" Dwelling at the Margins" is an exegesis of the short film Boundaries. Boundaries is a journey into the world of marginalised young people in inner urban Brisbane seen through the eyes of a the female main character with an eye for gentle beauty. The film forms the first part of the research and in the exegesis the ideas unfold that were behind the making of the film and that emerged further through its production and audience reception. The exegesis discussion centres on the major aspects of the film which are visual representations, female narratives and the themes of home and dwelling. Boundaries is a political film that looks from the edges of society. The exegesis seeks to explain the ideas behind this intention.

Respecto al expediente privado, se discute la materia de desalojo por ocupación precario, si efectivamente a la demandante le corresponde la restitución del inmueble, materia litis. Puesto que existen otros procesos de prescripción adquisitiva de dominio y nulidad de acto jurídico. Por otro lado, en el expediente público se discute si hay o no infracción por idoneidad al Código de defensa y protección al Consumidor, puesto que se incumplió con la entrega del inmueble en el plazo pactado debido a que la demora fue por culpa no imputable a la parte denunciada. / These reports will expose the main procedural pieces from both the private and public files. Regarding the private file, the matter of eviction for precarious occupation is discussed, if indeed the plaintiff is entitled to the restitution of the property, litis matter. Since there are other processes of acquisitive prescription of domain and nullity of legal act. El presente informe es del expediente No 34649-2014-0-1801-JR-CI-32 en materia civil sobre una demanda desalojo por ocupante precario, en el cual se discutirá un título que justifique la posesión para proceder o no con el desalojo. El caso inicia cuando el señor Zenobio Mesa Espinoza demanda a su hermano Víctor Mesa Espinoza, por que este ultimo viene poseyendo de forma indebida el segundo piso al no tener un título para poseer y no pagar renta. No obstante, el demandado alega ser propietario de todo el bien inmueble en virtud a ello presenta diversos medios probatorios (Copias del DNI, Certificado de Acta de matrimonio, Partidas de nacimientos de sus hijos, recibos de luz, arbitrios e impuestos prediales, etc.) e incluso una demanda por prescripción adquisitiva de dominio en virtud a estas pruebas, los presentes documentos no generan convicción en el juez de tener un título que justifique la posesión: asimismo, señala que la demanda por prescripción alegada ha sido rechazada y archivada. En virtud a lo expuesto, la Corte Suprema de Justicia de la República resuelve señalando que si existe un título para poseer por parte del demandado, ya que cuando el demandante indica que “ayudo a su hermano viva con él” se configuro un derecho de uso sobre el inmueble y , por tanto, debe resolverse el contrato de conformidad al artículo 1365 del Código Civil. / This report is from No. 34649-2014-0-1801-JR-CI-32 in civil matters about a complaint of eviction for precarious occupant, in wich will be discuss a title that justifi the posession to proceed or no with the eviction. The case begins when Mr. Zenobio Mesa Espinoza sues his brother Victor Mesa Espinoza, because the latter has been improperly possessing the second flooor by not having a title to own and not paying rent. However, the defendant claima to be the owner of all the real estate by that, the presents various means of proof (Copies of DNI, Certificate of marriege, birth certificates of his children, electricity bills, taxes and property taxes,etc.) and even a claim for acquisitive prescription of ownership as consequence of these evidence, but these documents don´t generate conviction in the judge of having a title that justifies possession: also indicates that the complaint for alleged the prescription has been rejected and filed. Therefore, the Supreme Court of Justice of the Republic decides that if there is a title to possess by the defendant, since when the plaintiff indicates that “ I helped my brother to live with me” a right of use is set up on the property and, as consequence, the contract must be resolved in accordance with article 1365 of the Civil Code. / Trabajo de suficiencia profesional

The constitutional rebuilding of the South African private law : a choice between judicial and legislative law-making

