La dénonciation publique : étude du cadre juridique applicable aux professionnels de la santé au QuébecBarkany, Alexandra 03 1900 (has links)
Au cours des dernières années, plusieurs professionnels de la santé ont dénoncé publiquement des situations problématiques affectant le système de santé et des services sociaux du Québec, notamment par le biais des réseaux sociaux et des médias traditionnels. Alors qu’ils contribuent à renforcer la transparence des organismes du réseau de la santé et à protéger les droits des usagers, ces lanceurs d’alerte se heurtent à une culture du silence et s’exposent, encore aujourd’hui, à des mesures de représailles. Ce mémoire cherche à clarifier le cadre juridique entourant les dénonciations publiques effectuées par les professionnels de la santé. La première partie examine la portée de la liberté d’expression dont jouissent ces professionnels. Cette liberté fondamentale, comme le droit du public d’être informé, n’est pas absolue. Son exercice doit être concilié avec d’autres droits et obligations, dont le droit à la réputation de l’employeur, le devoir de loyauté et les obligations déontologiques du professionnel, ainsi que les droits des patients. La deuxième partie s’intéresse à la protection juridique des dénonciateurs. Au fil des ans, le législateur a adopté plusieurs dispositions afin de faciliter la divulgation de certains actes répréhensibles. Celles-ci protègent principalement les personnes qui font des signalements à l’interne ou auprès d’une autorité compétente. Dans une perspective critique, ce mémoire souligne les insuffisances du droit québécois en matière de dénonciation publique et propose des avenues interprétatives et législatives visant à renforcer la protection des lanceurs d’alerte dans le secteur de la santé. / In recent years, several healthcare professionals have publicly denounced problematic situations affecting Quebec's health and social services system, notably via traditional and social media. Although they contribute to strengthening transparency in healthcare institutions and protecting the rights of users, these whistleblowers face a culture of silence and are still exposed to retaliation. This Master's thesis seeks to clarify the legal framework governing public disclosure made by healthcare professionals. The first part discusses the scope of the professionals' freedom of expression. This fundamental freedom, such as the public's right to be informed, is not absolute. Its exercise must be reconciled with other rights and obligations, including the employer's right to reputation, the duty of loyalty, ethical obligations, and the patients' rights. The second part focuses on legal protection for whistleblowers. The legislator has adopted over the years many provisions to facilitate the disclosure of wrongdoings. These provisions mainly protect whistleblowers who report internally or to a competent authority. Adopting a critical perspective, this thesis highlights the weaknesses of Quebec's legal framework on public disclosure and proposes interpretative and legislative pathways to reinforce the protection of whistleblowers in the healthcare sector.

本文從國際條約,內國法及美國法探討原住民之法律地位。第二章以國際條約及我國相關法規為例,說明原住民法律地位在國際上或我國之變遷。第三章援引國際法學者對原住民族之定義,將台灣原住民置於該定義下討論。就國際法言,民族自決是原住民法律地位的主要內涵,因此本文於第四章專述國際法上民族自決之內容與適用對象。原住民法律地位在台灣之發展,尚未能具有自決之權利或地位,相關的法律規範還在起步階段,目前實質之規範僅限對原住民身分之認定,第五章即討論此原住民身分之認定,與現行法律作用所產生之結果。因其影響大者為相關身分法之規定,本章遂以身分法為中心。原住民族於其所在國之法律地位之發展,並無一定公式可循,僅就我國現行規範言,其與原住民族的期待相較之下,仍有極大的落差。許多國家境內皆有其原住民族,其中印第安族法律地位在美國已有較完整的發展,況且其可為台灣原住民族所主張的自治模式,提供參考範例,遂於第六章論述美國印第安族法律地位之發展。

The Reflection and Reification of Racialized Language in Popular MediaWright, Kelly E. 01 January 2017 (has links)
This work highlights specific lexical items that have become racialized in specific contextual applications and tests how these words are cognitively processed. This work presents the results of a visual world (Huettig et al 2011) eye-tracking study designed to determine the perception and application of racialized (Coates 2011) adjectives. To objectively select the racialized adjectives used, I developed a corpus comprised of popular media sources, designed specifically to suit my research question. I collected publications from digital media sources such as Sports Illustrated, USA Today, and Fortune by scraping articles featuring specific search terms from their websites. This experiment seeks to aid in the demarcation of socially salient groups whose application of racialized adjectives to racialized images is near instantaneous, or at least less questioned. As we view growing social movements which revolve around the significant marks unconscious assumptions leave on American society, revealing how and where these lexical assignments arise and thrive allows us to interrogate the forces which build and reify such biases. Future research should attempt to address the harmful semiotics these lexical choices sustain.

