ela passam os grandes fluxos de capital, de pessoas e de informações do Brasil, em uma
rede complexa de bens e serviços. Face às peculiaridades e à escala dos problemas
enfrentados pela RMSP, coloca-se a questão da governança em uma região metropolitana
tão grande e tão complexa. Em efeito, uma vez que a RMSP não é um ente da federação
e, portanto, não possui um governo único e dedicado exclusivamente para sua gestão,
surge a necessidade de articulação entre os atores governamentais que têm atribuições e
competências sobre seu território.
As questões relacionadas aos modelos e formatos institucionais das regiões
metropolitanas vêm sendo objeto de debate há décadas, tanto no mundo acadêmico quanto
entre os profissionais e gestores que lidam diariamente com os desafios impostos pela
gestão destes territórios. Por isso alguns conceitos e ferramentas de análise são
fundamentais para a compreensão do fenômeno metropolitano.
Ao mesmo tempo, a evolução histórico-legal da governança metropolitana no
Brasil e em São Paulo nas últimas décadas mostra uma alternância entre períodos de
maior e menor centralização e contribui para o entendimento do cenário atual. Com a
aprovação do Estatuto da Metrópole (EM), no início de 2015, a imposição legal ao
governo do estado e aos municípios da elaboração conjunta de um Plano de
Desenvolvimento Urbano Integrado (PDUI), com a participação da sociedade civil, abrese
uma nova fase para a governança metropolitana brasileira e da RMSP. Este processo
ainda em curso explicita alguns conflitos e abre novas possibilidades de articulação entre
os entes federativos envolvidos. / The Metropolitan Region of São Paulo (MRSP) is the main centre of national
wealth in Brazil. Great flows of capital, people and information, pass through it in a
complex network of goods and services. In view of the singularities and scale of the
problems faced by the MRSP, the question of governance in such a large and complex
metropolitan region is raised. In fact, as the MRSP is not an entity of the federation and
therefore does not have a government structure exclusively dedicated to its management,
there is a need of articulation among the governmental actors that have attributions and
responsibilities over the same territory.
Issues related to the institutional models and formats of the metropolitan regions
have been the subject of debate for decades, both in the academic world and among
professionals and managers who deal daily with the challenges imposed by the
management of these territories. For this reason, some concepts and tools of analysis are
fundamental for the understanding of the metropolitan phenomenon.
At the same time, the historical-legal evolution of metropolitan governance in
Brazil and São Paulo in the last decades shows an alternation between periods of greater
and lesser centralization and contributes to better understand the current scenario. A new
phase of metropolitan governance has been opened up for Brazil and the MRSP with the
approval of the Metropolis Statute, in early 2015, and the legal obligation of the joint
elaboration of an Integrated Urban Development Plan, with the participation of civil
society. This process, which is still underway, has made explicit some conflicts and has
created new possibilities for articulation for the federative entities involved.

UTREDNING KRING TOLKNINGEN AV ”LITEN AVVIKELSE” / INVESTIGATION ON THE INTERPRETATION OF ”SMALL DEVIATION”Arveståhl, Beatrice, Lehtinen, Susan January 2017 (has links)
Purpose: In Sweden, a municipal plan monopoly is used to regulate what, how and where you can or cannot build. How the plans, in the shape of comprehensive and detailed development plans, are formed is in turn regulated by the Planning and Building Act (PBL). Throughout history, Swedish building regulations have gone through many more or less extensive changes with the overall goal to improve our built environment and simplify or streamline the planning and building processes. From this comes the term small deviation, which in PBL is used to allow building permits that deviate from the detailed development plan, provided that the deviation is small. There is, however, no explanation in the law as to what this might mean in practice, and so there are large differences in terms of interpretation and application. The goal of this study is to analyse how the term small deviation according to PBL, chapter 9 § 31b is interpreted and applicated in building permit trials. Method: The methods used in this study are interviews (with building permit officers) and document analysis (of building permit decisions from quarter two, 2016, and court cases from the Land and Environment Court of Appeal). Findings: How deviations are interpreted does indeed vastly differ, and while the municipalities do work in a similar manner to determine whether a deviation could be considered small, there are significant differences. Only in the matter of built area on a property, the three studied municipalities all have different practices in what size of violation may be considered small, and the building permit officers in one of these municipalities still deviate from this. In eight out of 13 court cases, the Land and Environment Court of Appeal judged differently from the previous authorities. Only in one did all authorities agree. Implications: The findings implicate the following: There are remarkable differences in how small deviation is assessed. De biggest differences are between the local building permit officers and the Land and Environment Court of Appeal. The factors that affect the assessment on a municipal level the most are experience, precedent cases and discussion with colleagues. Limitations: A wider study containing more information from several municipalities and an analysis of the material accessible to the municipalities for guidance to assess deviations would provide a clearer answer as to what affects