La RDC a hérité de la Belgique d’un système tutélaire cristallisé par le décret de 1950 sur l’enfance délinquante à qui l’on a reproché une inadéquation aux réalités sociétales locales. Ce texte est, toutefois, resté en application jusqu’en 2009, année à laquelle le pays s’est afin doté d’une loi sur la protection de l’enfant (LPE). Ce nouveau texte aura le mérite d’aborder la quasi-totalité des questions juridiques relatives à l’enfant ; mais sa principale faille reste le manque de clarté, de cohérence et de vision globale. Cette loi entretient, en effet, un imbroglio juridique qui ressort tant au niveau de la criminalisation primaire que secondaire. Si son intitulé laisse croire à la continuité du modèle tutélaire, son contenu dévoile un alignement sur le code malien de protection de l’enfant de 2002 qui, sur le plan pénal, est influencé par le système français d’obédience « répressionnelle ». Pendant que certains auteurs continuent à soutenir une irresponsabilité pénale absolue du mineur, la LPE fait appel à certains concepts qui remettent en question cette approche. Ainsi, la présente étude a proposé, à partir du droit coutumier et du droit comparé (français et belge), une lecture pénale et critique de la LPE basée sur une approche systémique, cohérente et contextuelle de la situation pénale du mineur-délinquant. Elle démontre, in fine, l’autonomie du droit pénal congolais des mineurs / The Republic democratic of Congo has inherited from Belgium a guardianship children’s system crystallized by the decree of 1950 on delinquent childhood, which was criticized for being inadequate to the Congolese societal realities. However, this text remained in force until 2009, when the country adopted a juvenal protection act (JPA). This text will have the merit of addressing almost all legal issues relating to children; but its main weakness remains the lack of clarity, coherence, and global vision. This law has indeed a legal imbroglio which emerges both at the level of primary and secondary criminalization. While its title suggests the continuity of the tutelary model, its content reveals an alignment with the Malian children’s protection act of 2002, which, on the criminal level, is influenced by the French system more oriented towards repression. While some authors continue to support an absolute criminal irresponsibility of the minor, the JPA uses some concepts which contradicts this approach. Therefore, the present study has proposed a criminal and critical reading based on a systemic, coherent and contextual approach to the juvenile offender while referring to both customary and comparative law (French and Belgian). 本研究旨在檢證雙元自主性模型中自主能力與情境操弄對訊息區辨表現的範疇優勢性運作機制;並為了排除過去系列相關研究結果可能受到共同方法變異偏誤所造成的效度威脅,本研究採取訊息區辨表現作為非自陳式效標變項,重新檢證雙元自主性模型的各項主張觀點。
本文共包含兩個研究,研究一經由811位台灣北部與南部的高中職三年級學生,以班級作為單位進行團體施測,測量其個體化與關係雙元自主能力,並透過情境中強調不同適應訴求的操弄,探討雙元自主能力與情境操弄對訊息區辨表現的共同作用效果,以重複檢證雙元自主性模型中對(1)雙元自主能力可以共存,以及(2)不同自主能力各具有範疇優勢性的兩項主張觀點。研究一結果發現:個體化自主與關係自主兩種能力之間具有中度的正相關,再次支持雙元自主取向能力可以相互共存的主張觀點;但兩種自主能力彼此間仍具有可區辨的關聯效度,其中個體化自主能力主要作用於個人範疇的訊息區辨表現上,而關係自主能力主要作用於人際範疇訊息區辨表現上。另外也發現與區辨訊息範疇一致的情境操弄,相較於不一致的情境操弄或是不給予情境操弄,能強化範疇優勢性的作用效果。
為強化研究一的結果,研究二針對研究一的研究限制改善情境操弄的工具與訊息區辨作業,並以台灣北部大學生作為研究對象,其中61位雙元自主能力皆高的雙高組受試者,以及63位雙元自主能力皆低的雙低組受試者。分別邀請至實驗室進行個別的電腦施測,並透過情境脈絡中強調不同適應需求的操弄,再次探討雙元自主能力對訊息區辨表現的範疇優勢性運作機制,結果發現:首先,相對於雙低組,雙高組受試者在個人範疇與人際範疇的訊息區辨表現都比較好,重複檢證雙元自主能力對於訊息區辨的作用效果;其次,相較於不一致的情境操弄或是不給予情境操弄,與區辨訊息範疇一致的情境促發能提升個人範疇與人際範疇的訊息區辨表現。並且發現情境操弄的效果主要作用於發展出高度雙元自主能力的雙高組受試者,在雙低組受試者身上不同的情境操弄則沒有差異,不僅反映出雙元自主能力與情境操弄對訊息區辨表現的共同作用效果,並且重複地驗證雙元自主性模型中共存的理論觀點以及本研究對雙元自主性範疇優勢的運作機制推論。
