Questa tesi di dottorato ha l’obiettivo di analizzare i processi attraverso cui individui ed organizzazioni costruiscono la loro posizione e la loro valutazione nel contesto di field istituzionali culturali e creativi. La tesi contiene tre capitoli che rappresentano tre distinti lavori di ricerca. Le analisi empiriche svolte sono incentrate sui settori del cinema (primo capitolo), della quality television (televisione ‘di qualità’, serie televisive) e della musica indipendente negli Stati Uniti. In tutti i lavori di ricerca sono stati utilizzati database longitudinali e metodi quantitativi e qualitativi. Nel primo capitolo, si analizza come gli scandali personali (di natura sessuale e non sessuale) influenzino la costruzione della peer recognition. Si prendono anche in considerazione gli effetti degli stereotipi legati al genere e dei comportamenti orientati alla valorizzazione delle diversità (solidarietà femminile), per comprendere come questi influiscano sulla peer recognition, insieme agli scandali, nell’ambito della valutazione degli attori di Hollywood (candidatura all’Oscar), nel lasso temporale 2003-2018. Nel secondo capitolo, viene teorizzato il processo di nascita e di consolidamento di un field interstiziale (interstitial issue field), attraverso l’analisi del caso del field nato tra la musica indipendente e la quality television negli Stati Uniti, dal 2003 al 2018. Si delineano le caratteristiche della infrastruttura istituzionale del field emerso, si definisce il ruolo lavoro degli attori istituzionali (institutional work) e degli spazi interstiziali (interstitial spaces). Nel terzo capitolo, i field istituzionali della musica indipendente e della quality television sono ulteriormente esaminati, tra il 2013 e il 2018, attraverso una indagine della collaborazione tra i due field, nell’ utilizzo di un album indipendente nella soundtrack di episodi di una serie televisiva. La ricerca mira a comprendere gli effetti della collaborazione sulla valutazione di un prodotto del field della musica indipendente (album indipendenti) che collabora con un field più ‘commerciale’ (quality television). / This doctoral thesis aims at shedding light on the processes by which individuals and organizations negotiate their structure, position, and evaluation, within the context of creative and cultural fields. It contains three chapters that represent three research studies. The empirical analyses undertaken throughout the research pieces are focused on the fields of cinema (first chapter), quality television, and independent music (second and third chapter) in the United States. For all of them, longitudinal databases are employed, and both quantitative and qualitative methodologies are utilized. In the first chapter, the role of personal (sexual and non-sexual) scandals for peer recognition is investigated. The research focuses on how scandals, gender stereotypes, and engagement in diversity-valuing behaviors (female solidarity) affect peer recognition for Hollywood actors (nomination of actors for an Oscar), in the time frame 2003-2018. In the second chapter, the process of emergence and consolidation of an interstitial issue field is theorized, by exploring the case of the field that emerged between indie music and the quality television in the United States from 2003 to 2018. In the analysis, the features of the institutional infrastructure of the emerged field, with the role of institutional actors and of interstitial spaces, are taken into consideration. In the third chapter, the fields of independent music and quality television in the US are further examined, between 2013 and 2018, by focusing on the patterns of evaluation of one field’s products (independent music, independent albums) when this field interacts with the other (quality television) – that is, when independent albums are featured in quality television episodes.

