The theme running through this dissertation is intended to prove that the Supreme Court has a role to play in the promotion, enforcement and sustenance of a proper democratic system of government, good governance and fundamental human rights and freedoms in Ghana.
The Study would therefore address the role of the Supreme Court in the development of Constitutional Law in Ghana, with particular emphasis on the court's contribution to the underlying concepts of the Fourth Republican Constitution of 1992; the guiding principles of constitutional interpretation and the vexed issue of whether the court should adopt a mechanical and literal approach to the interpretation of the Constitution or adopt a liberal, beneficent and purposive approach. The Supreme Court has asserted in the locus classicus decision: Tuffuor v Attorney-General [1980] GLR 637 that the 1979 Constitution as the supreme law, must be construed as a living political document capable of growth. Is there any evidence now to support that claim?
The study shall also investigate the question of the power of the Supreme Court to review legislative and executive action. We shall also examine the role of the Supreme Court in the interpretation and enforcement of the Constitution and Fundamental Human Rights and Freedoms in relation to the rights and obligations of the individual and the State with the view to achieving good governance. The 1992 Constitution itself is founded on the premise that there are limitations to the enjoyment of fundamental human rights and freedoms. What is the extent of such limitations as determined by the Supreme Court?
What has been the Supreme Court's contribution to the sustenance of political stability and democratic governance and, especially, in matters relating to coup d'etats and to enforcement of the Constitution itself as distinct from the enforcement of fundamental human rights and freedoms? Has the Supreme Court power to enforce the Constitution and the existing law where there is proven case of injustice and illegality? 知識分享是實現成功知識管理的關鍵步驟,然而在公共組織中的成員,當他們去分享自己的知識時,不僅需要花額外的時間和努力之外,甚至可能還會減少他們自己在組織中的權力地位和競爭價值,因此將成員個體的知識轉換組合成組織整體的知識,相形之下會更不容易達成。故本研究的目的在於瞭解哪些因素會影響公共組織成員中的知識分享行為,因此本研究模式中的構念係根據社會交換理論、社會資本理論以及計畫行為理論為基礎。 / 本研究根據這些相關理論所提出之構念發展出涵蓋社會心理(例如外在報酬、預期互惠及樂於助人)、組織系絡(例如認同、信任及支持分享的規範)以及資訊科技(例如資訊科技使用)等三組因素層面的整合性研究模式,並認為這三組因素層面下的變數都會影響成員的知識分享行為。而本研究對象為台北市政府所屬之一級行政機關單位的員工,經過叢聚隨機抽樣後,抽出16個市府所屬之一級行政機關單位中850位受訪者,有效問卷數為524份。而本研究採取結構方程模式(SEM)途徑來檢定本研究模式之假設關係與模式配適程度。 / 研究結果除了發現本研究模式配適度良好外,也發現模式內生變數部份中的知識分享意圖與知識分享行為有高度的正面影響關係,而知識分享的態度、主觀規範與行為控制認知對於知識分享意圖也有正面的影響關係。而模式外生變數部份,預期互惠、樂於助人和組織認同感對於知識分享態度有直接的正面影響;此外組織信任和支持分享的規範對於知識分享的主觀規範有直接的正面影響;還有資訊科技使用對於知識分享的行為控制認知有直接的正面影響,而令人訝異的是在本研究中的外在報酬對於知識分享態度卻是直接的負面影響。 / 因此基於這些研究結果的發現,認為增加員工間的知識分享行為和參加知識分享活動是和正面的社會互動文化有所關聯,因此除了型塑出彼此相互信任、認同的組織氣候或文化之外,也必須建構出易於知識分享的組織規範(如創新、團隊合作和尊重多元價值等)。然而知識分享主要是人與人之間的社會交換活動,因此還要強化成員分享知識的內在動機(如樂於助人)。所以鼓勵公共組織中的管理者和員工彼此間能夠保持頻繁的社會互動,以建立彼此間的人際信任與預期互關係,還有對組織整體的認同與信任,以促使成員產生分享知識的意圖。最後給組織中的公共管理者與政策制定者一個啟示,知識分享還是需要有一個知識分享環境或文化,因此管理者應該確保有效地創造出易於知識分享的環境或文化,以促使知識分享行為的產生。 / Knowledge sharing is a critical step for successful knowledge management. However, sharing knowledge not only requires time and effort but also reduces value or power in the public organization. Therefore, individual’s knowledge does not transform easily into organizational knowledge. The purpose of this study is to develop an understanding of the factors affecting the individual’s knowledge sharing behavior in the governmental context. The research model includes various constructs based on social exchange theory, social capital theory , and the theory of planned behavior .Hence, this research developed an integrated theoretical model and unveiled three sets of critical factors: psychological(extrinsic rewards, reciprocal relationships, enjoyment in helping others), organizational (identification ,trust , pro-sharing norm)and technological(information technology usage) that are believed to affect the knowledge sharing behaviors. Data