Les travaux ayant utilisé la théorie de la connaissance créative (Nonaka et Takeuchi,1997 ; Nonaka et al, 2001) dans un contexte d’émergence organisationnelle sontrares, notamment dans le contexte d’accompagnement par incubation. La thèses’appuie sur ce corpus théorique pour apprécier les capacités d’apprentissage d’uneméthode d’accompagnement mobilisant le modèle GRP (Génération, Rémunérationet Partage de la valeur) de Verstraete et Jouison-Laffitte (2009). Il s’agit, à la fois, derelever le contenu des apprentissages et de comprendre comment cesapprentissages se forment, se cumulent et se traduisent en compétencesentrepreneuriales. Pour ce faire, le cadre opératoire déploie une recherche-actionpragmatiste auprès de quatre cas de porteurs de projet accompagnés parl’incubateur congolais I&Fentrepreneuriat. / Very little current literature has used the theory of creative knowledge (Nonaka andTakeuchi, 1997 ; Nonaka and al one, 2001) in the context of organizationalemergence, and what is more, in the context of support for business incubation. Noresearch either has understood through the business convention deploying the GRPmodel (Generation, Compensation and value sharing) (Verstraete et Jouison-Lafitte,2009). It is not just a question of highlighting the learning content, but also have aclose look at how these learning processes are formed, accumulated and lead toentrepreneurial skills (meaning). In so doing, the methodology deploys pragmatistresearch action with four cases of project holders supported by the Congoleseincubator I & F entrepreneurship.

Cette recherche, inscrite dans le cadre du « vivre ensemble », consiste à identifier une relation entre construction de savoirs et reconnaissance mutuelle des acteurs en situation d’apprentissage. Identifier cette relation nécessite de problématiser la place du sujet scolaire éducable au « vivre ensemble » et la didactique adaptée à cette éducabilité. Déterminée par un contexte d’apprentissage de plus en plus rationalisé, la place du sujet scolaire ne lui permet plus qu’un accès au savoir ayant perdu tout sens en dehors d’une efficience indispensable aux logiques économiques et technicistes. Une autre place peut-elle permettre un autre rapport au savoir, celle d’un sujet riche de sa complexité psychologique, sociale et émotionnelle ? Ces dimensions n’impliqueraient plutôt pas un apprentissage interactif autorisant des expériences émotionnelles susceptibles d’assurer les conditions d’une reconnaissance mutuelle dans l’apprendre ? La recherche de terrain porte sur une situation interactive de lecture compréhension d’albums par un groupe identique de six enfants sur les trois ans du cycle 2. L’entretien, mené par les professeurs respectifs, se réalise selon le guide d’entretien d’un questionnement. Ce dernier a pour but de favoriser l’interprétation par le canal d’expériences émotionnelles singulières et d’aider à transformer les informations narratives en significations morales ou idéologiques comme outil de l’action de l’élève. Les outils d’analyses portent sur l’identification de l’interface des expériences émotionnelles traduites par le verbal et le non verbal des co-énonciations et leur rôle dans la reconnaissance identification et la reconnaissance mutuelle des acteurs. / The aim of this research, as part of the framework "Living Together", is to identify a relationship between the construction of knowledge and the mutual recognition of actors in a learning situation. To identify this relationship implies questioning not only the situation of the trainable school subject as to the framework "Living Together" but also the suitable didactics for this trainability. Due to an increasing rationalized learning context, the current situation only allows the school subject to acquire a knowledge which has lost all meaning beyond an efficiency dictated by economic and technical logics. Can there be a different approach to knowledge construction - that of a pupil complex and rich in psychological, social and emotional aspects? Should these dimensions not rather imply an interactive construction of knowledge, allowing for emotional experiences to ensure the conditions for mutual recognition in the learning process? The conducted field research has been based on interactive sessions of story reading to the same group of six children during three years of cycle #2. The interviews, conducted by the respective teachers, have been conducted according to the established guidelines for questioning. The purpose of the latter is to facilitate the interpretation through singular emotional experiences and to help transform narrative information into moral or ideological meanings, which can then be used as a tool by the school subject. The analytical tools focus on the identification of emotional experiences interface, through verbal and non-verbal exchanges, and their role in identity construction as well as mutual recognition of the stake holders.