A tension arises whenever the South African private law fails to meet constitutional right norms. To remedy a deficiency, two law-making options are available. The first is for the judiciary to develop or change private law principles and rules in order to provide protection for the implicated constitutional norm. The second is for the judiciary to enforce an obligation upon Parliament to enact legislation to amend or replace existing private law rights and obligations so as to safeguard the norm against interference from a private individual or entity. The former is the more conventional option, but, in recent years, the law reports record an increasing reliance on the legislative duty to protect constitutional right norms in private legal relationships. The thesis investigates the extent to which the latter phenomenon - which will be described as a 'pivot towards legislative remedies' - exists, and the circumstances in which the courts pivot towards legislative remedies rather than developing private law of their own accord. The thesis finds that legislative schemes that give effect to constitutional rights are likely to contain an array of benefits that are absent from or reduced in the judicial law-making process. The judicial pivot towards legislative remedies is thus a strategy to enhance the process through which conflicting rights are resolved, as it allows for the constitutional rebuilding of private law in a way that the judiciary is unable to do on its own. Importantly, however, theories of judicial deference do not explain the pivot. On the contrary, the courts have exercised a strict level of control over the legislative law-making pathway. Through either statutory interpretation or the review of legislation, the courts require legislation to contain the essentials of the judicial law-making framework. From this perspective, the judicial law-making process produces the floor of the rebuilding project and the legislative law-making process enhances that framework.

Au croisement de la sociologie des classes populaires et de la sociologie urbaine et du logement, cette thèse porte sur l’une des formes de logements non ordinaires qui a connu un développement massif en France dans les territoires ruraux et périurbains au cours de ces dernières années : le camping résidentiel. Combinant immersion ethnographique dans plusieurs campings de la région parisienne, entretiens, archives et statistiques, elle montre l’existence d’une véritable stratification interne à cet habitat, eu égard à l’hétérogénéité des situations résidentielles, des trajectoires, des ressources, des expériences et des styles de vie des habitants. Le camping résidentiel est de fait apparu comme remplissant trois grandes fonctions sociales segmentant la population qui le pratique : il peut représenter une alternative à la maison individuelle inaccessible, figurer un déclassement subjectif et objectif ou encore s’apparenter à une solution qui pallie la pénurie de logement abordable et évite le dénuement extrême de la rue. Inscrite dans une approche à la fois contextualiste et dispositionnaliste des manières d’habiter, la thèse rapporte ces trois fonctions du camping – qui constituent également trois styles de vie distincts – aux caractéristiques particulières de cette forme d’habitat non ordinaire mais aussi à des ressources, des trajectoires et des socialisations résidentielles différentes articulées à des dispositions populaires relativement homogènes. Elle identifie enfin les causes, les dynamiques et les conséquences des pratiques de délogement en documentant « de l’intérieur » un cas de fermeture de terrain de camping, exemple de concrétisation du risque associé au statut juridique de cet habitat. / This thesis finds itself at the intersection of the sociology of the working classes and urban sociology, with a special interest in housing. It focuses on one of the forms of non-ordinary housing that has seen massive development in France in recent years: residential camping. Combining an ethnographic immersion in several campsites in the Paris region, interviews, archives and statistics, it shows the existence of a real internal stratification within this habitat, taking into account the heterogeneity of residential situations, trajectories, resources, experiences and lifestyles of the inhabitants. Residential camping has in fact emerged as fulfilling three major social functions which segment the population that practices it: it may represent an alternative to the inaccessible single-family home, or stand as a subjective and objective downgrading or even be a solution that makes up for the shortage of affordable housing, thus preventing the extreme destitution of living in the streets. Illustrating a dispositionalist-contextualist approach to ways of living, the thesis connects these three functions of camping - which also constitute three distinct lifestyles - with the particular characteristics of this unusual form of housing. It also links it to different resources, trajectories and forms of residential socialisation corresponding to relatively homogeneous popular dispositions. Finally, it identifies the causes, dynamics and consequences of eviction practices by documenting "from the inside" the case of a campground closure, an example of the risk involved in the legal status of this habitat.

