La parole en action : dissensus sur les accommodements raisonnables lors des auditions en commission parlementaire au Québec (2010-2011)

La question du pluralisme religieux est au Québec, l’objet de désaccords et de variations dans son mode de régulation et ses instruments d’action publique. La consultation publique sur le projet loi n° 94, Loi établissant les balises encadrant les demandes d’accommodement dans l’Administration gouvernementale et dans certains établissements, est au cœur de ceux-ci. En se basant sur l'analyse des séances d’auditions publiques en commission parlementaire qui ont eu lieu au Québec entre mai 2010 et janvier 2011 sur le projet de loi n° 94, cette thèse vise à interroger les enjeux liés à la publicisation des prises de positions et de l’échange d’arguments entre différents acteurs. À partir d’une méthodologie par théorisation enracinée et d’un cadre conceptuel qui se rattache à la communication publique, cette thèse cherche à mettre en évidence quelques-unes des propriétés des interactions verbales et non verbales qui composent et incarnent cette activité délibérative. Elle approche ces interactions du point de vue de leur publicisation en s’appuyant sur deux principes : la participation publique en tant qu’un instant de la construction du problème public et l’audition publique en commission parlementaire comme maillon d’un réseau dialogique qui participe à la publicisation du désaccord sur les accommodements raisonnables. Mettant l’accent sur l’usage du langage (verbal, non verbal et para verbal), l’objectif de cette thèse est de mieux comprendre comment des groupes minoritaires et majoritaires, engagés dans une arène publique où les points de vue par rapport aux accommodements raisonnables sont confrontés et mis en visibilité, gèrent leur situation de parole publique. La démarche de recherche a combiné deux stratégies d’analyse : la première stratégie d’inspiration conversationnelle, qui observe chaque séquence comme objet indépendant, a permis de saisir le déroulement des séances d’audition en respectant le caractère séquentiel des tours de parole La deuxième stratégie reviens sur les principaux résultats de l’analyse des séances d’auditions pour valider les résultats et parvenir à la saturation théorique pour élaborer une modélisation. L’exploitation des données selon cette approche qualitative a abouti au repérage de trois dynamiques. La première fait état des contraintes discursives. La seconde met en évidence le rôle des dimensions motivationnelles et socioculturelles dans la construction des positionnements et dans l’adoption d’un registre polémique. La troisième souligne la portée de la parole publique en termes d’actualisation des rapports de pouvoir et de confirmation de son caractère polémique. La modélisation proposée par cette thèse représente le registre polémique comme un élément constitutif de l’engagement argumentatif des acteurs sociaux mais qui est considérablement enchâssé dans d’autres éléments contextuels et motivationnels qui vont orienter sa portée. En tant qu’elle est exprimée dans un site dialogique, la parole publique en situation d’audition publique en commission parlementaire est en mesure de créer de nouvelles intrigues et d’une possibilité de coexister dans le dissensus. Le principal apport de cette thèse est qu’elle propose une articulation, concrète et originale entre une approche de la parole publique en tant que révélatrice d’autre chose que d’elle-même (nécessaire à tout éclaircissement des points de vue dans cette controverse) et une approche de la parole publique en tant que performance conduisant à la transformation du monde social. D’où, le titre de la thèse : la parole en action. The public consultation of the Bill No. 94, an Act that establishes guidelines for governing accommodation requests within the Administration and certain institutions, is in the corner stone of this phenomenon. Based on the analysis of public hearings sessions of the parliamentary committee that took place in Quebec between May 2010 and January 2011, within the framework of public consultations on Bill 94, this thesis aims to examine issues related to the publicization of antagonistic positions. It endeavors to explore properties of the verbal and nonverbal interactions embodied in this deliberative activity by using the grounded theory methodology and the conceptual framework related to the domain of public communication. It approaches these interactions in terms of their publicization, based on two principles: the public participation as a moment of the public issue construction and the public hearings as a bond in a dialogic network participating in the publicization of the dissensus regarding the reasonable accommodations. By focusing on the use of the language (verbal and nonverbal), the goal of this thesis is to explain how minority and majority groups manage the situation of public speaking once they are engaged in a public arena where points of views about reasonable accommodations are confronted and visibilized, The research approach combined two analytical strategies: the first strategy is inspired by the conversational analysis that consists on observing every sequence independently. In fact, it has allowed understanding the progress of auditing sessions by respecting the sequential nature of speaking slots. The second