Previous issue date: 2008-06-03 / The objective of this study is to demonstrate, through doctrinaire and jurisprudential researches, which the practice of reviewing the employees, commonly made by employers, can invade the sphere of privacy of the employee injuring his dignity. Certainly, in relation to employment there is, on the one hand, a legal subordination of the employee and on the other, the power of direction of the employer, and that with this plea power of direction and the right of property, the employer use the review as a way of protecting his heritage. The practice of review is considered restrictive clause of fundamental rights, and, therefore, there are obvious limits to the actions of the employer in this regard. The magazine is divided into personal or intimate reviews and revised in personal objects, being the first performed on the body of the employee, and the second made in pockets, bags and in the employees vehicles. We defend, in the present study, that the intimate reviews are prohibited by injuring the dignity of the human being, while the reviews in the employee's personal objects can be charged, but respecting some rules. To reach such conclusions our study examined the work freedom, the relation of work and legal subordination, the power of direction, its tracks and limits, the right of ownership, the fundamental rights, human dignity, constitutional principles applied to the work relations, the protection of privacy, the collision of principles and horizontal effectiveness of fundamental rights. We also analised the position adopted by the Law compared and the positioning of the International Labor Organization concerning the issue, in addition to mechanisms adopted by the Labor Law as a way of repairing the damage caused to employees and the role of Labor Public Ministry and the unions related to the practice of reviewing / O objetivo do presente trabalho é demonstrar, por meio de pesquisas doutrinárias e jurisprudenciais, que a prática de revista nos empregados, efetuada comumente pelos empregadores, pode invadir a esfera da privacidade do empregado ferindo sua dignidade. É certo que na relação de emprego existe de um lado a subordinação jurídica do empregado e do outro o poder de direção do empregador, e que, com fundamento nesse poder de direção e no direito de propriedade, o empregador se utiliza da revista como forma de proteger seu patrimônio. A prática de revista é considerada cláusula restritiva de direitos fundamentais, existindo, portanto, evidentes limites para a atuação do empregador neste sentido. A revista é dividida em revista pessoal ou íntima e revista em objetos pessoais, sendo a primeira efetuada sobre o corpo do empregado, e a segunda efetuada em bolsas, sacolas e automóveis do empregado. Defendemos no presente estudo que as revistas íntimas são proibidas por ferir a dignidade da pessoa humana, enquanto que as revistas em objetos pessoais do empregado podem ser praticadas, porém respeitados alguns parâmetros. Para chegarmos a tais conclusões nosso estudo analisou a liberdade de trabalho, a relação de trabalho e a subordinação jurídica, o poder de direção, suas vertentes e seus limites, o direito de propriedade, os direitos fundamentais, a dignidade da pessoa humana, os princípios constitucionais aplicáveis às relações de trabalho, a proteção da intimidade, a colisão de princípios e a eficácia horizontal dos direitos fundamentais. Analisamos também a posição adotada pelo Direito comparado e o posicionamento da Organização Internacional do Trabalho referente ao tema, além dos mecanismos adotados pelo Direito do Trabalho como forma de reparação dos danos causados aos empregados e a atuação do Ministério Público do Trabalho e dos sindicatos no que diz respeito à prática de revista