從中國電影發展策略看台灣電影進入中國市場之機會與挑戰

本研究雖非旨在探討如何解決台灣電影產業困境,但不難看出研究最終的結論其實是解決台灣電影產業困境的方法之ㄧ。由於兩岸電影產業多年來缺乏交流,而原因除了中國對於電影的各項發展措施缺乏穩定性及中國電影法規與部門體制異常複雜之外,我們對中國電影之政策法制、市場偏好、產業規模及產業價值鏈知之甚少也是關鍵原因之ㄧ。 故本研究除了探討中國電影發展政策及其法規外,也以波特的五力分析模型探討兩岸電影產業的各個競爭面向,加上學者的產業研究及產業數據分析,用以回應本文欲探討的兩個問題包括: 1.中國在電影產業上之發展策略對台灣的機會與挑戰為何? 2.針對中國發展策略對台灣的機會與挑戰,台灣電影產業應採取哪些應變措施? 由本研究結果可看出,由於中國電影發展政策的影響,使得中國電影產業的替代品威脅遠較台灣電影產業低,但若台灣能夠與中國電影產業採取跨國合作的方式,爭取製作合拍片的機會,則可化危機為轉機,使台灣電影產業能夠走出市場狹小及人才不足的問題,並排除中國與香港簽訂CEPA後所帶來的華語合拍片的威脅。 關鍵詞:中國電影發展策略、電影產業、波特五力分析 / Though the purpose of this study is not to solve the current predicament of the film industry in Taiwan, it is obvious that the result of this research is one of the solutions of current situation. The insufficient communications between the film industry in Taiwan and mainland China is because that the developing policies of film are unable and the regulations and sections regard to the films are extremely complicated in China. In addition, we are not familiar with the film making policy, market tastes, industrial scale, and industrial value chain in China as well. Therefore, except for identifying the film developing policy and related regulations in China, this study also probed into the competitive factors of the film industries cross-Strait with Michael Porter's Five Forces Model and combined with the academic industrial research and data analysis to figure out the two topics of this study: 1. What are the opportunity and challenge of Taiwan to the developing strategy of the film industry in China? 2. What kinds of response measures should the film industry in Taiwan take to encounter the opportunity and challenge caused by the developing strategy of the film industry in China? The research result suggest that due to the influence of the film developing policy in China, the threat of substitution of the film industry in China is much lower than it is in Taiwan. However, if the film industries in Taiwan and China are able to cooperate and strive for the opportunity of film shooting, the crisis may be altered to a favorable turn, which allows the film industry in Taiwan to solve the problem of tiny market and insufficient human resource, and eliminate the threat of co-shooting of Chinese movies caused by the CEPA signed by China and Hong Kong. Esta dissertação tem o objetivo de investigar o cinema de propaganda política produzido por duas associações de caráter ideológico, entre os anos 1961 e 1964: o Instituto de Pesquisas e Estudos Sociais (Ipês), dirigido principalmente por ricos empresários liberais e anticomunistas; e o Centro Popular de Cultura (CPC da UNE), constituído por jovens artistas influenciados pelas idéias marxistas. Para tanto, busquei articular informações provenientes da análise intrínseca de seus filmes com as do contexto histórico em que foram feitos e exibidos e, em especial, as extraídas da documentação a que tive acesso, com o intuito, então, de compreender os modelos cinematográficos aos quais essas obras se alinharam. Ao estudar como ipesianos e cepecistas foram adversários em meio às instabilidades de um Brasil próximo ao Golpe de 1964, foi possível constatar como os dois grupos financiaram a atividade cinematográfica com a expectativa de intervir nos rumos socioeconômicos e culturais do país a partir de projetos conflitantes que, por um lado, pretendiam fortalecer o poder da elite com um capitalismo de base liberal e, por outro, romper com as estruturas de poder capitalistas. Nesse sentido, mesmo com essas divergências, a pesquisa demonstra como ambos utilizaram um discurso próximo em suas filmografias, repleto de similaridades, que se manifesta no uso de técnicas e linguagens idênticas, como é o caso das experiências estéticas didáticas e das representações do povo com a finalidade de concretizar um programa ideológico para a nação. Assim, esse mestrado procura defender a hipótese de que, mesmo politicamente opositores, Ipês e CPC manusearam um referencial cinematográfico com diversas semelhanças. / The present dissertation aims the investigation of the political propaganda film industry production between 1961 and 1964 by two ideological character associations: the Instituto de Pesquisas e Estudos Sociais Ipês (Research and Social Studies Institute), managed especially by liberal and anticommunist rich businessmen; and the Centro Popular de Cultura CPC da UNE (Culture Popular Center), constituted of young artists influenced by marxist ideas. And to do so, I tried to join information provided by the intrinsic analysis of their films and the historic context in which they were produced and released and, especially, the information taken from the documentation I had access to, with the purpose of understanding the cinematographic models to which these films attached. By studying how ipesianos (term used to refer to the members of Ipês) and cepecistas (term used to refer to the members of CPC) were opponents in the instable Brazil near the 1964 coup detat, it was possible to observe how both groups financed their cinematographic activity, expecting to exercise some influence on the country cultural and socioeconomic course, by producing conflicting projects intended to, on the one hand, strengthen the power elite by supporting liberal based capitalism, and on the other hand, bring the capitalist power structures to an end. Nevertheless, even showing divergences, this research makes evident how both groups made use of analogue methodology on their filmographies, full of similarities, expressed in their identical techniques and languages, which can be seen in their didactical esthetic experiences and representations of the people with the purpose of concretize an ideological program for the nation. Therefore, the main goal of this masters degree is to support the hypothesis that, even being politically opposite, Ipês and CPC made use of very similar cinematographic referential.

