connaissance de la loi toujours aussi impérative que dans les systèmes de pénalité antiques.Le discernement peut alors être défini comme une conscience réflexive : la connaissance des droits et devoirs reconnus à chaque personne, au sein de statuts juridiques que la prolifération des normes contribue à préciser. Aussi, la culpabilité n’est pas une connaissance de l’illicéité d’un résultat ; elle procède de l’ignorance des prescriptions légales chez celui qui est présumé en connaître l’existence. En procédure pénale, cette présomption devient protectrice des droits du mis en cause. Aucun acte coercitif ne peut être exercé à son encontre s’il n’a été avisé du statut dont il relève. Cette information assure ainsi la finalité rétributive de la peine chez celui qui n’ignore pas les raisons de sa condamnation. En tout état de cause, la soumission des individus au droit pénal est le seul objectif poursuivi en la matière, ce qui nécessite parfois la présence de victimes au procès pénal, à la seule fin de préserver leur foi en son impérativité. / Discernment is traditionally attached to the study of the « moral element » of the offense. Under the influence of the Penal Code of 1810, the foundations of natural law are at work, so that the discernment was defined by canon law as the ability to distinguish good from evil. But this understanding does not reveal the content of the original criterion of free will: it used to correspond to the knowledge of the divine law which secular law was only the reflection. The analysis of positive law secularized invites you to discover the existence of a presumption of knowledge of the law as imperative as it was in the systems of ancient penalty. Discernment can then be defined as a reflexive consciousness: the awareness of rights and obligations identified to each person within legal statutes that the proliferation of standards helps to clarify. Also, guilt is not a knowledge of the wrongfulness of an outcome; it proceeds fromignorance of the legal requirements in the person who is presumed to know of its existence. In criminal proceedings, this presumption becomes protective of the rights of the suspect. No coercive act can be exercised against him if he has not been notified of the status to which he belongs. This information ensures the retributive purpose of punishment, for the one who can’t ignore the reasons for his conviction. In any event, the submission of individuals to the established rules is the only objective of the criminal law, which might imply that it accepts the presence of victims in criminal proceedings, for the sole purpose of preserving their faith in his imperativity.

Comparing the meaning of the learnability principle for children and adults

Abstract in English and Afrikaans / The learnability principle relates to improving usability of software, performance and productivity. It was formulated mainly for the adult user group. Children represent an important user group, but fewer guidelines exist for their educational and entertainment applications. This study compares these groups, addressing the question: “Does learnability of software interfaces have a different meaning for children and adults?”. A literature survey conducted on learnability and learning processes considered the meaning of learnability across generations. Users learning software systems were observed in a usability laboratory where eye tracking data could also be recorded. Insights emerged, from data analysis, showing different tactics when children and adults approached unfamiliar software and revealing aspects of interfaces they approached differently. The findings will help designers distinguish varying needs of users and improve learnability. An additional subprinciple of learnability, „engageability‟, is proposed. Factors that make products engaging for children are different from those engaging adults. / Die leerbaarheidsbeginsel hou verband met die verbetering van die bruikbaarheid van sagteware, werkverrigting en produktiwiteit. Dit was hoofsaaklik vir die volwasse gebruikersgroep geformuleer. Kinders verteenwoordig in belangrike gebruikersgroep, maar minder riglyne is vir hulle opvoedkundige en vermaaktoepassings beskikbaar. Hierdie studie vergelyk hierdie groepe en speek die volgende vraag aan: “Het leerbaarheid van sagtewarekoppelvlakke verskillende betekenisse vir kinders en volwassenes?” „n Literatuuroorsig oor leerbaarheid en leerprosesse is uitgevoer met in ag neming van die betekenis van leerbaarheid vir verskillende generasies. The aim of this study is to analyze how eight women, through autobiographies, describe their experiences of leaving a relationship with a violent male partner. Furthermore, the purpose was also to illustrate factors that kept women from leaving the relationship and factors that encouraged them to leave. The study is mainly based on a gender perspective. In order to create a deeper understanding for the process of women leaving violent men,we included two theories in the study. The two theories are Eva Lundgren’s (2004) theory of The Normalization Process of Violence and Holmberg och Enander’s (2010) theory of the Process of Leaving Violent Men. The result shows that mens violence against women in intimate partner relationships. The result shows that women from the autobiographies tended to get used to the violence coming from their men and considered it to be a part of the relationship. Furthermore, result shows that men’s control and power over women go hand in hand, which leads to women adapting to the violent relation.