This happened in a litigation started in 2004, when the company's bankrupt estate Selecta Industry and Trade S.A. proposed the repossession against the residents of Pinheirinho occupation in São José dos Campos, São Paulo. Given these facts, the main goal of this study is to focus attention on the justice system before the conflict processing. We wanted to understand how the actors of this system influence the urban space and how was the legal mobilization of Pinheirinho actors around the judicial process. How the legal instruments were articulated to resist the repressive state? Through the dogmatic reconstruction of the land conflict, through judicial proceedings instituted from the Pinheirinho foundation in 2004, we observe how the space of the judicial process is configured in a dispute arena of social movements around the meanings of rights and the roles of the Rule of Law. / Em 22 de janeiro de 2012, oito mil pessoas foram removidas forçadamente de suas casas em consequência do cumprimento de uma decisão liminar de reintegração de posse. Essa decisão foi tomada nos autos de um processo judicial iniciado em 2004, em que a Massa Falida da empresa Selecta Indústria e Comércio S.A. propôs uma ação de reintegração de posse contra os moradores da ocupação Pinheirinho, em São José dos Campos, São Paulo. Diante desses fatos, o objetivo do trabalho consiste em focar a atenção no sistema de justiça diante do processamento do conflito. Com isso, queremos compreender como os atores desse sistema influenciam na produção do espaço urbano e como se deu a mobilização jurídica dos atores do Pinheirinho em torno do processo judicial. De que maneira os instrumentos jurídicos foram articulados para resistir ao aparelho repressivo do Estado? Para isso, através da reconstrução dogmática do conflito fundiário, por meio dos procedimentos judiciais instaurados a partir da fundação do Pinheirinho em 2004, observamos como o espaço do processo judicial se configura em arena de disputa do movimento social em torno dos significados do direitos e dos papeis do Estado Democrático de Direito.

Cette thèse de doctorat repose essentiellement sur notre analyse critique des études et des projets menés par différents consultants (syriens, européens, internationaux) et sur nos enquêtes de terrain à Damas, capitale de la Syrie. En 2004, près de 40 % de la population de l’agglomération de Damas vivaient dans des zones non-réglementaires. Celles-ci représentent donc une composante essentielle de l’expansion urbaine. Premièrement, la thèse analyse le phénomène de l’habitat non-réglementaire à Damas. Elle explique le marché foncier et les caractéristiques des lotissements clandestins dans trois études de cas, deux quartiers: Assad Al Din et Daf Al Chok et un village : Al Bahdalya. Elle montre également comment le maître d’œuvre effectue les étapes de sa construction. Deuxièmement, la thèse traite de la politique urbaine. Elle présente les consultants : MAM, Cities Alliance, Al Diwan, qui ont mené des études et des projets pour les zones étudiées. Elle examine ici leurs études et projets dans une analyse critique approfondie. Troisièmement, la thèse traite de la politique urbaine à l’épreuve des usagers. Elle étudie les caractéristiques socioéconomiques des habitants interviewés des zones étudiées, leur mobilité résidentielle et leurs attitudes à l’égard des projets et des études proposés. Certains des chefs de ménage interviewés pensent qu’ils seront logés, mais beaucoup pensent qu’ils seront expulsés. C'est pourquoi la thèse traite finalement la question du relogement en s’appuyant sur notre enquête de terrain dans une banlieue de relogement Al Hussainyah. / This dissertation is mainly based on our critical analysis of studies and projects by different consultants (Syrian, European, international) and on our fieldwork in Damascus, capital of Syria. In 2004, nearly 40 % of the population in the urban district of Damascus lived in informal settlements. Therefore, these settlements represent an essential component of urban expansion. Firstly, the dissertation analyzes the phenomenon of informal habitat in Damascus. It explains the land market and the characteristics of illegal settlements in three case studies, two neighborhoods: Assad Al Din and Daf Al Chok and a village: Al Bahdalya. It also shows how the builder performs the different phases of construction. Secondly, the thesis deals with urban policy. It presents the consultants: MAM, Cities Alliance, Al Diwan, who have undertaken studies and projects for the areas mentioned above. Here, the dissertation examines their studies and projects to provide critical, in depth analysis. Thirdly, the dissertation deals with the urban policy as perceived by the citizens. It studies socioeconomic characteristics of the interviewed inhabitants in the areas studied here, residential mobility and their attitudes towards projects and studies proposed to them. Some of interviewed household’s heads think they will be given a house, but many think they will be evicted. That is why the dissertation finally addresses the issue of relocation which is based on our fieldwork in the re-housing suburb of Al Hussainyah.

