В условиях тендерных закупок значимым является учет влияния многих факторов при выборе стратегии ценового предложения участника, которые выходят за пределы классической экономики. Целью магистерской диссертации является разработка модели прогнозирования ценового предложения участников тендерных закупок. В работе рассматривается понятие прогнозирования ценового предложения, влияние факторов на участника тендерных закупок и принципы поведенческой экономики. В качестве источников использовалась научно-исследовательская и методическая литература, нормативно-правовые акты и статистические данные различных электронно-торговых площадок в открытом доступе. В магистерской диссертации была разработана модель прогнозирования ценового предложения участника тендерных закупок, базирующаяся на функции полезности Неймана-Моргенштерна, отличающаяся учетом влияния релевантных факторов, позволяющая корректировать тактику поведения участника для каждого шага торгов и максимизировать полезность предложения с точки зрения принципов поведенческой экономики. / In terms of tender purchases, it is important to take into account the influence of many factors when choosing a bidder's price proposal strategy, which go beyond the classical economy. The aim of the master's thesis is to develop a model for forecasting the price offer of bidders. The paper discusses the concept of forecasting the price offer, the influence of factors on the participant in tender purchases and the principles of behavioral economics. The sources used were scientific research and methodological literature, regulatory legal acts and statistical data of various electronic trading platforms in the public domain. In the master's thesis, a model for predicting the price offer of a bidder was developed based on the Neumann-Morgenstern utility function, which takes into account the influence of relevant factors, which allows you to adjust the bidder's behavior tactics for each bidding step and maximize the utility of the offer in terms of the principles of behavioral economics.

The Price of Fear : Estimating the economic effect of fear of crimeusing sold apartments in Stockholm, Sweden

Fear of crime may differ between areas, even if levels of crime do not differ. Policymakers and companies should be interested in how much economical values individuals put on their emotions. No previous paper has tried to estimate the economic consequences of the kind of fear of crime that does not stem from an increase in crime. Through a hedonic fixed effect-approach and a unique data set, I close this gap by estimating the willingness to pay to avoid that fear. As the outcome variable, I use sold apartments in Stockholm municipality in the years 2017 and 2020. I find suggestive evidence of small to moderate effect of fear of crime on housing prices, even after controlling for crime levels, with an elasticity of -2% to -6%. The results are robust throughout different robustness tests. These findings may help politicians in their cost-benefit analyses when planning safety-increasing projects.

Skillnader i kvinnor och mäns investeringsbeteende : Svenska aktieinvesterares psykologiska bias, aktiepreferenser och dess långsiktiga konsekvenser

The purpose of this thesis is to analyze differences between stock preferences of women and men in Sweden and analyze what portfolio characteristics and long-term effects that are revealed by investing in the stocks than men and women prefer. To fulfill the purpose of the thesis, two fictious portfolios have been created which are based on data from the reports “Aktieägandet i Sverige” by Euroclear. These reports present the favorite stocks of Swedish men and women by presenting stock top charts between the years 2017- 2021, and the data covers the total stock investing Swedish population. The fictious portfolios have been assigned to two fictious investors, Alice, and Adam, to enable analysis of the investment behavior and the portfolio’s performance on an aggregate level.   Alice’s and Adam’s portfolios are evaluated by using risk- and portfolio management measures, and the investment behavior is evaluated through measures previously presented in research within behavioral economics. The analysis is conducted by combining classic financial theory and previous research within behavioral economics to evaluate investment behavior from the perspective of portfolio theory.   The results show that the investment behavior differs between Swedish men and women, considering both stock preferences and investment strategy. Men tend to have a higher preference for risk than women and are more active when managing their portfolio. Women tend to invest more long-term and manages their portfolio in a more passive manner. Women also tend to invest in value stocks with dividends, while men invest in growth stocks. The investment strategy of men demonstrates a betting element which leads to a high total and non-systematic risk exposure. The consequences of the investment strategies long-term indicates that women obtain a more stable return due to lower volatility in their portfolio, while the higher non-systematic risk exposure and turn-over rate in men’s portfolio indicates that their return will be more volatile over time.   The results confirm, to a great extent, previous research on the differences between the investment behavior of women and men on an individual level. Based on new observations we conclude that a limited rational behavior does not always equal a higher risk exposure in the portfolio as it can also lower the level of risk. In addition, based on the analysis, we can conclude that men tend to invest more unethical than women. / Uppsatsens syfte är att identifiera och analysera skillnader i svenska kvinnor och mäns aktiepreferenser samt analysera vad för portföljegenskaper och långsiktiga effekter som följer av investering i de aktier som kvinnor och män föredrar. För att uppnå uppsatsens syfte har två fiktiva portföljer skapats som baseras på Euroclears rapporter ”Aktieägandet i Sverige”. Rapporterna presenterar svenska kvinnor och mäns favoritaktier i form av aktietopplistor mellan åren 2017–2021, varav datan omfattar hela den svenska aktieinvesterande populationen. De fiktiva portföljerna har tilldelats två fiktiva investerare, Alice och Adam, för att möjliggöra analys av investeringsbeteendet och portföljernas prestation på en aggregerad nivå.   Alices och Adams portföljer utvärderas med risk- och portföljutvärderingsmått, och investeringsbeteendet utvärderas genom mått som tidigare forskning inom beteendeekonomi lyft fram. Analysen genomförs genom att kombinera klassisk finansiell teori med tidigare forskning i beteendeekonomi för att utvärdera investeringsbeteendet ur ett portföljvalsperspektiv.   Resultaten påvisar att svenska kvinnor och mäns investeringsbeteende skiljer sig åt gällande både aktiepreferenser och förvaltningsstrategi. Män tenderar att ha en högre riskpreferens än kvinnor, samt är mer aktiva i förvaltningen av portföljen. Kvinnor tenderar att investera mer långsiktigt och passivt i familjära värdebolag med utdelning, medan män investerar i tillväxtbolag. Mäns investeringsstrategi har inslag av betting, vilket leder till en hög total- och icke-systematisk riskexponering. Konsekvenserna av investeringsstrategierna på lång sikt blir att kvinnor erhåller en stabilare avkastning till följd av lägre volatilitet, medan mäns exponering mot icke-systematisk risk samt höga omsättningshastighet leder till mer volatil avkastning över tid.  Resultaten bekräftar i stor utsträckning tidigare forskning om skillnader i kvinnor och mäns investeringsbeteende på individnivå. Genom nya observationer konstateras att ett begränsat rationellt beteende inte alltid leder till en högre riskexponering, utan även kan sänka risknivån i portföljen. Dessutom kan vi utifrån analysen konstatera att män tenderar att investera mer oetiskt än kvinnor.