Men's violence against women is a major societal problem that can manifest itself in many different ways. The purpose of this study was to see how Sweden's three largest news magazines portray the problem of men's intimate partner violence against women, how different subject-positions are presented and to investigate whether the public's view of the problem is affected by media reporting. To do this, a qualitative discourse analysis has been done with 41 articles on the subject. The articles analyzed are taken from the newspapers Aftonbladet, Dagens Nyheter and Expressen. The study is based on a social constructionist perspective, where the focus is on language and how it constructs our understanding of the world and different phenomena. In addition to the social constructionist perspective, the study is based on three theoretical themes; Gender, media influence and discourse. The articles include, among other things, many women's own stories about the violence in their relationship. How they gradually broke down and how the violence, whether physical, mental, or both, has had devastating consequences for the women. A clear result is that there is a great deal of uncertainty and a lack of knowledge regarding men's intimate partner violence against women. And that it ́s not prioritized within the police and judiciary. The consequence is that few reports leads to prosecution and even fewer to actual convictions, which is problematic as the bleak picture that the media paints can affect others in a similar situation from seeking help.

A veterinary perspective on the use of animals in preschool education

The aim of this study was to investigate human-animal interactions in the triad comprising the veterinarian, the animal and the preschool and in so doing to elucidate the role of the veterinarian in the health and education of preschool children. The area of focus was a comparison of preschools in high and low income areas in and around Pretoria by means of qualitative and quantitative observational methods. It was found that all preschools investigated, included animals in the curriculum and a majority visited the zoo. Interactions included direct contact between children and animals kept permanently or temporarily at school, animal themes and topics, animal protagonists in books, videos, toys and games and excursions to the zoo, urban farms, agricultural museums and animal welfare societies. Teachers felt that child-animal interactions contributed positively to the holistic development of the preschool child, but were worried about management of animals at school and the possibility of zoonotic diseases. As protein of animal origin, such as milk, eggs, meat and fish, formed part of the diet of preschool children, this could also result in a risk of zoonotic disease, particularly in developing areas, where meat and milk hygiene were found to be inadequate. In order to address these fears, the literature was reviewed with regard to zoonotic diseases which could affect preschool children in South Africa. Incidence and prevalence were not well documented and the comparative significance could not be assessed. Therefore the comparative morbidity of diseases diagnosed by the paediatric department of a hospital serving the low income areas studied and a private practice serving the high income areas, were investigated. It was discovered that zoonotic disease formed a very minor proportion of diseases diagnosed. The diagnoses were, however, based on symptoms rather than aetiology and zoonotic causes for, in particular, respiratory and gastro-intestinal disease, could not be excluded. In the light of this, criteria were proposed for the prevention of zoonotic disease outbreaks at preschools. An outbreak of zoonotic disease at a preschool was documented and the application of primary health care principles suggested. Constraints were found to be mainly administrative. Co-operation between the departments of Health and Agriculture was complicated by financial implications which had not been budgeted. Despite this, the intervention was successful in controlling the disease and preventing further outbreaks. The presence of a veterinarian as part of the primary health care team was advocated. Within the preschool it was found that teachers lacked knowledge in the fields of animal ethology and management. Cost, ease of management and appeal to children were taken into account in the choice of animals by preschools. Rodents and birds were considered preferable to carnivores. Housing was evaluated and criteria suggested for management systems which would benefit both children and animals. Death and euthanasia of animals kept permanently at preschool was investigated and suggestions made for a teaching strategy to facilitate understanding by children of the abstract concepts of life, death and grief. A method was developed for the analysis of animal content in literature, games and toys at preschools. It was found that animals were central to the theme of a majority of the books and toys. Realistic