strategy is directed to the main results of the analysis of hearing sessions. The main goal is to validate results and to achieve the theoretical saturation that will develop a modeling. According to this qualitative approach, the use of data led to the identification of three features of talk: the first reports discursive constraints; the second notices the role of motivational and sociocultural dimensions in adopting a positioning and in choosing the discursive register; the third one highlights the range of public speaking in terms of updating the relations of power and in terms of confirmation of its polemical form. The modeling proposed by this thesis represents the polemical register as a fundamental element of the social actor’s argumentative commitment. At the same time, this register is significantly embedded in other contextual and motivational elements that influences its outcome. As it is expressed in a dialogical site, public speaking during parliamentary committee hearings is able to create a new intriguers and a possibility to coexist in the dissensus. The main contribution of this thesis, is that it offers a practical and original dual approach combining between a perspective approaching public speech as indicator of many things other than itself (necessary for the positions and opinions explanation) and a perspective approaching public speaking as performance leading to the transformation of the social world. La communication patient-médecin lors de consultations médicales : une recherche qualitative explorant les expériences des patients provenant de divers groupes ethniques et ethnolinguistiques

La communication patient-médecin est une composante clé des soins de santé et une bonne communication est liée à plusieurs bénéfices pour la santé du patient. Malgré ces bénéfices, les études documentent toujours des difficultés de communication entre patients et médecins, et ces difficultés seraient davantage présentes avec des patients de minorités ethniques et ethnolinguistiques. Bien que plusieurs études aient été effectuées pour investiguer la communication patient-médecin, la littérature comporte des lacunes qui limitent notre compréhension de cette communication. D’abord, la majorité des études ont été effectuées aux États-Unis ou en Europe. Ensuite, les études privilégient davantage des méthodes quantitatives, limitant ainsi notre compréhension de la perspective du patient quant à cette expérience. Enfin, les études négligent d’explorer les enjeux ethniques et ethnolinguistiques qui affectent l’expérience de ces groupes minoritaires. C’est à la lumière de ces constats que les objectifs du premier article inséré dans cette thèse ont été ciblés. Ce premier article consiste en une revue systématique et méta-ethnographie des études qualitatives qui explorent l’expérience des patients de divers ancrages ethniques et ethnolinguistiques en consultation avec les médecins. Les résultats de cette méta-ethnographie montrent que les patients vivent à la fois des expériences positives et négatives, qui découlent entre autres des compétences relationnelles et médicales des médecins. La majorité des études n’explorent pas les enjeux spécifiques aux minorités ethniques ou ethnolinguistiques, mais celles qui s’y sont penchées illustrent que ces groupes de patients rapportent davantage de difficultés de communication. Les résultats de cette revue de littérature confirment la pertinence des méthodes qualitatives pour bien saisir la perspective et l’expérience des patients. À la lumière de ces constats, l’étude doctorale a été développée afin d’explorer plus en profondeur l’expérience des patients appartenant à divers groupes ethniques et ethnolinguistiques en lien avec leurs expériences de communication et de relation avec des médecins. Lors des entretiens avec les soixante participants, il est devenu apparent que leurs expériences de participation dans la consultation représentaient un thème clé pour décrire leurs expériences de communication avec les médecins. Conformément à l’approche inductive, l’objectif émergeant fût d’explorer les expériences des patients relatives à leur participation dans la consultation médicale. D’autre part, l’étude cherchait à explorer les nuances spécifiques aux minorités ethniques et ethnolinguistiques en matière de participation. Les résultats montrent que la participation est un thème central aux expériences des patients. / Ces expériences participatives peuvent être classées selon deux dimensions clés, soit la dimension de participation sous forme d’échange d’information (p.ex., poser des questions) et la participation sous forme d’affirmation (p.ex., exprimer son point de vue). Pour chacune de ces dimensions, les patients discutent également de deux types de participation. Lorsque le patient initie cette participation, il s’agit de participation proactive, tandis que lorsque le médecin invite le patient à participer, il s’agit de participation réactive. Les patients discutent également d’expériences non-participatives, quoique ces expériences sont plus rares. En ce qui a trait aux particularités ethniques et ethnolinguistiques, ces minorités discutent moins fréquemment d’expériences participatives et attribuent ces difficultés de participation à des facteurs linguistiques, tels que la barrière linguistique et à leur identité ethnolinguistique. En