Ce travail s’attache à étudier le droit des artistes interprètes à la protection de leur travail à l’ère numérique. La première partie de ce travail s’intéresse à la théorie des droits d’auteur, l’histoire des droits moraux, et à l’application de la théorie des droits moraux aux procès qui impliquent les artistes interprètes aux Etats-Unis, au Royaume-Uni, et en France. De plus, ce travail présente le droit international en la matière, y compris la Convention de Berne et le Traite de Beijing. La deuxième partie de ce travail examine l’histoire de l’industrie du cinéma. Plus spécifiquement, il se concentre sur l’histoire de l’industrie du cinéma aux Etats-Unis, au Royaume-Uni et en France, en observant comment les progrès des technologies cinématographiques ont affecté les droits des acteurs de cinéma dans le domaine du droit national et international. La troisième partie de ce travail propose un Protocole au Traité de Beijing afin que créer un mécanisme pour diminuer les obstacles à l'accès à la justice qui empêchent les artistes interprètes de faire valoir leurs droits. La thèse se termine par uneréflexion sur les leçons qui peuvent être tirées de l'histoire et des pratiques actuelles des États-Unis, du Royaume-Uni et de la France en ce qui concerne les droits moraux des artistes interprètes, en recommandant que les trois pays fournissent à l'avenir des protections plus significatives aux artistes interprètes. / This work provides a broad study of the right of performing artists to protect their performances in the Internet era. The first part of this work explores the theoretical foundation of copyright law, the history of moral rights, and the application of the theory of moral rights to cases affecting performing artists in the United States, the United Kingdom, and France. In addition, this work discusses relevant international law, including the Berne Convention and the Beijing Treaty. The second part of this work addresses the history of the movie industry. More specifically, it concentrates on the history of the film industry in the United States, the United Kingdom, and France, observing how technological progress in filmmaking techniques have affected the rights of movie actors under both national and international law. The third part of this work proposes a Protocol to the Beijing Treaty that would create a mechanism to lower the barriers to justice that currently prevent performing artists from vindicating their rights. This work concludes with a reflection on the lessons that can be drawn from both the history and the current practices of the United States, the United Kingdom, and France with respect to the moral rights of performing artists, recommending that the three countries provide more significant protections to performing artists going forward.

本研究主要研究台灣電影產業環境及其競爭力,並透過研究給予電影產官學界在電影產業發展上的建議。研究方法是透過市場集中度瞭解目前台灣電影三大部門──製作業、發行業及映演業的市場集中情形,確立台灣電影產業之產業結構;再者,以麥克‧波特提出之產業環境類型檢視,瞭解其產業環境現況;最後以前兩步驟之結果為基礎,再經由鑽石理論之六大構面分析台灣電影產業在各項分析面向上的優、劣勢及可能的發展機會,彙整出台灣電影整體產業發展中,政府擬定政策、業者思考經營決策及電影產業學術研究上未來可行性的建議。 / The main scope of this research is to study the environment of film industry in Taiwan as well as its competitiveness. Also, throughout the research, opinions towards the film academia in the film industry shall also be elucidated. The research is carried out via acquaintance of concentration ratio of the three main parts in a film industry—production, distribution, and exhibition; furthermore, to clarify the production structure of the Taiwan film industry. Also, the current industry environment is evaluated by Michael Porter’s survey method. Lastly, based on the two aforementioned procedures of results with the application of the diamond theory altogether, a detailed analysis of the Taiwan film industry regarding the advantage and disadvantage and the relevant topics shall be further discussed.

