La protection des données à caractère personnel (DCP) constitue un droit fondamental autonome au sein de l’Union européenne (article 8 de la Charte des droits fondamentaux de l’Union européenne). En outre, la libre circulation de ces données et des services de la société de l’information, notamment des plateformes en ligne, est primordiale pour le développement de l’économie numérique dans le cadre du marché unique numérique européen. C’est dans ce contexte qu’un point d’équilibre entre la libre circulation et la protection des DCP fait l’objet du cadre juridique européen et français en matière de protection des DCP. Ainsi, dans cette étude, nous nous sommes intéressés en particulier aux enjeux liés à la mise en balance de ces deux intérêts. Ces enjeux suscitent une attention particulière notamment à l’ère des plateformes en ligne, du Big Data et de l’exploitation en masse des données à travers des algorithmes sophistiqués dotés de plus en plus d’autonomie et d’intelligence / Free flow of data and personal data protection on the Internet Protection of personal data is an autonomous fundamental right within the European Union (Article 8 of the Charter of Fundamental Rights of European Union). Moreover, free flow of personal data and free movement of information society services in particular online platforms is essential for the development of digital single market in European Union. The balance between free movement of data and personal data protection is subject of the European legal framework. However, the main challenge still remains to strike the right balance between effective personal data protection and free flow of this data and information society services. This balance is not an easy task especially in the age of online platforms, Big Data and processing algorithms like Machine Learning and Deep Learning.

The Economic partnership agreements and Market Power Europe : a case study of the African, Caribbean and Pacific States

There are many ways in which to define the relationship between the European Union (EU) and the African, Caribbean and Pacific (ACP) countries. Using Holsti‟s definitions of role theory, this study distinguishes between the ego (the EU) and the alter (the ACP countries), referring to the differing perceptions that each has regarding the same issue: the Economic Partnership Agreements (EPAs). It is argued that the EU carries out its external policies vis-à-vis the ACP countries, and in particular with the EPAs, in a manner that is perceived very differently by the two parties. The EU perceives its behaviour as that of Normative Power Europe (NPE) whereby actions are identified as altruistic and determined by a number of norms that form the core of the EU. Alternatively, it is suggested that in contrast to NPE, the ACP countries, with specific reference to southern Africa, experience and perceive quite a different version of the EU which is determined by Market Power Europe (MPE). MPE highlights a tangible and self-interested Europe not concerned entirely with altruistic intentions but rather the interests of its Single Market. Ochrana spotřebitele v EU / Consumer protection in the European Union

This thesis is focused on consumer protection in the European Union with a special emphasis on online shopping. The first section defines the term 'consumer protection', its development, institutional support, instruments and financing. Also, this part describes the digital market of the European Union, hindrances to the growth of online shopping as well as strategies which are created in order to form a digital single market in the European Union. The second section focuses on protection of personal data, alternative dispute resolutions, current legislation regarding consumers rights on internet and new proposals from the European Commission. The new proposals dominate the second part of this thesis and are discussed with an expert. A survey has been conducted to find out more about the Czech experience with problem solving when shopping online. Moreover, this thesis does not leave out court orders from the European Union´s Court of Justice which have led to the uniform application and interpretation of the consumer protection in the European Union.

The dissertation is dedicated to application of value added tax to an international trade in goods while it focuses on so called intra-Community supplies between EU member states. It focuses also on the extent to which the transitional VAT system is applicable in terms of European single market. The aim of the dissertation was to map existing and possible future development of the VAT system in the area of the intra-Community supplies and its legal framework. The primarily task was to analyze relevant legislation (first Directive 2006/112/EC and Act No. 235/2004 Coll., about the value added tax, as amended) taking into account case law of Court of Justice of EU and national courts of individual EU member states, including the application of the results of analysis on specific selected transactions. A fundamental question seems to be how to prove a fulfillment of conditions for application of the VAT exemption on delivering goods to another EU member state. The condition which appears to be most risky is that the supplier is obliged to prove that the goods left the national territory, especially in a situation where the actual transport is arranged by the customer and the supplier must largely rely on the information that he receives from the customer. 於一九九三年一月一日宣告統合完成之歐洲共同體單一市場,已經成為全 球最大的區域整合市場,其內部的經濟政策,乃對世界各國造成莫大的影 響,其動態亦為世界各國所關注。為了達到市場單一化目標,歐體對於市 場內部的自由競爭情況特別重視,歐洲共同體條約中之競爭規範(第八十 五條至第九十四條),即是對競爭態勢加以管制的法律依據,各會員國為 了增進本國產業的競爭力量,紛紛採行各種國家協助措施,然而各國的此 項措施是否會造成競爭規範的違反?對會員國內、共同體內部產生的是正 面或是負面的影響?對科技研究發展給予國家協助影響為何?。一般而言 ,科技研究發展之國家協助對產業具有正面的影響,並且對競爭態勢的破 壞程度較低,因此也不易違反國際上的補貼法規定,就歐體而言,近年來 逐漸將國家協助運用在科技研究發展上,一些科技產業在世界上更是居領 先的地位,其成果之顯著可見一般。國家協助措施可謂廣泛,舉凡獎勵、 利息優惠、稅賦折扣、低利貸款、保證項目等等,然而各會員國採行各類 措施比重互異,運用在產業的類別方面也不相同,當然產生的效果亦有高 低之別。雖然國家協助措施運用在科技研究發展上產生的問題較少,但是 一些研究發展契約(R&D Contrac t )存在有國家協助(State Aid)的 要素,而這些要素會產生負面的影響,共同體對此則嚴格管制之。歐洲共 同體對科技發展各方面的努力,反觀我國科技發展的現況,實有諸多尚待 改進之處,就政府協助科技產業方面,尚存在進一步補貼的空間,對於基 礎研究的投入更是目前亟需加強的課題。