Nesse sentido, nosso trabalho teve por objetivo avaliar como o PIBIC-Af colabora para a inclusão do aluno cotista e, além disso, identificar quais seriam os principais impactos positivos na formação do graduando participante do programa. O trabalho justifica-se devido à importância do sistema de cotas para a correção das desigualdades de acesso e pela necessidade de políticas inclusivas que promovam a qualidade da permanência dos alunos ingressantes do referido sistema de cotas. Nessa dissertação, foi utilizada uma abordagem metodológica qualitativa na qual foram realizadas entrevistas semiestruturadas com os docentes e discentes que participaram do programa nos editais dos anos de 2015 e 2016, o diretor e a ouvidora de Ações Afirmativas da UFJF. No caminho metodológico, também foi feito um levantamento bibliográfico acerca do tema tratado. Como referencial teórico, destacamos Beraldo e Magrone, Bourdieu e Canaan e Nogueira. O PIBIC-Af, conforme sugere a análise das entrevistas, atua como um importante instrumento didático-pedagógico de inclusão dos alunos que ingressaram por meio de cotas e também como ferramenta importante para o bom desenvolvimento acadêmico dos alunos, melhorando sua motivação, espírito crítico e capacidade investigativa, além de favorecer a assimilação de conteúdos e a construção de conhecimento. Por meio dos achados nesta pesquisa, foi elaborado um Plano de Intervenção Educacional com vistas a sugerir possíveis medidas para ampliação de iniciativas semelhantes a fim de promover o desenvolvimento dos alunos cotistas e estimular uma cultura de diversidade e inclusão. / This paper is the product of research accomplished in the master degree of Management and Evaluation of Public Education – CAED/ UFJF, with its subject matter being the Affirmative Actions politics at Universidade Federal de Juiz de For a (UFJF), focusing on the Institutional Program of Scholarships for Scientific Initiation (Programa Institucional de Bolsas de Iniciação Científica nas Ações Afirmativas/ CNPq or PIBIC-Af), since the affirmative actions aimed at quota holders, especially the ones of educational content, seem to demand more investment and new policies by the institution. In this sense, this paper aims at evaluating how PIBIC-Af collaborates for the inclusion of quota holders, as well as identifying the greatest positive impacts during the upbringing of the students who participate in the program. The study is justified given the importance of the quota system for correcting the entrance discrepancies, and by the need of inclusive policies that promote quality in the duration of the courses for those who entered university through this program. In this dissertation a qualitative methodological approach was adopted, in which semi-structured interviews were conducted with professors and students who participated in the program from the year 2015 to 2016, with the director and Ombudsman of Affirmative Actions at UFJF. Throughout the method, a bibliographic search on the addressed theme also occurred. As a theoretical reference, we highlight Beraldo and Magrone, Bourdieu and Canaan and Nogueira. The PIBIC-Af, as the interviews analysis suggests, acts firstly as an important educational instrument for the inclusion of students who entered via quota, and secondly as a tool for their academic development, improving their motivation, critical sense and investigative capacity, besides enhancing content assimilation and building knowledge. Through the findings in this research, an Educational Intervention Plan was created in order to suggest possible measures to enlarge similar efforts and promote the growth of the quota holders, as well as to assure a culture of diversity and inclusion.

Les droits de propriété intellectuelle à l'épreuve des procédures collectives / Intellectual property rights withstanding bankruptcy proceedings law

Le droit des entreprises en difficulté est une branche du droit qui se place au carrefour de disciplines juridiques aussi différentes que difficilement compatibles entre elles. Régulièrement, l'ouverture d'une procédure collective touche des droits de propriété intellectuelle représentant une importante part de l'actif des entreprises quels que soient le secteur concerné et la propriété intellectuelle en cause. Cette période donne naissance à multiples conflits d'intérêts, les conceptions qui s'y opposent bien souvent antagonistes reflètent les difficultés liées au chevauchement entre les mécanismes propres aux droits de propriété intellectuelle et ceux du droit des procédures collectives. Le droit de la défaillance des entreprises se révèle « complexe » la recherche d'un équilibre n'est pas aisée, et se traduit par une « cohabitation difficile ». L'analyse des interactions entre le droit des entreprises en difficulté et les droit de propriété intellectuelle, a permis de démêler l'enchevêtrement issu des querelles de frontières entre ces deux droits. / Bankruptcy proceedings law is a branch of law that combines different legal disciplines that as different as hardly compatible with each other. More often than not, the initiation of collective proceedings affects intellectual property rights which represent a significant part of the assets of companies whatever the sector and whatever the undertakings irrespective of the sector concerned and whatever the intellectual property in question. This period gives rise to multiple conflicts of interest insofar as the opposing views reflect the difficulties related to the overlap between the mechanisms that are specific to intellectual property rights and those that are specific to Bankruptcy proceedings law. Bankruptcy law turns out to be "complex" insofar finding out a balance is not easy and reflects in a "difficult cohabitation". The analysis of the interactions between bankruptcy law and intellectual property rights helped avoiding the entanglement that resulted from border disputes between these two legal disciplines.