<p>I december 2003 gick filmen <i>Kill Bill</i> upp på biograferna med ett våldsamt och blodigt innehåll. Reaktionerna blev starka, vilket kan bero på att <i>Kill Bill</i> är en actionfilm där kvinnorna har en annan roll än den lättklädda medhjälparen. Då kvinnorna står i fokus var filmen som gjord för en analysav hur just kvinnan gestaltas i filmens värld. Syftet med uppsatsen är att undersöka om de patriarkala strukturerna förändras när typiskt manliga roller intas av kvinnor. Analysen inriktar sig främst på filmen <i>Kill Bill</i>, men diskuterar också det sammanhang i vilket filmen skapats och lanserats det vill säga filmindustrin i Hollywood som knappast gjort sig känd för några jämställdhetssträvanden. In December 2003 the movie <i>Kill Bil</i>l premiered.</p> / <p>The reactions to its violent and bloody plot were strong, perhaps because <i>Kill Bill </i>is a film where women play different roles than the usual "sexy assistant", thus also making it suitable for an analysis of how women are represented on screen. The purpose of this thesis is to examine whether the patriarchal structures do change when the typical male part is given to by women characters. The analysis is mainly concentrated on the film <i>Kill Bill</i>, but will also discuss the context in which it was made - the Film Industry in Hollywood which has hardly been known for any ambition to achieve gender equality.</p>

The rise of co-productions in the film industry : the impact of policy change and financial dynamics on industrial organization in a high risk environment

The main aim of this study is to examine the interrelationship of finance and government intervention in explaining the rise of co-productions in the international film industry in the time period between 1997 and 2004. Mainstream economic geography literature presents the film industry typically as a case study for embeddedness and agglomeration effects, with successful industry clusters drawing their strength from process knowledge, networks and local interaction. However, there is an increasing disparity in the literature between what mainstream theory suggests, and what empirical studies find with respect to the importance of cluster-external relations and dynamics. This, as I will argue, is particularly evident when looking at the picture of the whole film industry production system that emerges from the literature, which fails to include the alternative and complimentary pattern of co-productions. Co-productions are collaborations between film producers from at least two different countries, pooling their resources across distance to produce a feature film project. In the past fifteen years, the number of films made as co-productions has risen continuously in Europe, with co-productions accounting for more than 30 per cent of European film production activity. As a mode of production based on temporary, cross-border collaboration that is supported in its coordination by temporary clusters, such as trade fairs and industry events, the coproduction phenomenon poses a conundrum to economic geography literature and challenges its explanatory framework. As I will argue, in order to arrive at a satisfactory understanding of the phenomenon, it is necessary to look beyond social factors associated with locality, and to examine instead dynamics impacting on the industrial organization of the whole production system. I will argue that in the context of the pervasive demand uncertainty characterizing the film industry, the analytical focus should be on financial dynamics, as production activity and its organizational form are ultimately dependent on finance as an enabling force. Based on a description of the film financing process as the primary process in which the relationship between the economic categories of financial and production capital are played out, I propose that in order to explain the growth of co-productions empirically, it is necessary to examine changes in the film financing environments of the increasingly interrelated European and US film industries. As the State is the most important provider of financial capital in the European film industry through the provision of public aid, the focus will lie in particular on the consequences of a paradigm change in the rationale of State intervention in Europe moving away from funding film for cultural reason, to supporting the industry on economic grounds since the mid 1990s. As will be shown, the most important consequence of this paradigm change has been the introduction of tax incentives to encourage investment into film in a number of European and international countries within a short period of time. As will be demonstrated, this has led to the formation of significant, locally confined capital pools that can dis-embed production; and to the emergence of a distinct capital cycle in international film financing, which has strongly impacted on the productive system of the film industry. Finally, a dynamic explanation for the growth of co-productions in Europe in the time period between 1997 and 2004 will be provided. I will argue that co-productions have firstly grown in order to overcome a lack of finance, but have in the context of a capital cycle based on tax incentives from Germany and the UK, increasingly become driven by the opposite dynamic, namely an abundance of financial capital seeking profitable investment opportunities. The study will conclude with a discussion of policy implications, a summary of contributions to the literature and a brief overview of future research opportunities.

The Cinematisation of Computer and Console Games : Aesthetic and Commercial Convergence in the Film and Game Industries

This thesis examines the growing trend of cinematisation in computer and console games, where both visual styles and industrial practices are concerned. The ever-increasing runtime of cinematic cutscenes in games, and the stylization of game graphics in accordance with established film genres are of primary focus regarding the gaming industry's absorption and interpretation of cinematic visuals. Comparisons of film-game convergence are based on the proliferation of non-gameplay promotional trailers and their role in hype-generation; as well as game producer strategies of franchising, cross-promotion, and initial-sales business model. Comparison is thus accomplished with regards to a number of fundamental similarities in both industries' business and commercial tactics, as stemming from the risk and reward-based investment financing system prevalent in both industries. Finally, a selection of user and industry professional video responses to the aforementioned trends are examined, both for their value in counter-balancing the assumptions of success which often follow staggeringly high initial sales figures; and for their value in layering the depth of film-game convergence even further, as they respond to the recent, filmic trends in games using the very language of film.