fiction where anthropomorphic animals were the central protagonists, had most appeal for children and it was suggested that these could be used in veterinary extension materials for prevention of zoonotic diseases or promotion of animal welfare. An evaluation system was proposed which included the input of veterinary ethologists. Animal facilities visited by preschools during excursions were evaluated. It was found that they were not sufficiently child-centred and environmen¬tally safe for young children. It was suggested that veterinary public health officials should become involved in order to improve animal well-being, particularly with regard to handling facilities and hygiene. In conclusion, a schematic representation of the multitude of roles for veterinarians in the holistic development of the preschool child was drawn up. The roles for different veterinary specialities were also tabulated in order to illustrate the important part played by this profession in the health and education of preschool children. / Die doel van die studie was om mens-dier-interaksies in die driehoek tussen veearts, dier en die kleuterskool te ondersoek om sodoende die rol van die veearts in die gesondheid en opvoeding van die voorskoolse kind aan te dui. Kwalitatiewe en kwantitatiewe navorsingsmetodes is gebruik om kleuterskole in die lae en hoë inkomste-gebiede in en om Pretoria te vergelyk. Alle kleuterskole wat ondersoek is, het diere in die kurrikulum ingesluit en die meerderheid skole het uitstappies na die dieretuin onderneem. Kind-dierinteraksies het die volgende ingesluit: direkte kontak tussen kind en dier op skool; diere in temas, stories, boeke, speletjies en speelgoed; asook uitstappies na die dieretuin, landelike museums, stedelike plase en dierwelsynsorganisasies. Onderwyseresse het gemeen dat die interaksies positief bygedra het tot die holistiese ontwikkeling van die voorskoolse kind, maar het kommer uitgespreek oor bestuur en siektes van diere. Omdat proteïene van dierlike oorsprong deel uitmaak van die dieet van voorskoolse kinders, was soönose ook 'n moontlikheid, veral in kinders van ontwikkelende areas waar dit uitgewys was dat higiëne met betrekking tot vleis en melk, nie na wense was nie. 'n Literatuurstudie het aangetoon dat die algemeenheid en omvang van soönotiese siektes, wat moontlik gevaarlik kon wees vir voorskoolse kinders, nie volledig genoeg omskryf was nie. Die vergelykende morbiditeit van siektes by Ga-Rankuwa Hospitaal se kinderafdeling (pasiënte van lae-inkomste gebiede) en 'n private praktyk in die oostelike voorstede van Pretoria (hoë inkomste gebied), is dus ondersoek. Soönotiese siektes het 'n klein deel uitgemaak van die siektes wat gediagnoseer was, maar die diagnose was op simptome, eerder as die etiologie van die siektes, gebaseer. Die vermoede bestaan dat veral siektes wat gediagnoseer is as respiratories en gastro-enteries, 'n soönotiese oorsprong kon gehad het. 'n Uitbreek van 'n soönotiese siekte by 'n kleuterskool is ondersoek en daar is voorgestel dat primêre gesondheidsorgmetodes gebruik word om dit te bekamp. Teenkanting op administratiewe vlak was die belangrikste probleem wat ondervind was, maar ten spyte daarvan kon die ondersoek suksesvol verloop. Die rol van die veearts as deel van die primêre gesondheidspan is ook hierdeur beklemtoon. Binne die kleuterskool is gevind dat daar 'n gebrek aan kennis is oor diere-etologie en dierebestuur. Kostes, praktiese versorgingsmetodes en die stimuluswaarde van diersoorte, was belangrike aspekte in die keuse van diere wat by skole aangehou is. Daarom was knaagdiere, voëls en vissies meer gewild as honde en katte. Die behuising van die diere is geëvalueer volgens voorgestelde kriteria wat tot voordeel van beide diere en kinders kan strek. Die dood en genadedood van diere by twee kleuterskole is ondersoek en voorstelle is gemaak uit 'n opvoedingkundige oogpunt, om die kinders konsepte betreffende lewe, dood en rou te laat begryp en ook om dit te kan verwerk. 'n Metode is ook ontwerp vir die analise van boeke en speelgoed en daar is bewys dat diere 'n hoofrol gespeel het in die meerderheid boeke en speelgoed by voorskole. Kinders het boeke verkies waar die hoofkarakters antropomorfiese diere was en die omgewing vergelykbaar was met die lewenswêreld van kinders. 'n Voorstel is dus gemaak dat sulke karakters gebruik word om veeartsenykunde voorligtingsboodskappe oor soönotiese siektes of dierwelsyn oor te dra aan jong kinders.Stedelike plasies, die dieretuin, landboumuseums en die Dierebeskermingsvereniging in Pretoria is besoek en daar is bevind dat dit nie veilig genoeg vir jong kinders is nie. Daar word dus aanbeveei dat veeartse in diens van plaaslike owerhede se gesondheidsdienste sulke plekke besoek, om voorstelle oor verbeterde veiligheid en higiëne te maak.Ten slote is 'n skematiese voorstelling van die veelsydige rol van veeartsenykundiges in die holistiese ontwikkeling van die voorskoolse kind saamgestel. The interpretation and application of dolus eventualis in South African criminal law

