Le droit public des utilisations du sous-sol : réflexions sur le régime juridique des stockages géologiques de déchets / Public law on subsoil uses : research on legal framework for underground storage

Des déchets industriels de toutes natures sont enfouis en sous-sol pour un temps indéterminé. Ce déplacement spatial et temporel des déchets confronte les règles de droits à deux univers particuliers, et plus ou moins lointains, le sous-sol et le long terme. Les cadres juridiques des stockages géologiques vont accompagner la technique de stockage souterrain dans son rôle d'exécutoire pour les activités industrielles menées aujourd'hui en surface. Le stockage géologique déplace la charge environnementale des déchets. D'une part, le sous-sol possède un cadre juridique propice à son exploitation industrielle et donc à son utilisation comme lieu de stockage de déchets. Cela est susceptible de heurter les différents usages du sous-sol. Des arbitrages entre les intérêts en conflits doivent être réalisés, au plan technique mais aussi démocratique, s'agissant des modes d'élaboration des décisions publiques relatives à l'espace géologique. Les droits d'exploiter les ressources souterraines peuvent, en outre, entraver les mesures de protection environnementale. D'autre part, le stockage géologique oblige les règles de droit à se projeter dans le temps. Les outils juridiques pour appréhender le futur sont mis à l'épreuve. La difficulté est de partager le fardeau des déchets au cours du temps, entre la sphère publique et la sphère privée. De la même façon, l'enfouissement de déchets dangereux à des échelles transgénérationnelles interroge le contenu et la portée de la responsabilité juridique envers les générations futures. / Industrial waste of all kinds are burried in the underground for an indefinite period of time. With this displacement, both in space and time, the rules of law face the challenge of two specific, and more or less distant, worlds: the subsoil and the long term. Legal frameworks for underground storage strengthen the technique of underground storage in its role as an outlet for industrial activities which are carried out on the surface. Underground storage shifts the environmental load of waste. On the one hand, the legal frameworks for subsoil use is favourable to industrial exploitation and therefore to the use of the underground as a storage place for waste. When it comes to the decision-making process for public action in relation with the subsoil, arbitration must be made between the competing interests at stake, both in democratic and technical terms. Besides, the rights to exploit the underground ressources can hamper environmental protection measures. On the other hand, underground storage compels the rules of law to look to the future. The legal tools to anticipate the years ahead are placed under severe strain. The challenge lies in how to share the burden of waste over time between the public and the private spheres. In the same way, the landfill burial of hazardous waste on a transgenerational scale questions the content and scope of legal responsability towards future generations.

La territorialité et l’Union européenne : approches de droit public / Territoriality and european union : public law approaches

La confrontation de la territorialité à l’Union européenne constitue une analyse originale, dans la mesure où la territorialité est traditionnellement exclusivement associée à l’Etat et à la souveraineté. La territorialité se caractérise par une polysémie, véritable « pêché originel » du concept. Elle peut cependant être utilisée à profit, afin de dégager toutes les virtualités de la confrontation entre un système politique en construction et un principe rattaché à l’Etat. En se fondant sur les mutations qui affectent ce dernier, et dans un contexte propice à la globalisation et à l’internationalisation des relations, l’analyse qui se dégage prima facie de cette confrontation tend à démontrer une perte de pertinence de la territorialité au sein de l’Union. Celle-ci s’est en effet construite sur un certain effacement des frontières et la constitution de territoires propres. L’affaiblissement du principe sera ainsi effectivement vérifié. Etudiée sous l’angle des matières publiques, l’étude apporte toutefois une approche transversale nouvelle de la problématique. La mise en contact des systèmes juridiques nationaux engendre des situations transnationales et nécessite l’élaboration de techniques juridiques qui bouleversent les cadres conceptuels nationaux. En outre, l’Union européenne ne constitue pas une entité abstraite, désincarnée ; elle est la créature de ses Etats membres. Elle est donc, dans une certaine mesure, structurée par la territorialité des Etats qui répercutent sur elle, leurs spécificités. Par conséquent, loin de s’inscrire dans des relations simplistes, la confrontation de la territorialité à l’Union européenne aboutit davantage à la démonstration d’une relation dialectique. / Juxtaposing the concept of “territoriality” and the European Union is a rather original analysis in so far as territoriality is traditionally associated with the State and with sovereignty. The term "territoriality" in itself, despite its "original sin", that is to say its polysemous feature, can be used favourably to reveal the potential of comparing a political system in the making with a State-related principle. Given the changes that the State is undergoing and the development of globalisation and the internationalization of relations, the comparison between “territoriality” and the EU would indicate, at first sight, that the former loses its relevance within the Union. The EU was indeed built upon the removal of borders and the creation of a “unified” territory. The weakening of territoriality is examined in this study which also offers an original, cross-cutting approach to the topic from a public law perspective. The divergence between the legal systems of each nation results in transnational situations and requires new legal approaches which profoundly alter national frameworks. However, the European Union is not an abstract or unreal entity; it is the product of its Member States, based upon the territoriality of these States, which, to a certain extent, bring their own specificities. Consequently, comparing territoriality and the European Union is more complex than a simplistic understanding of the two concepts may imply and leads more to a demonstration of dialectic tension.