the interpretation. Planerna i form av översikts- och detaljplaner reglerar vad, hur och var man får eller inte får bygga. Genom åren har PBL många gånger genomgått mer eller mindre omfattande förändringar med det övergripande syftet att förbättra svensk byggd miljö och förenkla eller effektivisera plan- och byggprocessen, därför har begreppet liten avvikelse tillkommit i PBL. I författningen framgår att det trots avvikelser från planbestämmelser är möjligt att bevilja bygglov, förutsatt att avvikelsen är liten. Det saknas dock förklaringar i PBL kring vad detta kan innebära, och stora skillnader i bedömningen kring vad som kan anses vara en liten avvikelse finns. Målet med arbetet är att analysera hur begreppet liten avvikelse enligt PBL, kap 9 § 31b tolkas och appliceras vid bygglovshandläggning. Metod: De metoder som använts i undersökningen är intervjuer (med bygglovshandläggare) och dokumentanalys (av bygglovsbeslut kvartal två, 2016, och rättsfall i Mark- och miljööverdomstolen från 2016). Resultat: Resultatet visar att det finns stora skillnader i hur liten avvikelse tolkas och appliceras, både mellan olika instanser och på kommunal nivå. Medan kommunerna använder dylika metoder för att avgöra om en avvikelse kan anses vara liten, finns det även avsevärda skillnader i bedömningen. Bara när det gäller byggrätt har kommunerna i undersökningen riktvärden det är stor skillnad på. I åtta av 13 fall bedömde Mark- och miljööverdomstolen olika från samtliga tidigare instanser, och bara i ett fall var samtliga överens om graden av avvikelse. Konsekvenser: De slutsatser som kan dras från resultatet är att: Det finns anmärkningsvärda skillnader i hur liten avvikelse bedöms. De största skillnaderna är mellan den lokala nämnden och Mark- och miljööverdomstolen. Det som främst påverkar bedömningen på kommunal nivå är erfarenhet, prejudicerande rättsfall och diskussion med kollegor. Begränsningar: En bredare undersökning med fler kommuner och bygglovsbeslut från en längre tidsperiod i kombination med en analys av det material som finns för att hjälpa bygglovshandläggare bedöma avvikelser hade kunnat ge ett tydligare svar på vad som påverkar tolkningen. Det hade också gett ett tydligare svar på hur skillnaderna huvudsakligen ser ut, vilket i sin tur gjort det möjligt att ta fram förslag till lösningar. After the democratic election of 1994, a new and integrated education system was developed in South Africa in accordance with international trends and the stipulations of the South African Bill of Rights with regard to equality, human dignity, basic education and equal access to education. According to the inclusive education system, learners with learning and developmental barriers should be accommodated within the mainstream of education. In order for inclusive education to succeed, a network of support was developed on departmental, provincial, district and school level. At school level, the school-based support team is directly responsible for supporting learners with learning and developmental barriers, educators and parents/caregivers. The effectiveness of these school-based support teams will, eventually, determine the quality of this inclusive education approach. The question which guided this research, is: How effectively does the school-based support team fullfil its function in the teaching and learning of learners with learning and developmental barriers within the framework of inclusive education? A qualitative research design was chosen which is exploratory, descriptive and explanatory. After an initial literature study in which international and national trends in this field were investigated, five primary mainstream schools were selected in the Western Cape according to certain criteria. A pilot study was conducted in another school to refine data collection strategies. Information was then gathered in the five schools by means of structured questionnaires, individual and focus group interviews, field notes and the study of appropriate documents. In order to evaluate these teams, eleven criteria were designed to serve collectively as an evaluation instrument. The effectiveness of the school-based support teams in the five schools were subsequently assessed and placed in various categories according to a conceptual framework. It was found that the school-based support teams function relatively effectively in most areas. The composition of the teams is effective. The perceptions of principals and school board members regarding their working relationship in the Zambezi Region of NamibiaChombo, Stanley Chombo 28 October 2020 (has links)
The purpose of this study was to explore the perceptions of principals and school board members (SBMs) regarding their working relationship in the Zambezi region of Namibia. Not much research about this area has been conducted in the Zambezi region and Namibia at large. The reviewed literature posits that principals play a major role in creating effective working relationships with SBMs. It also argues that positive working relationships between principals and SBMs are at the heart of making a school extraordinary. This working relationship can be fruitful if there is a closer understanding of the roles and responsibilities between the principals and SBMs. Three leadership theories that seemed to suit the study were analyzed and discussed. The transformational leadership, partnership and Dewey’s theory of democracy in education were relevant to this study. The three leadership theories guided the study in exploring the perceptions of principals and SBMs regarding their working relationships in the Zambezi region. They also guided the study to clarify the challenges that contributed to the lack of trusting working relationships between principals and SBMs in the Zambezi region in Namibia. The study is located in the interpretive paradigm, where a qualitative case study approach to the research problem was employed. For the purpose of the study, the researcher selected six schools, two primary schools, two combined and two senior secondary schools, as sites to explore the research problem. It is important to mention that the findings of the study cannot be generalized to all school boards in Namibia, since the research was limited to six schools in the Zambezi region only. The researcher summarized the findings of the study according to the four research questions.