The protection of monuments in Slovakia is mostly concentrated on „classical“ examples of cultural heritage (castles, historical city centers). It is not paying much attention to industrial buildings, which are important documents of national development in European context from the era of industrialization. These buildings are often also on the edge of public interest, due to their brownfield character, what places then into the great risk. Because many of these buildings are in private hands, it is often complicated to define the protection policy. It is in the interest of healthy development of society to protect cultural heritage as part of its own identity. The thesis is monitoring approaches to protection of monuments in Slovakia, as well as in global context and offers alternative approaches in terms of protection of industrial heritage.

本研究透過針對台東縣都蘭社群建造傳統竹筏所記載的民族誌,探索該社群在政府授權的美麗灣民間興建營運後轉移模式(BOT)發展案中的角色與互動。研究內容包括了(1)對民間興建營運後轉移之模式的總體回顧,以及美麗灣此個案的評估。(2)在地阿美族社群對發展計畫反對的詳細論述。(3)在替代發展方案上的建議。我的田野調查包含了在社群集會與示威抗議活動上的參與觀察,但調查的重心則立基於一條阿美竹筏建造與出海的過程。本文的結論提供了一套能夠兼顧在地居民互動及外來廠商利益的發展方案,旨在透過融合相關各方的觀點以圖能夠減少衝突並促進共同利益。 / This research explores the dimensions and interactions of the Amis community under the Miramar Resort (MR) Build-Operate-Transfer (BOT) development project authorized by the local county government through an ethnographic approach on the construction of a traditional bamboo raft in the township of Dulan, Taitung, Taiwan. The content of this study includes (1) A status review of the BOT policy in general and the MR development project in particular, (2) A detailed account of the local Amis community’s opposition to the project, and (3) Suggestion on alternative methods of land management. My fieldwork includes participant observation in the context of seminar meetings and activist demonstrations. However the centerpiece of the research at Dulan revolves around my personal participation in the construction of an Amis traditional bamboo raft and its launching into the ocean. Conclusions offer alternative ways for the development of an area that is interactive with indigenous peoples and outside commercial interests. The perspective taken is aimed at alleviating conflict through incorporating the views of stakeholders in the best interests of all parties involved.

The legal position of township developers and holders of coal-mining rights in respect of the same land

