Text in Afrikaans / Die sogenaamde vermoede van onskuld is via die Engelse Reg in ons reg oorgeneem en tot konstitusionele status verhoog met die daarstelling van artikel 25(3)(c) van die Grondwet, No. 200 van 1993. Hierdie reg om onskuldig geag te word en die gepaardgaande swygreg, wat hier kortliks aangeraak word, kan egter aan beperking onderhewig wees soos bepaal deur artikel 33 van die Grondwet. Die beginsels soos ontwikkel in Kanada en Amerika word ondersoek. Die slotsom waartoe geraak word is dat, alhoewel historiese en ander verskille deurgaans voor oe gehou sal moet word, die regspraak in genoemde jurisdiksies, en meer spesifiek Kanada, 'n groat rol sal speel by die inhoud wat die SuidA: frik:aanse howe, in die konteks van statutere vermoedens, aan die konstitusionele reg om onskuldig geag te word, sal gee. / The so-called presumption of innocence has been inherited from the English common law and awarded constitutional status by the introduction of section 25(3)(c) ofthe Constitution, Act 200 ofl993. This right to be presumed innocent and the accompanying right to remain silent, which is briefly touched upon, are however not absolute and can be subject to limitation as provided for by section 33 ofthe Constitution. The principles, as they have been developed in Canada and America, are investigated. The conclusion which is drawn is that, despite historical and other differences, it can be expected that foreign jurisprudence, particularly that of Canada, will play a major role in the content that will be given by the South African courts to the right to be presumed innocent in the context of statutory presumptions. / Criminal and Procedural Law / LL. This paper analyzes the strict liability system surviving in customs infringement procedures, the grounds for its existence or survival and its consequences. Also, the arguments against such system of liability attribution are examined. Thus, from such starting point, through a precise enumeration of statutory rebuttable presumptions whose intention can be presumed whenever it is difficult for Tax Authorities to prove such presumptions, I intend to find legal solutions to determine the grounds for its replacement without affecting the rights of the relevant individuals or legal entities when the customs infringements are decided. / El presente artículo aborda el estudio del régimen de responsabilidad objetiva que subsiste en materia infraccional aduanera, los fundamentos sostenidos para su existencia o pervivencia, y sus consecuencias. Asimismo, se desarrollan los argumentos contrarios a dicho régimen de imputación de la responsabilidad. Así, y partido de ello, se tratan de encontrar soluciones jurídicas que, sin vulneren los derechos de los administrados al juzgar las infracciones aduaneras, permitan resolver el fundamento de su sustitución, y ello, mediante un correcto establecimiento de presunciones legales relativas que permitan presumir la intención, cuando ella sea de difícil comprobación para el Fisco.

Criminal capacity of children

In this project the various International Instruments, namely the United Nations Convention of the Rights of the Child; 1989, the Beijing Rules and the African Charter, relating to the guidelines of the establishment of a minimum age for criminal capacity are furnished. The developments regarding the issue of criminal capacity since 1998 in Australia, the United Kingdom and Hong Kong are highlighted. The historical position and the current position in South African law with regard to the issue of criminal capacity are discussed as well as the implementation thereof by our courts. The statistics on children under 14 years in prison over the past five years are furnished. The introduction of the Child Justice Bill, 2002 by Parliament and the deliberations following the introduction, focusing on the issue of criminal capacity is highlighted. The proposed provisions of the Child Justice Bill, 49 of 2002 codifying the present common law presumptions and the raising of the minimum age for criminal capacity are furnished. The evaluation of criminal capacity and the important factors to be assessed are discussed as provided for in the Child Justice Bill, 49 of 2002. A practical illustration of a case where the criminal capacity of a child offender was considered by the court is, discussed and other important developmental factors that should also be taken into consideration by the court are identified and discussed. Important issues relating to criminal capacity, namely, time and number of assessments, testimonial competency of the child offender, evolving capacities and age determination are discussed and possible problems identified and some solutions offered. The research included an 11-question questionnaire to various professionals working in field of child justice regarding the issue of criminal capacity and the evaluation thereof. / Criminal and Procedural law / D.Litt. et Phil. Teoria e prática da substituição tributária progressiva no ICMS : uma análise do instituto após os julgamentos do recurso extraordinário nº 213396/SP e da ADIn nº1851-4/AL.

