This theses Brand product as a symbol of young participants is focused on the phenomenon of brands, which is interpreted through its relation to social status. In the theoretical part of the theses there are two contradictory views discussed (T. Veblen's and G. Lipovetsky's), which provide two different points of view concerning contemporary society and the relation between luxurious goods and social status. Through this discussion the thesis provides the characteritics of youth in the context of its developement during the 20th century. Another discussed topic are marketing techniques focusing on today's young generation. In the research part the author aims to find a connection between luxurious brands consumption and the concept of status among young adults studying Czech high schools. Results did not prove this connection to be very strong, and it seems therefore that Lipovetsky's point of view was the one closer to our analysis.

La construction de la conjugalité chez des conjoints de couples formés sur des sites de rencontre en ligne : une perspective interactionniste symbolique

Le couple est le commencement de la famille, la cellule fondamentale de la société et un des principaux lieux de solidarité pour les individus. Or, depuis quelques années l’irruption d’internet a permis l’instauration de rapports sociaux nouveaux que l’on peut identifier dans les façons de rencontrer quelqu’un ou de tomber amoureux. L’apparition des sites de rencontre a notamment permis à des individus de pouvoir faire la rencontre amoureuse de l’autre sur un site dédié et à convenance. Cette étude vise à une meilleure compréhension du phénomène social qu’est la construction de la conjugalité à partir de la rencontre sur des sites dédiés sur internet et partant des représentations des participants interrogés. Notre but était également de démontrer comme l’a souligné Marie-Chantal Doucet (2009) que l’action de l’individu sur les sites de rencontre en ligne n’est pas le fait de déterminations mais qu’il bénéficie plutôt d’une marge de jeu, lui permettant d’interpréter les codes et de donner un sens à ses actions et aux actions des autres car l’individu sur les sites de rencontre en ligne joue un personnage. Pour mener à bien cette étude, nous avons adopté un cadre théorique qui s’inscrit dans la perspective de l’interactionnisme symbolique en nous appuyant sur une approche par théorisation ancrée. Il ressort entre autre de l’enquête qualitative que nous avons menée que la construction conjugale est surtout le fruit de la rencontre en face à face car la rencontre en ligne proprement dite est marquée par le stigma et la marchandisation des corps que proposent les sites de rencontre ne sont pas propice au sentiment d’intimité favorable au développement du lien conjugal. / The couple is at the beginning of the family, which is the fundamental cell of the society and one of the main places of people solidarity. Though, from a few years, the inrush of internet has favoured the establishment of new social rules in relationship that we can identify in the new way of encountering somebody or fall into love. The appearance of dating websites has namely favoured to individuals to encounter a partner on a website at the convenience. This study aims to a better understanding of the social phenomenon of the marrital construction from the meeting from a dating website and going from the own perceptions of the participants interviewed. Our purpose was to demonstrate as Marie-Chantal Doucet (2009) that the action of the individual on the dating websites was not due to some determinations but benefited rather of a scope allowing him to perform codes and to make clear senses to his action as to the others actions because the individual is performing a character on the dating website. In order to carry out this study, we have adopted a theoretical framework which is a part of the symbolic interactionism perspective by supporting an grounded theory approach. It emerses from the qualitative method that we have carried out that the marrital construction is, above all, the result of the face to face dating after dating the partner on the dating website because dating on a website is still labelled by a stigma and it is the place of the human body commoditification that the dating website are not conducive to the feeling of closeness which favor the development of a matrimonial bond.

