O presente trabalho tem como premissa principal que o advogado é o mediador mais adequado para fazer a divulgação, através da publicidade, dos direitos coletivos e difusos dos cidadãos, no Brasil e na Argentina. Diante disso, propôs-se analisar o efeito que as sociedades modernas e a evolução das tecnologias da comunicação exerceram sobre a comunicação, e sobre os processos de conquista da democracia nos dois países. Procurou-se identificar que o advogado é agente transformador da Justiça quando leva ao judiciário as mais variadas demandas oriundas das transformações da sociedade. Através dos Estudos Culturais, em diálogo com os hibridismos culturais, procurou-se provar que o medo de uma comunicação de massa hipnotizante, é infundado. Por fim, foram buscados argumentos que procuram colocar a comunicação do advogado com a sociedade brasileira e argentina como peça fundamental para a consolidação da democracia nos dois países. / This paper has as main premiss that the lawyer is the most adequate mediator to spread, thru publicity, of the collective and diffuse rights of the citizens in Brazil and Argentina. In view of this, we propose to analyze the effects that the modern societies and the evolution of communication technologies exercise upon the communication and the processes of conquest of democracy in both countries. We tried to identify that the lawyer is a transforming agent of Justice when he brings to the judiciary the most various demands produced by the transformation of the society. Thru Cultural Studies, in dialogue with cultural hybridity, we tried to proof that the fear of the hypnotizing mass communication is unfounded. At last, we searched arguments that try to place the communication of the lawyer with the Brazilian and Argentinean society as a master piece for the democracy consolidation in both countries.

Previous issue date: 2010-07-01 / In Brazil, through social rights were recognized, in parallel, the civil and political rights. Even at authoritarian times, social rights have been formally recognized, given that the Federal Constitution of 1988 gave them enormous attention. However,
realization of social rights requires, beyond the state action, the commitment of workers and their unions, occupying Article 8., III CF/88 position of prominence in this particular, by allowing the union, as a procedural substitute, to file lawsuits in defense of collective rights (especially of a certain workers class) and homogeneous individual rights of its members. This ensures isonomic access to justice to the members of the class (especially professional), and also decrease the excessive amount of individual claims and increase the number of workers protected. Finally, the most frequent activities of the union as a procedural substitute for workers, beyond strengthening the ties between them, will reduce the low rate of spontaneous compliance of the constitutional and legal norms which enshrine social rights by employers, also reducing, as a result, judicial cases and relieving the Labor Courts. / No Brasil, através dos direitos sociais, foram consagrados, de forma paralela, os direitos civis e políticos. Mesmo em períodos autoritários, os direitos sociais foram reconhecidos formalmente, sendo certo que a Constituição Federal de 1988 deu a eles enorme destaque. Contudo, a concretização dos direitos sociais, além de prestações do próprio Estado, requer o empenho dos trabalhadores e de seus sindicatos, ocupando o artigo 8º., III da CF/88, neste particular, posição de destaque, ao possibilitar que o sindicato, na condição de substituto processual, ajuíze ações em defesa dos direitos coletivos (da categoria profissional, enquanto tal) e dos direitos individuais homogêneos de seus membros. Isso garante aos integrantes da categoria (notadamente profissional) isonomia no acesso à justiça, além de diminuir a quantidade excessiva de reclamações individuais e aumentar o número de trabalhadores tutelados. Por fim, a atuação mais freqüente do sindicato como substituto processual dos trabalhadores, além de fortalecer os laços entre eles, aumentará o baixo índice de cumprimento espontâneo pelos empregadores das normas constitucionais e legais que consagram os direitos sociais, reduzindo também, via de conseqüência, os processos judiciais e desafogando a Justiça do Trabalho.