This present work analyses one of the most relevant and debated themes of tributary law nowadays, the progressive tributary substitution institute applied to the tax over merchandise circulation and services of interstate and intercity transportation as well as over communication ICMS - , and analyses it with the clear objective of offering a dogmatic description of the institute, compatible with constitutional principles and able to serve as a guide to its practical application. For this it starts by fixing the theoretical tools to be used in the referred analyses, so from this describe dogmatically the respective normative bundle (after exposing a dialectic critics of other theories about the subject), specially the 7th paragraph of article 150 of the Federal Constitution (which contains two rules, the first one authoritative of the use of absolute presumptions and the second one containing a resolutive of efficacy legal condition), opposing this exegesis to the constitutional principles of legality, juridical security, isonomy, contributive capacity, workability, non-cumulating and confiscation impediment, seeking harmonizing interpretations able to preserve the maximum effectiveness of the institute without the sacrifice of the ruling efficacy of the quoted above principles, specially of those which contain fundamental rights of the tax-payer or contain guarantees of these rights. Having done this we go to the study of the main alterations provoked in the origin-rule of tributary incidence by this special collecting technique, this in relation to the normal pattern, without progressive substitution, retaining specially in the changes in relation to the passive subjective and to the calculus base, and in the final chapter present the conclusions of this study. It is worth mentioning that all work takes jurisprudence about the theme, specially from the Superior Tribunals, as an object of research (besides the ruling bundle), in an analyses really focused to practice, which aims to contribute to the construction of a pattern which is able to Express a balance point between the objective of combating illegal withholdment and the rights and guarantees of the tax-payers. / O presente trabalho analisa um dos mais relevantes e debatidos temas do direito tributário na atualidade, o instituto da substituição tributária progressiva aplicado ao imposto sobre operações relativas à circulação de mercadorias e sobre prestações de serviços de transporte interestadual e intermunicipal e de comunicação ICMS , e o faz com o claro objetivo de oferecer uma descrição dogmática do instituto, compatível com os princípios constitucionais, e capaz de servir de guia para a aplicação prática desse. Para tanto, inicia pela fixação das ferramentas teóricas a serem usadas na referida análise, para a partir daí descrever dogmaticamente o respectivo feixe normativo (após a crítica dialética de outras teorias sobre o assunto), especialmente o § 7º do art. 150 da Constituição Federal (que contém duas normas, a primeira autorizativa do uso de presunções absolutas, a segunda contendo uma condição legal resolutiva de eficácia), contrapondo-se essa exegese aos princípios constitucionais da legalidade, segurança jurídica, isonomia, capacidade contributiva, praticidade, nãocumulatividade e vedação de confisco, buscando interpretações harmonizadoras, capazes de preservar a máxima efetividade do instituto sem sacrifício da eficácia normativa dos supracitados princípios, especialmente daqueles que encerram direitos fundamentais do contribuinte ou garantias desses direitos. Feito isso, parte-se para o estudo das principais alterações provocadas na regra-matriz de incidência tributária por essa especial técnica arrecadatória, isso com relação ao modelo normal , sem substituição progressiva, detendo-se especialmente nas modificações com relação ao sujeito passivo e à base de cálculo, para no capítulo final apresentar as conclusões do estudo. Cabe salientar ainda que todo o trabalho toma a jurisprudência acerca do tema, especialmente a dos Tribunais Superiores, como objeto de pesquisa (ao lado do feixe normativo), numa análise verdadeiramente orientada para a prática, e que visa contribuir para a construção de um modelo capaz de expressar um ponto de equilíbrio entre o objetivo de combate à sonegação e os direitos e garantias dos contribuintes.