[pt] Por uma ética mais humana - uma reflexão sobre os referenciais éticos da pós-modernidade e a proposta ética da mensagem cristã aborda a sociedade pós-moderna neste tempo de constantes evoluções técnico-científicas, a hipermodernidade. As manifestações humano-sociais assumem uma configuração própria, conseqüência de um intenso processo de personalização. As frequentes inovações nem sempre produzem os frutos esperados. Muitas de suas conquistas são responsáveis por uma flagrante carência de valores e princípios éticos, por um indiferente subjetivismo e por um generalizado sintoma de vazio existencial. Cada vez mais vigoroso, o individualismo irresponsável torna-se uma real ameaça à sobrevivência humana. Essa situação interpela e desafia a todos, revelando a urgência de novos referenciais comportamentais que dinamizem novos relacionamentos e novas atitudes humanas, mais solidárias e mais responsáveis. Segundo Hans Kung, pelo poder de influência que ainda possuem, as grandes religiões são capazes de fomentar e dinamizar novos princípios e valores éticos. Para isso, é necessário buscar um consenso mínimo, sustentado no diálogo e no respeito mútuo. Levando em consideração a análise feita por Gilles Lipovetsky e a proposta ética ecumênica de Hans Kung, esta dissertação se propõe apresentar a mensagem cristã como uma autêntica proposta ética, capaz de dar uma significativa contribuição à humanidade nestes tempos de vulnerabilidade. Acreditamos que a Boa Nova do Evangelho se reveste de uma significativa preocupação com a dignidade humana e com a vida em todas as suas manifestações, oferecendo as bases fundamentais para edificar um mundo mais justo e mais humano. / [en] For a ethics more human - A reflection upon postmodernity ethical references and the ethical proposition of the Christian message presentes the postmodern society at times of constant technical-scientific evolution, the hypermodernity. Being subjected by constant technical-scientific evolution, postmodern society has achieved its summit. According to Gilles Lipovetsky, we have reached hypermodernity, in which the human-social manifestations take on a particular configuration, consequence of an intense process of personalization. This society characterizes itself by frequent innovations which don t always yield the pretended purpose. Many of its achievements are responsible for flagrant shortage of ethical values and principles, indifferent subjectivism and a generalized symptom of existential emptiness. While getting more vigorous, the irresponsible individualism becomes a real threat to human survival. This situation questions e dares everyone, revealing the urgency of new behavioral references that could stimulate new relationships and human attitudes, more solidary and responsible. As stated by Hans Kung, through the power of influence that they still possess, major religions are able to promote and stimulate novel ethical values and principles. Therefore, it is necessary to search for a minimum consensus, based on dialog and mutual respect. Reflecting upon the analysis accomplished by Gilles Lipovetsky and the ecumenical ethical proposition of Hans Kung, the present dissertation means to present the Christian message as an authentic ethical proposition, capable of bestowing a significant contribution to humanity in such vulnerable times. It is believed that Gospel s Good News overlays itself with significant worry towards human dignity and life in all its manifestations, offering the fundamental basis to build a more fair and human world.

It is understood the existence of these periods due to the predominance and repetition of certain behaviors in the social life of the 19 th , 20 th and early 21 st centuries, enabling the authors used to build the bibliography in this work to use such nomenclature. However, it is necessary to keep two aspects in mind: time is continuous and does not admit intersections; and the behaviors in each moment are not tight and the only verifiable ones in that time. Based on this, the study highlights, in each of the three moments, the most frequent attitudes mentioned in several books, as able to bring special characterization as well as a differentiated definition. After that, it verifies the relation between these moments and the formation and development of Rio Grande do Sul Ado Malagoli Museum of Art, electing three dates: the year of its official opening in 1957, pointing out characteristics from Modernity; the year it was moved to the building at Alfândega Square in 1978, highlighting traits of Post-Modernity; and the year of the exposition Art in France 1860-1960: The Realism , in 2009, stressing aspects of Hypermodernity. The crossing of the selected dates, by simple sampling, and characteristics of each of the periods previously mentioned are dealt with in the study, showing how social behaviors towards the museum may reflect characteristics of the chosen moments of culture. In order to develop the theme, the concept of social memory coined by Maurice Halbwachs is used along with an analysis of photographies, news reports, documents, interviews, exposition catalogues and attending sheets, and bibliography review which support the proposed analysis / O trabalho analisa pontos característicos de três momentos da cultura: Modernidade, Pós-Modernidade e Hipermodernidade. Estabelece-se e aceita-se, como ponto inicial, a partir do qual será desenvolvido o presente estudo, o entendimento de que existem os períodos acima nominados, tendo em vista a preponderância e repetição de determinados comportamentos na vida social do séculos XIX, XX e início do século XXI, autorizando, dessa forma, a nomenclatura adotada pelos autores consultados ao longo da elaboração do presente texto. Lembra-se, no entanto, dois pontos: o tempo é contínuo e não admite intersecções, e os comportamentos existentes em cada momento apontado não são estanques e únicos naquele espaço temporal. A partir disso, o estudo irá ressaltar, dentro