conclusion, les minorités ethniques et ethnolinguistiques semblent faire face à des barrières additionnelles qui peuvent poser entrave à une bonne communication et à une participation active en consultation. Il importe de s’intéresser à ces barrières additionnelles, car il se peut que celles-ci expliquent, en partie, les inégalités de santé affectant ces groupes minoritaires. Un Modèle contextualisé de la participation des patients est présenté et discuté, afin de contextualiser les expériences des patients. / Physician-patient communication is a central element in care and a good communication is linked to several health benefits for the patient. However, communication difficulties persist in medical encounters and these difficulties are more present in consultations with ethnic and ethnolinguistic minorities. Previous literature on physician-patient communication present some limitations that restrict our understanding of communication difficulties. In order to improve care, patients’ experiences of this communication must be understood. The first article inserted in this doctoral dissertation consists of a systematic review and meta-ethnography of qualitative studies exploring patients’ experiences of communication with primary care physicians. Three concepts emerged from analyses: negative experiences, positive experiences and outcomes of communication. Most studies in this review did not explore ethnic and ethnolinguistic aspects, but the few studies which did show that ethnic and ethnolinguistic minorities face additional barriers that exert mainly a negative influence on patients’ experiences of communication, namely, language barriers and discrimination. This review illustrates the pertinence of exploring patients’ experiences, with different ethnic and ethnolinguistic backgrounds, with qualitative methods, in order to gain a deep understanding of their perspective. Ensuing from this observation, the doctoral study was developed to explore in detail patients’ experiences of communication. During the interviews, it became apparent that patient participation was a central theme to describe patients’ experiences of communication with physicians. Since an inductive approach was chosen, the emerging objective of this study was to explore patients’ experiences of participation in the medical consultation with physicians. Moreover, we aimed to explore nuances in these experiences of participation according to patients’ ethnic and ethnolinguistic background. Findings show that patient participation is a central theme to describe experiences of communication. Five themes emerged in response to the first objective and these themes are organized in two key dimensions: a) participation in terms of information exchange and b) participation in terms of assertiveness. Across these themes, two types of participation emerged: proactive participation (i.e. patient initiated) and responsive participation (i.e. physician initiated). Patients also discussed experiences of non-participation; however, these were less common. Ethnolinguistic minorities discussed less participative experiences and attributed these difficulties to language barriers and to their ethnolinguistic identity. In conclusion, ethnic and ethnolinguistic minorities seem to face additional barriers which exert mostly a negative influence on their experiences of communication and participation. In turn, these difficulties may engender negative consequences for the patients’ health, thus partly explaining health inequities affecting these minority groups. A contextual model of patient participation is presented and discussed to contextualize patients’ experiences of communication and participation.

La représentation de l'islam au Québec : analyse de contenu de mémoires présentés à la commission Bouchard-Taylor

L'intérêt de cette étude a porté sur les difficultés culturelles d'intégration de la minorité musulmane au Québec. En procédant à l'analyse de contenu de douze mémoires déposés à la commission Bouchard-Taylor, en 2007, nous apprenons l'existence d'une représentation très négative de l'islam et des musulmans. L'islam est perçu, en effet, comme essentiellement violent, extrémiste et misogyne. De plus, il est associé à la quête de pouvoir et au refus des idéaux de la modernité. Cependant, les critiques adressées à l'islam représentent une invitation à la médiation sociale lancée aux musulmans. L'objectif consiste à résoudre le conflit de normes qui oppose les sociétés d'installation occidentales à l'islam, notamment en ce qui concerne le statut de la femme et le droit à la liberté de religion. L'islam est convié de ce fait à construire en son sein une éthique pluraliste afin de s'insérer dans l'environnement sécularisé de la société québécoise. Or, la représentation sociale stéréotypée qui est proposée de l'islam, dans les mémoires analysés, ne favorise pas la participation des musulmans à la médiation sociale. Par ailleurs, les individus rejettent le catholicisme en tant que système de régulation des rapports sociaux, au même titre que l'islam. Ils proposent une laïcité hybride pour le Québec, laïque et libérale, qui donne à voir l'existence d'un rapport ambivalent à la religion. Le principe de l'égalité des sexes au Québec est également affirmé. Il est envisagé comme un droit des femmes à disposer de leurs corps.