Essays in international economics and industrial organization

The aim of the thesis is to further explore the relationship between economic integration and firm mobility and investment, both from an empirical and a theoretical perspective, with the objective of drawing conclusions on how government policy can be used to strengthen the positive impact of integration on investment, which is crucial in moving and maintaining countries at the forefront of the technology frontier and accelerating economic growth in a world of rapid technical change and high mobility of ideas, goods, services, capital and labor.<p>The first chapter aims to bring together the literature on economic integration, firm mobility and investment. It contains two sections: one dedicated to the literature on FDI and the second covering the literature on firm entry and exit, economic performance and economic and business regulation.<p>In the second chapter I examine the relationship between the Single Market and FDI both in an intra-EU context and from outside the EU. The empirical results show that the impact of the Single Market on FDI differs substantially from one country to another. This finding may be due to the functioning of institutions.<p>The third chapter studies the relationship between the level of external trade protection put into place by a Regional Integration Agreement(RIA)and the option of a firm from outside the RIA block to serve the RIA market through FDI rather than exports. I find that the level of external trade protection put in place by the RIA depends on the RIA country's capacity to benefit from FDI spillovers, the magnitude of set-up costs of building a plant in the RIA and on the amount of external trade protection erected by the country from outside the reigonal block with respect to the RIA.<p>The fourth chapter studies how the firm entry and exit process is affected by product market reforms and regulations and impact macroeconomic performance. The results show that an increase in deregulation will lead to a rise in firm entry and exit. This in turn will especially affect macroeconomic performance as measured by output growth and labor productivity growth. The EU press publishers' right: past, present, and future

This master thesis is dedicated to the press publishers’ right introduced by Article 15 of the Directive (EU) 2019/790 on copyright and related rights in the Digital Single Market. The article became one of the most debated provisions in the whole directive. On the one hand, the discussion was driven by EU press publishers because of thecommercial crisis in the traditional press publishing and news mediasectors. Press representatives began to express concerns about the free riding of press publications by content aggregators and search engines who usually reuse such contents for profit. On the other hand, service providers argued that press publishers would lose traffic to their websites, affecting the quality of the press and constrainingfundamental rights. This conflict pushed the press publishers to bringing these issues before courts, legislators and competition authorities. Since these complaints were not resolved completely, the only way to resolve the conflict seemed to be the introduction of the EU-wide related right.

Upphovsrättsdirektivet, Digital Single Market-direktivet, befinner sig idag i en implementeringsprocess i EU-länderna. Implementeringen syftar till att harmonisera upphovsrätten mellan medlemsstaterna och att upprätthålla en väl fungerande inre marknad. Direktivet medför ett antal dilemman vid harmoniseringen av medlemsländernas lagstiftningar. Somliga länder är positiva till direktivet, medan andra anmärker en ordalydelse som är otydlig, abstrakt och svår att konkretisera. Frankrike var första land inom unionen att lägga fram ett lagförslag baserat på direktivet. Samtliga medlemsländer, däribland Sverige, har fortfarande tid på sig att införliva direktivet i sin lagstiftning. Syftet med uppsatsen är att utreda DSM-direktivets artikel 17 och dess implementering i fransk rätt med utgångspunkt i Frankrikes framställda lagförslag. Vidare är ändamålet att göra en konkret jämförelse mellan förevarande upphovsrättsliga normer i Sverige respektive Frankrike, för att således kunna analysera det franska lagförslagets lämplighet i svensk rättsordning. Lämpligheten ska försöka bedömas utifrån kulturella värderingar bakom nationell lagstiftning och upphovsrättspolitik. För att besvara frågeställningen huruvida det franska lagförslaget på implementering av DSM-direktivets artikel 17 kan vara en förebild för den svenska lagstiftaren, har framställningen disponerats enligt följande: vi har (1) utrett svensk upphovsrätt, (2) redogjort för DSM-direktivet och härrörande kritik, (3) uppgivit Regeringskansliets resonemang och frågeställningar gällande direktivets genomförande i svensk rätt, (4) utrett fransk upphovsrätt samt (5) översatt och tolkat förevarande lagförslag med tillhörande kritik. Utöver rättskällor, har framställningen till övervägande del grund i debattartiklar, tidskrifter samt inlägg online för att klargöra den aktuella problematiken rörande DSM-direktivet. Slutsatsen är att svensk respektive fransk upphovsrätt visserligen framstår som snarlika i stort sett. Däremot kan det franska lagförslaget på implementering av direktivet enbart framstå som en förebild i viss mån. Av artikel 17:s tre huvudområden kan vägledning av det franska lagförslaget endast ges gällande införandet av en klagomåls- och avhjälpningsmekanism. / <p>Det här är den slutgiltiga examensuppsatsen, en nedskuren version av en mer omfattande och djupgående version.
