This thesis explores the most basic purpose of education and how it can be advanced. To begin to analyze this fundamental area of concern, this thesis associates notions of education with notions and experiences of truth and authenticity, which vary historically and culturally. A phenomenological analysis, featuring the philosophy of Heidegger, uncovers the basic conditions of human experience and discourse, which have become bent upon technology and jargon in the West. He draws on Plato's account of the 'essence of education' in the Cave Allegory, which underscores human agency in light of truth as unhiddenness. Heidegger calls for ontological education, which advances authenticity as it preserves individuals as codisclosing, historical beings.

Med hjälp av denna vetenskapliga essä undersöker jag hur man kan uppmärksamma och värna leken och glädjen i musicerandet med förskolebarn. Detta belyser jag inte enbart ur barnens perspektiv utan även ur mitt eget och mina kollegors. Med hjälp av berättelser från min vardag på förskolan och utifrån min praktiska kunskap, ger jag en bild av hur detta kan te sig. Dessa berättelser är ett fundament för mina vidare reflektioner. Vad lek och leklust är skärskådar jag genom att bena upp begreppen i mindre beståndsdelar. Jag reflekterar bland annat över förberedelser, stämning, material, att bedöma gränser, stöttning av enskilda barn, att hålla sig öppen, arbetslaget, risken med longörer och nödvändigheten av humor. Den röst som jag huvudsakligen låter komma till tals är Johan Huizingas. Hans idéer om lekens väsen har hjälpt mig att formulera mina egna tankar. Andra får bistå mig för att ytterligare förtydliga, fördjupa och kontrastera mina resonemang. / Using this scientific essay, I examine how to recognize and protect the play and the joy of music-making with preschoolers. I highlight this not only from the children's, but also from my own and my colleagues, perspective. With the help of stories from my everyday life at preschool and based on my practical knowledge, I provide a picture of how this may emerge. These stories are the foundation for my further reflections. I scrutinize what play and playfulness are and carefully analyze the phenomenon into smaller parts. I reflect about, among other things, the preparation, atmosphere, materials, assessing rules, the support of individual children, ability to stay open, teamwork, the risk of verbosity and the necessity of humor. The voice that primarily has it's say belongs to Johan Huizinga. His ideas regarding the essence of play has helped me formulate my own thoughts. Others has also helped me to clarify, deepen, and contrast my own reasoning in this essay.

Platonic Craft and Medical Ethics

Platonic Craft and Medical Ethics examines the Platonic theory of craft and shows its application to different ethical problems in medicine, both ancient and modern. I begin by elucidating the Platonic use of the term “craft” or “technē”, using especially the paradigmatic craft of medicine, and explicate a number of important principles inherent in his use of the term. I then show how Plato’s framework of crafts can be applied to two ancient debates. First, I show how Plato’s understanding of crafts is used in discussing the definition of medicine, and how he deals with the issue of “bivalence”, that medicine seems to be capable of generating disease as well as curing it. I follow this discussion into Aristotle, who, though he has a different interpretation of bivalence, has a solution in many ways similar to Plato’s. Second, I discuss the relevance of knowledge to persuasion and freedom. Rhetors like Gorgias challenge the traditional connections of persuasion to freedom and force to slavery by characterizing persuasion as a type of force. Plato addresses this be dividing persuasion between sorcerous and didactic persuasion, and sets knowledge as the new criterion for freedom. Finally, I discuss three modern issues in medical ethics using a Platonic understanding of crafts: paternalism, conclusions in meta-analyses and therapeutic misconceptions in research ethics. In discussing paternalism, I argue that tools with multiple excellences, like the body, should not be evaluated independently of the uses to which the patient intends to put them. In discussing meta-analyses, I show how the division of crafts into goal-oriented and causal parts in the Phaedrus exposes the confusion inherent in saying that practical conclusions can follow directly from statistical results. Finally, I argue that authors like Franklin G. Miller and Howard Brody fail to recognize the hierarchical relationship between medical research and medicine when they argue that medical research ethics should be autonomous from medical ethics per se.

