A eficácia da regulação prudencial, no sentido de manter o sistema financeiro saudável, depende do modelo de ciclo econômico considerado na sua elaboração, na medida em que estes afetam os valores dos ativos que compõem os balanços e os passivos contingentes das instituições financeiras. La régulation bancaire doit être vue comme le fait d'encadrer et de contrôler l'activité bancaire, en la soumettant au respect des diverses normes, pour en maîtriser les risques afin de préserver la sécurité des déposants, la stabilité du système financier et les grands équilibres économiques. Pour arriver à cette fin, la régulation bancaire s'appuie essentiellement sur la réglementation et la supervision.Les systèmes bancaires domestiques étant devenus de plus en plus interdépendants, il apparaît nécessaire de faire face aux menaces de la même manière, de façon coordonnée au niveau international ou, à tout le moins, au niveau régional. C'est ainsi que la CEMAC et l'UEMOA se sont dotés au lendemain des crises de 1990 d'un dispositif de régulation marqué par une pléthore de réglementations et des organes de supervision communautaires. Depuis la crise de la dette survenue en Europe, la régulation de l'activité bancaire a évolué dans cette région avec la création de l'Union bancaire. Ceci dit, la supervision des établissements bancaires a été confiée à la Banque Centrale Européenne au sein de l' UE bien qu'elle demeure partagée avec les autorités nationales. Il s'agira pour nous, dans le présent travail, de comparer les dispositifs de régulation en vigueur dans les régions de la CEMAC, de l'UEMOA, de l'UE. On verra comment les régions de l'Afrique Centrale , de l'Afrique de l'Ouest et de l'Europe organisent la régulation bancaire en vue de préserver la stabilité des banques. Pour y parvenir il faudra comparer les différents organes chargés de la régulation et les principales règles de régulation qui existent dans ces régions. / Banking regulation should be seen as the act of monitoring and controling banking, by subjecting the compliance with various standards to control risks to preserve the security of depositors , the stability of the financial system and major economic balances. To achieve this, the banking regulation is based mainly on regulation and supervision. Domestic banking systems have become increasingly interdependent, it is necessary to deal with threats in the same way , in a coordinated manner at the international level or at least at the regional level . Thus CEMAC and UEMOA have adopted in the aftermath of the 1990 crisis a control device marked by a plethora of regulations and community oversight bodies . Since the debt crisis in Europe, the regulation of banking has evolved in this region with the creation of the banking union . That said, the supervision of banks has been entrusted to the European Central Bank within the EU although it remains shared with the national authorities.In the course of this work, our task will be to compare the existing control devices in the CEMAC region , UEMOA , EU . We shall review and find how the regions of Central Africa, West Africa and Europe organize banking regulation in order to preserve the stability of their banks. To achieve this goal, a comparison of the various bodies responsible for the regulation and the main regulatory rules that exist in these regions are deemed necessary.

De la gestion du ratio de solvabilité bancaire : Étude empirique des ajustements prudentiels relatifs à la juste valeur / Capital Adequacy Ratio Management : An empirical study of prudential fair value adjustments

Dans l'industrie bancaire, plusieurs études ont montré l'existence de la gestion du ratio de solvabilité. Toutefois, elles se sont focalisées pour l'essentiel sur la manipulation des provisions et avancent généralement que la gestion du ratio de solvabilité est mise en œuvre en vue d'éviter les coûts réglementaires associés à un ratio inférieur au seuil minimum. Notre thèse examine la pratique de gestion du ratio de solvabilité à travers les ajustements prudentiels qui sont des retraitements que la banque doit opérer pour passer des fonds propres comptables aux fonds propres réglementaires. Les ajustements prudentiels sont composés de déductions et de filtres prudentiels destinés à atténuer l'impact de la volatilité des fonds propres induite par la juste valeur liée à l'application des IFRS. Adoptant une démarche diachronique et une approche instrumentale, l'étude se base sur un échantillon de banques européennes et utilise des méthodes de régression par données de panel, ainsi que des tests de robustesse tels que le bootstrap et la régression quantile. Le principal apport de cette thèse est de montrer que la transformation de l'information comptable en information réglementaire passe par les ajustements prudentiels qui constituent un pont sur lequel une gestion opportuniste du ratio de solvabilité peut être effectuée à travers des variables relatives à la qualité du capital et à la performance opérationnelle de la banque. L'étude montre que la gestion du capital n'est pas l'exclusivité des banques présentant un ratio faible. Enfin, elle permet de ne plus considérer le ratio de solvabilité comme une boîte noire et de l'examiner à travers ses composantes. / Through Earnings Management practices applied to banking industry, several studies have shown existence of Capital Adequacy Ratio Management (CARM). However, they are mainly focused on loss loan provision (LLP) manipulation's and suppose that Capital adequacy ratio management motivation is to reduce regulatory costs imposed when the bank's capital adequacy ratio falls below the minimum. This thesis deals with the possibilities of banks to manage the regulatory ratio via the prudential adjustments, which are corrections made to equity items in the statement of financial position, to safeguard the quality of the supervisory capital and to reduce potential volatility induced by fair value accounting (application of IFRS). Adopting diachronic and instrumental approaches, the study is based on a sample of European banks and uses regression methods by panel data and bootstrap and quantile regression as post estimation and robustness tests. The main contribution of this thesis is to show that the necessary transformation of accounting information into regulatory information by prudential adjustments constitutes a bridge on which a timely CARM could be carried out through variables relating to the quality of the capital and the operational performance of the bank. Furthermore, the results show that CARM is not exclusively dedicated to banks with ratio close to minimum. Finally the results make possible to no longer consider the capital adequacy ratio as a black box and to examine it through its components.

