The legal certainty principle will be examined by observing how relative certainty and stability manifest when applying said principle, besides employing the concepts of knowability, reliability and calculability, and how the above mentioned principle reveals itself to be a prohibition mechanism on state arbitrary decisions. The concepts of unlawful acts and unlawful administrative acts will also be considered, as well as sanctions and administrative sanctions, which expose undesirable conducts and its legal consequences. Furthermore, the categories, phases and principles applicable to disciplinary administrative proceedings will also be explored. Lastly, the legal certainty principle applied in disciplinary sanctions will also be examined by means of the analysis of the types of unlawful conduct, how sanctions are applied, as well as the correlation between the types of unlawful conduct and sanctions / O presente trabalho objetiva a análise do princípio da segurança jurídica no processo administrativo disciplinar previsto na Lei nº 8.112/90, o Regime Jurídico dos Servidores Civis da União, das Autarquias e das Fundações Públicas Federais. Analisaremos o princípio da segurança jurídica, por meio de suas expressões da certeza relativa e estabilidade, além disso utilizando-se das ideias de cognoscibilidade, confiabilidade e calculabilidade, e como tal princípio revela-se um instrumento de vedação ao arbítrio estatal. Serão analisados os conceitos de ilícitos e ilícitos administrativos, bem como a sanção e sanção administrativa, que são o meio pelo qual se indicam as condutas indesejadas e sua respectiva consequência jurídica. Trata-se de uma investigação sobre a idéia de responsabilidade, que é entendida, por muitos, enquanto o efeito esperado na aplicação e cumprimento de uma medida socioeducativa. Para tanto, buscou-se opiniões a respeito do tema entre os teóricos do direito da infância e adolescência no Brasil e também da psicanálise, visto que essa última refere-se a um sujeito às voltas com a Lei e o Crime e pode, pois, colaborar com a criminologia, precisamente quanto a uma certa concepção de homem e de responsabilidade. La cour penale internationale et les etats africains / The international criminal court and the african states

Vingt et un an après la création du Tribunal International pour le Rwanda et dix-sept ans après la signature du traité de Rome donnant naissance à la Cour pénale international, la fièvre dénonciatrice que connait cette institution n’est toujours pas apaisée. La CPI est-elle otage des idéaux qui justifient sa création et des forces politiques antagonistes auxquelles elle reste malgré tout liée ? Les africains commettraient-ils davantage de crime passibles de poursuites devant la Cour que les ressortissant d’autres continents ? Si l’étude des procédures judiciaires nées des crimes commis dans des conflits se déroulant sur le continent africain et l’analyse des procédures de mise en cause de certains Chefs d’Etats africains soulignent le très important travail de lutte contre l’impunité que réalise la Cour pénale internationale, le bilan de ce travail met toutefois en évidence la collision des procédures judiciaires avec des impératifs politiques internationaux. Ce travail de recherche montre que si la CPI se veut un prolongement de la sécurité collective, l’efficacité de son action et son universalisme sont aujourd’hui mise en doute, au point de cristalliser les rapports de l’organisme judiciaire international avec le continent africain. / Twenty-one year after the creation of the International Tribunal for Rwanda and seventeen years after the signing of the Treaty of Rome giving rise to the International Criminal Court, the whistleblower fever that knows this institution is still not appeased. Is the ICC hostage ideals that justified its creation and antagonistic political forces which it nevertheless remains bound? African they commit more crime prosecuted before the Court that the national of other continents? If the study of legal proceedings arising from crimes committed in conflicts taking place on the African continent and in the analysis of the party proceedings of some African Heads of States stress the very important work to fight against impunity that makes the International Criminal Court, the outcome of this work, however, shows the collision of legal proceedings with international political imperatives. This research shows that if the ICC is an expansion of collective security, the effectiveness of its action and universalism are now in doubt, as to crystallize the reports of the international judicial body with the mainland African.