THE RELATIONSHIP BETWEEN SELF-DETERMINATION AND CLIENT OUTCOMES AMONG THE HOMELESSHanna, Samuel M. 01 June 2015 (has links)
This paper has attempted to determine if there is a significant relationship between self-determination and client outcomes among the homeless. The study has been based upon the conceptual framework set forth in Self-Determination Theory. The purpose of the study was to explore the relationship between self-determination and client outcomes among the homeless. Using a data collection instrument, based on empirically validated instrumentation, clients from several homeless service providers in the City of San Bernardino were assessed for the level of self-determination and autonomy support they experience within these agencies. Outcome measures included such things as whether the client was going to school, had a job and had a bank account. Overall, the results of the study were inconclusive, though some interesting post hoc observations were made. It was the primary aim of this paper to increase the knowledge base of the local network of homeless service providers and to promote the compassionate, equitable, and dignified treatment of the population they serve.

Omsorgsprincipen vid ansökan om internationellt sydd : En studie av det omarbetade asylprocedurdirektivet (2013/32/EU)Pereira Cunha, Naiara January 2020 (has links)
This paper addresses the principle of care in the recast asylum procedure directive (2013/32/EU). The purpose of the study has been to analyze how the principle of care is expressed in the directive regarding procedures for granting or rejecting asylum, as well as to analyze how the directive was implemented in Sweden. The recast asylum procedure directive aims to harmonize EU’s member states' procedures for granting and withdrawing international protection. Initially, this paper describes how the directive was created and how the principle of care is expressed in the directive and the meaning and content of the principle of care at EU level as well as its content and meaning according to Swedish law. To conclude, the Swedish implementation of the directive’s provisions directly connected to the principle of care will be discussed. The principle of care is one of the principles of good governance. The principles of good governance have been important in EU law to ensure legal protection for individuals when they are in contact with authorities of EU or Member States. In the analysis, what is found is that the principle of care can be divided into several sub-principles or requirements: individuals’ right to get their affairs treated; the obligation of authorities to investigate a request in an impartial manner; fair procedure and handling; authorities’ duty to take individual interests in consideration; authorities’ obligation to act within reasonable time and also other requirements regarding routines and procedure. Since a major part of this paper regards analyzing the relationship between EU law and national Swedish law, a discussion about the Member States’ institutional and procedural autonomy towards EU is also included. A conclusion is that the Swedish implementation of the directive's provisions related to the principle of care was deficient and that the directive itself restricts the Member States’ institutional and procedural autonomy. / Den här uppsatsen behandlar omsorgsprincipen i det omarbetade asylprocedurdirektivet (2013/32/EU). Syftet med arbetet är att analysera hur omsorgsprincipen uttrycks i direktivet avseende procedurer för beviljandet eller avslag av asyl, samt hur direktivet har genomförts i Sverige. Det omarbetade asylprocedurdirektivet syftar till att harmonisera EU- medlemsstaternas förfarande vid ansökan om internationellt skydd. Inledningsvis redogörs för hur direktivet skapades och hur omsorgsprincipen uttrycks i direktivet, vad omsorgsprincipen omfattar på EU-nivå, liksom principens omfattning i svensk rätt. Avslutningsvis analyseras genomförandet av direktivets bestämmelser med anknytning till omsorgsprincipen i svensk rätt. Omsorgsprincipen är en av principerna om god förvaltning. Principerna om god förvaltning har varit viktiga inom EU-rätten för att säkerställa ett rättsskydd för enskilda när dessa är i kontakt med EU:s eller medlemsstaternas myndigheter. Analysen kommer fram till att omsorgsprincipen kan delas in i flera mindre principer eller krav: enskildes rätt att få sina angelägenheter behandlade; myndigheters skyldighet att på ett opartiskt sätt undersöka en begäran; rättvis procedur och handläggning; myndigheters skyldighet att väga in enskildes intresse; myndigheters skyldighet att agera inom rimlig tid; samt andra krav på handläggningsrutiner. Eftersom en huvuddel av den här uppsatsen handlar om att analysera relationen mellan EU-rätt och svensk rätt, förs också en diskussion om medlemsstaternas institutionella och processuella autonomi gentemot EU. Slutligen presenteras slutsatsen att det svenska genomförandet av direktivets bestämmelser som anknyter till omsorgprincipen varit bristande och att direktivet har begränsat såväl medlemsstaternas institutionella som processuella autonomi.