Pour le superviseur, une approche historique de la banque permet de mieux assimiler ses modes de fonctionnement. Elle sert aussi à mieux comprendre pourquoi ses acteurs, toujours dotés, à raison, de la confiance indispensable au développement des affaires, font preuve parfois d’un sur-optimisme conduisant à leur ruine. La mobilisation du droit : telle est ce qui guide l’action du contrôleur de banque. La dernière crise financière a provoqué une prise de conscience en Europe : l’impossibilité pour chaque pays membre de l’Union d’exercer individuellement une surveillance efficace sans une harmonisation totale. Ainsi est née l’idée puis la construction du MSU. Centralisée à Francfort, la supervision unique est en place depuis le 4 novembre 2014. Mais sa feuille de route porte sur un champ plus diversifiable encore. Par construction, le MSU possède les qualités d’efficacité et de pérennité requises. Mais aura-t-il la volonté de contribuer à la transformation de toute l’Union européenne en zone de supervision optimale ? / For the supervisor, an historical approach of banks allows to better assimilate its ways of functioning. She also serves to better understand why her actors, always endowed of the confidence to develop business, sometimes, show an over-optimism leading to their ruin. The 2007-2008 crisis has provoked awareness in Europe: the impossibility for every member state of the Union to exercise individually an effective supervision without a total harmonization. So was born the construction of the MSU. Located in Frankfurt, the “supervision unique” has been working since November 4th, 2014. But the road map assigned to the supervision a new and more diversifiable field. For sure, the MSU is skilled enough, but is there a will to change the European Union into a “zone de supervision optimale”?

La préservation du système bancaire par la régulation : l'exemple du système bancaire comorien / The preservation of the banking system by regulation : the example of the Comorian banking system

