The recognition of same-sex unions in South Africa

With the abolition of apartheid and the introduction of a new constitutional dispensation, the state’s totalitarian exclusion of homosexuals from legal recognition was relegated to a past era. The constitutional commitment to human dignity and equality and the inclusion of sexual orientation as a prohibited ground of discrimination led to the recognition of same-sex life partnerships and, inevitably, same-sex marriage by means of a civil union regime. The object of this study is to investigate the scope of the legal consequences provided to same-sex couples by the Civil Union Act 17 of 2006 and to determine the legal standing of same-sex couples who fall outside the ambit of the Act. The study includes constitutional arguments pertaining to the continued recognition of same-sex life partnerships and a critical analysis of the constitutionality of the Civil Union Act as a separate measure to govern same-sex marriage. Discrimination on the ground of citizenship under the constitution of the Republic of South Africa, 1996

Prior to 1994, citizenship was one of the pillars upon which the erstwhile government's policy of separate development rested. The concepts of citizenship and nationality were manipulated by the apartheid government to justify the denationalisation of black people and the creation of different classes of citizenship. Race, colour and language were the distinguishing features used to classify people into the different classes of citizenship. With the advent of the new constitutional order in 1994, common citizenship and the rights associated with it were restored to all South Africans. This discussion shows how in the post-1994 constitutional order citizenship has become an element of nation-building, while on the other hand it continues to perpetuate discrimination against non-citizens. The study aims to further the debate regarding the ill treatment of non-citizens with a view of influencing legislative and policy reform to replace the existing laws which are biased against no-citizens. / Law / LL.M.

The role of cultural diversity on social wellness in a primary school in Gauteng

This study investigates the role of cultural diversity on social wellness in a diverse school setting. It explores the views of learners and teachers on issues pertaining to cultural diversity and social wellness in the school. An integrative lens encompassing Hettler’s (1970) wellness theory and Letseka’s (2000) Ubuntu principle were used as the framework to guide the study. The interpretivist paradigm was used because the research method for this study is qualitative in nature. Purposive sampling was used in this study where fifteen participants were selected. The approach used is a case study, with the case being a multicultural primary school in Gauteng Province, South Africa. Ethical clearance was obtained from the Unisa’s Ethics Committee. Furthermore, permission was granted by the Department of Basic Education and the school’s principal. All participants signed consent and assent letters before data were collected. Learner participants gave their assent to take part in the study after consent had been obtained from their parents and guardians prior to the commencement of data collection. Data collected reflected the participants’ understanding of the need and means to promote social wellness within a culturally diverse school setting. It also suggests that it is possible to make diversity work for, instead of against us as is advocated for by Sheets (2005). The themes that emerged from collected data were: knowing one another as well as each other’s cultures, respect for equality and human dignity, loving kindness and compassion towards everyone, practicing good manners and discipline towards everyone, positive social interaction/desired attitude and also leading by example. Recognition of domestic partnerships in South African law

With the advent of a new constitutional dispensation in South Africa, intimate relationships that were not formally recognised, such as customary marriages, became fully recognised through designated legislation. Domestic partnerships are, however, afforded only limited recognition despite compelling reasons that lead people to domestic partnerships. Domestic partners are also discriminated against based on marital status despite a Constitution that forbids discrimination based on equality, human dignity and marital status. The object of this study is to investigate whether there are sufficient grounds to afford domestic partnerships full recognition similar to that granted to civil marriage. This study includes arguments in favour and against the recognition of domestic partnerships and a discussion of the reasons that lead people into domestic partnerships. There will also be an analysis of the draft Domestic Partnership Bill 36 of 2008 to determine the suitability of the draft Bill to regulate domestic partnerships. Le dommage causé à soi-même a très longtemps constitué un sujet hors du droit, synonyme de stigmatisation morale ou de fatalité. Depuis la fin du XXème siècle, c’est un enjeu essentiel des politiques publiques qui fait encore aujourd’hui l’objet d’un débat éthique et juridique. D’une part, la volonté de se causer un dommage exprime les aspirations de l’homme contemporain à obtenir la maîtrise de son corps, qu’il s’agisse de choisir le temps et les conditions de sa mort, de revendiquer des pratiques masochistes ou bien de faire don de ses organes. D’autre part, cette prise de risque dommageable pour soi révèle très souvent une opposition de l’État et de la société en général, en raison de l’atteinte susceptible d’être portée aux valeurs sociales et aux équilibres budgétaires. En tant que sources croissantes de préoccupation, les manifestations et les limites du dommage causé à soi-même méritent d’être soumises à l’étude de leur contexte historique, social et juridique. / The damage caused to oneself was for a very long time a topic outside the law, as a synonym for moral stigmatization or for fate. Since the end of the XXth century, it is an essential public policy issue that is the object even today of an ethical and legal debate. On the one hand, the will to harm oneself reflects the aspiration of the contemporary man to have the control of its body, that it is a question of choosing the time and the conditions of its death or claiming masochistic practices or donating organs. On the other hand, this harmful risk-taking for oneself reveals frequently an opposition of the State and more generally of the society, because of the potential violation of the social values and the budget balances. As increasing sources of concerns, the manifestations and the limits of the damage caused to oneself deserve to be subjected to the study of their historic, social and legal context.