Il est quasiment devenu un lieu commun aujourd’hui de mourir à l’hôpital. Et s’il fallait traiter ce sujet, le plus souvent c’est la perspective médicale qui tenterait d’en percevoir les enjeux. C’est au tournant du milieu du XXème siècle, au lendemain d’un énième génocide, marquant l’esprit de l’humanité certainement pour l’éternité, qu’un nouveau langage bioéthique va se faire le vecteur d’une considération renouvelée de la personne. L’homme devient personne humaine dans les textes internationaux proclamant dès lors d’inédits droits de l’homme. C’est en prenant la bioéthique comme objet de réflexion qu’un certain droit de la santé, largement inspiré par la production de comités d’éthiques, a émergé d’une doctrine privatiste en premier, afin de cerner de premiers droits définissant celui qu’il serait convenu d’appeler alors le mourant. Toutefois, l’établissement public de santé confronté à la technologisation médicale, permettant alors un allongement de la fin de vie, s’est rapidement trouvé être un lieu de conflit entre ceux qui furent considérés comme des usagers de service public, et les commettants médecins de l’Etat. La primauté du droit privé de la personne semblait alors menacée, le droit administratif prenant le pouvoir afin d’indemniser les victimes de l’hôpital. Cependant, à force de réductions systématiques ne regardant la personne mourante que sous un angle génériciste, relevant d’un droit public, celle-ci s’est progressivement retrouvée parfaitement ignorée en son essence première que le droit privé parvenait à percevoir. Les formes les plus récentes de déresponsabilisation attesteraient d’une consécration de l’indemnisation finissant d’objectiviser l’être sous-jacent à la personne mourante, allant jusqu’à justifier l’acte euthanasique. L’approche réitérée de ce difficile objet d’étude trouverait à générer une réflexion que le philosophe du droit engagerait, réintroduisant la personne irréductible se manifestant comme point de départ et d’arrivée, de telle sorte que se pourrait être harmonisée la rencontre inévitable des domaines public et privé, juridique et politique, afin de rendre toute sa vérité onto-axiologique aux droits premiers du sujet mourant. / Today, dying at hospital is the most curently idea agreed in order to protect people. That’s maybe the reason why medical studies took this as an issue more than lawyer studies. It’s around the middle of the twentieth century, after one more genocide, marking the spirit of the humanity certainly for all eternity, that a new bioethical language is going to be made the vector of a consideration renewed by the person. The man becomes a human-person in the international texts, proclaiming from then on of unpublished works human rights. While taking the bioethics as object of reflection a certain health law, widely inspired by the production of committees of ethics, emerged from a privatiste doctrine in the first one, to encircle first rights of the one that it would have been advisable to call then the dying. However, the public institution of health confronted with the medical technologisation, allowing then an extension of the end of life, quickly was to be a place of conflict between those who were then considered as users of public service, and principals doctors of the State. The superiority of the private law of the person seemed then threatened, the administrative law taking the power to indemnify the victims of the hospital. However, by means of systematic reductions looking at the dying person only under an angle génériciste, recovering from a public law, this one gradually found itself perfectly ignored in the first essence which the private law succeeded in perceiving. The most recent forms of deresponsabilisation would give evidence of a consecration of the compensation stopping an objectivisation the underlying being to the dying, going person to justify the euthanasic act. The approach repeated by this difficult object of study would find to generate a reflection which the philosopher of the right(law) would engage, reintroducing the person inflexible as point of departure and arrival, so that could be harmonized the inevitable meeting of the public and private, legal and political domains, to return all its onto-axiological truth to the first rights of the dying subject.

