Online peer-to-peer lending regulation : justification, classification and remit in UK law

Despite its benefits, online peer-to-peer lending bears the risks associated with traditional forms of institutionalised lending. However, because individuals have taken over the role of the institutional lender, and the institutional participant in this form of lending takes a step back by acting only as an intermediary between the borrowers and lenders, ordinary individuals are left to bear the type of risks that institutions have traditionally borne, but without the same means of doing so. There has been little academic analysis of the role and form that regulation should take in the regulation of peer-to-peer lending and most discussions centre on the American regulatory experience. This thesis sets out to examine the theoretical classification of online peer-to-peer lending and the theoretical and practical justifications for regulating it. The aim is to ascertain the most appropriate way to regulate peer-to-peer lending, taking into account the underlying conceptual model which underpins it. The study adopts a theoretical analysis of P2PL participants and regulation based on the concepts of consumer protection and paternalism. It includes a doctrinal analysis of the UK peer-to-peer lending legislation and regulation to identify, describe and explain the rules pertaining to the industry. It also uses a comparative approach to compare P2PL with existing forms of financial lending and similar (dis)intermediated forms of transacting between individuals to show that online peer-to-peer lending is a unique form of intermediated transaction. The thesis argues that it is important that regulation displays an understanding of the underlying conceptual framework of the business model it aims to regulate. In doing so, it also argues that the peer-to-peer lending users are more than just ‘consumers’. They demonstrate a shift in the conception of individuals from consumers to prosumers because they participate in the production side of the services they receive. It goes further than existing discussions of prosumption by positing the concept of the ‘lendsumer’ to give a more accurate account of the role and experiences of peer-to-peer lenders and the effect this has on their transactional relationships and the risks they face because of this role. Based on this analysis, the thesis shows that the UK regulatory regime has limited suitability because it lacks awareness of the underlying prosumption model of peer-to-peer lending, focusing only on the business-to-consumer aspects. Consequently, it does not resolve all the issues resulting from the tripartite, participatory nature of the peer-to-peer lending transaction. In light of these findings, the thesis proposes the regulatory use of two main concepts and highlights their implications for peer-to-peer lending regulation. The first is the ‘lendsumer’ as a new paradigm of the consumer which has implications for the regulatory protections afforded to the P2P lenders. The second is the use of gatekeeper liability, adapted to online peer-to-peer lending, as a way to affect these protections in light of the particular vulnerabilities and risks experienced by the peer-to-peer lender.

It`s blameful to do nothing. You should catch the day and its possibilities. Every second, minute and day, you have the potential to be constantly productive. Do not lose a second of time that you can use to create an imprint of your existence. Do not waste your time when you have the opportunity to create something measurably valuable. Soon you are gone and the competition is great. Doing nothing is a task that fewer and fewer are devoted to, to a lesser extent. We are expected to always be accessible and keep up to date with what is happening around us. There is a constant occupation of our sense of mind, thoughtfulness and rest is unprioritized. We try to maximize the part of our time when we are productive and active to absurdity. The goal seems to make as big imprint of our existence as possible. Fast and more is applauded until the day we burn ourselves out. In my work, I investigate passivity as backlash in a faster world, in a world where focus is on production, efficiency and results. A world where everything worth valuing is measurable. What is really a desired result and is it always possible to measure? Who really gets that gain from our fast life? Can passivity and slowness act as an activist act? Can one passively create something measurable? Is burning time perhaps our time´s most provocative act? With my work, I want to question my constant bad conscience about being insufficient and my feeling of not doing enough. If I can´t do enough, I do nothing instead. / Det är skuldbelagt att göra ingenting. Du bör fånga dagen och dess möjligheter. Varje sekund, minut och dag har du potential att vara konstant produktiv. Förlora inte en sekund av tid som du kan använda till att skapa ett avtryck av din existens. Slösa inte med din tid när du har möjlighet att skapa något mätbart värdefullt. Snart är du borta och konkurrensen är stor. Att göra ingenting är en syssla som allt färre ägnar sig åt. Vi förväntas alltid vara tillgängliga och hålla oss uppdaterade om vad som händer runt oss. Det sker ständigt en ockupation av våra sinnesintryck. Eftertänksamhet och vila prioriteras bort. Vi försöker att maximera den del av vår tid då vi är produktiva och aktiva till absurditet. Målet verkar vara att hinna sätta ett så stort avtryck av vår existens som möjligt. Snabbare och mer applåderas till den dagen då vi bränner ut oss. I mitt arbete undersöker jag passivitet som motreaktion till en snabbare värld, i en värld där fokus ligger på produktion, effektivitet och resultat. I en värld där endast det som är mätbart ges ett värde. Vad är egentligen ett önskat resultat och är det alltid möjligt att mäta? Vem är det egentligen som får vinsten av vårt snabba liv? Kan passivitet och långsamhet fungera som en aktivistisk handling? Kan man passivt skapa något mätbart? Är ”att bränna tid”  kanske vår tids mest provokativa handling? Med mitt arbete vill jag ifrågasätta mitt konstanta dåliga samvete om att vara otillräcklig och min känsla av att jag inte gör tillräckligt. Om jag inte kan göra nog så gör jag istället ingenting.

