The needs of FET learners for personal well-being

Personal well-being is a state that involves feelings and thoughts. This concept is investigated in learning area Life Orientation and integrated in the curriculum as a learning outcome for Further Education and Training learners in grades 10-12. A literature study was done to discuss/clarify dimensions of personal well-being that is general subjective, psychological, social and spiritual well-being and mental health. Perspectives, theories, principles and features pertaining to well-being were investigated from an international and local context. An exploratory study used a qualitative approach to investigate and observe perceptions of a small sample of learners of personal well-being. Data gathering used focus groups which completed structured group work activities. The results indicate that learner participants have needs to be satisfied to reach a sense of personal well-being. Based on findings, recommendations regarding coping strategies, intervention strategies and support were made. / Educational Studies / M.Ed. (Guidance and Counselling)

從兩性平等探討我國女性勞動者保護法令 / A Critique on Female Worker's Protection Legislation from the Perspective of Gender Equality

摘 要 本文旨以保護與兩性平等之關聯性著手,「從兩性平等探討我國女性勞動者保護法令」,首先探究當前我國女性勞動者在勞動市場上所面臨之就業困境,其次探討聯合國、國際勞工組織、歐洲聯盟、經濟合作發展組織、美國、英國、日本等關於兩性工作平等法制之國際概況,並針對美、英、日三國在(1)就業上性別歧視之禁止(2)同工同酬原則之確立(3)兩性職業隔離之突破(4)工作場所性騷擾之禁止(5)母性保護原則(6)積極促進兩性工作平等方案之推動(7)兩性工作平等制度之執行機關與救濟途徑等重要兩性工作平等法制內容做比較分析與整理,以作為我國在推動與落實兩性工作平等法制之考據。最後針對我國現行保護女性勞動者及規範兩性工作平等事項之各類相關法律,做一整體檢討,並討論應如何將這些規定與追求兩性工作平等之理念相調和,藉以加強母性機能之特別保護,且同時又能落實兩性就業上待遇及機會之均等,從而創造雙贏之局面。 本文研究發現,雖然憲法、兩性工作平等法及相關女性勞動保護法令已明文針對性別平等以及婦女保護作規定,但卻未真正落實,致使我國女性勞動者在剛踏入職場的第一步便遭受招募上之性別歧視的困境,其勞動參與率偏低,薪資水準亦較男性勞動者低,且在勞動市場中,存在著明顯性別職業隔離現象,另外我國企業主給予女性勞動者之在職訓練與升遷機會均較男性勞動者少,而勞動市場中更存在著性騷擾、單身條款、婚育離職之現象與離職後二度就業之困難,如此諸多不利女性之就業現況,使我國女性勞動者在目前就業市場中處於劣勢地位且受到差別待遇。 另從本文「第四章 兩性工作平等國外法制之概況」、「第五章 美、英、日關於兩性工作平等制度之重要內容」研究兩性工作平等理念在國際間之趨勢,得知傳統勞動保護法制所強調之女性保護概念,已呈現不同之面貌,其由單純以女性保護這項因素作為立法保護之依據,已轉變從兩性平等出發,而現今科技與勞動醫學發達,亦是考慮是否給予女性勞動者保護之因素。因此過去對女性勞動條件之保護,有部分已經不符合上述潮流,且已無法滿足今日勞動樣態之多元化,反而成為部分女性進入勞動市場之障礙。但關於母性機能之保護,對女性或對國家、社會全體而言,具有不可欠缺之意義。同時,對於男女僱用平等原理之達成,亦是絕對必要之條件。因此,施行母性保護措施是從側面支持男女僱用平等原理的具體化行動,且母性機能之不可回復性,乃是基本母性保護不可遽然偏廢之主要理由。即便國際勞動組織之國際勞動公約不斷受到各國挑戰,但在限縮母性保護並予以彈性化之同時,亦課以國家在相關社會立法的周邊補充措施。可見國際潮流已從過去傳統女性勞動保護法制逐漸趨向兩性平等待遇及僱用機會均等原則邁進,但對基本母性保護仍採特別保護規定。 此外,經本文「第三章 我國女性勞動者就業之困境」及「第六章之第二至八節 我國現行各相關女性勞動者保護法制」之檢視後,發現我國現行女性勞動者保護法制漏洞百出,無法真正落實兩性於工作上之實質平等,雖已制定兩性工作平等法積極推動,但因現行兩性工作平等法之各法條過於簡要,不像國外先進國家針對各促進兩性工作平等相關法制以單獨立法方式或以詳盡之配套措施作輔助,故難免有掛一漏萬之處。此外,尚未對其相關法制作同步修法,使其各相關法制在運用上經常有衝突或矛盾之現象產生,此有待亟早修法改善,故本文「第七章」針對現行我國女性勞動者保護法令之立法缺失,提出法令面修正及實務面之建議方向,期盼藉此政策與法令改革,以達成我國憲法增修條文第十條第五項所揭櫫:「……消除性別歧視,促進兩性地位之實質平等」的崇高目標。