de cada um dos três momentos, as atitudes mais ocorrentes, citadas pela literatura, como capazes de trazer uma caracterização especial, assim como uma definição diferenciada. A seguir, verificar-se-á a relação desses períodos com a formação e o desenvolvimento do Museu de Arte do Rio Grande do Sul Ado Malagoli, elegendo três datas emblemáticas: o ano da sua inauguração oficial, em 1957, destacando características encontradas na Modernidade; o ano da sua mudança para o prédio da Praça da Alfândega em 1978, ressaltando traços relacionados com a Pós-Modernidade; e o ano da realização da exposição Arte na França 1860-1960: O Realismo , em 2009, salientando pontos que trazem referências à Hipermodernidade. The traditional legalistic approach is currently giv-ing way to a more wide-ranging view, exemplified in Ronald Dworkin s theory of law as integrity through which not only rules, but also principles themselves, should be subjected to a systemic, integrated analysis. Given this, Dworkin s work forms the theoretical platform for the questions raised by this entire study, since the integrated application of principles and rules has become fundamental in the pursuit of the ideal of justice, bringing a new focus on the role of administrative law in an environment of deep and rapid change that typifies hypermodernity. Consid-ering the new concept of the separation of powers, the notion of strict legality, by presupposing a means of controlling the exercise of State power, must be set against other constitutional principles of equal importance, taking into account the particularities of each case in question. In this context, the traditional concept of discretionality is outmoded. Jurisdictive control of these acts is not only possible, but also absolutely essential in a democratic state of law. The synthesis of this new paradigm for administrative law is clear and should be an indissoluble part of administators agenda in contemporary society: citizens are the effective benefici-aries of constitutional rights and guarantees. The technique of balancing principles by assessing their values in the particular case is already part of the jurisprudence of hypermodernity, which is in synchrony with neopositivism and the theory of law as integrity / Esta dissertação demonstra a recente tendência doutrinária e jurisprudencial ob-servada no Direito da hipermodernidade, que indica efetiva diminuição da parcela de discricionariedade nos atos da Administração Pública, a partir da aplicação in-tegrada de princípios e regras. Da tradicional abordagem puramente legalista passa-se atualmente para uma visão mais abrangente na teoria do Direito como Integridade, de RONALD DWORKIN, mediante a qual não só normas, mas também princípios, devem ser analisados de maneira sistêmica, integrada. Dado isso, a obra de DWORKIN é a base teórica de apoio às questões instigadas por todo este estudo, porque a aplicação integrada de princípios e regras se tornou essencial à busca do ideal de justiça, trazendo novo enfoque quanto ao papel do Direito Ad-ministrativo nesta ambiência de profundas e rápidas transformações típicas da hi-permodernidade. Considerada a nova concepção da separação dos poderes, o princípio da legalidade estrita, por encerrar uma fórmula de contenção do exercí-cio do poder estatal, deve ser contraposto a outros princípios constitucionais de igual relevo, observado o caso concreto. A acepção clássica da discricionarieda-de, assim, encontra-se de vez superada. O controle jurisdicional desses atos não é só possível, mas imprescindível num Estado Democrático de Direito. A síntese desse novo paradigma para o Direito Administrativo é clara e deve pautar a agen-da dos administradores na contemporaneidade: os administrados são os efetivos destinatários dos direitos e das garantias constitucionais. A técnica de pondera-ção dos princípios contrapondo valores nos casos considerados já faz parte da realidade da jurisprudência da hipermodernidade, que se encontra sintonizada com o neopositivismo e com a teoria do Direito como Integridade

Partant de la volonté de nous libérer de définitions techniques, technicistes ou produites dans la sociologiede l’appropriation sociale des usages des TIC afin de qualifier les usages de l’Internet par des organisations defemmes ou féministes en Afrique, nous avons privilégié dans cette thèse les travaux théoriques portant sur lepatriarcat et sur la colonialité du pouvoir (ensemble des relations sociales caractérisées par la subalternité –hiérarchisation entre dominants et dominés – produite par l’expansion du capitalisme). Ce parti pris nous apermis de poser un cadre d’analyse opératoire ne plaquant pas des analyses théoriques occidentales, sudaméricainesou asiatiques sur l’Afrique. Il a facilité la façon dont nous avons problématisé la relation entredomination masculine et domination liée à la colonialité de pouvoir, que nous avons nommée colonialitaire,dans un contexte de mondialisation et d’hypermodernité. Les manifestations différenciées de cette relation enAfrique du Sud et au Sénégal nous ont aidé à circonscrire le terrain et le contexte à partir desquels lesorganisations de femmes et féministes locales utilisent ou non l’Internet. La confrontation de leursreprésentations avec le cadre conceptuel est devenue informative et s’est avérée indispensable afin de qualifier lapolitisation de leurs usages. Il nous est ainsi apparu que l’Internet cristallise parmi les technologies del’information et de la communication un moyen par lequel la « société de l’information » est le produit comme laproduction d’une mondialisation hypermoderne où la colonialité du pouvoir et le patriarcat, en tant quesystèmes, s’exercent conjointement. Cette conjonction s’exprime par les biais théorique autant qu’empirique.Notamment nous avons observé que l’épistémologie utilisée dans ce cadre renoue avec des constructionstraditionnalistes, nationalistes, paternalistes et masculinistes des savoirs en écho à ce que