collected from 524 employees in Taipei City Government were conducted to test the research model using the structural equation modeling (SEM) approach. / The results of the study provide empirical support for the overall structure theorized in the research model. Knowledge sharing behavior was predicted by the employees’ intention towards knowledge sharing and perceived behavioral control. Knowledge sharing intention in turn was predicted by employees’ attitude towards knowledge sharing, subjective norm and perceived behavioral control. The employees perceptions of reciprocal relationships, enjoyment in helping others and identification were positively associated with favorable attitude towards knowledge sharing. The perceptions of extrinsic rewards exerted a negative effect on the attitude. Organizational trust and pro-sharing norm positively influenced employees’ subjective norm. Additionally, information technology usage was positively associated with high levels of perceived behavioral control towards knowledge sharing. / Based on the findings, the study indicates that an increased effort to encourage employees to participate knowledge sharing activities is associated with a positive social interaction culture. Specifically, reinforcing individual’s intrinsic motivation and creating an organizational context characterized by trust, identification and pro-sharing norm are likely to encourage both management and employees to socialize and interact frequently with each other by means of driving knowledge sharing intention. Finally, the study has implications for public manager and policy maker to formulate policies and appropriately to ensure the effective creation of a knowledge sharing culture.

Rights to property, rights to buy, and land law reform : applying Article 1 of the First Protocol to the European Convention on Human RightsMaxwell, Douglas January 2018 (has links)
This dissertation examines the application and effect of Article 1 of the First Protocol to the ECHR in relation to Scots land law reform. Chapter one will reflect on why existing rights to property have come to be challenged. Chapter two sets out the human rights paradigm and scrutinises what rights and whose rights are engaged. Chapter three traces the development of A1P1. Chapter four applies the human rights paradigm to contemporary reforms. Chapter five considers the broader effect A1P1 has had on domestic property law. This dissertation submits that the problem to be overcome is that, in many instances, Scots land law reform has been reduced into a simplistic struggle. A1P1 has been held up as either a citadel protecting landowners or as an ineffective and unjustified right to be ignored. At the core of this debate are competing claims between liberal individualist rights to property and socially democratic, egalitarian goals. This dissertation argues that it is important to move beyond this binary debate. This is not about finding some mysterious "red card" or eureka moment that conclusively shows compatibility or incompatibility. Instead, compatibility will be determined by following a rule-based approach that values rational decision-making and the best available evidence, as well as the importance of democratic institutions. As such, it will be illustrated how future challenges are likely to focus not on the underlying purpose of land law reform but on the macro or micro granularity of Ministerial discretion. In coming to this conclusion, it will be argued that A1P1 has a pervasive influence on the entire workings of all public bodies and, like a dye, permeates the legislative process.

In the practical part, there is an analysis of some travel contracts (including the terms of a contract) of tour operators and travel agencies located in České Budějovice. This part also analyses the results which were obtained from the questionnaires intended for the customers of tour operators or travel agencies and for the tour operators and travel agencies.