À cet effet, l'auteur résume les règles entourant les offres publiques d'achat, examine les principes touchés par la mise en place d'un régime de droits de souscription d'actions, ainsi que les effets d'un tel régime sur la valeur des actions. Dans un deuxième temps, l'auteur se penche sur la légalité des régimes de droits de souscription d'actions en effectuant une revue du principe de l'égalité des actionnaires et des droits et obligations des administrateurs en matière de défense à une offre publique d'achat. L'auteur termine en effectuant une revue des divers recours qui s'ouvrent aux divers intervenants. / The present thesis tries to review the main rules regarding the creation and the application of a shareholders rights plan. The author reviews also the sections of the Securities Act pertaining to the Take-Over bid. The author also explains the main principles of the corporation law domain and how a shareholders rights plan may be implemented. Second, the author reviews the legality of the implementation of the shareholders rights plan with regards to the shareholders rights given by the Law, and to the obligations and duties of the directors of the Corporation. At the end of the present thesis, the author presents a review of the main recourses opened to the Shareholders, the corporation and the bidder.

Such a possibility is found regulated in § 39, of article 515 of the Civil Process Code, where it is foreseen that in cases of the Gonclusionof lhe process wíthout judgement of the merit, the court may, upon finding itself convinced about the matter placed betore it, and being only of law, immediately decide the dispute. Lucie Novotná Krtoušová Abstract The aim of the presented doctoral thesis entitled "Theoretical Concept of Liability of Members of the Governing Bodies of Juristic Persons" is to determine what requirements can be placed on natural persons who act as members of the governing bodies of juristic persons, and to specify the substance of due managerial care as a legal basis for potential liability. The Civil Code lays down the duty of a governing body member to act with due managerial care in the discharge of his/her office in its general part; the relevant provisions thus apply to members of the governing bodies of all juristic persons under both private and public law, provided that this is compatible with their legal nature. Compliance with the duty of due managerial care - in cases where the governing body members act as representatives of the juristic person - is the decisive criterion for determining whether or not they will be liable to the juristic person for any damage caused in the discharge of their office. However, it is questionable whether this is a case of fault-based liability for breach of a legal duty or strict liability for breach of a contractual obligation. Responsibility, spontaneity and liberty

Isaiah Berlin maintains that there are two distinct forms of freedom or liberty: negative and positive. Berlin’s principal claim is that negative liberty does not require that the self be somehow separate from the empirical world (causally aloof, or an originator of causal chains). My principal claim is that to be an agent is to be committed to a separation of self in this sense, thus that the self for its very being requires to possess a species of positive liberty. This conception proceeds in part from Immanuel Kant’s claim that there is a separation between spontaneity and receptivity. Commitment to this assertion allows there to be an understood distinction between the self as a spontaneous self-active agent that makes choices, and the self as a mere reactionary brute that does what it does by biological imperatives. In this thesis, I defend the view that negative liberty is subsumed under positive liberty: you cannot have the former without the latter. I am therefore taking a rationalist stance towards Berlin’s thinking. My methodology is to bring into consideration two perspectives upon the underlying normative principles within the space of reason. The first is of Kant’s understanding of the principle of responsibility and the activity of spontaneity; the second is John McDowell’s understanding of that principle and activity. The key claim of this thesis is that Berlin misunderstands what it is to be a chooser. To be a chooser is to be raised under the idea that one is an efficient cause; human children are brought up being held responsible for their reasons for acting. This principle allows mere animal being to be raised into the space of reason, where we live out a second nature in terms of reason. Using their conclusions I further investigate Berlin’s understanding of conceptual frameworks, taking particular interest in historic ‘universal’ conceptions that shape human lives. He too finds that that we are choosers is necessary for what it is to be human. I take his conclusion, and suggest that if he had had a clear understanding of the space of reason, the historic claim that we have choice would find a more solid footing in the principle of that space, in that we are responsible for our actions. I conclude that the upshot of understanding the ‘I’ as an originating efficient cause is that we treat ourselves as free from a universal determinism that Berlin himself disparages; and that the cost to Berlin is that all choice is necessarily the activity of a higher choosing self. It is part of a Liberal society’s valuing, by their societal commitment to, the ideology of raising our children to understand themselves as choosers, that we have choice at all. This is irrespective of whether that which fetters choice is internal or external to the agent, or of whether having self-conscious itself requires such a cultural emergence of second nature.

