Semi-liberty is a juridical term used to appoint a modality of socio-educational measure of adolescent responsibility for their infractions, according to the brazilian Statute of Children and Adolescents (ECA Estatuto da Criança e do Adolescente) from 1990. This measure, according to the current legislation, consists in adolescent permanence in a house during a period from 6 months to 3 years, under the supervision and monitoring of a professional team with compulsory schooling and professionalization. One of the questions in this process is the relation between the functioning of the measure from its institutional (structure and organization) and intersectoral (organization and articulation with other public policies) strategies and the results of those actions in the life of these adolescents. Therefore, it was proposed to investigate the performance of institutional and intersectoral processes adopted by the semi-liberty socio-educational measurement developed in Foz do Iguassu, in the state of Paraná, focusing on institutional arrangements, behaviors, objectives of political actors, in the action tools and the institutional and intersectoral policy strategies. Starting from a qualitative, exploratory study, it was sought to perform pertinent questionings to the disciplinary power and to the society of control, respectively problematized by Michel Foucault and Gilles Deleuze. The theoretical discussion was coordinated with the experiences testified by the researcher and those reported by professionals of the House of Semi-liberty of Foz do Iguassu, in Paraná, added to the analysis of documents containing information about the socio-educational process of the attended adolescents and its consequences. The analysis of these experiences aimed to understand the existence of the object, its functioning correlated with the historical movement, a view not merely textual, but relational, discursive, in order to preserve the social unity and establish relations among the content - which appears -, the rules and the delimitations. The experiences and the objective data found on the functioning of semi-liberty indicate the transition movement of strategies interconnected to the control, disciplinary society according Foucault (2012f) and Deleuze (2010). The research focuses on the institutional and intersectoral strategies that combine the new to the old public policy model in the area of childhood and adolescence, interconnecting practices and political conceptions of the Children's Code to the Statute of Children and Adolescents . Practices in favor of the subject of universal law , that does not leave the idea of a dangerous subject on the job with the adolescent who commits an infraction. And, in this context, becomes a laboratory building new power relations, controlling and watching these adolescents to the model of life proposed by the democratic, participatory and inclusive society. / Este estudo objetiva refletir sobre o funcionamento institucional da semiliberdade, seus limites e suas possibilidades, a partir da problematização dos dados do caso em estudo com os dados nacionais e a análise sobre a proposta socioeducativa vigente. Entende-se semiliberdade como um termo jurídico usado para designar uma modalidade de medida socioeducativa, de responsabilização de adolescentes sobre seus atos infracionais, conforme Estatuto da Criança e do Adolescente (ECA), de 1990. Tal medida, conforme legislação vigente, consiste na permanência do adolescente em uma casa, por um período de 6 meses a 3 anos, sob a orientação e o monitoramento de uma equipe profissional com obrigatoriedade da escolarização e da profissionalização. Um dos questionamentos neste processo é a relação entre o funcionamento da medida a partir de suas estratégias institucionais (estrutura e organização) e intersetoriais (organização e articulação com outras políticas públicas) e os resultados dessas ações na vida dos adolescentes atendidos. Para tanto, propôs-se investigar o desempenho dos processos institucionais e intersetoriais adotados pela medida socioeducativa de semiliberdade desenvolvida em Foz do Iguaçu, no estado do Paraná, focando nos arranjos institucionais, nas condutas, nos objetivos dos atores políticos, nos instrumentos de ação e nas estratégias políticas institucionais e intersetoriais. A partir de uma pesquisa qualitativa e exploratória, buscou-se realizar questionamentos pertinentes ao poder disciplinar e à sociedade de controle, respectivamente problematizadas por Michel Foucault e Gilles Deleuze. O debate teórico foi articulado com as experiências presenciadas pela pesquisadora e as relatadas pelos profissionais da Casa de Semiliberdade de Foz do Iguaçu, PR, somados à análise de documentos que continham informações sobre o processo socioeducativo dos adolescentes atendidos e seus desdobramentos. A análise dessas experiências buscou compreender a existência do objeto e seu funcionamento, correlacionado com o movimento histórico, numa perspectiva não apenas textual, mas relacional, discursiva, de forma a preservar a unidade social e estabelecer relações entre o conteúdo que aparece, as regras e as delimitações. As vivências e os dados objetivos encontrados sobre o funcionamento da semiliberdade indicam o movimento de transição de estratégias ligadas à sociedade disciplinar e à de controle, conforme Foucault (2012f) e Deleuze (2010). A pesquisa centra-se nas estratégias institucionais e intersetoriais que aliam o novo ao velho modelo de política pública na área da infância e adolescência, interligando práticas e concepções da política do Código de Menores e do Estatuto da Criança e do Adolescente . Trata-se de práticas em prol do sujeito de direito universal que não abandonam a ideia de sujeito perigoso no trabalho com o adolescente autor de ato infracional. E, neste contexto, constitui-se um laboratório que constrói novas relações de poder, controlando e vigiando estes adolescentes de acordo com o modelo de vida proposto pela sociedade democrática, participativa e inclusiva.