Ekonomiska incitament och visselblåsning : En komparativ studie / Financial incentives and whistle-blowing : a comparative study

Visselblåsarbegreppet har blivit ett allt mer frekvent förekommande inslag inom den unionsrättsliga lagstiftningen, och vikten av att beskydda arbetstagare som bistår myndigheter med information som kan stoppa överträdelser har på senare år uppmärksammats och betonats världen över. I samband med en modernisering och uppdatering av den finansmarknadsrättsliga lagstiftningen, inte minst till följd av den tekniska utvecklingen inom området, valde EU:s lagstiftande organ att göra en markering mot fysiska och juridiska personer som ägnar sig åt överträdelser som kan vilseleda aktörerna på de finansiella marknaderna. Bland annat infördes, genom ett antal nya rättsakter, enhetliga sanktioner samt minimibestämmelser för kriminalisering av vissa ageranden. Vid framtagandet av lagstiftningen diskuterades även på EU-nivå huruvida ett potentiellt införande av ekonomiska incitament för visselblåsare som bidrar med värdefull information i fråga om marknadsmissbruk borde utgöra en del av det sociala skyddet för nämnda individer. Medlemsstaterna hade redan i samband med tidigare unionsöverskridande lagstiftning ålagts att vidta särskilda åtgärder för att säkerställa att visselblåsare erhåller skydd gentemot arbetsgivare avseende hämndaktioner, men här, tydligt inspirerade av den amerikanska lagstiftningen i motsvarande område, öppnade EU för första gången för att låta unionsmedlemmarna erbjuda monetära utbetalningar till visselblåsare. I förevarande uppsats presenteras den aktuella EU-lagstiftningen samt den inhemska lagstiftning som bestämmelserna genererat i Sverige. Nämnda inslag sätts i relation till den amerikanska visselblåsarlagstiftningen. En redogörelse för lagstiftningens mottagande och effekt – kombinerat med teoretiska såväl som statistiska studier avseende ekonomiska incitament kopplat till visselblåsning – används för att besvara frågan huruvida ett införande av nämnda incitament skulle kunna utgöra ett ändamålsenligt inslag inom den svenska lagstiftningen. Min argumentation, vilken presenteras i analysdelen, utmynnar i ståndpunkten att ekonomiska incitament mycket väl skulle kunna utgöra en funktionell beståndsdel av visselblåsarskyddet, men att lagstiftningens utformning och det praktiska utförandet skulle kunna optimeras jämfört med dess amerikanska motsvarighet. Vidare vill jag i analysavsnittet betona vikten av ett skifte i inställning och attityd inom europeisk rättskultur gentemot visselblåsare.