The findings derived from this study revealed that the majority of principals and SBMs perceived their working relationship as collegial. However, the study also revealed that some SBMs did not have a good working relationship with the principals. SBMs were not aware of how the finances of the school were utilized. Furthermore, they accused principals of not being transparent when it came to staff appointments.
The findings from this study also revealed that, when there was a good working relationship between principals and SBMs at the school, it became easier to maintain discipline among learners and that learners performed better. There needs to be good communication between principals and SBMs, as principals and SBMs are important partners when it comes to the smooth running of a school. There were consultations between principals and SBMs on matters regarding school development. It was, furthermore, learnt that, where there were consultations between principals and SBMs, unity and trust were developed. The Ministry of Education, Arts and Culture (2001:15; 2016:2) in Namibia clearly points out that “For every state school, a school board must be established to administer the school affairs and promote the development of the school and learners of the school” and to “ensure the school is effective in its teaching and learning programme”. However, the study revealed that principals and SBMs were not working in accordance with the Education Act, Act 16 of 2001. SBMs lost interest in participating in school activities. It became evident that SBMs did not seem to be attending school board meetings when invited and rendered many excuses. It emerged from the findings that parent SBMs wanted to be given sitting allowances when attending school board meetings. The findings from the study indicate that there should be good communication between principals and SBMs. Regular school board meetings could help build a good working relationship between principals and SBMs. School board training should be organized for principals and SBMs.
To mitigate the challenges faced by principals and SBMs regarding their working relationship in the Zambezi region of Namibia, recommendations associated with understanding of and adherence to policies, working together, communication, trust and fear among SBMs, are that all schools should have scheduled school board meetings that are communicated very early to everyone concerned and SBMs should be given sitting allowances. The researcher recommends that principals and SBMs receive compulsory and appropriate training that will help them to understand and perform their roles and responsibilities well. Where necessary, school board trainers should use a vernacular language (or seek the services of an interpreter) so that parent SBMs who are not fluently bilingual can understand and grasp all essential concepts of the training programme. In addition, the researcher recommends that community members, who are educated and knowledgeable but do not have children at the school, should be co-opted to serve on the school board. There should be clear policies and processes regarding the recruitment of staff who works at the school. The researcher posits that effective communication can be enhanced by employing vernacular languages in meetings to ensure that parent SBMs understand all the proceedings and are involved. It is advisable for the principal and other SBMs to communicate effectively, keep to what they say and always follow through with tangible actions. To reduce fear demonstrated by Learners’ Representative Council (LRCs) serving on the school board during meetings, it is advisable to give appropriate training so that they can gain a better understanding of their roles and responsibilities. In order for principals to work in harmony with SBMs, it is essential to have well-defined roles, as well as to treat everyone fairly and respectfully. / Educational Management and Leadership / D. impact it has had on the provision of human settlements in Gauteng. Th is dissertation has used
qualitative research methodology. This nuanced approach has enabled an e laborate exploration and
understanding of the NDP as a policy strategy and provided the tools to measure its impact on the
provision of human settlements in Gauteng. For this research, the participants were selected
purposively based on their expertise in the field of human settlements. The researcher conducted in
depth interviews with 15 senior policymakers in the Gauteng Department of Human Settlements
and South Africa’s National Department of Human Settlements and collect ed data on human
settlements, wh ich fed, into the findings and recommendations of the dissertation This study has
argued that housing policies in South Africa have evolved since 1994, moving away from redress
and distribution to an approach of creating sustainable integrated human settl ements. It has also
assessed how the Gauteng Department of Human Settlements set out to generate inclusive and
integrated settlements through the creation of “new towns”. The building of these “new towns” is in
line with the provincial government’s mandate of delivering integrated human settlements in the
province. South Africa’s Department of Human Settlements and the Gauteng provincial government
introduced the Megaprojects in 2014 as a R100billion economic corridor investment, which aims to
provide 800 0 00 housing opportunities across five corridors in Gauteng.