Det "avvikande" barnets tillblivelse : En studie om föreställningar, konstruktioner och maktrelationer kring barn med autismspektrumtillstånd i förskolan

Avsikten med denna studie är att problematisera och ge en djupare förståelse för tre utbildade specialpedagogers tankar och reflektioner, beträffande hur makt, konstruktioner och diskurser kan komma till uttryck kring barn med autismspektrumtillstånd (AST) i förskolan. Forskningsområdet utgår från en förståelse som hävdar att det finns otillräckliga kunskaper om maktrelationer, sociala konstruktioner och diskurser som präglar dessa barn. Studiens forskningsfrågor berör hur barn med AST skildras och förstås, blir socialt konstruerade samt vilka förhållningssätt som kan finnas gentemot dem i förskolan. De teoretiska utgångspunkter som denna studie grundas på, är socialkonstruktionism, diskursteori och Michel Foucaults maktperspektiv. För att samla in och analysera data, tillämpades den kvalitativa forskningsintervjun och diskursanalys. Resultaten visar att barn med AST betraktas som socialt avvikande och att de på olika sätt blir föremål för korrigering.

It seeks to prove that despite the progressive system in the execution of the sentence in Brazil to present itself as a set of principles and rules that aim to achieve retributive nature of the punishment of more human way through social reintegration, is primarily reinforcing the control of the bodies submitted to serve their sentences. In turn, the alternative and technological means of indirect monitoring, based on the electronic monitoring has been used as a mechanism or control gear, while despises the parallel implementation of social inclusion policies and therefore humanity of the convict. In order to confirm this hypothesis, the research is based on disciplinary power reference in the kidnapping of institutions, in particular in prison and electronic monitoring system from the way the criminal agencies even react to the condemned as machinery or gear maintenance of relations of power and control over the convicts. Through national and foreign literature, as well as the assessment of administrative and legal documents relating to criminal enforcement, analysis of the reality of electronic monitoring in Brazil and especially in Goiás, objective reinforce that finding, to expose the grounds of implementation of that electronic gear - in Goiás through electronic anklets - although a less painful form of surveillance and punishment than the classic system embodied in prisons, have the urge or the time control objective and actions of inmates who are not oportunizado social inclusion policies even the most traditional and basic shapes, namely, education, work, medical and psychological care. / Esta dissertação trata dos sistemas, regimes prisionais, controle e da eficiência da monitoração eletrônica na execução das penas, buscando demonstrar, que apesar do sistema progressivo na execução da pena no Brasil se apresentar como um conjunto de princípios e regras que objetivam alcançar a natureza retributiva da pena de modo mais humano por meio da reintegração social, primordialmente vem reforçando o controle dos corpos submetidos ao cumprimento de penas. O meio alternativo e tecnológico de vigilância indireta, consubstanciada na monitoração eletrônica tem sido utilizada como mecanismo ou engrenagem de controle, enquanto despreza a implantação paralela de políticas de inserção social e, consequentemente, a humanidade do apenado. Com o intuito de comprovar essa hipótese, a pesquisa se apoia na referência do poder disciplinar nas instituições de sequestro, em especial no sistema prisional e de monitoramento eletrônico a partir da forma como as agências penais reagem diante do condenado até mesmo como maquinarias ou engrenagens de manutenção das relações de poder e controle sobre os apenados. Por meio de pesquisa bibliográfica nacional e estrangeira, bem como pela apreciação de documentos administrativos e judiciais referentes a execução penal, a análise da realidade da monitoração eletrônica no Brasil e, especialmente em Goiás, objetiva reforçar aquela constatação, ao expor que a razão da implantação daquela engrenagem eletrônica – no estado, por tornozeleiras eletrônicas – embora uma forma menos dolorosa de vigilância e punição do que o sistema clássico consubstanciado nas prisões, tem o impulso ou o objetivo de controle do tempo e das ações dos apenados a quem não é oportunizado políticas de inclusão social, ainda que pelas formas mais tradicionais e básicas, quais sejam, educação, trabalho e atendimento médico-psicológico.