Taking Care of the Caregivers: The Moderating Role of Reflective Supervision in the Relationship Between COVID-19 Stress and the Mental and Professional Well-Being of the IECMH Workforce

The present study examined the relationships between COVID-related stress, mental health and professional burnout in the infant and early child mental health (IECMH) workforce and examined reflective supervision and consultation (RSC) as a potential protective factor in the context of COVID-related stress. Participants included 123 adults (n = 121 female, modal age range 30-39 years) in the TN IECMH workforce (mean years of experience = 13.6 years) surveyed in June/July 2020. Sector representation was quite varied (home visiting, childcare, child welfare, early intervention). Results indicated the majority (63%) of the sample was caring for someone else (e.g., child or elderly person) while working at home, 46% of the sample had depression symptoms (18% in the moderate-severe range), and 75% of the sample had anxiety symptoms (33% in the moderate-severe range). Higher COVID stress was associated with higher internalizing symptoms and burnout levels and this relationship was mediated by self-care behaviors such that the more COVID stress one reported, the fewer self-care behaviors they engaged in, and the higher the risk for internalizing and burnout. Finally, the pathway from COVID stress to self-care behaviors was moderated by RSC. IECMH professionals who received less than 1 year (or no experience) of RSC showed a significant decrease in self-care behaviors during times of low, average and high levels of COVID stress compared to those who received 1 year or more of RSC. Implications for both policy and practice will be discussed.

Recently, South African company law underwent a dramatic overhaul through the introduction of the Companies Act 71 of 2008. Central to company law is the promotion of corporate governance: companies no longer are accountable to their shareholders only but to society at large. Leaders should direct company strategy and operations with a view to achieving the triple bottom-line (economic, social and environmental performance) and, thus, should manage the business in a sustainable manner. An important question in company law today: In whose interest should the company be managed? Corporate governance needs to address the entire span of responsibilities to all stakeholders of the company, such as customers, employees, shareholders, suppliers and the community at large. The Companies Act aims to balance the rights and obligations of shareholders and directors within companies and encourages the efficient and responsible management of companies. The promotion of human rights is central in the application of company law: it is extremely important given the significant role of enterprises within the social and economic life of the nation. The interests of various stakeholder groups in the context of the corporation as a “social institution” should be enhanced and protected. Because corporations are a part of society and the community they are required to be socially responsible and to be more accountable to all stakeholders in the company. Although directors act in the best interests of shareholders, collectively, they must also consider the interests of other stakeholders. Sustainable relationships with all the relevant stakeholders are important. The advancement of social justice is important to corporations in that they should take into account the Constitution, labour and company law legislation in dealing with social justice issues. Employees have become important stakeholders in companies and their needs should be taken into account in a bigger corporate governance and social responsibility framework. Consideration of the role of employees in corporations entails notice that the Constitution grants every person a fundamental right to fair labour practices. Social as well as political change became evident after South Africa's re-entry into the world in the 1990s. Change to socio-economic conditions in a developing country is also evident. These changes have a major influence on South African labour law. Like company law, labour law, to a large extent, is codified. Like company law, no precise definition of labour law exists. From the various definitions, labour law covers both the individual and collective labour law and various role-players are involved. These role-players include trade unions, employers/companies, employees, and the state. The various relationships between these parties, ultimately, are what guides a certain outcome if there is a power play between them. In 1995 the South African labour market was transformed by the introduction of the Labour Relations Act 66 of 1995. The