The needs of FET learners for personal well-being

Personal well-being is a state that involves feelings and thoughts. This concept is investigated in learning area Life Orientation and integrated in the curriculum as a learning outcome for Further Education and Training learners in grades 10-12. A literature study was done to discuss/clarify dimensions of personal well-being that is general subjective, psychological, social and spiritual well-being and mental health. Perspectives, theories, principles and features pertaining to well-being were investigated from an international and local context. An exploratory study used a qualitative approach to investigate and observe perceptions of a small sample of learners of personal well-being. Data gathering used focus groups which completed structured group work activities. The results indicate that learner participants have needs to be satisfied to reach a sense of personal well-being. Based on findings, recommendations regarding coping strategies, intervention strategies and support were made. / Educational Studies / M.Ed. (Guidance and Counselling)

No. of bitstreams: 1 1441612.pdf: 7296177 bytes, checksum: 7e700ddc28ec670630100fd42e9aef61 (MD5) / This dissertation intends to show that the State Civil Small Claims Courts, regulated by the Law 9.099/95, guided by the principIes of orality, simplicity, infonnality, procedural economy and celerity, which were created because of the need to make a greatest access to justice viable, mainly among the poorest, with the reduction of costs and simplification of procedures that could make the judgements within a reasonable period possible, in the forensic custom rcality, are being misconstrued from their purposes. In this sense, the study shows numbers that confinn that the Small Claims Courts accomplished their aim to provide the access to the judiciary, but started to sufTer from the same problem of ordinary justice: slowness in the delay of jurisdictional execution. Besides the structure incompatibility with the CUlTent demand that will obviously cause slowness in the Small Claims Courts, the study shows the reason for this way of acting of the judges, responsible for the administration of the process, that reproduce in the Small Claims Courts the fonnality and the inherent bureaucracy of regular Civil law, when it establishes, in evident lack of measure with the law in its principies, a procedure with two fonnal audiences, one for conciliation, another when an agreement is 110t reached, for instruction and judgement, in separated days, increasing the time of process duration. The study concludes that the use of a single fonnal audience, besides being a legal detennination, is also in syntony with its principIes, and provides celerity in the judgements, reducing the cost and the waiting time of the litigants, obstacles to the access to justice which the law 9.099/95 tried to remove. / Esta dissertação pretende demonstrar que os Juizados Especiais Cíveis Estaduais, regulados pela Lei n° 9.099/95, orientados pelos princípios da oralidade, simplicidade, informalidade, economia processual e celeridade, que foram criados em decorrência da necessidade de viabilizar um maior acesso à justiça, principalmente da população mais carente, com redução de custos e simplificação de procedimentos que possibilitassem os julgamentos dentro de um prazo razoável, na realidade da práxis forense, estão sendo desvirtuado dos seus objetivos. Neste sentido, o estudo apresenta números comprovando que os Juizados Especiais cumpriram seu desiderato de proporcionar o acesso ao judiciário, mas que passaram a padecer do mesmo problema da justiça comum: a morosidade na entrega da prestação jurisdicional. Além da incompatibilidade de estrutura com a atual demanda que obviamente vai ensejar lentidão nos Juizados, o estudo apresenta como motivo para esse quadro a conduta dos juizes, responsáveis pela administração do processo, que reproduzem nos Juizados o fomlalismo e a burocracia inerente ao processo civil comum, ao instituir, em evidente descompasso com a lei e seus princípios, um procedimento com duas audiências, sendo uma para conciliação e outra, nos casos em que não é obtido acordo, para instrução e julgamento, em dias distintos, aumentando o tempo de duração dos processos. O estudo conclui que a utilização de audiência única, além de ser uma detenninação legal e estar em sintonia com seus princípios, proporciona celeridade nos julgamentos. diminuindo o custo e o tempo de espera dos litigantes, obstáculos do acesso à justiça que a Lei n° 9.099/95 procurou remover.