The politics & poetics of Gulliver’s travel writingCox, Philip 03 September 2019 (has links)
Working at the intersection of narrative studies and political theory, this thesis performs an original critical intervention in Gulliver’s Travels studies to establish the work as an intertextual response to the hegemonic articulations of European travel writing produced between the 15th and 18th centuries under the discourse of Discovery. My argument proceeds through two movements. First, an archeology of studies on Gulliver’s Travels that identifies key developments and points of significance in analyses of the satire’s intertextual relationship with travel writing. Second, a discursive analysis of the role of Discovery generally, and travel writing specifically, in constructing European hegemony within a newly global context. Together these movements allow me to locate Gulliver’s Travels firmly within the discourse of Discovery and to specify the politics of the text and the poetics of its operations. For this analysis I adopt a conceptualization of hegemony elaborated by Ernesto Laclau and Chantal Mouffe in Hegemony and Socialist Strategy (1985), which defines discourse as a structured totality of elements of signification, wherein the meaning and identify of each element is constituted by articulatory practices competing to fix the differences and equivalences between it and others within the discourse. An hegemonic discourse is one that successfully limits the possibility of novel articulations according to a particular governing logic. In the Age of Discovery, this governing logic, I argue, is a socio-spatial logic that constructed the “European” subject through its difference from the “Non-European,” the “civilized” subject through its difference from the “savage,” and the “free land” of the “savage” peoples through its difference from the occupied lands of the “civilized.” To conduct the concomitant critical analysis of Gulliver’s Travels, I draw upon Jacques Rancière’s conception of the “distribution of the sensible,” which refers both to the partitions determined in sensory experience that anticipate the distributions of parts and wholes, the orders of visibility and invisibility, and the relationships of address or comportment beneath every community; and to the specific practices that partake of these distributions to establish the “common sense” about the objects that make up the common world, the ways in which it is organized, and the capacities of the people within it. This enables me to establish travel writing as an articulatory practice that utilized a narrative modality to “reveal” the globe in a Eurocentric image dependent upon the logic of Discovery: a discursively constructed paradigm that I identify as what others have labeled “travel realism,” which organized the globe into a single field of discursivity predicated upon the “civilizational” and “rational” superiority of Europeans over their non-European Others. Gulliver’s Travels, I conclude, intervenes in this distribution of the sensible by utilizing the satirical form as a recomposing logic to upend the paradigm of travel realism and break away from the “sense” that it makes of the bodies, beings, and lands it re-presents. / Graduate

Le développement des modes alternatifs de règlement des différends dans les contrats administratifs est une nécessité. En effet, l’encombrement des juridictions administratives, conjugué au besoin d’un règlement des différends plus consensuel et apaisé, plaide en faveur de l’émergence d’une justice alternative. Néanmoins, l’ordre public encadrant l’activité des personnes publiques, et protégé par des normes impératives, impose que le développement des modes alternatifs soit régulé. À ce titre, l’étude du droit positif démontre que ce phénomène n’est pas inconnu dans le règlement des différends intéressant les contrats administratifs. Par exemple, les parties à un différend peuvent déjà librement recourir aux modes amiables (médiation, conciliation ou transaction), et quelques dérogations au principe d’interdiction faite aux personnes publiques de recourir à l’arbitrage sont prévues. Cela étant, les lacunes et les défaillances du régime actuel des modes alternatifs dans les contrats administratifs (absence de véritable statut du médiateur, défaut d’encadrement de la conciliation inter partes, complexité de la notion de concessions réciproques ou, encore, difficulté pour le juge administratif d’asseoir sa compétence en matière d’arbitrage international...) complexifient leur compréhension et leur mise en œuvre et risquent, par suite, d’accroître les violations de l’ordre public. Il est donc nécessaire de proposer un régime pérenne des modes alternatifs permettant d’assurer, d’une part, la protection des normes impératives du droit public et, d’autre part, la liberté des parties dans le choix et la conduite d’une justice alternative. Pour cela, leur futur régime devra autoriser l’arbitrage dans les contrats administratifs et le doter de garanties procédurales prenant en compte sa nature spécifique mais, aussi, certaines caractéristiques inhérentes aux personnes publiques et au droit administratif. De même, les procédures de médiation et de conciliation devront être améliorées afin d’assurer aux parties, un encadrement souple et favorable à la conclusion de transactions équilibrées et sécurisées. Enfin, ce régime devra définitivement consacrer le rôle du juge administratif. À cet effet, ce dernier pourra être