Despite these initiatives, the provincial Department continues to face several constraints such as
population growth, migration, unavailability of land, housing backlogs, a high rate of informal
settlements, corruption, poor implementation of policies, and a lack of economic growth and
budgetary constraints. The dissertation’s findings suggest that t hese challenges need to be tackled at
the policy level the Department of Human Settlements must pr ioritise implementation, good
governance and promote greater professionalism within the housing sector in order to achieve these
targets . The study further found that p olicymakers must also view housing as a specialised field that
requires extensive consul tation and implementation plans that are carefully tailored to address any
challenge s that the Department of Human Settlements could potentially encounter during the

Fritidshusets framtid : Fritidshusets karaktär och utformning / The future of vacation house : The nature and form of vacation housOttosson, Patrik, Seyedi, Adrian January 2020 (has links)
Purpose: Vacation house,a part of Sweden ́s history that decreases annually, mainly because existing vacation houses are being extended and permanented and few new ones are being built. One reason why many vacation houses are permanented is that the detailed development plan for the area is insufficient or missing to maintain the area as a vacation house area. In addition to the detailed development plan there is other legislation that is followed at building permits. For vacations houses there is no regulation in the legislation which causes difficulties for building permit management for individuals and authorities. The aim of the survey is to gather material with the aim to establish a definition of vacation houses into the legislation. Method: The survey is conducted as a qualitative study with semi-structured interviews with nearby municipalities building permit departments, equal in size as Jönköping's municipality and with smaller municipalities. The material from the semi-structured interviews was compared and strengthened with document analysis from previous research. The document analysis has reviewed previous researches, studies, judiciary, books and detailed development plans. Findings: The result shows that a definition of vacation houses should be legislated in Plan- och bygglagen and can be applied by Boverket’s building regulations with a clearer explanation of vacation houses. To give municipalities common ground to emanate from to preserve the nature of vacations house areas. How the vacations house areas should be designed and how their design can be preserved is most suitable in the detail development plan. It is in the detail development plan the area of a vacation home can be limited. If the area of the vacation homes is limited, the survey show that it will result in that fewer vacation homes are permanentized as the conveniences which permanent homes require will not fit. Implications: The results of the survey can be used to give municipalities an understanding of how building permits of vacation houses ́ are currently handled by other municipalities. The study contributes with improvement proposals for detailed development plan in the municipality of Jönköping. The conclusion of the result is that a more comprehensive study should be conducted to include municipalities throughout Sweden to ultimately lead to a joint definition for vacation houses.Limitations: The result is based on interviews with six municipalities and document analysis. A more comprehensive survey can interview more municipalities throughout Sweden to obtain a more generalized result, as well as to include authorities such as county administrative boards and Boverket. In a more comprehensive survey, more methods can be used as observations for better understanding of building permit handling of vacation homes and surveys to be able to reach out to all municipalities in Sweden. / Syfte: Fritidshusen, en del av Sveriges historia som minskar årligen, främst på grund av att befintliga fritidshus byggs till och permanentas samt att det byggs få nya. En anledning till att många fritidshus permanentas är att detaljplanen för ett område är otillräcklig eller saknas för att behålla området som ett fritidshusområde. Förutom detaljplan är det övrig lagstiftning som följs vid bygglov. För fritidshus saknas en definition i lagstiftningen vilket medför svårigheter för bygglovhantering för privatpersoner och myndigheter. Syftet med studien är att ta fram material som kan utnyttjas för att införa en definition av fritidshus i