Cette Thèse de sciences de gestion, se propose d’élucider les difficultés que rencontrent les acteurs du système bancaire comorien et apporter des solutions afin de lui garantir sa solidité, stabilité et enfin sa pérennité. Elle est divisée en deux parties. La première porte plus particulièrement sur le cadre national et internationale du système bancaire comorien. La deuxième met en évidence les banques comoriennes confrontées à la transparence financière et aux exigences de supervision prudentielle. Le premier titre de la première partie, tâche à mettre en lumière l’organisation actuelle du système bancaire comorien inspiré du modèle français (chapitre 1) et l’apport du développement récent de la finance islamique (chapitre 2) afin de combler le retard de la banque conventionnelle. La réorganisation de la Banque Centrale des Comores et la mise en place de la banque islamique locale, peuvent contribuer au changement radical du système bancaire comorien. Le deuxième titre, permet au régulateur et prêteur en dernier ressort (Banque Centrale des Comores) de prendre le modèle des normes prudentielles internationales proposées par le Comité de Bâle (Bâle II et III), pour réguler le système bancaire comorien afin de lui garantir sa solidité, stabilité et enfin sa pérennité (chapitre 1). A travers ces recommandations du comité de Bâle, nous avons apporté des solutions en élaborant la Matrice Msahazi Credit Scoring Corporation, destinée aux analyses des données des banques comoriennes contre un risque endogène (Chapitre2). Nous avons aussi élaboré d’autres matrices que les banques comoriennes se serviront pour la notation interne, des risques de contreparties (entreprises et particuliers) afin de lutter contre le risque exogène. La deuxième partie de cette Thèse suggère deux autres solutions : la première est l’exigence de transparence financière des banques comoriennes (Pilier 3 : Bâle2 et 3) afin de lutter contre les malversations financières orchestrées par certains agents (titre I). Le premier chapitre introduit l’objectif de la communication financière de manière générale et la manière dont le comité de Bâle (Bâle 2 et 3) recommande les banques de communiquer leurs informations financières (méthodes d’évaluations des risques et fonds propres). Le deuxième chapitre propose aux banques comoriennes et aux autorités de contrôles, les techniques de notation financière pratiquées au niveau internationale pour distinguer le niveau de solvabilité de la contrepartie. La deuxième solution, nous avons donné à la Banque Centrale des Comores, des techniques pour renforcer la supervision prudentielle (Pilier 2, Bâle 2 et 3), (titre II). Le premier chapitre exige d’une part la direction et le conseil d’administration de la banque de définir les techniques de contrôles, d’indentifications, d’évaluations, gestions des risques et les objectifs de fonds propre à atteindre. D’autre part, l’autorité de contrôle (Banque centrale des Comores) doit passer au crible tous ces outils de contrôle. Au deuxième et dernier chapitre de la recherche, nous avons proposé à la Banque Centrale des Comores des nouvelles méthodes de supervision prudentielle afin de garantir la solidité, stabilité et pérennité du système bancaire. Nous avons l’espoir que l’ensemble de ces suggestions contribueront à préserver la solidité, stabilité et pérennité du système bancaire comorien afin de financer le développement de l’économie comorienne et sortir le pays de la pauvreté. / This thesis on busness management, aims to elucidate the difficulties faced by the stakeholders of the Comorian banking system and to provide solutions to ensure its soundness, stability and sustainability. The thesis is divided into two parts. The first focuses specifically on the national and international context of the Comorian banking system. The second, highlights how the Comorian banks should adapt to the financial transparency and prudential supervision requirements. The first title of the first part, tries toshed light on the current organization of the Comorian banking system based on the French model (Chapter 1) and the contribution of the recent development of Islamic finance (Chapter 2) to close the gap in conventional banking. The reorganization of the Central Bank of the Comoros and the establishment of the local Islamic bank can contribute to a radical change in the Comorian banking system. The second title allows the regulator and lender of last resort (Central Bank of the Comoros ) to take the model of international prudential standards proposed by the Basel Committee (Basel II and III) to regulate the Comorian banking system in order to guarantee its soundness, stability and finally sustainability (Chapter 1). Through these recommendations of the Basel committee, we have provided solutions by developing Msahazi Credit Scoring Matrix Corporation, intended to analyse data of Comorian banks against endogenous risk (Chapter 2). We have also developed matrices other than Comorian banks used for internal rating of the counterparty risk (companies and individuals) to fight against exogenous risk. The second part of this thesis suggests two alternatives: the first is the requirement of financial transparency for Comorian banks (Pillar 3: Basel Conventions 2 and 3) in order to fight against embezzlement orchestrated by certain agents (Title I). The first chapter introduces the objective of financial reporting in general, and how the Basel Committee (Basel 2 and 3) asks banks to disclose their financial information (methods of risk assessments and equity). The second chapter provides credit rating techniques practiced at international level to the Comorian banks and supervisory authorities in order to distinguish the level of creditworthiness of companies and clients concerned. The second alternative we have given to the Central Bank of the Comoros is the techniques for strengthening prudential supervision (Pillar 2, Basel 2 and 3), (Title II) . The first chapter requires both the management and the bank's board of directors to define control techniques, identifications, assessments, risk managements and core capital goals. On the other hand, the supervisory authority (Comoros Central Bank) has to go through all these control tools. In the second and final chapter of the research, we propose to the Central Bank of the Comoros new prudential supervision methods to ensure the soundness, stability and sustainability of the banking system. We hope that all of these suggestions will help to preserve the soundness, stability and durability of the Comorian banking system in order to finance the development of the Comorian economy and lift the country out of poverty.