Att främja reflektion och samarbete : En essä om facilitatorns yrkeskunnande

Den här uppsatsen handlar om facilitatorns roll och yrkeskunnande. En roll som är relativt ny och för de flesta fortfarande helt obekant. Facilitatorn anlitas för att underlätta för grupper att föra samtal och dialog, men också för att gemensamt reflektera. Viktiga förutsättningar för att hitta formerna för fruktbara samarbeten, vilket står högt på många organisationers agendor idag.   I uppsatsen redogör jag inledningsvis för den möteskultur som råder inom organisationer idag. En kultur där medarbetare och chefer avsätter mycket tid i möten som vare sig ger dem själva, organisationen eller samhället något av värde. Det är många gånger envägskommunikation eller förmedling av information. I en tidsanda som ställer höga krav på rationaliseringar och effektivseringar har det dessvärre också blivit så, att tiden för samtal och genuina dialoger succesivt har reducerats till förmån för ökad kommunikation i olika digitala kanaler, inte misnt e-mail och sociala medier. Jag vill hävda att vi människor behöver träffas och samtala för att nå en gemensam och fördjupad förståelse för varandra och våra olika sakfrågor. Vad händer på sikt om vi inte ges möjlighet till gemensam reflektion? Hur ska vi kunna samarbeta om vi inte lär känna varandra och de förutsättningar som råder?   I inledningen redogör jag även för delar av den kunskapsteori som finns kopplat till ämnesområdet yrkeskunnande och teknologi, men också för min mission – att återerövra samtalet som en viktig arbetsmetod. Uppsatsen är skriven i essäistisk stil och det empiriska materialet kommer från de texter jag själv har författat under masterutbildnignens två år då dialogseminariemetoden tillämpats, men också från den dialogseminarieserie som jag själv har genomfört med sex andra facilitatorskollegor. Tillsammans har vi börjat utforska vår gemensamma profession och det yrkeskunnande som vi representerar.   Facilitatorns yrkeskunnande är mångfacetterat och svårfångat, men handlar i mångt och mycket om att vara öppen för människors olikheter. Se dem som berikande. Vara krockfrämjande. Bejaka olika perspektiv och infallsvinklar på saker och ting. Inte vara rädd för att konfrontera. Facilitatorn jobbar med olika tempoväxlingar och har en mängd olika metoder och tekniker till sitt förfogande för att möta olika problemställningar. Planerat eller improviserat. Det finns tydliga analogier med teatern, men också med läkar- och läraryrket. Det handlar om att skapa spänningar och väcka känslor hos deltagarna. Och sedan ta hand om och förvalta de känslor som väckts. Som facilitator blir man aldrig fullärd. Alla grupper är olika och varje ny mötessituation bjuder på nya utmaningar.   För mig känns det som att resan mot bättre vetande precis har börjat. I mina texter kan jag skönja en utveckling över tid, men det finns otaliga gator kvar att utforska. Jag är fortsatt nyfiken och jag vet bestämt att jag vil fortsätta att fördjupa mina kunskaper om facilitatorns yrkeskunnande och gärna då med dialogseminariet som fortsatt forskningsmetod. / This thesis explores the role and skills of a professional facilitator. A facilitator is hired to facilitate meetings and other group processes trough dialogue, conversations and active participation, with the purpose of makig reflection and collaboration within and between organisations possible.