Enfocou-se o instituto da decisão monocrática no contexto das minirreformas processuais brasileiras, que tiveram como alicerce o princípio da efetividade processual. Esse princípio pressupõe a duração razoável do processo, garantida na Constituição Federal Brasileira. A partir da constitucionalidade desse princípio, defendeu-se a constitucionalidade do artigo 557 do Código de Processo Civil, que não pode ser considerado abstratamente inconstitucional. Demonstrou-se que a aplicabilidade do artigo 557 pode ser inconstitucional se não atender à técnica da ponderação de valores, que garante a interpretação conforme a Constituição. Analisou-se o agravo interno, sob a premissa do valor da celeridade em cotejo com o devido processo legal, que permeou a subsequente análise do procedimento desta espécie de agravo. Após uma reflexão sobre os institutos da decisão monocrática e do agravo interno, aliada ao exame dos princípios do devido processo legal, ampla defesa, contraditório e motivação das decisões judiciais, passou-se ao exame empírico desses institutos jurídicos. Nessa análise, foram coletados e examinados dados estatísticos, que confirmaram – e, assim, possibilitaram a conclusão da dissertação – a constitucionalidade do artigo 557 e a importância de sua interpretação conforme os referidos princípios constitucionais. / This dissertation has the purpose to analise the institutes of the single verdict and the internal appeal, according to empirical methodology that focus the pragmatic reality of the 557 th. dispositive of Code of Civil Procedure`s enforcement. This dissertation focused the institute of the single verdict in the context of the reformation of the Brazilian Code of Civil Procedure, which had as foundation the principle of procedure efectiveness. This principle presupposes a reasonable duration of the suit, secured by the Brazilian Federal Constitution. From the constitutionality of this principal, this dissertation defended the constitutionality of the 557 th. dispositive of Code of Civil Procedure, which can`t be considered abstractedly unconstitutional. This dissertation proved that the enforcement of the 557 th. dispositive could be unconstitutional if doesn`t suit the technique of the weighing of values, which secures the interpretation according to the Brazilian Federal Constitution. This dissertation analised the internal appeal, under the presupposition of the value of the reasonable duration of the suit in comparison with the due process of law, which motivate the following analysis of the internal appeal proceeding. After a reflection of single verdict and the internal appeal institutes, also with the analysis of due process of law, legal defense, adversary system and the motivation of the judgement, this dissertation analised the empirical enforcement of these institutes. In this analysis, estatistic data have been collected, which corroborate – and, therefore, enabled the conclusion of the dissertation – the constitutionality of the 557 th. dispositive of Code of Civil Procedure and the consideration of its interpretation according to the mentioned constitucional principles.

Perfectionism : an exploratory analysis of treatment resistant eating disorder clients during intervention

To gain a better understanding of those struggling with severe eating disorders (anorexia nervosa and bulimia nervosa), the inner life-world and subjective experiences of therapy clients were explored within the South African context. This was an empirical qualitative study. Specifically, the study’s focus was on the psychological construct of perfectionism as experienced during the respondents’ treatment resistant eating disorders. The two objectives of the research were to describe and explain perfectionism, which served to increase an overall improved understanding of perfectionism. The study’s methodology encompassed a combination of phenomenological- and grounded theory methodology, exploring the narratives of six female candidates that were undergoing individual therapy for their eating disorders. These candidates were considered to have a treatment resistant eating disorder, because they had been struggling with this diagnosis for longer than a decade, and/or had previously received multiple treatment interventions without recovering. The therapy sessions were recorded via digital audio recordings, and used in the data analysis process. The discourses pertaining to the study’s focus were transcribed and analysed using phenomenological- and grounded theory methods. The phenomenological analysis produced individual descriptions of the participants’ experiences of their perfectionism, as well as a general description for perfectionism. The grounded theory analysis produced an emerging theory in the form of a cognitive schema. This schema was named The Perfectionistic Eating Disorder Self-schema (PEDSS), and explains the inner psychological process of perfectionism within a treatment resistant eating disorder client. The results of this study, in particular the PEDSS, has implications for those trying to understand, assist, and treat those who suffer from treatment resistant eating disorders, as well as helping those who struggle with perfectionism to understand their own problem more. / Psychology / D. Aspects of succession law in ancient Egypt with specific reference to testamentary dispositions