This thesis is concerned with the phenomenon of passivity in literature, particularly with how it manifests itself through actions, stagnation and means of existence of chosen literary characters and subjects. It concentrates on such figures that are inactive or apathetic, whose actions lack the clearly articulated meaning and purpose and it often seems that they vegetate rather than live an active life. The main theme is the relationship between passivity and activity and turning the passivity into a creative principle. The thesis applies the performative theory on the literary text and sees passivity of the literary characters or subjects as a means of their art performance which offers new interpretations of examining texts and the passivity in general. Methodologically the thesis is based especially on the performative theory of Erika Fischer-Lichte, but also on the anthropological research of transition rituals, theoretical concepts of mediality, John Austin's speech-act theory or on selected philosophical thesis of Maurice Merleau-Ponty and post-structuralist philosophy of Gilles Deleuze and Jacques Derrida. As primary texts for the analysis serve the short story The Overcoat (Шинель, 1842) by Nikolai Vasilievich Gogol, the novella Bartleby, the Scrivener (1853) by Herman Melville, The Book...

Penser l’être humain comme un être libre : tel est le souci constant de la réflexion de Paul Ricœur. Au niveau anthropologique, le philosophe cherche à remettre la liberté en lien avec la condition concrète de l’homme, où la nature, le corps, autrui et la société sont en jeu. Ce n’est qu’en reconnaissant une telle condition que la liberté devient réelle, affirmative et puissante. Au niveau ontologique, c’est la liberté humaine qui offre un accès privilégié à la compréhension de l’être en général. Après avoir écarté la notion de l’être comme objectivité, la liberté le dévoile comme un acte affirmatif. Au niveau méthodologique, le développement d’une herméneutique phénoménologique constitue un élément essentiel de l’ontologie de la liberté, dans la mesure où la pensée est elle-même toujours impliquée dans cette interrogation ontologique. C’est par un tel « engagement » que la pensée atteste l’être de la liberté, surtout face à l’énigme du mal. / One of the persistent concerns of Paul Ricœur’s philosophy is to reflect upon the human being as being free. At the anthropological level, Ricœur always considers freedom within concrete human condition, in which nature, body, others and society are all involved. One’s freedom becomes real, affirming and powerful only when such condition is recognized. At the ontological level, it is only as a free being that one has the privileged access to the understanding of being in general. Human as free being reveals that being should not be understood as objectivity, but as an affirming act. Finally, at the methodological level, Ricœur’s elaboration of phenomenological hermeneutics constitutes an essential element of his ontology of freedom. From his methodological development, it can be seen that the thinking philosopher himself, as a free being, is also engaged in his inquiry. In this regard, Ricœur’s philosophy as such becomes an attestation of free being, especially in his confrontation with the enigma of evil.