Le thème de la protection pénale de l'accusé, connu des pénalistes, mérite aujourd'hui d'être renouvelé sous un angle essentiellement probatoire, au regard de l'évolution actuelle du procès pénal. Situés au confluent de l'innocence et de la culpabilité, les droits et garanties accordés à l'accusé, entendu dans son acception conventionnelle, doivent être analysés en considération des principes fondateurs que sont la présomption d'innocence et les droits de la défense. L'évolution continue de ces deux principes, dans un sens diamétralement opposé, rejaillit inévitablement sur l'intensité et les modalités de la protection dont bénéficie toute personne suspectée ou poursuivie dans le cadre d'une procédure pénale.La présente étude, volontairement limitée à la phase préparatoire du procès pénal, se propose d'appréhender, dans un souci pratique et technique, les différentes évolutions jurisprudentielles et législatives opérées en la matière. Y seront ainsi abordées les principales problématiques actuellement rencontrées en procédure pénale telles que la question du statut juridique du suspect ou encore l'effectivité du principe du contradictoire dans l'avant-procès pénal. S'il peut être tentant, au premier abord, de conclure à un renforcement indiscutable de la protection pénale accordée à l'accusé, il conviendra alors de reconsidérer cette question à l'aune de l'étude des limites procédurales attachées au procès pénal. Loin d'aborder ce thème dans une optique partisane, il sera question de modération dans les propos tenus. En effet, peut-être plus que sur toute autre question de procédure pénale, il est impératif de savoir raison garder. / The theme of the criminal protection of the accused, well-known to criminal specialists, today deserves to be renewed under a probationary essentially angle, in the light of current developments in the criminal trial. Located at the confluence of innocence and guilt, the rights and guarantees granted to the accused understood in its conventional sense, must be analyzed in consideration of the founding principles of presumption of innocence and the rights of the defense. The continuing evolution of these two principles, in a sense diametrically opposite, inevitably reflects the intensity and the terms of the protection afforded any person suspected or prosecuted under criminal proceedings.This study deliberately limited to the pre-trial phase, proposes to understand, in a practical and technical problems, the various case law and legislative developments carried out in the field. Will thus addressed the key issues currently faced in criminal proceedings such as the question of the legal status of the suspect or the effectiveness of the adversarial principle in the preliminary criminal trial. While it may be tempting, at first, to conclude an indisputable strengthening the criminal protection afforded to the accused, then it will be necessary to reconsider this issue in terms of the study of procedural limitations attached to the criminal trial. Far from addressing this issue in a partisan way, it will be about moderation in the remarks. Indeed, perhaps more than any other issue of criminal procedure, it is imperative to keep a sense of proportion.

Les conditions de la responsabilité en droit privé : éléments pour une théorie générale de la responsabilité juridique / The conditions of responsibility in private law : elements for a general theory of legal responsibility

Alors que l’on enseigne classiquement la distinction radicale du droit pénal et de la responsabilité civile, une étude approfondie du droit positif révèle une tendance générale et profonde à la confusion des deux disciplines. Face à ce paradoxe, le juriste s’interroge : comment articuler le droit civil et le droit pénal de la responsabilité ? Pour y répondre, cette thèse suggère d’abandonner l’approche traditionnelle de la matière, consistant à la tenir pour une simple catégorie de classement des différentes branches, civile et pénale, du droit de la responsabilité. La responsabilité juridique est présentée comme une institution autonome et générale organisant la réaction du système à la perturbation anormale de l’équilibre social. Quant au droit de la responsabilité civile et au droit criminel, ils ne sont plus conçus que comme les applications techniques de cette institution en droit positif.Sur le fondement de cette approche renouvelée et par le prisme de l’étude des conditions de la responsabilité en droit privé, la thèse propose un ordonnancement technique et rationnel du droit pénal et de la responsabilité civile susceptible de fournir les principes directeurs d’une véritable théorie générale de la responsabilité juridique. En tant qu’institution générale, celle-ci engendre à la fois un concept de responsabilité, composé des exigences de dégradation d’un intérêt juridiquement protégé, d’anormalité et de causalité juridique et qui fonde la convergence du droit pénal et du droit civil, et un système de responsabilité, qui en commande les divergences et pousse le premier vers la protection de l’intérêt général et le second vers celle des victimes. / While the radical distinction between criminal law and civil liability is classically taught, a thorough survey of positive law reveals a general and profound trend towards a confusion of these two disciplines. Faced with this paradox, the jurist wonders : how to articulate the civil and criminal laws of responsibility ? To answer this question, the thesis suggests abandoning the traditional approach of the subject, which consists in treating it as a mere category of classification of the different branches, civil and criminal, of responsibility/liability. Legal responsibility is presented as an autonomous and general institution organizing the response from the system to abnormal disturbance of social equilibrium. Civil liability law and criminal law are, as far as they are concerned, henceforth conceived as the mere technical applications of this institution in positive law.On the basis of this new approach and through the prism of the study of liability conditions in private law, the thesis proposes a technical and rational organization of criminal law and civil liability that may provide the guiding principles of a real general theory of legal responsibility. As a general institution, it gives not only a concept of responsibility, requiring degradation of a legally protected interest, abnormality and legal causation, and establishing the convergence of criminal law and civil law, but also a system of responsibility, determining the divergences of them and steering the first towards the protection of general interest and the second towards the protection of victims.