Previous issue date: 2011-11-28 / Este trabalho tem como objetivo medir o tempo de duração dos processos judiciais envolvendo direitos sociais na seara educacional e verificar de que forma esse tempo afeta a fruição desses direitos. Visando atingir tais objetivos, foram identificados e analisados os processos judiciais, desde a sua entrada na 1.ª instância da justiça estadual até a data da sessão de julgamento do acórdão na 2.ª instância do Tribunal de Justiça de Minas Gerais. De forma subsidiária, o trabalho também identificou quem eram os litigantes, a influência da concessão das liminares no tempo de duração dos processos, a variação do tempo do processo com base na localização da comarca em que se inicia o processo e a existência de etapas mortas na tramitação dos processos judiciais. O pressuposto que guiou a pesquisa é o da possibilidade do perecimento de determinados direitos, como o direito ao oferecimento de vagas em creches e o direito ao acesso ao ensino superior público de forma gratuita, ante uma duração excessiva do tempo do processo judicial. / This study aims to measure the duration of court cases involving education social rights, seeing how this time affects the enjoyment of those rights. In order to achieve such objectives I identified and analyzed the legal cases, since its entry in a state court until the date of the trial session of Court of Appeals of Minas Gerais. Subsidiary this work also identified who the litigants are, the influence of granting injunctions in the duration of the processes, the time variation of the process based on the location of the county in which the process begins and the existence of dead steps in court proceedings. The assumption that guided the study is the possibility of extinction of certain rights, such as the right of places in day care and the right to access public higher education free of charge, in face of an excessive length of time of the lawsuit.

Le développement des relations économiques internationales et la construction d’un espace européen intégré tant d’un point de vue économique que politique a relancé le débat sur la nationalité des sociétés. La question n’est pas tant de savoir si les sociétés commerciales disposent d’une nationalité au même titre que les personnes physiques – les solutions en la matière sont depuis longtemps acceptées par la doctrine et la jurisprudence internationales – mais plutôt de déterminer comment cette notion a évolué et s’adapte aux contraintes d’une part, d’une économie de marché mondialisée et d’autre part, du droit de l’Union européenne qui bouleverse les solutions traditionnellement admises en matière de nationalité des sociétés dans les droits internes des Etats membres. Ainsi, les critères de rattachement juridique d’une société à un Etat déterminés par les règles de droit international privé de chaque Etat s’orientent inéluctablement vers le critère anglo-saxon de l’incorporation. L’apparition de nouvelles personnes morales de droit de l’UE comme la Société européenne (SE) ou la future Société privée européenne (SPE) posent également la question de la nationalité et de la loi applicable à ce type de groupement européen. Il en est de même s’agissant des groupes de sociétés dont une réglementation de leurs activités pourrait être relancée dans le cadre du droit de l’UE. / The development of international economic relations and the construction of an integrated European area, both from an economic and a political point of view, has revived the debate on the nationality of trading companies. The question is not so much whether trading companies have a nationality on an equal footing with natural persons – solutions have long been accepted by international doctrine and jurisprudence – but rather to determine how this notion has evolved and adapted to the constraints on the one hand, of a globalized market economy and, on the other hand, of European Union law which overturns the traditionally accepted solutions of nationality of trading companies into the legal systems of Member States. Thus, the criteria for the legal connection of a company to a State determined by the rules of private international law of each Member State are inevitably directed towards the Anglo-Saxon criterion of incorporation. The emergence of new European Union legal entities such as the European Company or the future European Private Company also raises the issue of nationality and the law applicable to this type of European legal entities. The same applies to groups of companies whose regulation of their activities could be revived under European Union law.

[pt] A tese apresenta um estudo sobre as toxicomanias pelo viés psicanalítico.
O ponto de vista que preside o trabalho é o de que o sujeito toxicômano dirige um
apelo ao Outro através do uso da droga para que a função paterna se faça presente.
Sob essa perspectiva, o uso da droga comporta uma mensagem dirigida ao Outro
para que um corte seja operado na relação sem limites construída com a droga.