L'occupation immobilière : étude de droit privé / Estate occupancy : a private law study

En droit privé, l’occupation s’entend, en principe, d’un mode d’acquisition originaire de la propriété des choses mobilières dépourvues de maître : c’est ainsi qu’elle a fait une entrée discrète dans le Code civil en 1804. Toutefois, depuis cette date, l’occupation a acquis une toute autre signification. Le législateur et le juge recourent aujourd’hui à cette notion pour désigner différents modes de jouissance de l’immeuble d’autrui. Il est question de conventions d’occupation précaire, d’occupation privative d’un bien indivis, d’occupant maintenu dans les lieux en suite d’un bail commercial ou d’habitation, d’occupant bénéficiaire d’une réquisition de logement, ou encore d’occupant sans droit ni titre. La notion d’occupation immobilière semble donc avoir acquis une place remarquable en droit privé. L’objet de cette étude est précisément de déterminer le rôle qu’elle tient en droit positif, dans ce domaine. Dans un premier temps, cette thèse réalise l’étude des diverses hypothèses dans lesquelles le terme « occupation » est utilisé pour désigner un fait d’emprise exercé sur l’immeuble d’autrui, que ce soit avec ou sans titre ; elle révèle également des situations officieuses d’occupation, telles que le mécanisme de la reconduction tacite applicable en matière de bail. Dans un second temps, est proposée une théorie générale de l’occupation immobilière en droit privé. L’occupation immobilière apparaît comme un fait d’emprise jouant un double rôle en droit positif : elle peut être simplement la traduction matérielle de l’exercice d’un droit d’usage préalablement reconnu à celui qui va devenir occupant, mais également l’élément permettant à ce dernier d’acquérir un tel droit ou, au moins, de le faire présumer. Reposant notamment sur diverses conditions d’efficacité, telles que la bonne foi ou l’univocité, elle présente alors un certain nombre de similitudes avec la possession, mais les deux notions ne sauraient pourtant être confondues. Au final, cette étude permet de mettre en lumière un nouveau fait créateur de droit, qui trouve sa place aux côtés de la possession et qui démontre une évolution de la propriété privée vers une « propriété pragmatique », soucieuse de s’adapter à des besoins divers, clairement reconnus par le droit positif. / In Private Law, occupancy (French “occupation”) is, in principle, understood as an original method of acquiring property of ownerless movable things: this is how it made a discreet entrance in the Civil Code in 1804. Since then, however, occupancy has acquired a whole new meaning. Today, both the legislator and the judge turn to this concept to describe different means of enjoying the property of others. It relates to precarious occupancy agreements, private occupancy of jointly owned property, tenant kept in the premises after the end of its commercial or residential lease, occupant beneficing an housing requisition, disseisor, or occupant without right or title. The notion of estate occupancy seems to have acquired a prominent position in Private Law. Hence, the purpose of this study is precisely to determine the role it holds in positive law in this area. First, this work aims at studying the various situations in which the term "occupancy” is used to designate the situation where a factual stranglehold is exercised over others’ property, whether with or without title. It also reveals informal occupancy situations, such as leases’ tacit renewal mechanism. Secondly, a general theory of occupancy in Private Law is proposed. Estate occupancy appears like a factual situation of stranglehold (“fait d’emprise”). It plays a dual role in positive law: it may simply be the substantive translation of the exercise of a right to use, previously recognized to whom will become the occupant, and, in the same time, the element allowing him to acquire such a right, or at least, assuming he does. Notably based on various effectiveness conditions, such as good faith or clarity, occupancy shows similarities with the notion of adverse possession, although in French law the two concepts should not be confused. Finally, this study shed light on a new fact giving rise to a right, which finds its place alongside the adverse possession and demonstrates an evolution from the private property to a "pragmatic property" caring to adapt to the various needs recognized by the Law.