Le droit des sûretés réelles a fait l’objet de profondes mutations à la suite de plusieurs réformes successives qui viennent de l’affecter. Si la matière s’est indubitablement modernisée, il reste qu’elle souffre d’un manque de cohérence globale qui tient tout à la fois à la trop grande offre de sûretés et à l’insuffisance de règles fédératrices venant régir l’ensemble. La question se pose alors de savoir s’il est possible et envisageable de dégager un socle de règles communes plus élaboré, voire même un droit commun, et selon quelles modalités. Il en ressort l’interrogation sur l’efficacité du droit ohada des sûretés réelles au regard de l’inadéquation entre les objectifs du législateur africain et les moyens qu’il a mis en oeuvre pour les atteindre. Au regard des expériences internationales, la réponse à ces questionnements réside à notre sens dans une réforme plus ambitieuse du droit ohada des sûretés réelles qui se traduirait par l’adoption d’une approche fonctionnelle telle qu’il nous a été donné de voir dans des pays appartenant à la même tradition juridique que la nôtre. Plus concrètement, il s’agira de redonner, à travers cette conception fonctionnelle des sûretés, de la cohérence, de la simplicité et de l’accessibilité, en somme de l’efficacité au droit ohada des sûretés réelles de manière à le rapprocher des populations et des réalités socio-économiques des États de l’ohada tout en n’occultant pas les enjeux économiques internationaux. / The real security interests law/secured transactions has gone through crucial changes following a series of several reforms which has affected it. If the subject matter has undoubtedly been modernized, it is obvious that the real security interests law/secured transactions is still lacking of general consistency which is linked simultaneously to the large numbers of proposal on security interests and to the insufficiency of federative rules which come to govern the whole. Actually, the problem poses the question to know if it is possible and conceivable to put forward a base of more sophisticated general rules, or even a general law, and according to what methods? The interrogation underlines the efficacy of ohada real securities law in regard to the inadequacy between the objectives of the African legislator and the means used by him to achieve them. In other words, it is admitted to question on the way of a reinforcement of the actual real securities law in sight of a greatest efficacy. In regard to the international experiences, the answer of these questioning is found, in our opinion, in a reform more ambitious of the ohada real securities law which is going to lead to the adoption of a functional approach as it was observed in States with the same juridical culture of ours. In concrete terms, it is important to give back, through this functional conception of securities interest, coherence, and simplicity, in sum, efficacy to ohada real securities law likewise to bring it closer to the population and to the socio-economic realities of ohada member States while revealing the international economic stakes.

Neither flesh nor fleshless : an object-relational study of the experience of Philophonetics-Counselling

Philophonetics-Counselling is a specific form of a bodily-oriented expressive therapeutic approach, defined for the purposes of this study as an approach that uses the non-verbal bodily modalities of movement, gesture, visualisation, and sound, as well as forms of artistic expression, as elements of a process, which furthers the physical and psychic integration of an individual. In view of the recent rise in bodily-oriented therapeutic processes, this study intends to describe and explore the role of especially bodily representation, but also mental representation in the phenomenon of the transformation and representation of sensory-emotional experience in the developing psyche. This is achieved by exploring the essence of described ‘lived experience’ of Philophonetics-Counselling, which is a means not only to elicit this phenomenon of transformation, but also to gain access particularly to bodily representation and bodily knowing. This exploration is guided primarily by a dialogue with object relations theory, exploring conceptualisations provided by Bollas, Ogden, Winnicott, Bion, and Klein. This dialogue is also, however, informed by contemporary bodily-oriented theorists, including Merleau-Ponty, Gendlin, and Shapiro. . The essence of this experience is explicated from qualitative material according to the Duquesne Phenomenological Research Method, which requires of the researcher to allow the inherent constituents and dynamic process to emerge such that the phenomenon can present itself to his/her awareness as it is in itself. Following this, by engaging with psychological theory in an attempt to understand this explicated structure, specific attention is given to the manner in which bodily representation and bodily knowing, particularly as applied or encouraged in therapeutic process, is intimately involved with thetransformation and representation of sensory-emotional experience. This research process reveals a means to rework and explore perhaps more directly the representations of self and other. An investigation into problem solving skills in calculus : the case of Unisa first year students

Students’ performances in mathematics in an Open Distant Learning setting have not always been impressive. An exploratory study into the problem solving skills of the University of South Africa students in the Calculus module MAT112 is being conducted using past examinations scripts between 2006 and 2009. The study re-assesses the work done in the end-of-year Calculus examinations, by both looking at the distribution of marks awarded and assigning new scores based on an assessment rubric adapted for the problem at hand. Further assessment of qualitative dimensions that is important for problem solving in Calculus is developed from the data obtained from the assessment rubric. Using factor analysis, a hesitation factor, transfer-of-knowledge factor as well as ingenuity factor, are identified in successful Calculus problem solving. The study proposes two conceptual models; the first is to guide students in solving Calculus problems while the second one is meant to assist lecturers in the assessment of students of Calculus. / Science and Technology Education / M. La distinction entre l’être et l’essence chez Hervé de Nédellec