The work is initiated by the historical evolution of Brazilian pension funds’ regulations. It analyzes the systemic impacts created by changes to the pension pillars, particularly to the first one (public pension). In view of these changes and the increasing relevance of the second pillar (occupational pension) to ensure the welfare, this dissertation aims to analyze the possibility of occurrence of cognitive biases in complementary pensions-related decisions. Those cognitive biases can lead individuals to choose options that do not maximize their welfare, for reasons such as inertia, procrastination and optimism, unlike the predicted by the rationality assumption of the neoclassical economic theory. The outcomes analyzed indicate the necessity of regulatory measures to mitigate these cognitive biases, which should be mainly the adoption of a choice arquitecture that can induce the welfare maximization, without limit the individual freedom of choice. Those measures, however, specially the automatic enrollment, are intended to alleviate the cognitive biases, being censurable its adoption in pension plans with predominance of other reasons to the low levels of enrollment, as distrust in the fund administration. Moreover, is needed to respect certain criteria in the automatic enrollment implementation, in order to ensure that this instrument is used only when cognitive biases that reduce the welfare are observed, as well that the option that people are being nudged to is a gainful option, at least most of the times. At end, it is verified the legality of these measures using the standard of proportionality, which allows to identify the limits to the regulatory intensity. / A presente dissertação investiga a utilização de medidas como a adesão automática pela regulação da previdência complementar fechada a partir da flexibilização do conceito de racionalidade, tendo como base a Análise Econômica e Comportamental do Direito. Inicia-se o trabalho pela evolução histórica da regulação da previdência no Brasil, avaliando os impactos sistêmicos das alterações ocorridas no primeiro pilar previdenciário (regimes básicos). Em virtude dessas alterações e do crescimento da relevância do segundo pilar de previdência social (Previdência Complementar Fechada) para a manutenção do bem-estar, analisa-se a possibilidade de ocorrência de vieses cognitivos que implicam desvios de racionalidade dos indivíduos nas decisões relativas à previdência complementar. Esses vieses cognitivos podem fazer com que indivíduos escolham alternativas que não maximizam seu bem-estar, por razões como inércia, procrastinação e superotimismo, ao contrário do que aponta o pressuposto de racionalidade da Economia Neoclássica. Os resultados analisados conduzem à necessidade de adoção de medidas regulatórias capazes de mitigar esses desvios de racionalidade, na forma de adoção de arquitetura de escolhas que induzam à maximização do bem-estar individual, sem limitar a liberdade individual dos envolvidos. Essas medidas, entretanto, especialmente a adesão automática aos planos de benefícios, destinam-se à mitigação de vieses cognitivos, sendo criticável sua adoção em planos de previdência onde observa-se predominância de outras razões para baixos níveis de adesão, como desconfiança em relação à gestão do plano. Ademais, faz-se necessário respeitar certos critérios para sua implementação, a fim de garantir que esse instrumento somente seja utilizado quando se observar vieses cognitivos que prejudiquem significativamente o bem-estar, bem como que a opção à qual os indivíduos estão sendo induzidos é vantajosa, ao menos na grande maioria das vezes. Ao final, verifica-se a juridicidade dessas medidas, à luz da proporcionalidade, norma que permite identificar os limites para a intensidade regulatória.

A presente tese tem por objetivo principal estudar a legitimação jurídico-moral da regulação estatal. Trata-se de tema de grande relevância e extrema atualidade em decorrência de dois fatores. Por um lado, desde o fenômeno da virada kantiana e da retomada da preocupação com o estabelecimento de uma teoria da justiça, tornou-se necessária a análise de justificação jurídico-moral de toda e qualquer instituição político-jurídica positivada. Por outro lado, entre as inúmeras instituições político-jurídicas positivadas, cresce cada vez mais a utilização das medidas jurídicas regulatórias, através das quais o Poder Público direciona ou controla a conduta dos agentes com o intuito de atingir determinada finalidade. Instituto econômico que é, ao interferir na alocação de riquezas, bens e serviços no mercado, a regulação estatal há tempos já vem sendo objeto de análise em uma perspectiva de legitimação econômica. Tradicionalmente, ainda dentro do paradigma da racionalidade, os economistas sempre apontaram as falhas de mercado como as razões a justificar as regulações estatais em um viés econômico. Mais recentemente, por sua vez, os adeptos da economia comportamental, rompendo ou relativizando as lições da Rational Choice Theory, têm apontado também as ações irracionais em heurística como razões a justificar as regulações estatais em um viés econômico. Ocorre, entretanto, que a regulação estatal é um instituto interdisciplinar. Ao direcionar ou controlar a conduta dos indivíduos, limitando ou implementando direitos e liberdades, a regulação constitui instituto simultaneamente jurídico e moral. A presente tese, portanto, buscará apresentar as razões a servir de justificação para a regulação estatal em uma perspectiva jurídico-moral. Neste ponto, adotar-se-á como paradigma de aferição de legitimação jurídico-moral das instituições político-jurídicas positivadas (entre as quais as regulações estatais) um liberalismo-republicano, consistente na compatibilização do liberalismo-igualitário com um republicanismo moderado. Desta forma, o estudo buscará defender a possibilidade de a legitimação jurídico-moral das diversas regulações estatais encontrar fundamento em um ou alguns de três valores jurídico-morais: a autonomia individual privada, as condições igualitárias e a autonomia pública. No que diz respeito à implementação da autonomia individual privada e das condições igualitárias, primeiramente, a tese defenderá a possibilidade de ser realizada uma nova leitura jurídico-moral dos institutos econômicos das falhas de mercado e das ações irracionais em heurística. Neste sentido, o conceito de falhas de mercado e o conceito de ações irracionais em heurística, em uma leitura jurídico-moral como razões a justificar a legitimação das regulações estatais, devem ser entendidos como situações em que o atuar livre dos agentes no mercado viole ou deixe de implementar os valores jurídico-morais fundamentais da autonomia individual privada e das condições igualitárias. Ainda no que diz respeito às influências liberal-igualitárias, a tese sustentará que, mesmo na inexistência de falhas de mercado ou de ações irracionais em heurística, será possível o estabelecimento de regulações estatais que encontrem justificação no valor jurídico-moral fundamental da igualdade, desde que tais regulações estejam destinadas a implementar as condições igualitárias mínimas necessárias à manutenção da própria autonomia individual privada e da dignidade humana. Por outro lado, no que diz respeito às influências republicanas, será exposto que as regulações estatais podem encontrar legitimação jurídico-moral também no valor jurídico-moral fundamental da autonomia pública. A saber, as regulações podem se encontrar legitimadas jurídico-moralmente quando da implementação dos projetos e políticas deliberados pelos cidadãos e pela sociedade no exercício da soberania popular, desde que tais projetos coletivos não violem os requisitos mínimos de dignidade humana dos indivíduos. A tese defenderá que os princípios da proporcionalidade e da igualdade podem exercer um papel de destaque na análise de legitimação jurídico-moral das regulações