Its analysis passes through the perception of a new international dynamic that places the state sovereignty, previously seen as unlimited, as something relative, which ends up propitiating the understanding that the immunity of jurisdiction is a value that may suffer limitations. The facts that triggered the relativization of this immunity serve to understand the gradual adaptation of its regulation to the characteristics of the international public law, upon the division of the acts practiced by the States into acts of government and acts of management. Having relativized the immunity in the procedure s instruction phase, thesis already appeased both in Brazil and in the majority of the countries of the international community, the challenge is to mitigate the immunity in the enforcement of the judgment decision phase, which continues generating polemics, maintaining almost absolute. This situation shows to be inefficient for solution of the majority of labor-related conflicts between domestic employees and foreign entities governed by public law, whether due to the difficulty in finding goods from the foreign State possible of being expatriated, whether due to the lack of execution of this procedure through the diplomatic means. We will thus seek to propose new guidelines to make effective the final verdict in labor lawsuits filed by national persons against foreign entities governed by public law, based on the fact that work is a constitutionally ensured human value in our country, to be observed inclusively by a foreign State, without this harming its sovereignty / O presente trabalho tem por objetivo desenvolver um estudo sobre a imunidade de jurisdição e de execução do ente público externo que contrata trabalhadores brasileiros. Sua análise passa pela percepção de uma nova dinâmica internacional que coloca a soberania estatal, antes tida como ilimitada, como algo relativo, o que acaba por propiciar o entendimento de que a imunidade de jurisdição é um valor passível de sofrer limitações. Os fatos que desencadearam a relativização dessa imunidade servem para entender a gradual adequação de sua regulação às características do direito internacional público, mediante a divisão dos atos praticados pelos Estados em atos de império e atos de gestão. Relativizada a imunidade na fase de conhecimento do processo, tese já pacificada tanto no Brasil como na maioria dos países da comunidade internacional, o desafio é abrandar a imunidade na fase de execução de sentença, que continua gerando polêmicas, mantendo-se quase absoluta. Essa situação mostrase ineficiente para a solução da maioria dos conflitos de natureza trabalhista entre empregados nacionais e entes de direito público externo, quer pela dificuldade de se encontrar bens do Estado estrangeiro passíveis de serem expropriados, quer pela falta de efetivação desse processo pela via da diplomacia. Buscaremos, dessa forma, propor novas diretrizes para tornar efetiva a sentença condenatória em ações trabalhistas movidas por nacionais contra os entes de direito público externo, com fundamento de que o trabalho é valor humano constitucionalmente assegurado no nosso país, a ser respeitado inclusive pelo Estado estrangeiro, sem que com isso seja ferida a sua soberania

Is the R2P- principle inefficient against the Security Council’s veto system? : - China’s indoctrination camps of Uyghur and Kazakh Muslim minorities in Former East Turkestan

During the UN World Summit 2005 all Member States of the United Nations unanimously accepted the Responsibility to protect- principle (R2P- principle), that each member state shall protect its own population from ethnic cleansing, genocide, war crimes and crimes against humanity. During the set-up of the United Nations and the Security Council’s veto system in the San Francisco Conference 1945, the five permanent members of the Security Council promised that their right to veto would be used “sparingly” and in the “interest” of the world organization, to safeguard “the International peace and security”. Despite the united acceptance of the R2P- principle to avoid mass atrocities since 2005, China have been detaining up to one million Uyghur, including Kazakhs in detainment camps, in former East Turkestan since the beginning of 2018. Since the passage to invoke the R2P- principle is by the Security Council, the question arises if- the veto would serve as a deadlock on the R2P- principle if China could veto such decision. The purpose of the thesis have therefore been to analyze if the R2P- principle is inefficient against the Security Council’s veto system, by targeting China’s opportunity of vetoing the R2P- principle. The conclusion have been that the R2P- principle is inefficient against the Security Council’s veto system. This is because a permanent member can block the R2P- principle by either vetoing or double vetoing a draft resolution, which have been demonstrated by illustrating how China could veto the R2P- principle. Since the decisions of the Security Council cannot be appealed or dissent in terms of the veto card and UN Charter, it leaves the R2P- principle inefficient with a weak operational legitimacy against the Security Council’s powerful veto system, on the cost of human lives.