Text in English / This study indicates the strong link between the belief in the afterlife and the inception of testamentary dispositions in ancient Egypt. To understand law, and specifically succession law, the importance of religion must be understood. Religion was embedded in society. One of the most important principles of religion was maat, which formed the basis for law. The living and dead formed part of the same community. The belief in the afterlife implied an immortality, an eternal continuation of life. There was a moral relationship between the dead and living and the deceased was dependent on sustenance after death. There was an obligation for the family to sustain the deceased, but this piety diminished and a need arose to make arrangements for sustenance prior to death. This led to the inception of the testamentary disposition document. The purpose of succession law is to maintain and strengthen the socio-economic structure in society and it therefore fulfils a social function. At the heart is the nuclear family. In ancient Egypt two systems of succession law developed: customary intestate succession and testate succession (by way of testamentary disposition). Different types of documents were used in ancient Egypt to serve the purpose of a testamentary disposition, such as the pious foundation and the imyt-pr. Important concepts and elements of succession law from the Old, Middle and New Kingdoms are identified and discussed. These include fideicommissum, trusts, usufruct, habitatio, legacies, the importance to indicate ownership of property, etc. The testamentary disposition documents of ancient Egypt must be one of the earliest examples of testate succession law. The Egyptian testamentary disposition, with its concepts and elements of succession law, was established centuries before Rome and Roman law were established. O comportamento lingüistico na comunidade bilíngüe ítalo-brasileira de Nova Pádua/RS : identidade, prestígio e estigma lingüísticos