Não trataremos dos efeitos orgânicos produzidos pelo uso da substância, mas da
função sempre singular que a droga pode ocupar um sujeito. No primeiro capítulo,
a introdução, será circunscrito o objeto de nosso trabalho: as toxicomanias. Já no
segundo capítulo examinaremos o fenômeno das drogas na perversão, na neurose
e na psicose. No terceiro capítulo, lançaremos um olhar sobre o uso da droga
através dos conceitos de supereu, satisfação pulsional, ideal do eu e pulsão de
morte. No quarto capítulo estudaremos o significante na dialética do desejo a fim
de localizar o lugar da droga para o sujeito. Trabalharemos também a construção
das relações de dependência que antecedem a dependência à droga em si e como o
uso da mesma pode servir como um apelo ao pai. Em seguida, partindo da
hipótese de que a fragilidade ou inoperância da função paterna propicia a
compulsão ao objeto droga como um modo de dar conta da angústia provocada
pelos efeitos da castração, investigaremos a problemática da droga a partir do
significante Nome-do-Pai e da Metáfora paterna. / [en] The thesis presents a study of addictions through the psychoanalytic point
of view. The view that presides the study is that the fellow addict runs an appeal
to the Other through the use of the drug to make the paternal function present.
From this perspective, the drug contains a message addressed to another so that a
cut should be operated in the relationship without limits built with the drug. It
will not treat the organic effects produced by the use of the substance, but the
unique function that the drug might occupy a person. In the first chapter, the
introduction, the object of the work will be circumscribed: the addictions. In the
second chapter it will examine the phenomenon of drugs in perversion, in neurosis
and psychosis. In the third chapter, it will launch a glimpse into the drug through
the concepts of superego, drive satisfaction, ego ideal and the death drive. In the
fourth chapter it will present the construction of dependence relations in
addictions and how drug use can serve as a call to a father. We will also study the
signifier in the dialectic of the desire in order to locate the place of the drug to the
addict. Then, assuming that the weakness or ineffectiveness of the paternal
function provides the compulsion to object drug as a way to solve the anguish
caused by the effects of castration, it will investigate the drug problem from the
significant Name of the Father and the paternal metaphor.

Creating safe, lively and attractive street spaces in city centres : A case study of Nygatan and Järnagatan in Södertälje / Att skapa trygga, levande och attraktiva gaturum i stadskärnor : En fallstudie av Nygatan och Järnagatan i SödertäljeJeanette, Bakhaya, Norlin, Felicia January 2023 (has links)
Throughout time, cities have been built in different ways and city structures can look different in different places in the world. The urban planning ideal has changed and small narrow alleys in the city have today been replaced by large roads adapted for cars. Streets can function as everything from transport routes to social meeting spaces depending on the design and experience. But the street, and the street space, which is the space that forms the surface between buildings, can today often be forgotten and experienced as tedious for many. In the work towards a more sustainable society, there is a lot that can be done in urban planning, and one of these is to design more attractive, safe and lively street spaces in order to meet the challenges that a growing city brings. Södertälje is a growing municipality in Stockholm County which will face these challenges while expanding. This study therefore aims to investigate Nygatan and Järnagatan in Södertälje's city centre based on their physical design, use and experiences of citizens and officials. This is to produce a basis for the design of a policy for sustainable improvement measures in the work to create a safe, lively and attractive street environment in Södertälje. To achieve the purpose of the study, a literature study was carried out together with the creation of a theoretical framework based on the various theories of Jan Gehl, Jane Jacobs and Warm in the Winter. In the theoretical framework, a model is developed with the five categories of urban form, mobility, environment, social and enjoyment, which were the basis for the various parts of the report. A spatial analysis was performed to obtain a physical description of Nygatan and Järnagatan. In addition, a document study was carried out to investigate which goals and strategies Södertälje municipality has. Furthermore, nine actors