The theme chosen is intended to accompany the reflections of Michel Foucault (1926-1984) on the so-called "kidnapping institutions". The way forward is to follow the footsteps of Michel Foucault's trajectory from his broader scope (the general panorama of his thinking) to the particular theme of "kidnapping institutions", especially through the moment of that trajectory in which they appear explicitly. To achieve such a purpose, there is an introduction about the intellectual path of the philosopher in (his) three moments, followed by the discipline and its generalization. The research focused on the study of the effectiveness of the Article 5th, LV, of the Federal Constitution of 1988, its incidence contours, its effects as standard of fundamental rights and the peculiarities of its application in the employment relationship. The research´s central problem was facing by two perspectives: Initially, was studied the applicability of the constitutional provision through the lens of modern constitutional theory, adopting, as the main theoretical, the thesis of constitutional effectiveness of José Afonso da Silva. At second step, without exclusively, was analyzed the problem under the postulates of contemporary constitutionalism and theory of fundamental rights. The research method was the critical revision of the doctrine tangential to the topic, the investigation of primary sources of constitutional legislative process, the jurisprudence, the foreign legislation and the documents published by international organizations. The search result is the postulate that the constitutional guarantees of adversarial and legal defense have immediate irradiation in private relations governed by the Direct Labour ensured by complete eficacial and effectiveness horizontal of the rule inserted in Article 5, LV, of the Federal Constitution 1988, not depending of any legislation or legislative change. To respect the constitutional provision, an employer who intends to sanction or dismiss the worker with a just cause argument must previously assure to him the exercise of the assurances of the contradictory and the legal defense, under penalty of nullity sanction imposed by lack of essential validity. In the case of dismission by just cause, the disrespect to the assurances implies consider the serious lack ineffectual, changing the argument of dismission for unjust type, unless the employee has obtained provisional stability, in which case will be possible think on reinstatement of the worker / O presente trabalho divulga pesquisa que adotou como objeto central a aplicabilidade das garantias do contraditório e da ampla defesa diante do poder disciplinar do empregador privado. A pesquisa se concentrou no estudo da eficácia do artigo 5º, LV, da Constituição Federal de 1988, seus contornos de incidência, seus efeitos como norma definidora de direitos fundamentais e as peculiaridades de sua aplicação na relação de emprego. O problema central foi enfrentando em duas perspectivas: Incialmente, estudou-se a aplicabilidade da norma constitucional sob a lente da moderna teoria constitucional, adotando-se, como principal marco teórico, a tese de eficácia das normas constitucionais de José Afonso da Silva. Em segundo momento, sem caráter exclusivo, analisou-se o problema sob os postulados do constitucionalismo contemporâneo e da teoria dos direitos fundamentais. O método de pesquisa consistiu na revisão crítica da doutrina tangente ao tema, na investigação das fontes primárias do processo legislativo constitucional, do acervo jurisprudencial correlato, da legislação estrangeira e dos documentos publicados pelos Organismos Internacionais. O resultado é o postulado de que as garantias constitucionais do contraditório e da ampla defesa têm imediata irradiação nas relações privadas reguladas pelo direto do trabalho, assegurado pela plenitude eficacial e pela eficácia horizontal da norma inserida no artigo 5º, LV, da Constituição Federal de 1988, não sendo dependente de qualquer legislação infraconstitucional conformadora ou de alteração legislativa. Em respeito à norma constitucional, o empregador que tiver a intenção de sancionar ou despedir motivadamente o trabalhador deve previamente assegura-lhe o exercício do contraditório e da ampla defesa, sob pena de nulidade da sanção aplicada por falta de elemento essencial de validade. Tratando-se de resolução do contrato por justa causa, o desrespeito às garantias implica em se considerar insubsistente a falta grave, convertendo-se a dispensa para a modalidade imotivada, salvo se o trabalhador for detentor de estabilidade provisória, hipótese em que será possível falar em sua reintegração