Over the past decade, the regulation of mining in South Africa has undergone a fundamental transformation in order to promote equitable access to the nation’s mineral and petroleum resources. The Mineral and Petroleum Resources Development Act 28 of 2002, drastically changed the regulation of mining by placing the nation’s mineral and petroleum resources under the custodianship of the state. The transformative objectives of resource reform, as envisaged in the Constitution of the Republic of South Africa, 1996, could however not be achieved without a measure of sacrifice -- most notably, that which had to be shouldered by the owners of the land in which the minerals are contained. Under common law, minerals vested in the owners of land and no one could compel them to extract or consent to the extraction of these minerals. Landowners were able to safeguard their land from mining activities by refusing to consent to mining. The Mineral and Petroleum Resources Development Act, 2002, changed this by providing that landowners could no longer prevent the state from granting qualifying applicants authorisation to mine. The transformative objectives of resource reform, have inevitably made great inroads into a landowner’s rights to use and enjoy his property optimally. The main focus of this study revolves around the limiting impact of South Africa’s current mineral-law dispensation on township development, and conversely, how township development impairs or limits the mining of coal. For a better understanding of the limitations which the current legislative provisions create in respect of the rights of landowners and holders of mining rights, a brief evaluation of the historical development of the right to mine coal is provided. The entitlements and reciprocal obligations of holders of mining rights and owners of the affected land are considered, and the parties’ legal remedies to resist interference in their respective rights are explored. In the process of considering possible remedies to resolve the conflict which inevitably arises, I explain why English-law principles governing lateral support (support owed by two adjacent properties [neighbour law]), and subjacent support (where the landowner may not be deprived of the vertical support his property derives from the sub-surface minerals) were incorrectly transplanted into our law. In Anglo Operations Ltd v Sandhurst Estates (Pty) Ltd, the South African Supreme Court of Appeal rejected the previously-held view that the right to subjacent support -- like the right to lateral support -- is a natural property right incidental to the ownership of the land. It was further held that conflict between holders of rights to minerals and owners of land should be resolved, not in accordance with English-law principles of neighbour law, but in terms of the law developed for rights relating to the use of servitudes. In summary, the court found that where the parties have not specifically contracted against the specific action (such as opencast or planned-subsidence mining), and provided that it was reasonably necessary for the mining right holder to use this invasive method, he may do so, so long as he does so in the manner least injurious to the entitlements of the surface owner. This decision, however, did not take into account the changes brought about by the comprehensive statutory framework of the Mineral and Petroleum Resources Development Act 28 of 2002 which I argue has replaced the earlier servitude construction. In this dissertation I consider whether possible solutions to resolve the conflict can be found in the principles relating to neighbour law, and whether the principles governing the use of servitudes remain relevant in resolving conflicts between landowners and holders of mining rights. I evaluate possible legal remedies and place special emphasis on the constitutionality of the curtailment of a landowner’s use and enjoyment of his property resulting from mining activities on or under his land. I further consider whether the exercise of a mining right, granted by the state, which results in a serious infringement of a landowner’s ownership, could in certain circumstances amount to a deprivation or possibly an expropriation in terms of section 25 of the Constitution. I discuss the position where the state’s regulatory interference is so severe that it deprives a landowner of the ability to exercise any, or a substantial portion of his ownership entitlements. I evaluate the possibility that such interference may constitute de facto expropriation for which compensation may be claimed. In the penultimate chapter I briefly mention how the relationship between landowners and holders of mining rights is managed and conflict is defused in other jurisdictions such as China, Australia, the United States of America, India, Germany and Swaziland. I conclude this dissertation with suggestions on possible ways in which the conflict may be resolved or at least minimised in future. / Die regulering van mynbou in Suid-Afrika het die afgelope dekade ‘n fundamentele verandering ondergaan ten einde breër toegang tot die nasie se minerale en petroleum hulpbronne te bevorder. Die transformatiewe oogmerk van hulpbron hervorming ingevolge die Grondwet van die Republiek van Suid-Afrika kon egter nie geskied sonder ‘n mate van opoffering nie. Die grootste aanslag van die nuwe mineraalreg bedeling word sonder twyfel gevoel deur die eienaars van grond ten opsigte waarvan mynregte deur die regering aan ‘n ander party toegeken word. Ingevolge die gemenereg was die eienaar van grond voorheen ook die eienaar van die minerale wat in die grond voorgekom het. Gevolglik was dit onder die uitsluitlike beheer van die eienaar om te bepaal of enigiemand anders die reg kon verkry om minerale op of in die betrokke grond te ontgin. Na aanvang van die inwerkingtreding van die Mineral and Petroleum Resources Development Act is hierdie posisie egter omvêrgewerp aangesien die regering voortaan die bevoegdheid het om te bepaal wie en op watter voorwaardes iemand die reg verkry om minerale te ontgin. Die toekenning van die reg om minerale te ontgin op ‘n ander se eiendom sonder die eienaar se toestemming, maak dus ernstige inbreuk op sy regte. Grondeienaars se bevoegdhede wat uit hul eiendomsreg voortvloei word in talle gevalle ernstig ingeperk ten einde die oogmerke van hulpbron transformasie te bereik. Die ondersoek wat hierna volg, is daarop toegespits om die beperkende aanslag van die regulering van steenkoolmynbou-aktiwiteite op die ontwikkeling van dorpsgebiede asook dié van die ontwikkeling van dorpsgebiedie op steenkoolmynbou beter te verstaan. Ten einde hierdie invloed beter te verstaan, word die geskiedkundige ontwikkeling van die reg om minerale in Suid-Afrika te ontgin kortliks oorweeg. Die regte en verpligtinge van die houers van mynregte en die eienaars van die grond wat deur die uitoefening daarvan geraak word, asook die remedies waaroor die onderskye partye beskik ten einde hul regte teen inbreukmaking deur die ander party te beskerm, word daarna oorweeg. In genoemde ondersoek toon ek aan waarom die Engelsregtelike burereg- beginsels van laterale steun en onderstut nie toepassing in ons reg behoort te vind nie en waarom die botsing wat ontstaan vanweë die uitoefening van die grondeienaar en die houer van ‘n mynreg se regte liefs versoen moet word deur die Suid-Afrikaanse serwituutreg beginsels toe te pas soos aangetoon in die beslissing van Anglo Operations Ltd v Sandhurst Estates. Hiedie beslissing het egter nie die veranderinge wat meegebring is deur die nuwe bedeling van die Mineral and Petroleum Resources Development Act in ag geneem nie en daar word gevolglik aangevoer dat die serwituut beginsels vervang is deur ‘n breedvoerige wetgewende stelsel. Die grondwetlikheid van die beperking op die bevoegdhede van ‘n grondeienaar om sy eiendom te gebruik en te geniet, word ondersoek, asook of daar enige gronde vir ‘n eis om skadevergoeding mag wees. In besonder word daar oorweeg of die leerstuk van konstruktiewe onteiening moontlik toepassing kan vind in gevalle waar die staat se regulering ‘n uitermatige beperkende effek het op die bevoegdhede van ‘n grondeienaar om sy eiendomsreg uit te oefen. In die voorlaaste hoofstuk ontleed ek baie kortliks hoe die verhouding tussen eienaars van grond in mynbougebiede en houers van regte om minerale te ontgin in Sjina, Australië, die Verenigde State van Amerika, Indië, Duitsland en Swaziland gereguleer word. Ter afsluiting word aandag gegee aan moontlike maniere om die belangebotsing tussen die betrokke partye uit die weg te ruim of te beperk. / Private Law / LL.M.