Avaliar as transformações apresentadas pelo processo de Planejamento Urbano, através do instrumento do Plano Diretor, na vigência do Estatuto da Cidade é o campo em que se situa esta pesquisa; cujos resultados deverão contribuir para a discussão acerca dos alcances e limites do Plano Diretor como instrumento de planejamento urbano. De modo a formar pressupostos teóricos que fundamentem a análise dos casos, estuda-se o processo de urbanização e o histórico do planejamento urbano no Brasil; as distintas concepções assumidas pelo Plano Diretor ao longo dos anos em que se desenvolveu e consolidou a prática do planejamento urbano no Brasil; o conteúdo regulamentado pelo Estatuto da Cidade; e a região do Vale do Paraíba paulista. Por fim, a partir do estudo e análise do processo de elaboração e do conteúdo dos Planos Diretores de 2006 dos Municípios de São José dos Campos e Pindamonhangaba, no Vale do Paraíba paulista, compreendido nas etapas de Diagnóstico e Proposições, verifica-se em que medida o processo de Planejamento Urbano, através do instrumento do Plano Diretor, vem incorporando os princípios, diretrizes e instrumentos urbanísticos regulamentados pelo Estatuto da Cidade, em 2001; no sentido de enunciar uma nova concepção de planejamento e gestão territorial. / To evaluate the transformations presented by the process of the Urban Planning, through the instrument of the Master Plan, in the validity of the Statute of the City is the field where it is pointed this research; which results may contribute for the discussion about the reaches and limits of the Master Plan as an instrument of the urban planning. In order to form theories which base the analysis of the cases, are studied the process of the urbanization and the historic of the urban planning in Brazil; the distinct conceptions assumed for the Master Plan during the years in which was developed and consolidated the practice of the urban planning in Brazil; the content regulated by the Statute of the City; and the region of the Valley Paraíba paulista. From the study and analysis of the process of elaboration and of the content of the Master Plans 2006 from the cities of São José dos Campos and Pindamonhangaba, in the Valley Paraíba paulista, comprehended by the stages of Diagnostics and Proposals, it is verified how the process of the Urban Planning, through the instrument of the Master Plan, incorporates the principles, directives and urbanistics instruments regulated by the Statute of the City, in 2001; in order to enunciate a new conception of territorial planning and management.

It intends to examine the relationship between subalternity and the commission of offences. The subjects studied are juveniles residing in Guarulhos who are currently on probation. One cannot simplify the complex phenomenon that is the commission of offences by juveniles by attributing it solely to poverty or to the life conditions to which they have been submitted along with their families. What has been observed during the treatment of juveniles on probation is that the subalternity inherent in their lives is often a defining factor to their behavior. This paper aims at revealing the truth beyond first impression and determining the role of subalternity in this process as a link between the conditions of life of these juveniles and the offences committed by them. The methodology used for data collection included participatory observation, bibliographical research, documental analysis and verbal history; and for data analysis the method used was materialist-historical Dialectic with a view to uncovering the object of study / O presente projeto de pesquisa foi elaborado partindo das observações feitas na prática cotidiana no exercício da função de coordenador do Posto Grande Norte de Liberdade Assistida, da Fundação Estadual do Bem Estar do Menor FEBEM-SP. Esta pesquisa pretende analisar a relação entre a condição de subalternidade e o cometimento de ato infracional. Os sujeitos a serem pesquisados são adolescentes domiciliados no município de Guarulhos e em cumprimento da medida socioeducativa de liberdade assistida. Não podemos reduzir o fenômeno complexo que é o fato de adolescentes cometerem atos infracionais à pobreza ou somente às condições de vida a que estes jovens e suas famílias estão submetidas. Observamos no atendimento aos adolescentes em cumprimento de medida socioeducativa de liberdade assistida que a condição de subalternidade é uma realidade presente na vida destes adolescentes e de suas famílias, e, que é muitas vezes, esta posição frente à vida que determina suas atitudes. Buscaremos com esta pesquisa um desvelamento da aparência imediata, buscando determinar o papel da subalternidade neste processo como uma mediação entre a condição de vida destes jovens e o ato