I only want to be human : Disembarkation platforms for refugees - not concentration camps

In this study I have studied the European Unions suggestion about disembarkation of refugees from a human rights perspective - especially the perspective of human value and human dignity. Human dignity is central. It is expressed in the preamble to the UN Human Rights, as well as in its first paragraph; “Everyone has the right to dignity, and it shall not be violated.” I have studied refugees that have previously spent time in large refugee camps outside Europe, in Jordan and in Libya. In my study I use Libya as an example on what refugees can face in camps in third-world countries. The subject caught my attention since the Norwegian ship MS Tampa picked up refugees on international water outside Australia. The Norwegian captain tried to leave them on Australian land but was refused to do so. Australia sent a military boat to pick them up and left them at an island outside Australia. Moreover European politicians have discussed the idea of off-shore, placements of refugees at disembarkation camps as a way of solving the problem of huge number of refugees that are looking for asylum in Europe as well as the many deaths at the Mediterranean Sea. There has also been a discussion on quota refugees chosen by the UNHCR. This made me wonder how the situation would be for the remaining refugees that will stay in these large camps, maybe for years, as well as how their human rights are respected in camps outside Europe where Europe have no control? How does this correspond to the principle of human value? In my qualitative study I started by making a literature study. Thereafter continued with an interview study where I interviewed refugees that have stayed at camps outside Europe. The purpose of the interview and the study was to take part of their narratives and to make their voices heard. I found that the narrative of refugees is not heard, this makes them feel less valued as human, or not even a human. Their dignity is violated, and their human rights are not respected. Their interests have been forced to give way to the interest of the state.

The diploma thesis deals with the search for answering the question of people´s not saying goodbye to the deceased. The first chapter deals with the topic of dying and death in the past and compares it to the present situation. Another chapter emphasizes the significance of the ritual in human life, it deals with the early and current funeral rituals, their justified meaning from a psychological point of view. It also deals with the places of the last resting of our ancestors. The third chapter deals with the ethical aspect of this issue and, in particular, with the search for the answers, which are the cause of the current situation. The last chapter focuses on social work with survivors, deals with accompanying, mourning, and counseling help.