[pt] A presente pesquisa visa à fundamentação teórica do reconhecimento dos
povos indígenas como verdadeiros sujeitos do Direito Internacional dos Direitos
Humanos, através do resgate do pensamento jurídico e teológico dos autores da
Escola Ibérica da Paz, cujos escritos, datados dos séculos XVI e XVII, colocaram
em causa os fundamentos éticos, jurídicos e políticos do processo de conquista e
colonização do Novo Mundo. Trata-se de um momento histórico particularmente
privilegiado para esta análise, em primeiro lugar, pelo ineditismo do contato
civilizacional proporcionado pela chegada das naus espanholas e portuguesas na
América, sob os auspícios das Coroas ibéricas e do Papa, impulsionando os
autores do Renascimento peninsular a adequar toda a tradição filosófica
mediterrânea cristã a uma nova realidade, resultando na reinvenção do direito
natural e das gentes no quadro de uma realidade cultural bastante distinta daquela
do orbis christianus medieval. Em segundo lugar, este contexto histórico e
geográfico permite uma análise do Direito Internacional, ainda como jus gentium,
ou seja, antes do modelo westfaliano de repartição das soberanias estatais pós
1648. Para a compreensão do problema de pesquisa proposto em toda sua
amplitude, o trabalho divide-se em três partes principais. A primeira dedica-se ao
estudo do fenômeno da coletivização da proteção internacional dos direitos
humanos, analisando de início as fontes de inspiração utilizadas para a redação da
Declaração Universal dos Direitos Humanos e o processo decisório que gerou a
divisão dos Pactos Internacionais das Nações Unidas em dois instrumentos com a
previsão de direitos civis e políticos separadamente dos direitos econômicos,
sociais e culturais e com mecanismos de implementação distintos, o que resultou
na proteção dos direitos humanos individuais mais amplamente desenvolvida que
aquela em dimensão coletiva. Demonstra-se, ao final, que, apesar de resistências
teóricas, as coletividades humanas possuem, contemporaneamente, um lócus
standi nos sistemas de peticionamento internacional em casos de graves e
sistemáticas violações de direitos humanos. A segunda parte destaca a trajetória
dos povos indígenas de objetos a sujeitos do direito internacional, assim como
examina o processo emancipatório dos povos indígenas no Novo
Constitucionalismo Latino-Americano. Esta parte intermediária do trabalho
demonstra ainda o reconhecimento da condição de sujeitos coletivos dos povos
indígenas por meio do estudo da casuística indigenista da Corte Interamericana de
Direitos Humanos, sobretudo após o caso paradigmático do povo Kichwa de
Sarayaku v. Equador (2012). Entretanto, por este trabalho não objetivar uma
análise apenas hermenêutica e normativista do Direito Internacional dos Povos
Indígenas, a terceira parte revela o papel da Escola Ibérica da Paz, nos séculos
XVI e XVII, na defesa dos direitos dos povos indígenas do Novo Mundo. Graças
à perspectiva do direito natural e das gentes, os povos indígenas eram
considerados pelos autores ibéricos como comunidades humanas livres e
soberanas que, como qualquer outro reino cristão, tinham o direito de se
autogovernar e dispor de suas terras. / [en] The aim of this thesis is to research the theoretical basis for the recognition
of indigenous peoples as true subjects of the international law for human rights,
by means of recovering the legal and theological thought of the authors of the
Iberian School of Peace. Their written work which dates of the sixteenth and
seventeenth centuries discuss the ethical, legal and political basis for the process
of conquer and colonization of the New World. Their debates occurred in a
privileged moment for the analysis, firstly because of the unprecedented contact
of civilizations created by the arrival of the Spanish and Portuguese caravels in
America, under patronage of the Iberian kings and the Pope. This contact
stimulated the authors of the Renascence in the Iberian Peninsula to adapt the
Christian Mediterranean philosophy tradition to a new reality which resulted on
reinvention of the natural law and the law of nations under the frame of a cultural
reality very different from that of the medieval orbis christianus. Secondly, the
historic and geographic context of the Iberian School of Peace allows an analysis
of the International Law still as jus gentium, i.e. before the Westphalian model of
state sovereignty established in 1648. For complete understanding the research
problem, the thesis is divided in three parts. The first part is dedicated to the study
of phenomenon of the collectivization of the international law of the human rights.