Esta pesquisa foi desenvolvida na comunidade lingüística ítalo-brasileira de Nova Pádua, situada Nordeste do Rio Grande do Sul, fundada em 1885 por imigrantes italianos. Esse grupo etnolingüístico convive com uma situação de línguas em contato e bilingüismo. O objetivo deste estudo foi investigar atitudes lingüísticas dos bilíngües em relação aos sistemas de fala utilizados pelo grupo étnico-social: a língua portuguesa standard, o dialeto italiano (Coiné) e a variedade de fala de língua portuguesa local. A investigação partiu do pressuposto de que os bilíngües adotam atitudes positivas ou negativas, de prestígio ou estigma, em relação às variedades lingüísticas. Além disso, pressupõe-se que o comportamento dos bilíngües é regulado por valores atribuídos às línguas. Os resultados mostraram uma gama de valores positivos e negativos atribuídos e percebidos nas variedades lingüísticas, e esses valores orientam o uso dessas variedades. Não só a avaliação positiva ou negativa orienta o comportamento lingüístico dos bilíngües, mas também fatores extralingüísticos como situações de interação formal ou informal e a solidariedade ao interlocutor. Inesperadamente, a pesquisa mostrou um conflito de valores e de identidade lingüísticos entre os participantes da amostra. Esse conflito revelou-se na contradição existente nos juízos de valor atribuídos às variedades lingüísticas, nas duas situações de avaliação propostas pela pesquisa. Na primeira, em que o falante seria uma terceira pessoa e não o sujeito da pesquisa, o dialeto italiano é o sistema de fala de maior prestígio, e a língua portuguesa standard, a língua de menor prestígio. As atitudes positivas em relação ao dialeto italiano ou dialeto vêneto (Coiné) apontam para uma ligação afetiva entre o sentimento étnico italiano e a identidade lingüística da amostra. Contraditoriamente, para uma situação interpessoal, em domínios usuais como: casa, Capela, escola, em que o próprio bilíngüe deveria falar, os valores divergiram. Isto é, os sistemas de fala de língua portuguesa, local e standard, receberam maior prestígio do que o dialeto italiano. Essas atitudes foram justificadas, entre outros motivos, pela necessidade de domínio da língua portuguesa, pela solidariedade ao interlocutor e pelo reconhecimento de uma forma lingüística de língua portuguesa local, língua portuguesa com marcas italianas. Dessa forma, os dados mostraram que a identidade lingüística italiana é mais idealizada e/ou nostálgica do que real. Em contrapartida, parece surgir um latente reconhecimento de uma prática lingüística ítalo-brasileira local. / This reasearch was developed in an Italo-Brazilian linguistics community of Nova Pádua, located in the northeast of Rio grande do Sul, which was founded in 1885 by Italian imigrants. This etnolinguisitcs group lives with a situation of bilinguism and languages in contact with each other. The aim of our work was to investigate the linguistics attitudes of the bilingual speakers in relation to the used speaking systems by the ethnic-social: the standard Portuguese language, the Italian dialect (Coiné) and the variety of the local speaking Portuguese language. The investigation began with the presupposition that bilingual speakers have positive or negative attitudes, prestige or stigma, in relation to the linguistics varieties. Besides this, we presupposed that bilingual speakers behaviour is measured by the values given to the languages. The results showed a series of positive and negative values related and perceived in the linguistics varieties. Not just the positive and negative evaluation guides the linguistics behaviour of bilingual speakers, but also extra-linguistics factors as a formal interation situation or the speaker s solidarity. Surprisingly, the research showed a conflict of values and linguistics identity in the sample. This conflict was revealed in the contradiction of the values judgement given to the linguistics varieties in the two evaluation proposals suggested by the research. In the first proposal, where the speaker is a third person, not the one belong to the research, the Italian dialect is the speaking system of the greatest prestige and the standard Portuguese language, the language of minor prestige. The positive attitudes in relation to the Italian dialect direct to an afective link between the Italian ethnic feeling and the sample s linguistic identity. Contradictorily, for an interpersonal situation, in usual dominions as house, school, chapel where the own bilingual should speak, the values differ. It means that the regional and standard Portuguese language speaking systems receive more prestige than the Italian dialect. Among other aspects, these attitudes were justified by the necessity of the Portuguese language dominium, by the speakers solidarity and by the recognition of a linguistics form of a local Portuguese language, Portuguese with Italian marks. By all these, the dates showed that the Italian linguistics identity is more idealized and/or nostalgic than real.On the other side, it seems appearing a latent recognition of a local Italo-Brazilian linguistcs practice.

New Public Phronesis : Ett mellanrum med möjligheter

I den vetenskapliga essäns form undersöker jag hur dagens styrningsideal och metoder påverkar vårdarens möjligheter att utveckla och praktisera fronesis. Fronesis är den benämning som filosofen Aristoteles använder om praktisk kunskap och klokt omdöme. Jag undersöker också hur styrningsidealen påverkar människosyn och bildningens villkor i ett vidare samhällsperspektiv. Jag ger utrymme åt begreppsutredning av fronesis eftersom det är en kunskapsform som har stor giltighet i sjukvården liksom i de flesta yrken där fokus ligger på det mellanmänskliga mötet och dess möjligheter men även utmaningar. Jag diskuterar mellanrummens betydelse och vikten av att ta ansvar för det som finns där. Det visar sig att i mellanrummen finns humanvetenskapen och vårdkonsten. Utan dessa riskerar det mellanmänskliga mötets underverk att utebli och det etiska vetandet att ersättas av ren rationalism. I min undersökning kommer jag fram till att hermeneutiken är en möjlighetsfilosofi i mötet med New Public Management. Alternativet som växer fram kan bli New Public Phronesis. / By using the scientific essay as a method, I investigate how today's governing ideals and methods affect the healthcare provider's ability to develop and practice fronesis. Fronesis is the term used by philosopher Aristotle on practical knowledge and wise judgment. I also investigate how the governance ideals affects view of man and the conditions of cultivation in a broader social perspective. I devote myself to the concept of fronesis because it is a form of knowledge which is of great value in health care, as well as in most professions with focus on interpersonal meetings with opportunities but also challenges. I discuss the importance of spaces and the importance of taking responsibility for what´s in there. It turns out that the spaces are where human science and art of care is practiced. Without these, the miracle of interpersonal meeting risks losing out and ethical knowledge to be replaced by pure rationalism. In my survey, I conclude that Hermeneutics is a philosophy of opportunities in meeting New Public Management. The emerging alternative might be New Public Phronesis.