in Södertälje municipality were interviewed and a survey was carried out to investigate how the citizens experience and use the two streets in the city centre, whereas 188 citizens participated. The results from the spatial analysis showed that Nygatan had significantly more criteria that were considered poor than Järnagatan had. The interviews indicate that the officials and actors believe that Södertälje has good potential and that the two street spaces can be developed even more, especially Nygatan. The survey showed that citizens consider Nygatan to be a dull street with too much traffic and too little social activities, restaurants/shops and greenery. Järnagatan was experienced in a more positive way, but even there the range of restaurants/shops was poor and more greenery and social activities were desired. Even though a street can fulfil the theoretical criteria that exist, the street space may lack important aspects that can be vital and act as the last piece of the puzzle to make a street safe, lively and attractive. The conclusion is that it is the whole of the street space that makes it successful and that the interaction between different factors matters. A street should both look good, function well and feel good. Finally, different solutions and methods should be tried because no street space is the same. Södertälje is well on its way to exploring the various solutions to create better street space through the projects and events they initiate. / Genom alla tider har städer byggts på olika sätt och stadens strukturer kan se annorlunda ut på olika platser i världen. Stadsplaneidealet har förändrats och små trånga gränder i staden har idag ersatts av stora vägar anpassade för bilar. Gator kan fungera som allt från transportsträckor till sociala mötesrum beroende på utformning och upplevelse. Men gatan, och gaturummet, som är det rum som utgör ytan mellan byggnader, kan idag ofta glömmas bort och upplevas som trista för många. I arbetet mot ett mer hållbart samhälle finns det en hel del som kan göras inom stadsplaneringen, och ett av dessa är att utforma mer attraktiva, trygga och levande gaturum för att kunna möta de utmaningar som en växande stad för med sig. Södertälje är en växande kommun i Stockholms län som i och med expansionen kommer stå inför dessa utmaningar. Denna studie syftar därför till att undersöka Nygatan och Järnagatan i Södertäljes stadskärna utifrån deras fysiska utformning, användning samt upplevelser av medborgare och tjänstepersoner. Detta för att ta fram ett underlag till utformningen av en policy för hållbara förbättringsåtgärder i arbetet med att skapa en trygg, levande och attraktiv gatumiljö i Södertälje. För att uppnå syftet med studien genomfördes en litteraturstudie i samband med skapandet av ett teoretiskt ramverk baserat på Jan Gehls, Jane Jacobs och Warm in the Winters olika teorier. I det teoretiska ramverket utvecklades en modell med de fem kategorierna stadsform, mobilitet, miljö, socialt och njutning som låg till grund för studiens olika delar. En rumslig analys utfördes för att få en fysisk beskrivning av Nygatan och Järnagatan. Dessutom genomfördes en dokumentstudie för att undersöka vilka mål och strategier Södertälje kommun har. Vidare intervjuades nio aktörer i Södertälje kommun och en enkätundersökning utfördes för att undersöka hur medborgarna upplever och använder de två gatorna i stadskärnan, där 188 medborgare deltog. Resultatet från den rumsliga analysen visade att Nygatan hade betydligt fler undermåliga kriterier än vad Järnagatan hade. Intervjuerna tyder på att tjänstepersonerna och aktörerna anser att Södertälje har god potential och att de två gaturummen kan utvecklas ännu mer, i synnerhet Nygatan. Enkäten visade att medborgarna anser att Nygatan är en trist gata med för mycket trafik och för lite sociala aktiviteter, restauranger/butiker och grönska. Järnagatan upplevdes på ett positivare sätt men även där var utbudet av restauranger/butiker dåligt och mer grönska samt sociala aktiviteter önskades. Trots att en gata och dess gaturum kan uppfylla de teoretiska kriterier som finns så kan gaturummet sakna viktiga aspekter som kan vara avgörande och den sista pusselbiten till att göra en gata trygg, levande och attraktiv. Slutsatsen dras om att det är helheten i gaturummet som gör det lyckat och att samspelet mellan olika faktorer spelar roll. En gata bör både se bra ut, fungera bra och kännas bra. Slutligen bör olika lösningar och metoder prövas eftersom inget gaturum är det andra likt. Södertälje är på god väg i att utforska de olika lösningarna för att skapa bättre gaturum genom de projekt och evenemang som de kontinuerligt arbetar med.