Hervé de Nédellec o.p. joua un rôle de premier plan dans la défense du patrimoine doctrinal de Thomas d’Aquin contre les effets des condamnations de la fin du XIIIe siècle et du début du XIVe siècle. Il a néanmoins défendu une position sur la distinction entre l’être et l’essence divergeant sensiblement de la distinction thomasienne, alors que cet élément se présente comme central à la pensée de l’illustre dominicain. Cette étude vérifie cette divergence et en rend compte, considérant le contexte historique et le rôle assumé par Hervé dans la défense de la pensée de son confrère. Allen (1958) caractérise la perspective hervéenne par son essentialisme et son approche sémantique, ainsi que par le rejet de la distinction réelle (Gilles de Rome et Thomas d’Aquin) et de la distinction intentionnelle (Henri de Gand). Il évoque par ailleurs l’influence de Godefroid de Fontaines, de Siger de Brabant et d’Averroès au regard de la distinction entre l’être et l’essence selon le mode de signifier retenue par Hervé. Ces observations se voient ici confirmées par l’exposé et la comparaison des principes ontologiques assumés par les différentes positions. Il est par le fait même rendu manifeste que Siger de Brabant, Godefroid de Fontaines, Hervé de Nédellec et encore Dietrich de Freiberg, tenants de la distinction sémantique, rejettent les positions adverses en raison de mêmes éléments qu’ils critiquent de celles-ci. La communauté doctrinale entre la distinction selon le mode de signifier et la théorie modiste ainsi que leur source commune dans le Commentaire à la Métaphysique d’Averroès sont par ailleurs mises au jour. Les modistes distinguent le signifié principal et les propriétés concernant (circa) le signifié principal. Dans la perspective sémantique, l’essence, l’étant et l’être sont conçus comme des propriétés concernant le signifié principal à la manière des propriétés circa de la grammaire spéculative. À l’instar des propriétés circa, « essence », « étant » et « être » diffèrent non parce qu’ils signifient différentes déterminations, mais au sens où ils signifient une même chose de différentes façons. L’analyse des objections soulevées par les tenants de la distinction sémantique et des éléments constitutifs de leur position fournit des outils nouveaux pour apprécier la distinction entre l’être et l’essence chez Thomas d’Aquin. Celle-ci se révèle procéder d’un cadre théorique inconciliable avec celui adopté par Hervé de Nédellec. Nous faisons ici valoir que cette liberté doctrinale d’Hervé de Nédellec s’explique par cela que la distinction entre l’être et l’essence n’était pas constitutive du fonds thomasien concerné par les ordonnances d’enseignement dominicaines de la fin du XIIIe siècle et du début du XIVe siècle, notamment puisqu’elle n’a pas été ciblée par les condamnations doctrinales ecclésiales ni par le correctoire de Guillaume de la Mare. / Hervaeus Natalis o.p. played a leading role in defending the doctrinal heritage of Thomas Aquinas against the effects of the condemnations of the end of the 13th and beginning of the 14th centuries. Nevertheless, he would have supported a position on the distinction between being and essence which is irreconcilable with the Thomasian distinction, even though this element is central to the thought of the illustrious Dominican. The present study verifies this discrepancy and give an account of it, considering the historical context and the role assumed by Hervaeus in the defence of the thought of his confrere. Allen (1958) characterizes the Hervean perspective by its essentialism and its semantic approach, as well as by the rejection of the real distinction (Giles of Rome and Aquinas) and the intentional distinction (Henri of Ghent). He also evokes the influence of Godfrey of Fontaines, Siger of Brabant and Averroes with regard to the distinction between being (esse) and essence according to the mode of signifying adopted by Hervaeus. These claims are here confirmed by the exposition and comparison of the ontological principles assumed by the different stances. By the same token, it is made clear that Siger of Brabant, Godefroid of Fontaines, Hervaeus Natalis and also Dietrich of Freiberg, the proponents of the semantic distinction, reject the opposing positions on the basis of the same elements that they criticize in them. The doctrinal community between the distinction according to the mode of signifying and the Modist theory, as well as their common source in the Commentary on the Metaphysics of Averroes are also brought to light. The Modists distinguish between the object signified and the properties concerning (circa) the object signified. In the semantic perspective, essence, ens and esse are conceived as properties concerning the object signified in the manner of the circa properties of speculative grammar. Like the circa properties, “essence”, “ens” and “esse” do not differ because they signify different determinations, but they differ in the sense that they signify the same thing in different ways. The analysis of the objections raised by the proponents of the semantic distinction and of the constitutive elements of their position provides new tools for appreciating the distinction between being (esse) and essence in Aquinas. It proves to proceed from a theoretical framework that is irreconcilable with that adopted by Hervaeus. We argue here that this doctrinal freedom of Hervaeus is explained by the fact that the distinction between being (esse) and essence was not constitutive of the Thomasian fund concerned by the Dominican teaching ordinances of the end of the 13th and beginning of the 14th centuries, especially since it was not targeted by the ecclesial doctrinal condemnations nor by the correctory of William de la Mare.