LRA remains the primary piece of labour legislation that governs labour law in South Africa. The notion of industrial democracy and the transformation of the workplace are central issues in South African labour law. The constitutional change that have taken place in South Africa, by which the protection of human rights and the democratisation of the workplace are advanced contributed to these developments. Before the enactment of the LRA, employee participation and voice were much-debated topics, locally and internationally. In considering employee participation, it is essential to take due cognisance of both the labour and company law principles that are pertinent: the need for workers to have a voice in the workplace and for employers to manage their corporations. Employee participation and voice should be evident at different levels: from informationsharing to consultation to joint decision-making. Corporations should enhance systems and processes that facilitate employee participation and voice in decisions that affect employees. The primary research question under investigation is: What role should (and could) employees play in corporate decision-making in South Africa? The main inquiry of the thesis, therefore, is to explore the issue of granting a voice to employees in companies, in particular, the role of employees in the decision-making processes of companies. 摘 要 資訊時代下,要求國家對於人民提供資訊,係為行政程序要求公開透明化之國家重要任務。近年來,我國法制發展,主要著重在要求政府對不特定多數人公開資訊之相關法制建構。相較於此,課予行政機關於行政程序對特定人民提供資訊,無論是行政機關為單方面的資訊提供,或進一步以對話的方式提供意見的諮詢,為我國法制規範上未予關注之處。現代社會變遷下,行政任務內容朝向複雜及專業化發展,國家扮演的角色亦隨之重新定位,除了在消極方面,要求國家不得過度干預人民權利的行使外;在積極的面向上,國家負有提供人民生存照顧服務的義務。具體落實在一般行政程序當中,由於行政任務的變遷以及法規的繁雜,常使人民難於釐清之間的權益關係,除此之外,在社會行政程序中,程序相對人大多具有在資訊取得較為弱勢之特徵,為了有效落實並達成個別社會給付之目的,需透過行政機關在社會給付行政程序中,提供人民相關協助。 要求國家於行政程序中提供人民相關資訊,涉及正當行政程序在憲法上的定位。釋憲實務對於正當法律程序之發展,及對該概念所為的闡釋,說明程序在憲法上亦受到檢視。除了透過憲法明文規定之權利推導出程序的要求外,特別是在行政領域中,行政程序基本權的肯認,所能發揮人民權利保障的功能,係為近年來實務及學理上,就該權利主張之具體依據及內涵,於法制發展上關注的重心。而要求國家對個別人民提供資訊,足以作為行政程序基本權的具體內涵之一。 在法律的層次方面,基於公益的考量,課予行政機關於行政程序中踐履相關的義務,必須進一步探求系爭法規之規範意旨,透過保護規範理論的操作,探究人民是否具備主觀公權利。我國行政程序法中,並未就行政機關對人民之諮詢及提供資訊義務作一般性規定,然而,在個別社會相關專業法規當中,則存在許多課予行政機關負有諮詢及提供資訊之具體規範。對此,德國法上考量在一般行政程序中,相較於在社會行政程序中的不同需求,將行政機關之諮詢及提供資訊的內容作不同規範,甚至及於行政程序尚未開啟前之程序階段作討論。在我國未就社會給付行政程序另行規範一部專業法規的前提下,在社會給付行政程序中,說明行政機關對個別人民負擔諮詢及提供資訊義務之正當性,分別從行政程序法之一般性規定,及個別社會專業法規之規範作探討。 行政機關違反行政程序行為的法律效果,除了影響系爭行政決定作成的效力外,在國家責任制度方面,透過地位回復請求權之制度建構,俾使人民得請求回復到,如同行政機關已為正確資訊提供之程序地位,進而得為權利之行使及選擇。地位回復請求權對於人民權利保障所能發揮的功能,殊值作為未來我國相關法制度發展的思考面向。 關鍵詞:正當法律程序、正當行政程序、程序基本權、協助義務、良好行政、 諮詢、提供資訊、社會法地位回復請求權、社會行政程序、信賴保護。 / Abstract Under the information age, requiring the State to provide information to the people, is the important tasks for the procedural requirements of transparency. In recent years, the development of Taiwan’s legal system, mainly focused on asking the Government for disclosure of information to public. Compared to this, whether to ask administrative agency to provide information, further to provide advice on ways of dialogue to the specific people were not of the legal norms of the attention. Changes in modern society, the administration task definition faces complex and the specialized development. The role of the State is to reposition, except the negative side, requires that the State shall not interfere unduly with the exercise of the right of the people, on the positive side, the State have obligations to provide the life of care. Realization in general administrative procedure, due to the changes of the administrative tasks, as well as the complexity of regulations, often makes people difficult to clarify the relationship between rights and obligations. Breast Reconstruction Post-Mastectomy : an Assessment of Rates, Limiting Factors and Attitudes at a Tertiary Care Center in Quebec

La reconstruction mammaire post-mastectomie améliore le bien-être psychosocial, et l’image corporelle des patientes. Parcontre, la reconstruction mammaire demeure faiblement utilisée et même inaccessible à des patients dû à des facteurs limitants. Les taux de reconstruction et les facteurs qui influencent l’accès à la reconstruction n’ont pas été évalués dans la province du Québec. Avec une revue de dossier rétrospective, l’objectif de notre étude est d’identifier les taux de reconstruction mammaire dans un centre tertiaire à Montréal et les facteurs qui influencent l’accès à la reconstruction, avec un revu de dossier rétrospective. Ensuite, nous avons évaluer directement dans la même cohorte de patientes, leur désire d’avoir une consultation en chirurgie plastique pour discuter d’une reconstruction. Il y avait un taux total de reconstruction mammaire post-mastectomie de 21%, dont 14% était immédiat et 8% tardif. Les patientes qui ont eu une reconstruction étaient plus jeunes, plus de tendance à avoir une plus grande proportion de