Polyphibianism : evolving transdisciplinarity into an imaginary organism of living knowledge

Transdisciplinarity emerged from the urge to grasp the elusive knowledge in the most fertile zone in between and beyond disciplines that escapes even the most elaborate interdisciplinary operations. While interdisciplinary protocol enables experts to operate within foreign disciplines, in the extreme case as diverse as art and science (by inviting artists into scientific departments and vice versa), the production of knowledge remains confined to particular domains. To transcend these confinements and access the knowledge that evades institutionalisation Basarab Nicolescu’s Manifesto of Transdisciplinarity sets up conditions for an open structure to be grown outside the current compartmentalisation into a living knowledge. This thesis imagines a possible evolution of transdisciplinarity into knowledge to be lived internally rather than learnt externally in order to overcome the anxiety in transcending the established culture of disciplinary research. By entering the transdisciplinary zone, the identity of experts-specialists dissolves, even the crudest separation into artists and scientists becomes obsolete. From the illusion of losing control over knowledge arises the fear of a return to archaic, mystic or even shamanic ways of knowing. Far from proposing a return to shamanism in its ancient forms this thesis imagines the way of polyphibianism – an imaginary solution to navigate efficiently the protoplasmic state of knowledge that would be indigenous to culture of disciplinary researchers. With every significant discovery the disciplinary researchers already intuitively trespass into the very zone that the Manifesto of Transdisciplinarity invites them to enter intentionally. From examination of documented introspective inquiries into their act of discovery the thesis infers the necessary sensibilities and adaptabilities of the individuals to cross the borders of their disciplines. Their seemingly lost identity is temporarily restored with the term polyphibian (analogous to amphibian) designating their ability to survive and explore multiple environments. With each change of circumstances in research a polyphibian adapts by swiftly reinventing its instinctive instruments, mutating its organs of knowing, indifferently to conventional habits of thought. Through their introspective writings this thesis investigates the polyphibic aptitude of Henri Poincaré, Henri Bergson and Marcel Duchamp to scout at the periphery of physics, metaphysics and ‘pataphysics, to intuitively anticipate the role of chance, chaos and complexity in both arts and sciences. A threshold of complexity has to be surpassed in order to bring the current apparatus of knowledge to life. Bergson’s insight on laughter and dreams suggests how intellect could transcend itself. The thesis proposes to consider laughter as faculty that could induce self-awareness in the intellectual apparatus while dreams are considered to facilitate self-organisation of intellect on higher orders of awareness. In Deleuzian manner of mutating Bergson’s work into Bergsonism, polyphibianism is a mutation in transcribing the code of Creative Evolution where Bergson insisted on interdependency between the theory of knowledge and the theory of evolution. The scholarly dispute on Bergsonian and anti-Bergsonian tendencies present in Marcel Duchamp’s work is revisited in the thesis by interpreting the higher dimensional Bride as a polyphibic organism of living knowledge with access to higher orders of awareness, able to guide the Bachelor’s apparatus of mechanical production and preservation of knowledge out of its predicament. Informed by peculiar Duchampian experiments that challenged both the domain of art and science the research projects in this thesis consist of an intervention at CERN that tested the impenetrability of institutionalised art-science collaborations and installation of the Interval of Suspended Judgement with high mathematical precision at the threshold between physics and ‘pataphysics. With these projects the problems of categorising researchers into artists and scientists are revealed. As Deleuze suggested, to effectively formulate the problem, to realize it in multiplicity of contexts, a new concept must be invented, a new organism must be conceived. This thesis gave birth to an imaginary organism of living knowledge in order to relieve the unnecessary anxieties and to fully engage in transdisciplinary research.