Certaines séries télévisées américaines proposent un traitement riche et problématique des voix féminines. Ainsi, Ally McBeal (Fox, 1997-2002), Sex and the City (HBO, 1998-2004), Desperate Housewives (ABC, 2004-2012) et Gossip Girl (The CW, 2007-2012) utilisent une voix-off féminine, mettent en scène des discussions entre femmes et ont pour personnages principaux des femmes qui prennent la parole dans la sphère publique. L’analyse de ces voix multiples démontre comment les dispositifs centrés sur la voix et le discours participent de la représentation des femmes, de la féminité et des rapports de genre à la télévision américaine. Cette recherche s’inscrit dans les études télévisuelles féministes en proposant une synthèse des courants qui constituent cette approche. L’analyse des contenus est associée à une prise en compte du contexte de production tout en ébauchant une étude des processus de réception. Ces trois dimensions permettent d’envisager les séries comme des « actes-en-société ». Les études filmiques et télévisuelles, l’histoire et les sciences de l’information et de la communication notamment sont convoquées pour étudier les représentations du genre dans un corpus d’épisodes de séries, d’entretiens avec des professionnels et de réactions de téléspectatrices et téléspectateurs.Si les voix des femmes n’ont pas toujours eu droit de cité dans les médias américains, elles émergent massivement dans les séries depuis les années 1990 notamment grâce à l’héritage du soap opera, genre audiovisuel féminin mettant au premier plan des relations interpersonnelles et des dilemmes moraux. La pratique du commérage apparaît comme un modèle pour de nombreux récits sériels mettant en scène l’intimité. Les séries inscrivent ainsi les voix des femmes dans une économie médiatique en réseaux proposant une réactualisation des représentations du genre. / Several recent American TV series offer an original treatment of women’s voices. Ally McBeal (Fox, 1997-2002), Sex and the City (HBO, 1998-2004), Desperate Housewives (ABC, 2004-2012) and Gossip Girl (The CW, 2007-2012) use female voiceovers, emphasize women’s talk and center on female characters who have a public voice. Analyzing these voices shows how audiovisual apparatuses centered on voice and speech convey specific representations of women, femininity and gender on American television.This research mobilizes feminist televisual studies in focusing not only on contents, but also on production and reception. Thus TV series can be understood as « social acts », that have a direct impact on society. Borrowing tools from film and television studies, history and media studies is necessary to analyze the series’ episodes, several interviews conducted with TV writers and online reactions from viewers.American media contained women’s voices for a long time. They started to appear in TV series in the 1990s, in part through the influence of the soap opera genre, which focuses on interpersonal relations and moral dilemmas. Gossip is a gendered practice linked to the soap opera, it is a model for many contemporary serial narratives that foreground intimacy. The series set women’s voices in a networked economy and thus re-actualize gendered representations.

本研究主要目的是探討現今人們透過電腦中介傳播系統(computer-mediated communication, CMC)發展出的人際情感親密關係。研究動機是基於網路目前的風行以及研究需要,並視網路為「虛擬情境」,稱此通道下之人際情感親密關係為「虛擬人際關係」,與親身接觸發展出的人際關係有相同與相異之處。
本研究整理1970年左右迄今「電腦中介傳播」從「媒介選擇」、「人際互動」到「人際關係」,從強調網路工作效益至人際效果的研究歷程。「媒介選擇」包括「去線索理論」中的社會臨場感理論、媒介豐富理論、缺乏社會情境線索假說等,以及強調社會影響的社會資訊處理觀點;「人際互動」則分為網路人際情感、網路中的語言與非語言線索、比較電腦中介傳播與面對面兩種人際互動等加以說明;另著重在網路人際關係的文獻探討,詳述walther以「社會資訊處理觀點」看電腦中介傳播人際關係的研究,並也說明可用在網路研究的人際傳播理論。文中提到電腦中介傳播人際情感親密關係研究之重要,並敘述與本研究-「虛擬人際關係」相關的理論與說法。
研究探討的重心有三:1. 欲了解「虛擬人際關係」的發展與組成,以及這種人際情感網絡對於現實生活中人際網絡具替代或互補作用;2. 了解「虛擬人際關係」與親身接觸人際情感關係的異同;3. 找出人們尋求「虛擬人際關係」的原因。
本研究以電子布告欄(Bulletin Board System, BBS)為研究情境,選擇清大電機BBS站心情類版為研究個案,採用俗民方法學的態度,以觀察、親身參與其人際互動、社會網絡分析、深度訪談、電子郵寄問卷等方式探討BBS中的人際親密關係與情感支持。
研究結果發現「虛擬人際關係」網絡對大多數使用者為人際網絡之擴大;其發展過程與親身傳播人際感情關係發展過程類似,也會有自我表白、分享、了解等親密關係與情感互動,但「匿名」、文字互動、想像與期待、與異性交往多、轉移傳播情境會有落差等,是兩人際關係發展不同之處。而「虛擬人際關係」的組成還必須要有電腦網路「匿名」、情感使用、虛擬情境等特質,以及使用者有電腦網路經驗、技巧、媒介接近性、學科背景、個人特質(個性、偏好)等條件,這些不同於親身接觸的人際情感關係的組成與發展因素,也是使用者去尋求「虛擬人際關係」,得到情感與親密之因。
因此,「虛擬人際關係」可以使人發展親密關係並有情感互動,它無法替代實際人際情感親密關係,人們也不可能脫離現實的人際互動,但即是如此,由電腦中介傳播媒介建構的情境卻可以是一處情感交流與宣洩的地方,科技進步也可有溫情的人際效果。 / The study mainly attempts to explore intimate and emotional interpersonal relationship through the computer-mediated communication(CMC) ,orthe Internet, which is regarded as a "Virtual context". The relationship is named as "virtual relationship" which is different from face-to-face(FTF) one.