infracional por eles praticados. The references selected were the Children and Adolescents Statute and the Juvenile Justice Administration System in São Paulo. The field for investigation chosen was the examination of the legislation (Minors Code 1979, Children and Adolescent Statute and Penal Code) and an analysis of 42 lawsuit papers filed during 2000, at the Forum of Special Jurisdiction for Infancy and Youthful of São Paulo State Justice Court. The results obtained indicate that: a) in the Minors Code 1979, there was already an intention of socio-penal control of adolescents involved in infringement process, but its materialization was instituted by ECA; b) regarding the Minors Code, many processes of discontinuity and continuity happened with ECA, remaining still the socio-historical of capitalist society; c) ECA owns Penal Code awards to normalize the procedures of infringement acts perpetrate by adolescents; d) the administration systems of juvenile justice promotes injustice instead of justice and also facilitate the occurrence of a perverse cycle of adolescents incrimination; e) the paradigm of integral protection conceived adolescents as subjects of rights and duties, constituting the juvenile penal right, that besides establishing the adolescent right to be summoned to court , established also his possibility to be deprived of liberty and ,therefore, to suffer a penal punishment; f) the juvenile penal right was converted into minors penal right, when it did not implement the quality of processual security of a due legal process; g) there is a tutelary and operating conception of socio-educative measures for the socio-juridical practices; h) ECA sociable horizon is regulated by the plan of a conservative modernization. Such assemblage of elements drive us to a (in) conclusion that pointed over and above the juvenile socio-penal control / A tese O controle sócio-penal dos adolescentes com processos judiciais em São Paulo: entre a proteção e a punição, teve como objetivo examinar a efetivação do controle sócio-penal dos adolescentes que respondem por processos infracionais. Adotou por referência o Estatuto da Criança e do Adolescente e o Sistema de Administração da (in) Justiça Juvenil em São Paulo. Tomou-se como campo de investigação o exame das leis Código de Menores de 1979, Estatuto da Criança e do Adolescente e Código Penal e a análise de 42 autos processuais arquivados, no ano de 2000, no Foro das Varas Especiais da Infância e da Juventude do Tribunal de Justiça do Estado de São Paulo. Os resultados alcançados revelam que: a) no Código de Menores de 1979, já existia uma intenção de controle sócio-penal dos adolescentes autores de ato infracional, mas sua materialização foi instituída no ECA, com fundamentos no devido processo legal; b) no ECA, em relação ao Código de Menores de 1979, ocorreram processos de descontinuidades e de continuidades, permanecendo os determinantes sócio-históricos da sociedade capitalista; c) o ECA tem aporte do Código Penal para normatizar os procedimentos do ato infracional praticado por adolescentes; d) o sistema de administração da justiça juvenil promove injustiça ao invés de justiça bem como possibilita a efetivação de um ciclo perverso de criminalização dos adolescentes; e) o paradigma da proteção integral concebeu o adolescente como sujeito de direitos e de deveres, instituindo o direito penal juvenil. A partir deste, o adolescente pode ser responsabilizado penalmente; f) o direito penal juvenil foi transformado em direito penal de menores, quando não implementou com qualidade as garantias processuais do devido processo legal; g) existe uma concepção tutelar e operacional das medidas sócio-educativas nas práticas sócio-juridicas; h) o horizonte societário do ECA está pautado no plano da modernização conservadora. The copyright protection of musical works : a historical and contextual analysis

This work is concerned with an analysis of the copyright protection of musical works. Musical works form part of the categories of works protected under copyright law. It would be easy to dismiss musical works as not warranting a serious study, as would for example, be warranted for “industrial property” rights such as patents and geographical indicators, or more “serious” copyrights such as architectural works and computer software. Such a perspective would however, not be cognisant of the significant contribution that the music industry, as part of the broader cultural and creative industries makes to the global economy. It has, for example, been shown that in 2013, the global cultural and creative industries contributed some US$2,250b, employing some 29,5 million people, with the music industry being one of the top three employers and with its revenues exceeding those of radio.1 A single