本文並依據研究發現提出各項討論,論述雙元自主性模型與過去相關文獻與實徵發現的異同。像是(1)該模型採取適應能力的觀點重新詮釋自主性的多元發展取向,進行一系列的實徵研究並且獲得支持的研究結果;(2)採取情境與性格交互運作的系統觀點,說明雙元自主能力的共存與範疇優勢性動態機制;(3)透過非自陳式的訊息區辨表現杜絕共同方法變異的可能威脅,重複檢證該模型的各項理論觀點以及本研究的推論假設;(4)最後針對研究中各項不符合預期的結果提出合理解釋,並且說明未來值得繼續深入探討的相關議題。 / This article has two main goals about verifying the ideas of the Dual Autonomy Model (Yeh & Yang, 2006; Yeh, Bedford, & Yang, 2007; Yeh, Liu, Huang, & Yang, 2007). The first is testing the collective effect of dual autonomy and situational operation on message discernment to support the processing mechanism of the domain superiority hypothesis. The second is using the message discernments as performance criteria variable to prevent the common method variance bias and replicate the each hypotheses of dual autonomy. In study 1, 811 senior high school students from north and south of Taiwan as participants were asked to complete a group-survey in their classrooms. A medium correlation between individuating autonomy (IA) and relating autonomy (RA) replicates the coexistence hypothesis. It was also found a distinguishable criterion-validity confirms the domain superiority hypothesis that IA was greater associated with personal domain message discernment but RA was greater associated with interpersonal domain message discernment. This effect of domain superiority was enhanced only under the congruous situational operation condition, shows the collective effect of situation and autonomy capacity that verifies the processing mechanism of domain superiority. For strengthening the result of study 1, study 2 improves the situational operation materials and the message discernment tasks. 61 college students whose dual autonomy both are higher and 63 college students whose dual autonomy both are lower were recruited as participants for study 2 from school in north of Taiwan. They were invited to a small room separately and asked to complete all of the materials and tasks that were presented on computer. The participants with higher dual autonomy have better message discernments of both domains than the participants with lower dual autonomy, replicates the effect of dual autonomy on message discernments. The congruous situational operation produced greater message discriminations than incongruous or none situational operation. This situational effect was only significant on the participants with higher dual autonomy, shows the collective effect of situation and autonomy capacity, confirms the coexist of dual autonomy, and also verifies the processing mechanism of domain superiority. These results and limitations of these two studies, comparison with the past findings, and considerations for future research are discussed.

Giving Ignatian Exercises at ecclesial frontiersHeiding, Sven Fredrik January 2011 (has links)
The Spiritual Exercises of Ignatius of Loyola, the founder of the Jesuit order, presuppose Roman Catholicism, but are today made by many who are not Catholics. Moreover, even Roman Catholics who make Ignatian Exercises often are not spontaneously inclined to obey Roman ecclesiastical authority. Neither avoiding the ecclesial dimension nor an authoritarian ‘follow the rules!’ provides spiritual directors with adequate orientation when working with issues at Church frontiers. This dissertation in pastoral theology seeks to navigate a middle position by moving beyond the individualism and the a-historical assumptions of the existing relevant literature. The dissertation remains close to the Ignatian primary sources, in the awareness that the Ignatian tradition needs to be constantly updated and that the contemporary ecclesial frontiers are not fully foreseen in the canonical texts. The main hypothesis is that a notion is needed of a ‘pilgrim Church’ in space and time, with Christians who are related to one another in a deep and fundamental sense. The minor hypothesis is that the individual needs to be open towards and prepared to learn from the Roman Catholic Church, in order to understand and to be profoundly moved by these exercises, but not necessarily to become a Roman Catholic. Having presented and discussed various approaches in the writings of twentieth-century and recent thinkers, this thesis puts forward its own ecclesiological position informed by Charles Taylor, Hans-Georg Gadamer and Karl Rahner. The aim is to take Ignatian studies forward by combining relational anthropology, hermeneutics and a sacramental understanding of the Church, and to apply this synthesis to the practice of giving Ignatian Exercises. The final chapter discusses a selection of cases in the light of my ecclesiological position. The synthesis and application claim originality.