lagstiftning. Metod: Undersökningen genomförs som en kvalitativ studie med semi-strukturerade intervjuer med närliggande kommuners bygglovsavdelningar, både i jämnstorlek med Jönköpings kommun och med mindre kommuner. Materialet från de semi-strukturerade intervjuerna bearbetades sedan genom att jämföras och stärkas med litteraturstudie från tidigare forskning. Litteraturstudien har granskat tidigare undersökningar, studier, domar, böcker och detaljplaner. Resultat: Resultatet visar att en definition utav fritidshus bör lagstiftas i plan- och bygglagen och kan tillämpas av Boverket med en tydligare förklaring till fritidshus. Detta för att ge kommuner en grund att utgå ifrån för att bevara fritidshusområdens karaktär. Hur fritidshusområden ska utformas och hur dess karaktär kan behållas görs lämpligast i detaljplaner. Det är även i detaljplanen ytan kan begränsas för ett fritidshus. Begränsas ytan för ett fritidshus visar undersökningen att färre fritidshus kommer permanentas då de bekvämligheter en permanentbostad bör ha inte kommer att rymmas. Konsekvenser: Undersökningens resultat kan användas för att ge kommuner förståelse för hur bygglov av fritidshus hanteras i dagsläget av andra kommuner. Studien bidrar med förbättringsförslag för detaljplaner i Jönköpings kommun. Slutsatsen av resultatet är att en mer omfattande studie bör genomföras för att inkludera kommuner inom hela Sverige för att i slutändan utmynna till en gemensam definition för fritidshus. Begränsningar: Resultatet är baserat på intervjuer med sex kommuner och litteraturstudier. En mer omfattande undersökning kan intervjua fler kommuner över hela Sverige för att få ett mer generaliserbart resultat, samt att inkludera myndigheter som länsstyrelser och Boverket. I en mer omfattande undersökning kan fler metoder tillämpas som observationer för bättre förståelse av bygglovshantering av fritidshus och enkäter för att nå ut till alla kommuner i Sverige.

Intresseavvägningar för planprojekt - inom Stockholms innerstad / Balancing of interests for planning projects - within Stockholm's inner cityWennström, Joel January 2020 (has links)
I denna uppsats studeras hur avvägningarna mellan allmänna och enskilda intressen hanteras avde dömande organen och hur de olika sakägarna resonerar utifrån de olika intressena. Arbetet har genomförts som en fallstudie där fyra olika byggprojekt studerats. Gemensamt för alla är att de ligger i Stockholms innerstad och har mött motstånd i form av överklaganden. Det finns lite olika definitioner för vad allmänintresset är, somliga menar att allmänintresset är ensammanslagning av flera enskilda intressen medan andra definierar att det bestäms av folkets valda representanter. Det ideologiska tillvägagångsättet som diskuteras är utilitarism, enhetligt, rättighetsbaserad ochdialogbaserad. För att tolka domstolarna domslut används fjäder- och balansvågsmodellen där fjädervågsmodellen symboliserar gränsen för vad man som sakägare är skyldig att tåla. Balansvågsmodellen symboliserar det beslut som tas baserat på de sammanvägda för- och nackdelarna. Det första fallet är kvarteret Plankan 24 där Svenska Bostäder vill bygga nya bostäder i den oexploaterade innergården, planen har mötts av kritik från de boende som menar att luftkvaliteten, bullernivåerna, ljusinsläpp, rekreationsytor, barnens miljö och kulturmiljön avsevärt kommer att försämras. Mark och miljööverdomstolen anser att de skäl som de klagande åberopat inte är tillräckliga för att planen inte ska genomföras. Fall nummer två handlar om Orgelpipan 6, en hotellbyggnadskomplex och en av citybanans uppgångar mittemot centralstationen. De klagande menar bland annat att ett nytt hotell kommer att skapa obalans på en redan obalanserad marknad, att ljusförutsättningarna kommer att försämras och att byggnaden kommer att för skada Stockholm. Länsstyrelsen anser inte att deklagomål som kommit in är tillräckliga för att planen inte ska vinna laga kraft. Det tredje fallet handlar om Mårtensdal 6, ett kontorskomplex som ska bli 125 meter högt. De klagande är befintliga hyresgäster som anser att deras verksamhet inte ska behöva flytta och Fortum Värme AB som anser att höjden på byggnaden riskerar att inskränka deras verksamhet pga. att den är högre än deras egen skorsten. Mark- och miljööverdomstolen beslutar att Fortums överklagande bör accepteras och upphäver därför planen pga. av allmänintresset. Något entydigt samband i domstolarnasbedömningar har dock inte kunnat konstaterats, det kan bero på att varje fall är unikt och har dess egna förutsättningar. Kommunen och övriga sakägare resonerar på olika sätt när det kommer till avvägningar