An accused cannot be held criminally liable by a court until he is considered to be culpable, a process which entails establishing criminal capacity and intention (dolus) or negligence (culpa). Determining a perpetrator’s necessary intent in the form of dolus eventualis has proved to be a predicament in South African jurisprudence. This type of intent occurs when a person does not aim to cause the unlawful act, however, he subjectively foresees the likelihood that in pursuing with his conduct, the unlawful result will possibly happen, and he reconciles himself to this possibility. The problem with this form of intention, especially where the death of another is caused recklessly, is, amongst others, reservations as to whether the perpetrator’s foresight was of a real, reasonable or a remote possibility. This research examines the imperatives and rationale for preceding and current interpretations and applications of dolus eventualis and associate concepts in South African as well as in selected foreign legal frameworks in order to provide a comprehensive perspective on the subject. In this regard, the study challenges conflicting judgments on the application of dolus eventualis in domestic courts, especially as regards homicide- and putative private defence cases, amongst others. It is evidenced that in case law concerning dolus eventualis, legal rules were not properly articulated when determining this type of criminal intent. In this investigation, the legislative framework applicable to dolus eventualis under international law is also critically evaluated with the aim of facilitating the comprehension of this element in South African law. As the concept of dolus eventualis is an indispensable concept in South African criminal law, recommendations are proposed on the application and interpretation of dolus eventualis suitable to the South African landscape, which includes possible law reform. / Criminal and Procedural Law / LL. Den blinda röda fläcken : Menstruation i svenska museisamlingar / The red blind spot : Menstruation in Swedish museum collections

Denna studie undersöker förekomsten av kulturarv rörande menstruation i svenska museisamlingar samt i vilka samband de har deltagit i utställningar eller på annat sätt exponerats för allmänheten. Undersökningen ämnar även ta reda på om tabu relaterat till menstruation påverkat insamlingen och exponeringen av de såkallade ”menstruationsföremålen”. Det empiriska materialet utgörs av en enkätundersökning utskickad till vad som kan sägas vara det allmänna museiväsendet i Sverige bestående av centralmuseum, regionala museum, kommunala museum, stadsmuseum samt ytterligare tre kulturhistoriska museum med en svarsfrekvens på 85,4% då 81 av 96 museum har deltagit. Studien visar att 50,6% av museerna har menstruationsföremål i samlingarna och att majoriteten av dessa hade cirka 1-5 stycken sådana och att den absolut vanligast förekommande föremålskategorin var menstruationsskydd. 64,8% av museer med menstruationsföremål i samlingarna hade exponerat dessa för allmänheten, oftast bara ett fåtal föremål och det vanligast förekommande utställningsformatet var tillfälliga utställningar. Majoriteten av menstruationsföremålen har förvärvats åren 1951-2021. Huruvida menstruationstabut har påverkat förekomsten av kulturarv rörande menstruation i svenska museum är svårt att utröna baserat på denna studie. Däremot kan tabut ha påverkat vilken sorts föremål som finns i museernas samlingar då det mesta materialet utgörs av menstruationsskydd vars uppgift att kontrollera mensflödet kan spegla samhällets förhållande till menstruation som ofta utgörs av skamkänslor inför ämnet. / This study examines the existence of cultural heritage concerning menstruation in Swedish museum collections and in which contexts they have participated in exhibitions or been otherwise exposed to the public. The study also intends to find out whether taboos related to menstruation have affected the collection and exposure of the so-called "menstrual items". The empirical material consists of a survey sent to what can be said to be the general museum system in Sweden consisting of central museum, regional museum, municipal museum, city museum and three other cultural history museums with a response rate of 85.4% as 81 of 96 museums have participated. The study shows that 50.6% of the museums have menstrual items in the collections and that the majority of these museums had approximately 1-5 of such items. The most common item category was menstrual protection. 64.8% of museums with menstrual objects in the collections had exposed these to the public, usually only a few objects and the most common exhibition format was temporary exhibitions. The majority of menstrual items have been acquired in the years 1951-2021. Whether menstrual taboos have affected the existence of cultural heritage concerning menstruation in Swedish museums is difficult to ascertain based on this study. On the other hand, taboos may have affected the type of objects in museums' collections, as most of the material consists of menstrual protection, the task of which is to control the flow of menstruation, which may reflect society's relationship to menstruation, which often consists of feelings of shame about the subject.