Durant les dernières années, la taille des systèmes ainsi que leur complexité ont pas mal évolué, entrainant le besoin d'approches distribuées pour la commande et l'aide à la décision. Cette thèse porte sur la résolution d'un problème incluant une commande distribuée et une aide à la décision, l'allocation dynamique de ressource dans un réseau.Pour résoudre ce problème, nous avons étudié un algorithme basé sur un consensus qui ne nécessite pas de calcul centralisé, et qui soit capable de traiter des applications modélisées par des systèmes dynamiques ou par des fonctions sans mémoires. La principale contribution de ce travail de thèse est d'avoir prouvé, en utilisant des outils issus de la théorie des graphes etl'analyse de la passivité, que le contrôleur atteint la solution optimale de façon asymptotique, sans obligation d'avoir une information complète.Afin d'illustrer la pertinence de notre résultat principal, plusieurs applications en ingénierie ont été étudiées, incluant la commande distribuée pour l'économie d'énergie dans des bâtiments intelligents, la gestion des clients dans un environnement de "smart grids", et le développement d'une méthode exacte d'optimisation distribuée pour un problème d'allocation de ressources soumis à des contraintes sur les bornes inférieures.Enfin, nous étudions les techniques d'allocation de ressources basées sur les modèlesde dynamique de populations. Pour les rendre distribuées, nous introduisons le concept dedynamique de populations "pas bien mélangées". Nous montrons que ces dynamiques peuventêtre utilisées pour des structures d'informations contraintes. Même si les dynamiquesde populations "pas bien mélangées" utilisent des informations partielles, ellesconservent des propriétés similaires aux dynamiques classiques qui utilisent desinformations complètes. Plus spécifiquement, la conservation de masse et la convergencevers l'équilibre de Nash sont prouvées. / Since the complexity and scale of systems have been growing in the last years, distributed approaches for control and decision making are becoming more prevalent. This dissertation focuses on an important problem involving distributed control and decision making, the dynamic resource allocation in a network. To address this problem, we explore a consensus--based algorithm that does not require any centralized computation, and that is capable to deal with applications modeled either by dynamical systems or by memoryless functions. The main contribution of our research is to prove, by means of graph theoretical tools and passivity analysis, that the proposed controller asymptotically reaches an optimal solution without the need of full information. In order to illustrate the relevance of our main result, we address several engineering applications including: distributed control for energy saving in smart buildings, management of the customers of an aggregating entity in a smart grid environment, and development of an exact distributed optimization method that deals with resource allocation problems subject to lower--bound constraints. Finally, we explore resource allocation techniques based on classic population dynamics models. In order to make them distributed, we introduce the concept of non--well--mixed population dynamics. We show that these dynamics are capable to deal with constrained information structures that are characterized by non--complete graphs. Although the proposed non--well--mixed population dynamics use partial information, they preserve similar properties of their classic counterpart, which uses full information. Specifically, we prove mass conservation and convergence to Nash equilibrium. / Dado que la complejidad y la escala de los sistemas sehan ido incrementando en los últimos años, las técnicas centralizadas de control y toma de decisiones están siendo reemplazadas por métodos distribuidos. Esta tesis se centra en un importante problema que involucra control y toma de decisiones distribuidas: la asignación dinámica de recursos en redes. Para abordar este problema, exploramos un algoritmo basado en consenso que no requiere computación centralizada, y que puede ser usado en aplicaciones modeladas ya sea por sistemas dinámicos o funciones sin memoria. La principal contribución de esta tesis es probar, por medio de teoría de grafos y pasividad, que el algoritmo propuesto alcanza asintóticamente una solución óptima sin la necesidad de usar información completa. Para ilustrar la relevancia del resultado principal de esta disertación, abordamos varias aplicaciones en ingeniería,incluyendo: el control distribuido en edificios inteligentes orientado a la eficiencia energética, la gestión de los clientes de un agregador en una red inteligente en la que se aplican estrategias de respuesta de la demanda, y el desarrollo de un método de optimización exacto que permite incluir restricciones de límite inferior. Finalmente, se exploran otras técnicas de asignación derecursos inspiradas en modelos de dinámicas poblacionales. Se introduce el concepto de poblaciones no—bien—mezcladas, y se muestra que las dinámicas asociadas a este tipo de poblaciones cuentan con una estructura de información local, caracterizada por grafos que no son completos. A pesar de que las dinámicas propuestas usan información parcial, ellas preservan características similares a las dinámicas poblacionales clásicas que usan información completa.