O comportamento lingüistico na comunidade bilíngüe ítalo-brasileira de Nova Pádua/RS : identidade, prestígio e estigma lingüísticos

Esta pesquisa foi desenvolvida na comunidade lingüística ítalo-brasileira de Nova Pádua, situada Nordeste do Rio Grande do Sul, fundada em 1885 por imigrantes italianos. Esse grupo etnolingüístico convive com uma situação de línguas em contato e bilingüismo. O objetivo deste estudo foi investigar atitudes lingüísticas dos bilíngües em relação aos sistemas de fala utilizados pelo grupo étnico-social: a língua portuguesa standard, o dialeto italiano (Coiné) e a variedade de fala de língua portuguesa local. A investigação partiu do pressuposto de que os bilíngües adotam atitudes positivas ou negativas, de prestígio ou estigma, em relação às variedades lingüísticas. Além disso, pressupõe-se que o comportamento dos bilíngües é regulado por valores atribuídos às línguas. Os resultados mostraram uma gama de valores positivos e negativos atribuídos e percebidos nas variedades lingüísticas, e esses valores orientam o uso dessas variedades. Não só a avaliação positiva ou negativa orienta o comportamento lingüístico dos bilíngües, mas também fatores extralingüísticos como situações de interação formal ou informal e a solidariedade ao interlocutor. Inesperadamente, a pesquisa mostrou um conflito de valores e de identidade lingüísticos entre os participantes da amostra. Esse conflito revelou-se na contradição existente nos juízos de valor atribuídos às variedades lingüísticas, nas duas situações de avaliação propostas pela pesquisa. Na primeira, em que o falante seria uma terceira pessoa e não o sujeito da pesquisa, o dialeto italiano é o sistema de fala de maior prestígio, e a língua portuguesa standard, a língua de menor prestígio. As atitudes positivas em relação ao dialeto italiano ou dialeto vêneto (Coiné) apontam para uma ligação afetiva entre o sentimento étnico italiano e a identidade lingüística da amostra. Contraditoriamente, para uma situação interpessoal, em domínios usuais como: casa, Capela, escola, em que o próprio bilíngüe deveria falar, os valores divergiram. Isto é, os sistemas de fala de língua portuguesa, local e standard, receberam maior prestígio do que o dialeto italiano. Essas atitudes foram justificadas, entre outros motivos, pela necessidade de domínio da língua portuguesa, pela solidariedade ao interlocutor e pelo reconhecimento de uma forma lingüística de língua portuguesa local, língua portuguesa com marcas italianas. Dessa forma, os dados mostraram que a identidade lingüística italiana é mais idealizada e/ou nostálgica do que real. This etnolinguisitcs group lives with a situation of bilinguism and languages in contact with each other. The aim of our work was to investigate the linguistics attitudes of the bilingual speakers in relation to the used speaking systems by the ethnic-social: the standard Portuguese language, the Italian dialect (Coiné) and the variety of the local speaking Portuguese language. The investigation began with the presupposition that bilingual speakers have positive or negative attitudes, prestige or stigma, in relation to the linguistics varieties. Besides this, we presupposed that bilingual speakers behaviour is measured by the values given to the languages. The results showed a series of positive and negative values related and perceived in the linguistics varieties. Not just the positive and negative evaluation guides the linguistics behaviour of bilingual speakers, but also extra-linguistics factors as a formal interation situation or the speaker s solidarity. Surprisingly, the research showed a conflict of values and linguistics identity in the sample. This conflict was revealed in the contradiction of the values judgement given to the linguistics varieties in the two evaluation proposals suggested by the research. In the first proposal, where the speaker is a third person, not the one belong to the research, the Italian dialect is the speaking system of the greatest prestige and the standard Portuguese language, the language of minor prestige. The positive attitudes in relation to the Italian dialect direct to an afective link between the Italian ethnic feeling and the sample s linguistic identity. Contradictorily, for an interpersonal situation, in usual dominions as house, school, chapel where the own bilingual should speak, the values differ. It means that the regional and standard Portuguese language speaking systems receive more prestige than the Italian dialect. Among other aspects, these attitudes were justified by the necessity of the Portuguese language dominium, by the speakers solidarity and by the recognition of a linguistics form of a local Portuguese language, Portuguese with Italian marks. By all these, the dates showed that the Italian linguistics identity is more idealized and/or nostalgic than real.On the other side, it seems appearing a latent recognition of a local Italo-Brazilian linguistcs practice.