L'évolution du cadre institutionnel de la régulation prudentielle / The evolution of institutional framework of prudential supervision

Avec l’annonce de la création d’une Union bancaire européenne, l’évolution du cadre institutionnel de la régulation prudentielle est actuellement au coeur des débats politiques. Le projet de réforme prévoit la dévolution d’une importante partie du contrôle prudentiel des entreprises financières à la Banque centrale européenne. Les conflits d’intérêts potentiels susceptibles d’être générés dans le cadre de la détermination de la politique monétaire et de la mise en oeuvre du contrôle prudentiel ont souvent été mis en exergue par les détracteurs du modèle de régulation intégré aux institutions d’émission. Cependant, les influences réciproques ainsi que la complémentarité tenant à l’exercice des missions de stabilité monétaire et de stabilité financière par le banquier central pourraient tendre à justifier l’adoption de telles mesures. La concentration des pouvoirs monétaires et prudentiels dans le giron des banques centrales impliquerait néanmoins pour ces dernières de répondre au principe de la légitimité démocratique, cela tout en conservant un certain degré d’indépendance à l’endroit du pouvoir politique. La conciliation de ces deux exigences semblerait nécessaire dans l’hypothèse où les banques centrales se verraient amenées à exercer un rôle croissant au sein de la sphère financière. Plus largement, c’est peut-être dans la recherche de cet équilibre que réside le secret de la conception d’un cadre institutionnel optimal dans le domaine de la régulation monétaire et financière. Les insuffisances dénoncées des modèles de supervision pourraient-elles ainsi se voir pallier par l’institution d’un Système mondial de banques centrales en charge du contrôle prudentiel ? / With the announcement of the creation of an European banking union, the evolution of institutionnal framework of prudential supervision is currently at the center of political debates. The draft reform provides for the devolution of a significant part of prudential supervision of financial enterprises to the European central bank. The potential conflicts of interest which might be generated in the framework of the determination of monetary policy and the implementation of prudential supervision have often been underlined by critics of the integrated regulatory model within issuing institutions. However, both reciprocal influences and complementarity in the exercice of the missions of monetary stability and financial stability by the central banker might tend to justify the adoption of such measures. The concentration of monetary and prudential powers within central banks would imply, though, for those latter to satisfy the principle of democratic legitimacy, this while keeping some degree of independence from the political power. The conciliation between these two requirements would seem necessary assuming that central banks would be set to exercise an increasingly important role within the financial sphere. More extensively, perhaps the secret of the design of an optimal institutionnal framework in the area of financial and monetary supervision lies in the search for this balance. Might insufficiencies highlighted in supervisory models be overcome by setting up a world system of central banks in charge of prudential supervision?

La préservation de la bonne santé du secteur bancaire a toujours été au cœur des préoccupations de la profession bancaire mondiale. La lutte contre le blanchiment des capitaux constitue un moyen pour les banquiers de préserver cette santé. En effet, les banques camerounaises et françaises bien qu’assujetties à la lutte contre le blanchiment des capitaux, ont plus d’un intérêt à mettre en œuvre le dispositif préventif anti-blanchiment. D’une part, au niveau organisationnel, les banques camerounaises et françaises se sont dotées d’un service anti-blanchiment et de dispositifs informatiques qui veillent à stopper leur utilisation à des fins de blanchiment de capitaux. Au plan fonctionnel, les obligations de vigilance imposées aux banques au titre de la lutte contre le blanchiment des capitaux rejoignent et renforcent les règles bancaires déjà instaurées en vue d’une saine pratique des activités bancaires. Cependant, le dispositif préventif anti-blanchiment n’a pas été bien accueilli au sein de la profession bancaire. Pour cause, celui-ci s’attaquait à des principes chers à la profession bancaire notamment, le secret bancaire et le devoir de non-ingérence. De même, la mise en œuvre du dispositif a fait naître de nouvelles obligations dont la violation fait l’objet de sanctions. / The preservation of the good health of the banking sector has always been at the heart of the concerns of the world banking community. The fight against money-laundering is a way for bankers to preserve this health. Indeed, French and Cameroonian banks though assujetties subject to the fight against money-laundering have more than one interest to implement operative preventive anti-money laundering. Firstly, at the organizational level, Cameroon and French banks have an anti-money laundering service and computer devices that shall stop their use for the purpose of money-laundering. Functionally, the vigilance obligations imposed on banks in respect of the fight against money-laundering join and strengthen banking rules already implemented in practical with a healthy level of banking activities. However, operative preventive anti-money laundering is not well-received within the banking profession. For cause, it was attacking principles dear to the banking profession in particular, secrecy and the duty of non-intervention. Similarly, the implementation of operative has brought new obligations whose violation is the subject of sanctions.