Write or Perish : How Screenwriters Author their Careers

The aim of the present study was to investigate how the impermanence of contract work affects working lives, self-perceptions and the career strategies of Swedish screenwriters of finding and keeping work. Furthermore, it also explored how screenwriters experience their abilities to exercise authorial leverage over media content. Introducing the concept of “career authoring” to cover different aspects of the professional lives of screenwriters such as managing a career, establishing authorship and contractual negotiations, the study was able to embrace various mind-sets and strategies for career success. Combining ethnographical studies and textual analyses the study was able to ascertain that the contingency of the Swedish film and television industries necessitates strategies to cultivate reputations, industrial visibility, consciously receive writing credits and conform to a traditional division of labour. Moreover, the study illuminated the importance of contractual negotiations for career success in terms of both retaining and wavering rights to their work. Strategies for exercise increased authorial leverage were not only confined to the script, but extended beyond the page, where the latter  accentuated processes of reconfiguring traditional conceptions of screenwriters’ abilities to influence media content.

Au début des années 1950, le cinéma japonais achève de se remettre des restrictions d'abord imposées par le régime militariste, puis entraînées par la défaite du pays. L'industrie cinématographique prospère rapidement et puise dans la littérature des histoires pour les films qu'elle doit produire à une cadence toujours plus élevée afin de répondre à la demande des salles de cinéma. C'est dans ce contexte que Naruse Mikio (1905-1969) a réalisé six films inspirés de textes de Hayashi Fumiko (1903-1951). Ces films sont représentatifs tout à la fois des relations que les institutions littéraires et cinématographiques entretenaient à l'époque où les films ont été réalisés, du rôle joué par la littérature dans la politique de production des studios de cinéma et de la façon dont l’adaptation était perçue par la critique de cinéma.Mais outre la présentation de ces aspects contextuels et historiques, l'objectif de cette thèse est de dégager des pistes qui aideraient à appréhender l'œuvre de Naruse Mikio à travers l'examen des choix qu'il opère lors du processus d'adaptation, que ce soit au niveau du sujet, de la construction du récit, ou encore de la mise en scène. Naruse parvient à trouver un équilibre entre ses ambitions formelles et les exigences du récit en élaborant avec virtuosité un style effacé ou « invisible ». Pour tenter d'en faire ressortir les particularités, notre effort s'est concentré sur l'analyse des éléments de notre corpus (films, textes et scénarios). Dans cette entreprise, les textes de Hayashi constituent un référent précieux qui aide à déterminer les rapports que le cinéaste entretient avec son sujet, avec le scénario ou encore avec les contraintes inhérentes au cadre dans lequel il travaille. / In the early fifties, the Japanese film industry had almost recovered from the restrictions imposed first by the military regime and then from Japan’s defeat in the Pacific War. The industry then prospered rapidly and found in literature the stories needed in order to produce enough movies to comply to the always growing demand of the cinemas. It was in this context that Naruse (1905-1969) realized six movies inspired by Hayashi Fumiko's (1903-1951) works. These movies are exemplary of the relationship between literary institutions and the film industry at the time they were shot. They are also typical of the importance of literature in the production policy of the diverse film studios as well as the manner movie critics received these screen adaptations.Besides the presentation of the contextual and historical aspects, our objective is to identify ways which would help to discover Naruse Mikio's works through the filter of choices made by him at the time of the adaptation, be it when choosing the topic, the story construction or the stage direction. Naruse was able to find a balance between his formal ambitions and the requirements of the story by skillfully elaborating a subdued or “invisible” style. In order to highlight the singularities of his personal style, we have concentrated our effort on the analysis of the diverse elements of our corpus: the films, texts and scripts. In this endeavour Hayashi’s writings are a precious point of reference helping us to determine the precise nature of the relationship the film director had with his subject, with the script as well as the constraints imposed by the frame he was working in.