The study examined several related researches from 1970s on "media choice theory" and "interpersonal interaction". The former includes social presence theory, media richness theory and social information processing(SIP) theory. The latter combs the differences in the interpersonal emotion, ve.rbal/nonverbal cues and human interaction between the CMC and FTF chanell. and interpersonal relationship .Besides, the author describes Walther's SIP theory a lot and suggests it can also be applied to the research of internet-based interpersonal communication. The study also suggests that the most important in the research of CMC is to undesrstand the connection among the users, especially in emotion and intimacy.
There are three points in the research:(1)the development and constitution of the virtual relationships, (2)the difference in between virtual and FTF relationships, (3)finding out the reasons why people come to virtual relationships.
The methods of the study include ethnographic participant observation, social network analysis, depth interview and E-mail questionnaire to discuss the internet- based interpersonal intimate relationships and emotion support. The "feeling", "manwoman" and "love" boards at NTHU were chosen to be the case study .
The results find that "virtual relationship" is most BBS-users's expansion of their social networks. The developing process of virtual relationship is similar to that of FTF relationship, including self-disclosure, sharing and understanding.The different, however, fall on nicknames, verbal interaction, image and anticipation in the BBS. In addition to the development, the constitution of virtual relationships is based upon nicknames, use of emotion, users' idiosyncrasy, BBS experiences and computer skills that are also the reasons why people need virtual relationships.
Virtual relationship, therefore, enables one to develop intimate relations and share each other's feelings. However, the interpersonal relationship under FTF remains unreplaceable. No one can do without the interaction. Even so, the "virtual context" still provides a space for the expression and sharing ones' emotions; therefore, technology progresses also promote the warmth in interpersonal relationships.

Piety, Intimacy and Mobility : A Case Study of Charismatic Christianity in Present-day StockholmMoberg, Jessica January 2013 (has links)
Stockholm County is a post-industrial Swedish region characterized by high levels of mobility and technologization as well as ethnic and religious diversity. Among its religious minorities exist various strands of charismatic Christianity, some of which originate from the Pentecostal revival of the early 20th century and some of which belong to more recent movements. The aim of this ethnographic study is to examine how affiliates of the multicultural charismatic Christian congregation New Life Church practice religiosity within the context of their personal daily lives, within the framework of the general congregation and in terms of their involvements with other religious organizations in the area of Stockholm. Beginning with the assumption that the practice of contemporary religiosity and the development of a religious identity are part of an ongoing process of habituation, the study describes how practitioners cultivate a form of charismatic piety characterized by certain embodied orientations, patterns of ritualization and narrative genres. To shed further light on this process, it draws upon a variety of theories concerning ritualization, embodiment, performance, narratives and materiality. Apart from this, the study also constitutes an attempt to explore and measure the impact on the practitioners’ religiosity of late modern developments such as urbanization, detraditionalization and global mobility as well as the growing absorption in consumerism, emotional intimacy and the unfolding of the “authentic” inner self. While pursuing these ends, the study also calls into question previous assumptions about charismatic Christianity in Sweden, most particularly the assumption that today’s practitioners remain inclined to be entirely faithful to one given institution and its system of beliefs and practices. Indeed this view is directly challenged herein by the finding that contemporary charismatics are far more inclined to eclectically appropriate elements and models of thoughts from various contexts of origin as well as to affiliate with and/or visit multiple Christian institutions.