estatais. O princípio da proporcionalidade, neste ponto, será útil instrumental metodológico na aferição de legitimação jurídico-moral de uma medida regulatória em uma perspectiva interna, quando da aferição da relação estabelecida entre os meios e os fins da regulação. O princípio da igualdade, por sua vez, será útil instrumental metodológico na aferição de legitimação jurídico-moral de uma medida regulatória em uma perspectiva comparativa entre as diversas medidas regulatórias existentes. Por fim, uma vez enfrentados os pontos mais sensíveis pertinentes à justificação de toda e qualquer medida regulatória bem como estabelecida uma teoria geral acerca da legitimação jurídico-moral da regulação estatal, a presente tese realizará um estudo de caso acerca da legitimação jurídico-moral especificamente das regulações que utilizam argumentos de natureza paternalista. Trata-se de regulações que, ao direcionar a conduta de agentes com o intuito de zelar por bens, direitos e interesses destes próprios indivíduos cuja liberdade é restringida, apresentam-se extremamente controversas. Será exposto que, desde a clássica obra On Liberty de JONH STUART MILL, o paternalismo jurídico vem sendo tradicionalmente associado a uma conotação pejorativa de violação aos valores jurídico-morais fundamentais. A tese, porém, adotará posição segundo a qual as regulações paternalistas podem eventualmente encontrar legitimação jurídico-moral na promoção ou proteção dos valores jurídico-morais fundamentais da autonomia individual privada e da igualdade. Além disto, defenderá o estudo que os institutos econômicos das falhas de mercado da assimetria de informações e dos problemas de coordenação bem como os institutos econômicos das ações irracionais em heurística, adotados na nova leitura jurídico-moral proposta, servirão de instrumental útil na identificação das situações em que tais regulações paternalistas se encontram legitimadas jurídico-moralmente diante da premissa liberal-republicana. / The main objective of this thesis is to study the juridical-moral legitimation of public regulation. The theme is both important and current due to two factors. On one hand, since the Kantian turn and the retake of the concern with the establishment of a theory of justice, it became necessary to analyze the juridical-moral justification of every single positive political-juridical institution. On the other hand, among the countless positive political-juridical institutions, each day it increases the use of regulation, measures trough witch the State directs or controls the conducts of the agents in order to achieve a certain goal. Being an economic institution, as it interferes in the allocation of wealth, goods and services in the market, public regulation has already been for years object of analysis in a perspective of economic legitimation. Traditionally, still inside the paradigm of rationality, the economists have always pointed out the market failures as reasons to justify public regulation in an economic sense. More recently, the followers of the behavioral economics, breaking up with or mitigating the lessons of the Rational Choice Theory, have pointed out also the irrational actions in heuristics as reasons to justify public regulations in an economic sense. It happens, though, that regulation is an interdisciplinary institution. While it directs or controls conducts of individuals, limiting or enforcing rights and liberties, regulation presents itself also and at the same time as a juridical and moral institution. The thesis, then, will try to present the reasons that can be used in the justification of public regulation in a juridical-moral perspective. At this point, it will be used as a paradigm for the juridical-moral legitimation of the positive political-juridical institutions (among them the public regulation) a republican-liberalism, witch consists in an agreement established between the egalitarian-liberalism and a moderate conception of the republicanism. So being, the study will try to defend that the juridical-moral legitimation of the many existent public regulations can find foundation in one or some of three juridical-moral values: private individual autonomy, egalitarian conditions, and public autonomy. Concerning the enforcement of private individual autonomy and of egalitarian conditions, at first place, the thesis will defend the possibility of a new juridical-moral reading of the economic institutions of market failures and of irrational actions in heuristics. The concept of market failures and the concept of irrational actions in heuristic, in a juridical-moral reading as reasons to justify the legitimation of public regulations, should be understood as situations in witch the free acting of the agents in the market violates or isnt capable of enforcing the fundamental juridical-moral values of private individual autonomy and of egalitarian conditions. Still concerning the egalitarian-liberal influences, the thesis will hold up that, even when market failures and irrational actions in heuristics do not exist, it will be possible the establishment of public regulations that find justification in the juridical-moral foundation of equality, as long as these regulations are bound to improve the egalitarian conditions necessary to the maintenance of human dignity and private individual autonomy. On the other hand, concerning the republican influences, it will be shown that public regulation can find juridical-moral legitimation also in the fundamental juridical-moral value of public autonomy. This means that regulations might be juridical-morally legitimate when they implement projects and policies deliberated by citizens and society in the exercise of popular sovereignity, as long as these collective projects do not violate the minimum standards necessary to ensure human dignity. The thesis will defend that the principles of proportionality and of equality may play an important role in the analysis of juridical-moral legitimation of public regulation. The principle of proportionality can be an useful methodological instrument in the analysis of the juridical-moral legitimation of a regulatory measure in an internal perspective, questioning the relationship established between the means and ends of the regulation. The principle of equality, on its turn, can be an useful methodological instrument in the analysis of the juridical-moral legitimation of a regulatory measure in a comparative perspective between the numerous existent regulatory measures. At last, once studied the most important issues concerning the justification of every single regulatory measure and once established a general theory about the juridical-moral legitimation of public regulation, the thesis will develop a case study about the juridical-moral legitimation specifically of the regulations that use paternalistic arguments in their support. Those regulatory measures, as they direct the conducts of agents aiming to protect goods, rights and interests of these same individuals whose liberties are restricted, are very controversial. It will be shown that, since the classical work On Liberty by JOHN STUART MILL, legal paternalism has been traditionally associated to a negative connotation of fundamental juridical-moral value violation. The thesis, though, will adopt the position that regulatory measures may find juridical-moral legitimation in the enforcement or protection of the fundamental juridical-moral values of private individual autonomy and of equality. Besides, it will hold up that the economic institutions of market failures information asymmetry and coordination problems as well as the economic institutions of irrational actions in heuristics, adopted in the new juridical-moral reading suggested, may be useful tools in the identification of the situations in witch such paternalistic regulations are juridical-morally legitimate in face of the republican-liberalism.