permet cet outil :l’accélération de l’appropriation du corps des femmes, la surenchère rhétorique et politique des dominants,l’institutionnalisation des concepts, l’occidentalisation des pensées, les privatisations en tous secteurs, lesconcurrences croisées de l’Occident, l’Extrême et le Moyen-Orient sur les terrains tant économique, politiqueque socioculturel, religieux. Il est alors apparu que les inégalités de genre s’aggravent en même temps que lesidentités sexuelles à tous les niveaux (État, institutions, population) deviennent souterraines et que les rapportsdifférenciés de « race » et de classe se creusent. Fort de ce constat, nos analyses nous ont mené à réaliser que lesfemmes de « la base » se retrouvent en situation d’accentuer la prise en charge immédiate de la gestion del’urgence (augmentation de la pauvreté, des violences, diminution de l’accès aux ressources, à la santé, àl’éducation…), parfois d’accepter leur subalternité tout en la négociant auprès des dominants. Aussi, peu à peu, / With our initial intention to be liberated from the definitions — technical, technocratic or thoseemanating from the sociology of the social appropriation of ICT uses — in order to analyze the usage of theInternet in women’s and feminist organizations in Africa, we focused in this thesis on theoretical workrelating to patriarchy and the coloniality of power (totality of social relations characterized by subalternity —hierarchization between the dominants and the dominated — produced by the expansion of capitalism.) Thisposition enabled us to establish a working analytical framework without imposing Western, South Americanor Asian theoretical analyses on Africa. It also facilitated how we expressed the problematic of therelationship between male domination and the domination inherent in the coloniality of power, which wehave called “colonialtairian” in the context of globalization and hypermodernity. The differentiatedmanifestations of this relationship in South Africa and Senegal helped us delineate the field and contextwithin which local women’s or feminist organizations use or don’t use the Internet. Comparing theirrepresentations within the conceptual framework proved edifying and indispensable in determining thepoliticization of their use. It thus became apparent that among the information and communicationtechnologies, the Internet crystallizes one means by which the “Information Society” is both the product andthe production of a hypermodern globalization in which the systems of coloniality of power and patriarchyfunction conjointly. This conjunction is clearly evidenced both theoretically and empirically. Especiallynoteworthy is that the epistemology used in this context reconnects to traditionalistic, nationalistic,paternalistic and male constructions of knowledge echoing what this tool facilitates: a rapid increase of theappropriation of women’s bodies, the dominants’ rhetorical and political grandstanding, theinstitutionalization of concepts, the Westernization of thought, privatization in all sectors and criss-crossingcompetition throughout the West, the Far East and Middle East in economic, political, socio-cultural andreligious areas. It then appeared that gender inequalities worsen at the same time as sexual identities on alllevels (state, institutions, population) are buried away, while differentiated “race” and class relationshipsbecome more pronounced.

Isso para saber a razão que fundamenta a exploração da notícia sobre o crime e sobre o investigado, pelos meios de comunicação de massa, bem como os reflexos deste trabalho da imprensa no resultado do processo, na sociedade, na pessoa do investigado e na política criminal. O método escolhido para o desenvolvimento do estudo foi o fenomenológico-hermenêutico e o seu resultado foi verificação de que a mídia explora a notícia sobre o crime com o único objetivo de atrair consumidores para os produtos de seus anunciantes. Contudo, desta conduta resulta a violação de muitos direitos de quem faz parte do processo penal, uma vez que a mídia mitiga a presunção de inocência e os direitos e garantias individuais do acusado. Isso porque promove julgamentos antecipados, que resultam na estigmatização de determinados cidadãos e na seletividade operada pelo próprio Estado, através de uma legislação simbólica, desenvolvendo o que se denomina de processo penal do inimigo. Por fim, a única saída para minimizar os reflexos da atuação midiática no processo é a veiculação da notícia sempre com esteio na presunção de inocência, ampla divulgação das sentenças absolutórias e condenações para as hipóteses de ilícitos causados pelo abuso do direito de informar. / The objective of this study is to analyze the relationship between media, criminal and social control. That to know the reason underlying the exploitation of the crime and the investigation by means of mass communication as well as the reflections of this work of the press in the process output, in society, in the person of the investigation and criminal policy. The method chosen for the development of the study was the phenomenological-hermeneutic. And the result was the finding that the media operates on news of the crime with the sole purpose of attracting consumers to the products of their advertisers. However, this behavior results in the violation of many rights who is part of the criminal proceedings, since the media mitigates the presumption of innocence and the rights and individual guarantees of the accused. This is because it promotes early trials, which result in the stigmatization of certain citizens and selectivity operated by the state itself, through a symbolic legislation, developing what is called the prosecution of the enemy. Finally, the only way to minimize reflections of the media work in process is the placement of news always stay with the presumption of innocence, full disclosure of convictions and acquittals sentences for cases of illicit caused by abuse of the right to inform.