On the Possibilities and Impossibilities of Love : Mapping the discursive field of love-relationships, its components, conflicts and challengesStrandell, Jacob January 2012 (has links)
In this thesis I reframe theories of love-relationships in late modernity (by Anthony Giddens, Zygmunt Bauman and Ulrich Beck & Elisabeth Beck-Gernsheim) in relation to a general framework of discursive theory (inspired by Michel Foucault). I suggest that current developments and contradictions in the field of love-relationships with advantage can be understood in terms of discourse and discursive conflict. Utilizing the discursive framework, I conceptualize two conflicting discursive regimes (as romantic love and individualized freedom), and their components. With these components in mind, I explore how contradicting discursive components are problematized in established risk-discourse, using cases of popular culture as illustrative reference. Risk-discourses force short-term practical solutions, and put pressure on further discursive change by inducing anxiety and cognitive dissonance. Future discourse will have to adapt to several conditions, including the (in)compatibility of discursive components, how well practical strategies work out, how social interaction is organized, and how discursive deconstruction unavoidably have consequences for the fundaments of love itself. / I uppsatsen omtolkar jag senmodernitetsteorier om kärleksrelationer (av Anthony Giddens, Zygmunt Bauman och Ulrich Beck & Elisabeth Beck-Gernsheim) till ett generellt diskursteoretiskt ramverk (inspirerat av Michel Foucualt). Uppsatsen redogör för hur samtida utvecklingar och motsättningar inom fältet kärleksrelationer med fördel kan förstås i diskursteoretiska termer. Med hjälp av detta ramverk utvecklar jag två diskursiva regimer och deras respektive komponenter (konceptualiserade som romantisk kärlek och individualiserad frihet). Med dessa komponenter i åtanke granskar jag hur konflikterande komponenter problematiseras genom etablerade riskdiskurser, med fallstudier av populärkultur som illustrativa exempel. Jag menar att att dessa riskdiskurser driver fram kortsiktiga praktiska lösningar, och orsakar ångest och kognitiv dissonans vilka motiverar ytterligare diskursiva förändringar. Kommande diskursiva förändringar måste förhålla sig till flertalet omständigheter inklusive diskurskomponenternas (in)kompabilitet, huruvida praktiska lösningar är hållbara, hur social interaktion organiseras i allmänhet och hur diskursiv dekonstruktion oundvikligen får konsekvenser för kärlekens fundament.

A study of intertextuality, intimacy and place in Barbara Adair's In Tangier we killed the blue parrot.Rossmann, Jean. January 2005 (has links)
In my thesis, I argue that Barbara Adair's In Tangier We Killed the Blue Parrot can be viewed as a palimpsest. In this sense her re-inscription of the lives and fictions of lane and Paul Bowles in the International Zone of Tangier, Morocco, in the 1940s reflects on and is implicated in the contemporary South African Zeitgeist. Through illuminating the spatial and temporal connections between the literary text and the social text, I suggest that Adair's novel creates a space for the expression of new patterns of intimacy. The Bowleses' open marriage and their same-sex relationships with local Moroccans are complicated by hegemonies of race, class and gender. To illustrate the nature of these vexed intimacies I explore Paul's sadomasochistic relationship with the young hustler, Belquassim, revealing the emancipatory nature of the expatriate's erotic and violent encounter with the Other. Conversely, I suggest the shades of Orientalism and exoticism in this relationship. While Adair is innovative in her representation of the male characters, I argue that she perpetuates racial and gendered stereotypes in her representation of the female characters in the novel. lane is re-inscribed in myths of madness and selfdestruction, while her lover, Cherifa, vilified and unknowable, is depicted as a wicked witch. This study interrogates the process of selection and representation chosen by Adair, which proceeds from her own intentionality and positionality, as a South African, as a human rights law lecturer, as a (white) woman and as a woman writer. Ce mémoire se penche sur l’évolution des stratégies d’autoreprésentation et d’autofictionnalisation dans cinq solos de Marie