A presente tese tem por objetivo principal estudar a legitimação jurídico-moral da regulação estatal. Trata-se de tema de grande relevância e extrema atualidade em decorrência de dois fatores. Por um lado, desde o fenômeno da virada kantiana e da retomada da preocupação com o estabelecimento de uma teoria da justiça, tornou-se necessária a análise de justificação jurídico-moral de toda e qualquer instituição político-jurídica positivada. Por outro lado, entre as inúmeras instituições político-jurídicas positivadas, cresce cada vez mais a utilização das medidas jurídicas regulatórias, através das quais o Poder Público direciona ou controla a conduta dos agentes com o intuito de atingir determinada finalidade. Instituto econômico que é, ao interferir na alocação de riquezas, bens e serviços no mercado, a regulação estatal há tempos já vem sendo objeto de análise em uma perspectiva de legitimação econômica. Tradicionalmente, ainda dentro do paradigma da racionalidade, os economistas sempre apontaram as falhas de mercado como as razões a justificar as regulações estatais em um viés econômico. Mais recentemente, por sua vez, os adeptos da economia comportamental, rompendo ou relativizando as lições da Rational Choice Theory, têm apontado também as ações irracionais em heurística como razões a justificar as regulações estatais em um viés econômico. Ocorre, entretanto, que a regulação estatal é um instituto interdisciplinar. Ao direcionar ou controlar a conduta dos indivíduos, limitando ou implementando direitos e liberdades, a regulação constitui instituto simultaneamente jurídico e moral. A presente tese, portanto, buscará apresentar as razões a servir de justificação para a regulação estatal em uma perspectiva jurídico-moral. Neste ponto, adotar-se-á como paradigma de aferição de legitimação jurídico-moral das instituições político-jurídicas positivadas (entre as quais as regulações estatais) um liberalismo-republicano, consistente na compatibilização do liberalismo-igualitário com um republicanismo moderado. Desta forma, o estudo buscará defender a possibilidade de a legitimação jurídico-moral das diversas regulações estatais encontrar fundamento em um ou alguns de três valores jurídico-morais: a autonomia individual privada, as condições igualitárias e a autonomia pública. No que diz respeito à implementação da autonomia individual privada e das condições igualitárias, primeiramente, a tese defenderá a possibilidade de ser realizada uma nova leitura jurídico-moral dos institutos econômicos das falhas de mercado e das ações irracionais em heurística. Neste sentido, o conceito de falhas de mercado e o conceito de ações irracionais em heurística, em uma leitura jurídico-moral como razões a justificar a legitimação das regulações estatais, devem ser entendidos como situações em que o atuar livre dos agentes no mercado viole ou deixe de implementar os valores jurídico-morais fundamentais da autonomia individual privada e das condições igualitárias. Ainda no que diz respeito às influências liberal-igualitárias, a tese sustentará que, mesmo na inexistência de falhas de mercado ou de ações irracionais em heurística, será possível o estabelecimento de regulações estatais que encontrem justificação no valor jurídico-moral fundamental da igualdade, desde que tais regulações estejam destinadas a implementar as condições igualitárias mínimas necessárias à manutenção da própria autonomia individual privada e da dignidade humana. Por outro lado, no que diz respeito às influências republicanas, será exposto que as regulações estatais podem encontrar legitimação jurídico-moral também no valor jurídico-moral fundamental da autonomia pública. A saber, as regulações podem se encontrar legitimadas jurídico-moralmente quando da implementação dos projetos e políticas deliberados pelos cidadãos e pela sociedade no exercício da soberania popular, desde que tais projetos coletivos não violem os requisitos mínimos de dignidade humana dos indivíduos. A tese defenderá que os princípios da proporcionalidade e da igualdade podem exercer um papel de destaque na análise de legitimação jurídico-moral das regulações estatais. O princípio da proporcionalidade, neste ponto, será útil instrumental metodológico na aferição de legitimação jurídico-moral de uma medida regulatória em uma perspectiva interna, quando da aferição da relação estabelecida entre os meios e os fins da regulação. O princípio da igualdade, por sua vez, será útil instrumental metodológico na aferição de legitimação jurídico-moral de uma medida regulatória em uma perspectiva comparativa entre as diversas medidas regulatórias existentes. Por fim, uma vez enfrentados os pontos mais sensíveis pertinentes à justificação de toda e qualquer medida regulatória bem como estabelecida uma teoria geral acerca da legitimação jurídico-moral da regulação estatal, a presente tese realizará um estudo de caso acerca da legitimação jurídico-moral especificamente das regulações que utilizam argumentos de natureza paternalista. Trata-se de regulações que, ao direcionar a conduta de agentes com o intuito de zelar por bens, direitos e interesses destes próprios indivíduos cuja liberdade é restringida, apresentam-se extremamente controversas. Será exposto que, desde a clássica obra On Liberty de JONH STUART MILL, o paternalismo jurídico vem sendo tradicionalmente associado a uma conotação pejorativa de violação aos valores jurídico-morais fundamentais. A tese, porém, adotará posição segundo a qual as regulações paternalistas podem eventualmente encontrar legitimação jurídico-moral na promoção ou proteção dos valores jurídico-morais fundamentais da autonomia individual privada e da igualdade. Além disto, defenderá o estudo que os institutos econômicos das falhas de mercado da assimetria de informações e dos problemas de coordenação bem como os institutos econômicos das ações irracionais em heurística, adotados na nova leitura