It analyses the sources that provide inspiration for the Universal Declaration of
Human Rights and the decision process that divided the International Pacts of the
United Nations in two instruments, one for civil and political rights and other for
economic, social and cultural rights. The fact that the two instruments have
distinct implementation mechanisms resulted on the protection of individual
human rights being more widely developed than the protection of the collective
dimension of human rights. It is demonstrated that besides the resistance in the
tradition of human rights theory, human collectivities currently have locus standi
in the international petitioning systems for the systematic violation of human
rights. The second part emphasizes the trajectory of indigenous peoples from
objects to subjects of international law, and examines their emancipatory process
under the New Latin American Constitutionalism. This intermediate part of the
work demonstrates the recognition of the condition of collective subjects for the
indigenous peoples by means of the study of indigenous case law brought to the
Inter-American Court of Human Rights, especially after the paradigmatic case of
the people Kichwa de Sarayaku v. Ecuador (2012). As this thesis does not aim to
analyze the international law of the indigenous peoples resorting only to legal
hermeneutics and normative studies, the third part reveals the role of the Iberian
School of Pace of the sixteenth and seventeenth centuries to the protection of
indigenous peoples rights in the new world. Due to the perspective of the natural
law and the law of nations, the indigenous peoples were considered by the Iberian
authors as free and sovereign human communities that, as any other Christian
kingdom, had the right of self-government and control of their lands.

Les biens d'usage public sont la catégorie centrale de la construction du droit administratif des biens. L'absence d'une analyse d'ensemble de la catégorie, en droit colombien, pousse à revoir les bases sur lesquelles elle repose et ses conséquences. Plus que toute autre catégorie juridique, les biens d'usage public sont tributaires de leur histoire, c'est dans l'étude de cette dernière que se trouvent les clés d'interprétation de tout le système. Le modèle utilisé par le code civil colombien a été calqué sur la division des biens publics, opérée par le droit espagnol colonial – inspirée à son tour du droit romain. Une mise à jour s'avère nécessaire. À partir de la notion de propriété publique, et de son régime constitutionnel, il est possible de construire une définition matérielle des biens d'usage public, permettant de comprendre les caractéristiques de l'usage public. Cela implique, aussi, une révision complète du régime juridique à la lumière de l'exploitation sociale et économique – valorisation – de la propriété publique. À une triple protection, celle de la propriété publique, du bien d'usage public et de l'usager, s'ajoute une nouvelle approche des occupations privatives. Cette idée d'exploitation sociale et économique anime un nouveau régime des titres habilitant l'occupation privative, des redevances pour occupation des biens d'usage public et des droits réels administratifs. / Regulation of public property available for public use is at the core of administrative law. The Colombian Civil Code has copied colonial Spanish law in the matter, which in turn was inspired by Roman law. However, the absence of an exhaustive and coherent regulation in Colombia has forced the interpreter to study its foundation and further developments to interpret it. An update of this legal system is, therefore, imperative. Beginning with the concept of public property and its constitutional regulation, it is poss ible to analyze the elements of its public use, which will allow proposing a definition of those assets. It is necessary to analyze the regulation of these public properties under the light of their social and economic value. The protection granted by the law to the concepts of public property, public use and public user, has to be assessed under the new approach of the administrative authorizations pertaining to such public property. This notion of social and economic value will also allow scholars/people to have a new vision of the regulation of administrative authorizations, the exclusive rights (in rem) they confer and the income they produce.

Aussi, la recherche est relative à l’identité du constitutionnalisme.L’exclusion se définit comme le décalage entre l’orientation identitaire du constitutionnalisme et l’identité ducorps du sujet. La méthode d’analyse proposée, afin de traiter de l’exclusion en droit, et déplacer la comparaison,est tripartite : mettre en évidence l’orientation identitaire du constitutionnalisme, en identifier la structureidentitaire, pour, enfin, en déterminer les étrangers ou « Autres. » La recherche vise à déplacer la comparaison enproduisant une phénoménologie de l’exclusion constitutionnelle, ou « dehors constitutifs, » avec une typologiedes étrangers du droit.