Brassard entre 2000 et 2011 – Jimmy, créature de rêve, La noirceur, Peepshow, L’invisible et Moi qui me parle à moi-même dans le futur. L’objectif de cette étude est d’analyser comment les masques vocaux contribuent au dévoilement de soi et produisent de ce fait un sentiment d’intimité malgré l’alternance des effets d’identification et de distanciation qu’ils suscitent. Le premier chapitre montre que, par l’ouverture du moi sur le monde au fil des créations, les protagonistes parviennent bientôt à dire « je » sans avoir la consistance d’un personnage, alors que le moi de l’archiénonciatrice se dilate grâce à la perméabilité et aux permutations continuelles des thèmes, des motifs et des personnages. Le second chapitre analyse le décloisonnement spatial qui affecte la scène et la salle comme la performeuse et ses collaborateurs dans l’établissement d’un véritable dialogisme. À partir de l’étude du corps en scène, le dernier chapitre examine les effets du décloisonnement textuel et spatial, et montre que la mise en évidence du triple rôle endossé par Brassard – auteure, actrice et agenceure scénique – oblige à reconsidérer la nature du corps qui s’offre au regard durant la représentation, en invitant le spectateur à s’investir dans le jeu scénique au-delà des évidences. / This dissertation focuses on the development of the strategies of self-representation and autofictionnalisation in five one-woman shows by Marie Brassard between 2000 and 2011 – Jimmy, creature de reve, The Darkness, Peepshow, The Invisible and Me Talking to Myself in the Future. The objective of this study is to analyze the way vocal masks contribute to self-disclosure and thereby produce a feeling of intimacy despite the alternating effects of identification and alienation they engender. The first chapter shows that by opening the “me” to the world through creations, the protagonists soon come to say “I” without having the consistency of a character, while the “me” of the archienonciator expands through continual permeability and permutations of themes, motives and characters. The second chapter analyzes the deregulation affecting the space stage and the audience as well as the performer and her collaborators in the establishment of a genuine dialogism. With the study of the body on stage as its starting point, the last chapter examines the effects of spatial and textual decompartmentalization and shows that the display of the triple role endorsed by Brassard – author, actress and scenic organizer – forces us to reconsider the nature of the body that offers itself to the audience during the performance, inviting the audience member to invest himself in stagecraft beyond what is obvious.

Les figures de l’intimité en situation de rue : une pluralité d’expériences chez les jeunes à MontréalCôté, Philippe-Benoit 05 1900 (has links)
Cette étude a pour objectif de comprendre les significations que les jeunes en situation de rue à Montréal accordent à leurs relations intimes. Si la plupart des travaux empiriques misent essentiellement sur les risques que présentent les activités sexuelles pour la santé des jeunes en situation de rue, peu d’entre eux tentent de comprendre, à partir du point de vue des jeunes eux-mêmes, le sens qu’ils donnent à leurs relations intimes. C’est à la lumière de ces travaux que cette étude propose de dépasser une lecture réductrice de l’intimité de ces jeunes en appréhendant l’articulation entre leurs expériences intimes et leurs expériences de rue.
Inspirée de la sociologie de l’expérience de Dubet (1994), cette étude s’intéresse à la construction de l’expérience intime des jeunes en situation de rue dans un rapport dynamique entre leur espace d’autonomie et les conditions sociales qui les encadrent. Ce cadre d’analyse permet de rompre avec les travaux qui présentent ces jeunes soit comme des victimes passives des conditions de vie précaires de la situation de rue, soit comme des êtres imprudents ou insouciants en matière de sexualité. S’inscrivant dans une méthodologie qualitative, des entrevues individuelles ont été réalisées auprès de trente-deux jeunes en situation de rue (18 femmes et 14 hommes) âgés de 18 à 27 ans (moyenne = 22 ans). Les témoignages de ces jeunes ont été analysés à partir d’une méthode typologique (Schnapper, 2005) qui a permis d’élaborer des types-idéaux d’expériences intimes en situation de rue, les « figures de l’intimité ».