mastectomie bilatérale, avaient des cancers non-invasifs et habitaient plus loin de l’hôpital (>10km). Environ la moitié des patientes avec une mastectomie sont intéresser à avoir une consultation avec un chirurgien plasticien mais seulement 38% ont eu une reconstruction. Les chances d’avoir subi une reconstruction, augmentent lorsqu’une reconstruction est offerte et expliquée. Présentement, il existe des barrières autres que les désires de la patiente qui empêchent l’accès à la reconstruction mammaire post-mastectomie. / Breast reconstruction post-mastectomy has been shown to improve psychosocial wellbeing, and body image. However, accessibility and acceptance of breast reconstruction is limited, with patients being unequally privileged based a number of limiting factors. To date, no evaluation on the rates of reconstruction and the factors that influence patient access has been performed in the province of Quebec. The objective of the research was two-fold with the first component being to identify the rates of breast reconstruction at a tertiary care center in Montreal and the factors influencing the rates of reconstruction through a retrospective chart review. The second component was to directly evaluate in the same cohort of breast cancer patients; their interest in a consultation with plastic surgery through a telephone questionnaire. There was a total rate of PMBR of 21%, where 14% of patients had an immediate reconstruction and 8% of eligible patients underwent a delayed reconstruction. Patients that received a PMBR were younger, more likely to have bilateral mastectomies, had non-invasive breast cancer and resided further then 10km from the hospital. Approximately half of patients with a mastectomy were interested in consulting a plastic surgeon but only 38% of all patients underwent a reconstruction. The offer and awareness of reconstruction increased the chance of opting to have a reconstruction. There are barriers outside of the patient’s own desires that impede their access to breast reconstruction.

Text in Afrikaans / The purpose of this research study was to determine whether social workers at ground-level experience job satisfaction in their current job situations, as well as to determine the motivational factors that play a role in this regard. Eleven non-governmental welfare organisations in the Boland Region were included in this investigation. Forty-seven social workers participated in this investigation. Based on this investigation into the experiences relating to job satisfaction of ground-level social workers, the following conclusions became evident: Younger social workers experience more job satisfaction then there counterparts in mid-life, while the social in the age bracket of 50 years and above seem to experience more job satisfaction. There seems to be a great deal of job dissatisfaction amongst social worker in the Boland Region as two thirds of the respondents indicated the intention to change their current places of employment. Based on theses conclusions, it is recommended that supervisors within region should establish a forum at which they can deliberate about their management role as supervisors in order to promote job satisfaction amongst social workers. / Social work / M.Diac.

Introdução: O AVC (acidente vascular cerebral) é uma das mais importantes causas de alterações neuropsicológicas. Uma avaliação cognitiva inicial realizada por telefone implicaria em um diagnóstico mais precoce de prejuízo cognitivo e demência, reduzindo custos e tempo. Objetivo: Examinar as propriedades psicométricas da versão brasileira da Entrevista Telefônica para Avaliação do Estado Cognitivo - Modificada (TICS-M) em pacientes pós-AVC. Métodos: Previamente à validação da TICS-M em indivíduos acometidos por AVC, foi realizada tradução para o Português do Brasil e adaptação transcultural da versão original da TICS-M em uma amostra de 30 sujeitos não clínicos. Após esta fase, um subgrupo de 61 pacientes com AVC, participantes do Estudo da Mortalidade e Morbidade do AVC (EMMA) que ocorre no Hospital Universitário da Universidade de São Paulo, foram convidados a participar da validação da TICS-M, seis meses após o evento agudo. A TICS-M foi aplicada em três momentos: avaliação inicial (entrevista presencial), uma e duas semanas após a primeira avaliação. Na avaliação inicial, além da TICS-M, questionários adicionais foram aplicados para avaliar a cognição: MoCA (Montreal Cognitive Assessment), MEEM (Mini Exame do Estado Mental); e para a depressão, HDRS (Hamilton Depression Rating Scale). Todos os questionários foram aplicados por duas entrevistadoras treinadas para o estudo. A confiabilidade intra-observador da TICS-M foi testada através dos coeficientes de Pearson, Intraclasse e alfa de