jurídico-moral proposta, servirão de instrumental útil na identificação das situações em que tais regulações paternalistas se encontram legitimadas jurídico-moralmente diante da premissa liberal-republicana. / The main objective of this thesis is to study the juridical-moral legitimation of public regulation. The theme is both important and current due to two factors. On one hand, since the Kantian turn and the retake of the concern with the establishment of a theory of justice, it became necessary to analyze the juridical-moral justification of every single positive political-juridical institution. On the other hand, among the countless positive political-juridical institutions, each day it increases the use of regulation, measures trough witch the State directs or controls the conducts of the agents in order to achieve a certain goal. Being an economic institution, as it interferes in the allocation of wealth, goods and services in the market, public regulation has already been for years object of analysis in a perspective of economic legitimation. Traditionally, still inside the paradigm of rationality, the economists have always pointed out the market failures as reasons to justify public regulation in an economic sense. More recently, the followers of the behavioral economics, breaking up with or mitigating the lessons of the Rational Choice Theory, have pointed out also the irrational actions in heuristics as reasons to justify public regulations in an economic sense. It happens, though, that regulation is an interdisciplinary institution. While it directs or controls conducts of individuals, limiting or enforcing rights and liberties, regulation presents itself also and at the same time as a juridical and moral institution. The thesis, then, will try to present the reasons that can be used in the justification of public regulation in a juridical-moral perspective. At this point, it will be used as a paradigm for the juridical-moral legitimation of the positive political-juridical institutions (among them the public regulation) a republican-liberalism, witch consists in an agreement established between the egalitarian-liberalism and a moderate conception of the republicanism. So being, the study will try to defend that the juridical-moral legitimation of the many existent public regulations can find foundation in one or some of three juridical-moral values: private individual autonomy, egalitarian conditions, and public autonomy. Concerning the enforcement of private individual autonomy and of egalitarian conditions, at first place, the thesis will defend the possibility of a new juridical-moral reading of the economic institutions of market failures and of irrational actions in heuristics. The concept of market failures and the concept of irrational actions in heuristic, in a juridical-moral reading as reasons to justify the legitimation of public regulations, should be understood as situations in witch the free acting of the agents in the market violates or isnt capable of enforcing the fundamental juridical-moral values of private individual autonomy and of egalitarian conditions. Still concerning the egalitarian-liberal influences, the thesis will hold up that, even when market failures and irrational actions in heuristics do not exist, it will be possible the establishment of public regulations that find justification in the juridical-moral foundation of equality, as long as these regulations are bound to improve the egalitarian conditions necessary to the maintenance of human dignity and private individual autonomy. On the other hand, concerning the republican influences, it will be shown that public regulation can find juridical-moral legitimation also in the fundamental juridical-moral value of public autonomy. This means that regulations might be juridical-morally legitimate when they implement projects and policies deliberated by citizens and society in the exercise of popular sovereignity, as long as these collective projects do not violate the minimum standards necessary to ensure human dignity. The thesis will defend that the principles of proportionality and of equality may play an important role in the analysis of juridical-moral legitimation of public regulation. The principle of proportionality can be an useful methodological instrument in the analysis of the juridical-moral legitimation of a regulatory measure in an internal perspective, questioning the relationship established between the means and ends of the regulation. The principle of equality, on its turn, can be an useful methodological instrument in the analysis of the juridical-moral legitimation of a regulatory measure in a comparative perspective between the numerous existent regulatory measures. Since software and hardware is well available for automated text analysis and since a large data that describes real projects submitted to grant program is opened up, there is a possibility to follow phenomena of behavioral economics and psycholinguistics which evidence particularities in textual descriptions may be statistically associated with a reader's behavior or with a reader's decision-taking, which, in this case, involves an influence on final allocation of grant funds. The thesis uses forenamed areas as a starting-point and also employs quantitative indicators from the field of forensic linguistics in order to perform a computer-aided quantitative text analysis. The main goal is to evaluate from correlation perspective, if there in real operational programmes were present any associable relationships between the quantitative features of a proposed project's textual description and the amount of grant allocated to a project. The thesis is divided into four chapters, where it introduces basis, describes analyzed data and used methods, comments on made analyses and found relations, and all the performed research is summarized and evaluated in the last chapter.