Marken är något fundamentalt. Jag dras till att skapa hålrum och att gjuta av dem. Låta händerna leda. Det är något som attraherar mig med att inte riktigt kunna föreställa mig formen av hålrummet i tanken, att det är ett glapp i överföringen mellan händernas rörelser och tankens. Att värdera det definierade högre än det odefinierade, vill jag lägga i en parantes.  Vi använder språk som materia, vi bygger betydelser, rum som skapar sammanhang, stödkonstruktioner, konstruktion som är dikt, som är en rörelse som är jord som är ett arbete som är sten som är en förflyttning som är trä som är en handling som är metall som är nära intill, att skulptera en tanke. Det är idén om att kroppen har en korrekt form som gör kroppen korrupt. Den brutna cirkeln är på ett sätt en helhet av två korrupta kroppar. Kategorier och definitioner är något verkligt, oavsett hur de är skapade eller kommit till. Vi uppmärksammar genast om något är konstigt. Två enheter som vi uppfattar som separata, är separata. Om de inte varit separata skulle vi uppfattat de som ett och inte som två. Det här ser vi omedelbart. Om vi inte är i ett främmande sammanhang med främmande definitioner, men då kommer säkerligen någon ganska snart att uppmärksamma oss på hur saker hänger ihop. Människor är hjälpsamma på sådant sätt. / My work may be described as bordering between sculpture and installation, intuitive and conceptual, it could in a way be seen as a broken circle, as one, but i will work hard to make the two entities, the two seemingly half circle shaped entities, to be separate, to be two.  I will assert they are one work but also not, I will assert their indepencence, they are two. The bridge, the connection, will (or will not) happen in the thought, not by sight. There will be no side-by-side, object dialog in near space, rather association through memory and through distance. Like an object or some kind of occurence is planted early on in a movie and then reoccurs later on with the purpuse to further the understanding of course of events.  We tend to read two half circles near each other as a whole circle. Robert Morris made two half circles with only a thin lit gap underlining their distinct form, but at the same time dissolving them as a broken circle. It is the idea of of a correct body that makes a body corrupt. The broken circle is in a way the whole of two corrupt bodies.