mellan allmänna och enskilda intressen. Generellt gör kommunen avvägningar genom ett utilitaristiskt och enhetligt tillvägagångsätt medan sakägarna använder olika tillvägagångssätt beroende påom de representerar ett företag, en förening eller är en privatperson. / This paper examines how the balances between public and private interests are handled by the appeals court and how the different stakeholder’s reason based on the different interests. The work has been carried out as a case study in which four different construction projects were studied. Common to all is that they are in Stockholm's inner city and have met with resistance in the form of appeals. There are slightly different definitions for what the public interest is,some believe that the public interest is a combination of several individual interests, while others define that it is decided by the elected representatives of the people. The ideological approach under discussion is utilitarianism, unitary, rights-based and dialogical. To interpret the court's verdict, the dynanometer and beam scale model is used wherethe dynamometer model symbolizes the boundary of what you as a stakeholder are obliged toendure. The beam scale model symbolizes the decision that is made based on the weighted pros and cons. The first case is Kv. Plankan 24, where Svenska Bostäder wants to build new housing in the undeveloped courtyard, the plan has been met by criticism from the residents who believe that the air quality, noise levels, day light, recreation areas, children's environment and the cultural environment will deteriorate significantly. The Land and environmental court consider that the reasons cited by the complainants are not sufficient for the plan not to be implemented. Case number two is about Kv. Orgelpipan 6, a hotel building complex and one of the new entrances for the new commuter track, Citybanan. The complainants believe, among otherthings, that a new hotel will create imbalance in an already unbalanced market, that the lighting conditions will deteriorate and that the building will harm the character of Stockholm. The County Administrative Board does not consider that the complaints received are sufficient for the plan not to get implemented. The third case is about Mårtensdal 6, an office complex that will be 125 meters high. The complainants are existing tenants who feel that their business should not need to relocate and Fortum Värme AB who believes that the height of the building risks reducing their business because it is higher than their own chimney. The Land and environmental court decide that Fortum's appeal should be accepted because the public interest of Fortums appeal is greater than the office building to be higher than the chimney. The last case is the construction of the Nobel Center at Blasieholmen behind the NationalMuseum. The complainants jointly oppose the plan as it will affect the national interest and the historical culture environment. The Land and Environmental Court cancels the plan because it involves significant damage to the historical cultural environment and the national interest. The ideology that seemed to be the one most applied for the court was a mix between utilitarianism and unitary. The rights-based ideology was not used at all and the dialogue-based is something that is used earlier in the planning process. However, no clear connection in the judgments of the courts has been found, it may be because each case is unique and has its ownconditions. The municipality and the other stakeholders reasoning in different ways when it comes to the delimitation of public and private interests. In general, the municipality balances through autilitarian and uniform approach, while the business owners use different approaches depending on whether they represent a company, an association, or a private person.

Evaluation determines the impact of social services as well as job performance and
assures communities that social workers render effective services. Post audits are done
as part of performance management at the Christian Social Councils in the Highveld
Synodal Region.
The purpose of this research is to look at the experiences of social workers that had a
post audit to determine whether adjustments to improve the audit system are needed.
A qualitative approach with an exploratory, descriptive and contextual research design
was followed. Participants were identified according to the purposive sampling
method. Data was collected during semi-structured interviews. The data was analysed
and verified according to the models of Tesch (in Creswell, 2003) and Guba (in