Separation of powers and the political question doctrine in South Africa : a comparative analysis

Section 34 of the Constitution of the Republic of South Africa, 1996 outlines the scope of judicial authority as encompassing the resolution of any dispute that can be resolved by the application of law. The courts in South Africa have developed several justiciability canons that restrain when courts may adjudicate disputes, such as standing, mootness, ripeness, and the prevention of advisory opinions. These justiciability canons emanate from constitutional considerations such as respect for separation of powers and the proper role and scope of judicial review in a constitutional democracy. This study focuses on another justiciability canon - the political question doctrine. This doctrine arises from the principle of separation of powers and, in the main, provides that certain questions of constitutional law are allocated to the discretion of the elected branches of government for resolution. As a result, such questions are non-justiciable and require the judiciary to abstain from deciding them because not doing so intrudes into the functions of the elected branches of government. The underlying theme is that such questions must find resolution in the political process. Through a comparative lens, the study examines the origins and current application of the political question doctrine in selected countries with a view to obtain lessons therefrom. It examines the origins of the doctrine, by placing particular emphasis on the early application of the doctrine by the US Supreme Court. The study also examines the modern application of the doctrine in the constitutional jurisprudence of several countries, including Ghana, Uganda and Nigeria. It advances the view that while the doctrine exists in the South African jurisprudence, the Constitutional Court should articulate and develop it into a clear doctrine taking into account lessons from those countries. The study offers some recommendations in this regard. The study submits that the political question doctrine is an appropriate legal mechanism through which the South African judiciary can address the recent problem of the proliferation of cases brought to the courts that raise non-justiciable political questions and threaten to delegitimize the role of the courts in a democracy. / Public, Constitutional and International Law / LL. The effects of financial liberalisation in emerging market economies

The aim of this research is to show the effects of financial liberalisation on emerging market economies, how these economies removed restrictions on financial institutions so that they can be globally integrated, and to show the flow of international finance in and out of a country. This research also illustrates how the financial system in these economies moved from being government-led to being market-led. The main finding of this research is that many countries failed to reap the benefits of liberalisation because of weaknesses in the regulatory structure, undercapitalised banks, volatile markets and contagion effects. The research concludes that the long-term gains of liberalisation certainly supersede short-term instability of liberalisation. Thus, for financial liberalisation to have predominantly positive effects, attention should be drawn to the importance of a more prudent regulatory and supervisory environment. Furthermore, financial liberalisation must be accompanied by a sound institutional infrastructure, proper conduct of monetary and fiscal policies, a reduction in corruption, and an increase in transparency. 近年來,國內金融問題層出不窮,陸續發生多起的金融弊案,皆有引發金融危機之可能。因此如何強化金融監理效能,建立金融市場之安定與秩序,實為金融革新的重要議題。 世界上多數國家的金融監理架構有單一監理機關與多數監理機關,甚至折衷於二者之方式。我國目前金融市場中因金融商品之區隔性降低、金融購併與金融集團之出現、效率監理原則、及因應WTO的加入考量,究竟如何調整金融監理架構以強化金融監理效能,實為當務之急。因此,政府希冀成立金融監督管理委員會,以有效整合金融發展政策及監理事權,全面加速金融現代化工程,因應未來國際金融競爭趨勢。 而本文,以「論金融統合監理之架構」為題,試圖先對我國現行金融監理架構做一剖析;其次針對單一監理架構—以英國金融服務管理局(Financial Service Authority)、澳洲金融監理總署(Australian Prudential Regulation Authority)、韓國金融監理局(Financial Service Supervision)為介紹;在其次亦就多數監理架構為論述—以美國的金融監理架構為題;繼而對於我國未來金融監理架構—以現行的行政院金融監督管理委員會組織法草案為介紹;最後做一評析與建議。 / In the last decade, Taiwan has experienced several financial institutions scandals and a local financial crisis has almost emerged. Under such a circumstance, it is essential for the Government to undertake regulatory reform in order to enhance the regulatory efficiency and reinstate the social confidence toward the financial markets. To cope with the entrance into WTO, the trend of financial liberalization, the emergence of financial conglomerates, it seems crucial for Taiwan to reconstruct the regulatory framework to promote the regulatory effectiveness and efficiency. Under such a scenario, the Government intends to establish a new regulatory agency, i.e. the Financial Regulatory Committee, to regulate financial institutions in a consolidated approach. The main theme of this paper focuses on the issue of the consolidation in financial regulatory structure. In the first place, the current financial regulatory mechanism in Taiwan is addressed and the potential inefficiency is identified. Secondly, some models of the single-regulator approach are examined, including the Financial Services Authority of UK, the Australian Prudential Regulatory Authority and the Financial Services Supervision of South Korea. On the other hand, the US model, the most significant one in the multiple-regulator approach, is also envisaged in the third place. Fourthly, the draft of Financial Regulatory Committee Bill of Taiwan is examined and the potential failures therein are explored. As possible contribution to the financial regulatory reform in Taiwan, some conclusive remarks and suggestions are submitted in the final place.