successful musician can earn in excess of US$100m per annum,2 making the industry ripe for litigious claims. For this reason therefore a consideration of the legal rules that apply to the protection of musical works is crucial. There is currently no clear exposition and systematic analysis of the legal principles applicable to the field of music copyright and no work devoted to the in-depth delineation of the rights and sub-rights relating to musical copyright protection. This study seeks to address this research and knowledge gap by providing a historical and contextual analysis of the protection of musical works. The aim is to provide a complete picture of the milieu of music copyright protection to enable the reader to feel empowered in dealing with the subject-matter. This the writer does by mapping the historical development of music copyright protection in particular from eighteenth century England when the first copyright legislation was enacted, until the enactment of the British Copyright Act of 1911, which signalled the emergence of the “common law” copyright system. The writer then shows how this enactment shaped the development of modern music copyright law, and concludes by presenting a contextual consideration of the current South African law of music copyright and highlighting the challenges it is faced with. / Mercantile Law / LL. This dissertation investigates the advantages of procuring capital-intensive infrastructure services via Public-Private Partnerships (P3s or PPPs) – cost and time savings and; innovation and high levels of efficiency – accounting for these advantages by reference to the underlying legal provisions and principles that facilitate them; and in this process highlights two significant directions in which Canadian P3 law, policy and practice has evolved – the enactment of P3 legislation and/or the formulation of non-statutory P3-related policy; as well as the establishment of legal institutions that promote and/or facilitate P3 procurements. The dissertation also addresses key arguments raised against P3s, by reference to aspects of Canadian law, policy and P3 practice. The research methodology comprises a detailed review of legal and non-legal sources. The implication of the research findings is that, given the foregoing developments in Canadian P3 law, policy and practice, the key arguments canvassed against P3s are overstated and lacking in merit.

Veiled threats? Islam, headscarves and religious freedom in America and France

For a variety of historical, cultural and political reasons, the Islamic headscarf has become an increasingly controversial matter in Europe. This is particularly the case in France, where the Parliament passed, in March 2004, a piece of legislation that prohibits students from wearing the Muslim veil—together with any other ‘conspicuous’ religious sign—in the classroom. Although Statute 228/2004 proved highly controversial and attracted unprecedented media attention, it was overwhelmingly supported by French MPs as a response to popular opposition towards religious insignia at school and was heralded as a ‘liberating’ piece of legislation that faithfully reasserted the beloved French principle of laïcité. Overseas, the new law was less favourably perceived and was often accused of being discriminatory and of violating the students’ freedom of religious expression. This thesis compares the French and American attitudes towards religious symbolism in general and the Islamic veil in particular. As in other matters, at first sight these two countries seem to adopt a very different—if not opposite—approach to religion and the Muslim veil, and so much so that their positions are often described as ‘irreconcilable’. This thesis will argue that this is hardly the case. Indeed, it will show that, at least before the passage of Statute 228-2004, the French and American legal systems adopted a substantially similar approach that appeared respectful of a veiled student’s right to wear religious insignia. This, the work will also suggest, is not surprising, for contrary to popular belief, the American conception of secularism is in many respects stricter than the French idea of laïcité, with the result that French ‘exceptionalism’ on matters of religion is hardly a convincing ground for justifying the new piece of legislation. The fundamental value of a Franco-American comparison, this work will suggest, ultimately lies with the fact that such a comparison demolishes a good portion of the popular myths surrounding the affaire des foulards: that the French legal system is fiercely secular; that the American one is strongly ‘religious’; and that France was, in 2004, confronted with a veritable ‘veil emergency’ that rendered the passage of the new statute all but inevitable.