Participatory interventions for pro-social and collective action in natural resource management: An institutional and behavioural approach / Intervenciones participativas para la acción pro-social y colectiva en la gestión de los recursos naturales. One of the main environmental policy challenges is convincing individuals and organisations to engage in socially desirable courses of action; that is, to have them internalise the consequences of their decisions. As contributions from institutional and behavioural economics have indicated, policies aimed at fostering pro-social action can be ineffective and even counterproductive if the interests and concerns of the relevant actors are not properly considered throughout the policy process. In fact, international conventions and national legislation around the world generally recommend stakeholder involvement in order to properly address pressing environmental challenges. The evidence that underpins and informs this recommendation, however, is still insufficient and scattered across different strands of literature. On the one hand, research on participatory governance has indeed systematically documented the potential for policymakers and resource managers to obtain high-quality, context-specific and legitimate input for environmental policymaking from participatory processes. On the other, the available research has also cast doubt on the potential of participatory processes to produce concrete change in (pro-social) action on the ground. In general, the success of these processes ultimately depends on their design, implementation and context. However, most of these conclusions stem from rich qualitative accounts of participatory processes, structured comparisons of cases and systematic reviews of case studies and the available literature. With this type of evidence, it is difficult to neatly identify the impact of participatory interventions on pro-social and cooperative behaviour and systematically assess the underlying mechanisms. This thesis addresses these knowledge gaps. The thesis investigates the extent to which and the mechanisms by which participatory interventions could foster (or hinder) pro-social and collective action for natural resource management and environmental protection. It comprises four chapters, each constituting a stand-alone, self-contained academic paper. Throughout the different chapters, the thesis reviews and integrates insights from the literature on participatory governance and from the institutional and behavioural analyses of pro-social and collective action. Furthermore, using two laboratory economic experiments (Chapters 3 and 4) and one framed lab-in-the-field experiment (Chapter 5), the thesis systematically assesses specific hypotheses concerning the potential impacts of participatory interventions on cooperative and pro-social behaviour and the underlying mechanisms of these impacts. The introductory chapter of the dissertation gathers, presents and discusses the insights gathered from each chapter. It expands on the motivations for the thesis, presents the general and specific research gaps and questions the thesis tackles and clarifies the conceptual, theoretical and methodological foundations upon which the thesis is grounded. Chapter 2 (entitled Participatory interventions for collective action in environmental and natural resource management) reviews the literature on participatory governance together with the literature on collective action in natural resource and environmental management. The main goal of this review is to contribute to integrating the main insights from both strands of literature regarding (a) the potential of participatory interventions to foster collective action and (b) the channels through which they might foment (or hinder) collective action. It therefore seeks to help integrate the insights from these different strands of literature, which, although related, have generally been disconnected until now. The chapter draws on the Institutional Analysis and Development (IAD) framework to organise these insights within a coherent conceptual framework. As the results of this literature review indicate, participatory interventions have the potential to foster collective action through two channels. Firstly, by helping resource users to change (and enhance) the rules, norms and strategies that constrain and guide their behaviour (the indirect channel) and, secondly, by directly influencing the specific behavioural factors (e.g. knowledge, trust, preferences, perceptions and beliefs) that collective action hinges upon (the direct channel). However, to sustain collective action, the relevant literature has consistently emphasised that trust needs to be continually cultivated and ensured. Therefore, in line with insights from earlier studies on participatory governance, the results of this literature review also indicate that practitioners and policymakers must not only design participatory interventions carefully to effectively build the trust needed to heighten and sustain collective action, but participatory interventions must also be adequately embedded within the broader (social-ecological and governance) context, providing for follow-up, enforcement, monitoring and conflict-resolution mechanisms. From Chapter 3 through Chapter 5, the thesis focuses on the direct channel, studying the potential of participatory interventions to directly influence behaviour within relevant economic action situations such as social dilemma and distributive action situations. Within a given environment and institutional context, the studies recreate processes commonly facilitated within participatory interventions. Chapter 3 assesses the effects of externally structured and facilitated processes of information exchange, and Chapters 4 and 5 examine the impact of inducing perspective-taking via role-switching techniques (Chapter 4) and instructions (Chapter 5). Thanks to this experimental approach, it is possible to systematically assess the behavioural impacts of these types of processes as well as the underlying mechanisms. Chapter 3 (entitled Structuring communication effectively for environmental cooperation) starts by reviewing previous experimental studies on the effects of two-way communication in social dilemmas to identify the elements that are commonly involved in effective communication processes. This review notes four cooperation-enhancing components of communication: (i) problem awareness, (ii) exploration of strategies to tackle the problem at hand, (iii) agreement on desirable joint strategies and (iv) ratification of agreed-upon strategies. A total of 560 students at Osnabrück University participated in a laboratory implementation of a voluntary contribution mechanism; a public goods game. The experiment implemented a series of interventions that represented these components of communication and contrasted the resulting levels of cooperation with the average outcomes of control groups interacting under either free (unstructured) communication or no communication whatsoever. The intervention that facilitated agreement on a common strategy (i.e. the combination of (ii) and (iii)) was particularly effective at boosting cooperation. Furthermore, combined with interventions promoting problem awareness and ratification, this intervention produced levels of cooperation similar to the average levels of cooperation observed in groups with free-form communication. The results of this experiment expand the understanding in the literature of the role of communication in social dilemmas and provide insights into the potential of structured and facilitated processes of information exchange and social interaction to foster collective action for environmental management. Chapter 4 (The effects of inducing perspective-taking through role reversal in a give-and-take a dictator game on pro-social behaviour) and Chapter 5 (Perspective-taking for pro-social behaviour in watershed management) deal with the effects of inducing perspective-taking on unilateral pro-social behaviour. The