The evolution of the punitive system, from the end of the 15th century to the present day, clearly demonstrates the key role that the criminal law has developed in all phases of capitalism. During the transition from feudalism to capitalism, the punishment was fundamental to format the new proletariat, instilling in them the disciplines of the new mode of production. After the Industrial Revolution, the prison adopted a posture more intimidating and terrorist. In the Fordist period, the carcer came to be regarded as a stage to the social rehabilitation and reintegration of the offender into the society, while welfare policies sought to maintain the poor class away from criminality. Finally, in the post-Fordism period, the welfare policies gave way to criminal policies, thus the social control and management of poverty are conducted through the prisons. The mass incarceration of the groups socially segregated, in a policy of zero tolerance, gives the keynote of the present time, as well as the severity of punishments. / O presente estudo tem por objetivo precípuo a análise do Direito Penal sob a perspectiva marxista, evidenciando sua intrínseca relação com o modo de produção capitalista. A evolução do sistema punitivo, desde o final do século XV até os dias atuais, demonstra claramente o fundamental papel que o Direito Penal desenvolveu em todas as fases do capitalismo. Durante a transição do sistema feudal para capitalista, as penas foram fundamentais na formação do novo proletariado, incutindo-lhes as disciplinas do novo modo de produção. Após a Revolução Industrial, o cárcere adotou uma postura mais intimidatória e terrorista. No período fordista, a prisão passou a ser encarada como etapa de ressocialização e reintegração do infrator ao seio social, enquanto as políticas de assistência social buscavam afastar a classe menos favorecida da criminalidade. Por fim, no pós-fordismo, as políticas de assistência social cedem lugar às políticas criminais, sendo que o controle social e a gestão da pobreza são realizados através dos presídios. O encarceramento em massa dos grupos segregados socialmente, em uma política de tolerância zero, dá a tônica do momento atual, assim como a severidade das punições.

The purpose of this study is to increase the understanding for how home care services interpret and handle situations with and around caretakers alcohol use. Interviews have been conducted with two managers and six basic staff in two different home care service-groups. The interviews were individual with the managers and in group form with the staff. The interviews have been analyzed using Hasenfeld’s theory on Human Service Organizations and moral practice together with Beronius’ interpretation of disciplinary exercise of power. Our result showed that the handling of caretakers alcohol use differed both within and between the home care service-groups and there was a lack of guidelines on how to deal with this. Consequently it seemed to be a lot of individual assessments carried out by the staff, which sometimes led to a moral practice. Another important result was the fact that the interviewees quickly became very fixed on abuse and addiction, even though the interviews had focus on alcohol use in general. It is obvious that when a substance abuse problem exists, difficulties arise in home care services work.

Under de senaste tre decennierna har populära managementböcker erbjudit snabba och enkla recept för hur ledare ska leda personal på ett effektivt sätt. Dessa böcker har blivit bästsäljare och har inspirerat många ledare inför nya utmaningar angående personalfrågor. Kända managementförfattare har alltså stor påverkan för hur individ och ledarskap uppfattas i samhället, samt för att förstärka en viss vision om hur människors beteende borde utformas för att företagsmässiga mål skall kunna uppnås. Denna studies syfte var att öka förståelsen för populär managementlitteraturs maktdimensioner. Tre bästsäljande managementböcker från sekelskiftet analyserades genom en foucaultinspirerad diskursanalys, med fokus på styrningsmentalitet, disciplin och människosyn. I analysen visas hur de utvalda böckerna innebär en styrningsmentalitet som präglas av interna kontroll- och utvärderingsformer, samt en disciplinär dimension som kristalliseras ut i definitioner av vad norm och avvikelse är i dagens organisation. / Over the past three decades, popular management books have offered quick and easy recipes for how leaders have to lead staff in an effective manner. These books have become bestsellers and they have inspired many leaders to face challenges regarding management of people. Famous management writers have thus a big influence on how individuals and leadership are perceived in society, as well as a big influence to reinforce a certain vision of how human behavior should be designed in order for that entrepreneurial goals will be achieved. The study's aim is to increase understanding about the power dimensions in popular management literature. Three best-selling management books from the turn of the century were analyzed using a Foucault-inspired discourse analysis, focusing on management mentality, discipline and view of human beings. The analysis shows how the selected books implies a management mentality  that is characterized by internal monitoring and evaluation, as well as a disciplinary dimension that crystallizes in the definitions of what norm and deviation are in today's organization.