This thesis is concerned with the question of what religious education should aim to achieve in the public sphere, and from that comes an interest in what is it that the teacher of religious education should aim to do. My enquiry is located, theoretically as well as conceptually, in the sphere of education. It is an educational study into religious education and situated in what can be termed a ‘Continental construction’ of educational research. I identify that since the inception of religious education in public schools in England, persistent assumptions have been made about both religion and education. I show how this has led, in my view, to conceptualisations of religious education which have been, and continue to be, incomplete. The central chapters of my thesis consider first religion and then education. This allows me to introduce my theoretical base, which is especially but not exclusively drawn from the work of Simone Weil and Hannah Arendt. I develop an argument suggesting that by also understanding religion existentially as faith, rather than as only belief or practice, will open new ways of considering the role of religious education in the public sphere. This is alongside an argument I develop with Arendt for education being conceptualised as bringing the child to action rather than to reason. This thesis argues for a broader understanding of religion, and therefore what it means to live a religious life, in religious education than has previously been considered. I bring this broader way of understanding what it means to live a religious life together with my argument for conceptualising education as bringing the child to action. This enables me to make a new proposal for what religious education should aim to achieve in the public sphere.

Lançamos mão de algumas categorias de Gianni Vattimo e Andrés Torres Queiruga como aporte teórico capaz de nos possibilitar uma aproximação à teologia da revelação. Finalmente, estabeleceremos um diálogo entre estes autores e as discussões recentes sobre os lugares hermenêutico-literários de sentido, para então podermos apontar o desafio do que a cultura pós-moderna põe diante da teologia, a saber, a cooperação no discernimento da fé. Esse Último passo conduzirá a um deslocamento teórico-prático onde a teologia pode ser conduzida da condição de tuteladora doutrinária, a outra condição, de fonte de discernimento para as múltiplas vivências da fé cristã. / [en] The purpose of the present thesis is the reflection on the challenges that Contemporary culture brings to Theology of Revelation. To do so, we open the discussion with post-modernity and its purpose to enlarge rationality, in the sense of introducing experience as a valuable way of perceiving reality. We use Gianni Vattimo s and Andres Torres Queiruga s cathegories as Theoretic approaches in order to introduce the dialogue with Theology of Revelation. Then, we establish a dialogue between these authors and the recent discussions on hermeneutic-literary places of meaning, in order to point out the challenge with which post modern culture faces Theology, i/e, the cooperation in the discernment of faith. This last step will take us to a practical-theoretical dislocation where Theology may change its condition of doctrinal tuthorship to another condition of discernment as a source of multiples experiences of christian faith.

Après une intrusion chaotique dans la théorie de la responsabilité pénale, l’imputabilité peut aujourd’hui apparaître comme une donnée d’essence classique. Elle répond à une définition subjective faisant consensus en doctrine et supposant l’addition du discernement et d’une volonté libre de l’agent. Dans le prolongement, elle est unanimement entendue comme constituant le fondement de la responsabilité pénale. Cependant, la cohabitation entre les différentes conditions de la responsabilité pénale, en particulier entre les concepts de culpabilité et d’imputabilité, n’est peut-être pas aussi pacifiée qu’il n’y paraît. En réalité, la question de l’indépendance des notions n’a jamais été clairement résolue, car leurs composantes respectives participent des conditions subjectives à l’engagement de la responsabilité pénale. Pourtant, la question est loin d’être anecdotique, en particulier si l’on considère certaines institutions fondamentales du droit pénal, au rang desquelles figurent les notions d’infraction et de complicité. Il apparaît ainsi, à l’analyse, que la définition traditionnelle de l’imputabilité mérite quelques ajustements, conduisant à une reconfiguration du champ de la condition de liberté relevant de l’imputabilité. Cette recherche vise aussi à établir que l’imputabilité est une donnée étrangère à l’infraction concrètement commise. Cette place spécifique au sein de la responsabilité pénale, mettant en évidence le lien entre l’imputabilité et la sanction infligée en rétribution de l’infraction commise, permet d’adopter une vision plus large du concept, susceptible d’affronter le bouleversement consécutif à l’entrée du droit pénal dans l’ère de la post-modernité. Cette dernière, que l’on pourrait associer au néopositivisme pénal du début du siècle, s’est accompagnée d’une résurgence des concepts de risque et de dangerosité. L’impact de cette évolution sur l’imputabilité peut apparaître radical : rupture du caractère unitaire de la notion, émergence du concept d’imputation à l’égard des personnes morales, voire même