Cronbach. As características internas do TICS-M também foram avaliadas através de uma análise exploratória utilizando o método Análise de Componentes Principais. A validade discriminatória do instrumento para rastreamento de demência pós-AVC foi avaliada em comparação a MEEM pela análise da área sob a curva (AUC) determinada pela curva ROC. Foram calculadas sensibilidade e especificidade para o ponto de corte ideal para rastrear demência. Resultados: De maneira geral, a TICS-M traduzida para o português apresentou um bom entendimento dos itens na mostra de indivíduos não clínicos. Foi observada uma frequência de 23% sugestiva de demência pós-AVC. O nível de escolaridade esteve positivamente associado ao estado demencial rastreado pelo MEEM. O estado depressivo assim como outras características de base não se associou à demência sugerida pelo MEEM. A confiabilidade teste-reteste intra-observador revelou taxas quase totais nos três momentos avaliados (Pearson Coeficiente > 0,85, Coeficientes de Correlação Intraclasse > 0,85 e Coeficiente alfa de Cronbach: 0,96). A análise fatorial determinou três domínios: memória de trabalho e atenção; memória recente e de evocação e orientação. A área sob a curva (AUC) determinada para a TICS-M em comparação com MEEM foi de 0,89 (intervalo de confiança 95%: 0,80-0,98). O ponto de corte sugerido para TICS-M foi de 14 pontos (escala de 0-39 pontos) para rastrear demência com sensibilidade de 91,5% e especificidade de 71,4%. Resultados semelhantes foram observadas com o MoCA. Conclusão: A versão brasileira da TICS-M sugere ser um instrumento de pesquisa útil e confiável para rastrear demência em pacientes pós-AVC / Introduction: Stroke is one most important cause of neuropsychological disorders. An initial cognitive assessment performed by telephone resulting in an early diagnosis of cognitive impairment and dementia, reducing costs and time. Objective: To examine the psychometric properties of the Brazilian version of the Modified Telephone Interview for Cognitive Status Assessment (TICS-M) for assessment of dementia in post-stroke patients. Methods: Prior to validation of TICS-M in post-stroke patients, translation was performed for the Brazilian-Portuguese and cross-cultural adaptation of the original version of TICS-M in a non-clinical sample of 30 subjects. After this phase, 61 stroke patients enrolled in the Stroke Mortality and Morbidity Study (The EMMA study) that occurs at the University Hospital of the University of São Paulo, were invited to participate in this sub-study to validate the TICS-M six months after the acute event. The TICS-M was applied in three moments: first evaluation (personal interview), one and two weeks after of the first evaluation. At the first evaluation, beyond the TICS-M, additional questionnaires were applied to assess cognition: MoCA (Montreal Cognitive Assessment), MMSE (Mini-Mental Status Examination), and for depression, HDRS (Hamilton Depression Rating Scale). All questionnaires were administered by two trained interviewers for the study. Reliability of the TICS-M was tested by intra-observer rates using Pearson, Intraclass and Cronbach´s alpha coefficients. The internal characteristics of TICS-M were also evaluated by an exploratory analysis using Principal Component Analysis. The discrimination validity of the instrument to assess dementia was evaluated by comparison to the MMSE analysis of the area under the curve (AUC) determined by the ROC curve. Sensitivity and specificity for the ideal cutoff to assess dementia were calculated. Results: In general, the TICS-M translated into Portuguese version showed a good understanding of the items in non-clinical individuals. A frequency of 23% suggestive of post-stroke dementia was observed. The level of education was positively associated with dementia status assessed by MMSE. The depressive status, as well as, other baseline characteristics was not associated with dementia suggested by MMSE. Test-retest reliability intra-observer revealed almost total rates in the three evaluation moments (Pearson coefficient > 0.85, Intraclass Correlation Coefficient > 0.85 and Cronbach\'s alpha coefficient: 0.96). The factorial analysis determined three domains: working memory and attention, recent and recall memory and orientation. The area under the curve (AUC) determined by TICS-M compared to MMSE was 0.89 (95% confidence interval: 0.80-0.98). The cutoff suggested for TICS-M was equal or greater than 14 points (range 0-39 points) to assess dementia (91.5% sensitivity, 71.4 % specificity). Similar results were observed with the MoCA. Conclusion: The Brazilian version of TICSM suggests being a useful and reliable research instrument to evaluate dementia in poststroke patients in epidemiological studies