Nesse cenário, aparece o específico e conturbado tratamento dado à pessoa jurídica brasileira equiparada a estrangeira, no tocante à imposição das restrições. A sua viabilidade passa pela inarredável leitura hermenêutica da influência da garantia fundamental da função social da propriedade, pautada no fundamento da dignidade da pessoa humana, na nova visão de propriedade inaugurada no século XXI. Ao pretender sejam impostas às pessoas jurídicas brasileiras as restrições típicas de aquisição de imóvel rural por estrangeiros, uma série de medidas precisam ser planejadas e implementadas. / With the outcome of the period referred to the Natural Law and the consequent emergence of the state conformation model, appear with him the segmentation between the public and private and between nationals and foreigners. Being the territory issue of national interest, touches every sovereign state to decide how to treat the acquisition of real estate by foreigners. Although relevant a comparative analysis on the driving theme in other countries, the theme will be developed from the perspective of Brazilian law. It is a topic that inherently involves private law and public law. After all, the property is supported by both the Federal Constitution and the Civil Code, which requires an analysis of the Constitutionalization of (Private) Law, so thus dichotomous glimpsed movement between these branches of the law over time. In a transnational society of extreme complexity, as experienced today, are reported to be significant changes in the conception of human being as an individual, as a member of society and as a participant in the figure of the State. In this scenario, appears the particular and troubled treatment given to Brazilian entity treated as foreign, concerning the imposition of restrictions. Its viability passes by the unmoved hermeneutic reading of the influence of the fundamental guarantee of the social function of property, based on the grounding of the dignity of the human person, in the new view of property opened in the XXI century. When you want the typical restrictions acquisition of rural property by foreigners are imposed on the Brazilian legal entities, a number of measures need to be planned and implemented.

Rights to property, rights to buy, and land law reform : applying Article 1 of the First Protocol to the European Convention on Human Rights

This dissertation examines the application and effect of Article 1 of the First Protocol to the ECHR in relation to Scots land law reform. Chapter one will reflect on why existing rights to property have come to be challenged. Chapter two sets out the human rights paradigm and scrutinises what rights and whose rights are engaged. Chapter three traces the development of A1P1. Chapter four applies the human rights paradigm to contemporary reforms. Chapter five considers the broader effect A1P1 has had on domestic property law. This dissertation submits that the problem to be overcome is that, in many instances, Scots land law reform has been reduced into a simplistic struggle. A1P1 has been held up as either a citadel protecting landowners or as an ineffective and unjustified right to be ignored. At the core of this debate are competing claims between liberal individualist rights to property and socially democratic, egalitarian goals. This dissertation argues that it is important to move beyond this binary debate. This is not about finding some mysterious "red card" or eureka moment that conclusively shows compatibility or incompatibility. Instead, compatibility will be determined by following a rule-based approach that values rational decision-making and the best available evidence, as well as the importance of democratic institutions. As such, it will be illustrated how future challenges are likely to focus not on the underlying purpose of land law reform but on the macro or micro granularity of Ministerial discretion. In coming to this conclusion, it will be argued that A1P1 has a pervasive influence on the entire workings of all public bodies and, like a dye, permeates the legislative process.

Through the historic-critic exposition regarding the dictatorial period in Brazil, is recognized a pragmatic crises present in the State in contemporary times, resulting strongly from the so called anos de chumbo (or lead years), with reference to the importance on the access of information as a fundamental human right and the necessity to respect the Federal Constitution of 1988 and other pacts and relevant international declarations to the matter. The critical approach will be one philosophical following Hannah Arendt and Walter Benjamin observations in which relates the present politic state of obscurity of information regarding the country?s past. Judging the necessity to vouch for the broad public access of information related to the period as a means to the effectual of established constitutional rights. Establishing premises linked to Rights to Truth and Memory, limiting that the State of Exception in Brazil in the military dictatorship must be revised in levels which are social, psychological, historical, cultural and, mainly, legal. Valuing the fundamental problematic core in admitting the necessity of governmental politics of management of public archives secret through international norms of human rights protection, deepen the work of the State before the recognition of the civil and political rights as fundamental pillar to the maintenance of the human being dignity. Approaching the theme of Transitional Justice as response to systematic violations and generalized to human rights, intending recognize the basis of a justice to be adapted and build in societies which develop after periods of generalized violations of the human rights. To conclude, the research is inserted in the Concentration Line of Hermeneutic, Constitution and Concretization of Rights, from the Post-graduation Program of Law from University Vale do Rio dos Sinos - UNISINOS - intending take the issue into a critic reflexion in the fight for the effectuation of rights, in a constitutional and international level, in the apparatus of the Democratic State of Law.