It still analyses the Human Dignity and Human Rights custody, specially those which fall upon the Police performance and knowledge. Furthermore, it establishes a linking between the public safety policy in São Paulo State, in Brazil and in Mercosul. This study deepens in the role of Police Academy and its teaching staff, in collecting data about the teachers, what is taught in teachers training and development and what is practiced by Civil Police. Finally, the thesis brings out the perspectives to be faced and proposes actions that culminate in Human Dignity custody pointing out that the investigation police needs to aim the Human Rights performance / A tese examina o papel da Academia de Polícia de São Paulo no ensino da disciplina Direitos Humanos e o impacto desse conteúdo programático na realidade da atuação Policial Civil de São Paulo. Parte de um escorço histórico sobre os Direitos Humanos, identificando a Dignidade Humana como um princípio présistêmico. Aponta os traços mais visíveis da atuação policial ilegal por meio da prática da tortura elemento mais exterior de uma atuação de busca da verdade real desprovida de meios organizados de atuação. It defines the person with deficiency in our juridical system, enlarging the list of the Ordinances ns. 3.298/1999 and 5.296/2004, based in the international legal system and in the jurisprudence. The development of the concepts of human dignity, equality and non discrimination are the foundations for the creation of affirmative actions, seeking to the social inclusion of the persons with deficiency, and they are object of a fast approach. In Brazil, the equalization of access opportunities to the job market for persons with deficiency is looked for through the adoption of a system of quotas or legal reserve. The Brazilian system of quotas forces to the persons with deficiency recruiting in the formal market of work, through contract between employee and employer, or through the use of reserved vacancy in public contest. The compulsory nature of person with deficiency recruiting, the increase of the fiscalization by the Labor Department and by the Labor Public Prosecution Service and the recruitings without any planning are cause of legal and social questions. To guarantee the economical function of the companies and to motivate the Brazilian system of quotas, this work proposes the adoption of fiscal and social security measures, the creation of subsidies and the alteration of the Law n. 8.742/93, in order to increase the forecast of a temporary suspension of the payment of the benefit of the special attendance when of the beginning of a labor activity of any species, until the person with deficiency returns to the inactivity. The person with deficiency social inclusion is accompanied of a series of important subjects, treated by the work, that should be faced by the State and by the whole society / A dissertação de mestrado demonstra a trajetória da pessoa com deficiência na busca do reconhecimento de seus direitos, enfocando a proteção prevista em diversos diplomas internacionais voltados à reconstrução dos valores humanos, na Constituição Federal de 1988 e em diversas leis infraconstitucionais. Define quem é a pessoa com deficiência em nosso ordenamento jurídico, ampliando o rol constante nos Decretos ns. 3.298/1999 e 5.296/2004, com fundamento no ordenamento internacional e na jurisprudência. O desenvolvimento dos conceitos de dignidade humana, igualdade e não discriminação são os fundamentos para a criação de ações afirmativas, visando à inclusão social das pessoas com deficiência, e são objeto de uma rápida abordagem. No Brasil, busca-se a equiparação de oportunidades de acesso ao mercado de trabalho da pessoa com deficiência, através da adoção de um sistema de cotas ou reserva legal. O sistema de cotas brasileiro obriga à contratação de pessoas com deficiência no mercado formal de trabalho, por meio de contrato entre empregado e empregador, ou através da utilização de vaga reservada em concurso público. A obrigatoriedade de contratação de pessoas com deficiência, o aumento da fiscalização do Ministério do Trabalho e do Ministério Público do Trabalho e as contratações sem qualquer planejamento são causa de questionamentos legais e sociais. Para garantir a função econômica da empresa e incentivar o sistema de cotas brasileiro, propõe este trabalho a adoção de medidas fiscais e previdenciárias, a criação de subsídios e a alteração na Lei n. 8.742/93, no sentido de acrescentar a previsão de uma suspensão provisória do pagamento do benefício da assistência especial, quando do início da atividade laboral de qualquer espécie, até que a pessoa com deficiência volte à inatividade. A inclusão social das pessoas com deficiência é acompanhada de uma série de questões relevantes, tratadas no trabalho, que devem ser enfrentadas pelo Estado e por toda a sociedade

The Brazilian Civil Code, published in 2002, despite the ability to relate to the constitutional system of protection of human dignity, not encompassed in its content the admission of full autonomy of persons with disabilities. Nevertheless, the Federative Republic of Brazil became a signatory to the International Treaty on the Rights of Persons with Disabilities, which promoted a paradigm shift on the focus of the concept of disability, which, of course, sparked a significant impact on the study of theories of disabilities and its corollaries. Brazilian law inclusion of people with disabilities (Law no. 13,146 - 2015), called the Disabled status, in obedience to the fundamental principles of the Convention on the Rights of Persons with Disabilities, raised transformation in the parental system of disability and, consequently, the procedural issues relating to the protection of the disabled person. The changes brought about by People with Disabilities Statute generated sequels in the Civil Law inherent institutions such as marriage and interdiction, and Civil Procedure, like the reflections in prescription and decay and the institution of the new decision-making tool supported. / Após a ratificação em 2009 por parte do Brasil da Convenção sobre os Direitos da Pessoa com Deficiência, editada em 2007, a sistemática jurídica atinente à teoria das incapacidades e seus desdobramentos sofreu modificações intensas. O Código Civil brasileiro, editado em 2002, em que pese a aptidão para se relacionar com a sistemática constitucional de proteção da dignidade da pessoa humana, não abarcou em seu conteúdo a admissão da integral autonomia das pessoas com deficiência. A despeito disso, a República Federativa do Brasil se tornou signatária do Tratado Internacional sobre os Direitos das Pessoas com Deficiência, sendo promovida uma mudança paradigmática sobre o enfoque do conceito de deficiência, o que, naturalmente, deflagrou consequências significativas no estudo das teorias das incapacidades e seus corolários. A lei brasileira de inclusão da pessoa com deficiência (Lei nº. 13.146-2015), denominada de Estatuto da Pessoa com Deficiência, em obediência aos preceitos fundamentais da Convenção sobre os Direitos das Pessoas com Deficiência, suscitou transformação no sistema pátrio de incapacidade e, por consequência, nas questões processuais relativas à proteção da pessoa com deficiência. As mudanças trazidas pelo Estatuto da Pessoa com Deficiência geraram sequelas em institutos inerentes ao Direito Civil, como o casamento e interdição, e Processual Civil, a exemplo dos reflexos na prescrição e decadência e na instituição do novo instrumento de tomada de decisão apoiada.