results outlined in Chapter 4 indicate that perspective-taking, induced through role reversal, can be associated with significant average changes in the participants’ self-reported state of emotions (in terms of both empathic and positive as well as in distressing and negative emotions). The emotional reactions that the role reversal seems to influence, however, do not appear to result in significantly more (or less) pro-social behaviour. The chapter explores and discusses two plausible explanations for these results, namely the transient effects of emotional reactions and the opposing effects of diverging emotional reactions on pro-social behaviour. These results come from the analysis of data from 144 students at Osnabrück University who participated as dictators in a laboratory implementation of a give-and-take dictator game. The design of the experiment allows the identification of the effect of inducing decision-makers to experience the other person’s position through unilateral role reversal on pro-social behaviour. During the simulation round, dictators in treatment groups experienced how it would feel to be in the role of the recipient. Dictators in the control groups only learned about the distributional consequences of their allocation decisions on recipients. Hence, through a treatment comparison, it was possible to single out the effects resulting from temporarily taking on the position of the other participant. To understand the underlying drivers of a potential behavioural change, the study elicited participants’ emotional states both before and after the simulation round. The results in Chapter 5 indicate that inducing perspective-taking can be associated with relatively greater pro-social behaviour based on an experimental study of downstream farmers’ behaviour in a watershed management context. Moreover, the provision of information on the social-ecological context during the perspective-taking exercise cannot account for the different behavioural patterns in the treatment and control groups. These results come from a lab-in-the-field experiment carried out with 177 downstream farmers in a Peruvian watershed. In the experiment, farmers in the treatment groups were motivated to imagine the upstream farmers’ perspective (i.e. to think about their thoughts and feelings) before deciding on whether or not to contribute to an initiative in the upper watershed. The initiative intends to help upstream farmers improve their well-being without compromising the water supply downstream. The behaviour of farmers in the treatment groups was compared against the behaviour of farmers in the control groups wherein perspective-taking was not induced. Taken together, the results of Chapter 4 and Chapter 5 illustrate the potential of inducing perspective-taking—commonly promoted in participatory processes—to trigger pro-social behaviour in economic situations. It can indeed alter relevant behavioural variables and trigger pro-social behaviour in distributive and social-dilemma situations. Nevertheless, as the literature on perspective-taking has previously indicated, the final effects depend on the specific procedures by which and the situations and contexts wherein perspective-taking is induced. Based on these findings, it is possible to sustain that participatory interventions do have the potential to effect changes in pro-social and cooperative behaviour at both the collective and individual level. Whether this impact is realised or hindered hinges on the procedures and contexts of participatory interventions. It would also depend on the mechanisms provided to follow up on the initiated processes and sustain and build upon the early outcomes. The contributions of this thesis are threefold. Firstly, it integrates insights from the literature on the institutional and behavioural analysis of pro-social and collective action and the literature on participatory governance for natural resource management. Secondly, it generates new evidence, based on experimental methods, in terms of the potential for participatory interventions to foster pro-social and collective action, and in terms of the mechanisms by which participatory methods and processes could effectively impact (or hinder) pro-social and cooperative behaviour. In this way, the thesis helps to bridge the gap of knowledge in terms of how participatory interventions can effectively change behaviour and, subsequently, encourage socially desirable social-ecological outcomes. In doing so, it also adds to the understanding of pro-social and cooperative human behaviour and the way that the processes of information-exchange and perspective-taking, which are often facilitated by participatory processes, may (or may not) advance it. Research on participation is, however, still ongoing and, in terms of the way forward, the thesis makes a third, methodological contribution. It demonstrates how experimental research in both the laboratory and in the field, conducted under a coherent conceptual and methodological framework, can complement one another and shed light on the extent to which and the means by which participatory interventions can produce changes in behaviour. The experimental method, in terms of both laboratory and field experiments, can therefore complement the set of methods traditionally employed to analyse participatory processes. The results of the studies comprising the thesis underscore the importance of carefully analysing the policy process. As contributions from the behavioural literature have repeatedly indicated, human behaviour is driven by a combination of self-regarding, social and procedural preferences. Hence, addressing pressing environmental challenges involving externalities and social dilemmas not only entails getting the policy design right to synergistically coordinate and orchestrate these different types of preferences. It also requires careful design, analysis and implementation of the activities and methods that structure and facilitate stakeholder interactions throughout the policy process.

Behavioral Economics of Agri-Environmental Policies

Modern agriculture is causing a wide range of environmental problems. By regulating the agricultural sector, human societies try to find a balance between enabling the production of food and public goods and preventing negative consequences for the environment. In the European Union this is mainly achieved through the Common Agricultural Policy (CAP). Since many of the environmental indicators are still showing negative trends, an ongoing evaluation and adaptation of the policy instruments included in the CAP is asked for. At the same time, the field of policy evaluation is more and more incorporating a behavioral economic perspective on human behavior, one that deviates from the homo oeconomicus model that has long dominated research in this area. This thesis presents a study on “Behavioral Economics of Agri-Environmental Policies” by combining themes from agricultural and environmental economics with methods and perspectives from behavioral and experimental economics. It thereby contributes to the emerging field of behavioral agricultural economics. Specifically, it aims to shed light on the behavioral drivers of pro-environmental decisions of farmers and how these insights can be used to evaluate and adapt the CAP. With a lab-in-the-field experiment with farmers from Lower Saxony in Germany, an influence of the framing of the farmers’ societal role, their self-identity, as well as control aversion and feelings of warm glow on farmers’ behavior was uncovered. From a policy perspective, the results of this thesis provide a case for the continued use of both mandatory and voluntary policy instruments. Furthermore, with a Principal Components and Cluster Analysis, a multi-facetted picture of different farmer self-identities prevalent in the sample population was revealed. Based on a literature review, the thesis also provides an analysis of how behaviorally-informed interventions might increase the environmental performance of the CAP in the future.