Outsourced workers have a different status in the workplace, which excludes them from the benefits offered by the companies. As a result, society has to deal not only with the fragility of the wage relationship, but also with the collapse of the principles that regulate sociability among workers. The thesis is that the company organizational changes produce the adhesion of direct workers to the organizational ideas cause give them a feeling of colective belonging, even when we take into consideration the reduction of the workers that productive by lean production processes. Fifteen interviews were conducted with each group of workers; two union leaders were also interviewed. Furthermore, were examined the collective agreement between the direct workers and the company, and that company s yearly reports, since 2003. / O objetivo deste trabalho é analisar em que medida as mudanças organizacionais ocorridas em uma indústria de alumínio primário no município de Barcarena, no Estado do Pará, promove a adesão dos trabalhadores e a diferenciação social entre trabalhadores diretos e terceirizados. Como se sabe, os terceirizados possuem estatuto diferenciado no espaço de trabalho, o que os exclui da rede de benefícios oferecida pelas empresas. Nesse sentido, a sociedade passa a conviver não apenas com a fragilidade presente na relação salarial, mas também com o desmoronamento dos princípios reguladores da sociabilidade entre os trabalhadores. A tese que defendemos é a de que as mudanças organizacionais implantadas a partir da década de 1990 na empresa produzem certa adesão dos trabalhadores diretos ao ideário organizacional da empresa por lhes conferir um sentido de pertença coletiva, mesmo quando se considera a redução dos quadros funcionais promovida pelas reestruturações produtivas. Foram realizadas 15 entrevistas com cada grupo de trabalhadores e duas entrevistas com dirigentes sindicais; também analisamos o acordo coletivo dos trabalhadores diretos com a empresa e os relatórios anuais desta desde o ano de 2003.

Trois études sur la mesure de la performance des entreprises en matière de développement durable : pouvoir disciplinaire et légitimation / Three studies on the corporate sustainability performance measurement : disciplinary power and legitimation

L’objectif de cette thèse est d’étudier, sous un angle sociologique, la nouvelle pratique de mesure de la performance des entreprises en matière de développement durable. Cette pratique émergente constitue un espace social où s’articulent divers jeux de pouvoir, de confrontation et de résistance de nombre d’acteurs engagés dans le domaine du développement durable. Le premier article présume que l’analyse du discours, socialement construit et constitué, entourant les mesures produites et diffusées (souvent très médiatisées), joue un rôle fondamental dans la compréhension de ladite pratique. En particulier, le discours transmis par les organismes de mesure de la performance socio-environnementale des entreprises, aussi bien dans leurs sites web que dans leurs documents publics, se trouve à promouvoir une idéologie du chiffre qui sous-tend l’exercice d’un certain pouvoir de type disciplinaire sur les entreprises évaluées. En dépit de toutes les ambiguïtés et les incertitudes méthodologiques associées à la pratique de la mesure socio-environnementale, les organismes de mesure s’efforcent de développer et de transmettre un discours, relativement réducteur, pour légitimer leur revendication d’expertise en la matière. Le deuxième article de cette thèse fait état des stratégies de légitimation déployées par les organismes de mesure ainsi que leurs effets disciplinaires sur les entreprises évaluées et les parties prenantes. Il s’agit, dans les faits, du pouvoir disciplinaire et de normalisation de l’idéologie des chiffres qui peut induire certains effets d’autodiscipline dans le champ du développement durable en général. Une telle autodiscipline s’observe également dans le monde universitaire lorsque les gardes-frontières des organisations font pression sur les chercheurs à renoncer à la publication de leurs recherches. Prenant la forme d’une étude méthodologique, le troisième article de la thèse cherche à susciter une réflexion sur les entraves que peut poser le pouvoir des gardiens des organisations, notamment lorsque celui prend la forme de menaces de poursuites judiciaires, sur l’indépendance et la liberté des chercheurs et des universités auxquelles ils se rattachent. / The objective of this dissertation is to examine, under a sociological lens, the new practice of the corporate sustainability performance measurement. This emerging practice seems to be a social space where are structured various games of power, confrontation and resistance of many actors involved in the field of sustainable development. The first paper assumes that discourse analysis, socially constructed and constituted, surrounding measurements produced and disclosed (often highly popularized through the media), plays a fundamental role in the understanding of the practice of corporate sustainability performance measurement. In particular, the discourse transmitted by the sustainability ratings and rankings agencies (SRRA), both on their websites and in their public documents, tends to promote an ideology of numbers that exerts disciplinary power over companies appraised. Despite all the ambiguities and methodological uncertainties associated with the practice of socio-environmental performance measurement, SRRA strive to develop and transmit discourse, quite reductive, to legitimize their claim to expertise in the field. The second paper of this dissertation outlines the legitimation strategies deployed by SRRA and the disciplinary impacts of these strategies on companies scrutinized and stakeholders. Actually, it is the disciplinary power and the normalization power of the ideology of numbers which can induce some effects of self-discipline in the field of sustainable development in general. Such self-discipline is also observed in the academic world when corporate gate-keepers put pressure on researchers to abandon the publication of their research. As a methodological study, the third paper of the dissertation seeks to stimulate reflection on the impediments that the power of the corporate gate-keepers can pose on the independence and the freedom of the researchers and the universities to which they are attached, especially in the case of threats of lawsuits.