La notion de constitution dans l'oeuvre de l'assemblée constituante iranienne de 1906

En 1906 le royaume de Perse connut une révolution constitutionnelle qui lui a donné la première constitution écrite du pays. Durant les années où la révolution se prépare, la société civile ouvre un grand champ d’émergence des concepts modernes du droit public. L’œuvre de l’assemblée constituante de 1906, qui a donné naissance à la constitution et à son complément, en est un exemple par excellence. Dans cette thèse nous allons procéder à l’exploitation de l’œuvre de l’assemblée constituante pour y suivre la genèse et l’évolution des concepts de droit public. Nous allons chercher à travers les concepts principaux du droit public - représentation, égalité civique et égalité devant la loi - la conception qu'avaient les constituants de la Constitution. Nous allons aussi observer la notion de constitution à certains moments décisifs de la révolution, où par exemple les révolutionnaires appelleront le roi au serment pour protéger la constitution. Dans cette thèse nous assisterons aussi à un processus qui par le biais de la redéfinition des anciens concepts de droit public, fait naître les concepts modernes du droit public. Cette thèse en se référant à l’histoire constitutionnelle du pays vise à relever un défi du droit constitutionnel d’aujourd’hui en Iran. Un droit constitutionnel qui, dès sa naissance, ne prend pas au sérieux l’histoire de la discipline. Par cette thèse nous voulons mettre en valeur l’importance et la nécessité des études historiques dans l’enseignement ainsi que dans l’étude du droit constitutionnel. / In 1906 the Persian Kingdom witnessed a constitutional revolution which gave it its first written constitution. In the early years of the revolution, civil society opened a great field for the emergence of modern concepts of public law. The work of the Constituent Assembly of 1906, which gave birth to the Constitution and its Supplement, is a unique illustration of this. The present thesis proceeds to explain the work of the Constituent Assembly in order to follow the genesis and evolution of the principles of public law in Iran. Referring to the principal concepts of public law - representation, civic equality and equality before the law - we will attempt to find the particular conception that the constituents of the Constitution had of these concepts. We also explore the notion of constitution at certain key moments of the revolution, where, for example, the revolutionaries called the King to give oath for the safeguard of the Constitution. Further, the thesis explains the process by which modern concepts of public law were given birth through a redefinition of ancient concepts. By referring to constitutional history, the present study aims to expose the challenges to constitutional law in Iran today, a constitutional law which has failed to seriously account for the history of the discipline. The present study therefore aims to show the importance of, and need for, historical studies in the teaching and study of constitutional law in Iran.

The code of Concord : Emerson's search for universal laws

The purpose of this work is to detect a pattern: the concordance of Ethics and Aesthetics, Poetics and Politics in the most influential American thinker of the nineteenth century. It is an attempt to trace a basic concept of the Emersonian transcendentalist doctrine, its development, its philosophical meaning and practical implications. Emerson’s thought is analyzed genetically in search of the generating paradigm, or the set of axioms from which his aesthetic ideas as well as his political reasoning are derived. Such a basic structure, or point of convergence, is sought in the emergence of Emerson’s idea of universal laws that repeat themselves on all levels of reality. A general introduction is given in Part One, where the crisis in Emerson’s life is seen as representing and foreshadowing the deeper existential crisis of modern man. In Part 2 we follow the increasingly skeptical theologian’s turn to science, where he tries to secure a safe secular foundation for ethical good and right and to solve the problem of evil. Part 3 shows how Emerson’s conception of the laws of nature and ethics is applied in his political philosophy. In Part 4, Emerson’s ideas of the arts are seen as corresponding to his views of nature, morality, and individuality. Finally, in Part 5, the ancient and classical nature of Concord philosophy is brought into focus. The book concludes with a short summary.

Harming the dignity of the learner; refusing to hear his side of the story; neglecting to help him retrieve his stolen property : such are the unfortunate occurrences at many South African schools, and such are the experiences that have led to this research. Dedicated educators sometimes default, leaving their wronged learners out m the cold. The questions are therefore: • What causes this conduct of educators and why does it recur? • Is it ignorance of their legal position? • Is it insensitivity to common law principles and statutory provisions? • Is it sheer carelessness? Mindful of the introduction of the South African Constitution Act 108 of 1996, wh1ch contains the long-awaited Bill of Fundamental Rights, this study has been undertaken to give an educational-juridical perspective of the educator-learner relationship 1n South African public schools by means of a literature study and an elementary legal comparative study. Various legal terms which influence the educator-learner relationship significantly are defined.