Il est bien connu que la synchronisation de l’activité oscillatoire dans les réseaux de neurones joue un rôle important dans le fonctionnement du cerveau et pour le traitement des informations données pas les neurones. Cette thèse porte sur l’analyse de l’activité de synchronisation en utilisant des outils et des méthodes issues de la théorie du contrôle et de la théorie de la stabilité. En particulier, deux modèles ont été étudiés pour décrire l’activité oscillatoire des réseaux de neurones : le modèle de Kuramoto et le modèle de Hindmarsh-Rose. Une partie de ce manuscript est consacrée à l’étude du modèle de Kuramoto, qui est un des systèmes les plus simples utilisé pour modéliser un réseau de neurones, avec une connexion complète (all-to-all). Il s’agit d’un modèle classique qui est utilisé comme une version simplifiée d’un réseau de neurones. Nous construisons un système linéaire qui conserve les informations sur les fréquences naturelles et sur les gains d’interconnexion du modèle original de Kuramoto. Les propriétés de stabilité de ce modèle sont ensuite analysées et nous montrons que les solutions de ce nouveau système linéaire convergent vers un cycle limite périodique et stable. Finalement, nous montrons que contraint au cycle limite, les dynamiques du système linéaire coïncident avec le modèle de Kuramoto. Dans une seconde partie, nous avons considéré un modèle de réseau de neurones plus proche de la réalité d’un point de vue biologique, mais qui est plus complexe que le modèle de Kuramoto. Plus précisément, nous avons utilisé le modèle de Hindmarsh-Rose pour décrire la dynamique de chaque neurone que nous avons interconnecté par un couplage diffusif (c’est à dire linéaire). A partir des propriétés de semi-passivité du modèle de Hindmarsh- Rose, nous avons analysé les propriétés de stabilité d’un réseau hétérogène de Rindmarsh-Rose. Nous avons également montré que ce réseau est pratiquement synchronisé pour une valeur suffisamment grande du gain d’interconnexion. D’autre part, nous avons caractérisé le comportement limite des neurones synchronisés et avons établi une approximation de ce comportement par une moyenne des dynamiques de tous les neurones. / It is widely recognized that rhythmic oscillatory activity in networks of neurons plays an important role in the brain functionning and a key role in processing neural information. This thesis is devoted to the analysis of this synchronized activity by using tools and methods issued from automatic control and stability theory. Two models are used to describe oscillatory activity of neural networks : Kuramoto model and network of Hindmarsh-Rose neurons. First, we consider Kuramoto model with complete (all-to-all) coupling, which is one of the simplest systems used to model neural network. For this model we construct an auxiliary linear system that preserves information on the natural frequencies and interconnection gains of the original Kuramoto model. Next, stability properties of this model are analyzed and we show that the solutions of the new linear system converge to a stable periodic limit cycle. Finally, we show that constrained to the limit cycle, dynamics of the linear system coincide with the original Kuramoto model. Second, a model for the network (population) with a better behavior, with respect to the Kuramoto model, from a biological point of view but more complex is considered. Particularly, we consider a network of diffusively coupled neurons where we use a Hindmarsh-Rose model to describe the dynamics of each individual neuron. Based on semi-passivity of individual Hindmarsh-Rose neurons, we analyse stability properties of a heterogeneous network of such neurons and show that network is practically synchronized for sufficient large values of interconnection gains. Moreover, we characterize the limiting synchronized behavior by using an averaging of all neuron dynamics.

Uncovering The Sub-Text: Presidents' Emotional Expressions and Major Uses of Force

The global context of decision making continues to adapt in response to international threats. Political psychologists have therefore considered decision making processes regarding major uses of force a key area of interest. Although presidential personality has been widely studied as a mitigating factor in the decision making patterns leading to uses of force, traditional theories have not accounted for the emotions of individuals as they affect political actions and are used to frame public perception of the use of force. This thesis therefore measures expressed emotion and cognitive expressions in the form of expressed aggression, passivity, blame, praise, certainty, realism, and optimism as a means of predicting subsequent major uses of force. Since aggression and blame are precipitated by anger and perceived vulnerability, they are theorized to foreshadow increased uses of force (Gardner and Moore 2008). Conversely, passivity and praise are indicative of empathy and joy respectively, and are not expected to precede aggressive behavior conducted to maintain emotional regulation (Roberton, Daffer, and Bucks 2012). Additionally, the three cognitive variables of interest expand on existing literature on beliefs and decision making expounded by such authors as Walker (2010), Winter (2003) and Hermann (2003). DICTION 6.0 is used to analyze all text data of presidential news conferences, candidate debates, and State of the Union speeches given between 1945 and 2000 stored by The American Presidency Project (Hart and Carroll 2012). Howell and Pevehouse's (2005) quantitative assessment of quarterly U.S. uses of force between 1945 and 2000 is employed as a means of quantifying instances of major uses of force. Results show systematic differences among the traits expressed by presidents, with most expressions staying consistent across spontaneous speech contexts. Additionally, State of the Union speeches consistently yielded the highest scores across the expressed traits measured; supporting the theory that prepared speech is used to emotionally frame situations and setup emotional interpretations of events to present to the public. Time sensitive regression analyses indicate that expressed aggression within the context of State of the Union Addresses is the only significant predictor of major uses of force by the administration. That being said, other studies may use the comparative findings presented herein to further establish a robust model of personality that accounts for individual dispositions toward emotional expression as a means of framing the emotional interpretation of events by audiences.