effacement pur et simple de l’imputabilité à l’égard des personnes physiques. Pourtant, des modalités de restauration de l’exigence d’imputabilité seront envisagées sur les terrains substantiel, par le truchement de l’imputabilité comprise comme capacité pénale, et processuel – par des propositions concernant les procédures pensées en considération de la psychologie de l’agent. Au bout du compte, il apparaît que l’imputabilité est de nature à jouer un rôle décisif dans l’organisation d’une cohabitation raisonnée avec le concept de dangerosité, en condamnant la prise en compte de la dangerosité seulement hypothétique sans exclure la possibilité d’une rétention après la peine. / After a chaotic intrusion in the theory of penal liability, imputability can today appear as a classical notion. The general doctrinal consensus is that it depends on a subjective definition, implying the offender’s discernment and free will. Moreover, the notion of imputability is unanimously considered as the basis of penal liability. However, cohabitation between the various conditions of penal liability, particularly between the concepts of guilt and imputability, may not be as steady as it seems. Indeed, the independence of these notions has actually never been clearly demonstrated, for their respective components represent the subjective conditions creating penal liability. Nevertheless, this topic is far from being anecdotal, specifically among several fundamental institutions of criminal Law, in which the notions of infraction and complicity are involved. Thus, the definition of imputability may deserve some adjustments, and imply, consequently, a reworking of the release condition coming under imputability. This study also aims at proving that imputability is an irrelevant element to the concretely committed offence. This specific part in penal liability, highlighting the link between imputability and the penalty imposed in response to the committed offence, enables a wider vision of the concept that could help facing the upheaval resulting from the entry of criminal Law in the post-modernity era. The latter, that one could associate with the beginning of the century’s penal neopositivism, also implied the resurgence of the concepts of risk and dangerousness. The impact of this evolution about imputability may seem radical : end of the unitary aspect of the notion, emergence of the concept of imputation towards legal entities, and even total erasure of imputability towards natural persons. And yet, some solutions to the reconstitution of the exigence of imputability will be developed, not only in a substantial approach, where imputability will be understood as penal capacity, but also in a procedural approach – thanks to suggestions of procedures taking the offender’s psyche into account. In the end, imputability seems to play a major part in the organization of a balanced cohabitation with the concept of dangerousness, by condemning a strictly hypothetical consideration of dangerousness, without excluding a potential reservation after the penalty.

L’aptitude à la sanction ou capacité pénitentiaire joue un rôle plus original puisqu’elle apparaît comme le fondement de la personnalisation de la peine, permettant d’adapter la sanction pénale à la personnalité et aux besoins de celui qui doit la subir. / Originally defined as the capacity to be punished, criminal capacity can be understood more widely as summarizing mental abilities that are required for criminal responsibility. Some are needed to commit the offense, others for criminal responsibility but both ensure the moral meaning of criminal law. Applied to the penalty, criminal capacity can be used to adapt the sentence to the personality and needs of those who must endure it.

Shakespeare and soteriology: crossing the Reformation divideAnonby, David 07 December 2020 (has links)
My dissertation explores Shakespeare’s negotiation of Reformation controversy about theories of salvation. While twentieth century literary criticism tended to regard Shakespeare as a harbinger of secularism, the so-called “turn to religion” in early modern studies has given renewed attention to the religious elements in Shakespeare and his contemporaries. Yet in spite of the current popularity of early modern religion studies, there remains an aura of uncertainty regarding some of the doctrinal or liturgical specificities of the period. This historical gap is especially felt with respect to theories of salvation, or soteriology. Such ambiguity, however, calls for further inquiry into historical theology. As one of the “hot-button” issues of the Reformation, salvation was fiercely contested in Shakespeare’s day, making it essential for scholarship to differentiate between conformist (Church of England), godly (puritan), and recusant (Catholic) strains of soteriology in Shakespearean plays. I explore how the language and concepts of faith, grace, charity, the sacraments, election, free will, justification, sanctification, and atonement find expression in Shakespeare’s plays. In doing so, I contribute to the recovery of a greater understanding of the relationship between early modern religion and Shakespearean drama. While I share Kastan’s reluctance to attribute particular religious convictions to Shakespeare (A Will to Believe 143), in some cases such critical guardedness has diverted attention from the religious topography of Shakespeare’s plays.