L’analyse des témoignages a permis de dégager cinq figures de l’intimité en situation de rue: la réussite criminelle, le retrait, la survie, l’engagement et l’enfermement. Si chacune de ces figures propose des articulations singulières entre les expériences intimes et les expériences de rue des jeunes à Montréal, cette analyse permet néanmoins de soulever des recoupements théoriques entre les types-idéaux identifiés dans cette étude. Il est possible de constater que les jeunes des figures de la réussite criminelle et de l’engagement tissent une expérience intégrée de la situation de rue par la construction d’un sentiment d’appartenance à un groupe de pairs, tandis que ceux des figures du retrait et de la survie témoignent d’une expérience de rejet où la situation de rue est considérée comme disqualifiante. Également, l’analyse des témoignages illustre que les jeunes des figures du retrait et de l’engagement rapportent une subjectivation des partenaires intimes par un engagement affectif et émotionnel, tandis que ceux des figures de la réussite criminelle et de la survie décrivent une objectivation de la sexualité pour répondre à différents besoins. Cette étude met donc en lumière l’importance d’appréhender l’articulation entre les relations intimes des jeunes et le rapport qu’ils entretiennent à l’égard de la situation de rue afin de saisir la pluralité et la complexité de leurs expériences de vie. / The objective of this study is to understand how street-involved youth in Montreal experience their intimate relationships. Most studies focused on sexual health and HIV infection risks. However, little is known about the meanings they give to their intimate relationships and how they are influenced by the street life. In this study, the relationship between intimate experiences and street experiences of young street-involved people is explored.
Inspired by the sociology of experience (Dubet, 1994), this study focuses on the construction of the intimate experience of street-involved youth, assuming a dynamic relationship between their agency and the social and material conditions of the street life. This analytical framework allows us to overcome the empirical works which present these youth as passive victims of precarious living conditions or as careless and reckless when it comes to sexuality. Individual interviews were conducted with thirty-two street-involved youth (18 women and 14 men) aged from 18 to 27 years old (mean = 22 years old). The testimonies were analyzed within a qualitative typological framework (Schnapper, 2005), allowing the construction of ideal types of intimate experiences in the street life, the “figures of intimacy”.
Five figures of intimacy in the street life among young people were constructed based on the testimonies analysis: criminal success, withdrawal, survival, commitment and confinement. Each of these figures offers a unique dynamic description between intimate experiences and street experiences of the participants. The analysis shows some overlaps between the figures. Youth from the criminal success and the commitment figures build a sense of belonging to a peer group in the street situation, while youth from the withdrawal and survival figures perceived the street situation as disqualifying and try to stay away from other street-involved young people. Also, participants from the criminal success and survival figures reported a subjectivation of the intimate partner through emotional commitment. In contrast, youth in the withdrawal and the commitment figures showed a tendency to instrumentalize sexuality in order to satisfy various needs. This study illustrates the importance of understanding the dynamic between intimate relationships and the street life to capture the diversity and the complexity of the life experiences of the street-involved young people.

People spend substantial parts of their life in a close dyadic relationship. The results range from the fulfillment of emotional, intellectual, social and physical needs, to physical and emotional abuse.
The study clarifies the association between sex-role identity type, with its two traits (masculinity and femininity), and relationship satisfaction, at the dyadic level. The latter implies a focus on the identical (or different) levels of presence of the two constructs among partners in couples. Extraneous factors and personal (non-dyadic) effects are covered in addition.
The two main variables are evaluated with the Bem Sex Role Inventory (BSRI) and Spanier's Dyadic Adjustment Scale (DAS). In each case, a second instrument was administered for validation. The survey-type study followed a correlational, cross-sectional design.

The correlational design and relatively small sub-samples dictated the application of descriptive frequencies, and chi-square, variance (ANOVA) and regression analyses, as statistical techniques.
The findings emerged as more similar than different for homosexual and heterosexual participants. This implies that homosexuals are not a deviant group, but equally able to achieve happiness. Congruent (identical) sex-role identity traits between partners were not strong(est) in predicting satisfaction. However, femininity and androgyny, as highest adaptive type, and identical sex-role identity types between partners did. As a result, the initial sex-role identity congruence theory has been modified into the adaptive femininity trait theory.
Married heterosexual women face a predicament. While for them an undifferentiated sex-role identity type correlates with their husbands' happiness, and their own unhappiness, the inverse applies to their femininity and androgyny.