amené à assister les parties dans la mise en œuvre des modes alternatifs (création d’un juge administratif d’appui dans l’arbitrage, combinaison des procédures de référé avec les modes amiables...). Le juge administratif devra être aussi chargé du contrôle de conformité de la solution alternative à l’ordre public. Cette attribution de compétence, qui résonne de plus fort en matière d’arbitrage international, est indispensable à la protection de l’intérêt public. Ce n’est qu’à ces conditions, que le développement des modes alternatifs de règlement des différends pourra prendre toute sa place dans les contrats administratifs. / The development of alternative dispute resolution in administrative contracts is a necessity. Indeed, the congestion of the administrative courts, combined with the need for a more consensual and calm settlement of disputes, pleads in favour of the emergence of an alternative justice. Nevertheless, the public order governing the activities of public bodies, and protected by imperative norms, requires that the development of alternative methods be regulated. As such, the study of positive law shows that this phenomenon is not unknown in the settlement of disputes concerning administrative contracts. For instance, the parties to a dispute can already freely resort to amicable methods (mediation, conciliation or settlement agreement), and some exceptions to the principle prohibiting public bodies from resorting to arbitration are provided for. However, the voids and shortcomings of the current system of alternative dispute resolution in administrative contracts (lack of proper status of the mediator, paucity of framework for inter partes conciliation, complexity of the concept of reciprocal concessions or, difficulty for the administrative judge to assert its competence in international arbitration...) make its understanding and implementation more complex and more prone to increasing public order violations. It is therefore necessary to propose a sustainable regime of alternative methods to ensure, on the one hand, the protection of peremptory norms of public law and, on the other hand, the freedom of the parties in the choice and conduct of an alternative justice. For that purpose, the future regime will have to authorize arbitration in administrative contracts and endow it with procedural guarantees taking into account its specific nature but also certain characteristics inherent in public entities and administrative law. Furthermore, the mediation and conciliation procedures will have to be improved in order to provide the parties with a flexible framework conducive to the conclusion of balanced and secure settlement agreements. Finally, this regime must definitively establish the role of the administrative judge. To this end, that judge may be called upon to assist the parties in the implementation of alternative methods (creation of an administrative support judge in arbitration, combination of interim reliefs with amicable procedures...). The administrative judge must also be responsible for checking the compliance of the alternative solution to the public order. This attribution of jurisdiction, which is resonates all the more in international arbitration, is fundamental for the protection of the public interest. It is only under these conditions that the development of alternative dispute resolution mechanisms can take its place in administrative contracts.

La redéfinition des conditions d’exercice de la souveraineté aérienne des États membres, par un transfert progressif de compétences au profit de l’Union européenne, ne peut être analysée uniquement en termes de dépossession et de réduction de leur puissance individuelle. Les compétences aériennes confiées à l’Union permettent l’affirmation de l’ensemble européen sur la scène internationale. Ce processus, mouvant et encore inachevé, se traduit par une prise en compte accrue de la spécificité européenne en matière d’aviation civile. Malgré des réticences certaines émanant aussi bien des États membres que des États tiers, l’Union s’érige progressivement au rang d’acteur de poids, capable d’influencer le contenu normatif du droit aérien contemporain, de la même manière que le font les puissances aériennes traditionnelles et notamment les États-Unis. Ces nouvelles tendances, révélatrices de la souplesse et de la plasticité de la convention de Chicago, permettent de dresser des perspectives quant aux possibles évolutions futures de l’ordre international de l’aviation civile. / The way in which the Member States have redefined the conditions regarding how they exercise their air sovereignty, by progressively transferring power to the European Union, cannot be viewed solely as them removing and reducing their individual powers. The powers conferred to the European Union in aviation matters are resulting in an affirmation of the international role of Europe as a whole. This on-going, and as yet incomplete process, may be seen in a greater recognition of the specific European aspect regarding Civil Aviation. In spite of the hesitance of Member States and non-member States, the European Union has progressively taken its place among the key players, able to influence developments in modern aviation law, in the same way as other established aviation authorities and especially the United States. These new trends reveal the flexibility and elasticity of the Chicago Convention and the potential future developments in International Civil Aviation.