My first chapter explores the tension in The Merchant of Venice between Protestant notions of justification by faith and a Catholic insistence upon works of mercy. The infamous trial scene, in particular, deconstructs cherished Protestant ideology by refuting the efficacy of faith when it is divorced from ethical behaviour. The second chapter situates Hamlet in the stream of Lancelot Andrewes’s “avant-garde conformity” (to use Peter Lake’s coinage), thereby explaining why Claudius’s prayer in the definitive text of the second quarto has intimations of soteriological agency that are lacking in the first quarto. The third chapter argues that Hamlet undermines the ghost’s association of violence and religion, thus implicitly critiquing the proliferation of religious violence on both sides of the Reformation divide. The fourth chapter argues that Calvin’s theory of the vicarious atonement of Christ, expounded so eloquently by Isabella in Measure for Measure, meets substantial resistance, especially when the Duke and others attempt to apply the soteriological principle of substitution to the domains of sexuality and law. The ethical failures that result from an over-realized soteriology indicate that the play corroborates Luther’s idea that a distinction must be maintained between the sacred and secular realms. The fifth chapter examines controversies in the English church about the (il)legitimacy of exorcising demons, a practice favoured by Jesuits but generally frowned upon by Calvinists. Shakespeare cleverly negotiates satirical source material by metaphorizing exorcisms in King Lear in a way that seems to acknowledge Calvinist scepticism, yet honour Jesuit compassion. Throughout this study, my hermeneutic is to read Shakespeare through the lens of contemporary theological controversy and to read contemporary theology through the lens of Shakespeare. / Graduate / 2023-11-20

Alors que l’on enseigne classiquement la distinction radicale du droit pénal et de la responsabilité civile, une étude approfondie du droit positif révèle une tendance générale et profonde à la confusion des deux disciplines. Face à ce paradoxe, le juriste s’interroge : comment articuler le droit civil et le droit pénal de la responsabilité ? Pour y répondre, cette thèse suggère d’abandonner l’approche traditionnelle de la matière, consistant à la tenir pour une simple catégorie de classement des différentes branches, civile et pénale, du droit de la responsabilité. La responsabilité juridique est présentée comme une institution autonome et générale organisant la réaction du système à la perturbation anormale de l’équilibre social. Quant au droit de la responsabilité civile et au droit criminel, ils ne sont plus conçus que comme les applications techniques de cette institution en droit positif.Sur le fondement de cette approche renouvelée et par le prisme de l’étude des conditions de la responsabilité en droit privé, la thèse propose un ordonnancement technique et rationnel du droit pénal et de la responsabilité civile susceptible de fournir les principes directeurs d’une véritable théorie générale de la responsabilité juridique. En tant qu’institution générale, celle-ci engendre à la fois un concept de responsabilité, composé des exigences de dégradation d’un intérêt juridiquement protégé, d’anormalité et de causalité juridique et qui fonde la convergence du droit pénal et du droit civil, et un système de responsabilité, qui en commande les divergences et pousse le premier vers la protection de l’intérêt général et le second vers celle des victimes. / While the radical distinction between criminal law and civil liability is classically taught, a thorough survey of positive law reveals a general and profound trend towards a confusion of these two disciplines. Faced with this paradox, the jurist wonders : how to articulate the civil and criminal laws of responsibility ? To answer this question, the thesis suggests abandoning the traditional approach of the subject, which consists in treating it as a mere category of classification of the different branches, civil and criminal, of responsibility/liability. Legal responsibility is presented as an autonomous and general institution organizing the response from the system to abnormal disturbance of social equilibrium. Civil liability law and criminal law are, as far as they are concerned, henceforth conceived as the mere technical applications of this institution in positive law.On the basis of this new approach and through the prism of the study of liability conditions in private law, the thesis proposes a technical and rational organization of criminal law and civil liability that may provide the guiding principles of a real general theory of legal responsibility. As a general institution, it gives not only a concept of responsibility, requiring degradation of a legally protected interest, abnormality and legal causation, and establishing the convergence of criminal law and civil law, but also a system of responsibility, determining the divergences of them and steering the first towards the protection of general interest and the second towards the protection of victims.
